  • Journalist to court: declare sale of my father’s house illegal

    A journalist, Olorunleke Moses, has asked an Ikeja High Court to declare as declare as illegal, null and void the sale of his late father’s house in Ikeja by some members of his family to a business man, Alhaji Kunle Owonifari.

    The disputed property built by his late father, Ilori Moses, is situated at 37, Ipodo Street, Ikeja, Lagos.

    In a suit filed by his counsel, Morufu Bello, before Justice Babajide Candide-Johnson, the claimant is asking the court for an order setting aside the sale of the property.

    He also prayed the court for an order putting ‘caveat emptor’ on the property and another order mandating  the Registrar of Title, not to register the governor’s consent of the new purchaser, Alhaji Kunle Owonifari.

    The defenders in the suit are: Taiwo Moses, Modupe Moses, Olajumoke Moses, Alhaji Kunle Owonifari, The Probate  Registrar, High Court of Lagos State and Registrar of Titles, Lagos State Land Registry are first, second, third, fourth, fifth and sixth defendants respectively.

    In a 16-paragraph statement of claim deposed to in support of the writ, Olorunleke Moses averred that the disputed property was given to Iwalere Moses on the one hand and Taiwo and Kehinde Moses, on the other hand as stated in the will of his late father, Ilori Moses who died November 20, 1988.

    He averred that by the content of the will, Iwalere Moses was given the entire upstairs of the one storey building while Taiwo and Kehinde Moses were given exclusive possession of the apartments downstairs.

    He averred that Iwalere Moses, Taiwo Moses and Kehinde Moses are step brothers, adding that Iwalere in addition has other siblings including himself, the claimant.

    He stated that  Iwalere  died May 21, 1991 without any issue and that upon his death, his interest in the property reverted to his other siblings including the claimant.

    He stated that not long after the death of Iwalere Moses, his step brother, Kehinde Moses, disappeared and efforts to locate him proved abortive.

    The claimant further averred that after the death of Iwalere Moses, the first defendant, Taiwo Moses, unilaterally sold the property to the exclusion of the siblings of Iwalere Moses and without any grant of probate.

    He averred that the unilateral decision of the first defendant, Taiwo Moses, was allegedly done in collusion with the executors of the will of their late father, Modupe Moses and Olajumoke Moses, the second and third defendants respectively.

    He stated that his request made in writing, through his counsel, Morufu Bello, for a reversal of the sale of the property was ignored and not complied with by the defendants.

    However, in their Notice of Preliminary objection to the suit filed through their counsel, A.A. Oyewole, the first, second, third and fourth defendants jointly asked the court to strike out the suit filed against them by Olorunleke Moses on grounds of gross incompetence, irredeemable irregularity, want of jurisdiction and breach of rules of the court.

    They also prayed the court for an order striking out the suit for failure, refusal and neglect of the claimant to accompany the originating process with verifying affidavit to verify the content of the high court processes as provided for by Order 6, Rule 5 of the High Court of Lagos State Civil Procedure Rules 2012.

    They predicated their objection on 10 grounds.

    They claimed for instance that there was no written Memorandum caused by the claimant/respondent and or their solicitors setting out their claims and option for settlement as deposed to in paragraph 3 of the deposition contained in Form 01 and deposed to on April 30, 2018 which they also stated was defective and void.

    They cited the condition precedent to the assumption of jurisdiction in the decided case of Madukolu Vs Nkemdilim 1862 1 ALL N.L.R. (PT 4) 557 which they claimed has neither been met nor satisfied by the claimant.

    They averred that there is no evidence of the attempts made by the claimant/respondent to settle the matter out of court as stated on page 152 of the High Court of Lagos State Civil Procedure Rules 2012.

    Citing breach of the rules of the court, they contended that the court is duty bound to enforce the provision of the rules to the letter amongst litigants for certainty and regularity of proceedings.

    But in their counter affidavit in opposition to the defendants preliminary objections, deposed to by one Benson Ugboduma, it was contended that the fact that the claimant did not attach a verifying affidavit to the suit is not enough to warrant striking it out.

    It was stated that a pre action Form 01 was deposed to on April 30, 2018 in support of the action of the claimant and that it was done in compliance with the rules of the court.

    They averred that the arguments of the defendants was cosmetic and a mere academic exercise which they contended was not enough to strike out the suit.

    The claimant insisted that justice in the matter lies in dismissing the application of the defendants as it is lacking in merit and an over reach brought to rob them of their right.

    Justice Candide-Johnson has fixed December 11 for hearing of the matter.

  • Edo journalist seeks help to treat wife’s cancer

    A journalist in Benin City, Edo State, Mr. Lucky Ighomuaye, has appealed to well meaning Nigerians to come to his aid to enable him treat his Wife, Mrs. Benedicta Ighomuaye, who is suffering from breast cancer.

    Ighomuaye said his wife has successfully undergone surgery at the University of Benin Teaching Hospital, UBTH including her chemotherapies, but the doctor said she needed to repeat the process due to some complications to avoid further spread.

    The doctor who does not want her name in print, said it will require about N1,000,000 for another round of complete chemotherapy.

    “I spent all of my savings on the previous exercise and I am appealing to the Edo State government and other well meaning Nigerians to come to my assistance to enable me give her the needed treatments,” he said.

  • Campus journalists fault suspension of UI’s Law student

    Campus Journalists drawn from universities across the country under the auspices of “Free Campus Press Movement” have condemned the suspension of Kunle Adebajo, an award-winning campus journalist and  Law student of University of Ibadan who’s expected to proceed to law school this year.

    In a statement, the group faulted the two-semester suspension of Adebajo, by the University management under the Leadership of Professor Idowu Olayinka.

    Full text of the press statement reads: “While we are not contesting the powers of the University to discipline Students, we are very much concerned that the institution management found it very convenient to suspend Kunle Adebajo for his investigative feature titled “UI: The Irony of Fashionable Rooftops and Awful Interiors” published on Guardian newspapers in 2016.”

    “Not only do we find this strange in the current dispensation of modern terms and in the post-colonial era, we also find it strange that the University failed to observe that this intellectual work did not in anyway abuse or defame any personality nor institution but rather aimed to improve the standard of the University.

    “We are deeply disappointed that a University of prestige and calibre like University of Ibadan will fail to observe that ethics of Journalism requires objectivity, we feel the objectivity of Kunle Adebajo was seen as subjectivity by the University management which is appalling”

    While stressing the importance of freedom of the press, the release noted that, “in the current age where Press Freedom is being preached, we find it very disheartening that University of Ibadan decided to be the premier varsity in suspending campus Journalists”.

    “We would not fold our arms, we call on all well-meaning Nigerians to prevail on the University management to rescind the suspension of Mr Adebajo,” it added.

  • Herdsmen killings: Miyetti Allah threatens to sue journalists

    The Nasarawa state chairman of Miyetty Allah cattle breeders association (MACBAN) has said that he will take legal action against any journalist that carries any report considered to be malicious to the Fulani tribe.

    The chairman, Husseini Muhammed made the threat following wide media report on the killing of three policemen and eight Agatu farmers in Mararaba-Udege, in Nasarawa local government area of Nasarawa state.

    While reacting to the involvement of Fulani herdsmen in the killings in Lafia on Thursday, he said his association is ready to sue any journalist who dares to involve Fulani herdsmen in their report in the event of any killings”.

    “Why should the word Fulani herdsmen be used anytime there are killings of people? That amounts to criminalizing the entire Fulani tribe and we will not take that again”.

    “The media is the one fueling this hatred against the Fulani people and we will sue any journalist whose report reflects this henceforth,” Husseini said.

    “We are not in support of any Fulani man who kill or involved in any criminal activities, the police should arrest and prosecute any Fulani man if caught”.

    “Other tribes like the Niger Delta people started the kidnapping but nobody mentions Niger Delta whenever a kidnapper is arrested, but whenever killing is committed then it is the Fulani herdsmen, we can’t take this anymore”.

    The association, therefore, cautioned reporters to desist from using the word Fulani herdsmen in the event of any killings else it will engage them in a legal battle.

  • Buhari greets journalist Ajibade at 60

    President Muhammadu Buhari has felicitated with journalist and author, Kunle Ajibade, on his 60thbirthday, billed for May 28, 2018.

    In a statement by the Special Adviser on Media and Publicity, Femi Adesina, President Buhari joined the media industry in specially celebrating the renowned author of “Jailed for Life’’ and “What a Country!’’ for his literary prowess and contributions to topical issues in the country over the years.

    The President recalled the many hurdles Ajibade had to overcome, and the sacrifices he made in the pursuit of seeing fairness and justice institutionalized in the country, including going to jail for trumped up reasons.

    He commended Ajibade’s patriotism, resilience and desire to see Nigeria become a better country.

    The President prayed that the almighty God will grant the author longer life, good health and more wisdom to serve the nation he loves so much.

  • Police deny manhunt for journalist over IGP video clip

    The Kano Police Command has debunked media reports it had launched probe and threatened bloggers arrest over IGP’s trending video.

    A statement by the Commissioner of Police, Rabiu Yusuf, signed by the Public Relations Officer Magaji Musa Majia, described the news story as “false and an act by mischief makers.”

    The statement reads: “The attention of Kano State Police Command is drawn to trending headlines in some national dailies and online Media that the “Police launched probe, threaten bloggers arrest’’ over IGP’s trending video.

    “The Command hereby debunks the news as false in its entirety and an act by mischief makers. No journalist was arrested nor invited by the Command for interrogation over the video clip.

    “It is crystal clear that the Command maintains cordial relationship with the State Chapter of the NUJ, the Correspondence Chapel and all bloggers.

    “The media outlets responsible for the report had their correspondents here in Kano but none consulted the Command to verify the news.

    “No manhunt of any journalist what so ever by the Kano Police Command please.”

    A video clip allegedly showing the Inspector General of Police struggling to present his speech at an occasion in Kano went viral during the week.

    A reporter of Liberty TV Aminu Nuhudeen was alleged to be behind circulation of the clip, which he denied.

    He was seen yesterday at the APC State Congress in Kano at the Sani Abacha stadium in the metropolis.

  • CJ urges journalists to uphold professional ethics

    The Chief Judge (CJ) of Lagos State, Justice Opeyemi Oke, has urged journalists in the state to be professional and uphold the ethics of journalism while carrying out their duties.

    Oke made the call while addressing members of the National Association of Judiciary Correspondents (NAJUC), Lagos Chapter, on Friday in Lagos.

    She said journalists covering courts across the state must be highly professional and always have investigative minds in order to write good stories.

    The CJ emphasised that truth and fact must be the watch words for every journalist, noting that media practitioners who habitually turned in fake stories, were always labeled enemies of progress.

    “l encourage you all to practise investigative journalism; get facts in order not to send out false information to the public,’’ she advised.

    The chief judge promised to look into the challenges journalists faced in covering court proceedings in the state with a view to addressing them.

    “The courtroom is an open place that is accessible to the public. It is a place where you get information concerning the judicial process as well as watch proceedings,’’ Oke said.

    DSS lacks power to ask Independent journalist to reveal source, says Falana

    THE Department of State Services (DSS) lacks the power to force the Abuja Bureau Chief of The Independent, Mr. Tony Ezimakor, to disclose the source of his information, activist-lawyer Femi Falana (SAN) has said.

    Ezimakor was released from detention last night.

    Falana,  in a statement issued in Lagos yesterday titled, “Tony Ezimakor cannot be forced to disclose his source of information”, advised the DSS to release him unconditionally as he has not committed any offence known to law.

    The senior lawyer, who said Ezimakor’s detention was illegal and unconstitutional, drew the attention of the DSS to Section 35(2) of the Constitution, which provides that “any person who is arrested or detained shall have the right to remain silent or avoid answering any question until after consultation with a legal practitioner or any other person of his own choice”.

    “Since Mr. Ezimakor is constitutionally entitled to “remain silent”, the Department of State Services lacks the power to subject him to disclose the source of his information.

    “Therefore, by arresting and detaining Mr. Ezimakor for the purpose of compelling him to disclose the source of a story written by him and published by The Independent newspaper, the DSS has acted malafide, illegally and unconstitutionally.

    “As Mr. Ezimakor has not committed any offence known to law, the DSS should release him unconditionally and publicly apologise to him in line with the requirement of Section 35(6) of the 1999 Constitution of Nigerian as amended.”

    He noted that the Abuja Bureau Chief of The Independent was arrested last week by the DSS  for publishing a story on the alleged payment of $2 million to the Boko Haram terrorists for the release of some of the abducted Chibok girls.

    He noted that the DSS, which felt embarrassed by the publication, held Ezimakor till last night. He was asked to disclose his source of information as a condition for his release.

    “The harassment of Mr Ezimakor is a sad reminder of the case of Messrs Tunde Thompson and Nduka Irabor, who were tried, convicted and jailed by the Buhari/Idiagbon junta in 1984 over their refusal to disclose their source of information pertaining to a story published in The Guardian.

    “Regrettably, the DSS  is yet to appreciate that a journalist cannot be forced to disclose his source of information under the current democratic dispensation,” Falana stated.

  • Journalist launches human interest website

    A new on-line media has been added to the growing numbers of websites in the country. The website, taiwoabiodun.com, will be accessible from Monday, January 15.

    According to the founder, Taiwo Abiodun, the website will for now on every Monday feature human interest, investigative, personalities, arts and culture stories, among others.

    Abiodun is a seasoned journalist who has worked in various media houses including the defunct Concord newspapers, The Hope newspaper (owned by Ondo State government), Village News (Ogun State), The Comet and The Nation newspaper.

    AN Ebonyi based journalist has incurred the wrath of suspected political thugs in the state after posting a Facebook message critical of Governor Dave Umahi.
    Charles Otu of The Guardian was descended upon by the thugs on Friday, beating him to stupor.
    On the same day, the publisher of People’s Leader, Mr. Samuel Nwaeze was shot by gunmen at about 7.p.m. in front of his office at 2, Awolowo Street in Abakaliki.
    Otu said his attackers were sent to kill him over his Facebook post, in which he criticised the current administration in the state.
    Mr. Otu told the News Agency of Nigeria (NAN), yesterday that the thugs accosted him at about 6.p.m. on Friday at Vanco Junction in Abakaliki and started beating him with clubs and other dangerous weapons.
    He said the beating attracted passers-by, “but the thugs threatened to shoot anybody that interfered.”
    He said he was later abducted and taken to the “Ebonyi Cabinet Office” where he was asked to write an undertaking never to write any story against the state government or be silenced permanently.
    He said the thugs later drove him to the Kpirikpiri Divisional Police Headquarters.
    “I was asked by the group to write a statement that I was rescued by the Ekubaraoha Youth Assembly from a mob that was attacking me.
    “The thugs who accosted me at the Vanco Junction arrived in a 16-seater Toyota bus with the inscription of Ekubaraoha Youth Assembly.
    “They accused me of being a threat to the state government and threatened to silence me unless I signed a written undertaken never to write anything against the state government.
    “I collapsed at the police station having lost consciousness due to the severe beating they gave me but I was revived at the emergency ward of the Federal Teaching Hospital, Abakaliki,” Mr. Otu said.
    Otu has in his Facebook posting criticised the administration of the governor saying it has not lived up to its promises to the electorate.
    Also, recounting his own experience in the hands of gunmen, Nwaeze said: “I narrowly escaped death. I was lucky the assailants who came on a motorcycle missed the target; the story would have been a different one. I heard a bang and I felt sharp pains and blood gushing out from my back.”
    He added that he saw two men running with guns in their hands.
    “It was then that I realized that I had been attacked by drive-by shooters,” he said.
    He said he had reported the incident to the police.
    The Nigeria Union of Journalists (NUJ), Ebonyi Council, condemned the attacks.
    The chairperson of the union, Veronica Oshim, called on security agencies to rise to the challenge.
    She told NAN that journalists must be provided with safe and secure environment to inform and educate the public.
