    Court to NAFDAC: Warn consumers against taking Fanta, Sprite with Vitamin C

    A Lagos High Court, Igbosere, Lagos State, Monday ordered the National Agency for Food, Drug Administration and Control (NAFDAC) to compel Nigeria Bottling Company (NBC) PLC, manufacturers of Fanta and Sprite soft drinks, to include a written warning that the content of the bottles cannot be taken with Vitamin C.

    Justice Adedayo Oyebanji made the order while delivering judgment in a suit filed by a Lagos businessman, Dr Emmanuel Fijabi Adebo and his firm, Fijabi Adebo Holdings Ltd against the NBC and NAFDAC.

    The court warned that taking Fanta and Sprite with Vitamin C is poisonous and awarded a cost of N2 million against NAFDAC for failing “to live up to expectations.”

    It declared that NAFDAC failed the citizens of Nigeria by its certification as satisfactory for human consumption, products which in the United Kingdom (UK) failed sample test for human consumption and which became poisonous in the presence of Ascorbic Acid ordinarily known as Vitamin C, which can be freely taken by unsuspecting members of the public with Fanta and Sprite.

    The plaintiffs had urged the court to declare that the NBC was negligent and breached the duty of care owed to its customers and consumers in the production of what it argued was contaminated Fanta and Sprite soft drinks with excessive “benzoic acid and sunset” addictive.

    Fijabi also urged the court to direct NAFDAC to conduct and carry out routine laboratory tests of all the soft drinks and allied products of the company to ensure and guarantee the safety of the consumable products, produced from the NBC factory.

    The plaintiffs’ counsel Mr Abiodun Onidare  in an amended statement of claim alleged that sometime in March, 2007 Fijabi Adebo Holdings purchased large quantities of Coca-Cola, Fanta Orange, Sprite, Fanta Lemon, Fanta Pineapple and Soda Water from the NBC for export to the UK for retail purposes and supply to their customers in the UK.

    They said, among others, that when the consignment of the soft drinks arrived in the UK, fundamental health related matters were raised on the contents and composition of the Fanta and Sprite products by the UK health authorities, specifically the Stockport Metropolitan Borough Council’s Trading Standard Department of Environment and Economy Directorate.

    The claimants alleged further that NAFDAC failed to carry out necessary tests to determine if the soft drinks were safe for human consumption.

    The claimants demanded N15, 119,619.37 as special damages and N1, 622,000 being the money admittedly received from the claimants.

    However, NBC in its amended statement of defence filed by Mr. T. O. Busari admitted supplying the products but contended that the products manufactured by it were meant for local distribution and consumption as the firm does not manufacture its products for export.

    It denied that it was negligent in the manufacturing of its products as alleged, stressing that stringent quality control procedures were adopted in its production process to ensure that its products were safe for consumption.

    The firm denied that the damages alleged by the claimants were occasioned by its negligence or any fault from the company as the level of the chemical components in its soft drinks is safe for consumption in Nigeria.

    NAFDAC did not file any defence.

    In her judgment, Justice Oyebanji said: “It is imperative to state that the knowledge of the Nigeria Bottling Company that the products were to be exported is immaterial to its being fit for human consumption. The court is in absolute agreement with the learned counsel for the claimants that soft drinks manufactured by Nigeria Bottling Company ought to be fit for human consumption irrespective of colour or creed.

    ”It is manifest that NAFDAC has been grossly irresponsible in its regulatory duties to the consumers of Fanta and Sprite manufactured by Nigeria Bottling Company. In my respective view, NAFDAC has failed the citizens of this great nation by its certification as satisfactory for human consumption, products which in the United Kingdom failed sample test for human consumption and which become poisonous in the presence of Ascorbic Acid ordinarily known as Vitamin C, which can be freely taken by the unsuspecting public with the company’s Fanta or Sprite.

    ”As earlier stated, the court is in absolute agreement with the learned counsel for the claimants that consumable products ought to be fit for human consumption irrespective of race, colour or creed.

    ”By its certification as satisfactory, Fanta and Sprite products manufactured by Nigeria bottling company without any written warning on the products that it cannot be taken with Vitamin C, NAFDAC would have by its grossly irresponsible and unacceptable action caused great harm to the health of the unsuspecting public.

    ”The court, in the light of the damming evidence before it showing that NAFDAC has failed to live up to expectations, cannot close its eyes to the grievous implication of allowing the status quo to continue as it is.

    ”For the reasons herein adumbrated in this judgement, the court hereby orders as follows:

    ”That NAFDAC shall forthwith mandate Nigeria Bottling Company to, within 90 days hereof, include on all the bottles of Fanta and Sprite soft drinks manufactured by the company, a written warning that the content of the said bottles of Fanta and Sprite soft drinks cannot be taken with Vitamin C as same becomes poisonous if taken with Vitamin C.

    ”In consideration of the fact that this case was filed in 2008 and that it has been in court for nine years, costs of N2 million is awarded against NAFDAC. Interest shall be paid on the costs awarded at the rate of 10% per annum until liquidation of the said sum.”

     

  • N6.8bn fraud: How ex-NAMA officials made withdrawals – Bank official

    An official of Stanbic IBTC Bank, Mr Ade Babatunde, on Monday told a Federal High Court, Lagos, how Segun Agbolade, a former General Manager (Finance), Nigerian Airspace Management Agency (NAMA), defrauded the agency.

    Babatunde, while being led in evidence by the EFCC prosecutor, Mr Rotimi Oyedepo, made the revelations at the resumed hearing of the case before Justice Babs Kuewumi.

    The News Agency of Nigeria (NAN) reports that Oyedepo had led the witness as the first prosecution witness (PW 1) in the N6.8 billion fraud case against some former employees of NAMA.

    NAN reports that EFCC had arraigned the accused including NAMA’s former Managing Director, Ibrahim Abdulsalam; former General Manager of Procurement, Olumuyiwa Adegorite and Agbolade on a 21-count charge of N6.8 billion fraud.

    Others are former acting General Manager of ICT, Bolaniran Akinribido; Sesebor Abiodun, Joy Adegorite and two companies- Randville Investment Ltd. and Multeng Travels and Tours Ltd.

    When the case was called for continuation of hearing, Babatunde told the court how the funds belonging to NAMA were allegedly converted for personal use by the accused when Abdulsalam was at the helm of affairs.

    He said that on July 13, 2015, a cash withdrawal of N3 million was made by Agbolade, (General Manager of Finance) from the account of Randville Investment Ltd.

    The witness also said that on July 15, 2015, there was another withdrawal of N2.5 million from the account of Randville Investment Ltd. and same was transferred to the account of Agbolade.

    “On Sept. 16, 2015, there was a credit transfer of N22 million into the account of Randville Investment Ltd.

    “On Sept. 28, 2015, N100 million was deposited in a fixed deposit account, and on maturity, same was paid into the account of Randville Investment Ltd.

    “On the same date, N28 million was transferred out of the account, but I cannot confirm the beneficiary, because it was not stated in the statement of account.

    “Also, on Sept. 28, 2015, N100 million was placed in another fixed deposit account.

    “On Oct. 28, 2015, the N100 million earlier placed in a fixed deposit account was paid into the account of Randville Investment Ltd.

    “On Nov. 2, 2015, N50 million was transferred twice from the Randville Investment Ltd. and I cannot also confirm the beneficiary, because it was not stated in the statement.

    “Then, on Nov. 10, 2015, there was a withdrawal of N3 million from the account of Randville Investment Ltd. by Segun Agbolade.” the first prosecution witness told the court.

    After the witness’ testimony, the defence counsel led by Mr Wale Akanni (SAN), sought for an adjournment to enable to them to cross examine the witness.

    The judge, however, granted the request, and the case was adjourned till April 5 for continuation of trial.

    NAN reports that EFCC had on Aug. 19, 2013, brought the accused before the court, accusing them of conspiring to induce NAMA to deliver N2.8 billion to Delosa Ltd., Air Sea Delivery Ltd. and Sea Schedules Systems Ltd.

    The anti-graft agency of alleged that the delivery was under the pretence that the money represented the cost of clearing NAMA’s consignments.

    EFCC further alleged that between Jan. 2 and Dec. 17, 2013, the accused allegedly converted N191 million belonging to NAMA for their private use.

    It also accused the NAMA officials of converting N728 million between 2013 and 2015 and other sums for their personal use.

    The prosecution said that the offences contravened Section 8(a) of the Advance Fee Fraud and other Fraud Related Offences Act, 2006 and punishable under Section 1(3).

     

  • Fear grips Ikorodu community as militants return to terrorise Isawo residents

    Residents of Isawo in Ikorodu, Lagos State, say they now live in palpable fear following the return of militants who are terrorising people in the area.

    The News Agency of Nigeria (NAN) recalls that the militants, mostly kidnappers and pipeline vandals, were chased out of the area in August last year following bloody clashes in the community.

    NAN reports that scores of people were killed in 2016 during clashes between militants and residents of Isawo community, leading to the deployment of a joint military taskforce in the area.

    Residents told NAN on Monday that many of the hoodlums had returned to Isawo and neighbouring communities, robbing and terrorising residents.

    “The militants are back to Isawo area. They brandish guns openly during daytime and rob people at night; many residents are now living in fear.

    “The men are boasting that they are back to revenge the killings of their people in Isawo last year.

    “For instance, Olusola Oke Street junction in Isawo near Majidun is one of the militants’ meeting points where they smoke Indian hemp openly.


    “Residents don’t go out daily until 7a.m, and before 6 p.m., everyone is back home,’’ a female resident, who pleaded anonymity, told NAN in Isawo.

    She said some residents had relocated from the area for their safety since the return of the hoodlums.

    Another resident, who also sought anonymity, told NAN: “When we thought that these people were gone forever, they came again.

    “We want the military and the police to check them before they start killing again.’’

    Reacting to the development, ASP Olarinde Famous-Cole, Lagos State Police spokesman, told NAN that the command was re-strategizing the security arrangements in the state, including Ikorodu area.
    Famous-Cole said more police patrol teams would be deployed in the area, and urged residents to provide useful information on the activities of the hoodlums.

    , told NAN :”I don’t have any report yet to suggest that militants are back in those areas.

    “But Lagos State Governor has approved the return of swamp buggies to open up the creeks in those areas to enable us carry out in-depth patrols,” he said.

    The swamp buggy is a motor vehicle used to traverse boggy swamp terrain.

    Buggies are able to move about on dry land, shallow mud, sand, shallow water and deep mud.

    NAN recalls that the Inspector-General of Police, Mr Idris Ibrahim, on Aug. 4, 2016 visited Isawo creeks in Ikorodu neighbourhood over the activities of militants.

    Fashola restates commitment to serve the people of Lagos

    Mr Babatunde Fashola, the Minister of Power, Works and Housing has restated his commitment to serve the government and people of Lagos in accordance with necessary due process.

    Fashola said this in a statement issued in Abuja on Friday by Mr Hakeem Bello, his Special Adviser on Communication.

    The minister also pledged to treat the request of the state on merit just as would be done to other states.

    Fashola was reacting to statements credited to Governor Akinwumi Ambode of Lagos State that the “Federal Ministry of Works” was frustrating the efforts of his administration to carry out a “total reconstruction of the International Airport Road from Oshodi’’.

    The governor had also accused the ministry and security services of denying the state government access to the Presidential Lodge in Lagos, six months after approval was granted by the President.

    According to Fashola, his response is to ensure that members of the public are not misled by deliberate or inadvertent statements.

    He said the allegations of lack of cooperation from the Ministry and frustration of Lagos State Government development initiatives were not true.

    Fashola said that the ministry had in 2016, approved the use of the Federal Ministry of Works yard at Oworonsoki by Lagos State Government to create a lay-by to ease traffic.

    He said Lagos State was granted rights to manage the Street Lighting on the 3rd Mainland Bridge to support the security initiatives of the state.

    Fashola said in the same year, the ministry also supported approval of the World Bank Loan of 200 million dollars to the state, a request the previous administration had denied the state.

     “For the International Airport Road, the correct position is that the Lagos State Government presented a request for four roads that it would wish to take over.

    “This is consistent with the position being canvassed by the minister for states that are interested to apply to take over roads that are within their states.

    “The ministry has presented the memorandum conveying the request of the state to the Federal Executive Council (FEC) as was done with a similar request by the Kaduna State Government in 2016,” he said.

    He said FEC could not reach an immediate decision due to the fact that two of the roads also connect Ogun State and so, requested for the input of Ogun State Government.

     

    Fashola stated that the Presidential Lodge was under the management of the presidency and not the ministry.

     

    He said a directive was issued to the ministry to work out modalities for the handing over after approval by the president.

     

    Fashola said the ministry had prepared a vesting instrument to convey the transfer, stating that the Presidential Lodge was a high security location.

     

    He said access to the lodge was not under the control of the ministry, noting that officials of the ministry also required security clearance to enter the lodge for any work.

     

    “If there is any lack of co-operation, it is on the part of the state government that has refused to approve the ministry’s request for Land for the National Housing Programme in Lagos.’’

    Ande Africa maps entrepreneurial ecosystem of Lagos

    Most humans are entrepreneurs because the will to create—and to survive and strive to prosper is encoded in our DNA. But it doesn’t mean we should all start companies.

    We embrace Reid Hoffman’s view on entrepreneurship and see it first-hand in Lagos. Nigeria’s economic nerve centre constantly attracts big numbers of people pursuing fortunes and dreams. For entrepreneurs here, starting and growing a business can be really tough. But the will to create new opportunities have driven many to start one of several online platforms that has emerged in recent years.

    As young Nigerian entrepreneurs continue to create, the need to map and support these businesses becomes more pressing. Questions like— what support systems are needed to back entrepreneurs behind these businesses? Who are the intermediary organizations supporting entrepreneurs? How do we engage them and facilitate more support for entrepreneurs? The Aspen Network of Development Entrepreneurial (ANDE) is an organization that works with intermediary organizations that provide this kind of support to local entrepreneurs.

    We recently hosted an event in Lagos and presented the Lagos Entrepreneurial Ecosystem Snapshot. With support from Citi Foundation, the goal of this ecosystem is to provide better insight about the business environment, local support systems, and entrepreneurial intermediaries in and around Lagos and Abuja (Nigeria) and Accra (Ghana). It will also map the organizations supporting small and growing businesses (SGBs), and identify those gaps, challenges, and opportunities within the entrepreneurial ecosystem in these locations.

    This project will provide much needed intelligence for organizations to understand their role within the entrepreneurial ecosystem, identify potential partners, and serve as a reference for entrepreneurs to identify where to access certain types of support.

    “To be able to tackle various challenges in the Lagos entrepreneurial ecosystem, actors need to find a way to collaborate and not just compete,” said ANDE West Africa Chapter Coordinator, Olatunji Ajani, highlighting key findings alongside ANDE West Africa Regional Chapter Consultant Joshua Adedeji. According to him, “poor access to finance, lack of collaboration and /coordination among actors supporting entrepreneurs, difficulty in finding competent and skilled talent, and high- cost of rent are amongst the most pressing challenges.”

    Key stakeholders who presented at the discussion on the 10th of February included ANDE steering committee members: Peter Bamkole (Enterprise Development Centre), Nneka Eze (Dalberg Global Development Advisors), and Mobola Onibonoje (Alitheia Capital). Other organizations such as AMSCO, WEConnect International, Ashoka, Fate Foundation, Leap Africa, CSR-in-Action, Bolseth Group, MEST, and Idea-Nigeria were also in attendance.

    Representatives from Youth for Technology Foundation, Mind+, Makers Academy, WAVE Academy, E-green, MITIMETH, Sceptagon International, Third Sector Development Solution, and Unlock Consulting, among others met in small groups to discuss the findings and recommend how to close the gaps.

    According to Mr Adedeji, similar stakeholder meetings will be held in Abuja and Accra in March to get input from actors in the entrepreneurship community in those cities. The final entrepreneurial ecosystem snapshot will be released towards the end of second quarter of 2017.

    2017 UTME will be hitch-free – JAMB

    Mr Sunday Aladegbaye, Lagos State Coordinator of the Joint Admissions and Matriculation Board (JAMB), has said that all the 2017 Unified Tertiary Matriculation Examination (UTME) intending candidates will experience a hitch-free examination.

    Aladegbaye said this on the sidelines of the Parents’ Forum organized by the Management of the King’s College on Thursday in Lagos.

    According to him, there will be no compromise in the accreditation of centres to be used for this year’s UTME.

    He said that measures were being taken to avoid technical hitches.

    The News Agency of Nigeria (NAN) reports that some candidates that sat for the examination in 2016 complained of technical challenges in some of the centres.

    Such hitches ranged from malfunctioning of computers to poor power supply.

    This resulted to moving affected candidates to other functional centres.

    “We have taken time to go round designated centres in the states, in order to ascertain the level of functionality of their computers, the backups and other requirements.

    “Where we find missing gap, we dropped such centres immediately and those that meet requirements, we recommend them to management.

    “We will continue to insist on accreditation of well-equipped centres; no more, no less.

    “This is because, as a parent myself, I will not do anything that will compromise the future of my children,’’ Aladegbaye said.

    NAN learnt that the board would begin the sales of its registration documents for the UTME before the end of March.

    The coordinator warned candidates not to fall prey to some desperate persons, who had been defrauding innocent Nigerians in the guise of selling registration documents.

  • Man in court for asaulting girlfriend over cash

    A 37-year-old man, Chibuke Nwachukwu, on Wednesday appeared before a Badagry Chief Magistrates’ Court for allegedly injuring his girlfriend with a cutlass following an argument over money.

    The accused, whose address is unknown, is facing a charge of assault.

    The Prosecutor, Insp. Akpan Ikem, told the court that the accused committed the offence on Feb. 28, at Small London, Seme border.

    He said that the accused and the complainant, Miss Glory Raymond, got into an argument over money when the former carried out the act.

    “He was supposed to give her money, but his continual refusal resulted into a heated argument between both of them.

    “During the argument, the accused used a cutlass to inflict injuries on the left hand of the complainant,” he said.

    Ikem said that the offence contravened Section 171 of the Criminal Law of Lagos State, Nigeria 2011.

    The section prescribes three years imprisonment for an offender.

    The accused, who was not represented by a counsel, however, pleaded not guilty to the offence.

    The Magistrate, Mr Jimoh Adefioye granted bail to the accused in the sum of N100, 000 and two sureties in like sum.

    He adjourned the case till April 12, for further hearing.

    INEC caution residents against illegal voters registration

    The Independent National Electoral Commission (INEC) in Lagos State on Wednesday cautioned residents against illegal registration of voters going on in Ikorodu area of the state.

    Mr Femi Akinbiyi, the Head of Publicity and Protocol of INEC in the state, said in a statement that the commission had not started registration of voters in any part of the state.

    “It has come to the notice of INEC that some unscrupulous elements in the society have been engaging in illegal registration of voters in Ikorodu Local Government Area of Lagos State.

    “For avoidance of doubt, the commission in the state has not commenced registration of voters in any part of the state.

    “Appropriate notice will be issued to the general public when the registration commences,” Akinbiyi said.

    He said that law enforcement agencies had been informed of the development with a view to apprehending the criminals behind the illegal act.

    “The general public is kindly requested to furnish the office with information regarding any such illegal registration,” Akinbiyi said.

    He said that the public could also contact security agencies and give useful information such illegality.

    The News Agency of Nigeria (NAN) reports that the incident is coming as the Lagos State Independent Electoral Commission (LASIEC) is urging registered voters who have yet to collect their Permanent Voter Cards to do so.

    According to the commission, this will enable them to cast their votes in the forthcoming elections into the 20 Local Governments and 37 Local Council Development Areas of the state.

    Though the commission has yet to announce a specific date for the election this year, it has started holding stakeholders’ forum ahead of the poll.

    Dalung, Ambode to inspect National Stadium on Wednesday

    The Minister of Sports, Solomon Dalung and Governor  Akinwunmi Ambode of Lagos State  will  inspect the National Stadium Surulere Lagos on Wednesday to assess the level of work to be done there. They will also visit the various youth centres in the state within two days.

    The inspection kick starts what will eventually end up as a cooperation between the federal government and Lagos state to renovate the National Stadium. The edifice has continued to dilapidate after the last international game was played in the main bowl in 2005.

    The Lagos state Governor Mr Akinwunmi Ambode expressed intent to give the stadium a face lift last week, when he paid a courtesy and condolence visit to the Minister of Youth and Sports Barrister Solomon Dalung in Abuja.

    “I will like to bring the National stadium to life. The last time a game was played at the National Stadium was in 2005. If this project pulls through, it will bring about the employment aspect of football and hosting of matches at the stadium. We want to bring back the football culture of Lagos state to the National Stadium after its renovation” Governor Ambode said.

    Most stadia in the country had been up for concession following federal government’s inability to fund the renovations of most of the football grounds.

    According to the Minister, “We were trying to drive a concession but Lagos state’s interest in the National Stadium is what we call an overriding interest which is based on equity. If Governor Ambode is interested in the National Stadium then the concession process is already abated” Dalung said.
