    A country without lawyers is blessed

    Any patriotic Nigerian would be bothered by the pensive mien of the Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi, as he addressed a gathering of legal eggheads, including the Chief Justice of Nigeria (CJN), Kudirat Kekere-Ekun, at the Supreme Court complex in Abuja on Monday. His low and shaky voice betrayed the weight of the embarrassment he felt from the shame and disgrace some lawyers have brought to the bar in recent times.

    “It is for this reason that my office has now taken the unusual step of verifying the authenticity of this and other complaints with a view to referring them to the appropriate disciplinary bodies,” he said. The AGF was referring to a recent incident involving the alleged inglorious bid by flamboyant lawyer, rights activist and Senior Advocate of Nigeria, Chief Mike Ozekhome, to take possession of a London property belonging to the late former Minister of the Federal Capital Territory (FCT), Lt-Gen. Jeremiah Useni.

    As the story goes, the property, House 79 Randall Avenue, London NW2, was purchased by Useni in 1993, using the name ‘Tali Shani’. But following his death in January this year, Ozekhome moved to take ownership of the property and, in the process, got himself entangled in a messy case that bordered on forgery, impersonation, corruption and conspiracy.

    Trouble began when Ozekhome sought to register the said property, which he claimed was transferred to him by the owner, ‘Mr Tali Shani’, in August 2021 as a gift and out of gratitude for the many legal services he (Ozekhome) had rendered to him in the past. Unfortunately for the SAN, another ‘Tali Shani’, a female, represented by her solicitors at the London tribunal, had also laid claim to the property.

    Thus began a legal battle with claims and counter-claims that exposed both parties as nothing but two bands of impostors desirous of reaping where they did not sow. “The final outcome of this case, therefore, is that both parties have failed. Neither ‘Tali Shani’ was who they said they were… The real owner, via a false name, was General Jeremiah Useni,” the judge declared, leaving the activist lawyer and his rival crestfallen.

    Of course, any well-meaning Nigerian would be disappointed with what transpired at the London tribunal, but only a few would be surprised, knowing that the Nigerian Bar Association (NBA), the umbrella body of lawyers to which Ozekhome belongs, has hardly conducted itself in a more dignifying way in recent times. Put more succinctly, its public conduct in recent times has fallen far short of the expectations of patriotic Nigerians.

    A few months ago, the body was up in arms against Ibok Ete Ibas, the administrator appointed for Rivers State in the aftermath of the state of emergency declared by President Bola Ahmed Tinubu, for daring to complain that it collected a whopping N300 million from the state government but failed to honour an agreement that its annual national conference would be held in the state. Instead, the conference was moved to Enugu State, where another huge sum must have changed hands.

    Rather than show remorse for what was an obvious act of betrayal, the body brazenly declared that the money in question was a gift from the Rivers State Government and not something concomitant on any form of obligation! The situation has caused many to wonder what would be left for governance if every professional body becomes a recipient of such gifts.

    Sadly, the NBA thinks nothing of the aforementioned scandals, but was quick to demand a probe into Ibas’ tenure as the administrator of Rivers State as well as the recent Afriland fire outbreak that claimed some lives in Lagos recently.

    On the basis of its antics, the only reason the NBA has not been tagged a political party is that it is yet to officially register as one. Every of its gathering is laced with campaign, especially against the administration of President Tinubu as was witnessed during its recent conference in Enugu where, in a partisan theatrics, Channels Television presenter Seun Okinbaloye led the lawyers in an open ridicule of the President and his government. It was a repeat of the caricature they made of Vice President Kashim Shettima as the running mate of Tinubu and guest at their annual conference in the build-up to the presidential election in 2023.

    Law, it must be said, is nothing but an assemblage of moral values and the consequences for their violation arranged in sections and sub-sections. Without ethics, it is nothing better than a car without an engine. That, unfortunately, is the lot of Nigeria with NBA’s scant regard for morality. It would not be a surprise if the people charged with designing the academic curricular of universities and law schools are already contemplating blacking out ethics the same way former President Olusegun Obasanjo directed that History be wiped out from schools.

    The special treatment accorded two new entrants into the legal profession, Dino Melaye and Deji Adeyanju, over and above established lawyers with immense contributions to Nigeria’s legal jurisprudence during a recent gathering of the body is danger signal that worse days await the bar unless there is proper re-orientation of the new generation of lawyers. AGF Fagbemi’s declaration on Monday that he had started a probe into the messy property controversy in the United Kingdom could be a good starting point.

    An Ikeja Special Offences Court yesterday heard how a lawyer Emmanuel Ironsi Okoroafor allegedly defrauded his client, Oketola Adewole, of N73million for perfecting land title.

    Adewole stated this while giving evidence before Justice Olubusola Okunuga.

    Led in evidence by the Economic and the Financial Crimes Commission (EFCC) Prosecuting counsel, Ahmad Usman, the witness told the court that the defendant was his lawyer

    “I have a friend Paul Adeyemi, he is a police man, he was the one that introduced Emmanuel Okoroafor to me as his lawyer and assured me that I could use him if I had any legal issues” he said

    The witness, a fisherman and a businessman, confirmed  that he had so many legal activities with the defendant.

    “The first work he did for me was when my uncle purchased a flat. He prepared the agreement for me and I paid him N200,000. The second was when I wanted to sponsor a community. He prepared an agreement for me and I paid for into his wife’s account because they have a joint account.

    “Also, when I had an issue with the EFCC in Abuja, he came with me and I sponsored all the bills.”

     Adewole further told the court that he owns a land at Gedegede Waterfront, Lekki, Lagos, about four plots and that  the defendant suggested that he would perfect the land title for him.

    “One fateful day, he said to me, ‘Chief Benson, this your land at Gedegede Waterfront, what documents do you have for it?  I can’t develop that place without genuine documents’.”

    He said he could get the documents for the land. I believed and accepted his advice,” he said.

      The witness added that the defendant said he would bring a surveyor from the Surveyor-General’s office to measure the land.

    “We fixed a date to meet; myself, Emmanuel Okoroafor and Peter Tyson from the Surveyor-General’s office. We walked through the land and nobody embarrassed us.

    “Peter Tyson measured the land and said the total cost for the survey and everything is N35million which I told him I don’t have. He, then, said I should bring N18million.”

    The witness also added that the defendant said Tyson is working in a ministry and that such an amount couldn’t be paid into his account.

    Lawyer seeks order to stop police harassment of colleague

    Activist lawyer, Kabir Akingbolu, has  requested a Lagos High Court  to restrain the Lagos State Commissioner of Police, the Deputy Commissioner of Police in charge of the State Criminal Investigation Department (SCID), Panti, and one, Gbenga Osho, from further harassing and intimidating a female lawyer, Bolanle Kikelomo Akande.

     Akande, who is from the law firm Bola Awo-Onidanla & Co., filed the case through her counsel,  Kabir Akingbolu.

    She is asking the court to declare that the police’s involvement in her harassment at the request of Gbenga Osho is illegal and unconstitutional, violating her fundamental rights to dignity, personal liberty, privacy, and freedom of movement as protected under the Nigerian Constitution.

    In the suit, Akande also accuses the police of unlawfully laying siege to her law firm to conduct an illegal search without a warrant. She claims this action violates her constitutional rights to privacy and family life as guaranteed by Section 73 of the 1999 Constitution of Nigeria.

    Akande is seeking damages of N10 million as compensation for the unlawful harassment and intimidation she allegedly experienced on September 19 and 20, 2024.

    In addition, she has requested the court to compel the respondents to issue a public apology in two national newspapers.

    A property transaction in which the first respondent, Gbenga Osho, was a property vendor, while Akande’s client, Joseph Adelani Sodiya, was the buyer.

     The property in question is located at Block 8, Room 15, Sogunro LSDPC Housing Estate, Ogba, Ikeja, Lagos.

    The transaction reportedly became contentious, with Osho allegedly threatening both Akande’s client and her law firm.

    Despite several attempts to resolve the matter, Osho allegedly resorted to harassing Akande and vandalizing her client’s property.

    On July 27, 2024, Akande discovered that her law office had been broken into, with several files, including documents related to the disputed property, missing.

    This incident was promptly reported to the police.

    Although the police initially investigated the matter and invited Osho for questioning, Akande alleges that Osho subsequently began threatening her, claiming he had powerful connections within the police.

    On September 19, 2024, Akande received a call from the SCID, Panti, summoning her for interrogation, which she attended. Despite being released without charges, Akande claims the harassment continued.

    On September 21, police officers allegedly visited her office to conduct a search, refusing to present a warrant. Akande contends that the search was conducted unlawfully, and the repeated police actions have caused her embarrassment and disrupted her legal practice.

    Akande asserts that her rights to privacy, liberty, and dignity have been severely violated by the police’s actions.

    She is therefore seeking court’s intervention to stop the harassment and to restore her peace of mind as a respected legal practitioner with over 25 years of experience.

    Human rights lawyer, Oghenejabor Ikimi, has condemned security agencies for parading suspects, saying it violates their rights, as well as portrays Nigeria in bad light, internationally.

     Ikimi, the Executive Director, Centre for the Vulnerable and Underprivileged (CENTREP), listed the security agencies as the Nigeria Police Force, Nigerian Army, the Economic and Financial Crimes Commission (EFCC).

    In an interview, Ikimi said: “EFCC is not the only organisation parading their suspects in open glare; all the security agencies are doing it – the Army , the Police are doing it. But it is wrong. It violates the fundamental rights of the suspect.

    “The suspect has rights, the suspect is entitled to his fundamental human rights even in the custody of the police or other security agencies. But just because each of these agencies want to outdo the other, the parade suspects as if we are the most criminal minded people in the whole world,” the lawyer stated.

    He explained that all over the world, particularly in developed nations, criminal suspects exist, but the countries knowing the negative impact of such publicity do not put them in the open.

    Lawyer lifts Kwara students through foundation

    No fewer than 10 indigenes of the Babanloma community in Ifelodun Local Government Area of Kwara State, who are students of different higher institutes have benefitted from this year’s scholarship award by the Otunba Gbofinniyi Educational Foundation (OGEF).

    The foundation’s founder, an Abuja-based lawyer, Otunba Tunde Falola, said he conceived the idea of the award during the conferment of the chieftaincy title of  Otunba Gbofinniyi of Babanloma on him on July 15, 2023 by the community’s traditional ruler, Oba Muhammed Usman Jimoh Allara, Ilufemiloye 1 Loma of Babanloma.

    It was learnt that the chieftaincy title was in recognition of his contributions towards the development of the community and the preservation of its territorial integrity, using the instrumentality of law.

    This year’s award, which is the maiden edition, it was further learnt, is part of Falola’s efforts to give back to the society and assist the indegents to attain their educational aspiration.

    A statement jointly signed by Falola and the Secretary of awardees’  selection committee, Alhaji Raheem Ogunola revealed that “the beneficiaries of the award were selected randomly from various institutions of higher learning, with special attention on gender balance and religious equality.”

    According to the statement, each of this year’s awardees got N50,000 bringing the total amount to N500,000.

    The statement added: “The gesture is in line with his (Falola’s)  foundation’s mission of contributing to the educational advancement of the Babanloma community and the vision of becoming one of the reliable organisations that offer humanitarian services within the community.“The idea behind the establishment of the foundation is to offer more contributions towards the progress of the community, by choosing the education sector as a major area of focus.

    “Through the foundation , the educational advancement of Babanloma students is assured of a brighter future.

    “This year’s scholarships award also coincides with the one-year anniversary of the conferment of the chieftaincy title on the Otunba himself,” the statement said.

    The first five awardees are university students. They are:

    • Falola, Doyinola Moyinoluwa, from the Fadeyi compound in Babanloma, a Law student at the Redeemer’s University, Ede, Osun State.

    • James, Okikiola Henry of the Atari compound in Babanioma, a student of Statistics at the Federal University of Technology, Minna, Niger State.

    • Bolaji, Olajide Abosede of the Aperin compound in Babanioma, a student of Public Health at the Kwara State University, Malete, Kwara State.

    The other five are drawn from the polytechnic and colleges of education and health sciences. They are:

    • Kosalamola, Ruth Oluwatosin of the Onigbajamo compound in Babantoma, a student of Biology at the Kwara State College of Education, Ilorin, Kwara State.

    • Soliu, Abibu Olamilekan of the  Oluode Olokuta compound, a student of Community Health at the Ibrahim College of Health Science and Technology, Zuru, Kebbi State.

    • Kolawole, Tititayo Christiana of the Fadeyi compound, a student of Banking and Finance at the Kwara State Polytechnic, Ilorin.

    • Adebayo, Ramota Onaolapa of the Alagbala compound, a student of Business Administration at the Kwara State Polytechnic, Ilorin, Kwara State.

    • Alabi, Baliqeez Titilayo  of the Ajibola Area compound, a student of Nursing and Midwifery at the Kwara State College of Nursing and Midwifery, Oke-Ode.

    Lawyer cleared of fraud allegation

    A former Chairman of the Surulere Lawyers Forum (SLF), Chief Fred Onyeka, has been cleared of the allegation of embezzling N100,000.

    Another former chairman, Mrs. Chioma Ferguson, made the allegation on the Forum’s WhatsApp platform.

    Onyeka was chairman from 2012 to 2014, while Ferguson served from 2014 to 2017.

    Onyeka had demanded an apology from her and threatened to sue and file a complaint with the police if she did not substantiate her claim.

    Ferguson made the allegation on June 1 but did not provide proof despite a demand for it by Onyeka through his counsel.

    However, elders of the forum intervened, following which Ferguson and Onyeka agreed to settle.

    They met at the office of Chief Olusegun Fabunmi (SAN) on June 10.

    Parties resolved: “That both Chioma Ferguson and Chief Fred Onyeka have agreed to resolve the issue between them amicably;

    • “That Chief Onyeka has not committed any wrongdoing;

    • “That Mrs Ferguson and Chief Onyeka have agreed that this matter will not be mentioned again between them;

    • “That both parties have agreed to discontinue all present and contemplated legal actions.”

    Witnesses at the meeting were Chief Fabunmi (patron), Mr Biodun Ogundeji (patron), Otunba Martin Ogunleye (former chairman), Prince Eddy Njoku (chairman) and Eno Mbanugo (Vice Chairman).

    Ferguson had alleged that Onyeka withdrew the sum from the Forum’s account and was “yet to account for it till date.”

    Onyeka said the allegation was highly defamatory of his professional reputation as he never tampered with the Forum’s funds.

    He said he was shocked when his attention was drawn to the allegation, which never came up previously at any of the Forum’s meetings.

    “I must express my unmitigated shock and utter surprise at this allegation. I have never heard of this before,” he had said.

    According to him, even when he was invited to render an account after his tenure, no mention was made of any missing N100,000.

    “There were no SLF properties in my possession. After Mrs Ferguson took over, she sent a lady who came to my office to collect a few files and photographs in my possession.

    “There was no mention of N100,000 embezzlement. At the end of my narration, the House resolved that all issues had been resolved

    “This attack on my person is extremely provocative and if not refuted to the zenith is deeply damaging.

    “I urge SLF to independently investigate these allegations. 

    “I call for a copy of the statement of the account during my tenure and request for expenditure details with specific proof of my embezzlement of any N100,000.

    “I request total and open investigation/enquiry with immediate effect and without delay,” Onyeka had stated before he was cleared.

    Former Chair of Surulere Lawyers Forum (SLF), Fred Onyeka, has demanded an apology from a colleague, Mrs Chioma Ferguson, who accused him of embezzling the forum’s N100,000.

    Ferguson made the allegation in a post on the forum’s WhatsApp platform.

    Onyeka, through his counsel, issued her a two-day ultimatum to apologise for the allegation, “failing which we shall petition the police, Legal Practitioners Disciplinary Council (LPDC) and file a writ at Lagos High Court”.

    Mrs Ferguson alleged Onyeka withdrew over N100,000 from SLF account and that the “money he is yet to account for till date.” Onyeka said the allegation was defamatory of his reputation.

    “I demand the specific time(s) and dates after my tenure that I embezzled money from the SLF account,” the lawyer said.

    Onyeka said he was shocked when his attention was drawn to the allegation, which never came up previously at any of the forum’s meetings.

    “I call for a copy of the statement of the account during my tenure and request expenditure details from me with proof of my embezzlement of any N100,000.

    “I request open investigation/enquiry without delay.

    “I declare my availability at this and at all times to answer for whatever acts I may be accused of,” Onyeka said.

    2024 bid-round: Lawyer advocates net-zero emission

    An oil and gas expert, Tolu Aderemi, has stressed the importance of competence, capacity and patriotism in guiding Nigeria’s 2024 oil and gas bid round, which opened on April 29.

    Aderemi, a Visiting Professor at Afe Babalola University, highlighted the significance of meeting Nigeria’s OPEC quota of 1.38 million barrels per day.

    He noted that statistics from the fourth quarter of 2023 show Nigeria’s struggle to meet its OPEC quota, with production levels falling below the target.

    The OPEC Monthly Oil Market Report (MOMR) for March 2024 revealed a decline in Nigeria’s output from 1.427 million barrels per day in January to 1.322 million barrels per day in February.

    This was attributed to challenges such as crude oil theft, insecurity, asset vandalism, and sabotage.

    Despite these obstacles, Aderemi, Partner at Perchstone & Graeys LP and Chairman of the International Law Association (ILA) Arbitration Committee expressed cautious optimism about the success of the 2024 bid round.

    He cited the government’s implementation of a robust Regulatory Action Plan (RAP) and a transparent bidding timetable.

    He believes the regulator has set out a robust, realistic and transparent bidding timetable and a credible data partner.

    According to him, where the regulator is faithful to its processes, the exercise will not only be successful but will deliver increased foreign exchange revenue to Nigeria.

    Aderemi said it would also lead to improved job creation and a robust and vibrant market with new technologies and infrastructural development.

    “It is also bound to birth greater opportunities for indigenous players,” the lawyer said.

    As the bid round progresses, Aderemi stressed the importance of bidders’ commitment to Nigeria’s net-zero emission target.

    He also raised concerns about market exits following the passage of the Petroleum Industry Act in 2021.

    The lawyer urged the government to attract competent investors while ensuring transparency and sustainability in the sector.

    Aderemi warned against potential pitfalls in the bid round, including forced mergers of bidders, allegations of favouritism, unrealistic signature bonuses, and inflated asset values, which could result in failure if not addressed.

    Aderemi praised the government’s initiative and doggedness to consistently stimulate the Nigerian oil & gas market with a robust and friendly legal and regulatory framework.

    He urged the world to look at the new Nigeria and its market landscape under President Bola Ahmed Tinubu’s business-friendly administration.

    Lawyer gets ultimatum to retract allegations

    Ondo State Governor, Lucky Aiyedatiwa, yesterday, gave a lawyer, Oladotun Hassan, a seven-day ultimatum to retract alleged certificate forgery levelled against him.

    Aiyedatiwa, in a letter: “Defamatory Publications Against Mr Lucky Orimisan Aiyedatiwa,” written by his counsel, Ebun-Olu Adegboruwa, demanded an apology in three national dailies.

    News Agency of Nigeria (NAN) reports the letter was dated April 8, in Abuja.

    “The above matter refers. We are solicitors to Governor of Ondo State, Mr. Lucky Orimisan Aiyedatiwa (“our Client”) on whose behalf we write this letter on the above subject matter.

    “It has come to the attention of our client that by an unsolicited letter dated June 2, 2023, you caused to be authored and submitted to the Police, an unsubstantiated complaint of misrepresentation, certificate forgery, examination malpractice and perjury, against our client.

    “Whereas, you are not a registered voter in or an indigene of Ondo State to possess the requisite locus to ground your said complaint.
