  • Police want me to implicate Saraki, says Offa robbery suspect

One of the suspects in the April 5th, 2018 bloody bank robbery in Offa, Offa local government area of Kwara state, Ayoade Akinnibosun on Monday revealed that the police asked him to implicate Senate President Bukola Saraki.

Akinnibosun alongside two other suspects, Ibikunle Ogunleye (2nd accused person) and Adeola Abraham (3rd accused person) gave testimonies of how police extracted statements from them under duress at a Kwara state High Court, sitting in Ilorin.

Other accused persons Salaudeen Azeez and Niyi Ogundiran were in court.

The three accused persons also said that the principal suspect Michael Adikwu in the robbery incident was shot dead by one Inspector Vincent attached to the police Intelligence Response Team (IRT).

The police high command had reportedly announced that Michael Adikwu slumped in their custody and was rushed to the hospital before he finally died.

IRT which office in Abuja, is headed by Deputy Commissioner of Police Abba Kyari Akinnibosun, who is the first accused person, Ogunleye and Abraham in the Offa robbery incident were examined and cross-examined by their counsel Mathias Emeribe and Prosecution counsel Razaq Gold in a trial within trial on how they were tortured and threatened by the police to make confessional statements.

Prosecution witness Inspector Hitila Hassan had on Thursday told the court that the suspects voluntarily gave their statements under his supervision.

Lead Prosecuting Counsel Prof Wahab Egbewole sought to tender the statements as exhibit but defence counsel Mathias Emeribe objected.

Mr. Emeribe argued that the statements were not voluntarily taken, noting that they fell short of the provisions of the Evidence Act particularly sections 28 and 29.

At Monday proceedings, Akinnibosun said “Abba Kyari told me to mention the name of Senate President Bukola Saraki that he gave me the guns for the operations. But I declined to do contending that my life is at stake.

“He promised that they would reward me handsomely and set me free if I can indict Senator Saraki. When I disagreed they called some policemen to take me back to their cell. During this time my hands were tied to my legs in the back. Their children are in America and Europe you are allowing yourselves to be used as political thugs.”

Akinnibosun added that he was the leader of Kwara South Liberation Movement mobilizing young jobless graduates for the Senator representing Kwara South district in the upper legislative chamber, Dr Rafiu Ibrahim.

The essence is to secure government jobs for the boys, he said. Ayoade Akinnibosun, Ibikunle Ogunleye and Adeola Ibrahim gave graphic details of their horrifying experience allegedly in the police custody in Abuja.

During one of their encounters at the police IRT ‘theatre room,’ they said in their presence Inspector Vincent allegedly shot dead five Fulani men.

The trio added that it was in the same ‘theatre room that Inspector Vincent otherwise known as ‘Mr. Torture,’ allegedly shot dead Michael Adikwu for failing to indict them in the robbery incident.

According to Ibikunle Ogunleye “they brought the late Adikwu to implicate us and he said he had not met any of us in his life that is why Mr. Torture shot him to death. “

Presiding judge, Justice Halimat Salman adjourned the case to March 25th for continuation of trial within trial.

  • Offa robbery: Absence of defence counsel stalls hearing of suspects

Absence of defence counsel, Mathias Emeribe on Tuesday stalled the continuation of hearing of the Offa robbery suspects at the Kwara state High Court sitting in Ilorin.

All the accused persons, Ayoade Akinnibosun, Ibikunle Ogunleye, Adeola Abraham, Salaudeen Azeez and Niyi Ogundiran were in court on Tuesday.

Prosecution counsel, Prof Wahab Egbewole informed the court that Mr. Emeribe called and sent text message to him on what he described as “life threatening experience on the road” and suggested adjournment, which the court reluctantly agreed with.

Presiding judge, Justice Halima Saleeman expressed disappointment over the absence of the defence counsel in court.

She said that the prosecution counsel should have asked for details of the “life threatening experience” of the defence counsel.

“Does it mean that he won’t step out of his room till after the national elections? I can’t fathom this excuse and explanation, for someone to sit in the comfort of his house and be sending text messages. This court is only interested in timely dispensation of the matter and any delay could put the court in jeopardy”, she said.

Justice Saleeman thereafter adjourned hearing on the matter till March 14 and 15, 2019.

Speaking with reporters after the court sitting, Prof Egbewole said that the defence counsel called him on Sunday and also sent a text message to him on Tuesday that he could not be in court on Wednesday and suggested a date after the national elections.

He said “this is just to show on the part of the prosecution that we’ve arranged our witnesses because we have them here from Plateau and Zamfara states, to ensure that the matter proceeds. But here we are.

  • Prosecution counsel stalls hearing of Offa robbery case

Commencement of definite hearing of the Offa robbery case could not begin yesterday at the Kwara State High Court sitting in Ilorin, the state capital.

This was due to the unpreparedness of the prosecution counsel.

The court had fixed yesterday at the last adjourned date for definite hearing as a result of the inability of the prosecution counsel to produce witnesses in court.

The five accused Ayoade Akinnibosun, Ibikunle Ogunleye, Adeola Abraham, Salaudeen Azeez and Niyi Ogundiran were in court.

The April 5th 2018 bloody bank robbery incident claimed 33 lives including nine policemen and women.

The accused were charged with alleged conspiracy, armed robbery, murder, culpable homicide and illegal possession of fire arms.

Appearing for the first time in the case for the state government/prosecution, Prof Wahab Egbewole (SAN), urged the court to grant him some ample time to interact with the witnesses.

He thereafter applied for a short adjournment.

He added that “I got a fiat from the state Attorney General and Commissioner of Justice Kamaldeen Ajibade yesterday to take over the case. I am yet to interact with the witnesses who are in court.

”I want to plead, I will not ask for adjournment any more in this case. What is important in this matter is for justice to be done to all parties at the end of the day,” Ajibade said.

In his reaction, defense counsel, Mathias Emeribe, agreed with the position canvassed by the learned silk.

“However, I want to urge him to impress it upon the police to avail me of all the evidences they want to tender in the matter. It is important for me to study the evidence and bring same before my clients to be able to do a proper defense in this matter,” he added.

Said he: “I am still waiting for prosecutors to show that they have the capacity and all that is required to do well in this case.  At least, if for nothing, you discover, the fault is not from the

defense, so that when I begin to make the necessary applications the whole world will know that the defense is justified.

“There are some things you will do and it will look as if you are not ready to do justice in this matter. My countenance and that of the defense have shown that we are ready to prove our innocence.”

Angered by the delayed in the commencement of hearing, the trial Judge, Justice Halimat Salman said “I don’t like what is happening in this case. At the end of the day they will put the blame on the court.

The witnesses are in court yet you (prosecutors) are not ready for prosecution.”

Before granting the application for adjournment, Justice Salman said “the court is reluctantly granting the adjournment at the instance of the prosecution.”

She then adjourned the case to January 25th for hearing.

  • Offa robbery: Absence of witnesses stall hearing of suspects

Hearing on Offa robbery suspects at the Kwara state High Court sitting in Ilorin, was on Monday stalled by the failure of prosecution to produce witnesses in court.

As a result, the court at its resumed hearing on Monday, adjourned the case to January 18, 2019, for definite hearing.

The five accused persons brought before the court were Ayoade Akinnibosun, Ibikunle Ogunleye, Adeola Abraham, Salaudeen Azeez and Niyi Ogundiran.

The April 5th 2018 bloody bank robbery incident claimed 33 lives including nine policemen and women.

The accused were charged alleged conspiracy, armed robbery, murder, Culpable Homicide and illegal possession of firearms.

When the case which was slated for definite hearing Monday came up, Kwara state Director of Public Prosecution (DPP), Jimoh, Mumini said that the police who investigated the case could not bring their witnesses who are all in the Force Headquarters in Abuja to the court.

The DPP added that “all the witnesses in the robbery case are policemen who investigated the case and they are all from the Police Headquarters in Abuja. No witness was taken from Offa where the robbery took place and non from Kwara state. ”

Mr Mumini said that all efforts he made to the police Assistant Inspector General David Igodo who is in charge of Police investigation and Mr Abba Kyari, a Deputy Commissioner of Police who led the investigation team to Kwara state to produce the witnesses in court did not yield any result.

The DPP said, “on the 10th of December, 2018, I wrote a letter to the AIG, Mr Igodo which I copied to this honorable court to make available all witnesses in this case in court today. I followed it up with phone calls on January 2, 4 and 6, 2019. It was at about 8.07 pm yesterday (Sunday) that Abba Kyari, DCP told me that the witnesses will leave Abuja for Ilorin this morning. I told him that the court would sit at 9am. The AIG then told me to beg the court for short adjournment.”

He, however, sought for short adjournment for the case from the court.

The Defence Counsel, Mathias Emeribe said that the prosecution was not ready to go on with the case.
He did not however oppose to the adjournment.

He pleaded with the court to order the prosecution to serve him with the amended charge of the case as well as the confessional statements of the five accused persons.

In his ruling, the trial Judge, Justice Halimat Salman said that she was adjourning the case till January 18, 2019 because the police failed to make the witnesses available in court.

She then vacated the definite hearing order slated for today and ordered that the police should send down all the witnesses to Ilorin for the definite hearing of the case on Friday next week, 18th January, 2019.

  • Don’t play politics with Offa robbery, Minister warns

Information and Culture Minister  Lai Mohammed yesterday  chided some political actors in Kwara State for what he termed attempting to trivialise the April 5, 2018 robbery attack in Offa.

Thirty-three lives were lost in the robbery.

Speaking at the 2018 Ijakadi Festival in Offa, Alhaji Mohammed   said claims of compensating the victims in monetary terms could not equate the lives lost in the incident, and described efforts to trivialize the act as indecent.

He asked the people to condemn any attempt to play politics with human lives.

His words: “In recent days, there have been attempts by some political desperadoes to trivialize the calamity that befell this community when those armed robbers attacked banks and the police station, among others.

“These desperadoes were quoted as saying that when they visited this town to commiserate with the people after the attack, they donated N10 million, even when what was stolen from the banks’ vault was N7 million.

”Now, let us ask them: How many of those who were killed in that attack have they also been able to bring back? How can any sane person equate human life with money? No amount of money is worth any human life. And no one should play politics with human life. All people of conscience must condemn this glib comment by a desperate political warlord.”

Alhaji Mohammed commended the resilience of the people of Offa for organizing such an elaborate festival, despite the calamity that befell their community this year, saying it is not surprising because Ijakadi festival itself is a celebration of the Offa virtues of strength and determination, as well as equity, justice and wisdom.

He expressed delight that the people of Offa have resolved that never again will any armed robber, hoodlum or brigand shed the blood of any innocent person in the town by raising N700 million to build an ultra modern Mobile Police Force Barracks in the community.

The Minister said in keeping with the mandate of the Federal Ministry of Information and Culture to develop and promote national festivals, a manager of the Ijakadi Festival has been nominated to attend a training on festival management in Ghana.

In his remarks, the Olofa of Offa, Oba Mufutau Gbadamosi Esuwoye II, said the Ijakadi Festival is aimed at sustaining the cultural heritage of the people and fostering cohesion in Offa community and its environs.

Highlights of the festival include traditional wrestling, homage to the Oba by the various districts, horse racing, hairdo and traditional attire display, as well as Moremi showpiece.

  • Offa robbery suspects pleaded not guilty

An Ilorin, Kwara State High Court yesterday took the pleas of April 5 bloody Offa robbery suspects.

The five suspects arraigned in court pleaded not guilty to the five count of armed robbery and illegal possession of firearms preferred against them.

The suspects were physically present in court and were represented by Mr. Mathias Emeribe.

They are Ayoade Akinibosun, Ibikunle Ogunleye, Salawudeen Azeez, Adeola Abraham and Niyi Ogundiran.

The five charges against them include conspiracy to rob banks in Offa; possession of gun and explosives and robbery of the staff and premises of Zenith, Eco Bank, Union Bank, GT Bank et al; conspiracy to murder nine police officers and other innocent souls on the said date including women; commission of culpable homicide resulting in the death of nine police officers and others and illegal possession of firearms (two AK47) on the said day.

Taking their pleas one by one, they all swore not to know anything pertaining to the bloody robbery incident on April 5 this year, which claimed scores of lives including those of police officers.

All the suspects claimed not to be in Offa on the day of the robbery incidents. Two of the suspects, Adeola Abraham and Salawudeen Azeez, when asked of their involvement in the murder of nine police officers, retorted: ‘Auzubillahi.’

Salawudeen Azeez added: “I have not touched a gun in my life time.”

Earlier, the prosecution led by the Kwara State Attorney General Kamaldeen Ajibade (SAN) said the case was adjourned from November 21 till yesterday to amend the charge based on the “information as to the death of the first accused person, one Michael Adikwu.

“We have filed out application to that effect. We are ready to move our harmless application dated and filed 23rd of November, 2018 and brought pursuant to Section 207, 208 subsection one and two of criminal procedure.

“We pray for an order granting the complainants/applicants to amend the charge deleting the name of the first accused and an order for the application to be properly filed.”

Presiding Judge, Justice Halimat Salman, granted the prayers of the prosecution for the deletion of the name of the first accused person, Michael Adikwu, reported by the police to have slumped and died in their custody.

Before the commencement of pleas, suspects’ counsel Mr. Emeribe had asked the court to give him more time to interact with the suspects, adding that he was just seeing them for the first time in court.

Said he: “I was just served with the court processes this morning. I won’t blame the prosecution as they may not know. I was briefed about the matter yesterday by the families of the suspects.

“I stand on the Provision of Section 36 which talks about adequate time. It is, however, within the power of the court to do justice, taking cognizance of the sensitivity of the matter.

“The only thing that can save them from the hangman’s noose is the constitution. I don’t know the kind of pleas they are going to make now that will not work against them.”

But, Justice Salman said in order to save time, “I will take their pleas this morning.”

The counsel to the accused also brought to the notice of the court that he was yet to be in possession of the CD and confessional statements of the suspects attached to the charge sheet.

  • Offa robbery: Police diverting attention from extra -judicial killing, says Saraki

The Senate President, Bukola Saraki, has accused police authorities of diversion in the alleged extra judicial killing of a prime suspect in the April 5, 2018 Offa robbery incident, in which 33 persons were killed by the bandits.

Police had reported that the suspect, Michael Adikwu, died in detention  thus prompting Saraki to demand inquiry into the circumstances that led to the suspect’s death.

In response, the police said that Adikwu’s death will not stall the trial of the remaining suspects.

Police investigation had linked Saraki to some of the robbery suspects, who claimed that they received empowerment from him, and that, they had been used by Saraki, in the past, to disrupt elections in Kwara State.

But in a statement, yesterday, by his media Adviser, Yusuph Olaniyonu, the Senate President described the police’s respinse as mere diversionary tactic.

According to him, the action of the police was aimed at evading the serious issues of human rights abuse, extra-judicial killing and politicisation of criminal investigations.

The statement clarified that when he mentioned in his statement on Wednesday, that he had been vindicated, Saraki was not referring to the outcome of a case which is just about to commence.

Rather, the statement he claimed, was pointing to the belated admission by the police, that Michael Adikwu, the prime suspect, had died in custody, a fact that was initially denied by the police when he (Senate President) raised it a few months ago.

He alleged a cover up by the police in the mishandling of the investigations, adding that police authorities have continued to make inconsistent statements and committing more blunders.

“The police, while reacting to our disclosure that the prime suspect had died in custody, caused their spokesman, Moshood Jimoh, to respond that: ‘Michael Adikwu is in police custody in one of the South-west states…helping in the investigation’. The same Police have equally documented the claim that the suspect died during arrest. What a contradiction!

“It is surprising that the Police, which initially allowed the said Adikwu to grant interviews to several national newspapers while in custody, refused to inform the public that the suspect had died, until the Attorney General of Kwara State, mentioned it on November 21, 2018 in the course of his address to the High Court in Ilorin, while applying to amend the charge sheet,” said Saraki.

Saraki urged President Muhammadu Buhari to institute an inquiry into Adikwu’s death because it has several implications for the country’s legal system and its engagement with the international community.

“This is an instance of what these international partners complain about. The Presidency should make a point that the present government does not tolerate human rights abuse, extra-judicial killing, politically-motivated criminal investigation and refusal to comply with global best practices by security agencies by instituting an inquiry into the case of the death of this suspect,” Saraki added.

The Senate President called for diligent prosecution of the Offa robbery case so that justice can be done to the innocent victims of the April 5 attacks, the suspects facing trial and the state where peace was disturbed by the sad incident.

  • Offa robbery: Reps to investigate death of key suspect

The House of Representatives is to investigative the circumstances surrounding the death of Michael Adikwu, a key suspect in the Offa, Kwara State, bank robbery.

The incident, which occurred seven months ago, claimed many lives.

The Committee on Police Affairs, Human Rights and Justice mandated to carry out the investigation, is expected to uncover the issues and answer questions as to when the suspect died, how he died, why the police denied the facts of his death, at what point the police leadership discovered the death of the suspect and why the police are covering up the facts.

The committee is also expected to unravel issues of human rights abuse, extrajudicial killings and manipulation of criminal investigation by the police.

The decision of the lawmakers followed the adoption of a motion of urgent national importance by Zakari Mohammad (PDP, Kwara), who noted how shocking was the disclosure by the police that Adikwu, the principal suspect in the bank robbery in Offa, Kwara State, which occurred on Aprii 5, is dead.

He said: “The police initially confirmed to the Attorney- General of Kwara State through the Police Public Relations Officer, Moshood Jimoh, that the principal suspect was alive and in custody and was helping the police in the investigations of the robbery that led to the killing of 22 people and recovery of firearms that were carted away.

“Of concern, however, is that it took the police so long to make the disclosure about the death of the principal suspect after denying its veracity as was reported in the media.

“It is equally worrisome that there have been inconsistencies in the various statements by the police and a possible cover up of this extra-judicial killing with the aim of tarnishing the image of some innocent individuals for political purposes.

“It is common knowledge that it is the constitutional duty of this hallowed chamber to take action wherever such level of irresponsibility and recklessness of an important law enforcement agency such as the Police have arisen in the course of investigations into a vicious crime.”
