Appeal Court affirms Sani, Idris’ elections as Kaduna, Kebbi govs

The Court of Appeal in Abuja has set aside the September 28 judgment of the election petition tribunal which declared the last governorship election in Kaduna state inconclusive.

In three unanimous judgment on Friday, November 24, a three-member panel of the court held that, as against the finding of the tribunal, the election was conclusive and won by the All Progressives Congress (APC) whose candidate was Uba Sani.

The court held that there was no basis for the tribunal to have ordered the conduct of supplementary election in 22 polling units in seven wards in four Local Government Areas in Kaduna State.

Justice Obietonbara Daniel-Kalio, in his lead judgment in the main appeal filed by the Peoples Democratic Party (PDP) and it’s candidate in the election, Mohammad Isa,  resolved the five issues, identified for determination, against the appellants.

Justice Daniel-Kalio held that the petition filed by the appellants at the trial tribunal was deemed abandoned because their application for the issuance of  pre-hearing notice was filed prematurely, before the close of pleadings and was therefore considered incompetent and void.

He said: “The consequence of filing premature application for issuance of pre-hearing notice is that the petition is deemed abandoned.”

The judge also held that the tribunal was right in holding that the written statement on oath of subpoenaed witnesses were invalid having not been filed with the petition as required under Paragraph 4 (5) of the 1st Schedule to the Electoral Act.

He further that the tribunal was right to have rejected substantial portions of evidence of two witnesses called by the petituoners for being hearsay evidence.

Justice  Daniel-Kalio held that, as against the contention by the appellants, the tribunal correctly evaluated the evidence adduced by them.

“I cannot see where the tribunal incorrectly evaluated the evidence of the appellant’s and that the evaluation was perverse,” he said and proceeded to dismiss the appeal for lacking in merit.

Justice Daniel-Kalio, who also read the lead judgments in the cross-appeals by the APC and Sani, allowed both appeals and set aside part  the judgment of the tribunal which declared the election inconclusive and ordered the conduct of fresh election in 22 polling units.

He held that the tribunal was wrong to have ascribed probative value to election results, which it found to have contained discrepancies, in arrive at its conclusion that the election was inconclusive.

In a separate judgment, another panel of the appellate court dismissed the petition by the PDP and its candidate in the last governorship election in Kebbi state.

Justice  Uzo Ndukwe-Anyannwu, who read the lead judgment, resolved all the five issues, identified for determination, against the appellants.

Justice Ndukwe-Anyannwu, who held that the appellants failed to prove their claims of forgery and non-complaince, said the appeal was without merit.

She further held that the allegations of forgery of testimonial made by the appellants against the state’s Deputy Governor of the State, Abubakar Umar was unproved.

The judge equally held that there tribunal was right to have held that Umar attended the secondary school he claimed to have attended.

She said there were sufficient evidence to show that Umar attended the Sultan Abubakar College, Sokoto.

Justice Ndukwe-Anyannwu proceeded to affirm the earlier judgment of the trial tribunal which dismissed the appellants’ petition and upheld that election of Governor Nasir Idris of the All Progressives Congress (APC) in Kebbi state.

One dies as police disperse pro-Palestine protest by Shi’ites in Kaduna

Aman, identified simply as Aliyu, died yesterday in Kaduna in a melee between members of the Sheikh Ibrahim Zakzaky-led Islamic Movement in Nigeria (IMN), also called the Shi’ites, and the police.

The incident occurred when the Shi’ites staged a pro-Palestine protest in the northcentral city.

The state police command said IMN members attacked the policemen drafted to disperse the “illegal” protest over the ongoing Israel-Hamas war in Gaza.

It was in the melee that Aliyu was killed.

But the Shi’ites accused the police of killing two of their men during the clash.

Reacting to the incident, Kaduna State Police Command’s spokesman Mansur Hassan, an Assistant Superintendent of Police (ASP), said: “It is a lie to say that police killed two Shi’ite members. We were only out to disperse the protesters because IMN is a proscribed organisation in Kaduna State. They were protesting against Israel and Palestine war. But this is not Israel; this is Kaduna.

“On the contrary, it was the IMN members that started firing at our men. They fired catapult with pellets at our men. In the process, they (Shi’ites) killed one civilian identified as Aliyu. They blocked the road, attacked innocent civilians passing by.”

The IMN members started the protest from the premises of the Kaduna State Council of the Nigeria Union of Journalists (NUJ), marching through Muhammadu Buhari Way to the office of the National Human Rights Commission (NHRC) to submit a protest letter.

Minutes after the protest started, policemen clashed with the protesters, firing teargas and shooting into the air to disperse them.

The protesters carried placards with various inscriptions.

Leader of the protesters, Aliyu Umar Tirmizi, explained the reason for the march.

“The Israeli occupiers have, in the past 75 years, been unleashing genocide, ethnic cleansing and apartheid on the unarmed civilians that include men, women and children (in Gaza).

“They have murdered thousands of children and the aged and have demolished houses and worship places of innocent civilians. The Zionist Israel has abused the sanctity of the holy Mosque of Al-Aqsa and terrorised innocent worshipers that visited the place,” he said.

Kaduna to build 10,000 housing units

Kaduna State Government said it is set to construct 10,000 housing units, especially for the poor in rural and urban centres across the 23 Local Government Areas of the state within the next 4 years.

The Permanent Secretary in the state’s Ministry of Housing and Urban Development, Rabiu Yunusa stated this yesterday at the 12th Meeting of the National Council on Lands, Housing and Urban Development holding at Umaru Musa Yar’Adua Conference Centre Kaduna.

The Permanent Secretary stated that, the Governor Uba Sani led government under its Urban Renewal Project, was set to put in place developmental plans that would provide housing facilities for the poor and underserved in Kaduna State.

Yunusa explained that the mass housing project conceived by the state government would provide affordable houses in the 23 Local Government Areas of the state.

According to him, the Governor Uba Sani led government has already attracted a charity organization from Qatar that would provide 500 housing units for the most vulnerable in the state.

He said: “The issue of the housing challenges in Kaduna State, is not only peculiar to the state. It’s something that affects everywhere; even the Federal Government. Luckily, the 7-point agenda of the governor is focusing on the housing gap and he is very passionate about it.

“He has already instructed us to come out with the modalities on how to close the gap and we have so many things in the pipeline which of course, we will actualize like the mass housing across the 23 Local Governments in the urban and the rural areas.

“This meeting is very important because they are the mother ministry at the federal and we are at the state. So, we want to have synergy with them so that we can find a solution on how to close the gap on the housing issue.

“Besides the provision of 500 Charity Houses under the Qatari Charity Foundation, the state government intends to provide 10,000 more houses in the next four years.”

The Director, Planning, Research and Statistics of the Federal Ministry of Housing and Urban Development, Kolapo Raheem had earlier in his remarks, said the theme of this year’s meeting was chosen in consideration of the dire need to galvanize domestic and foreign funds towards meeting the nation’s housing challenges and enhancement of the country’s overall economic growth and development.
