    …Refuses Sheriff’s, Ibrahim’s request to disband fresh panel

     

    Factional leaders of the People’s Democratic Party (PDP), Ahmed Makarfi and Ben Obi and the substituted governorship candidate of party in Ondo State, Eyitayo Jegede recorded major victory before the Court of Appeal in Abuja Thursday.

    The court, in two unanimous rulings by a three-man panel, upheld the applications by Makarfi, Obi (Chairman and Secretary of the PDP Caretaker Committee) and Jegede for leave to appeal against the June 29, 2016 judgment and October 14, 2016 ruling of Justice Okon Abang of the Federal High Court, Abuja.

    Justice Abang had, in the judgment of June 29, recognised the Ali Modu Sheriff leadership of the PDP as the authentic body to take decisions for the party.

    In the October 14 post-judgment ruling, Justice Abang ordered the Independent National Electoral Commission (INEC) to accept the name of Jimoh Ibrahim (produced by the leadership of the party in Ondo, supported by the Sheriff faction in place of Jegede produced by the Markefi backed faction of the party in Ondo.

    Justice Ibrahim Saulawa (who led the panel) said in the lead ruling in the application by Jegede that he has satisfied the court that he was a necessary party to the case even when he was not a party at the trial court.

    Justice Saulawa held that under Order 7 Rule 3 of the Court of Appeal Rule an interested party to a judgment, who was not a party at the trial court, is allowed to apply to the appellate court for leave to appeal if such an application had been rejected by the lower court.

    He noted that in this case, since the trial court had reject Jegede’s application for leave to appeal, he was right to have file similar application again before the Court of Appeal within the prescribed 15 days.

    As against the argument by lawyer to factional Chairman of PDP in Ondo State, Biyi Poroye and other members of his Executive, Beluolisa Nwofor (SAN) that the June 29 judgment was a consent one, the court held otherwise.

    The court held that since Jegede was not a party at the trial court, he could not have consented to the judgment. It noted that by the record of the court, INEC that was a party at the trial court, did not consent to the judgment.

    “I am satisfied that there are reasonable grounds duly established by the applicant (Jegede) that he be given the opportunity to appeal the judgment.

    “The applicant has duly established that he is the person aggrieved by the decision of the court below, having won the primary of the party,” Justice Saulawa said.

    He granted that application, deemed the notice of appeal and record of proceedings already compiled by the Jegede as properly filed and compiled.

    The courts granted an order departing from its court’s rule and abridge the time within which parties could file their processes.

    It granted the appellant (Jegede) 24 hours within which to file his brief or argument and three days to the respondents to file respondent’s brief.

    The ruling delivered in the application by Jegede, was adopted in the similar applications by Makarfi and Obi.

    In an earlier ruling, the court refused an application by Poroye and others for the disbandment of the fresh panel set up to hear all the appeals on the dispute over the governorship candidate of PDP in Ondo.

    The court held that the decision to set up a special panel to promptly determine the appeals was within the administrative powers of the Court of Appeal President, which cannot be challenged by anyone in court.

    Other members of the panel: Justice Ignatius Igwe Agube and Ita Godwin Mbaba agreed with the lead decisions by Justice Saulawa.

    Threat of ‘war’ in Ondo State

    As the governorship election in Ondo State, South-west Nigeria fast approaches, political developments in the state have become a cause for worry. Ondo State and its next-door neighbour, Ekiti State, are the two states under the control of the opposition Peoples Democratic Party, PDP, in the South-west geo-political zone of the country.

    The two states have some peculiar similarities. Their people are brothers and sisters. In fact, Ekiti State was carved out of Ondo State some 20 years ago. In terms of culture, tradition and other socio-political issues, the two states are like Siamese twins. Besides, the incumbent governors of the two states, Olusegun Mimiko of Ondo and Ayodele Fayose of Ekiti, are two dogged governors who were able to stand their own when the ‘progressive’  tsunami overran the South-west a few years ago, first, through the Action Congress of Nigeria, ACN and then, the All Progressives Congress, APC.

    Fayose put paid to the reign of the ACN in Ekiti State after a ding-dong battle at the polls in 2014. Similarly, Mimiko went through an energy-sapping judicial duel with his namesake, the late Olusegun Agagu, who was governor of Ondo State on the platform of the PDP. Mimiko, a veteran of grassroots politics, had briefly served in the government of Agagu as secretary to government before he pulled out due to disagreement with his boss over his second-term agenda. By doing this, he incurred the wrath of the then president and another namesake, Olusegun Obasanjo, who was also his political benefactor. With this, he knew that the doors of the PDP were foreclosed against him.

    As a grassroots politician, he knew he could weather the storm without the PDP. He later pitched his tent with the nascent Labour Party at that time. It was on the platform of the Labour Party that he contested election in 2007 as governor of Ondo State. By the calculation of the Independent National Electoral Commission, INEC, he lost that election. Agagu won.

    But Mimiko thought differently. He felt he was short-changed. He headed for the courts to test the veracity of the result of the election. It was the battle of his life. And for two years, the case went on. He was finally pronounced governor on February 23, 2009, on the platform of the Labour Party which he single-handedly financed and nurtured to national reckoning.

    In his first year in office, his popularity soared to high heavens. It was like he was the only good thing that had happened to the state in many years. Market women, students, artisans all sang his praises to high heavens. That was the time the people of the state came up with the slogan: “Iroko”, (as he is popularly known and called), “gba si be”. In Yoruba mythology, Iroko, one of the biggest trees in the forest, is highly revered. It is credited with so many superstitious beliefs connoting, raw energy, strength and power.

    So, whenever Mimiko was sighted in town, the common refrain was: “Iroko, gba sibe”. “Gba sibe,” in this context, means “our votes are for you anytime, any day.” And long after the 2007 elections and the titanic court battles, the slogan stuck to him like a plague, a positive one, that is. But today, all that is history. The Iroko of yesterday is desperately struggling to find a successor to take over from where he will stop on February 24, 2017.

    Long before the two separate governorship primaries embarked upon by the two factions of the PDP in the state — the Ahmed Makarfi and the Ali-Modu Sheriff factions — there had been indications that Mimiko would settle for Eyitayo Jegede, a Senior Advocate of Nigeria, SAN, and the state’s attorney-general and commissioner for justice, as successor. And true to bookmakers’ prediction, when the Makarfi faction of the PDP to which Mimiko belong, held their own primary in Akure, Jegede emerged as the candidate. The Ali-Modu Sheriff faction later took their own primary to Ibadan and Jimoh Ibrahim, also a lawyer and controversial businessman, emerged winner.

    Jegede’s emergence caused some furore in his faction, but it was quickly doused. On the other hand, Ibrahim’s emergence from the Sheriff’s faction was like a fait accompli. Those who know Ibrahim are aware of his ruthlessness when it comes to spending money. Since he emerged as a candidate of the Sheriff faction of PDP in the state, he had avoided the public, preferring instead, to remain underground where he has been throwing tantrums at real and imaginary enemies.

    First, he accused certain officials of INEC of demanding a $1 million bribe from him. That one has been debunked. Then, the big upset came when a court in Abuja, came up with the verdict that he was the “rightful” candidate of the PDP and also instructed INEC to acknowledge him as such. That decision overturned the apple cart in the whole political configuration in the state as far as the forthcoming election is concerned.

    The matter was made worse, when on Thursday, October 27, INEC came out with the list of eligible candidates and endorsed Jimoh Ibrahim as the authentic candidate of the PDP. Since that announcement, it is as if hell has been let loose in the state.

    Though the announcement must have caught Mimiko napping, he quickly summoned courage and dashed to Abuja, to lay his complaints before the President. He, however, gave a proviso that if the decision was not quickly reversed, his state could go up in “conflagration”. This is the crux of the matter.

    For God’s sake, why should Ondo State go up in flames if Mimiko’s anointed candidate does not contest the election? It is true that Mimiko has recorded some significant achievements in office as governor of Ondo State, but as stated earlier, the goodwill that heralded him into office more than seven years ago, seems to have evaporated.

    Ibrahim may have been an interloper in PDP, but what is happening in the larger PDP today and particularly in Ondo State is the handiwork of Mimiko. He, it was, who teamed up with the likes of Ayo Fayose and Nyesom Wike of Rivers State and brought Ali-Modu Sheriff to the party as interim chairman. Now, Sheriff has proved too artful for all of them to handle and instead of presiding over a united party, he is doing the job of an undertaker.

    Initially, according to reports, the trio — Mimiko, Fayose, and Wike — were all engaged in a war of attrition trying to outdo one another to gain Sheriff’s favour and possibly, become a running mate to him if his ambition to become the presidential candidate of the PDP in 2019 materialises. At least, that was the permutation and game plan. Now, that plan has fallen flat on its face.

    Jimoh Ibrahim may have played a crude, crooked and smart one on Mimiko and the PDP, but, by and large, what is happening is an internal problem of the PDP, which should not be magnified into a state-wide conflagration. The truth is that it is a faction of the PDP in the state that is beating the drums of war and stoking the fire from beneath. It is now left for the security agents to do their jobs.

    After all, there are divisions and schisms in all the other parties particularly the APC and Alliance for Democracy, AD, in the state, but none has called its supporters out to disrupt the peace and tranquillity of the state.

    As it is, except the court reverses itself, INEC may not be able to save the PDP. And just like Justice Ignatius Agube, a justice of the Appeal Court observed last week, the party’s failure to internalise democracy within its fold over the years was the cause of its problems. Indeed, almost all the political parties operating in Nigeria today are guilty of this anomaly. The earlier the parties put their houses in order, the better for democracy in Nigeria.

    Plateau State Governor, Simon Lalong on Tuesday said that the crisis hitting the People’s Democratic Party (PDP) in Ondo State will not halt the forthcoming governorship election in the state.

    According to him, only the Independent National Electoral Commission (INEC) can stop the election from holding based on security issues.

    He therefore advised PDP in the state to put its house in order.

    The governor spoke with State House correspondents after meeting Vice President Yemi Osinbajo at the Presidential Villa, Abuja.

    On the threats by Ondo State Governor Olusegun Mimiko that elections can’t go on in a situation where the state is in crisis, Lalong said: “Well I don’t like joining issues with the incumbent because he is not contesting election, he is not the candidate for Ondo. I have said here that if they have issues within their party they should go and resolve that issue within PDP. This is not a PDP matter. In that election it’s not only PDP that is contesting election, other political parties are engaged in contesting the election and the chief electoral officer is the INEC.

    “If INEC comes and says we are not going to conduct election because of some security issues, we will accept. But as far as we are concerned, we are not worried about what other political parties would say. For APC we are ready to contest the election we have a candidate and we are going into the elections in November.

    “For us, our party is ready for election in Ondo state, infact we are flagging off our campaigns on Thursday so we are very ready,” he added.

    On the purpose of his visit to the Vice President, he said that he came to discuss issues concerning his state.

    “My meeting with the vice president is not about election. I just came in to see the VP on other state engagements like issues on agriculture, school feeding programme because the Vice President is the chairman on the school feeding programme,” he stated.

  • Ondo: Court of Appeal gets new panel

    …To inform parties about new hearing dates Thursday

     

    The President of the Court of Appeal, Justice Zainab Bulkachuwa has constituted a fresh panel of three Justices to hear appeals relating to the dispute over the governorship candidate of the People’s Democratic Party (PDP) in Ondo State.

    The new panel has Justice Ibrahim Saulawa (Acting Presiding Justice of the Calabar division of the court) as head.

    Other members are Justices Ignatius Igwe Agube and Ita Godwin Mbaba (both of the Owerri division.

    The Nation learnt Wednesday that members of the new panel will meet today and agree on when to commence sitting and work-out schedule of sitting, following which hearing notices will be sent to parties.

    The new panel is to act in place of the last one, headed Justice Jumai Sankey that withdrew on Tuesday following a petition by factional Chairman of the PDP in Ondo Prince Biyi Poroye.

    Justice Bulkachuwa, in a letter dated November 1, 2016, a copy of which was served on the court’s Chief Registrar, informed members of the new panel of their appointment.

    By the letter, a copy of which The Nation sighted in Abuja yesterday, the new panel is to hear and determine four appeals.

    They include:  CA/A/402//2016, filed by the Ahmed Makarfi faction of the PDP against Benson Akingboye and two others; CA/A/551/m/2016 filed by Ahmed Makarfi and Ben Obi against Biyi Poroye and 10 others and CA/A/551A/m/2016 filed by Clement Faboyede and another against 10 others.

    The panel is also to hear an appeal marked:  CA/A/EPT/567/2015 filed by Diri Kelly Adonye and INEC and two others.

    Two pending appeals in relation to the Ondo PDP crisis it yet to be assigned to any panel.

    They are:  CA/A/551C/2016 filed byEyitayo Jegede against Prince Biyi Poroye and 10 others; and CA/A551B/2016 filed by the PDP against Biyi Poroye and 9 others.

    In her letter to members of the new panel, Justice Bulkachuwa directed them to independently design their work schedule, including dates of hearing of the appeals.

    They are also to liaise with the Presiding Justice of the Abuja division of the court, Justice Abdu Aboki.

    Part of the letter reads: “You are hereby empannelled to sit and determine the above appeals in Abuja Division expeditiously.

    “Hon. Justice I. M. M Saulawa will be presiding in the panel.

    “Fixation of dates to be worked out with the Presiding Justice, Abuja division.”

    On Tuesday, Justice Sankey had, while speaking about petition by Poroye, said iy contained many allegations, including claim that members of her panel were induced to act in favour of the appellant.

    Other members of her panel were Justices Emmanuel Agim and Oluwayemisi Williams Dawudu.

    Justice Sankey said: “The petitioner is not only complaining about the speed with which the panel is going about the case, he also said that the setting up of the panel is unnecessary because the case did not require any urgency.

    “The petitioner accused me of being very poor. He said because I was ill some years ago, I have become so poor that I am open to corruption. He is using my illness of about five years ago to say I am so poor that I am now open to corruption.

    “I carry my poverty with pride. I will not steal any body’s money,” Justice Sankey said.

    Justice Agim wondered why the petitioner failed to explore the legitimate process of asking a judge to withdraw from a case rather than resorting to casting aspersions at innocent judges via a petition, containing unsubstantiated allegations.

    “One of the allegations in the petition is that the reason we are doing this case is that we have been paid money,” Justice Agim said.

    While announcing her panel’s withdrawal from the appeals, Justice Sankey said: “Ordinarily, since no facts have been placed before this court formally, to show a likelihood of bias on the part of the panel, and since learned Senior Advocates for the petitioner and first respondent has disassociated himself from the petition, we would have been minded to continue with the hearing of these appeals.

    “This position will accord with settled law on bias against a judge on the basis of which his recusal is sought. It is that a judge, upon such a mere allegation, should not simply throw in the towel and abandon the case. “Such an attitude has been described as an abdication of judicial responsibility. It is the duty of the judge to consider the facts placed before him to find out if they are not just spurious and whimsical, but discloses a reasonable basis that there is a real likelihood of bias.

    “Even though this petition has fallen short of showing any likelihood of bias, nonetheless, we consider it more desirable to recuse ourselves at this stage in respect of all appeals and applications connected to the Ondo State governorship election.

    “All the files in this regard are now sent back to the Honourable President of the Court of Appeal for re-assignment.”

    Seven die, 13 injure in Ondo auto crash

    Seven people Tuesday lost their lives in an accident which occurred around Amurin village along Akure-Owo expressway road in Owo local government area of the Ondo State.

    The incident, which occurred around 2.a.m was said to have been caused by over speeding of the driver of a Peugeot J5 bus with registration number BKK 424 XA

    It was gathered that the J5 bus driver collided with a Truck belong to Nigerian with registration number NA 1087 BO5 and 13 other passengers were also said to have sustained severe injuries and currently receiving treatment at the Federal Medical Centre (FMC), Owo.

    As at the time of filing this report, the identities of the dead victims are still unknown.

    Officials of the Federal Road Safety Corps (FRSC) refused to talk on the incident.

    But, the State Police Public Relations Officers (PPRO), Mr. Femi Joseph confirmed the incident.

    According to him “The army truck, driven by one Sergeant Ashima Abdullahi broke down and parked beside the road when the bus rammed into it at that midnight.”

    The PPRO also stated that the remains of the dead victims had been deposited at the morgue of the Federal Medical Centre, Owo while the injured were also receiving treatment at the hospital.

    The Peoples Democratic Party (PDP) in Ondo State on Wednesday forwarded the name of Prince John Ola Mafo to the Independent National Electoral Commission (INEC) as the running mate of Mr. Eyitayo Jegede (SAN) in the November 26, 2016, governorship candidate.
    This is in line with the directive of INEC that the issues bordering on withdrawal and replacement of candidates would elapse today, October 12, 2016.
    The Publicity Secretary of the PDP in Ondo State, Mr. Banji Okunomo in an interview said the credentials of Mafo qualified him for the position.
    According to Okunomo, the decision to pick Mafo was taken by the highest decision body of the PDP in Ondo State.
    His words: “At the highest decision-making body of Ondo State Peoples Democratic Party (PDP) today, the PDP resolved on the choice of Ola Mafo as the Deputy Governorship candidate of the party.
    “The party took this far-reaching decision after considering all factors that would lead to its victory at the poll.
    “The party weighed a number of options including the credentials of Ola Mafo which ranged from being a former chairman of Ilaje local government area of Ondo State, former Commissioner for Information in Ondo State.
    “Mafo was also a former Special Adviser to Governor Mimiko and until his nomination, he is the chairman of the Ondo State Football Association (ODSFA).
    “Mafo is also a foundation member of the PDP and a veteran politician from the Southern senatorial district particularly Ilaje local government, a native of Zion Pepe,” he said.
    Okunomo posited that the choice of Mafo was based on equity and political balance saying: “For equity and balance, it is apposite for the party to uphold his nomination as the Deputy Governorship candidate.
    “His name has been forwarded to the INEC as the Deputy Governorship candidate of the PDP. With this development, all party members are further directed to go about their normal campaign, this time, for the Eyitayo/Mafo ticket.
    “Finally, the party wishes to congratulate Prince John Ola Mafo for this political elevation,” Okunomo said.

    Ondo State Professionals in Edo State have appealed to aspirants of the All Progressive Congress who lost at the party primaries to support the candidacy of Mr. Rotimi Akeredolu for the party to be victorious at the polls.

     

    The Ondo Professionals urged Segun Abraham to sheathe sword and not set the stage fire because he lost at the party primaries.

     

    Chairman of the group who spoke to journalists at the end of the group’s quarterly meeting in Benin City, Dr. Samson Falana, said Akeredolu has the capacity to solve unemployment problems as well as fixing infrastructural decay in the state.

     

    Dr. Falana appealed to National Leader of the APC, Asiwaju Bola Tinubu, to support Akeredolu for the overall interest of the APC.

     

    His words, “Ondo APC has spoken by electing Akeredolu to represent the APC in the elections. No external forces should circumvent their collective will.”

    A group, Akoko Consultative Forum(ACF) said it would support the former Minister and flag bearer of the Social Democratic Party(SDP), Dr Olu Agunloye in his governorship bid for theNovember 26 poll in Ondo state.

    A statement by its Chairman, Chief Festus Obaude, Secretary, R.A Ajayi, and Welfare/Education Committee Chairman,Christopher Olorunfemi described Agunloye as an illustrious son of Akokoland who has the capacity to uplift the area and the whole state.

    The Akoko group lamented that the people in the four local government areas of the state have been relegated to the background with lack of infrastructures to make life meaningful to the people.

    ACF noted that the present government since inception in February 2009 has not made its impact felt in Akoko land especially on good road network, stable electricity and potable water supply.

    It expressed optimism that with Agunloye’s passion for Akokoland, the former Chief Executive of the Federal Road Safety Commission (FRSC) would bring development to the communities in Akokoland and Ondo state as a whole.

    According to the statement “we are determined individually to support Agunloye’s aspiration, although ACF is apolitical, but our members are conversant with the situation in Akoko land, we believe with our support and that of the people, the SDP candidate will emerge victorious in the coming election.

    “We believe it is the turn of Akoko to produce the next governor,we are not happy that our people could not speak with one voice,the only alternative now is Agunloye and we will support him”.

    The ACF said the people-oriented programmes of the SDP would bring development to the state, create wealth and employment for the people.

    It urged the people of Akoko land to rally round the Erusu-Akoko politician and vote massively for his emergence as Governor in the state.

    The All Progressives Congress (APC) in Ondo State has congratulated the Governor-elect of Edo State, Mr. Godwin Obaseki on his victory at the just concluded September 28, 2016, Governorship election in the State.

    A statement issued by the APC State Publicity Secretary, Omo’ba Abayomi Adesanya said the victory is well deserved by the party especially in a keenly contested poll.

    APC lauded the Independent National Electoral Commission (INEC) for ensuring the exercise when on smoothly.

    The party noted that the simultaneous Accreditation and Voting system introduced by the commission has largely reduced rigging and violence.

    It therefore, advised INEC not to lose sleep on the new strategy it adopted, but to improve on it for future elections, especially, the November 26thGovernorship election coming up in Ondo State.

    APC appealed to its members in Ondo state to work assiduously for the victory of APC and it candidate, Mr. Oluwarotimi Akeredolu (SAN).

    The governorship candidate of the Unity Party of Nigeria (UPN) in Ondo State, Barr. Bolarinwa Aidi on Monday said the administration of Governor Olusegun Mimiko has short changed people of the state.
    He particularly lamented that the people living in the northern and southern senatorial areas of the state have been totally cut off from governance.
    Aidi stated this at a press conference held in Akure, the state capital to kick off his campaign ahead of November 26, gubernatorial poll.
    The UPN candidate said he intends to pursue with vigor, the five noble cardinal programmes of the party and return the state to the path of progress if elected.
    He noted that “on the issue of decadence in social amenities and dilapidated infrastructure, my heart bleeds anytime I remember that more than 75 percent of the citizens of my state are currently living without electricity and pipe borne water.
    “While the people of Ondo south and north are badly affected by this precarious situation, the outgoing inept, rudderless, greedy and insensitive administration under Mimiko has not been able to think out of the box by looking towards other viable options towards electricity generation.
    “The ripple effect of the denial of electricity to the larger population of the state for instance, can better be imagined than experienced-businesses are grounded or killed totally and the cost of running businesses for those who can afford to power their generators, are most times running those businesses at a loss.
    “It is most unfortunate that almost 96 percent of the Ondo state population are denied access to potable water.
    “The one-time celebrated Ondo State water corporation is now a shadow of itself as it has neglected, refused or patently denied the good people of Ondo clean, hygienic and treated water.”
    However, he promised to employ qualified teachers to teach students and also tackle unemployment head-on by having an in-depth research on how to reposition the economy of the state from prostate condition by diversifying into agriculture.
