    EFCC arraigns ex-NIMASA DG on fresh theft, fraud charges

    The Economic and Financial Crimes Commission (EFCC) on Friday arraigned a former Director-General of the Nigerian Maritime Administration and Safety Agency (NIMASA), Patrick Akpobolokemi, on new charge of converting N2.6billion.

    He was also accused of defrauding the Federal Government to the tune of N795.2million.

    Akpobolokemi was arraigned before Justice Ibrahim Buba along with three others – Capt. Ezekiel Agaba, Ekene Nwakuche, Governor Juan – and three companies, namely Blockz and Stonz Limited, Kenzo Logistics Limited and Al-Kenzo Logistic Limited.

    In a 22-count charge, they were accused of converting a total of N2, 658,957,666 between December 23, 2013 and May 28 this year. The defendants pleaded not guilty to all the charges.

    Akpobolokemi and nine others, including two companies, were earlier arraigned before Justice Saliu Saidu of the same court on Thursday.

    They were accused of conspiring among themselves to convert N3.4billion belonging to NIMASA. They had also pleaded not guilty to the charge.

    In the November 23 charge signed by Festus Keyamo and Rotimi Iseoluwa, EFCC said Akpobolokemi, Agaba, Nwakuche and Juan conspired to convert and converted N437.7million between December 23, 2013 and March 13, 2014 in Lagos.

    The Economic and Financial Crimes Commission (EFCC) on Thursday arraigned a former Director-General of the Nigerian Maritime Administration and Safety Agency (NIMASA), Patrick Akpobolokemi.

    He was arraigned along with nine others, including two companies, before Justice Saliu Saidu of the Federal High Court in Lagos.

    They were accused of conspiring among themselves to convert N3.4billion belonging to NIMASA.

    The commission said the sum “was derived from stealing.”

    EFCC said the alleged offence contravenes Section 18 (a) of the Money Laundering (Prohibition/Amendment) Act of 2012 and punishable under Section 15 (3).

    The others are – Captain Ezekiel Agaba, Ekene Nwakuche, Felix Bob-Nabena, Capt. Warredi Enisuoh, Governor Juan, Ugo Fredrick, Timi Alari and two companies Al-Kenzo Limited and Peniel Engineering Services Limited.

    According to the charge dated November 20, signed by Festus Keyamo and Rotimi Iseoluwa, the accused persons converted the sums between December 2013 and July 15 this year.

    In count one, the defendants allegedly “conspired among themselves to commit an offence, to wit: conversion of the sum of ‎N1,151,214,000.00, property of NIMASA, which sum was derived from stealing.”

    EFCC said on December 23, 2013, the defendants allegedly converted N861.5million. On July 7 and 15 this year, they allegedly converted N235.4million.

    Akpobolokemi, Agaba, Nwakuche and Al-Kenzo were accused of converting N60million which they “derived from stealing.”

    A former Nigeria Maritime Administration and Safety Agency (NIMASA) Director-General, Mr Temisan Omatseye, yesterday denied rigging or splitting contracts at the agency.

    He said he did not award the contracts single-handedly, but referred them to the governing board for approval.

    Omatseye said NIMASA did not know when the Procurement Act, which provides for a tenders board, came into effect, adding that he continued to rely on the governing board for approval of contracts above N5million.

    The former NIMASA boss is undergoing trial before Justice Rita Ofili-Ajumogobia of the Federal High Court in Lagos on an amended 27-count charges of contract scam.

    He was accused of contract splitting involving about N1.5 billion, which violates Section 58(4) (d) of the Public Procurement Act 2007 and Section 14(a) of the money laundering (Prohibition) Act, 2004. He pleaded not guilty to the charges.

    During cross-examination by counsel for the Economic and Financial Crimes Commission (EFCC) Godwin Obla (SAN), Omatseye said all contracts awarded under his tenure followed due process.

    Some of the contracts were for office equipment such as generating sets, computers, printers, BlackBerry smartphones, among others.

    Omatseye said between September 2009 and April 2010, there was no Tenders Board at NIMASA.

    He said he was unaware of the need for a Tenders Board because the law was not brought to the agency’s attention.

    “The Procurement Act was not known to the agency. That’s why everything was going through the governing board in line with the NIMASA Act,” Omatseye said.

    According to him, all the contracts were advertised.  “When I was the Director-General, and coming from private sector, I ensured that extant guidelines were followed. We ensure that everything was advertised.”

    When Obla confronted Omatseye with the fact that a particular contract was awarded for N129million to a company that bidded N100million, when another company had bidded N84million, the defendant said he later cancelled the contract.

    “The statements by myself and MK Shehu (his Director of Procurement) categorically stated that this contract was cancelled,” he said.

  • Firm to NIMASA, others: probe death of nine crew members

    AN oil trading firm, Twinstomp Energy Limited, has appealed to the Navy, Marine Police, Nigerian Maritime Administration and Safety Agency (NIMASA) as well as other relevant authorities to investigate the death of nine of its 12 crew members in a shipping accident.

    The firm said its vessel, MT Tank (IMO no 8681460), collided with another vessel MT Elixir (IMO no 9282510) along Bonga terminal offshore Warri, Delta State on October 19.

    The incident, it said, led to the death of nine Nigerian crew members identified as Kulo Eddy Osang, Arerebo Arepade Clifford, Finecountry Timipouadeh, Akindele Akinbanjon and Odafe E. Offeh.

    Others were Magaji Joshua, Isaac Kojo Money and Salami Malcolm. Others are Ejila Philip, Moses Apobowei and Sambo M.

    Only three of the crew members were rescued alive.

    In a petition by Olumide Oyewole of Andrias & Co Legal Practitioners, the solicitors of Twinstomp Energy Limited, the firm demanded comprehensive probe into the accident with a view to unraveling causes of the mishap.

    The firm said: “Apart from the loss of the ship, MT Tank, we understand that only one body has so far been recovered of the nine dead crew members.

    “We seek your assistance by using your good office to cause a thorough investigation to be conducted on the matter.”

    Oyewole gave the accident site as 04 degrees 27 degrees North and 004 degrees and 27 degree East.

    The Director of Naval Information, Commodore Kabiru Aliyu, confirmed the collision.

    He said two combat vessels have been deployed to the scene of the collision from the Central Naval Command, Bayelsa.

    FG probes NNPC, NPA, NIMASA over remittances

    The Federal Government has started the investigation of fraudulent practices carried out in government’s revenue generating agencies during the last administration.

    The probe, this time, is on the agencies that remitted naira denomination to the Federation Account instead of the actual dollar revenue.

    The Governor of the Central Bank of Nigeria (CBN), Godwin Emefiale, informed the National Economic Council (NEC) of the new probe on Thursday.

    Four State governors namely – Ben Ayade (Cross River), Olusegun Mimiko (Ondo), Aminu Tambuwal (Sokoto) and Darius Ishaku (Taraba) briefed State House correspondents at the end of the NEC meeting presided over by Vice President Yemi Osinbajo.

    Ayade said the Nigerian National Petroleum Corporation (NNPC), Nigeria Port Authority (NPA) and the Nigerian Maritime Administration and Safety Agency (NIMASA) are among the government agencies fingered in the fraudulent remittances.

    According to him, investigations are still ongoing on the remittances.

    He said: “A brief report on the FGN agencies remiting dollar revenues in naira into the Federation account was also given by the CBN governor.

    “He said investigations are ongoing. Such agencies include but not limited to NNPC, NIMASA and NPA.”

    He also said that the permanent secretary in the Ministry of Finance briefed the council on the Excess Crude Account, which he said stands at $2.25 billion as at October 15.

    On the provision of loans to states based on collaterisation of the Excess Crude Account (ECA), he said: “The CBN governor briefed that 27 states have made request for the N10 billion facility and it is currently being processed.”

    “He has called on the affected states to complete all necessary documentation for the same money to the 27 states.”

    The governor added that as at Thursday not all states have indicated interest in the ECA collaterised loan.

    Army to NIMASA: consider fallen soldiers’ kids in seafarers scheme

    The Chief of Army Staff, Lt. Gen. Tukur Buratai, has appealed to the Nigerian Maritime Administration and Safety Agency (NIMASA) to  engage children of  soldiers who lost their lives in the battle against insurgency in its Nigerian Seafarers Development Programme (NSDP).

    This, according to him, will help to alleviate the sufferings of the families of the soldiers who died while defending their father land.

    Buratai spoke when NIMASA’s Acting Director-General Pastor Haruna Baba Jauro visited him at the Army headquarters, Abuja.

    He appealed to NIMASA and  other corporate organisations to assist with the resettlement of the Internally Displaced Persons (IDPs) through their Corporate Social Responsibility (CSR) programmes to have them properly re-integrated into the society.

    “I want to appeal to you and other responsible corporate bodies to assist with the resettlement of IDPs now that calm is being restored to some of those communities because the situation in the camps is not really conducive,” Gen Buratai said.

    While commending NIMASA for combating piracy and other criminal activities on the nation’s territorial waters, he said the Army will always be ready to assist the agency in curbing criminalities, especially in the creeks where barges and other water crafts are used to commit crimes,such as crude oil theft and piracy

    Earlier, the NIMASA chief had congratulated General Buratai on his appointment and  commended him for the successes recorded so far in the fight against insurgency in the Northeast under his leadership.

    Army Chief commends NIMASA for combating piracy

    The Chief of Army Staff, Lt.-Gen. Tukur Buratai, has commended the management of the Nigerian Maritime Administration and Safety Agency (NIMASA) for combating piracy and other criminal activities on Nigerian waters.

    This is contained in a statement by NIMASA’s Head of Public Relations, Hajia Lami Tumaka, issued on Thursday in Lagos.

    According to the statement, Buratai gave the commendation while receiving the Acting Director-General of NIMASA, Mr. Haruna Baba Jauro, who paid a working visit to the Army Headquarters in Abuja.

    The statement said Buratai pledged that the army would cooperate with NIMASA to curb criminal activities, especially in the creeks where crude oil theft and piracy were perpetrated using barges and other water crafts.

    It said the army chief also appealed to NIMASA and other corporate organisations to assist with the resettlement of the Internally Displaced Persons (IDPs).

    The statement quoted the army chief as saying that resettlement was important since calm was being restored to some of the communities.

    It said that Buratai noted that “this could be done through the Corporate Social Responsibility programmes in order to have them (IDPs) properly re-integrated into the society.”

    It appealed to NIMASA to engage some children of the soldiers who lost their lives in the battle against insurgency in its National Seafarers Development Programme (NSDP).

    The statement explained that the army chief pointed out that this would alleviate the suffering of the affected families.

    According to the statement, Jauro congratulated the Chief of Army Staff on his appointment and commended him for the successes recorded so far in the fight against insurgency in the North-East.

    It called for the continuous support of the army in the fight against piracy and other criminal activities in Nigerian waters.

    It added that the partnership had been very useful in reducing the menace of piracy.

    The statement advised the management of NIMASA to take a holistic look at Jauro’s requests and come up with practical initiatives in providing solutions to them.

    How NIMASA blew N17b on varsity land, by panel

    Even though it has yet to take off, the Nigerian Maritime University (NMU) in Kurutie, Delta State, has cost a fortune.

    The Nigerian Maritime Administration and Safety Agency (NIMASA), the university’s promoter, may have spent N17 billion on acquiring the land for its temporary site, a probe panel has learnt.

    The panel was constituted by the Federal Ministry of Transport (FMoT) to ascertain the desirability or otherwise of the university, which was inaugurated with fanfare by former President Goodluck Jonathan 19 days before he left office.

    The panel is wondering how NIMASA spent N17 billion to get two hectares of land in Kurutie, which lacks basic facilities, such as power, water, road, school and health centre.

    Its members, it was gathered, were not happy with what they saw when they visited the site, last week.

    Sources said there was nothing to justify the huge amount spent on the Kurutie land.

    A source said: “The promoters of the university had bad motive before going there to buy land. Are they telling us that it is more expensive to buy land in the creeks than Abuja and Eko Atlantic City?

    “They left the capital city of Asaba, Warri, Agbor and other developed towns to purchase the land in the mind-boggling creek village because they wanted to build a university? Is that the first community to host a university?

    “How much is a plot of land in Asaba and other developed towns in Delta State for anybody to claim that they purchased a plot of land in the creek for over a billion naira? What was the attraction?

    “Even in the big commercial city of Lagos, Ibadan and Port Harcourt, how much is a plot of land in the creeks not to talk of the remote village of Kurutie?

    “How many millionaires not to talk of billionaires are living in that community and its environs? What is the major occupation of the people living in that area apart from fishing?

    “Apart from the land and the structures on the temporary site, even if the university is the owner of over 50 new buildings and the land they occupy, it would still not justify the N17 billion spent on the land by NIMASA,” he said.

    The panel has reportedly queried the amount paid for the buildings on the land before its acquisition.

    A senior NIMASA official claimed that when the agency proposed to establish the university in Kurutie, the community agreed to provide the land. But the promoters, he alleged, returned, few months later to say that the land was bought for N17 billion.

    “Leaders of that community and the promoters of the university must be invited by the committee and the Federal Government to tell Nigerians if the land was sold to NIMASA or not. The amount that was paid by NIMASA and the actual amount it cost to get a plot of land in that area.

    “The N17 billion is public money. The past and present leadership of the agency must be made to tell Nigerians the truth about the money. Why the management of the agency should abandon its core responsibility of safety at sea to build university in order to siphon public fund and think that they can go away with it because they have the ears of the last administration?

    “Well, time changes with man. Therefore, we are happy that there is a change in the government and we hope President Muhammadu Buhari will help us retrieve the money,” the official said.

    The official also alleged that the Cabotage Vessel Financing Fund (CVFF) was not well managed by NIMASA, urging the committee to investigate how much was withdrawn from the fund and what it was used for.

    The CVFF, he said, has grown to billions of dollars without any indigenous ship owners benefiting from it.

    Contributors, he said, do not know the amount in NIMASA’s care, adding that it was time its Acting Director-General, Pastor Haruna Jauro, made the amount public.

    NIMASA Deputy Director, Public Relations (DDPR) Hajia Lami Tumaka, said the panel’s report would be sent to the government when it is ready.

    The committee, according to her, is expected to evaluate all the projects being executed by NIMASA to ascertain their level of completion vis-à-vis the funds released for them.

     

  • NIMASA, NSPMC partner on new seafarers’medic certification documents

    The Nigerian Maritime Administration and Safety Agency (NIMASA) has introduced new Seafarer’s Medical Certification Documents in compliance with requirements of the Maritime Labour Convention (MLC) 2006 and Standards of Training, Certification and Watchkeeping (STCW) 1998 as amended.

    Presenting the documents to stakeholders in Lagos, its Acting Director-General (DG), Mr. Haruna Baba Jauro, said better compliance is one of the key areas in which the agency plays its role of domesticating International Maritime Laws and Conventions that help to keep maritime activities and the marine environment safe, its Head, Public Relations, Hajia Lami Tumaka explained in a statement at the weekend.

    Represented by Director, Maritime Safety and Seafarers Standards Department, Vincent Udoye, an engineer,  Jauro said the new documents on certification are more secure as they are printed with better security features in collaboration with the Nigerian Security Printing and Minting Cooperation (NSPMC) to ensure that Medical Certificates of fitness for seafarers in Nigeria are authentic and in line with international standards.

    Accordingly, the DG further assured all stakeholders in the sector “that NIMASA as an Agency of the government will continue to strive to meet the needs of the sector through better administration of safety standards in all facets of maritime operations”.

    In compliance with other international maritime laws to which Nigeria is a party, notably the Safety of Life at Sea (SOLAS ’74) and the Search and Rescue (SAR) 1978 Conventions, among others, the Agency has also implemented measures, such as procurement of patrol boats, ambulances and priority operational vehicles in addition to facilitating capacity building of human resources towards the successful implementation of these conventions.
