A’court acquits Lagos doctor jailed for raping wife’s niece

The Court of Appeal sitting in Lagos has discharged and acquitted the Medical Director of Optimal Cancer Care Foundation, Dr Olufemi Olaleye, of defilement of his wife’s niece.

Dr Olaleye was accused of raping his wife’s teenage niece and was sentenced to life imprisonment by an Ikeja Sexual Offences and Domestic Violence Court.

The trial judge at the lower court had found the case presented by the prosecution as compelling.

Olaleye had appealed his conviction by the lower court seeking an order of the appellate court to quash his conviction and life sentence for defilement and sexual assault by penetration of a minor.

Delivering judgment in the matter yesterday, the court of appeal determined all five issues of appeal against the prosecution in favour of the appellant.

Justice Jimi Bada of the Court of Appeal, Lagos Division, who read the lead judgment of the three-man panel, held that the trial court erred in convicting Dr Olaleye based on “tainted” and “unreliable” evidence of his estranged wife, Oluremi, and the alleged survivor (names withheld).

Justice Bada said there were material contradictions in the evidence gathered by the prosecution, which shouldn’t have been relied on by the lower court.

The appellate court faulted the evidences of the prosecution during trial, which it noted were from a child forensic specialist, a medical doctor from the Mirabel centre and the investigating officer.

The appellate court held that the evidences against the appellant were found to be “worthless”.

The appellate court held that the trial judge at the lower court descended in the arena and interfered in the proceedings to bridge the yawning gaps in the prosecution’s case.

The Court of Appeal also queried the prosecution’s failure to present material witnesses such as two family members who witnessed the appellant’s alleged confession.

Justice Bada said that a trial-within-trial ought to have been conducted during trial to verify the voluntariness of the appellant’s confessional statements while in police custody.

The appellate court held that the confessional statement of Dr Olaleye was made under duress after he had been detained for six days.

The appellate court therefore quashed the conviction of Dr Olaleye and discharged and acquitted him of all charges brought against him at the lower court.

The lead judgment read by Bada was adopted by the two other justices, Mohammad Sirajo and Folasade Ojo.

“This serial paedophile, a headteacher, who is expected to teach his students morals, stooped so low and defiled the underage girls, what a shame!

“Continuous education and awareness of this issue of sexual menace must be at the  forefront of all stakeholders in the administration of justice so as to advocate for the rights of young children.

“The defendant, having been found guilty of the two counts bordering on defilement, is hereby  sentenced to life imprisonment on each of the counts.

“The sentencing, will however, run  concurrently and his name be registered in the sex offences register as maintained by Lagos State,” the judge ordered.

During the trial, the state ounsels, led  by Olusola Soneye, called three witnesses while the defence counsel called four.

  • UK-based Nigerian nurse jailed for death of 10-week-old son

UK-based Nigerian nurse jailed for death of 10-week-old son

Ruth Auta, a Nigerian working as a nurse in the United Kingdom (UK), has been sentenced to three years in prison over the death of her 10-week-old son, Joshua Akerele.

The 28-year-old single mother reportedly left Joshua alone in her nurse’s accommodation for eight hours on December 20, 2022 to complete her shift.

On returning, she discovered her son lifeless in his cot and immediately called 999, reporting that he was not breathing.

The infant died an hour after the ambulance arrived despite resuscitation efforts. Tests revealed that he might have overheated due to excessive layers of clothing and bedding.

The single mother initially told the police that she had collected Joshua from a childminder after she finished work. She took him back home, fed him, placed him on her bed and then fell asleep next to him.

She claimed that when she woke up, she found him unresponsive.

However, Auta was later charged after police found CCTV of her leaving and entering her accommodation without Joshua on the day of the incident

Also, officers discovered incriminating texts. She had urged her childminder to say she was looking after Joshua that day.

But the childminder told officers she had not seen the infant for a number of days.

Auta was charged with cruelty to a child and pleaded guilty at Manchester Magistrates’ court on May 24, 2024. Her case was adjourned by a month for sentence.

On June 6, while attempting to board a flight to Nigeria, she was apprehended at Gatwick Airport with a one-way ticket.

Sara Davie, from the Crown Prosecution Service, said: “Whilst she went to work to provide care for other people, Ruth Auta left the very person who needed her care the most home alone.”

Although no conclusive cause of death could be given for Joshua, the court heard he may have overheated due to the layers of clothing and bedding he was wrapped in.

Davie said that, as a nurse, Auta should have known the dangers of leaving her baby unattended and “must now live with the consequences of the terrible decision she made that day”.

“Our thoughts and sympathies are with all those who have been affected by Joshua’s death,” Davie added.
