    $6b Mambilla project: Ex-Minister Agunloye re-arraigned on amended charge

    A former Minister of Power, Dr. Olu Agunloye, was yesterday re-arraigned before a High Court of the Federal Capital Territory (FCT) in Apo on a seven-count amended charge the amendment made by the Economic and Financial Crimes Commission (EFCC) filed against him.

    Agunloye pleaded not guilty when the charge bordering on forgery, disobedience of a presidential order and corruption on the 3,960 megawatts (MW) Mambilla Hydroelectric Power Station in Taraba State, was read to him by a court official.

    The prosecution alleged, among others, that the former minister received N5.212 million from Sunrise Power and Transmission Company Limited (SPTCL) and Leno Adesanya through Jide Abiodun Sotinrin.

    The money was allegedly paid into Agunloye’s Guaranty Trust Bank account for conveying the Federal Government’s approval for the construction of the power station in favour of SPTCL while serving as minister.

    Testifying yesterday, the second prosecution witness (PW2), Adewale Agunbiade, a Compliance Officer with Jaiz Bank Plc (formerly with GTBank), said he neither knew the defendant personally nor had any special interest in the case.

    Agunbiade said despite having left GTBank, he was not surprised when the EFCC invited him in May 2023 to write a statement on the case.

    The witness, who was cross-examined by defence lawyer Aseola Adedipe (SAN), said when he informed the EFCC that he had left GTBank, he was told that it did not matter since he prepared the documents on the court’s proceedings.

    He confirmed the bank statement of Jide Abiodun Sotinrin, who paid money into Agunloye’s account on August 10, 2019, October 22, 2019, and November 13, 2019.

    Agunbiade said the transactions were about individuals’ transfers, explaining that the transfer of money was from one individual customer of GTBank to another individual customer of the same bank.

    The witness explained that the transfer of N3.6 million by Sotinrin to Agunloye’s account did not reference that it was made on behalf of either Leno Adesanya or Sunrise Power and Transmission Limited.

    Alleged $6b fraud: Agunloye faults EFCC on amended charge

    A former Minister of Power, Dr. Olu Agunloye, yesterday challenged the amended charge the Economic and Financial Crimes Commission (EFCC) filed against him at a Federal Capital Territory (FCT) High Court in Abuja.

    The former minister is standing trial for alleged infractions in the award of the $6 billion Mambila Hydropower plant in Taraba State.

    Agunloye, who was minister under former President Olusegun Obasanjo’s administration, is charged with seven counts bordering on forgery and disobedience to presidential order before Justice Jude Onwuegbuzie.

    In the suit, the EFCC alleged that Agunloye, on May 22, 2003, awarded a contract, titled: “Construction of 3,960 megawatt (MW) Mambilla Hydroelectric Power Station” on Build and Operate basis.

    The anti-graft body also alleged that the minister contracted the project to Sunrise Power and Transmission Company Limited without any budgetary provision, approval and cash backing.

    The EFCC also alleged, among others, that it traced some suspicious payments made by Sunrise Power and Transmission Company Limited to the former minister’s accounts.

    But the defendant pleaded not guilty to the charge.

    At the resumed hearing of the matter, the prosecution counsel, Abba Muhammad (SAN), informed the court that the commission filed an amended charge before the court and provided additional six proof of evidence.

    The lawyer prayed the court to allow the defendant take his plea to the amended charge.

    Agunloye, through his counsel, Adeola Adedipe (SAN), told the court that the case was adjourned for the defence to cross-examine the second prosecution witness (PW2), Adewale Agunbiade.

    The former minister said the defence came prepared for the cross-examination of the PW2 and not for an amended charge.

    He urged the prosecution to allow its witness to be cross-examined first before talking about an amendment to the charge before the court.

    Adedipe said the prosecution could not unilaterally amend the charge before the court.

    The lawyer averred that for the prosecution to amend the charge against the defendant, it ought to apply formally to the court for leave to do so.

    He cited the provisions of Section 218(2) of the Administration of Criminal Justice Act (ACJA).

    Muhammed said the prosecution has the power to amend the charge at any stage of trial before judgment, citing Section 216(1) and (2) to back his submission.

    After listening to their submissions, Justice Onwuegbuzie directed the prosecution to formally apply for the amendment to the charge to enable the defence to respond to same.

    He announced that the court would hear the application at the next adjourned date and adjourned the case till November 11.

    $6b Mambilla Hydropower project: Ex-minister Agunloye remanded in Kuje Prison

    • Court to hear bail application today

    A High Court of the Federal High Court (FCT) in Apo has ordered the remand of former Minister of Power and Steel, Olu Agunloye, in Kuje prison, Abuja.

    This followed his arraignment before the court yesterday.

    Agunloye was arraigned on a seven-count charge in which he was, among others, accused of accepting bribe, engaging in forgery, disobedience to presidential directive, and conspiracy.

    The ex-minister, who is the sole defendant in the charge, was said to have conspired with Leno Adesanya (said to be on the run) of Sunrise Power and Transmission Company Limited (SPTCL) in allegedly committing the offences.

    The defendant was accused of receiving a bribe totalling about N5,221,000.00 from Adesanya and SPTCL in relation to the award of the contract for the construction of 3,960 megawatts (MW) Mambilla Hydroelectric Power Station in favour of SPTCL while in office in 2003.

    He pleaded not guilty when the charge was read to him and the prosecuting lawyer, Abba Mohammad of the Economic and Financial Crimes Commission (EFCC), applied that the defendant be remanded in custody pending the commencement of trial.

    Defence lawyer, Adeola Adedipe (SAN), told the court that an application for bail had been filed for the defendant.

    In view of the information from Adedipe, Justice Jude Onwuegbuzie adjourned till today for the hearing of the bail application.

    But the judge ordered that the defendant be remanded in Kuje prison until the determination of his bail application.

    Counts in the charge against the former minister, among others, read:

    *That you, Olu Agunloye, whilst being the Minister of Power and Steel on or about the 22nd of May 2003 in Abuja awarded a contract, titled: Construction of 3,960MW Mambilla Hydroelectric Power Station on a Build, Operate, and Transfer Basis, to Sunrise Power and Transmission Company Limited without any budgetary provision, approval and cash backing and you thereby committed an offence contrary to and punishable under section 22(4) of the Corrupt Practices and other Related Offences Act, 2000.

  • Buhari congratulates Olu Agunloye at 70

    President Muhammadu Buhari, has felicitated with the former Corps Marshal of the Federal Road Safety Commission, and former Minister of Power and Steel, Dr Olu Agunloye, on his  70th birthday.

    The felicitation by the president was contained in a statement issued by his Special Adviser on Media and Publicity, Mr Femi Adesina, in Abuja on Friday.

    Buhari, in the statement, joined members of Agunloye family, his friends, professional colleagues and political associates in congratulating the former minister.

    The president noted that Agunloye had over the years, contributed to national development with his knowledge and experience in science.

    He extolled Agunloye’s visionary and purposeful style of leadership, and his advocacy for good governance, derived from participatory democracy and development, as the way forward for a peaceful and prosperous Nigeria.

    The president also saluted Agunloye’s courage and patriotism in serving the country in various capacities, including Minister of State for Defence (Navy), and his decision to join the governorship race in Ondo State in 2016.

    Buhari prayed that the almighty God would continue to protect and guide Agunloye and his family, and grant him longer life to keep serving the country.

  • 2019: Those who hijacked APC failed to manage it well – Ikimi

     PDP led CUPP sets up four committees to solidify agreement

    Chieftain of the People’s Democratic Party (PDP), Tom Ikimi has blamed some forces within the All Progressive Party (APC) for the crisis being witnessed in the ruling party.

    Ikimi noted that those who hijacked the party had failed to manage the fairs of the party very well, hence the crisis.

    This is as the PDP led Coalition of United Political Parties (CUPP) sets up four committees to solidify the agreement signed by the 39 member-coalition. The committees are : Contact and Mobilization; Blue print and manifestos; Strategy and Planning; and Medial and Publicity.

    The coalition was set up on the 9th of July as an alternative vehicle by the political parties to wrestle power from the ruling APC.

    Ikimi is the chairman of the 23 member committee of Blueprint and manifesto, which includes Babaginda Aliyu, Olisa Agbakoba, Olu Agunloye.

    Mallam Bolaji Abdulllahi, who recent resigned from his position as the spokesperson of the ruling party was announced as the head of the Media and Publicity committee, which includes Kazeem Afegbua, Kola Ologbondiyan etc.

    The Strategy and Planning committee is headed by Kawu Baraje of the RAPC and it also includes Prof. Rufai Akali, while the Contact and Mobilization committee have as members Ibrahim Kazaure, Senator Dino Melaye and others.

    Speaking to reporters after the inauguration of the committees, Ikimi said “I was involved in the merger arrangement that produced the All Progress Congress (APC) unfortunately, some people who hijack the arrangement could not manage it and that is why we are seeing the demise of APC now.”

    Speaking on the setting up of the committees, Ikimi said “I am pleased since they came together, they have been waxing stronger and stronger, not even one of the members has left the coalition and every time we meet, we are building our strength. Today, we have witnessed the inauguration of four very important committee of this coalition and its membership is drawn among all the 39 political parties. I am pleased to serve as the Chairman of the Blue print and Manifesto committee, which indeed will be that document that we will present to Nigerians that will contain all the things we will want to do for Nigerians in the next administration. Am happy that we are making progress that the steering committee is working well, and we are at the point of actual take off now.

    “It seems to me that the coalition of United Political Parties is the next best thing for Nigeria as we stand.

    “I hope we will work in accordance of our agreement and CUPP will remain stronger and stronger.”

    In his opening remark, the Chairman of the coalition steering committee, Olagunsoye Oyinlola posited that the inauguration represent another phase of the struggle to wrestle power from the APC.

    He said, “The country cries for revival. We must not and ill not abandon Nigeria in the hands of the current officials who have convinced everyone that they are incompetent and incapable of driving Nigeria to prosperity. We have seen the people impoverished to the extent that the Brooklyn institute recently crowned Nigeria as the Poverty Capital of the world. We have seen how insecure and unhappy our people have become. We are also appalled at how the government is lost and how it shamelessly blames its failures on the past. Our people are helpless. They look up to us for deliverance. We must not fail them.”

    Charging members of the committees, Oyinlola noted that the inauguration of the various committees is a further consolidation of whatever has been achieved by the Coalition since the signing of the MOU.

    “The coming together of these parties was an unprecedented political action in this country. Even our opponents knew that what we did was a watershed in the quest to redirect the affairs of Nigeria. Since that event, a lot more has happened. We have seen patriotic elected and appointed officials leaving the sinking ship of the ruling party for this coalition. In days and weeks to come, we will see more positive actions that will convince every Nigerian that this coalition is the government in waiting,” he added.

    He also stressed that “each of these sub- committees has duties which are closely linked with the duties of every other ones. This is to tell us that the sub- committees must work in harmonious ways that will ensure the realization of the ultimate objective of the coalition.

    “This cardinal objective is known to all of us. It is to wrest power from the APC in the 2019 elections and take Nigeria to prosperity. And by the grace of God, we won’t fail. However, we have to work hard knowing that the destiny of our country and those of millions of our countrymen and omen depend on the success of this movement. As I stated at the MOU signing ceremony, these are not the best of times for our country. We have all seen how our country has been, in the last three years, slipping progressively into socio-economic and political coma.

    “When we signed the MOU days ago, the Nigerian people were elated at the coming together of patriotic political parties. However, they felt the same way when a merger was consummated in the build up to the 2015 elections. Regrettably, the All Progressives Congress which came out of the 2015 exercise has failed the people and we all know that that tells us is that we have a lot of work to do. We must in words, action and conduct show clearly to our people that this coalition is not just another gang- up to capture power for self-aggrandizement. We must plan well and work hard to wrest power from the APC and use the resultant power for the good of our people. ” He therefore appealed to all members of the committee to “be in one committee or the other here to be selfless in discharging our responsibilities. Again, I repeat as I said days ago, the spirit of a new Nigeria has been born and is already at work. The sub-committees we have just inaugurated, here represent another phase in the offensive we launched to reclaim our country.’ God Almighty will crown our efforts with success. We shall not fail. ”

    The governorship candidate of the Social Democratic Party (SDP Dr Olu Agunloye on Saturday voted in Erusu where majority of the voters were women.

    Agunloye who is the first governorship candidate in the state to pick a woman as his running mate expressed satisfaction with the peaceful conduct of the election.

    He said without good governance and credible leadership,the state would not move forward.

    The former Chief Executive of the Federal Road Safety Commission(FRSC) has mapped out various ways to improve the life of the citizenry in the state if given the opportunity to govern the state.

    His running mate,Erelu Modupe Akindele Martins voted in Ore,Odigbo local government said the election was devoid of violence.

    She appreciated women for supporting her and the party’s  candidate,Agunloye.

    Warning: Beware of Ogere FRSC checkpoint. We were stopped there on Sunday evening by FRSC checkpoint maybe Number 242 vehicle. We were breaking no laws. We were driving in the right lane when most people drove in the left lane to avoid the FRSC who often jumped out of the way of vehicles refusing to stop. We were asked for particulars and then fire extinguisher. Another officer took a keen interest in the licence on the windscreen and scrutinised me. I did not look at him. The particulars officer asked us to go when the scrutinising officer gesticulated to others.  He said to my hearing, ‘this is the man who has been writing petitions against us.’ We were ordered us to stop again. This same officer got on his phone to announce to his superior that he has ‘arrested a man who has been writing petitions against the FRSC and is impounding his car’. My driver was ordered to hand over the keys to the car.  I was asked to get out of the car. Things were getting a little tense though most of the officers did not know what was going on, as they were attending to two other vehicles, a white pickup and navy blue Benz. Knowing that we had not broken any law and anxious not to be falsely arrested, I asked my driver to bring my FRSC file which I carry around. From it I extracted a plaque given me by FRSC and a Q&A booklet to the Highway Code written by me in 1991 after we had written the Highway Code on my dining table under Professor Wole Soyinka and Olu Agunloye for which we took no fat contract fees –just love of country. The sight of these mellowed things down and we were asked to go, but not before I advised the FRSC staff that we want to love them but they make it so difficult with their ‘uniform is God’ behaviour. I can only imagine what could have happened if the FRSC were armed. I do not write petitions. I write facts. Change the facts and I will change my writing, arrest or no arrest. I was among the first set of Special Marshals, so to be stopped is interesting. To be harassed is a crime against my human rights. I seek no revenges. Let the FRSC train and retrain its staff to ‘help’ not ‘hinder’ road users whether they ‘petition; or not! I love FRSC in which I have invested a lot of my time. I will not allow bad FRSC people to destroy my investment and the investment of good FRSC people, past and present. We must stop the corruption of the uniform –moral and monetary.   Nigeria is part of the world and cannot continue to provide no or minimum standards when Nigeria earns and squanders so much money annually. Nigeria’s aviation gurus should visit Mumbai’s ‘swanky’ new airport terminal before congratulating themselves on what they have done at MMA and elsewhere. The artwork is fantastic along all the walls you find scenes and historic events from India’s past including maps made from recycled circuit boards which is being used by many of our own artists. At least one percent and sometimes two percent of all funds expended on public buildings is allocated to iconic artwork in all civilised countries. Is such a law enforced in Nigeria? This is what the arts groups and architects associations need to fight for in all Nigeria’s public building contracts. Are Nigeria’s authorities who travel all over the world first class at Nigeria’s expense blind when they pass through the airports of other countries? How dare they make us appear as a country with no art! Our artists should google Mumbai’s new airport and protest through organised sectors. They should get to work getting entrepreneurial jobs for their members.

    This government promises just 20,000MW in five years when South Africa has 45, 000 MW now and will have 80,000MW in five years.? Rubbish.  So power is not a priority? This government is saying that there is no money to finish the Lagos-Ibadan Expressway used by millions a day. Rubbish. So this road is not a priority. Is this political punishment or economics?

    Be in no doubt about how politicians despise and hate you until a week to the elections when they need you and are forced to tolerate you as they would a necessary evil or a poor relation. How else do you explain why they seem to have a right to every good thing while you remain with nothing, chicken change even though you supposedly put them there through the manipulation of your vote? When you complain, they reply quickly that change will come slowly. Well my friends ‘Change Must Come’. Even unelected political office holders owe their positions to the electorate for voting for the employer.

    There are those seized by greed. The phone camera will force police and VIOs and FRSC to earn your respect. Let us put up posters around the country –‘There may be cameras monitoring your corruption. Beware!  We must never forget those who, by greedily seizing the political space, forcing Nigerians to bow to them and call them distinguished, honourable and representative. The political class succeeded in subjugating the people to keep Nigeria as ‘The Dark Country’ in electricity, education, health, economics, housing while devaluing our businesses, currency and lives.

    Ex-FRSC chief decries state of Akoko roads

    Former Corps Marshal/Chief Executive of the Federal Road Safety Commission (FRSC) Dr. Olu Agunloye has decried the deplorable state of the Ikare-Ajowa road in Akoko, Ondo State.

    Agunloye, a chieftain of the Labour Party (LP), said the road has been under construction since the tenure of the late former Governor Olusegun Agagu, which is over 10 years ago.

    He threatened to sue the contractors handling the project.

    Agunloye said: “This road is in a very deplorable condition. Its current state is dangerous. It combines incessant dangers from road traffic crashes with serious health hazards arising from inhaling heavy dusts, which may lead to acute health conditions in the short run or lung cancer in the long run.

    “It is also hazardous to non-road users as well, especially children and the elderly, who inhale heavy doses of dusts daily from their bedrooms. The road, especially from Imo-Arigidi to Ikaram is not vehicle worthy or people-worthy by public safety standards.

    “The dusty road has not only painted floors, bedrooms, wardrobes and drawers brown in several homes; it has sent several of our people to hospitals and some to early graves.

    “The situation has become significantly tragic for the Imo-Arigidi, Erusu, Ibaram, Iyani and Ikaram communitie, as many residents have died of asthma and bronchitis.

    “It is wrong of the contractor to open up the entire stretch to dust for over a year, irrespective of whether or not the government is aware of its careless but dangerous action.

    “We have noted that it may be correct, as most people say, that the government has been insensitive about this road and the plight of the people, but the construction company has not shown any professionalism and is liable in the face of the law.

    “I wonder how the neglect got to this level and what the government expects the people of Akoko to do. It is indeed embarrassing!”
