  • RMAFC commends FG on review of Production Sharing Contracts

The Revenue Mobilization Allocation and Fiscal Commission ( RMAFC ) has commended the Federal Government on the approval given by President Muhammadu Buhari to the Nigerian National Petroleum Corporation ( NNPC ) to enable it undertake a review of all Production Sharing Contracts ( PSCs ) between it and its various partners to reflect the current realities in the industry.

In a press statement signed by Mr. Ibrahim Mohammed, RMAFC’s Spokesperson, the Commission recalled that it had earlier thrown its weight behind the proposed review of the PSCs approved by the Federal Executive Council ( FEC ) at its meeting held on Wednesday, 13th December, 2017.

The statement quoted the RMAFC Acting Chairman, Shettima Umar Abba Gana stressing that “the Commission viewed the move by the FG as a welcome development and commendable as the Commission, that has the constitutional responsibility of monitoring revenue accruals into and disbursement of revenue from the Federation Account had been consistently calling for the review of these contracts for the past seven (7) years adding that these contracts had not been reviewed nine (9) years after both conditions stipulated in the relevant provision of the Act have elapsed, thereby leading to the huge revenue loss of about $21 billion by the Country in the last 20 years”.

It would be recalled that the Minister of State for Petroleum,  Dr. Ibe Kachikwu, recently announced that the government had approved steps to amend Section 17 of the Deep Offshore and Inland basin Production Sharing Contracts Act, 1999 which specifically provides that the 1993 PSCs should be reviewed once the price of crude oil exceeds $20 a barrel or fifteen (15) years after the contracts i.e. 2008.  To this end, the Commission advised that Government should take appropriate steps to ensure the review of these agreements with due diligence.

Similarly, RMAFC recalls that in April, 2016, it drew the attention of Government to the fact that three (3) main contract types namely Joint Venture, Production Sharing and Service Contracts were in use in the Nigerian Oil and Gas Industry.  Having carefully examined the fiscal terms of each contract and the associated revenue inflow into the Federation Account therefrom, the Commission lamented that the PSCs as represented by the 1993 PSC’s which should have been renegotiated as far back as 2008 has yet to be done, thus causing the Federation Revenue losses due to the unfavourable terms of the contracts.

RMAFC further advised the Federal Government to restore production in Joint Venture Contract to previous level of approximately 108 million barrel per day and also requested OPEC to increase Nigeria’s quota because of the country’s population.
“It should be noted that the JVC makes the highest contribution to the Federation Account compared to other revenue streams,” the statement said.

Mohammed denied the allegations, but said he too was no longer interested in the marriage.

He, however, did not object to the wife’s request for a divorce.

He accused his wife of not taking good care of his children as well as starving him of sex.

In his ruling, the judge, Mr. Ahmed Bima, adjourned the case until June 8 for the dissolution of the marriage and to look into the counter-claims of the husband.

  • Only NASS Service Commission can explain N13.5m running cost of Senators – RMAFC

The Revenue Mobilisation Allocation and Fiscal Commission ( RMAFC ), says only the management of the National Assembly Service Commission can explain the N13.5 million running cost allegedly being enjoyed by each Senator. Mr Ibrahim Mohammed, the Head, Public Relations, said this in a statement on Wednesday in Abuja.

According to him, the Remuneration Act only covers salary and allowances but not running cost.

He said that the clarification became imperative in view of the recent revelation by Sen. Shehu Sani (Kaduna Central-APC), who was reported to have disclosed to the public that each senator collects monthly running cost of N13.5 million.

Sani had said that this was in addition to the monthly salary of N750, 000 prescribed by the “Certain Political, Public and Judicial Office Holders (Salaries and Allowances, etc.) (Amendments) Act 2008.”

Mohammed said that a closer look at the monthly entitlement of senators reveals that each of them collects salary and allowances of the sum of N1.06 million.

He said that the figure consists of the following: Basic-N168,866, motor vehicle fueling and maintenance allowance; N126,650, Personal Assistant N42,216.

    “Domestic Staff-N126,650, Entertainment-N50,660,Utilities-N50,660, Newspapers/Periodicals-N25,330, Wardrobe -N42,216, House Maintenance –N8,443 and Constituency-N422,166 respectively.”

He also said that some allowances were regular, while others were non-regular.“Regular allowances are paid regularly with basic salaries, while non-regular allowances are paid when due.

“For instance, furniture allowance of N6.079 million and severance gratuity of N6.079 million are paid once every tenure, while motor vehicle loan of N8.1 million is optional which the beneficiary has to offset before leaving office.

“The payment of running cost is not part of RMAFC mandate, therefore, only the National Assembly can explain it,” he said.
According to Mohammed, the Law on Salaries and Allowances of Public Office Holders is very clear.

Mohammed also said that auditing does not fall within the purview of the commission.

He said that any other payments being enjoyed by any political or public office holder outside those provided in the Remuneration Act of 2008 were not known to the commission.

He added that the Chief Accounting Officers of the agencies concerned should explain such payments.

Mohammed advised that Nigerians should avoid misinformation and misrepresentation of facts capable of misleading citizens and members of the international community.

He said that they could access the actual details of the present remuneration package for Political, Public and Judicial Office holders in Nigeria published on its website: www.rmafc.gov.ng.

When contacted, the Chief Medical Director of the hospital, Prof. Lawal Khalid said the management had made arrangement for Consultants and

“Our accident and emergency unit is functional to take care of emergency cases and some consultants and house officers are also engaged in the provision of skeletal services to our patients.

“Even today our clinic had provided services and it will continue, because we will not allow things to be completely paralysed,” he assured.
