  • MTN kicks as govt demands for $2b ‘unpaid’ taxes

    MTN Nigeria has been asked to pay $2billion for import duties, Value Added Tax (VAT) and withholding taxes on foreign imports/payments.

    But the telco has rejected the demand, which is from the Office of the Attorney-General of the Federation.

    In a statement, the company said it had been lauded by the various tax authorities for its faithfulness on tax remittance to the Federal Government.

    It has, however, notified its stakeholders about the new demand from the Federal Government.

    The statement, which was endorsed by its Corporate Relations Executive, Tobe Okigbo, said: “MTN equally strenuously rejected the findings of the Attorney General’s investigation and believes it has fully settled all amounts owing under the taxes in question.”

    “Following the receipt of the letter from the CBN on foreign exchange repatriation, MTN Nigeria has provided an update on the company’s position on the issue. The company has also notified the market and all stakeholders that it has received a notice from the Attorney General of Nigeria that he intends to recover up to $ 2 billion of tax relating to, inter alia, import duties, VAT and withholding taxes on foreign imports/payments.

    “It is both regrettable and disconcerting that despite the historic engagements with the Nigerian authorities by MTN Nigeria, the Senate investigation into the CCI (Certificate of Capital Importations) matter, and the multiple tax assessments done by the Nigerian tax authorities over many years that were satisfactorily concluded, that these matters are being reopened.

    ”From the CBN’s own letter and subsequent statements, it is clear that there is no dispute that the capital captured in MTN’s books and for which CCIs were issued was imported into Nigeria, and this is acknowledged explicitly by the CBN. It is equally clear that Nigerian law provides for guaranteed unconditional transferability of funds through an authorised dealer in freely convertible currency relating to dividends or profits attributable to the investment, payments and in respect of loan servicing where a foreign loan has been obtained.

    “All dividend repatriation done by MTN Nigeria to its shareholders was done on the basis of its equity capital and all the historic dividends were declared against valid equity CCIs and in fact no preference dividends were declared and no interest in respect of these preference shares was paid. This means that it is incorrect to suggest that the conversion of a shareholder loan to preference shares has any relation to the repatriation of dividends. The two are simply not connected and we are trying to understand this position that the Central Bank has taken.”

    Reacting to the Attorney-General’s “demand notice” for historical tax obligations, Mr Okigbo said: “MTN has conducted a detailed review of these claims, and provided evidence of tax remittance to the Attorney General’s office. The Attorney General’s notice indicates that he is rejecting this evidence. We believe that all taxes due to the Nigerian government have been paid and these allegations have not been raised by any of the revenue generating agencies that MTN engages with regularly, and from whom MTN has received numerous awards for compliance.”

    He, however, said the telco will continue to engage with the authorities on all these matters and “we remain resolute that MTN Nigeria has not committed any offences and will vigorously defend its position”.

    Giving further update on the CBN letter on foreign exchange, the telco said the MTN Group and the original shareholders injected $402, 625,419 into MTN Nigeria between 2001 and 2006 in the form of loans and equity. These initial inflows were the basis for the issuance of various legacy CCIs obtained from Authorised Dealers in accordance with regulations. The inflow of capital has been confirmed by the CBN.

    “We were notified by the office of the AG last week that they have not accepted the documentation presented and they have given notice of an intention to recover the $2.0billion from MTN Nigeria. Based on the detailed review performed MTN Nigeria believes it has fully settled all amounts owing under the taxes in question,” the telco said.

    APC kicks as PDP sweeps council poll in Delta

    Peoples Democratic Party (PDP) in Delta State yesterday won in 23 local governments in the council elections.

    The Chairman, Delta Independent Election Commission (DSIEC), Mike Ogbodu, who declared the results in Asaba, said elections were postponed in Ughelli North and Ethiope East local governments.

    He said elections in these councils will be conducted  tomorrow.

    Ogbodu said 55 chairmanship candidates contested the poll, adding that PDP won 425 councillorship seats.

    He said All Progressives Congress (APC) won one councillorship seat in Ward 2 in Aniocha North Local Government.

    The chairman said 59 PDP councillors were returned unopposed.

    He said elections did not hold at Otor-Owhe community in Isoko North, Ozoro following an injunction by a Delta State High Court.

    APC condemned the election and called for cancellation.

    It urged the electoral body to conduct another poll that will be transparent and peaceful.

    The party Chairman, Mr. Jones Erue, in a statement alleged that sensitive election materials were not delivered as expected in most of the polling units where the elections were supposed to hold.

    He alleged that where the materials were delivered, they did not arrive in time, as most were hijacked and re-directed, adding that result sheets did not accompany the materials in most of the councils.

    Erue alleged that in places where result sheets were produced, they were in contrast with the samples presented to party officials during DSIEC training exercise.

    He said returning officers were not at polling units to conduct the elections or announce the result.

    According to him, “a DSIEC returning officer at Ozoro in Isoko North Local Government was arrested at a hotel annex in Ozoro facilitating illegal thumb-printing of votes. He was handed over to the police at Ozoro.”

    Erue said violence marred the elections in local governments and wards.

    “In fact, we learnt that DSIEC office at Ughelli was torched, while election materials were not issued.”

    His words: “We are not shocked by the outcome of the election because we had issued out a note of caution previously, warning about the potential for connivance between DSIEC and PDP officials or agents.

    “Our party was prepared for peaceful elections. Unfortunately, the people were let down, but more importantly, DSIEC demonstrated to the world that it is not yet able to deliver such an onerous responsibility for conducting peaceful elections. We recall that PDP had been boastful that APC was not on ground. However, this election has proved that to be false. The bastardisation of this election that ought to be peaceful shows PDP is a dying party, and that they were amazed by the level of preparedness, organisation and mobilisation APC mustered across the state. There is no doubt that PDP is experiencing a backlash from the masses, given the overall poor performance by its council officials and the state government that oversees the councils.

    “In all of this, we are most saddened that during the process of this election, at least three of our members were shot in Ughelli South Local Government, and not fewer than a dozen others were attacked with machetes and injured by PDP thugs, just as vehicles were damaged. We wish these gallant ones a quick recovery, just as we extend our deepest appreciation to them for standing up for what is right and just. We stand with them in their pains.

    “It is disheartening that the people have been robbed once again of their constitutional and inalienable right to freely pick leaders of their choice. This is a crime against the people, and the day is nearer when PDP will have no choice but to beckon to the voices of the people who are tired of the poverty PDP has inflicted on them over the years.”

  • NBL kicks off 2017 Maltina Teacher of the Year award

    Nigerian Breweries Plc (NBL) on Tuesday opened entries for this year’s edition of the Maltina Teacher of the Year Award.

    At the unveiling at the Eko Hotel&Sutes, Victoria Island, Lagos  on Tuesday, the firm’s Managing Director and Chief Executive Officer Mr. Nikolaas Vervelde, recalled that the initiative, which began in 2015, is to recognise and celebrate exceptional teachers nationwide.

    It remains part of the organisation’s continuous commitment to the development of education in the country, Vervelde further explained.

    Represented by the firm’s Corporate Affairs Adviser, Mr. Kufre Ekanem, Vervelde also stated that for the first time, the competition would be expanding its tentacles to accommodate teachers across private schools nationwide.

    According to him, the contest sponsored under the initiative of the Nigerian Breweries Felix Ohiwerel Education Trust Fund (NB-FO-ETF) intervention in the education sector, has brought about the construction of over 280 classrooms and 30 libraries in both primary and secondary schools across the 44 communities in Nigeria, in addition to impacting over 20, 000 students directly.

    He said the expansion of NB-FO-ETF birthed the Maltina teacher of the year, anchored on the fact that despite the sensitive role teachers play in moulding future leaders, they are often underestimated.

    According to him, collection of applications which opened on Tuesday, would last till Friday July 7, adding that interested teachers are to download application forms from the Maltina website -www.maltina-nigeria.com.

    “As it was the case in the previous editions, all duly completed applications will be subjected to an intense selection and judging process. An external and independent panel of judges has been constituted to ensure transparency, credibility and objectivity of the initiative,” he added.

    He said the five-step evaluation process of entries received would result in 37 champions (one per state and the FCT), subject to entries meeting the threshold as set by the panel of judges. From among the states champions, the teacher of the year 2017 will emerge.

    He added that all state champions and winners would be rewarded at a grand ceremony on Thursday, October 12, to also commemorate the World Teachers’ Day.

    The Maltina Teacher of the Year Award has so far produced 42 state champions and two overall winners. The maiden winner was Mrs. Nkemdillim Obi of the Federal Government Girls College, Onitsha, Anambra State, while Mr. Imo Essien, a teacher at the Special Education Centre for Exceptional Children, Uyo, Akwa Ibom State who the subsequent edition.

    Sheriff kicks as Makarfi, others form APDP

    Anxiety has hit the Ali Modu Sheriff faction of the Peoples Democratic Party (PDP) following the submission of an application to the Independent National Electoral Commission (INEC) for the registration of a party named Advanced Peoples Democratic Party.

    The commission yesterday confirmed receipt of the application believed to have come from supporters of Senator Ahmed Makarfi,Chairman of the Caretaker Committee of the PDP.

    The Sheriff camp is kicking against the formation of the new party which it perceives as a  threat.

    Some PDP members loyal to the Ahmed Makarfi camp had wondered whether it might not be better for them to abandon the  party for Sheriff and his supporters in the aftermath of the recent verdict of the Court of Appeal recognising Sheriff as the rightful chairman of the party.

    The court also sacked the Caretaker Committee headed by Makarfi.

    The Deputy National Chairman to Sheriff, Dr. Cairo Ojougboh, yesterday called moves to register  the Advanced PDP as  Advanced Free Fraud.

    Contacted yesterday on the Advanced PDP application, INEC’s spokesman, Mr. Nick Dazang said:”The Commission has received not less than 70 applications from associations seeking registration and it is processing them.

    “The association you mentioned must be one of them.”

    However, Dazang did not disclose the criteria to be used or the faction’s chance of succeeding.

    The Nation gathered that some members of the Makarfi faction of the PDP are trying to convince others of the need to form a new political party.

    “Right from the beginning, Sheriff was a big mistake; he did eight years as governor on a party platform opposed to PDP and he has never been known for the kind of brotherly compromise that our people are expecting, “ a PDP chieftain said yesterday in Abuja.

    In a telephone chat yesterday,  Dr. Ojougboh  said :”The PDP is a lawful franchise and we won’t associate with fraud.”

    He asked  PDP members and the general public not to “have anything to do with the so called Advanced PDP.”

    Attempts to get the reaction of the spokesman of the Ahmed Makarfi led Caretaker Committee, Prince Dayo Adeyeye proved abortive.

    Our correspondent’s repeated calls to his mobile telephone line did not connect and he did not reply to the SMS message in respect of the matter.

    The  Association of Senior Civil Servants of Nigeria (ASCSN) has condemned the Federal Government’s plan to sack 3,500 public servants under the guise of  illegal appointment.

    Its Secretary-General, Comrade Alade Lawal, expressed shock that the Federal Government wanted to send 3,500 employees to the labour market at a time when millions of Nigerians were dying of starvation because of the harsh economic conditions imposed on them by bad policies.

    ”The greatest tragedy of this insensitive planned retrenchment is that the association has already taken the government to court on this matter and the least we expect in a normal democratic society is for the government to allow the court process to be pursued to its logical conclusion and in the interim maintain the  status quo ante on the matter.

    “It must be emphasised that if citizens begin to disrespect the judicial process and resort to self-help as this government has been doing, sooner or later, the entire society will be engulfed in anarchy,” the Lawal stated.

    According to the group, when it got wind that the Federal Government had concluded plans to sack about 6,000 workers because they were alleged to have been illegally recruited by the last administration, the association filed a suit at the National Industrial Court (NIC) to forestall the move.

    It added that the case in suit No. NICN/459/2016 filed by the ASCSN at the NIC, Abuja, against the Head of the Civil Service of the Federation came up for hearing on February 1 and was adjourned.

    It said even if the workers were recruited from certain part of the country, what the government should do was to employ people from the other part so as to balance the imbalance instead of throwing 6,000 helpless workers into the job market.

    The ASCSN regretted that a government that came to power promising to create millions of jobs had been preoccupied with devising all forms of trickery to indulge in mass sack of Nigerian workers.

    Labour kicks against El-Rufai’s plan to sell 1,990 quarters

    The Nigeria Labour Congress (NLC) and Trade Union Congress (TUC) in Kaduna State have kicked against plans by the state government to sell 1,990 government quarters on public auction, based on their open-market value.

    The unions said the workers occupying these quarters were not given the option of first refusal before the offer was extended to the public, a situation they described as “unfortunate and unacceptable”.

    The government said it decided to sell about 1,990 of its non-essential residential quarters to cut the cost of maintaining the quarters.

    A statement by the Chairmen Comrade Adamu Ango (NLC) and Comrade Shehu Mohammed (TUC) said: “The workers of Kaduna State were taken aback by a paid advert in a newspaper relating to the sale of government quarters to political office holders disguised as highest bidders.

    “The decision of the Kaduna State Executive Council was without recourse to relevant stakeholders, especially the workers, who are the creators of wealth and the legal occupants of these properties.

    “It is very unfortunate that the workers currently occupying these quarters were never given an option of first refusal before the extension of offer to the public.

    “Another area of concern to the workers, who receive peanut as salaries and wages, when compared with political office holders, is the mode of payment – payment of 25 per cent of purchase price (including 10 per cent non-refundable deposit), must be made to the Kaduna State government within 90 days of being declared winner. The 75 per cent must be paid within an additional 90 days. Thus, all buyers must effect full payment within 180 days of contract.

    “From the above condition, tell me which state workers can afford this payment? This condition, in the first instance, is contrary to the provision of the Federal Government Mortgage Bank arrangement of issuing loans to civil servants.

    “We advice the state government to borrow a leaf from the Federal Government which, in its monetisation programme, gave workers, who are the legal occupants of government houses, an unconditional right/option of first refusal, this is more so that the Federal Government policy was midwifed by the selfsame Nasiru El-Rufa’i.”

    Nigeria has kicked against the stereotype that migrants are “desperate, parasitic and less-economic value group”.

    The leader of the nation’s delegation to the 133rd Assembly of the Inter-Parliamentary Union (IPU) in Geneva, Switzerland and House of Representatives’ Deputy Speaker, Yussuff Lasun, made this known yesterday.

    Lasun, while addressing the General Assembly of IPU, noted that migrants represent an increased market size, purveyor of skill and talent, alternative sources of labour and workforce as well as reversal of population losses.

    But he warned that before granting asylum to migrants, all states must collaborate with the INTERPOL and take appropriate steps to ensure that such persons had no link with terrorism.

    The deputy speaker said the scale, scope and complexity of migration in the world were on the increase due to conflicts and terrorism, which he blamed for creating a pool of Internally Displaced Persons (IDPs) and economic downturn, especially in Nigeria.

    He added that millions of migrants were leaving their countries in search of opportunities as well as due to social strife arising from religious fundamentalism, xenophobia, ideological intolerances, and natural disasters such as desertification, flooding, earthquake and volcanic eruptions.

    “I wish to remind us that when people migrate for any of these reasons, they carry along with them their fundamental human rights within the contest of the 1948 United Nations Universal Declaration of Human Rights (UNDHR).

    “Accordingly, whether migration within national boundaries or transnational borders, it is our responsibilities to evolve policies that respect the rights of refugees or asylum-seekers.

    “In doing so, we must recognise that all human beings are born free and it is morally and legally wrong to discriminate against any on the account of race, colour, sex, language, religion, political, national or social origin, property, birth or other status

    “It is important that we remove the stereotype of migrants as a desperate parasitic and less economic value group. In fact, if properly integrated, they will be veritable drivers of economic growth and development…

    “We accept that in the short run, they may constitute a drain of scarce natural resources and opportunities to the host country, but in the long run, migrants bring to the table all the benefits of diversity in terms of food, good, culture and services.”

    While prescribing measures that can solve the problem, Lasun urged world leaders to be mindful of the 1951 Convention that was adopted after the World War 2 and amended in 1957 to cover the whole world.

    “In the light of the foregoing, and since by definition, refugees are not protected by their own government, the international community must ensure they are safe and protected.

    “We must observe the statement of the UN High Commission for Refugee (UMHCR) that refugees deserve as a minimum the same standard of treatment enjoyed by other foreign nationals in a given country. In any case, the same treatment as nationals.”

    He availed the forum steps being taken by Nigeria to address IDPs issue.

    Lasun said: “We have established IDP camps across the country. We have persons escaping the consequences of insurgency housed on temporary basis.

    “Similarly, on July 31, 2014, a Presidential Committee on Boko Haram Victims Support Fund was established.”

    “In view of the sensitivity attached to the issue by the Nigerian parliament, the House of Representatives has established a Committee on DPs and Initiatives on Northeast.

    “In the Senate, a Bill has been introduced on the creation of Northeast Development Commission and has gone through second reading”.

    On way forward, Nigeria called on nations to deepen their democratic system by adopting inclusive practices to eliminate sources of conflicts and tensions.

  • Sacked Rivers LG service commission boss kicks

    The former Chairman of Rivers State Local Government Service Commission, Nnamdi Wokekoro, has expressed shock at the decision of the state House of Assembly to recommend his sack, which has consequently been effected by the state Governor, Chief Nyesom Wike.

    Wokekoro, who spoke in Port Harcourt yesterday through his legal representative, Mr Richard Onyeweola, said that the members of Rivers State House of Assembly were duly informed about his inability to appear before them on Thursday because he was out of the state.

    Onyeweola said that a formal letter was sent to the assembly in that regard and that his client sought a rescheduling of the appointment with the lawmakers.

    Wokekoro expressed disappointment that the lawmakers did not give him and members of the local government service commission fair hearing before they recommended their sack.

    Meanwhile, the lawmakers yesterday screened and cleared a chieftain of the Peoples Democratic Party (PDP) in Port Harcourt City Local Government, Chief Azubike Nmerukini to replace Wokekoro.

    It will be recalled that Nmerukini was the chairman of the commission before the former governor of the state, Rt. Hon. Chibuike Amaechi, removed him and replaced him with Wokekoro.

    The lawmakers also dissolved the membership of the Assembly Service Commission that was appointed by former Governor Amaechi.

    After grilling them on the floor of the House, the lawmakers accused them of illegal employment, official misconduct and financial misappropriation.

    Aregbesola kicks as Omisore alleges violence plan

    Osun State Peoples Democratic Party (PDP) governorship candidate Senator Iyiola Omisore has accused Governor Rauf Aregbesola of planning to cause violence during the August 9 poll.

    He said the governor had bought 20 Armoured Personnel Carriers (APCs), which “would be used to cause violence during the election”.

    In a statement yesterday by his media aide, Prince Diran Odeyemi, Omisore alleged that the APCs were parked inside the Government House in Oke Fia, Osogbo, the state capital.

    He said: “Aregbesola has a premeditated strategy to release these APCs for questionable use during the coming election. Why did he fail to release these armoured tanks to the police, if they were purchased for the security of the state and the interest of the masses he claims to be protecting?

    “Aregbesola has been preaching violence, even before the commencement of his campaign, and this is evident in his repeated calls on innocent citizens of Osun to arm themselves with charms and other traditional weapons when going to perform their civic responsibilities on August 9.

    “It is imperative on the part of the appropriate authorities to investigate this development because credible information at our disposal lend credence to the fact that the All Progressives Congress (APC) candidate plans to deploy the APCs to tactical use during the election and his calls for charms’ use are a diversionary approach to achieving his inimical aims.”

    Aregbesola’s media aide, Mr. Semiu Okanlawon, said Omisore is ignorant, adding that he (Omisore) is afraid of his past.

    He said: “In an apparent display of either ignorance or mischief, or both, Omisore said the acquisition of APCs is for the August 9 governorship election. In the first place, we do not know why Omisore is catching a fever over the acquisition of APCs and security patrol vans at this stage.

    “If Omisore and his handlers have forgotten, this government did not have to wait for any election before putting in place adequate mechanism to protect the peace and security of our people. Perhaps, the PDP candidate and his hangers-on believe Osun people have short memories like they do.

    “They need to be reminded that on April 5, 2013, Aregbesol, with fanfare, handed over about 120 patrol vans and five APCs to security agencies at a ceremony witnessed by an Assistant Inspector-General, Ghandi Orubebe, who represented the Inspector-General of Police.

    “If not for laziness, mischief and a determination to score cheap political point, we expect Omisore to have made inquiries in the office of the IG about what the APCs in Osun are meant for and whether the IG is aware of their presence or not.

    “At the handing over of the last batch of security equipment – including patrol vans and APCs – to various security agencies last year, Aregbesola pledged to do more if that would guarantee the security of our people and make Osun an investor-friendly state.

    “For the avoidance of doubt, below are the words of the governor at that occasion: ‘Our people will live in peace, happiness and joy under the full protection of the Almighty. The era of criminality has gone forever. It is to ensure that that era does not come back that we have done all these and we are going to do more. We have also paid for some APCs, which are more sophisticated than the ones we have now. We are about to order heavy duty motorcycles, the sound of which is enough to drive away criminally-minded people. They will be here before the end of the year. Every street will have one.’

    “Given the above statement by Aregbesola over a year ago, what then is strange and in what way has the government deviated from what it promised to do to guarantee peace. Omisore only reminds us of the popular Yoruba saying: Asebaje sebi toun lanwi, ase buruku e ku ara fu (meaning the evil-minded is permanently suspicious and agitated).

    “We advise Omisore to concentrate on his campaigns and operate within the limits of the law and civility, because the current government will stop at nothing to bring the full weight of the law to bear on anybody who violates the law, no matter his status, including, of course, those who want to hide under the guise of electioneering to perpetrate evil. Those who have no skeletons in their cupboards need not fear.”
