  • Court sentence man to one year imprisonment for cheating

    A Jos Upper Area Court III, sitting in Kasuwan Nama, on Thursday sentenced a food vendor, Chiwendu Okporoama, to one year in prison for cheating  a used clothes seller of N350, 000.

    The Judge,  Mr Yahaya Mohammed, convicted Okporoama, after he pleaded guilty.

    Mohammed however gave Okporoama an option to pay a fine of  N20, 000 fine.

    The judge also ordered Okporoama to pay the N350, 000.

    Earlier, the prosecutor, Sgt. Jonathan Danladi, told the court that the complainant, Mrs Charity Emenike, who resides at No J 617, Apata Street Jos, reported the case on Aug. 5, at the Laranto Divisional Police Station.

    He said that the convict deceived the complainant  into believing that he will supply her with a bail of second- hand clothing, popularly called “Okirika”.

    Danladi said that after collecting the money, the convict failed to supply the clothes and also refused to return the complainant’s money.

    He told the court that during police investigation Okporoama, admitted to the offence.

    He said that the offence contravened Section 322 of the Penal Code Law of Northern Nigeria.

    Man jailed three years for sexual abuse of three boys

    A 28-year-old businessman, Abdullahi Mohammed, has been sentenced to three years imprisonment for sexual abuse of three boys.

    Mohammed was sentenced on Friday following his arraignment at a Jos Upper Area Court.

    According to the Prosecutor, Sgt Ibrahim Gukwat, the incident took place on October 22.

    Gukwat said that the accused had been in police custody since then, adding that the case was reported by members of a vigilance group on Nigeria Alikazaure Street.

    The prosecutor said that the vigilance group arrested and bought the accused to Laranto Police Station.

    Gukwat said the accused was caught having anal knowledge of the three boys forcefully.

    “He had three boys at the same time, namely Mustapha Abubakar, 9 years, Umar Usman, 12 years and Haruna Abdullahi, 12 years.”

    Gukwat said during police investigation, it was revealed that the accused was beaten by concerned members of the public.

    ‘’The accused sustained injury from the attack from angry public, but he was taken to the hospital for treatment.”

    On arraignment, the accused pleaded guilty to the charge and begged the court for mercy.

    Gukwat said the offence was contrary to Section 284 of the Penal Code.

    The Judge, Yahaya Mohammed, sentenced the accused to three years imprisonment without an option of a fine.

    Mohammed said the sentence would serve as a deterrent to others.

    Man jailed two years over illegal possession of firearms

    A Jos Upper Area Court on Wednesday sentenced a 32-year-old man, Mohammed Bello, to a two-year prison term over illegal possession of firearms.

    The News Agency of Nigeria (NAN) reports that Bello was sentenced after he pleaded guilty to the charge of being in possession of a locally fabricated gun and 30 rounds of ammunition.

    The magistrate, however, gave Bello a fine option of N5,000.

    The prosecutor, Yakubu Tambaya, had told the court that Bello was arrested by a police officer, Insp. Dalyop Davou, on April 7, 2017 during a road search.

    “The accused was arrested during a stop and search operation along NNPC filling station, Zaria Road, Jos.

    “The policeman stopped a vehicle for a routine search and found a locally made revolver and 30 rounds of cartridges owned by the accused. He was arrested when the officer confirmed that he had no legal tittle to the items,” he said.

    He said that the offence was contrary to section 3 of the Robbery and Firearms Act.

    The accused promptly pleaded guilty and begged for leniency, while promising to change his ways.

    Man docked for raping eight-year-old girl

    A 57-year-old man, Aminu Ibrahim, was on Wednesday re-arraigned before a Jos Upper Area Court for allegedly raping an eight-year-old girl.

    Ibrahim of Goda Sagai community in the Jos North Local Government Area was charged with criminal intimidation and rape.

    The News Agency of Nigeria (NAN) reports that the accused was previously arraigned on May 26 this year.

    The Police Prosecutor, Insp. E.A. Inegbenoise, of the State Criminal Intelligence and Investigation Department, had told court that the mother of the victim reported the matter at the Nasarawa Gwong Divisional Police Headquarters on April 26.

    Inegbeniose said that the accused lured the girl into his shop with 50 kobo and Viju milk drink and then raped her.

    He said that the mother of the child noticed that her daughter was walking with difficulty, which made the victim to tell her mother what had her happened.

    The prosecutor said that the victim told her mother that the accused said he would kill her if she told anyone.

    He said the girl, thereafter, led her parents to the shop of the accused and identified a bench he used during the raping.

    Inegbenoise said that during police investigation, the accused confessed to having committed the crime.

    NAN reports that the accused, who was previously on remand was granted bail in the sum of N200, 000 with a surety in like sum.

    This was after his counsel, Mr. David Adudu, prayed the court to grant his client bail.

    Adudu in his prayer, claimed that the accused was hypertensive and needed medical supervision.

    He assured that if the bail was granted, his client would neither jump bail nor interfere with police investigation.

    But the prosecutor prayed court to deny the bail application as there were qualified medical doctors in prisons, who could take care of inmates with health challenges.

    Inegbenoise also argued that owing to the nature of the crime, the offence was not bailable, unless special circumstances.

    The Judge, Mr. J.Yahaya, however, admitted the accused to bail in the sum of 200, 000 and a surety in like sum.

    Yahaya said that the surety must be a ward head, residing within the jurisdiction of the court.

    However, the case which was assigned for continuation of hearing could not hold as judges of the lower courts are currently on strike.

    The matter was adjourned to July 21 for continuation of hearing.

  • Two men in court over rape of minors  

     

    Two men accused of raping two minors appeared before a Jos Upper Area Court on Friday.

    The duo – Shuaibu Musa, 17, and Bashiru Mohammed, 19, who allegedly raped two minors aged 13 and 16, were charged with criminal conspiracy and rape.

    The police prosecutor, Mr E. A. Inegbenoise, told the court that Mr Bulus Badung of Dawul-Bob village in Vwang District in Jos South, reported the matter at the `A’ Divisional Police Headquarters, On March 29.

    Inegbenoise alleged that the accused persons, on the said date, accosted the victims at about 6 p.m. on their way home and dragged them into a nearby bush.

    He said that when the victims put up resistance, the accused persons tied them up with ropes and raped them.

    “During police investigation, the accused persons confessed to committing the crime,” he claimed.

    The prosecutor added that the offences contravened sections 97 and 283 of the Penal Code and could attract punishment of up to 21 years imprisonment, upon conviction.

    The accused persons, however, pleaded not guilty to the crime when the charges were read in court.

    Counsel to the accused, Mr David Adudu, in a written application, prayed the court to grant his clients bail, quoting section 36(5) of the 1999 constitution that presumed an accused person innocent until otherwise proven.

    Adudu said that if the bail was granted, his clients would neither jump bail nor interfere with police investigation.

    The judge, Mr Mustapha Yahaya, admitted the accused persons to bail in the sum of N100,000 each, and two sureties each in like sum.

    Yahaya said that the sureties must reside within the jurisdiction of the court and must submit, to the court, two recent passport-sized photographs and their national identity cards.

    He adjourned hearing in the matter to May 18.

     

     

  • Man okays divorce, demands refund of N400, 000 dowry from wife

    A 30-year-old lawyer, Usman Ahmed, on Tuesday asked his 25-year-old wife, Zainab Abdulkadir, to refund N400,000 dowry paid on her as a condition for divorce.

    Zainab had sought dissolution of the marriage for lack of interest by her husband.

    The petitioner, through her counsel, Mr Bala Bako, told the court that, “my client is no longer interested in the marriage.

    “She is seeking a divorce from her husband.’’

    But counsel to the respondent, Mr M.k. Idoko, told the court to prevail on the petitioner to refund the dowry paid on her.

    He said that the petitioner deserted the respondent when he was writing his final examination at the Law School.

    “My lord, my client’s wife decided on her own to leave her matrimonial home while her husband was away to Law School writing his final examination.

    “He (husband) tried to no avail to reconcile with her; but since she is the one who is willing to leave, she should refund the N400, 000 paid on her as dowry.

    “By Islamic injunctions, she is to refund the exact dowry or even more, depending on the negotiation the two families reached, ’’ he argued.

    Idoko said that it was on that ground that the respondent was demanding for exact amount paid as dowry.

    The petitioner’s counsel Bako, however, said that the respondent abandoned her.

    “She did not leave voluntarily, but she was compelled to do so when her husband abandoned her in their matrimonial home,’’ he said.

    Bako said that the dowry cannot be refunded in full because she does not have such money.

    “According to Islamic law, she will refund only what she can afford.

    “My lord, the plaintiff can afford only N60, 000 as refund to her husband; after all he subjected her to trauma when he abandoned her at home, ’’ Bako said.

    Idoko objected to the petitioner’s prayer, arguing that the petitioner’s claim of being subjected to trauma was false.
    “The marriage was just about a year, and she subjected her husband to trauma as she abandoned him while writing his final examination at the Law School.
    “My lord, if she cannot pay more or the exact amount, we are asking her to pay N350, 000 and nothing less as refund for her dowry, ’’ he said.

    The judge, Yahaya Ibrahim, adjourned the case till April 21, for ruling.
