  • Again, Makarfi, Sheriff disagree on court’s ruling

    Chairman of the National Caretaker Committee of the Peoples Democratic Party (PDP), Senator Ahmed Makarfi and his rival PDP chairman, Alhaji Ali Modu Sheriff, have again disagreed on the latest court ruling on the party’s festering crisis.

    A High Court in Port Harcourt, the Rivers State capital, yesterday affirmed the Makarfi-led caretaker committee as the authentic leadership of the troubled party.

    In a statement in Abuja, Makarfi expressed satisfaction with the judgment.

    Said he: “I am indeed happy with the judgment, on the one hand but also sad that it had to come to this.

    “For me, there should be no winner or loser on this matter. I am still calling on Senator Ali Modu Sheriff and his followers to join us so that we accommodate one another and indeed all other groups in a just, fair and equitable manner with a view to moving the party forward.”

    But in a reaction shortly after the judgment, Sheriff said the ruling by the Port Harcourt court cannot supercede an earlier judgment delivered by an Abuja High Court, which recognised him as the national chairman of the PDP.

    The  former Borno State governor insisted that he remains the party’s national chairman, despite yesterday’s ruling.

    At a news conference in Abuja yesterday, Sheriff said the appeal process had also been initiated.

    He argued that both the Federal High Court in Port Harcourt and the court in Abuja that affirmed his chairmanship of the party are of coordinate jurisdiction.

    “I also want you to know that the court that gave judgement in Abuja High Court last week and the Federal High Court in Lagos, and today’s (Monday’s) judgment are all courts of same coordinate jurisdiction.

    “Therefore, the order we have in Abuja is still subsisting. What it means is that unless the Court of Appeal decides otherwise, I still remain the national chairman of the PDP.

    “Any court that is of the same jurisdiction cannot overrule another court, only the Court of Appeal can do that.

    “We disagree completely with today’s judgment. We have asked the same court to stay execution on the judgment.”

    The caretaker committee of the Peoples Democratic Party (PDP) insisted yesterday that the party’s embattled National Chairman, Alhaji Ali Modu Sheriff, was only out to destroy the party.

    Spokesman for the committee, Prince Dayo Adeyeye, said in a statement that Sheriff was in cahoots with agents of the ruling All Progressives Congress (APC) on the mission.

    “Intelligence report available to us shows that Senator Sheriff  is in league with some agents of the ruling All Progressives Congress (APC) having nothing to lose and everything to gain if it helps destroy the PDP, has continued to enjoy the support of non PDP members to carry out their nefarious acts,” he said.

    PDP members across the country, Adeyeye said, are already aware of the evil desires of the former Borno State Governor and have chosen to ignore him.

    He also alleged that Sheriff and his group have been shopping and approaching the courts with dubious information for interlocutory orders to keep them afloat until they frustrate PDP’s gubernatorial elections in Edo and Ondo states as designed by their sponsors.

    His words: “Legitimacy in politics is not given through a procured interlocutory injunction but through the mandate of the people and Sheriff and his cohorts will soon realise this.

    “We are aware that Sheriff’s sponsors have urged him to sustain his illicit role for a while and create a semblance of a faction in the party to give way for some elected PDP members to take the advantage to decamp but unknown to them, members of our great party are aware of their game and have vowed to resist them.”

    The party urged the judiciary to be wary of dubious information and always block anything that could diminish their enviable role as the pillar in the sustenance of democracy in the country.

    The party  assured its members that the caretaker committee under Senator Ahmed Makarfi remains committed to discharging the assignment given to it by members and has refused to be distracted.

    The party warned its members to beware of Greek gifts being offered by agents whose mission is to kill the party.

    The National Caretaker Committee of the Peoples Democratic Party (PDP) has expressed satisfaction with yesterday’s judgment of an Abuja High Court which sacked Senator Ali Modu Sheriff as National Chairman.

    The committee advised Sheriff to retrace his steps and join hands with others to move the party forward.

    But the Sheriff camp said the court did not sack the embattled chairman and that the judgment of was being misinterpreted.

    The court, presided over by Justice Valentine Ashi, nullified the 2014 PDP constitution amendment upon which Sheriff was appointed PDP chairman.

    The court described the purported amendment as illegal and a violation of the Electoral Act.

    Secretary of the Ahmed Makarfi -led caretaker committee, Senator Ben Obi, described the judgment as a welcome development.

    “We expect more positive court rulings in the days ahead in favour of our party. It is time for them to face the truth and retrace their steps,” he said.

    He called on Sheriff and his supporters to stop their hard line posture and cooperate with the caretaker committee to move the party forward.

    “We believe that truth must be upheld; we want all hands to be on deck to chart the way forward”, Obi added.

    Repudiating the judgment, the National Secretary of the Sheriff faction, Prof. Adewale Oladipo, said in a statement yesterday: “This is completely false and a clear misrepresentation of the ruling of the court as it never gave any ruling ousting the national chairman.

    “Our attention has been drawn to reports circulating in the media that a Federal Capital Territory (FCT) High Court has ousted the National Chairman of the PDP, Senator Ali-Modu Sheriff.

    “For the avoidance of doubt, the court only heard and delivered judgment on a matter concerning certain amendments in the PDP constitution, which has nothing to do with the election of Senator Ali Modu Sheriff as the national chairman or even that of his predecessor, Alhaji Adamu Muazu.

    “Senator Ali Modu Sheriff was duly elected as the national chairman of the PDP. He still holds office as the national chairman and has not been removed by any court.

    “We therefore urge those misleading the media and the unsuspecting public to desist from such. The media is also urged to always cross-check their facts before going to press.”

    The chairmen of state chapters of the Peoples Democratic Party (PDP) have thrown their weight behind the Ahmed Makarfi-led Caretaker Committee.

    The chapter chairmen, who paid a solidarity visit to Makarfi in Abuja yesterday, said they would continue to respect the decision of the May 21 national convention of the party that set up the  committee.

    The leader of the delegation, Alhaji Yahaya Mohammed, said as delegates to the convention, they were bound by the outcome, adding that doing otherwise would amount to undermining the national leadership of the party.

    Mohammed, who is the chairman of the Federal Capital Territory chapter, urged the factional national chairman, Alhaji Ali Modu Sheriff, to respect the decision of the convention in the in the overall interest of the party.

    Makarfi said the crisis in the party was proof that the PDP is worth struggling for and that the committee’s mandate was to bring everybody on board.

    According to him, dragging the crisis for too long could be injurious to the health of the party.

    The Ebonyi State Governor, Dave Umahi, who presented the report of the party’s just concluded primary election in EdoState to Makarfi, said no individual can be greater than the party.

    He also appealed to Sheriff to retrace his steps, even if he felt he had been wronged by the decision of the party.

    “Leadership is for service and the party is ready to right whatever wrongs Sheriff might have suffered as a result of the party’s decision. Nobody has the powers to dissolve state executive committees except the National Executive Committee”, Umahi stated.

    The Peoples Democratic Party (PDP) National Caretaker Committee, led by Senator Ahmed Makarfi, has asked security agents to put ‘National Chairman’ Senator Ali Modu Sheriff under watch.

    In a statement yesterday by its spokesman Dayo Adeyeye, the Makarfi group “appeals to the Nigeria Police, the Department of State Service and indeed all security agencies to call Sheriff to order as well as keep more than an eye on him, so that he doesn’t precipitate crisis in any part of the country, … since we, as Nigerians already have enough on our hands to contend with.”

    It said Sheriff lacked the power to suspend the Edo State PDP executive committee. Urging the Edo executive to ignore the purported suspension, the Makarfi group said it was part of Sheriff’s plan to create confusion, ahead of the governorship election.

    Adeyeye maintained that the National Working Committee (NWC) headed by Sheriff had ceased to exist, following the setting up of the National Caretaker Committee by the National Convention in Port-Harcourt, capital of Rivers State.

    Also yesterday, the Makarfi group said it would continue to work day and night to build followership for the party.

    “The committee still wishes to renew its call to Senator Ali Modu Sheriff to embrace dialogue leading to peaceful resolution of the situation at hand”, another statement by Adeyeye added.

    It denied that Makarfi and the Secretary of the committee, Senator  Ben Obi, held secret meetings with an unnamed chieftain of the All Progressives Congress (APC), as alleged by Sheriff last week.

    “On the other hand, as soon as the National Caretaker Committee was appointed, people started retracing their steps back to the Party.

    But former Jigawa State Governor Sule Lamido raised the hope that the crisis is an indication that the party is strong and that it will soon be resolved.

    Lamido told reporters in Bamaina village in Birnin Kudu Local Government, Jogawa state that the party would emerge stronger and bigger.

    According to him, it is normal for people to fight for what is existent, valuable, worthy and important.

    “PDP is a big party that has history and it is a party of conglomeration of all Nigerians across the devide.

    “This is not our first crisis, if you go down our history from the formation of the party you will notice that this is not the first time we are having crisis.

    “You can remember that the late Sunday Awoniyi had battle of leadership with former Chairman Banabas Gemade.

    “We also had crisis during Audu Ogbeh’s reign.“You don’t fight for what is not in existence.

    “PDP was in power for 16 years and the crisis and fight had always been with us,’’ he said.

    He said that both Ahmed Makarfi and Modu Sherrif are members of PDP and would remain members no matter what happened.

    Lamido said the party had the capacity to resolve its differences.

    He gave the assurance that the discord within the party would soon be over.

    The former governor stated that PDP would return to power in 2019 because it is a conglomeration of Nigerians.

    Sheriff, Makarfi fail to end feud

    There appears to be no peace in sight for the Peoples Democratic Party (PDP), with its two factions sticking to their guns.

    “National Chairman” Ali Modu Sheriff and disputed Caretaker Chairman Ahmed Makarfi have refused to name their teams for peace talks.

    Based on the collapse of the peace move, the National Secretariat of PDP has remained shut by the police.

    It was learnt that the factions have not agreed on the agenda for the proposed negotiation.

    Although the two leaders have been slated to meet since Monday, each of them has been shifting the goal post because of “irreconcilable differences.”

    It was yesterday gathered that the reconciliation is being delayed by:

    • withdrawal of all cases in court by Sheriff and his associates/ loyalists;
    • Sheriff’s demand to remain in charge of the party even if he has to step aside later;
    • Disagreement over the involvement of the PDP Governors Forum and the Board of Trustees in the reconciliation; and
    • The shape of the Unity National Working Committee (NWC) being envisaged.

    As part of the initial agreement, Sheriff and Makarfi were expected to name four representatives for the peace talks.

    A top source, who spoke in confidence, said: “The two factions have not been able to meet since Monday because they have not agreed on the agenda. Neither of them has named its representatives for the reconciliation talks.

    “For instance, Sheriff is adamant on going through all the gamut of the legal process because he feels the law is on his side as far as this crisis is concerned.

    “So, he wants to negotiate from a position of strength as the National Chairman of the party. He wants to remain in charge of the party until otherwise decided by the party leaders.

    “He sees the Makarfi committee as a dissident group. This was why Sheriff nullified Monday’s PDP governorship primaries in Edo State.

    “Banking on the mandate of the National Convention, the Makarfi group has kept to its status as the authentic leadership of the party. It believes that other than political exigency, Sheriff has no locus to sit at the negotiation table with the caretaker committee.

    “The Caretaker Committee is of the opinion that the outcome of all suits will favour its mandate. It has been accusing Sheriff ‘s camp of misinterpreting some pronouncements of the court to cling to power.”

    Another source said the two factions disagreed on the involvement of the PDP Governors Forum and the Board of Trustees in the reconciliation.

    The source said: “Left to Sheriff, he does not want the involvement of the Board of Trustees because its members have taken sides with Makarfi’s Caretaker Committee. The same thing applies to some governors who have openly condemned him.

    “He believes that his purported sack at the National Convention was hatched by some governors and BoT members. And he was shocked that the BoT leadership handed over to Makarfi’s Caretaker Committee at the National Secretariat.

    “There is distrust between the two factions and it has become impossible for the reconciliation talks to take off. Therefore, the negotiation appears dead on arrival.”

    A member of the BoT, who spoke in confidence, said: “As it is now, only a definite pronouncement by the court will help the party to get over the crisis and reconcile. We hope the court will grant all cases accelerated hearing.

    “In the alternative, some leaders of PDP have been reaching out to Sheriff’s main backer, Sen. Buruji Kashamu, to prevail on his candidate to give room for reconciliation.

    “If Buruji can be of help, the two factions should be able to go to the negotiation table by next week.”

    A police source said: “We are awaiting the outcome of the reconciliation meeting by the two groups based on the pledge they made to the immediate past Inspector-General of Police, Mr. Solomon Arase.

    “The National Secretariat of PDP remains under lock and key at the instance of the two factions in order to prevent a breakdown of law and order.”

    The disputed Ahmed Makarfi caretaker Committee of the Peoples Democratic Party (PDP) yesterday described “National Chairman” as Ali Modu Sheriff as “desperate to destroy” the party.

    Reacting to Sheriff’s decision to “nullify” the primary conducted for the Edo State governorship aspirants and his plan to organize another one, the Makarfi group accused Sheriff of “working very hard for the enemies of our party.”

    A statement by spokesman of the faction, Prince Dayo Adeyeye, said: “The leadership of the Peoples Democratic Party (PDP) has uncovered further plans by the ousted Chairman, Senator Ali Modu Sheriff and co-travelers to deceive unsuspecting members of our Party, security agencies and the general public to support his ambition to remain as Chairman of the Party by claiming he has a court Order.

    “It is now very clear that Senator Ali Modu Sheriff is working very hard for the enemies of our great Party.. First, the Edo Primary Election and all the processes leading to it thereof were properly conducted, monitored and observed by INEC. Edo PDP Chairman has warned Sheriff to stay clear of their affairs as the Party in the state is resolutely united behind Pastor Osagie Ize-Iyamu, the Candidate of the PDP.

    The PDP warned that any of its members serving  in any committee set up by Senator Sheriff will be engaging in anti-party activities and will face disciplinary action stressing that Sheriff did not display any court Order before the gentlemen of the press during his last press briefing.

    “We have concluded our investigations and discovered that there is no trace of any court order obtained by Senator Sheriff or any of his cohorts either at FCT high court or the Federal high court in Abuja or any court in Nigeria

    The Party urged its members, the security agencies and the general public to disregard his claims and take it as one of his fraudulent antics saying that “whatever he says today is the rantings of a sinking man trying to hold on to the last straw”.

    Makarfi blames ‘external forces’ for PDP’s woes

    Chairman of the caretaker committee of the Peoples Democratic Party (PDP), Ahmed Makarfi has blamed external forces for the festering crisis in the party.

    This is coming just as two groups of irate youths yesterday clashed at the party’s secretariat protesting in support of Makarfi and the ousted National Chairman, Alhaji Ali Modu Sheriff.

    It was the same set of protesters that stormed the party’s office on Wednesday but they got tired a few minutes after and shuffled out of the party secretariat in batches.

    Speaking after a meeting of PDP leaders, which ended in the early hours of yesterday, Makarfi said Nigerians could no longer afford to stand aloof and watch Sheriff and his group threaten the nation’s democracy.

    He urged Nigerians to rise in defence of democracy, saying the party would pursue its court cases against Sheriff to a logical conclusion.

    He said: “We reviewed all that have been going on in the party, especially since Monday. You are all witnesses to the thuggery that took place. Actually, those who remember would know that that was how Boko Haram started.

    “Thugs were brought into Abuja and some people forced themselves into the secretariat. In the process, documents and some properties belonging to be party cannot be accounted for. This cannot be without support from some quarters, definitely not from the PDP.

    “We have the former chairman recorded saying that he was going to go beyond the Inspector General of Police in order for him to gain access into the Secretariat.

    “We don’t know what he meant by going beyond the IGP but all of you are sensible enough to decide the person beyond the IGP could actually mean.

    We are at a loss. Therefore, we deliberated on this and we have taken a position to stand by democracy, to stand by our right and to stand by our party”.

    The party chief called on the security agencies to rise to the occasion and checkmate illegalities, no matter how highly placed the perpetrators may be.

    He restated the party’s position that Sheriff was being sponsored by unnamed individuals in the All Progressive Congress (APC) to destabilise the party.

    “And those elements that may be interfering in our internal affairs, whether  they belong to any particular party or they do not belong to any at all, they should let us be, as we are not interfering in any other body’s affairs.

    “We have it on record that the former Chairman, a day or two before he forced himself into the secretariat, had a meeting with one of the governors of the party in power and then the next day this event took place.

    “If he claimed to be chairman of PDP, what meeting could he have had with the governor? Did he get any encouragement, facilitation, any guaranty for him to go ahead and do what it did? This is for Nigerians to think on and take a position on”, Makarfi said.

    According to him, despite the difficulties and the lukewarm attitude of the security agencies, the PDP would overcome its challenges.

    “We are confident that at the end of the day, justice will be done. We are confident that justice will be done in all the issues before the judiciary. We are also confident, even if there are slips from the security agencies, they will see reason and know that is it in the best interest of everybody that they stand on the side of what is right, what is just and that is on the side of the legitimate leadership of the party so that peace can reign”.

  • Makarfi’s committee clears Ize-Iyamu, Edebiri and Iduoriyekemwen

    The Peoples Democratic Party (PDP) has screened and cleared three aspirants who bought its nomination and expression of interest form for the primary scheduled for September 20.

    Those cleared are Pastor Osagie Ize-Iyamu, Chief Solomon Edebiri and Matthew Iduoriyekemwen.

    They were screened by a committee sent to the state by the national headquarters, led by Senator Ahmed Makarfi.

    Senator Ali Modu Sheriff on Monday set up a screening committee on the Edo election and named Senator Hope Uzodimma as Chairman. But, it was ignored.

    Certificates of clearance are issued to the three aspirants after the screening.

    Members of the committee were a former Minister of Education, Prof. Tunde Adeniran (Chairman), Senator Joshua Lidanin (Secretary), Chief Abiye Sekibo, Ndubuisi Nwigwe and Hon Farouk Yahaya.

    Adeniran said the party would not be distracted by the action of those he said were sponsored to cause disaffection in the PDP.

    Adeniran said the screening was to enable the party elect a candidate that has unblemished records.

    He said that the three aspirants wee found worthy and met the stipulated conditions of the party to contest the primaries.

    The former Education Minister assured the aspirants of a level playing field since he party has learnt its lessons.

    He said: “The era of imposition is over. The era of impunity is over. We are entrenching internal democracy. We are determined to get back on track.”

    “We are not deterred. The members of the PDP know what is happening. Imposition cannot work. Self proclaim leaders have no place in the PDP. We want a candidate that can win election and is accepted by the people”.

    Edebiri said the screening was transparent adding that he would now go ahead to solicit votes from delegates for the primary scheduled for Monday.

    AFTER a short break, Peoples Democratic Party (PDP) leaders returned yesterday to their bitter struggle for the party’s control.

    Ousted National Chairman Ali Modu Sheriff took over the secretariat in Abuja, proclaiming himself the authentic leader and dismissing the Ahmed Makarfi-led Caretaker Committee as an illegal body.

    But the Makarfi camp wrote to the Independent National Electoral Commission (INEC), demanding to be recognised as the authentic leadership of the party.

    INEC was yet to take a decision on the PDP crisis last night.

    It was gathered that the electoral commission was awaiting the decision of the court on all pending issues.

    Sheriff yesterday staged a dramatic return to the party’s national secretariat.

    With Sheriff were erstwhile National Secretary Prof. Wale Oladipo, ousted National Auditor Adewole Adeyanju and a former presidential aide, Ahmed Gulak. There was a small crowd of supporters.

    An initial attempt by the party chiefs to enter the building as early as 9a.m. was blocked by policemen manning the gate – apparently on the orders of the Ahmed Makarfi-led caretaker committee.

    Undeterred, Sheriff went to confer with Inspector General of Police Solomon Arase, at the Force Headquarters and got permission to be allowed into the building.

    On arrival at the secretariat, Sheriff said his tenure as chairman remained valid till December 2018. He dismissed the caretaker committee as an illegal body.

    Said he: “After due consultations with serious-minded stakeholders of the party and my lawyers, against the background that I have remained committed to lawful procedures, I have come, fully armed with all the necessary court orders, to resume as national chairman, as directed by a court of competent jurisdiction.

    “As we settle down to move the party forward, we wish to call on all party members within and outside the country to come around so that we can together reposition the PDP for future challenges.

    “We have served the necessary court orders on the Independent National Electoral Commission, which is the impartial arbiter in matters like this; the police as custodians of the law and we will make same available to you gentlemen of the press, so that you can make informed analysis of the issues involved. We hereby seek your own cooperation as we continue the task of re-engineering the PDP.

    “I wish to use this opportunity to thank all those who stood on the side of the truth and the law, and wish to place on record that never again shall the PDP return to wallow in lawlessness and impunity.”

    Last week, key party organs, including the governors, Board of Trustees (BoT) and National Assembly caucus, handed over the party’s affairs to the caretaker committee.

    But Sheriff said the caretaker committee was alien to the PDP’s constitution and that if there was any need for setting up such a committee, he, as chairman, ought to have presided over the exercise.

    “Against this backdrop, I hereby declare as null, void and of no consequence whatsoever, any action taken by any person or group of persons, except by my leadership which is recognised by law,” he declared.

    He called on prospective aspirants for the upcoming governorship election in Edo State to obtain their nomination forms for N10 million as against the N16 million fixed by the caretaker committee.

    “Any aspirant who obtains nomination form from the caretaker committee would have themselves to blame because the only National Working Committee recognised by law is the one presided over by me,” Sheriff said, adding:

    “I therefore call on everyone to shun all acts that will tend to portray the party as being lawless. We must learn to obey our laws first before we can hope to provide the desired leadership.”

    The former Borno State Governor accused the party of promoting illegalities and impunity – in disobedience to court orders. He described the caretaker committee as one of such cases of impunity.

    According to him, he stayed away from the party in deference to a court order restraining him from parading himself as chairman. The said order  lapsed after 14 days, Sheriff said, adding:

    “I have all the while kept away from the office in strict compliance with the ex parte order of the Port Harcourt Federal High Court, which lapsed on the 9th of June and not because I sanction the illegalities being committed by some few members of our party.”

    Makarfi’s committee writes INEC to demand recognition

    The Ahmed Makarfi committee wrote INEC Chairman Prof. Mahmood Yakubu  last week.

    The committee based its request on the outcome of the National Convention of the PDP in Port Harcourt and the decision of the Board of Trustees (BoT) of the party.

    In the letter, the caretaker committee said it was put in place at the National Convention, which was supervised by INEC officials.

    It also asked INEC to deal with it henceforth on any issue relating to the party.

    A source, who spoke in confidence, said the Caretaker Committee based its letter on the mandate given to it by the National Convention in line with Section 33(5) of the PDP Constitution.

    The section says: “The National Convention shall have and exercise authority to (a) formulate policies and programmes of the party; (b) elect or remove the national officers of the party; (c) elect the presidential candidate of the party; (d) demand and receive reports from the National Executive Committee and from any other committees or organs of the party and take appropriate action on such reports; (e) appoint such committees as it may deem necessary, desirable or expedient and assign to them such powers and functions as it may deem fit.”

    The source added: “If you read this section very well, the National Convention is empowered to raise the Caretaker Committee.

    “In fact, Section 31(5)(g) mandates the Board of Trustees to ‘offer advice on party matters to the National Executive Committee of the party’.

    “It was on these constitutional premises that the Caretaker Committee approached INEC for recognition. As a matter of fact, INEC supervised our National Convention.”

    A highly-placed source in INEC confirmed the receipt of the letter.

    He said: “We have received a letter from Makarfi’s committee seeking recognition.

    “We have refrained from replying the letter because there are many cases in court on the crisis in the party with INEC joined in some matters.

    “We are therefore yet to take a decision to avoid committing any act of subjudice. We are yet to issue a letter of recognition to the Caretaker Committee.

    “I think we may  go by the pronouncement of the court on this crisis.”

    Asked when the INEC management will meet, the source added: “At the appropriate time.”
