    Contractual differences slowed down Bodo-Bonny road project completion, says Julius Berger

    Julius Berger Nigeria PLC has revealed that the Bodo-Bonny Road project, awarded in 2014, would have been completed earlier if not for contractual differences.

    The company, however, assured its commitment to completing the remaining sections using advanced concrete technology and state-of-the-art equipment.

    The federal government and Julius Berger Nigeria PLC were locked in prolonged negotiations over the Bodo-Bonny Road project, culminating in an April directive giving the company until the end of 2024 to complete the work. 

    The ultimatum followed Minister of Works David Umahi’s rejection of the company’s N28 billion variation demand on the 82% completed project, with the government offering N20 billion instead. 

    According to former Permanent Secretary Yakubu Kofarmata, the N199.923 billion contract was initially scheduled for completion by December 2023, with a clause barring further variations. 

    The 39-kilometer road, the first to connect Bonny Island to the rest of Rivers State by land, remains a critical infrastructure project. 

    Umahi then, warned that if the contractor failed to accept the government’s terms and resume work, the earlier 14-day ultimatum which had already expired would be reactivated. 

    However, Emmanuel Isibor, Manager of Media Relations for Julius Berger, revealed in a statement on Tuesday that workers were seen last week finalizing concrete pavements on both sides of the major road into the island.

    He said the company is constructing state-of-the-art concrete roads inside the oil-rich Island which constitutes the terminal section of the ongoing Bodo-Bonny Road project in Rivers State.

    He noted that last week, workers were seen busy on-site putting final touches to the concrete pavements on both sides of the major road into the Island, while others were busy laying reinforcement gauze, and later mixed concrete on the main road.

    He added that all through, Julius Berger site workers were seen constructing rigid concrete pavements and roads using specialized international equipment from Wirtgen, Germany.

    The statement reads in part: “With an array of equipment ranging from, Mobile concrete batching plant, Concrete mixer, Concrete pumps, Concrete pavers to Concrete boom placer, the workers were busy on the job last week.”

    “He quoted the Project Manager, Tim Nippert, as saying “We are building about 5.50km of concrete roads with pavements on this Island. The last 5.50km on this Island will have its roads and pavements built on concrete.

    “Due to the extremely challenging soil conditions on the main Bodo-Bonny Road and expected long-term settlements of up to 30cm over a period of 30 years, the contract for the job did not ask for concrete construction on the Road except for the Island roads.

     “This is an innovative approach to modern-day construction. We are happy with what we are seeing here on this Island. Even the progress on the road from Bodo across Afa Creek Bridge and Opobo Bridge across Opobo Channel and Nanabie Creek Bridge to this point on the Island, we are excited.

    “Julius Berger is doing great on this road,” retorted a community leader and Chairman of the Bodo-Bonny Road Project Peace Committee, Chief O. R. Longjohn, last week.

    The Senate yesterday mandated its President, Godswill Akpabio, to issue a warrant of arrest to compel the Managing Director of Julius Berger Nigeria Plc, Dr. Peer Lubasch, to appear before its Committee on Works at a date to be specified by the Red Chamber.

    The resolution of the Senate followed its consideration and adoption of a Point of Order moved by Minority Whip Osita Ngwu (PDP, Enugu West) during plenary.

    In his motion, which was co-sponsored by Senators Asuquo Ekpeyong (APC, Cross River South) and Barinada Mpigi (PDP, Rivers South East), Ngwu informed the Senate that Julius Berger Plc had consistently refused to appear before the Senate Committee on Works to answer questions on abandoned projects and alarming contract variation from N54 billion to N195 billion.

    Akpabio said the date for the arrest would be stated in the warrant.

    Ngwu urged the Senate to note that on November 20, 2024, the Senate mandated its Committee on Works to investigate the state of road infrastructure across the country.

    He said the Red Chamber recalled that further to the investigative hearings, Julius Berger Nigeria PIc had neglected and refused to honour the Senate’s invitations to provide details of their role in the Odukpani-Itu highway project, despite receiving substantial public funds amounting to over N18 billion.

    Abuja-Kano Highway: Fed Govt gives Julius Berger seven-day ultimatum

    The Federal Government has issued a seven-day ultimatum to Julius Berger Nigeria PLC to accept its revised contract sum of N740.8 billion for the completion of the 82-kilometre Section II of the Abuja-Kaduna-Zaria-Kano road.

    The government expressed frustration over the construction giant’s delay in resuming work on the project, saying this was causing hardship among Nigerians plying the road.

    It said despite approving the revised project cost, its abandonment had drawn flaks from many Nigerians.

    Works Minister David Umahi issued the ultimatum to the construction company yesterday in Abuja when its new Managing Director Pier Lubasch visited him in company of outgoing MD Lars Richter.

    In a statement by his Special Adviser on Media, Uchenna Orji, the minister regretted that the government was taking the blame for the company’s carefree attitude towards the project.

    He said: “If Berger is not doing it, then let’s have other people to do the job within the time that we can control price.

    “We’ve had more than 20 letters from Berger on this. It is a ping pong game from Julius Berger.

    “The prices rose from N710 billion to N740 billion because of these delays. And if we don’t think about continuing the delays, it is the problem of the Ministry of Works.”

    Umahi expressed dismay that Julius Berger, which had enjoyed Federal Government’s patronage as well as that of sub-national governments, was not realistic in its contract pricing, especially in this period of Nigeria’s economic challenges.

    The minister directed the contractor to, within seven days, accept or reject the approved reviewed contract sum for the completion of the rehabilitation of Section II of the Abuja-Kaduna-Zaria-Kano road or face contract determination.

    He said the Federal Government would not allow itself to be held to ransom by the desire for unrealistic pricing and augmentation by contractors.

    “This offer is not subject to any condition. It’s not subject to any condition that is being dished out here. It’s taken as given after more than 14 months. I’m sorry, I have to sound this way because there must be an end to negotiation.

    For some time now the “LONG BRIDGE” along the Lagos Ibadan Expressway has become and remained an “ALBATROSS” for many motorists and other commuters along this route. The reconstruction of some portions of the road by Julius Berger with the bottlenecks created by blocking parts of the road with long concrete slabs has aided and given easy access to the hoodlums to operate either in the early hours of the morning when workers are heading to work in Lagos or Ibadan or in the evening when they are returning home from work.

    In recent times specifically in the month of September the Longbridge especially the approaching bus stop, Wavwa and Arekpo has become the operating areas of the hoodlums. These areas have growing bushes on both sides of the road and the under bridge has habour the hoodlums.

    Either when there is a gridlock on the road or a vehicle breaks down on the road the hoodlums emerge from the bushes and under the bridge to violently attack innocent commuters. The unsuspecting innocent commuters are attacked violently, their valuables such as GSM Handsets, their jewelries, cash on hand and anything that the hoodlums might lay hands on are taken away violently.

    The hoodlums emerge with sharp cutlasses, knives, locally made pistols and pieces of armoured stones rock which they (hoodlums) use as alternate weapons on commuters. Fact is that the area surrounding the wavwa bus stop and Arekpo has been converted into “SHANTIS” by these hoodlums.

    They have pockets of huts in this area as their permanent abode. They pretend to be cattle rearers in the day and by night they turn to highway robbers. In recent times there has been a cases of kidnapping in this area. The hoodlums rush in individuals whose vehicle breakdown on the long bridge due to electrical or mechanical faults. Such commuters have no “self-defense” since they did not prepare for such sudden attacks.

    History of hoodlums attacks along the longbridge dates back to the early 80s and spread to the early 90s. The early millennium witnessed a lull on hoodlums attack on the longbridge. However, with the influx of some persons pretending to be cattle rearers in the area the menace of hoodlums attacks assumed devilish heights. The only Police Divisional Headquarters in the area is the Wavwa division. The station lacks the necessary operational tools to tackle the offensive operations of the hoodlums.

    To save lives and properties along this longbridge and flush the hoodlums from this area, a clarion call goes to the Ogun state Government, the Lagos State Government, the Ogun State Police Command Headquarters, the Lagos State Police Command Headquarters and Zone 2 Zonal Police Headquarters and the Army Divisional in the area to form a joint task force to rid the area of these hoodlums.

    The first step of action to be taken is the clearing of all the shanties in the area. All illegal structures under the bridge should be cleared or demolished. The bushes have to be cleared to give commuters a clearer vision as they drive along the route in the night. These measures will bring to a close the menace of notorious hoodlums along the longbridge. The main road construction company along the route JULIUS BERGER should be instructed to create alternate routes for commuters either Lagos bound or Ibadan bound instead of almost blocking the road on both sides with long concrete slabs.

    This writer had once fallen victim of these robbers along the longbridge. The earlier these above actions are taken by the two State Governments the better for lasting solutions to hoodlums attacks on the “LONGBRIDGE”.

    FG tasks Julius Berger on speedy completion of ₦820b road projects

    The federal government has told Julius Berger Nig. Plc to fast-track the completion of the rehabilitation of the 82-km Section II of the Abuja-Kaduna-Zaria-Kano dual carriageway and the construction of the Bodo-Bonny road with bridges across the Opobo Channel, Route 430 in Rivers State.

    This followed the Federal Executive Council’s (FEC) approval of the re-scoping and downward review of the contract for the rehabilitation of the Abuja-Kaduna-Zaria-Kano dual carriageway and the revised estimated total cost/augmentation of the contract for the construction of Bodo-Bonny road with bridges across the Opobo channel, route 430 in Rivers State totalling ₦820,873,565,749.38.

    From the reviewed contract sum of ₦740b Abuja-Kaduna-Zaria-Kano dual carriageway, the government has already paid the contractor ₦391 billion leaving about ₦340 billion outstanding.

    The government has given the contractor a 14-month completion period for the project.

    The government, however, warned that it would not entertain any increase in the reviewed contract and would also not hesitate to terminate either of the contracts, with the approval of President Bola Tinubu, if its terms were not acceptable to the construction company.

    The Minister of Works, David Umahi said the government cannot afford to remain in perpetual negotiations with the contractor while urging that they put in some form of patriotism into its association with the government.

    Umahi, in a statement by his Special Adviser on Media, Uchenna Orji on Sunday, during a meeting with Julius Berger (Nig.) Plc, represented by its Executive Director, Projects, Benjamin Bott and the Head of Contract Management, Omonigho Brown, in Abuja on 3rd October 2024, emphasized the need for the contractors handling Federal government projects to exhibit corporate nationalism in price negotiation in the face of the daunting economic challenges facing the country.

    The Minister said FEC, at its meeting of 23rd September 2024 approved the re-scoping and downward review of the contract for the rehabilitation of the Abuja-Kaduna-Zaria-Kano dual carriageway in the FCT, Kaduna and Kano States, contract No. 6350 and the revised estimated total cost/augmentation of the contract for the construction of Bodo-Bonny road with bridges across the Opobo channel, route 430 in Rivers State, contract No. 6247, amounting to a total contract sum of N740,797,204,713. 25 and N80,076,361,036.13 respectively.

    He said: “Then we have section II, which is 82 kilometres by two, which is the section that JBN Plc is working on.

    “And so, if you check what FEC approved on 23rd of September, FEC had approved that the total contract sum within the scope of Berger would be ₦740 billion, which means that if you remove ₦391 billion paid already, you now have about ₦340 billion remaining, which is the scope of their work for the 164 kilometres.”

    He urged the contractor to mobilize in the four sections of the Abuja-Zaria-Kaduna-Kano project to finish the job within 14 months.

    Noting that the prices given on the said projects were the best considering the economic reality of the time, the Minister said, “So we are appealing to you not to try to increase the contract sum because it will not be possible.

    “And we have written to the President to approve that if JBN Plc does not accept the ₦740 billion, we will terminate the contract.

    “We have terminated some of their jobs because we’ve been negotiating sometimes 12 months, 13 months.

    “There must be an end to negotiation. We are ready to pay you (JBN Plc) even fresh mobilization, just to underscore the interest of the President in this project.

    “So we are appealing and begging you that by Monday, you should be able to sign the addendum to the contract.”

    The Minister stressed the importance of JBN Plc mobilizing at multiple locations across the two projects to ensure their completion within the scheduled period, saying, “On the Bodo-Bonny project, we don’t think we have any issue.

    “We’ve agreed on the ₦280 billion, which is the new contract sum that is fixed, and then for a 12-month completion period; that is an additional 12 months.

    “So we want you to mobilize in a minimum of three locations. So that within these 12 months, we’ll be able to finish the job.

    “In the letter to NLNG, we have to also propose 30% advance payment, so that they will be able to have enough funds to mitigate inflation and any form of variation.”

    Orji stated that the meeting concluded with the formal handover of the Letters of Award for the revised project contract sums to Julius Berger (Plc), on the terms “That the contract is fixed, firm, non-transferable, and will be automatically terminated by the expiration of its term unless formally reviewed by the Ministry”.

    Handler of the 39-kilometre Bonny-Bodo Road contract Julius Berger Nigeria got a marching order from the Federal Government yesterday – deliver the project by the end of the year.

    The construction company also heard from Works Minister Dave Umahi that its request for N28 billion variation on the 82 per cent completed project is unacceptable.

    The government offered additional N20 billion for the completion of the first road to link Bonny Island to the rest of Rivers State.

    According to the Ministry’s Permanent Secretary, Yakubu Kofarmata, the scheduled delivery date for the N199.923 billion project was December last year with a caveat that there would be no further variation.

    Umahi threatens a refusal of the government offer by the contractor and failure to return to site by tomorrow will force the government to enforce the previous expired 14-day ultimatum.

    The clarifications were provided at a meeting in Abuja with the Managing Director of Julius Berger, Lars Ritcher and the Bodo-Bonny Road Peace Committee.

    This meeting followed a letter requesting an extra N28 bilion and outlining various additional conditions for the project’s completion.

    Cautioning that no contractor has the authority to dictate terms on any contract that has already been agreed upon by both parties, the minister cited the legal requirement for both parties to review the contract terms before signing it.

    The minister told the Julius Berger delegation to either accept the government’s response to their demands on the project and proceed with it, or voluntarily terminate the project themselves.

    The Minister of Works Sen. David Umahi has ordered Julius Berger PLC, the contractor handling the 35-kilometer Bodo-Bonny road and bridge project in Rivers State, to return to the site and ensure its timely completion.

    The Minister emphasised the urgency and significance of the directive, noting that the project, initially awarded to Julius Berger Nigeria Plc by the previous administration at a revised cost of N199b with a completion date of December 31, 2023, is crucial for economic transformation in the region, being approximately 84% complete.

    Umahi expressed bewilderment over the contractor’s absence from the site despite their commitment under the agreement to meet the revised completion date. 

    He set April 2024 as the new deadline for the project’s delivery.

    Hosting a delegation from the Bodo–Bonny Road Peace Committee on Monday, December 5, 2023, Umahi assured the project’s host communities that the Federal Government, under President Asiwaju Bola Ahmed Tinubu’s Renewed Hope administration, is committed to ensuring the project’s swift completion.

    As stated by his Chief Press Secretary (CPS), Uchenna Orji, the Minister highlighted a partnership agreement in 2017 between the Federal Government through the Federal Ministry of Works and Nigeria LNG (NLNG) outlining the funding modalities for the project.

    He faulted the contractor’s stance on project variations, highlighting that they had previously committed to completing the project without seeking additional variations, saying, “No equipment must be allowed to be moved out of site, they must complete that project as agreed and as signed and nothing has removed that responsibility which they willingly on their own signed. 

    “I implore you the Peace Committee to report to me the progress that has been made on that road”

    “Bobo-Bonny project was augmented to 199billion, I am told by the Ministry and NLNG Limited that there was a document signed by Julius Berger that the project cannot be varied which means that the project cost cannot be increased, the project is about 35 kilometers”.

    He, however, praised the host communities for maintaining peace with the contractor despite project delays while urging them to persist in their peaceful approach towards contractors working on projects in their vicinity.

    He assured the delegation that the Ministry would ensure the completion of the Bodo-Bonny road project by April 2024, saying, “Nobody will hold this country to ransom if they cannot do it, another person will come and do it and finish it even better but the only charge I give to you is not to allow any equipment out of sight until they complete the project”.

    Umahi also guaranteed that the Federal Government would manage a coastal road in the same region, facing even more significant site challenges, and the cost would be less than what the government is currently paying Julius Berger.

    “I respect them for their quality and commitment, but we shouldn’t be taken for granted” “It is a character of arrogance for them to demobilize from site,” he added

    Federal Director Bridges and Design Engr. O. O. Awosanya gave a brief history of the award and funding of the project by Julius Berger. 

    According to him, the initial date of completion of the project with 13 bridges was supposed to be 31st December 2023, saying, “We have three main bridges and we have nine mini bridges and one bridge over the pipeline.

    “The project completion as of today is about 84% and the contractor has requested for a review which is against the spirit of the propagated agreement that was signed between the Federal Government, the Nigerian Liquefied Natural Gas, and JB in 2021,” he said.

    Leader leader of the delegation and acting Chairman of the Peace Committee, Chief Charles John Jumbo appreciated President Tinubu and the Minister for the massive interventions and efforts they are bringing to the road sub-sector and changing the narrative of the road infrastructure in Nigeria.

    He said the delegation was in the Minister’s office to register their displeasure over the sudden demobilization from the site and abandonment of the Bodo-Bonny Road and Bridge project by Julius Berger Plc despite the huge funds committed by the Federal Government through NLNG and implored the timeous intervention of Federal Government to avert the imminent hardship to be faced by the people of the area.

    The federal government has taken delivery of the second Niger bridge from the contractor, Julius Berger, seven months after it was inaugurated by previous administration. 

    The Minister of Works, David Umahi, while addressing reporters shortly after he was conducted round the road and the facilities by the Managing Director of Julius Berger, Dr Lars Richter, said that he was satisfied with the level of work done. 

    Umahi, therefore, commended the previous and present administrations for doing quite a lot for bringing the work to fruition, saying that the job was very beautiful and well completed. 

    He said: “We have light issue and we’ve put things together on how to permanently have light especially at night. 

    “What we have agreed is to deploy solar solution in the coming weeks so that every night we don’t have to run diesel.

    “The roads are going to be completed when we have completed the two inter changes, one is taking us off from Asaba town to cut off the traffic and the other one is going to be done by Reynolds Construction Company (RCC) Ltd to avoid Onitsha town and take you straight to Obosi. 

    “President Bola Tinubu is very committed to the project, we’re going to acquire more and so that we can built service stations, filling stations, restaurants and supper markets and other facilities as we see in western world. 

    “We are determined to that, the need to do this with the inter changes is going to be a very smart one, so that over the years we can have a beautiful and maintained road”, he said. 

    The minister further assured of security within the bridge by providing Closed-circuit (CCTV) cameras and some security personnel

    Earlier, the Managing Director of Julius Berger, Dr Lars Richter, said Sunday’s event was a technical handover after the project was inaugurated by the former administration. 

    He said that work was successfully completed in time, adding that Julius Berger had delivered highest quality of work. 

    Also speaking, the Director, Bridge Design and Construction, (South), Federal Ministry of Works, Mr Bede Obioha, tasked the residents around the second Niger bridge to help secure the already installed facilities.

    Bede commended the staff of his ministry and the contractors for a job well done, while urging the road users and the residents to abide by the rules of the road.

    Delta State Government and construction giant,  Julius Berger Nigeria Plc, yesterday, signed a 78 Billion naira contract for the construction of flyovers, cloverleaf and road expansion projects in Effurun and Warri metropolis of the state. 

    The contracts include road expansion of a section of DSC/NPA Expressway, including a Cloverleaf Interchange at the existing Effurun flyover, alongside two pedestrian bridges, Flyover bridges at Enerhen junction to Marine Gate, DSC roundabout and PTI junction. 

    The Secretary to the State Government, Dr Kingsley Emu, and  the Commissioner for Works (Highways and Urban Roads),  Comrade Reuben Izeze, signed on behalf of the State Government, while the  Managing Director of Julius Berger Nigeria Plc, Dr Lars Richter, and the  Regional Manager, Engr Friedrich Wieser, signed for the construction giant. 

    The Solicitor- General and Permanent Secretary, Ministry of Justice, Mr Omamuzo Erebe,  and  the Permanent Secretary, Ministry of Works, Mr. Fred Edafioghor, witnessed the signing. 

    Speaking during the ceremony, Governor Sheriff Oborevwori said the signing ceremony was a culmination of days and months of critical planning and deft negotiations and a major step forward in his administration’s plan to start an infrastructural revolution that would change the face of Warri and environs. 

    He said: “Today’s event is the high point of months of vigorous planning,  meetings, reviews and tough negotiations. I am pleased that we have reached a point of agreement. 

    “It is pertinent to know that this is the first time in Delta State that we are engaging Julius Berger Plc in construction jobs. They have been in Delta, they worked in NPA, but this is the first time the state government is engaging them for construction projects. 

    “On behalf of the government and the people of Delta state, I want to express my deep appreciate to Julius Berger PLC, the Ministries of Works(High way and Urban roads), Justice, Finance and the Office of the Secretary to the State Government; for the countless energy invested in the process. 

    “I am aware that the road to this signing ceremony was tasking and draining but you stayed on course and, today, we are reaping the fruit of your diligence and resilience,” he said. 

    The Governor who said the choice of Julius Berger was informed not only by their excellent record but also by their experience in road construction in riverine terrains, tasked the contractor to deliver the projects within  27 months.

    “We have seen what they have done in other states with topography like Warri and we are confident that they will replicate the same feat here. 

    “Upon completion, these projects will not only change the face of Warri and its environs, but also ease the traffic congestion in the area and alleviate the hardship faced by the commuters. 

    “As it is often the case with road constructions of this nature, there will be direct employment benefits for our people, especially, engineers, artisans and even food vendors. Transporters and so many others in the construction value chain also stand to benefit. 

    “I assure all Deltans and residents of the state that the M.O.R.E agenda is on course. They should expect more landmark projects across the different senatorial districts in fulfilment of our pledge to make life more meaningful to our people,” Oborevwori stated. 

    Richter, while thanking Delta State Government for giving the company the opportunity to deliver on the projects, commended Governor Oborevwori for the vision and foresight in a huge investment and for the commencement of a new era for the people of the state. 

    “We commend the Delta State Government for this and we are honoured to be the chosen partners for the construction of this vision. 

    “We are also looking forward for a successful partnership, a great achievement and the commencement of a new era to the benefit of the people of Delta state,” he said.
