Court in Ibadan dissolves 14-year old marriage

A Mapo Customary Court in Ibadan, on Friday dissolved the 14-year old marriage between one Kafayat Lawal and her husband, Wasiu Lawal.

The court dissolved the marriage over man’s starvation of the woman and his inability to fend for her physical and material needs.

The President of the court, Mr Ademola Odunade, said that the marriage was dissolved because the duo agreed to separate.

“We cannot force any relationship on spouses especially if it is their will to separate.
“Therefore, in the interest of peaceful coexistence, the union between Kafayat and Wasiu has ceased to be henceforth.

“Kafayat shall take custody of the four children produced by the union and Wasiu shall pay N10,000 monthly as feeding allowance for the upkeep of the four children,” he said.

Ademola ordered that the man should also be responsible for the children’s education and other welfare.

The president further ordered Wasiu to give N3,000 to his former wife to enable her to park her belongings away.

Earlier, the complainant had told the court that her husband was irresponsible and heartless.
“Wasiu has never been responsible for my physical and material needs as well as those of the children.

“In fact, the children and I had to live from hand to mouth because he provided us with nothing, she said.

The complainant said that when she became critically ill, Wasiu did not pay attention to her but took her for a nonentity.

The respondent, however, blamed the woman’s parents for “ruining” the marriage and accepted that they be divorced.

“My lord, I opt for separation in order to have a new lease of life. But I must let the court know that Kafayat’s parents did everything to destroy our togetherness.

“I will not forget to add that Kafayat herself has been unfaithful to me as she is into extra-marital affairs. I am equally frustrated over the whole episode,” he said.

  • Husband to court: My wife beats me often, separate us

An Ibadan based travel agent, Mr Oluwatimilehin Oyewole, on Friday begged a Mapo Customary Court in Ibadan to dissolve his four-year-old marriage, to save him from constant beating by his wife.

Oluwatimilehin had in a petition to the court said that his wife, Kehinde usually slaps or mishandle him anytime they had disagreement.

“My lord, anytime I complain about Kehinde’s waywardness and lack of respect for me, she beats or attacks me with any dangerous thing within her reach.

“Sometimes, Kehinde freely pulls my manhood as part of her attack on me.

“Most of the time, I run out of the house for her even in the midnight.

“However, it is not that she is more powerful than I am, but I am merely trying to avert bloodshed or casualty.

“I am most disturbed by the disposition of her mother who always supports her misbehaviour.

“Worst of all, Kehinde has exited my house for more than a year now and I have reports that she has been sleeping with different men around.

“I was told that if I admit her back into my house without her confessing to me all those who have had sexual intercourse with her, I might have to bear the evil consequence that should naturally befall her.

“This is the reason why I thought that I should let Kehinde go before she eventually kills me,” Oluwatimilehin stated.

The News Agency of Nigeria [NAN] reports that when the matter came up, Kehinde was not in court to defend the allegations leveled against her.

The bailiff, however, confirmed that Kehinde was served with the notice to appear before the court.

The President, Mr Ademola Odunade, adjourned the matter to March 15, for further hearing.

Wife seeks divorce for alleged sexual starvation

A middle-aged woman, Latifat Adeleke, has asked a Mapo Customary Court in Ibadan, to dissolve her marriage with Adetola Adeleke, over alleged sexual starvation.

Latifat, a trader and mother of two, on Wednesday asked the court to end the nine-year-old marriage after declaring that she was “totally fed up.”

In her petition to the court, Latifat alleged that Adeleke, a spare parts dealer, aside from neglecting his traditional responsibilities of catering for her and the two children, had no time for her.

“Adeleke has over three to four years now, failed in his responsibilities as a husband towards me and as a father to his two children.

“The worst of all, my Lord, is that he has kept away from having sexual intercourse with me which greatly saddens my heart.

“We no longer stay together and the bond of love between us has disappeared,” Latifat declared.

Adeleke, who denied all the allegations levelled against him by his wife, however told the court that he was happy to part ways with Latifat.

He alleged that his wife was adulterous, extravagant and a party enthusiast.

“My lord, this year alone, Latifat has dubiously obtained close to N300, 000 from me in the name of celebrating birthday for our children.

“I once caught her red-handed with her lover on our matrimonial bed.

“When I asked her if what she did was right or not, there was no remorse, even when it actually happened on our matrimonial home,” he said.

“She has been involved in all manners of atrocities; this is why I called it all off with her.

“Please, my Lord, I don’t want her to take custody of the eight and six year-old children, because she doesn’t stay around; Latifat keeps going to parties,” Adeleke told the court.

After listening to both parties, the President of the court, Mr. Ademola Odunade, adjourned the matter till Jan. 27, 2016 and directed both parties to produce evidence to support their claims.
