NBA disagrees with police over killing of Nsukka lawyer

The Nigerian Bar Association (NBA) Nsukka Branch has expressed dissatisfaction on the account of the Kogi Police Command over how their colleague Elias Ugwu was killed on March 9 by the police.

Ugwu was reportedly killed by security operatives after he had successfully gone to a Kogi forest to pay ransom demanded by kidnappers ti secure the release of his kidnapped cousin.

However, the Kogi Police Command explained that its officers shot and killed the lawyer by mistake after he allegedly refused to stop at a police checkpoint.

They also accused the deceased of not informing the police of the plan to pay ransom for the rescue of his cousin, a development the police said made them think the deceased and his rescued cousin were kidnappers.

However, reacting to the police explanation of their colleague’s gruesome death weekend in statement by Mr. Sunny Okoro, Chairman NBA, Nsukka Branch, the NBA insisted that Ugwu was deliberately and unjustifiably killed by state actors.

It also vowed that the association will continue to push until justice was duly served.

Okoro explained that their slain colleague left Nsukka on the fateful day he was killed and succeeded in securing the release of his cousin, Ugwu Alexander who was kidnapped with five other passengers at Ijih Urban Area in Kogi State, only to be killed by police on his way back to Ayingba where his cousin resides.

The statement titled :“The gruesome killing Of our colleague, Barr. Elias Ugwu, by officers of the Police Area Command, Anyigba Kogi State: The Position of the NBA, Nsukka Branch,” reads:

“It’s with heavy hearts that we make this press statement on the killing of our colleague, Barr. Elias Ugwu, who at all times before his untimely and mindless decimation, was a bona fide member of the NBA, Nsukka Branch.

“Information available to us is that our late colleague’s cousin, one Ugwu Alexander, was kidnapped alongside five other passengers at Ijih Urban Area between Aloma and Ejule in Kogi State and were taken into the bush and made to contact their relations for the payment of ransoms for their release.

“The said Ugwu Alexander made a distress call to our late colleague and intimated him of the state of affairs, prompting our colleague to start making frantic efforts to raise the ransom and secure the release of his cousin.

“Upon sourcing the demanded ransom, our colleague made reports to the Anti-Kidnapping Office of the Nigeria Police Force, and also the Divisional Headquarters of the Nigeria Police Force, Ogrute, Enugu-Ezike in Igbo-Eze North Local Government Area, both in Enugu State, intimating both commands of the kidnapping, and his proposed journey to Kogi State to deliver the ransom.

“Our colleague proceeded to Kogi State to deliver the ransom as directed by the kidnappers.

“After delivering the ransom somewhere in Alede-Egume, and securing the release of the said Ugwu Alexander, our colleague was making his way back to Anyigba where his cousin resides, with his cousin and one other person, Chidi Aneke who accompanied him from Nsukka, and when they got to Ojigbala-Egume, unknown to them that the police had laid an ambush for them, they drove into the ambush and the police, without an attempt at even stopping their vehicle, opened fire, and shot our colleague on the head; it is also worthy to mention that the police van was packed away from the road, to avoid suspicion as they laid in wait for the car.

“After shooting our colleague, the other two occupants of the vehicle made passionate pleas to the police to rush him to the hospital, after identifying themselves and explaining their mission in the area, but the officers chose to treat them as suspected armed robbers, arrested and handcuffed the two survivors; at the time they eventually accepted to take our then dying colleague to the hospital, it was already too late and he was pronounced dead-on-arrival.

“We have also read with dismay, the statement issued by the Kogi State Police Command with all the distortions and contradictions that it is laced with.

“We wish to put the records straight, first, that our colleague, Elias Ugwu, left Enugu State, on Saturday, the 9th day of March 2024, the same day he was gruesomely killed by the police. It is therefore a deliberate misinformation, to state that he and his companions were seen roaming the bush in Kogi State for two days or more prior to the 9th day of March, 2024.

“It is also a deliberate and callous distortion to state that our colleague was flagged down and he refused to stop and that it was the tyres of the vehicle that the police targeted. Our colleague, by the account of the survivors of the incident, was never stopped at all but was simply fired at by an officer later simply identified as Sampolo, on jumping out from the bush where he and his colleagues hid waiting for the vehicle.

“Furthermore, why would the police allege that Elias Ugwu was killed in the bush, when he had already entirely left the village where the ransom was paid, and was driving to Anyigba, and the victim of the kidnap already reaching out to people, joyfully announcing his freedom? What are the police intending to hide?

“It’s disheartening that the Kogi State Police Command would, instead of showing sympathy and remorse for this obviously reckless act, choose rather to embark on churning out spurious allegations aimed at shielding their personnel from the law.

“Our position as a Branch of the NBA remains that Elias Ugwu was deliberately and unjustifiably killed by state actors, and we will continue to push until justice is duly served.”

NBA okays election date, approves new branches

NATIONAL Executive Committee (NEC) of Nigerian Bar Association (NBA) has approved July 20 for election of officers as proposed by the Electoral Committee (ECNBA).

It ratified publication of the preliminary notice and eletion guidelines.

Officers will be elected to succeed Yakubu Maikyau (SAN) and his executive.

Their tenure will end after this year’s annual general conference (AGC) in Lagos from August 23 to 30.

NBA NEC approved creation of Eti-Osa Branch and reiterated its approval for the new Surulere Branch.

Surulere Branch is anchored on the establishment of Surulere/Yaba Judicial Division by chief judge of Lagos.

NEC authorised the constitution of caretaker committees for Eti-Osa and Surulere to organise branch elections.

These were part of the communiqué issued at the close of NBA’s first quarterly NEC meeting in Jos, Plateau State.

It condemned actions of the leadership of the Section on Public Interest and Development Law (SPIDEL), which it said undermined the president and council.

“Consequently, NEC directed removal of members of the Executive Committee of SPIDEL.

“NEC also ratified all actions taken by the president with respect to SPIDEL and directed that all actions filed by John Aikpoko-Martins and Funmi Adeogun, purportedly on behalf of NBA-SPIDEL be discontinued,” the communiqué said.

NBA NEC condemned the attitude of members nominated into its statutory bodies, saying their actions or inactions were undermining the association’s interests.

It directed that nominees in statutory bodies report their activities to the council through NBA president.

NEC ratified and approved constitution of NBA Remuneration Implementation Committee chaired by Mazi Afam Osigwe (SAN).

It condemned an unrecognised group parading as officers of NBA Bori Branch.

NEC directed that a letter be written to chief judge of Rivers State recognising only the elected officers led by Idris Abayomi Shehu as chair.

NBA rejects Nigeria-U.K trade pact, to challenge MoU

    • Association suggests ways out of economic, security woes

The Nigerian Bar Association (NBA) yesterday insisted on challenging the Enhanced Trade Investment Partnership (ETIP) Agreement between Nigeria and the United Kingdom (UK).

It expressed the fear that the agreement would take jobs away from Nigerian lawyers, if their UK counterparts were allowed to practise in the country.

Nigeria signed the far-reaching MoU with the UK on Tuesday.

The Minister of Industry, Trade and Investment, Dr. Doris Nkiruka Uzoka-Anite, said the agreement “reaffirms our dedication to nurturing economic and trade alliances, especially in critical sectors, like energy, legal, and financial services”.

She described it as “a robust partnership understanding which promises to be a springboard for immense growth in trade relations with the UK”.

NBA said it was not consulted before the agreement was signed, vowing to challenge it up to the Supreme Court.

Its president, Yakubu Maikyau (SAN), who issued a statement condemning the pact, also addressed reporters afterwards.

“We know for certain that the British Government will not undermine its own body of legal professionals in such a spectacular fashion as this administration has done to the NBA in the matter of this agreement.

“It is truly tragic that while the government of the UK is seeking opportunities for its own lawyers beyond its constrained environment, the government of Nigeria is attempting to deprive Nigerian lawyers and their millions of dependents of means of livelihood.

“To embark on such a venture without recourse to the NBA is the height of insensitivity to the plight of the legal profession in Nigeria, and this is totally unacceptable,” the NBA said.

The association said it would mobilise its members to challenge the agreement, urging them to “brace up for the struggle ahead”.

“The NBA under my leadership will not allow any incursion into our legal space.

“We intend to fully challenge the legality of this agreement all the way to the Supreme Court if necessary…

“We have begun the process of mobilising our members for a possible nationwide public demonstration in objection to this agreement,” Maikyau said.

But Dr. Uzoka-Anite explained that the agreement was misconstrued.

In a statement on the facts about the pact, she said: “Regrettably, our earlier report erroneously suggested that Nigeria has signed an MOU that allows lawyers licensed in the United Kingdom to practise in Nigeria.

“We wish to state emphatically that there is no such provision or agreement in the MOU.

“For the avoidance of doubt, Nigeria does not have a Mutual Recognition Agreement (MRA) with the United Kingdom and made no commitment, under the MOU or elsewhere, to allow UK-licensed lawyers to practise in Nigeria.

“As it currently stands, foreign licensed lawyers (including those licensed in the U.K.) cannot practice in Nigeria, as categorically stated in the MOU.

“We recognise that cross-jurisdictional practice between Nigeria and the United Kingdom is still an ongoing conversation amongst relevant stakeholders within the legal practitioners’ community in Nigeria, and this was reflected in the MOU.”

A highly placed source in the NBA said despite the minister’s clarification, the association would still challenge the agreement.

“We will challenge the agreement to the very last notwithstanding the minister’s statement,” the source said.

The NBA urged the Federal Government to take urgent steps to address the worsening security and economic fortunes of the country.

Calling for a holistic approach, the associations said: “Beyond getting the right tools and equipment, the welfare of security personnel must be reviewed to improve the lot of officers and men of the Armed Forces, and other security personnel, in and out of service.

“It is our view that the delay in commencing fundamental reforms in the Nigerian Police is a contributory factor to our nation’s current state of insecurity.

“We call on the administration to stop paying lip service to Police Reform and begin a meticulous reform of the police.”

NBA decried the economic downturn marked by what it called the “free fall” of the naira and “skyrocketing” prices of foodstuff.

It recommended that the government must, as a matter of urgency, announce deadlines for specific fundamental economic steps to be taken towards economic recovery.

NBA added: “This will enable all stakeholders to assess the performance of government in regard to promises it has made and become a basis to hold government accountable to the people.

“Secondly, the Tinubu Administration must show demonstrably a commitment to diversification of the economy.

“There is so much talk by ministers on what the government wants to do in the areas of agriculture and solid minerals.

“It is time to back up talking with concrete deliverables.”

NBA hailed the Federal Government for raising the Judiciary’s financial allocation and urged President Tinubu to ensure the inauguration of the 11 Supreme Court Justices.

NBA asks FG to address insecurity, economic hardship, justice reform

The Nigerian Bar Association (NBA) has asked the Federal Government to take urgent steps to address the worsening state of security in the country and its dwindling economic fortune in view of the impact on the populace.

Speaking in Abuja , NBA President, Yakubu Maikyau (SAN) said the heightening state of insecurity and the sorry state  economy constitute a major source of concern, and which the Fed Govt must address without delay.

He said: “In other to focus the nation’s attention on the issue of insecurity and to ensure that all resources at our disposal are put in place to deal decisively with this issue, we call on

President (Bola) Tinubu to declare a state of emergency in the area of security.

“As rightly noted by Mr. President himself, neither prosperity nor justice can prevail amidst insecurity and violence.”

Maikyau noted that what make the current state of insecurity more worrisome “is the increasing boldness of the perpetrators.

“Security personnel, who have the responsibility of securing the lives and properties of Nigerians, have apparently been unable to effectively stem the spread of the violent crimes across the country.

“What used to be at the fringes of the country (bad as it was) has now taken the centre-stage. The entire country is under siege by terrorists, bandits, and criminal gangs.

“It is no longer easily determinable, if not impossible, which square kilometre of the Nigerian territory is under the authority or control of the Federal Government of Nigeria.

“A situation where criminality dots all over the space known as the Nigerian territory, in a manner that

diminishes the presence of law enforcement agencies, directly challenges the sovereignty of Nigeria.

“Some Nigerians have lost, and many more are fast losing confidence in the ability of the Federal Government to deal with the security situation in Nigeria. At this time, when public confidence in the sincerity of government in dealing with insecurity is at its lowest ebb, something radical must be done as a matter of emergency.”

He faulted the increasing militarisation of the civil space in view of the frequent deployment of military personnel for duties ordinarily meant for the police, arguing that such practice is not only weakening the police as an institution, it overburdens the military agencies.

“This military intervention, as we have seen over the years, is not sustainable. There is no substitute for

embarking on far reaching reforms of the Nigerian police that will elevate it to an effective

and efficient institution capable of enhancing the sense of security of Nigerians.

It is obvious that the Nigerian Police in its present form cannot deliver on its mandate,” he said.

The NBA President urged the Fed Govt to adopt a holistic approach to the issue of security while not overlooking the peculiarities of each region and design bespoke measures to deal

    with them.

“Beyond getting the right tools and equipment, the welfare of security personnel must be reviewed to improve the lot of officers and men of the Armed Forces, and other security personnel, in and out of service.

“It is our view that the delay in commencing fundamental reforms in the Nigerian Police is a contributory factor to our nation’s current state of insecurity.

“We call on the administration to stop paying lip service to Police Reform and begin a meticulous reform of the police.”

He expressed concern about the current sorry state of the nation’s economy, noting that despite claim the country has the largest economy in the content and the progress have been made, the current reality presents the opposite.

“Our economy is dwindling, the naira is on a free fall, prices of food stuff have skyrocketed, our future

economic outlook seems to be on the negative trend. Inconsistent economic policies have

largely led to weakened economic fundamentals including sluggish economic growth. .

“The direct result of these is the low standard of living, alarming rate of poverty, high unemployment rate and the wide disparity in the socio-economic status of the Nigerian population.

“It would not be surprising given this current reality if the number of Nigerians living in extreme poverty has increased.

He urged the government to urgently communicate to the populace concrete efforts being put in place to address the current hardship in the country and called on President Tinubu to take seriously the cries of ‘we are hungry’ by Nigerians across ethnic and religious lines.

He argued that with the calibre of individuals who constitute the Federal cabinet, and President Tinubu’s impact in Lagos as the governor,  the Fed Govt cannot now argue that it lacked plans to address the negative effects of the economy policies of previous administration.

As a way of addressing the current economic challenge, the NBA President recommend that the Government must, as a matter of urgency, announce deadlines for specific fundamental economic steps to be taken towards economic recovery.

He added: “This will enable all stakeholders to assess the performance of government in regard promises it has made and become a basis to hold government accountable to the people.

“Secondly, the Tinubu administration must show demonstrably a commitment to diversification of the

economy. There is so much talk by Ministers on what the government wants to do in the

areas of agriculture and solid minerals. It is time to back up talking with concrete deliverables,” he said

Maikyau commented the Fed Govt for a raise in financial allocation to the Judiciary and urged President Tinubu to ensure the inauguration of the recently appointed 11 Justices for the Supreme Court.

“On current developments within the justice sector, we welcome the commitment of the Federal Government to the improvement of the conditions of service of judicial officers.

“We are pleased to note that the NBA’s recommendations for the upward review of judicial salaries and

allowances are being considered for implementation.

“We want to specifically commend the Honourable Attorney-General of the Federation for his leadership role in this regard. The appropriation of N341, 625, 739, 236.00 for the Judiciary is a development that has never happened in the history of Nigeria.

“We look forward to the urgent implementation of the proposed review. We also request that the President should swear-in the 11 Justices appointed to the bench of the apex court.”

Expressed concern about  the ebbing public confidence in the Judiciary and called for urgent reforms to ensure enhanced commitment to justice delivery by judicial officers and improved transparency and accountability in the management of the system.

“Judicial officers must take their oath and judicial code of conduct seriously; they must avoid actions and omissions that will give the appearance of compromise.

“Like Ceaser’s wife, judicial officers must be above suspicion – they must live above reproach. Proven cases of judicial misconduct must be dealt with decisively.

“I am aware that petitions have been written to the National Judicial Council, alleging one form of misconduct or the other against some judicial officers, particularly in election related matters.

“These cases must be thoroughly investigated, and any judicial officer found to have compromised his oath of office must not be allowed to continue to serve on the Bench and should be made to face the wrath of the law. This is the way to begin building back confidence in the judiciary.”

The NBA President kicked against an aspect of the “Enhanced Trade Investment Partnership (ETIP)” agreement recently signed the Federal Government of Nigeria and the Government of the United Kingdom, which allows UK lawyers to practice on Nigeria.

He noted that despite the latest clarification by Minister for Investment, Trade and Industries that the agreement did not allow UK lawyers to practice in Nigeria, the NBA was adverse to such plan in whatever for.

Maikyau added: “It is very sad that while the UK government is creating opportunities for its lawyers outside the United Kingdom, the Government of Nigeria, by its action or omission, seeks to shrink the legal space for an already burdened legal practice.

“What efforts has the government of Nigeria made to ensure that Nigerian lawyers have access to the UK legal environment?

“What is even more tragic is that the agreement was entered into without engaging the NBA on the text of the agreement.

“This is a clear indication of the limited recognition the Government of Nigeria attaches to its professional bodies.

“We are certain that the UK government will not treat its law society and bar council in such despicable manner.

“For avoidance of doubt, let me say clearly, that the NBA reject the agreement in so far as it relates to legal services. We fully intend to seek judicial review of the agreement including up to the supreme court if necessary.

“While we must accept the reality of globalisation and open our borders for transnational trade and exchange of services, this must be done strategically, purposefully, without and endangering the already exposed and weakened Nigerian market.

“We therefore request for a holistic review of all the agreements under the ETIP and the AfCFTA, particularly in view of the developments in the ECOWAS sub-region.

“In addition, we have begun the process of mobilizing our members for a possible nationwide public demonstration in objection to this agreement,” Maikyau said.

We insist bail must be free – NBA

The Chairman of Lagos Branch of the Nigerian Bar Association (NBA), Mr Olabisi Makanjuola, has called on lawyers to report any demands for money for bail at police stations.

Makanjuola told the News Agency of Nigeria (NAN)  on Tuesday in Lagos that bail remained  free by the provisions of the 1999 Constituion.

He said that  the branch would do everything lawful to ensure that bail remained free in Lagos State.

He spoke on ways to maintain ethical and professional standards in the legal profession.

He said that the Lagos Branch of NBA would ensure that demands for money for bail at police stations in Lagos State would stop.

“Our colleagues that go to the police formations always come back to lament that, often times, money is paid to secure bail of suspects.

“The point we are making is that it must stop; even if that is one thing we begin to get right.

“A clarion call to everybody out there is that where any officer demands money for bail, please reach out to us, and we will draw the attention of the commissioner of police.

“He must live up to his promise; bail is free and bail must continue to be free,” the chairman said.

Makanjuola also said that the branch was determined to clamp down on fake lawyers.

“In the next couple of weeks and months, the Lagos branch intends to begin to clamp down on persons who parade themselves as lawyers.

“If any lawyer conducts himself in any manner that is improper, we ask members of the public to bring such a person to our attention; we have an ethics committee,” he said.

Makanjuola added that the branch was committed to providing trainings for lawyers to expose them to other aspects of legal practice apart from litigation.

He expressed confidence that the trainings would equip lawyers more and reduce ‘ambulance chasing’ and unethical conducts by some lawyers.

The constituents in the petition signed by Rauf Dele Yusuf demanded investigation into the Appeal Court judgment, which they described as controversial.

The constituents claimed that the state House of Assembly Tribunal had before then ‘rightfully’ dismissed the petition against the PDP lawmaker filed by the All Progressives Congress (APC) candidate, Yusuf Musa, challenging the election of Otunba Afolabi in the March 2023 House of Assembly election.

They said the dismissal of the tribunal’s verdict in favour of the PDP lawmaker by the Appeal Court on the grounds of certificate forgery was against the rule of law.

  • NBA, AGF, legal giants mourn courageous Aketi

NBA, AGF, legal giants mourn courageous Aketi

The Nigerian Bar Association (NBA) yesterday paid tribute to its former president Oluwarotimi Akeredolu (SAN), who lost a long battle with cancer.

Aketi, as he was fondly called in legal circles, was called to the Bar in 1978 and had served the NBA in many capacities.

He was Secretary and Vice Chair of the NBA Ibadan Branch and became the 24th President of the association from 2008 to 2010 before he became Ondo State governor.

The association’s incumbent president, Yakubu Maikyau (SAN), described Akeredolu as “one of the most influential and courageous Presidents ever to lead the NBA”.

He said in a statement: “Aketi, as he was popularly called, was in our lexicon a true Barman who firmly believed in the ability of the legal profession to make a difference in our society.

“It was this belief that led him into politics resulting in being elected twice as the Governor of Ondo State.

“Aketi will mostly be remembered for his forthrightness and down-to-earth perspectives, especially on matters of national importance.

“He will be positively remembered for his several contributions to the growth and development of Ondo State and the entire region.

“As Governor, Aketi was at the forefront of the establishment of the regional security network, Amotekun, to address security concerns in the western region.

“So far, the network has been effective in stemming the tide of terrorism, armed robbery, kidnapping, banditry, etc., within the region and currently stands as a model for other regions to emulate.

“There is no denying that the learned Senior Advocate left indelible footprints in the sands of time.”

A former NBA president, Olumide Akpata, said the Bar has lost “a giant of the legal profession, an unwavering beacon of justice, and a patriotic statesman”.

“He embodied and personified the highest ethics and values of the Bar – an advocate for justice, a defender of rights, and a true social engineer.

“Aketi’s departure leaves an unfillable void in Nigeria’s legal community. However, I find solace in the fact that he lived a life of purpose, service, and sacrifice for the greater good,” Akpata said.

Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi (SAN), condoled with Akeredolu’s family and the people of the state over his death.

He described the Ondo governor’s death as a colossal loss to the country, the legal world and civil society organisations.

Fagbemi, in a statement by his spokesman, Kamarudeen Ogundele, said: “I am saddened by his death. He was a patriot, a go-getter and a legal luminary, who served his state well and the entire country.

“His days as the NBA president brought immense growth to the bar. He will be sorely missed…”

Law teacher and prosecutor, Wahab Shittu (SAN), said Aketi rose to the inner bar as one of the most eminent lawyers in Nigeria’s history.

The SAN, who recalled his many encounters with Akeredolu, said: “It is really unfortunate that death came and snatched away a persona that l consider a real human being – passionate, principled, kind, simple, practical, down to earth and revolutionary.

“The Bar is proud of the accomplishments of Aketi both in his stellar services to the NBA and his tour of duty as governor of Ondo.

“If anyone is in doubt of the accomplishments of the late eminent silk, please undertake a visit to Ondo and you will marvel at the radical transformation of the state under His Excellency’s watch.

“Farewell, our Great Aketi. Life levels all men, Death reveals the Eminent. We mourn.”

The Ibadan Branch of the NBA said it lost a mentor and caring patron.

The chair, Mrs Folasade Aladeniyi, said: “He was always there for us. I knew him to be a man of great faith in Christ.

    • Lagos Branch to hold bar dinner Dec. 15

There is a need to create a favourable environment for businesses and investments to thrive, Lagos Branch Chairman of the Nigerian Bar Association (NBA), Olabisi Makanjuola, has said.

The subject, he said, will form the theme of the branch’s annual Bar dinner.

At a briefing in Lagos, Makanjuola, a partner at Olaniwun Ajayi LP, said the dinner is scheduled to be held on December 15 at the Queens Park Event Centre in Victoria Island, Lagos.

Its theme is: “Creating a favourable environment for business and investment in Nigeria through legal policies and reforms.”

The keynote speaker is the Managing Director/Chief Executive Officer of Polaris Bank, Adekunle Sonola.

The chairman said: “Legal policies and reforms are key to economic development.

“So, we decided to bring the Managing Director of one of our finest banks in Nigeria to share experience with us on how businesses can stay afloat in a challenging economy.”

Popular comedian Kiki will be the compere, while the dinner will feature a special guest artist.

Makanjuola said the dinner, which will be free to members, is fully sponsored through funds raised by the planning committee, headed by Mr. Adeleke Alex-Adedipe.

He said the dinner was made free for the first time in fulfilment of part of his campaign promises.

“The annual law dinner is rooted in the finest traditions of the legal profession.

“It is expected to bring together legal practitioners, judges and industry helmsmen to network, celebrate and enjoy some fine dining.

“Lawyers work a lot, and they deserve to play and rest after a good year of working hard.

“This year’s dinner will be free of charge to all our members. However, interested members are required to have registered via the portal of the branch.

“The requirement to attend this dinner is that you must have paid your branch dues as of March 31. For colleagues who have not paid branch dues, we’re so sorry, you will not be able to attend.”

He said non-members can attend by paying a token of N20,000, adding that limited spaces are available.
