    APC to hold national convention March 2026

    …releases timetable for wards, LGA, states, zonal congresses

    The All Progressives Congress (APC) has released a detailed timetable and schedule of activities for its ward, local government, state, and zonal congresses, as part of efforts to inject new leadership into the party’s structures nationwide.

    The party also fixed its National Convention for March 2026, to be held after the completion of all congresses.

    The one-page timetable, released on Sunday in Abuja by the APC National Secretary, Senator Ajibola Basiru, in line with Articles 11 and 17 of the party’s constitution, shows that activities will commence on December 1, 2025, and culminate in the National Convention in March 2026.

    According to the schedule, the process will begin with a nationwide membership e-registration exercise from Monday, December 1, 2025, to Thursday, January 30, 2026. The exercise is aimed at updating and validating the party’s membership database ahead of the congresses.

    Notice of the congresses will be issued to state and FCT chapters on Monday, February 2, 2026. The sale and submission of nomination forms for ward and local government positions will take place from Wednesday, February 4, to Monday, February 9, 2026, while screening of aspirants is scheduled for Tuesday, February 10, to Friday, February 13, 2026. Ward congresses will hold on Saturday, February 14, 2026.

    Local Government Area congresses, which will include the election of three national convention delegates per LGA, with at least one female delegate, are slated for Thursday, February 19, 2026. Appeals arising from the ward elections will be heard on Wednesday, February 18, while LGA appeals are scheduled for Saturday, February 21, 2026.

    For state-level activities, nomination forms for state executive positions will be sold from Monday, February 23, to Friday, February 27, 2026. Screening of aspirants will take place from Monday, March 2, to Wednesday, March 4, 2026. State congresses for the election of State Executive Committees are scheduled for Saturday, March 7, 2026, with appeals fixed for Monday, March 9, to Wednesday, March 11, 2026.

  • CRUTECH alumni plan national convention

    The Cross River University of Technology (CRUTECH) Alumni Association has fixed December 12 for its National Convention for the election of new executives.

    The convention date was announced at a meeting of the Central Working Committee (CWC) of the association, held at Okuku in Yala Local Government Area of Cross River State.

    The CWC is an organ of the association comprising of the National Executive Council (NEC), Board of Trustees (BOT) and Chapter chairmen and secretaries.

    In a statement, the national Public Relations Officer of the association, Comrade Inyali Peter, said the electoral committee for the convention was also formed.

    Its members include: Romanus Abua, Agnes Bassey, Ekpo Otu, Michael Otonko, Ajah Esu, Victor Oke and Abasiofiok Nkanta.During its inauguration, which Peter noted would happen soon, the President, Eyam Abeng would announce the chairman and secretary.

    The convention will hold in the Ogoja campus of the institution.

    Other resolutions contained in the statement include a mandate to review the constitution in due course to make the alumni seat in the governing council an elective office against the current situation where the President doubles as a council member.

    The statement advised those interested in the forthcoming election to be civil in their campaigns.

    The meeting was part of a two-day retreat which included a visit to the Management of the Okuku satellite campus of the institution, an interactive session with students of the campus as well as a courtesy call on the Clan Head of Okuku, HRH Ogamode Patrick Odaji Ipoule

    During the meeting with the clan head, the association lamented the encroachment on CRUTECH land by land grabbers and pleaded with the monarch to intervene.

     

  • Presidential race: 7,000 delegates to affirm Buhari’s candidacy at today’s APC’s convention

    About 7,000 delegates from across the country are expected to endorse the candidacy of President Muhammadu Buhari on Saturday at the special national convention of the All Progressives Congress (APC) holding in Abuja today.

    The convention is a culmination of series of events which began with the special congresses to select delegates for the the convention which will be presided over by the National Chairman Comrade Adams Oshiomhole and members of the National Working Committee of the party.

    Initially, the convention was expected to also deliberate on the way forward for the party, but the convention committee headed by Oyo State Governor Abiola Ajimobi said it will be a one-agenda event.

    Addressing a news conference at the APC national secretariat in Abuja yesterday, Deputy Chairman of the convention committee and Borno State Governor, Kashim Shettima, said the confirmation and rectification of the candidacy of the President is a commitment to steady progressive and positive change.

    Shettima, who stood in for Chairman of the Convention Committee, said: “Let me assure you that the nomination and ratification of the candidacy of President Muhammadu Buhari is a commitment to service, progressive and quality change.

    “Despite some of the problems we have encountered during the primaries in our various states, the National Working Committee of the party is working assiduously to resolve all the issues. It is a family quarrel and we are going to sort things out amicably.

    “The party is doing and will continue to do all it can to resolve all the issues amicably so that everyone can be carried along and we can all unite as one in order to ensure that President Muhammadu Buhari is returned to the poll come February 2019.

    “The current APC administration, led by our dear President, is making sure and steady progress and we cannot afford to drop the ball and return our great country to those dark days, especially the 16 wasted years preceding this administration.

    “About 7,000 delegates from across the length and breadth of our great country, and all necessary arrangements had been put in place to ensure security.

    “The convention will commence by 2 pm tomorrow at the Eagles Square. The transport committee is making arrangements to reduce to the barest minimum the inconvenience it might cause Abuja residents.

    “We moved the convention time from 9 am to 2 pm deliberately to accommodate delegates that are coming from far and near. Incidentally, people from Kogi, for instance, can be in Abuja within three hours.

    “But believe me, all our delegates will be on ground by 2 pm.”

    Shettima said the votes scored by the President during the Presidential primaries across the country was a highly guarded secret which will only be revealed during the national convention.

    Asked whether the convention will consider and fill vacancies created by the exit of some members of the National Working Committee, especially the National Secretary and the National Publicity Secretary, Shettima said: “This convention is a special convention for the emergence of our Presidential flag bearer, no any other issue with be tabled beyond issues pertaining to the emergence of our presidential flag bearer.

    “In subsequent conventions and NWC and NEC meeting, others issues can be discussed and sorted out.

    “The convention is to elect our Presidential candidate. It is not an elective convention. Three candidates per local government, apart from the statutory delegates, are expected at the convention.”

    It was, however, observed that some states may not be part of the convention as they were yet to conclude their primaries, which must be concluded by Sunday at the latest, which is the last day for the submission of list of candidates to the Independent National Electoral Commission (INEC).

    Acting National Publicity Secretary, Yekini Nabena, is however confident that the party will beat the deadline, saying states that have not concluded their primaries are expected to do so not later than Sunday.

  • Tight security as PDP holds national convention

    Water-tight security arrangements have been made by the Rivers State Police Command and other security agents for today’s national convention of the main opposition Peoples Democratic Party (PDP).

    Port Harcourt, the capital city of the hitherto volatile Rivers State and its environs are being properly guarded by security agents, considering the large number of PDP members from the 36 states and Abuja who will be converging on Adokiye Amaesimaka Stadium to elect a candidate that will challenge President Muhammadu Buhari, the presidential candidate of the ruling All Progressives Congress (APC), during the 2019 election.

    The Public Relations Officer (PRO) of the Rivers State Police Command, Nnamdi Omoni, a Deputy Superintendent of Police (DSP), in a telephone interview yesterday assured all PDP delegates and other persons who would be at the convention that there would be adequate protection of their lives and property, urging them not to entertain any fear.

    Omoni said: “Water-tight security arrangements have been made by the Rivers State Police Command. I can assure you that the national convention of the PDP will be seamlessly held and there will be no security breach in view of the heavy deployment of policemen at the venue of the national convention, hotels, entry and exit points, as well as other strategic points.

    “All the black spots in Port Harcourt and its environs have been identified and are being properly policed. Day and night movements before, during and after the convention will be without any incident.”

    The 12 presidential aspirants expected to slug it out at the convention are Aminu Tambuwal, Atiku Abubakar, Rabiu Kwankwaso, Bukola Saraki, Sule Lamido, Ahmed Makarfi, Attahiru Bafarawa, Ibrahim Dankwambo, Tanimu Turaki, Datti Baba-Ahmed, David Mark and Jonah Jang.

    Addressing a crowded press conference at Hotel Presidential, Port Harcourt yesterday, the Director-General of Tambuwal Campaign Organisation, Mike Omeri, assured that the Governor of Sokoto State would be crowned winner by the delegates at PDP’s national convention in view of his capacity, youthfulness, capability, experience and as the most qualified candidate.

    Omeri said: “The accredited delegates will be free to cast their votes without interference, but I can assure you that almost all of them will vote for Gov. Tambuwal, who has never been invited for questioning by any security or anti-graft agency.

    “Governor Tambuwal is young and he believes in the future of Nigeria. He also believes that Nigeria has passed the stage of potential, but now at the stage of possibilities and fulfilment of dreams. He has a blueprint to transform Nigeria and he always speaks from the heart.”

    Former Edo state governor and chairmanship candidate of the All progressives Congress (APC), Adams Oshiomhole has arrived Eagles square  in Abuja, venue of the party’s national convention.

    Before his arrival, some delegates and key party officials arrived the venue of the convention.

    Amongst those that arrived early was Senator Ovie Omo-Agege. The minister of Transport Rotimi Amaechi arrived the venue at about 11:40 am.

    There is heavy security presence in and around the venue.

    The National Executive Committee of the All Progressives Congress (APC) has approved the extension of the tenure of the John Odigie Oyegun led National Working Committee and state executive committees of the party for any other one year with effect from June 2018.

    Kogi state governor, Yahaya Bello who briefed newsmen after the meeting which was supposed to draw up a timetable for the conduct of party congresses leading to the National Convention of the party said the decision was taken in line with article 13 of the party which allows the NEC to exercise the powers of the National Convention.

    He said the tenure extension was taken in view of the need to avoid any confusion in the operation of the party ahead of the forthcoming general elections and to give the Asiwaju Tinubu led reconciliation committee to carry out an effective job.

    The meeting which started at exactly 11.06 when President Mubammadu Buhari arrived the APC headquarters accompanied by Vice President Yemi Osinbajo and ended at about 2.12 pm was attended by state governors, members of the National Assembly and state Chairmen among others.

    However, the Senate President, Senator Bukola Saraki and Speaker of the House of Representatives, Hon. Yakubu Dogara as well a few state governors were conspicuously absent.

    The Kogi governor was accompanied by the National Publicity Secretary of the party, Mallam Bolaji Abdullahi and Chairmen of the party in Plateau, Rivers, Anambra, Ondo and Nasarawa states.

    The party was silent on the conduct of its national convention and the amendment to the party constitution.

    He said: “At the end of the National Executive Council meeting today, a major decision was taken in line with the constitution of our party. We are all aware that the tenure of the current NWC and the executive members of this party both elected and appointed comes to an end in June this year.

    “Considering the time left for the party to conduct all the Congresses and convention and considering that our leader Sen. Tinubu has been charged with the responsibility of reconciling all aggrieved members of our party, we can not afford to approach the general elections with more dispute and crisis.

    “So, relying on Article 13 of our constitution, which empowers the NEC to carry out the function of the convention, the NEC has decided to extend the tenure of the current NWC and other executive committees at various levels for another twelve months, starting from June 30th.

    “Let me tell you that this will not stop the convention of the party. But to go into elective Congresses is what we are trying to avoid relying on the constitution of our party. As a matter of fact, Mr. President believe in ensuring that there are Congresses and convention across board.

    “However, how would you manage the crisis that will arise thereabout? Let me give you instances, in Ekiti and Osun states, there state congresses were postponed similarly in 2014 ahead of the elections, just two states to avoid crisis talk more of the whole country. So, that is why this decision was taken.”

    Speaking in the timeline for the Tinubu committee, he said “I don’t have the terms of reference that was given to our leader and I want to believe that there is no committee tthat is set up without timeline. So, I’m not in the position to tell you the timeline given to that committee.

    “Also, every member of this committee whether one man committee or multiple man committee, I want to assure you that every members of APC, we are cooperating 100% with our leader Sen. Bola Tinubu.”

    Those who attended the meeting include President Muhammadu Buhari, Vice President Yemi Osinbajo, Governors Aminu Bello Masari (Katsina), Aminu Waziri Tambuwal (Sokoto), Yahaya Bello (Kogi), Sani Bello (Niger), Kashim Shettima (Borno), Abubakar Badaru (Jigawa), Ibikunle Amosun (Ogun), Abdulaziz Yari (Zamfara), Nasir El Rufai (Kaduna), Abubakar Ibrahim (Bauchi), Abdullahi Ganduje (Kano), Rochas Okorocha (Imo), Akinwumi Ambode (Lagos) Samuel Ortom (Benue), Simon Lalong (Plateau) and Rotimi Akeredolu (Ondo).

    The much awaited Peoples Democratic Party national convention is holding today at the Eagle Square, Abuja.

    Party faithful from across the country and delegates have been arriving at the venue since monring.

    More than 2000 delegates are expected to vote to fill the positions of the national chairman and several other national offices.

    The party has been under the supervision of different interim national executives since May 2015 when Adamu Mu’azu resigned as part of the fallout from the 2015 election lost.

    The aspirants are Uche Secondus, Gbenga Daniel, Jimi Agbaje, Rashidi Ladoja, Taoheed Adedoja, Tunde Adeniran, Raymond Dokpesi, Aderemi Olusegun and Chief Olabode George, who later withdrew from the race on Friday night.

    George, Ladoja and Jimi have all pulled out on the eve of the race.

    10:50pm: Counting and collation of ballots is expected to be done by midnight.

     

    8:10pm: Voting ends at the PDP 2017 National Convention.

    4:20: Former President, Goodluck Jonathan in his remark said the party has never deceived Nigerians, saying it only promise what it can deliver.

    4:00pm: Former Vice President, Atiku Abubakar, in his remark said the APC government promised to give Nigerians 3 million jobs a year, instead 3 million jobs lost.

    2:45pm: Former Akwa ibom State Governor, in his remark said party members have been contributing positively in the National Assembly to help the APC administration for the good of Nigeria, so that the PDP will take over a healthy country in 2019.

    2:30pm: Former Oyo State Governor, Senator Rashidi Ladoja has stepped down from the race.

    2:10pm: PDP Chairman of BoT, Walid Jibrin, in his remark said the PDP we will take over power in 2019.

    1:10pm: The party caretaker chairman Senator Ahmed Makarfi in his speech began with a tribute to the founding fathers of the PDP.

    He calls for a one-minute of silence in honour of one of the founding fathers of the party, former Vice president Alex Ekwueme.

    “In the wake of the performance of our dear party at the 2015 general elections, it was natural, as in most human endeavors for all of us to, not necessarily despair, but be disappointed and do some introspection with a view to finding out what went wrong and how best to make amends and move forward”.

    He also said the caretaker committee was able to resolve the issues concerning PDP members across the country.

    “Joblessness has never been at such high levels in the history of this country, while the education sector is all but comatose”.

    “The relative ease with which foodstuff and other essentials were available and affordable to the average Nigerian under PDP governments is now history”.

    “Kidnap for ransom has taken a life of its own, so are the incessant farmers/herdsmen clashes and criminalities so camouflaged. Government must up the ante in its efforts to confront these menaces” he said.

  • UPP holds national convention

    The United Progressive Party (UPP) will hold its national convention in Anambra state on June.

    Already, the National Working Committee of the party headed by its national chairman, Dr. Chekwas Okorie, has constituted a five-man committee to oversee the organisation of the convention. It is headed by Chief Uchenna Amaku.

    Also, the committee has Chief David Ukeje as its secretary, while other members are Comrade John Ewodage, Chief (Mrs.) Ify Ezenwa and Hon. Chidi Uzoma.

    In a statement in Awka by the party’s publicity secretary, Chief Uchenna Amaku, the UPP charged the committee with the responsibility of arranging and delivering the one-day convention ahead of the governorship election to live up to expectation.

    The UPP national convention committee had the following terms of reference: “To oversee the arrangement and accreditation of delegates to the convention in accordance with the guideline that would be issued to the committee before the date of the convention.

    “To carry out other directives and assignments regarding the 2017 national convention that may emanate from the national chairman of UPP.”

    The UPP would ratify date for the governorship primary of the party towards the November 18 poll in Anambra State and name members of the governorship campaign committee for Anambra State.

    Makarfi committee can’t organise convention – Sheriff

    Estranged National Chairman of the People’s Democratic Party (PDP), Alhaji Ali Modu Sheriff has insisted that the Ahmed Makari led Caretaker Committee cannot organise the party’s national convention, saying the committee is an illegal body.

    Sheriff, in a statement on Tuesday by his Media Adviser, Mr. Inuwa Bwala, faulted the recognition given the caretaker committee by the Board of Trustees (BoT).

    According to him, there is no provision in the party’s constitution for a caretaker committee at the national, adding that a competent court has pronounced the committee illegal, while affirming Sheriff as the chairman.

    The statement said, “References should not even be made to the caretaker committee in the search for solutions to the PDP crisis.

    “It was the imposition of the caretaker committee in the first place, even as a contraption that precipitated the crisis, and any attempt to legitimise its function could spell further crisis for the PDP.

    “The BOT members should stop playing the ostrich and come to terms with the reality of Sheriff’s chairmanship, until a proper convention is organized.”

    The Sheriff camp said the Chairman of the BOT, Senator Walid Jibrin has forfeited the confidence of greater majority of party members because of his inconsistency and crave for money, and should give way to a credible person whose honour and integrity are not in dispute to steer the affairs of the PDP BOT.

    Sheriff further stated that, the BOT chairman has in his actions and utterances portrayed the BOT as being teleguided, saying he has brought credibility problem to the august body by clearly taking sides and championing the cause of particular interests in the crisis, at the expense of his leadership roles as mediator.

    “The chairman (Sheriff) was of the view that, even though the BOT lacks the powers to give orders, it has acted in breach of its sacred duty as a father and so called conscience of the party by recognising the Caretaker Committee, even when members know that it was the wrong thing to do.

    “As much as he respects the BOT members, they should not allow themselves to be dragged into fighting a war for the benefits of a few power brokers.

    “To this end, the National Chairman wishes to state categorically that, the BOT which earlier derailed peace initiatives by taking sides, coupled with the obvious roles of some of its members in the crisis, and against the background of the fact that it is merely an advisory body, lacks the moral and legitimate rights to dictate the pace of negotiations.

    “Already, the reconciliation committee, under Governor Seriake Dickson is still carrying out its assignment of reaching out to all parties, and until the committee makes its recommendations, which the national Working Committee will look at and convene a NEC meeting for necessary deliberations, the BOT’s actions are of no consequence,” the statement concluded.

    Updated: Court orders PDP to suspend national convention

    A Federal High Court in Abuja has restrained the People’s Democratic Party (PDP) from proceeding with its planned national convention slated for Port-Harcourt, Rivers State on August 17.

    Justice Okon Abang, in a ruling Monday, granted an interim order directing parties in a suit before his court to suspend all plans and actions in relation to the convention pending the hearing and determination of a motion on notice for injunction filed by plaintiffs in the case.

    The case was filed by Ali Modu Sheriff and other members of the National Working Committee of the PDP, which he heads.

    The substantive suit was filed before the court’s vacation and assigned by the Chief Judge to Justice Abang’s court for hearing.

    The plaintiffs’ motion for injunction dated July 20, 2016 is seeking various reliefs, principal among which is an order restraining INEC from monitoring the national convention of PDP to be held on August 17 in Port Harcourt.

    The motion was slated for hearing on August 28, 2016 after the plaintiffs obtained the court’s leave for the motion on notice to be heard during its long vacation.

    The motion was not heard on July 28 as scheduled, on account of a motion for joinder filed by Senator Ahmed Makarfi and six other members of his Executive Committee.

    The motion was, again not heard yesterday owing to the various rulings of the court on some application, including the joinder application by Makarfi and others.

    In one of the ruling, the judge granted the prayer by Makarfi and others and joined them as defendants in the suit.

    Those joined were Makarfi, Ben Obi, Odion Ugbesia, Abdul Ningi,  Kabiru Usman, Dayo Adeyeye and Alhaja Aisha Aliyu. They were joined as 3rd to 9th defendants.

    After his clients were joined as parties in the suit, lawyer to Makarfi and others, Yunus Usman (SAN) applied for adjournment to enable him study the plaintiff’s motion for injunction, which was served on him in court yesterday by plaintiffs’ lawyer, Adeniyi Akintola (SAN).

    Adeniyi, who did not object to Usman’s application for adjournment, prayed the court to make an interim preservation order to restrain parties from taking steps to dissipate the res (substance of the case).

    Akintola, who drew the court’s attention to an order ex-parte obtained last week by a party in the case, Senator Ben Obi, from the Port-Harcourt division of the court, noted that the respondents have the habit of flouting court orders.

    He said the order obtained by Obi from the Port-Harcourt court was intended to frustrate proceedings before the Abuja court.

    Akintola said the court will be rendered helpless if no positive order was made and an adjournment was granted as sought by the defendants’ lawyer.

    Ruling, the judge said it was shocking that, despite being aware of the plaintiffs’ motion for injunction, and also being aware that a ruling was to be delivered in his application to be made a party in the case before the Abuja court, Senator Obi, on August 9, obtained an ex-parte injunction from the Port-Harcourt division of the court, directing INEC to monitor the convention and security agencies to provide security.

    “The action of Senator Ben Obi is unlawful and unfortunate. A court of coordinate jurisdiction cannot make an order that will neutralise the proceedings in another court of coordinate jurisdiction. The Port-Harcourt division of this court cannot make an order to neutralise proceedings in this court.

    “Any court of coordinate jurisdiction that takes delight in making ex-parte order in frustrating another court of coordinating jurisdiction’s proceedings is entirely on its own,” the judge said.

    He said he would have adjourned proceedings on the plaintiffs’ motion for injunction without making any preservative order, as requested by lawyer to Makarfi and others, Yunus Usman (SAN), but for an urgent and compelling need for such order in view of the action by Senator Obi and the need to take care of conflicting interests of parties before the court.

    “Senator Ben Obi, with the greatest respect to him, is a senior and responsible citizen of this country. He cannot undermine the authority of this court. He ought to have waited for the court to deliver ruling in his application, which has now been delivered in his favour.

    “Senator Ben Obi cannot slap the court in the face and expect the same court to grant him an adjournment in this matter without making any interim preservatory order.

    “Democracy is anchored on the rule of law, not on the rule of self-help; not on the rule of might. Democracy is not anchored on the whims and caprices of any person, no matter hi position in the society. If we are to sustain this democracy, nobody should be above the law.

    “Senator Ben Obi, with the greatest respect to him, cannot treat this court with disdain and levity. What is the need for rushing to another court for an order, when a court is already seised of your application? This is unfortunate and unfair,” the judge said.

    Relying on the Supreme Court decision in the case of Lagos State v. Ojukwu1986 1 NWLR pt 18 at page 621, he noted that on no account must a party to a suit resort to self- help.

    He said where a party takes the laws into his/her hands; the court must invoke its disciplinary jurisdiction to curb the excesses of the recalcitrant party, in exercise of the court’s power for the maintenance of its dignity and integrity.

    “In the light of this, lawyers and politicians must ensure that the hard earned democracy is protected to avoid anarchy. If there is a breakdown of law and order, it is the masses of this country that will suffer. The politicians and senior lawyers will quickly find their way out of the country. The court is here to ensure that there is no anarchy.

    “Therefore, in the exercise of my disciplinary jurisdiction, where a party has taken the law into its hands, and in line with the Supreme Court decision in the case of Lagos State and Ojukwu, in the interest of justice and competing interests of parties, an order is hereby made in the interim, suspending PDP convention slated for the 17th of August 2016 in Port Harcourt, Rivers State, pending when the plaintiff’s motion on notice dated 20th July 2016 is heard and determined,” the judge said and adjourned to 12 noon today, hearing of the plaintiffs’ motion on notice for injunction.

    Earlier, the judge dismissed a motion filed by on behalf of the PDP by Ferdinand Orbih (SAN) seeking an order for stay of proceedings in the case pending the determination of an appeal he filed against the court’ ruling of July 28, 2016.

    The court had, in the ruling, held that Orbih, who announced appearance for the PDP on the strength that he was briefed by the Makarfi leadership of the party, cannot appear in the case because the Makarfi group lacked the power to act on behalf of the party.

    The judge allowed Olagoke Fakunle (SAN) who was briefed by the Sherif faction to represent the PDP in the case.

    Ruling on Orbih’ application for stay of proceedings, Justice Abang held that the notice of appeal filed by Orbih was incompetent as he was not known by the court as a lawyer for the PDP.

    The judge said: “Mr. F. O Orbih (SAN) has no right of appeal over the decision of this court and against the ruling of this court recognising O. Fakunle (SAN) as the counsel for the PDP.”

    He said Orbih, having not been recognised as a party in the suit, he could only have appealed against decision of the court delivered on July 28 by first seeking the leave of the court to appeal as an interested person.

    “Having not obtained leave to appeal against the decision of the court, it is my view that he (Orbih) has compiled nothing and transmitted nothing (as regard the record of proceedings which he said he had compiled and transmitted).

    “Therefore, the compilation and transmission of records to the Court of Appeal is in nullity.”

    The judge also said Orbih failed to file a verifying affidavit, exhibitting the notice of appeal that he filed with respect of the case as he ought to do.

    “With the greatest respect to the learned counsel, he has laboured in vain. There is no evidence that the appeal has been transmitted,” he said.

    Justice Abang, who noted that the court spent about five hours in resolving Orbih’ application, awarded N50,000 cost against him, to be personally by him, in favour of the plaintiffs.

    Justice Abng equally dismissed a motion filed by one Sikirula Ogundele, asking for among other prayers, that the judge should disqualify himself from further hearing the case.

    In the motion which was said to have been filed on his behalf by his lawyer, Yemi Oke, Ogundele, who is not a party to the suit, accused the judge of bias.

    The judge was angered by the decision of the applicant to join him as a respondent in the appeal filed against the July 28 decision of the court by Ogundele.

    A lawyer, Dolapo Kehinde, who initially held the brief for Oke, withdrew his appearance in the case when he could no longer defend the content of the motion.

    Justice Abang, in upholding the request by Akintola and Fakunle for the dismissal of the motion, held that Ogundele “is a meddlesome interloper” in the case.He is a busybody wandering about.”

    He said Ogundele and his lawyers also flouted the provisions of section 188 of the Evidence Act which grants a judge judicial immunity against being sued over his decision in the course of his official duty.

    The judge said, but for the decision of Ogundele’s lawyer not to proceed with his application, he (the judge) would have cited him (Ogundele) for contempt for making contemptuous depositions in the affidavit supporting his application.

    Monday’s proceedings, which started at 9am, ended at 4.45pm.

    Parties are to return to court Tuesday at 12noon.
