PDP chair: Lagos chapter endorses Bode George

The Lagos State Chapter of the PDP on Sunday night endorsed Chief Olabode George as their preferred candidate for the National Chairmanship position during the forthcoming  December 9 National Convention of the party.

Dr Moshood Salvador, the State Chairman of PDP, gave the certification at a feedback meeting between George and members of the party, held at the party’s secretariat in GRA, Ikeja.

Reports say that George had been on campaign in the Southern states of the country to seek support for votes ahead of the National Convention.

There are about eight aspirants jostling for the National chairmanship seat of the party from the south.

They include: the former Governor of Ogun State, Chief Gbenga Daniel, former Minister of Education, Prof. Tunde Adeniran.

Others are: the former Minister of Youth Development, Prof. Taoheed Adedoja and former Lagos State PDP governorship candidate, Mr Jimi Agbaje, Prince Uche Secondus, a former acting National Chairman of PDP, and Chief Raymond Dokpesi.

Salvador said: “ On behalf of Lagos PDP, we must vote for Chief Bode George come December 9;  the South west is the rightful region to have the chairman of our great party.

“In the last dispensation, Ekiti produced the Vice- Chairman while Osun and Oyo states took the highest office. It is only Lagos that is left and what we want is the chairman.

“The South-east and the South-south have produced a chairman before that is why it is our turn to have the chairman of PDP,’’ he said.

Earlier, George assured members that if given the opportunity to serve, he would re-establish the culture and tradition put in place by the founding fathers of  the PDP.

“If I am given the opportunity, I will not be new to the management of this party because the party’s constitution is not going to be new to me; I know its provisions as I know the back of my hand.

“We grew up with the party and the founding fathers handed over the culture of the party to us and that is what we would re-establish.

“Just check out, from the end of our convention to the national election is a very short time, it is not a time where you can do experimentation, it is not a time you can bring a green horn to be the chairman of the party.

“If you are desirous that you want to win that election, on that day before you cast your votes search your consciences and think very carefully.

“Secondly, it is not a matter of life and death, if I don’t believe that I have anything to offer, I will not be here.

“I will not compromise on things that are not right and are not in the constitution.

“ I will do things the way they should be done and everybody will be happy. That was how our founding fathers were moving the party forward ,’’ George said.

PDP chairman aspirants to sign peace accord – Dokpesi

Chief Raymond Dokpesi, the one of the Peoples Democratic Party ( PDP ) National Chairmanship aspirants, has said that all the eight chairmanship aspirants would sign a peace accord as part of their commitment toward successful convention.

Dokpesi, the founder of Daar Communications, disclosed this in an interview with newsmen after the PDP Governors Forum met with all aspirants in Enugu, which ended at early hour of Monday.

Dokpesi disclosed that all the aspirants had agreed to sign the peace accord at the party’s national secretariat, Wadata Plaza, Abuja, by 4 p.m.

He described the move as part of efforts by the aspirants to ensure that the party comes out of the convention  stronger and united.

“With that accord being signed we are going to look forward to a very peaceful and harmonious convention.”

Asked if the issue of zoning came up at the meeting of the forum with the aspirants, Dokpesi said the party was explicit enough on the issue of zoning.

He said that while the party’s presidential ticket was zoned to the North, the position of chairman’s was zone to the South, without specific reference to  states or geopolitical region.

He said that the candidates had agreed to work together

“After the zoning principle, all the aspirants have agreed to work together to come up with a common position. Anybody can contest.

“If the party in its wisdom and the aspirants agreed within themselves and notify the party early enough that would be fine.”

Also asked if the issue of a consensus  candidate was deliberated at the meeting Dokpesi said “no, but that did not mean there were no discussion among the aspirants.

“Today on the way forward, a few of the aspirants met in the morning and in the afternoon and discussed which solution can be adopted.”

Dokpesi added that following the meeting  he would go ahead with his campaign and consultation to fulfill his ambition.

The Governor of Ekiti and Chairman of the Forum, Mr Ayodele Fayose, said that the party national convention, schedule for Dec. 9, would be a world class  that other political parties would emulate.

Fayose said that the party had work hard and it has all it takes to win the Saturday Anambra Governorship election.

“We are using this opportunity to demand that the election should be credible. It should not only be credible but seen to be credible.

“We want to believe that Nigeria is of age to organise election that is acceptable at home and internationally, on Nov. 18 in Anambra,” Fayose added

In attendance were the Chairman of the party’s National Caretaker Committee, Sen. Ahmed Makarfi, all the PDP governors, except Ebonyi represented by his deputy.

Other aspirants at the meeting were Chief Bode George, Gbenga Daniel, Prince Uche Secondus, Prof. Tunde Adeniran, Jimi Agbaje, Taoheed Adedoja and Rashid Ladoja.

I will emerge new PDP chairman – Agbaje

A former Peoples Democratic Party (PDP) governorship candidate in Lagos, Mr. Jimi Agbaje, has declared that he will secure the party’s national chairmanship position at the August 17 convention slated for Port Harcourt, Rivers State.

Agbaje, who made the declaration shortly after he collected his nomination papers in Abuja, Tuesday, said, “I will not be contesting if I know I will not win.”

The aspirant said he is not intimidated by the presence of political old horses in the race, saying the field is open to everyone that believes they can win.

He said with him as chairman, the PDP will get a new lease of life.

“We are going to get back the power we lost at the centre and all the states we lost come 2019. Of course we made mistakes in the past and the time has come for us to correct the mistakes”, he stated.

Agbaje added that the job of reconciling aggrieved party chieftains and members across the country would be easier under his leadership, pointing out that he does not belong to any faction.

He promised to run an all-inclusive administration that will bring members under the same umbrella, adding that the party must be united to enable it play the role of viable opposition.

Agbaje ruled out consensus arrangement in the contest, saying consensus is always very difficult to achieve.

The position has been zoned to Lagos and Ogun States.

“I believe the field should be open for all interested aspirants to contest. You can even decide to run against the tide if the position is not zoned to your area. You have the right to test your popularity at the convention ground,” he stated.

  • Appeal Court upholds Ambode’s election

    Appeal Court upholds Ambode’s election

The Court of Appeal, Lagos Division, on Wednesday held that Akinwumni Ambode was validly elected as the governor of Lagos State on April 11.

It dismissed the appeal filed by his challenger, Jimi Agbaje of the Peoples Democratic Party (PDP), and awarded cost against him.

The appellate court affirmed the verdict of the Lagos State Governorship Election Petition Tribunal which, on July 1, upheld Ambode’s victory.

The three-man tribunal, led by Justice Muhammad Sirajo, struck out Agbaje’s petition seeking to nullify Ambode’s declaration as winner.

Ambode, of the All Progressives Congress (APC), polled 811,994 votes against Agbaje’s 659,788.

Justice Sirajo said the petition by Agbaje and the PDP were defective because they failed to pray for the conduct of a fresh election.

The Appeal Court, after dismissing Agbaje’s appeal on the ground that it is “incompetent”, ordered him to pay compensation cost of N50,000 to each of the respondents.

Ambode, APC, the Independent National Electoral Commission (INEC) and the Resident Electoral Commissioner (REC) are the respondents.

The Appeal Court rejected the appellant’s argument that the tribunal ought to have made the order as a consequential one.

It held: “There is no doubt that one of the inherent powers of the court is to make consequential orders in the interest of justice, even when such orders have not been prayed for.

“But the inherent powers of a court to make consequential orders do not include the power to grant a substantive or principal relief.”

The tribunal had struck out Agbaje’s petition due to his failure to ask for a fresh election.

It held: “In the instant petition, apart from seeking an order nullifying the election of the second respondent, the petitioner did not ask for fresh election.

“So, if, for instance, the election is nullified, the people of Lagos State would be left in an anarchy situation as no order can validly be made for the conduct of fresh election, same having not been sought for.”

Updated: Tribunal affirms Ambode as Lagos governor

The Peoples Democratic Party (PDP) governorship candidate Jimi Agbaje has lost his bid to unseat the Governor of Lagos state, Akinwunmi Ambode of the All Progressives Congress (APC).

The Lagos State Governorship Election Tribunal sitting in Ikeja, Wednesday dismissed Agbeje’s petition filed against the election of Akinwunmi Ambode of the APC.

The three man governorship elect‎ion tribunal led by Justice Muhammad Sirajo unanimously held that the petition was incompetent and dismissed it.

Agbaje had challenged the declaration of Ambode as the winner of the April 11, 2015 governorship election in the state in the petition he filed before the tribunal.

He had alleged irregularities during the election which he said breached the provisions of the Independent Electoral Commission’s (INEC) approved guidelines for the polls.

But ruling on the preliminary application filed by Ambode’s lawyer, Chief Wole Olanipekun, the panel said that the petitioner, Jimi Agbaje did not ask for a fresh election despite asking the court to nullify the election.

“In the instant petition, apart from seeking an order nullifying the election of the second respondent, the petitioner did not ask for an order of fresh election. So, if for instance, the election is nullified, the people of Lagos State would be left in an anarchy situation as no order can validly be made for the conduct of fresh election, same having not been sought for.

“A petition that is found on disqualification of a respondent and an order of nullification of the election must of necessity contain a prayer for an order of fresh election. Where such a prayer is lacking, the petition will be incompetent and academic as even the resolution of such a petition in favour of the petitioner will not confer any utilitarian value on the petitioner(s)

” Where no relief for fresh election is claimed in a petition, a ground of petition founded on section 138(1)(b) of the Electoral Act and the entire petition itself are incompetent and liable to be struck out,” Justice Sirajo said.

Striking out the petition Wednesday, Justice Sirajo who read the verdict of the panel said: “It is for this reason that the grounds of the petition that survived up till this point can no longer be countenanced. In the circumstance paragraph 13(b) and 14 of the petition and reliefs 19(5) and 19(8) are hereby struck out in view of the want of the relief seeking for the conduct of fresh election. Having done so, the petition becomes bare and empty

” In the final analysis, and in consideration of our foregoing decisions on all the issues raised in this application, we hold that the application has merit and is hereby granted as prayed. This petition is struck out for being incompetent.”

While moving the preliminary objection to the petition, Olanipekun had argued that the petition should be struck out for being incompetent.

According to Olanipekun there was no correlation between the reliefs being sought by the petitioner and the particulars of application on one hand and the grounds for questioning the election on the other hand.

“The grounds and particulars in the petition are at opposites with the facts and reliefs being sought within the purview of Section 285(2) of the 1999 Constitution. I urge my Lordships to dismiss the petition,” Olanipekun said.

He further submitted that there was no where in the pleadings where the petitioners attacked the victory of the respondents or questioned the conduct of the election.

Olanipekun said: “I submit that there is no petition before your lordships known to law. There are no grounds challenging the election of my client under Section 138(b)(c) of the Electoral Act 2010 as amended.”

According to him, the court cannot act on sentiment and sympathy of parties emphasizing that sympathy does not override clear provisions of the law.

Counsel to APC, Dr Muiz Banire had aligned with the submissions of Olanipekun and described the petition as having no ground and therefore should be struck out.

“This is a groundless petition; there is no petition before Your Lordships. I pray that the purported document before Your Lordships be struck out,” Banire said.

However, counsel to Agbaje, Mr Clement Onwuenwunor, had opposed their submissions and maintained that the petition was competent.

He had argued that the issues for determination by the tribunal had been carefully spelt out.

He said; “Paragraph 13(a) and (b) of our petition questioned the election in Lagos State on the grounds of non-compliance with the Electoral Act and irregularities such as in the use of the card readers.

“We have looked at their preliminary objections in this case and have concluded that they are objections made on mere technicalities.”

He urged the tribunal to dismiss the notices of preliminary objection with substantial costs in favour of the petitioner.

However, ruling on the issue, the three man tribunal upheld the preliminary objection raised by Chief Wole Olanipekun and Banire that the petition was incompetent.

Reacting to the judgment Wednesday, Olanipekun said: “We have come to the end of the proceeding in the respect of challenge with the election of governor Akinwumi Ambode as the governor of Lagos state.

“The tribunal agreed that the petition is incompetence; the court also agreed that incompetence petition does not meet the requirement of the tribunal.

“The petition has to be based on the electoral act and the constitution. The tribunal also agreed that the petition having not grounded on the constitution as well as electoral act binding decisions of the court of Appeal and Supreme Court the tribunal is bound to follow, the tribunal has no alternative than to strike out the case.”
