NUPENG, PENGASSAN call for probe of IOCs

The Nigeria Union of Petroleum and Natural Gas Workers (NUPENG) and Petroleum and Natural and Senior Staff Association (PENGASSAN) have written to President Bola Tinubu, demanding an investigation into the allegation that the International Oil Companies (IOCs) are plotting to undermine the Dangote Refinery and Petrochemicals.

In a letter to the President, through his Chief of Staff, Mr Femi Gbajabiamila, dated July 1, the unions emphasised the need for transparency and public trust in the findings.

The letter, signed by NUPENG’s General Secretary, Afolabi Olawale, and PENGASSAN’s General Secretary, Lumumba Okugbawa, reads: “The leadership and members of our great Union and Association profoundly appreciate your commitment and dedication to restoring the economic growth and prosperity of our dear Nation, and we are also fully mobilised and committed to supporting your laudable thoughts and hard decisions towards these lofty goals.

“Unfortunately, we are deeply concerned and shocked by the recent unusual allegations by the Dangote Refinery and Petrochemicals Company of a deliberate plot by some International Oil Companies (IOCs) to frustrate their business efforts and continued existence.”

The unions highlighted that the alleged sabotaging actions include denying the refinery crude oil supply and inflating market prices, forcing the Dangote Refinery to source crude oil from as far away as the United States, thereby incurring high operating costs and logistics.

“The Dangote Refinery is not only a critical national asset but also a beacon of hope for our energy security, economic growth, and employment opportunities. The economic benefits of a local refinery with such capacity as Dangote’s in Nigeria can never be overstated,” the letter continued.

The associations also noted their campaigns for Nigeria to require companies benefiting from joint venture agreements to establish refineries and petrochemical companies within the country.

NUPENG leadership crisis deepens as group holds parallel election

The leadership crisis within the Petroleum Tanker Drivers (PTD) branch of NUPENG has taken a new turn as an aggrieved suspended group held parallel elections to select the organization’s national executives.

The main faction of the organization, led by embattled suspended national chairman, Comrade Lucky Osesua, briefed journalists at a press conference in Abuja, described the election which was conducted by the opposition on July 3, 2024, in Lagos as a Kangaroo exercise that is null and void, declaring that the party went against the judgement of the National Industrial Court of May 29, 2024.

Addressing the press in the company of Comrade Dayyabu Garga in Abuja, the Deputy National Chairman, Comrade Humble Ogbonna Power, and other aggrieved members, Comrade Osesua declared that his group did not recognize the election exercise hence it held its own separate election.

Osesua described his group’s position as a liberation struggle, stressing that they are law-abiding persons who have prepared for all the consequences their cause of action for the liberation of PTD will bring.

According to him, ‘the court ordered NUPENG to forthwith put the process for the new election in motion by constituting an all-inclusive Electoral and Caretaker Committee, as ordered in the judgment in Suit No. NICN/YEN/14/2022, who shall conduct the election within 4 months from the date of this judgment.

He said: “But, NUPENG, on May 31, 2024, released once again discriminatory and selective election guidelines to favour their preferred candidates. This is against the judgment of the court, not equitable, unfair, unjust, and against natural justice.

“We totally condemn this continuous act. We condemn the continuous suspension of all our members; all the people suspended had to be recalled and reinstated to their various units and positions as they were in line with the court judgment of May 29, 2024, as those are the people who will form the delegates. Once again we reiterate that the court ordered the fresh election to be all-inclusive and nondiscriminatory on any account”.

The group further pledged to remain law abiding and never to work against the seamless policies of President Ahmed Bola Tinubu’s administration, while enjoining members to continue in their pivotal roles of distributing petroleum products across the country.

Nigeria Union of Petroleum and Natural Gas Workers (NUPENG) has called on the Federal Government to fast-track the rehabilitation of the Port Harcourt Refinery, saying that it is improper that the Federal Government kept postponing the opening.

Speaking at the special delegates conference of the Petroleum Tanker Driver (PTD) of NUPENG in Lagos during the week, the National President, NUPENG, Comrade William Akporeha, said the union was awaiting the inauguration, saying that the government has assured them that it would commence operation by the end of the month.

Akporeha also called on the government to ensure that bad roads were fixed across the nation. According to him, this would ensure the smooth distribution of the petroleum products.

“We are eagerly awaiting the Port Harcourt Refinery to come on stream. We wish to call on the government to ensure that the old Port Harcourt Refinery starts production by the end of July as promised.

Akporeha also said the union was happy with the outcome of its election, adding that this is what NUPENG is known for.

He urged the new officers to be dedicated to the union.

“There is no faction in PTD, all of us are one. We are one with NUPENG. NUPENG has shown to the world that NUPENG and PTD are one. There is no division,” he said.

At the end of the election, Comrade Augustine Egbon emerged as national chairman of the junior workers’ union in the downstream oil sector.

His opponent Lucky Osesua did not take part in the election.

Egbon thanked stakeholders for ensuring a smooth election. He restated his stance that the PTD would not sever its relationship with its umbrella body, while also offering an olive branch to its aggrieved members.

He said: “I give thanks to God Almighty for making this election possible for us again. I thank the security personnel for ensuring adequate security. I thank our leaders in NUPENG, who did all that was necessary to guarantee a smooth election.

Chairman, Electoral Committee, Comrade Solomon Kilanko declared that the process was in line with the judgment of the National Industrial Court(NIC), Abuja.

He said: “The judgment also demands that the election should be all inclusive and non-discriminatory.

“To this end, the electoral Committee notified members that no one is barred from participating and, in addition, the list of delegates that are eligible is still the same list that was used for the October 31, 2023 election in Ibadan to ensure that those suspended after the election are allowed to participate.”

Comrade Oluchi Chinagorom from the Port Harcourt zone will serve as National Secretary while comrades Lawan Garba, Mathias Ote, Dauda Olabisi and Olaolu Akinmuyise, are National Vice Chairman, Kaduna, Warri, Lagos and Port Harcourt zones of the PTD-NUPENG.

The duo of comrades Malut Abubakar and Odinakachi Nwafor emerged as First Deputy National Chairman and Second Deputy National Chairman.

Justice O. Y. Anuwe of the NIC in Abuja, had on May 29, this year, annulled the previous election held in Ibadan, last October.

Justice Anuwe had ordered that NUPENG should set up an Electoral Committee to organise a new national delegates’ conference within four months.

The judge also instructed that the NUPENG Constitution and the PTD by-laws be followed in conducting the new election.

The Registrar, Trade Union of Nigeria (TUN), Mr Amos Falonipe and Mr. Segun Arowolo from the Legal Department of the Federal Ministry of Labour and Employment monitored the election where 16 national officers emerged.

Attempted Murder: ‘How I escaped death’, NUPENG secretary-general tells court

The General Secretary of the Nigeria Union of Petroleum and Natural Gas Workers (NUPENG), Olawale Afolabi, on Wednesday, June 26, gave details of how he narrowly escaped death when he was attacked by some ex-leaders of the leaders of the Petroleum Tanker Drivers (PTD) branch of NUPENG.

Afolabi spoke while testifying before a High Court of the Federal Capital Territory (FCT) in Maitama at the commencement of trial in the attempted murder case involving the ex-leaders of the leaders of the Petroleum Tanker Drivers (PTD).

The defendants include; a one-time national chairman, Lucky Osesua, his deputy, Dayyabu Yusuf Garga, Humble Obinna, Akinolu Olabisi, Godwin Nwaka, and Tiamiu Sikiru,

The rest are Abdulmimin Shaibu, John Amajuoyi, Zaira Aregbo, Patrick Erhivwor, Stephen Ogheneruemu, Gift Ukponku, and Sunday Ezeocha and seven others.

They were in the suit, marked: CR/042/202, were alleged to have attacked the National President of NUPENG, Comrade Williams Akporeha, General Secretary, Wale Afolabi, and the newly elected National Chairman of the PTD-NUPENG, Augustine Egbon.

They pleaded guilty to the charge and were remanded in prison custody until they perfected their bail.

Led in evidence by prosecuting lawyer, David Kaswe, Afolabi (who is the first prosecution witness) told the court how the defendants descended on him, beat him, and left him to die.

He described the incident, which occurred on November 1, 2023, as the “most awful and horrible day” in his life, adding that it was the day he almost died as a result of the attack carried out on him by the defendants.

Afolabi recalled how he and the National President of NUPENG and two others had arrived at the headquarters of the union at 50 Majekodunmi Crescent, Utarko, Abuja on that fateful day for their lawful duties.

He said unknowingly to them, the defendants had laid siege inside the premises and pounced on him immediately he had used the pedestrian gate to gain access into the building since the main gate was not opened by the security guard.

“Lucky came to me, grabbed my throat, trying to strangulate me. Obinna came and gave me a blow and Sikiru Tiamiu gave me another blow and I became dizzy”, he said.

The witness said when the beating was much and he was about to die, Lucky shouted at the others “Don’t kill him here,” while Gaga said, “Pull him out, it is not supposed to be here “at the point he was dragged out of the union’s premises and further beaten outside until he lost consciousness.

”When I regained consciousness the next day, I found myself in Zankli Hospital, Abuja.

“I suffered severe injuries. I was afraid for my life and safety at the hospital. I had to leave for another hospital,” he said.

Afolabi added that he was later taken to the police station on November 2, 2023, where he made a statement and was taken to the Police hospital services for further treatment.

Kaswe subsequently tendered the hospital reports and patient cards of the two hospitals.

The lawyer also tendered documents from a healthcare facility named: Emmanuel Eye Care Services and Dental Clinic, which were all admitted in evidence by the court.

Also admitted was the petition written to the police on Nov. 2, 2023.

Under cross-examination by a lawyer of the defendants, Benson Igbanoi, Afolabi said he could not remember the number of statements he made to the police.

He admitted not mentioning the names of his attackers in his statement to the police, even though he gave their names while testifying earlier in court.

When asked if there was an election a day before he arrived in Abuja, he answered in the affirmative adding there were three elections, in Ibadan, Warri, and Port Harcourt, and that they have 150 branches.

Also, when asked how he was able to recognise those whom he said attacked him, the witness submitted” that I lost consciousness does not mean I lost my memory ‘

The witness stated that he did not know the name of the doctor who treated him in the hospital.

After the witness’ testimony, Justice Halilu Halilu adjourned till October 10 for the continuation of the trial.

The defendants reportedly attacked the NUPENG President and General Secretary when they accompanied the new PTD national chairman, Augustine Egbon, and other members of his executive to the national secretariat of the union in Abuja, at the end of a Special Delegates Conference for the PTD Branch of NUPENG held in Ibadan, where Egbon and others emerged as national officers of PTD-NUPENG.

The fresh election was a sequel to the judgment of Justice Bashar Alkali of the National Industrial Court of Nigeria, Yenagoa Judicial Division, Bayelsa State, which nullified the PTD Branch of NUPENG election held on June 30, 2O22 in Ibadan.

The defendants are alleged to have acted, “in a manner likely to cause the death of one Comrade Wiliams Akporeha and Comrade Augustine Egbon”, an offence punishable under Section 229 of the Penal Code Act, 2004.

They are also accused of voluntarily causing grievous bodily harm to Comrade Williams Akporeha, Comrade Olawale Afolabi, Comrade Solomon Kilanko, and Comrade Augustine Egbon.

    ‘No crisis in NUPENG, PTD’

The Nigerian Union of Petroleum and Natural Gas Workers (NUPENG) has declared that there is no crisis  in the national leadership of the association or in that of its arm, Petroleum Tanker Drivers Branch.

NUPENG’s General Secretary, Comrade Olawale Afolabi, made the clarification in a letter to the Dangote Refinery and Petrochemical Limited, in  response to the latter’s  report, urging NUPENG and PTD to settle their rift.

Recently, the management of Dangote Refinery and Petrochemical Limited had called on the feuding NUPENG and the PTD leaders to settle.

Afolabi stated that NUPENG is an indivisible trade union under Comrade Prince Williams Akporeha as the National President and Comrade Afolabi Olawale as the General Secretary.

Afolabi said: “We write in response to certain media publication on your response to a purported letter from a lawyer from Edoga Enenche and Co. alleging that there is some sort of “division in the union” and we want to firmly and strongly deny and denounce such situation in our union.

“The NUPENG is one and indivisible trade union organisation underthe leadership of Comrade Prince Williams Akporeha as the National President and Comrade Afolabi Olawale as the General Secretary of the Union.

“For the records, the NUPENG is a credible and responsible trade union organisation duly registered and recognised under Trade Union Act (As Amended) of the Federal Republic of Nigeria with over 120 branches across the country and out of which the Petroleum Tanker Drivers Branch s one of them.

“Further for the records, the National Delegates’ Conference for the Petroleum Tanker Drivers (PTD) branch of the union was successfully convened and conducted on the 31st of October, 2023 at the University of lbadan Conference Centre in compliance with the Constitution of the union and By laws of the PTD with Six 680 delegates from 170 units of the branch in attendance.

“These delegates freely and peacefully elected the national leadership of the PTD branch of NUPENG under the chairmanship of Comrade Augustine Egbon.’’

Afolabi said delegates’ conference was attended and certified by Mr. Amos Falonipe, the Trade Union Registrar of Nigeria from the Federal Ministry of Labour and Employment.

He said the contents of  the purported letter is not only mischievous, but also unfounded, inciting and capable of causing industrial crisis in the Oil and Gas industry most

especially in the newly commissioned Dangote Refinery and Petrochemical Limited.

  • PTD, NUPENG crisis lingers

    PTD, NUPENG crisis lingers

The last year’s leadership crisis in the Petroleum Tanker Drivers (PTD) Branch of the NUPENG has lingered into another year with the association taking a swipe at the General Secretary of the Union, Afolabi Olawale, for calling its members “public goats”.

Afolabi had reportedly, during an interview that he granted a national television a few weeks ago, categorised the PTD members as ‘public goats.’

National Chairman of PTD and his deputy, Comrade Lucky Osesua and Comrade Dayyabu Garga, in a jointly signed press statement, issued yesterday, said that incessant use of derogatory phrases and words against their members at Unit, Zonal, and National levels was a reflection of failed leadership, arrogance, and lack of men of honour at the helms of the union’s affairs.

The PTD national leaders also demanded a retraction of the offensive words by the General Secretary, stressing that failure to do so would further strip him of any honour.

The leaders also stated that as a man of honour and for the place of history, he needed to make the necessary amends in the interest of the union.

“It was a total display of shame to see Afolabi Olawale, the General Secretary of a Union like NUPENG, describe those he claimed to have organized in the informal sector of the union, as public goats.

“He brazenly made the comment without restraint because he is used to it. He loves using demeaning phrases and terms anytime he talks about PTD. He loves calling us illiterate people, scavengers, etc.

“In the same interview, he even said nobody takes care of tanker drivers because most of their employers are not properly structured; then as chief organizer himself, it shows he has failed in his core and statutory responsibilities if in 2024, PTD members are still not well structured so much that their employers will find it difficult to take care of drivers’ well-being and welfare, then it will be fair to conclude that Afolabi is completely a total misfit, a neophyte occupying the seat of General Secretary of NUPENG.

“Unfortunately, he made the disrespectful remarks openly to the surprise of the whole world while also exposing his own incompetence, failure, arrogance, lack of honour, and integrity.

“The question-and-answer session on TVC was an opportunity for him to prove himself as an upright leader, but his many nauseating gaffes, snafus, unintelligible mumbo jumbo and meaningless reactions extremely showed that he is a wrong man for the job of NUPENG General Secretary.

“We, therefore, admonish him to retract the insults passed on us, and failure to do so will further strip him of any honour left in him, and for the price he owes history, he must make the necessary amends in the interest of NUPENG and trade unionism as a whole.

“It is, however, on record that Afolabi has no regard for the basic norms of human conduct. He lacks any self-awareness or self-scrutiny. He seems beyond embarrassment. The only moral and social compass he follows is his own false and fraudulent ideas about what is appropriate and inappropriate, shameful or deceitful.”

“As we have said before, Afolabi Olawale cannot try to take the credit as if the health insurance scheme, which he is currently hyping, was his brainchild. What he is currently championing lacks acceptability, consultation, education and due process. He and his ilk are only using coercive force to lure our members into it, which is against the good intent of the health insurance scheme.

“Our reaction underscores the lack of attraction in the NUPENG programmes and policies which ostensibly lack direction, sincerity and purpose as it is being orchestrated by the current leadership under Afolabi Olawale (General Secretary) and Williams Akporeha (President).

“We therefore urge our members to take informed decisions about their welfare, health, life, wellbeing, and livelihoods and never allow anyone to tricklishly distort their destinies through thoughtless, fishy, self-imposed and questionable schemes.

“We also take this opportunity to inform all PTD members across the board that we are very close to judicial victory whereby things will be done by a constitutionally recognized and legitimate leadership of Comrade Lucky Osesua and Comrade Dayyabu Garga through the grace of God Almighty and the support of all our members and other relevant stakeholders,” the statement said.

    PTD tackles NUPENG over leadership

The National leadership of Petroleum Tanker Drivers (PTD) Branch of NUPENG, yesterday  told Augustine Egbon, Afolabi Olawale, Williams Akporeha and Salimon Akanni Oladiti that their plot to remove Comrade Lucky Osesua and Comrade Yusuf Dayyabu Garga as Chairman and Deputy Chairman of the PTD would fail.

The PTD described the plot as “an enterprise in futility.”

The National Chairman, Osesua and National Secretary, Humble Power Obinna of the PTD branch in a  statement on Sunday, advised the NUPENG leadership to stop chasing shadows and concentrate on letting lasting peace reign in the union.

They said parading  Egbon as the National Chairman of PTD was an affront and unconstitutional.

The duo also added that Gambo Tuge, who is a respected leader in PTD, remained law-abiding and not a fugitive and could not be labelled with unprintable names simply because he was protectimg the interest of the union through legitimate and decent means recognised by the law as well as International Labour Organisation (ILO) conventions guiding trade unionism.

They  also said the election conducted in Abuja on October 31, 2023, by the branch was legal.

The Abuja election, they said, produced Osesua, Garga, Obinna, Akinlolu and other executives.

They stressed that those calling for fresh election had not breached any law, nor had they committed any crime.

PTD also condemned the use of Police and other coercive forces to bully them into silence while also maintaining that police cannot be cajoled to fall for their vicious antics by intimidating, victimizing, oppressing and frustrating them through blackmail, forum chopping/trumped-up charges and propaganda.

Furore in NUPENG over glory for Health Insurance Scheme

Comrade Lucky Osesua, the National Chairman of the Petroleum Tanker Drivers (PTD) Branch of NUPENG, has cautioned drivers in all four zones of the union to be cautious and not fall for the anctics of Afolabi Olawale, the General Secretary of NUPENG, regarding the reintroduction and launch of the Health Insurance Scheme.

The warning was expressed in a press statement the PTD National Chairman, Comrade Lucky Osesua

and National Secretary, Comrade Humble Obinna Power issued in Abuja.

Osesua said that he was the brain behind the programme, which he had earlier introduced to the drivers as the branch chairman.

Osesua, on behalf of the branch, urged PTD members to critically assess the current situations instead of falling for Afolabi’s rhetoric in the mainstream and social media.

He said they should make up their minds and take informed decisions about their welfare, health, life, wellbeing and livelihoods and never allow anyone to negatively alter their destinies by flaunting a caricature of the original idea.

Osesua, in a widely circulated press release, signed by him and the National Secretary, Comrade Humble Obinna Power, said the scheme under his leadership sought to address the welfare, well-being, life and livelihoods of all members of the Branch who traverse the length and breadth of the country on wheels.

He, however, expressed regrets that the scheme was now shrouded in secrecy, adding that signatories had been changed and there was no more transparency and accountability in it, contrary to the initial scheme, which was in the best interest and welfare of the drivers on wheels and principal officers of the Union.

He said: “The attention of the National leadership of the Petroleum Tanker Drivers (PTD) Branch of Nigeria Union of Petroleum and Natural Gas Workers (NUPENG) has been drawn to the offer of the General Secretary of the Union, Afolabi Olawale and the President, Williams Akporeha to launch and reintroduce an existing health insurance scheme which was introduced by me earlier in my tenure, but unfortunately the duo have deliberately manipulated the health insurance scheme, making it so obnoxious for our members to key into, due to the regime of multiple taxes, levies and rates being introduced at various depots and loading stations.

“Putting the records straight, my humble self and my deputy, Comrade Dayyabu Yusuf Garga alongside the entire executives introduced the health insurance scheme for our drivers to have a new lease of life and access to quality and affordable health care in any part of the country once they tender their automated identity cards which contain their biometrics.

“Afolabi Olawale cannot try to take the credit as though the initiative was his brainchild. What they are doing currently lacks acceptability, consultation, education or due process; they are only using coercive force to lure our members into it, which is against the good intent of the health insurance scheme.

“Our reaction underscores the lack of attraction in the NUPENG programmes and policies which ostensibly lack direction, sincerity and purpose as it is being orchestrated by the current leadership under Afolabi Olawale (General Secretary) and Williams Akporeha (President) which is an admittance of their usual disaster in what they tagged “Health Insurance for Petroleum Tanker Drivers on the Wheel.”

“We therefore urge our members to take informed decisions about their welfare, health, life, wellbeing, and livelihoods and never allow anyone to negatively alter their destinies through dubious and questionable scheme.

“My humble self, my deputy Comrade Dayyabu Yusuf Garga and the entire constitutionally-recognised and legitimate national executives of PTD Branch of NUPENG are aware that National Health Insurance Scheme (NHIS) is one of the health financing options adopted by Nigeria for improved healthcare access especially to the low income earners.

He further stated: “One of the key operators of the scheme is the health care providers. Thus, their uptake of the scheme is fundamental to the survival of the scheme. But laughably, Afolabi, as usual, was attempting to take credit for it while also trying to reinvent the wheel. This is most ridiculous and unthinkable.

“However, we have gathered hard facts from impeccable sources that Afolabi who is now driving the process only redesigned it to further impoverish our members because the intention is reactionary and also serve as a Greek gift to hoodwink our members, but little did he know that our members have made up their minds not to fall for his anti union antics and extortionist tendencies.

“It is therefore imperative for us to state clearly that the scheme which is set to kick off on Thursday, December 14, 2023 was only hurriedly reintroduced to launder Afolabi’s already battered image and to seek empathy from our members as he craves for recognition, acceptance and legitimacy.

“For those who know Afolabi, he is such an individual who doesn’t have any track record or history of making people happy but rather he derives pleasure in  inflicting hardship and pains on people for selfish and greedy intents.

“We are still surprised why the General Secretary of our parent union will be among signatories to PTD’s bank accounts, especially the one for the health insurance scheme and others.

This is the first time this will be happening; it is alien to our byelaws and extant rules, and moreso, there are more than a hundred other branches both in formal and informal sectors; why is he investing so much passion and interest in the goose that lays the golden egg: the PTD Branch?”

“In the light of the above, we passionately appeal to all our members to remain steadfast and law abiding by showing solidarity with us as we continue in the struggle to restore decency, sanity, constitutional democratic process and rule of law; and more importantly to bring back dignity to our labour in order to revive our socio-economic fortunes as well as freedom and pride. Thank you all, and God bless you.”

The Nigeria Union of Petroleum and Natural Gas Workers (NUPENG) has mourned the death of its former General Secretary, Comrade Chief Frank Ovie Kokori who died on Thursday, December 7.

Kokori, a foremost labour leader, passed away after a prolonged illness.

    He was 83.

In a statement signed by NUPENG President, William Akporeha and General Secretary, Afolabi Olawale, the Union said Kokori was a “well-known committed and dedicated defender, promoter and fighter for workers’ rights and democratic rights of the citizens.”

The statement added: “He spent a life of “Sacrifice” to struggles for emancipation of the working class globally and enthronement of democratic rule in Nigeria.

“He spent years in prisons and severally brutalised in his struggles for not only the Trade Unions but in the struggles against military rule in Nigeria.

“His later years were spent nursing some of the vicious wounds inflicted on him in the course of those struggles yet like a great Warrior he was, he still lived up to good age before he eventually surrendered to go home for a peaceful rest after those struggles for humanity.

“We love Comrade Frank Ovie Kokori but we as humans, we have to take consolation in the great and wonderful memories he left behind for us to cherish and celebrate.
