    Ogah: I’m not desperate to be Abia governor

    A People’s Democratic Party (PDP) governorship aspirant in Abia State, Dr Uche Ogah, Wednesday said his demand to be sworn in as governor was not borne out of desperation.

    He said contrary to impression being created, his case against Governor Okezie Ikpeazu was far from being an ambush.

    According to him, his victory at the court is valid and not “a hurriedly executed legal ambush for the acquisition of political power as being insinuated by some persons.”

    “My case is strongly anchored on facts, and the refusal of Ikpeazu to respond to the core issues and his resort to propaganda speaks volumes,” Ogah said.

    At a briefing in Lagos through his counsel Mr Monday Ubani, Ogah said his case predated Ikpeazu’s swearing in as governor and had reached the Supreme Court before returning to the lower court.

    Ogah said his claim was that Ikpeazu was not eligible to participate in the primaries on the basis that he failed to pay his taxes as and when due as required by the 1999 Constitution, PDP’s Guidelines, and the Electoral Act of 2010. He said on the face of it, Ikpeazu’s tax clearance was questionable.

    The Tax Clearance form (Code PD002/G), dated November 4, 2014, and sworn to at the High Court Registry, Aba, shows that Ikpeazu’s tax receipt number for December 2011 is 0012849; that of December 2012 is 0012846 and that of December 2013 is 0012847 and 0012848.

    “Did he use one booklet to pay tax for three years? Is he the only one paying tax? How come the tax number which ends in 49 came first rather than last?,” Ubani asked.

    He said Ogah went to court soon after the primaries because the PDP’s appeal panel failed to respond to his complaints about Ikpeazu’s alleged non-qualification.

    When he filed the suit in 2014, Ikpeazu challenged the court’s jurisdiction. The appeal process got to the Court of Appeal until it was decided by the Supreme Court which ruled that the Federal High Court had jurisdiction to hear the case.

    The first judge handling the case, Justice Adeniyi Ademola, withdrew from the case on the basis that he was accused of bias and returned the file to the Chief Judge. The matter was re-assigned to Justice Okon Abang.

    “If Ikpeazu is convinced about the rightness of his cause, he should vacate the seat, plead his case in a court of law and when granted victory come back rather than resort to propaganda,” Ubani said.

    According to him, the Independent National Electoral Commission (INEC) should not be blamed for issuing Ogah with a certificate of return because the court ordered that it should be with immediate effect.

    Besides, there was no order to the contrary brought to INEC’s notice. “We got an enrolment order which INEC complied with,” Ubani said.

    The lawyer said legal steps would be taken to discharge the restraining order made by an Osisioma High Court stopping Ogah’s inauguration.

    “We have to vacate the order lawfully even though the judge who made the order did not indicate a return date,” Ubani said.

    On why Ogah should be sworn in, the lawyer said an appeal does not operate as a stay of execution in pre-election matters, adding that it is “absurd” for a court of coordinate jurisdiction to arrest an order made by another court.

    “The Inspector-General of Police and the Attorney-General of the Federation should have ensured compliance with Justice Abang’s order in the absence of any contrary order, because the judgement says ‘with immediate effect’, and an appeal does not mean a stay of execution because it is not a criminal case,” Ubani said.

    He said Ogah would not take the laws into his hands but would pursue his case to the logical conclusion through the courts, adding that he was not desperate to be governor.

    Ubani said Ogah, an oil magnate, entrepreneur, investor and President of Master Energy Group, a conglomerate with over 15 subsidiaries and interests across a variety of industries with over 40,000 employees, “is not in the race for the money”.

    “He sees involvement in politics as an opportunity to have more solid and sustainable impact on Abia,” he added.

    The Governor of Abia State, Dr Okezie Ikpeazu has called on Abians not to panic, but remain calm over the judgment of Justice Okon Abang of the Federal High Court Abuja delivered today in favor of Mr. Uche Oga against him, in the case of alleged falsification of tax receipts.
    In a release by his chief Press Secretary, Enyinnaya Appolos, Governor Ikpeazu, who said that he has faith in the judiciary and the rule of law, added that he will appeal the ruling as he has instructed his lawyers to file an appeal immediately against the said judgment.
    The Governor noted as an appointee of the Abia State Government from 2011 to 2014, when he served as the General Manager, Abia State Passengers Integrated Manifest and Safety Scheme (ASPIMSS), and first Deputy General Manager, Abia State Environmental Protection Agency (ASEPA) Aba and Environs respectively, before his resignation in October 2014 to contest the Governorship election in the state, that within the period  his taxes were deducted at source, and when he had need of his tax clearance in 2014, he applied to the Abia State Board of Internal Revenue, and was duly issued with his tax receipts for the period in question.
    He maintained that he remains the Governor of the state, according to the law and will await the final determination of the matter by the appellate courts.

    Senior Special Adviser on Arts and Tourism to Governor Okezie Ikpeazu of Abia State.

    Dauda, a Mass Communication graduate of Federal Polytechnic Oko, Anambra State, hails from Obingwa Local
    Government Area of Abia State.

    Speaking after a meeting with Governor Ikpeazu at the Abia State Governor’s Lodge in Aba, the Comic-Actor said his
    appointment is a call to service.

    His words: “This administration in Abia State under Governor Ikpeazu is condemned to repositioning the state, and I have just been called to join the team to help the Governor to interpret his dreams for the state.

    “It is a call to service, and I will give my best. Those of us whobstarted what is known as Nollywood and entertainment in Nigeria today know that Aba played a major role in production, promotion and marketing of our works, but suddenly and somehow, Aba was no longer in the picture, but Governor Ikpeazu is poised to reverse the trend and we are here to
    support him and make it work.

    “I thank the Governor for the opportunity to serve and I promise to mobilize and galvanize my brothers and sisters in the entertainment industry to return Aba and Abia in general to its pride of place as far as tourism and arts are concerned,” Dauda said.

  • Ikpeazu, Orji task children on education, commitment

    Governor Okezie Ikpeazu of Abia State has challenged children to study hard and equip themselves and prepare properly to take hold of the future as leaders of the next generation.

    The Abia governor in his message to children advised Abia children to shun all forms of vices and negative influences and focus their energy towards becoming great ambassadors of the state and illustrious sons and daughters of their community.

    Ikpeazu warned that parents and the educational institutions that mentor children will be failing in their responsibility if they do not focus attention on developing children that will have the capacity to right the wrongs of the past and change the world.

    In a related development, the immediate past governor of Abia State, Senator Theodore Ahamefule Orji, has reaffirmed his commitment towards the wellbeing of the Nigerian children and also pledged to continue to invest in their future.

    Orji’s pledge was contained in a press statement to mark this year’s Children’s Day celebration, signed by his Media Adviser, Mr. Don Norman Obinna, and made available to newsmen in Umuahia.

    Orji who is the senator representing Abia Central said, “As future leaders whose shoulders lay the greatness of our country Nigeria, we shall not relent but strive to initiate actions that will benefit and promote children’s welfare, mutual exchange and understanding and the way we can achieve these is by exposing the children to modern education.

    A nation reproduces its species by investing in the future of her children through education and the only way I know that a child can become a human being is through socialization and socialization in this contemporary age is done through the exposure of the child to the modern educational system.”

    He maintained that education is the pivot with which development activities revolve and enjoined parents not to encourage hawking among their underage children but to endeavor to send them to school as that remains the best legacy they will give to them.

    He urged both federal and state governments to ensure the proper implementation of the 6-3-3-4 educational system which provides students in senior secondary class opportunity for vocational studies.

    Orji said by ensuring the full implementation of the system, it will help to reduce the alarming rate of unemployment in Nigeria as students will graduate to become employers of labour rather than remain unemployed after graduation.

    The former Abia governor said his concern for the future leaders of the country made him to introduce a scholarship scheme that will produce 240 graduates as well as empowerment programmes.

    He added that the programme has seen the donation of various vocational items to thousands of young people and school leavers in his constituency, Abia Central Senatorial District, in his 365 days in the Red Chambers of the National Assembly.

    Why we upheld Ikpeazu’s election – Supreme Court

    The Supreme Court on Friday held that Okezie Ikpeazu was returned as governor of Abia because Alex Otti failed to prove the allegations brought against his victory in the April 11, 2015 governorship election.

    The News Agency of Nigeria (NAN) reports that Ikpeazu and Otti contested the election on the platforms of the Peoples Democratic Party (PDP) and All Progressives Grand Alliance (APGA) respectively.

    Giving reasons for its Feb. 3 judgment, Justice Suleiman Galadima held that Otti and the APC were unable to prove the issue of over voting, allegations of violence and corrupt practices allegedly perpetrated by the respondents.

    “On the issue of over voting, the court holds that there was no sufficient proof as the voter register and the card reader report were not tendered.

    “The criminal allegation of corrupt malpractices carried out by PDP loyalists for the benefit of the governor was not also proved,’’ he held.

    On the cancellation of the election results in Obingwa, Osisioma Ngwa and Isiala Ngwa by the returning officers, Galadima held that it was wrong.

    “That action amounted to the disenfranchisement of voters. It was also inappropriate for the tribunal to order the cancellation of election.

    “All of this misappropriation only gave room for the unlawful declaration of the APGA candidate by the lower court.

    “Those actions were perversion of justice and the apex court could not have allowed them,’’ he said.

    Galadima further held that the evidence placed before the court showed clearly that the tribunal usurped the constitutional duties of INEC.

    “On the card reader, the court maintains its earlier position that the tribunal cannot supplant the voter register.

    “The gadget is only meant to authenticate bearers of voter card and not meant to usurp the statutory power of the voter register.

    “At the moment, the voter register remains the only authentic document as provided by Section 49 of the Electoral Act to prove allegation of fraud in elections,’’ Galadima declared.
