    Terrorism: Osinbajo renews call for international collaborations

    Vice President hosts Bangladeshi Army chief

    VICE President Yemi Osinbajo yesterday renewed the call for international collaboration at tackling the menace of terrorism, stating that Nigeria will continue to cooperate in the global fight.

    He made the call while hosting the Bangladeshi Chief of Army Staff, Gen. Abu Belal at the Presidential Villa in Abuja.

    He described as unfortunate that networking among terrorists groups across the world has increased, hence the need for countries to close ranks and unite against threats posed by their activities.

    Prof Osinbajo said: “We are concerned about terrorism not just within our borders, we have also seen the influence of terrorists across borders and how terrorist organisations have cooperated with each other

    “We are aware for instance that some within our own borders are cooperating with ISIL and we think that this sorts of evil collaborations must have a response from countries that share similar experiences and can present a credible force against terrorists.’’

    Speaking about the urgency required to tackle the menace, the vice president warned: “Terrorism is a major problem and perhaps the most significant problem that the free world will face in the coming years.’’

    On the Nigeria-Bangladesh relations, he said that an improved cooperation between the Bangladeshi and Nigerian military would go a long way in curbing threats posed by terrorist groups within and around borders of the two countries.

    Osinbajo said: “We have benefitted a lot from some of your experiences in fighting insurgency in Bangladesh and we hope that we benefit even more from those experiences.

    “We have had similar problems with Boko Haram and I know that you have also had problems of some sort with terrorist groups within the borders of Bangladesh.’’

    He listed defence and economy among others as the area requiring the cooperation of the two countries.

    The vice president hoped for collaboration in some other areas like the Bangladesh Ordinance Factory, saying: “We also have an ordinance factory here at DICON which we are hoping to do a lot with very soon. We hope that there might be ways that we could cooperate especially in the manufacture of ordinances, arms generally and other forms of weaponry.’’

    The Bangladeshi Chief of Army Staff Gen. Abu Belal Muhammad expressed gratitude at the reception accorded to his delegation since arriving in Nigeria.

    He said the long-standing relations between Nigeria and Bangladesh has helped in the career development of many officers of the armed forces of both countries.

    Gen. Muhammad added that there was however a need to strengthen relations on the defence and economic fronts to tackle challenges that are peculiar to both countries.

    The Bangladeshi Army chief is in Nigeria on a working visit to improve military relations between both countries.

  • Osinbajo’s panel grills NIA DG again

    The Presidential Investigative Panel headed by Vice President Yemi Osinbajo on Monday again quizzed the suspended Director-general of the National Intelligence Agency (NIA), Ayo Oke.

    Oke was suspended last Wednesday over discovery of large amounts of foreign and local currencies by the Economic and Financial Crimes Commission (EFCC) in a residential apartment at Osborne Towers, Ikoyi, Lagos, over which NIA has made a claim.

    He had appeared before the panel last week.

    Among the panel members that quizzed Oke on Monday were the National Security Adviser, Babagana Monguno.

    The committee set up by President Muhammadu Buhari is also investigating the allegations of violations of law and due process made against the suspended Secretary to the Government of the Federation (SGF), David Babachir Lawal, in the award of contracts under the Presidential Initiative on the North East (PINE).

    The committee is expected to submit its report by next week.

    The meeting which started around 1.p.m on Monday was still in progress at the time of filing this report.

    The Presidential Investigative Committee has formally written to the suspended Secretary to the Government of the Federation, Mr. Babachir Lawal, and the Director-General of the National Intelligence Agency (NIA), Mr.  Ayo Oke.

    The committee, headed by Vice President Yemi Osinbajo, directed the two officials to submit all documents relating to award of contracts by the Presidential Initiative for the North East (PINE) and the cash remittances to NIA in the last two years.

    Lawal is being probed over alleged N200 million contract awarded by the Presidential Initiative for the North East (PINE) to Global Vision Limited, a company with which he has links, for the clearing of ‘invasive plant species’ (weeds) in Yobe State.

    Oke, on the other hand, is being investigated over alleged $43.4 million covert operations cash uncovered by the Economic and Financial Crimes Commission (EFCC) at the 7B apartment in Osborne Towers, Ikoyi, Lagos.

    The Osinbajo-led panel wrote to the two embattled government officials on Thursday, asking them to submit a comprehensive report complete with all available documents related to the allegations that were levelled against them.

    The documents they are expected to submit include

    • details of appropriated funds in the last two years;
    • allocation of special funds if given;
    • approvals for funds and by who;
    • expenditures; withdrawals from the Central Bank of Nigeria(CBN) if any;
    • covert operations and for what purposes;
    • completed and non-completed projects;
    • list of contracts awarded;
    • ongoing projects;
    • and operation of safe houses.

    The committee expects the two officials to send their responses to the panel on or before Monday. A source said the committee will start “interacting with the suspended officials from next week.”

    The modalities for their appearance are being worked out by the committee, the source said.  Some government agencies will be invited too for “interaction,” he said.

    Findings made by our correspondent at press time indicated that the Economic and Financial Crimes Commission (EFCC) has retrieved the details of all transactions on NIA’s account from the CBN.

    “We learnt that the anti-graft agency has collected the details of inflow and outflow from our account from the apex bank without our knowledge,” a source in NIA said.

    Former President Goodluck Jonathan was said to have been implicated as the approving authority of a sum of $289 million  given to NIA from the account of National Petroleum Investment Management Services (NAPIMS), a subsidiary of the Nigerian National Petroleum Corporation (NNPC).

    The said sum, tagged Special Intervention Fund, was said to have been approved by the former president for the security agency in February 2015, in the build-up to the presidential election he eventually lost to President Muhammadu Buhari.

    The embattled NIA DG reportedly said he has a copy of the approval letter from Jonathan.

    It was gathered that the Osinbajo committee will also probe speculations that the $289 million might have been part of the slush funds deployed for the 2015 general election.

    A presidency source said: “This is part of why the ongoing investigation is necessary. We suspected that there might be more to it because the funds were released in February 2015.

    “Even if in confidence, Osinbajo’s committee will want to know the nature of the covert operations.

    “The NIA is claiming that the Special Intervention Funds were given to all security agencies but without the approval of the National Assembly.

    “The motive was suspected to have a link with the 2015 presidential election. The funds might be Jonathan’s war chest.”

    Corroborating  the suspicion, a former Assistant Director of NIA, Mr. Ibrahim Ibrahim, told a national newspaper that “Jonathan approved $289 million or so in November 2014 in excess of the approved budget of the agency.

    “So, that excess  was intended  as campaign funds.”

    But a  top NIA official faulted the claim.  “Ibrahim was talking rubbish, he was disengaged a long time ago.

    “He was no longer in the system, so he could not have known of appropriated or special funds. ”

    “How can someone who left the system about five to six years ago be talking authoritatively?

    “Even as an Assistant Director in the system, he could not have known about the financial status of NIA. He is too junior to be in the picture.”

    He said  Ibrahim was disengaged for alleged extreme religious views, he has been looking for any opportunity to get back at NIA.

    “Let him leave the Presidential Investigative Committee to do its job, he said.

    Another source in NIA, who gave an insight into the approval by Jonathan and how the allocation came from NAPIMS, however, said: “When the budget performance was poor and funds were not forthcoming, the former President approved special intervention funds for all security agencies.

    “There is a document showing in clear terms that the ex-President approved the $289 million.

    “We used the funds to upgrade our ICT facilities; execute an ultra-modern conference centre; construct electronic gates in NIA; build 90 (three-bedroom) flats for staff which were completed in December 2016; construct link road and do the ongoing fencing of NIA.

    “It should be put on record that apart from the special intervention funds, NIA was not given any money for capital projects in 2015.

    “Our suspended DG will hand over all the details to the Presidential Investigative Committee, including the approval by the ex-President.

    “A multi-national company handled most of these projects. The company can be invited.”

    Vice President Yemi Osinbajo on Thursday met with some top security officials and other highly placed officials at the Presidential Villa, Abuja.

    The meeting came 24 hours after the Secretary to the Government of the Federation, Babachir David Lawal and the Director General of the National Intelligence Agency (NIA), Ayo Oke, were suspended from office.

    Those at the meeting included the Director General of the Department for State Security (DSS), Lawal Daura, the National Security Adviser, Babagana Monguno and the Inspector General of Police, Ibrahim Idris.

    Others are the Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Ibrahim Magu and the Minister of Justice and Attorney General of the Federation, Abubakar Malami.

    Adamawa State Governor, Jibrilla Bindow, was also reportedly sighted at the Presidential Villa on Thursday.

    It was not certain whether Bindow, who was seen by some staff, met with the vice president or the Chief of Staff to the President, Abba kyari.

    There were however speculations that the governor’s visit was not unconnected with the suspension of the SGF.

    Lawal is from Adamawa State.

    Magu, after meeting with the vice president, disclosed that he attended Assets Recovery Committee meeting.

    Vice President Yemi Osinbajo yesterday urged Nigerians to emulate the sacrificial love that Jesus Christ showed to all generations by preaching and showing love to all.

    Osinbajo gave the advice while speaking to reporters shortly after the Easter Service at the Aso Villa Chapel.

    The vice president had at the service preached on love to one another and said it was the foundation of the nation’s development.

    The News Agency of Nigeria (NAN) reports that Osinbajo’s sermon is entitled: ‘Revelations on the Resurrection of Jesus Christ.’

    He said: “It is a message for love for all; there is no tribe, no religion; regardless of faith, Jesus loves us. This is how we should relate with ourselves.

    “It is a pure love and I think that it is what everyone should bear in mind at this time.”

    He urged Nigerians to serve God faithfully to earn forgiveness and salvation in the hereafter.

    Osinbajo noted that spiritually, Jesus stood between hell and heaven, and serves as an intercessor for mankind.

    “All that is required is to believe in Him by acceptance of the commitment he made on the cross,” he said.

    At the service were the Special Adviser to the President on Media and Publicity, Mr. Femi Adesina and the Senior Special Assistant to the President on National Assembly Matters, Senator Ita Enang.

  • Bamaiyi’s lies: In defence of Osinbajo and Justice Ade Alabi

    Savouring his court-ordered freedom after spending about eight years at Kirikiri prison, Lagos for alleged complicity in the attempted assassination of Alex Ibru, then publisher of Guardian newspaper, a former Chief of Army Staff, Lt- General Ishaya Bamaiyi, has come out with his book.

    The book, titled “Vindication of a General” ought to have been aptly titled “Lies of a General”.

    The book, which purports to be his own story, detailing his travails during his trial, is unfortunately riddled with falsehood and gross misrepresentation of facts as far as the incident regarding his false allegation against the first presiding judge, Ade Alabi was concerned.

    Bamaiyi was charged along with Major Hamza, Al-Mustapha, former Lagos police Commissioner, James Danbaba, CSP Rabo Lawal and Col. Baba Yakubu, over the attempted murder of Mr Ibru.

    As the trial got underway, the defendants tried all tricks in the book to delay and scuttle their trial and one of the strategies was to accuse the presiding Judge, who incidentally was the Chief Judge of Lagos State, Justice Ade Alabi, of demanding a bribe of $10 million (not N10 million as stated by Bamaiyi in his book), to enable him grant bail to the defendants.

    First, the defendants made the allegation in the open court, ostensibly to annoy the judge and eventually to get the case transfered to another judge who would then start the case de novo.

    The case was being prosecuted by the Lagos State Attorney-General and Commissioner for Justice, Prof. Yemi Osinbajo, who was ostensibly incensed over this spurious allegation.

    The defendants, thereafter petitioned the National Judicial Council (NJC) which investigated the allegation and exculpated the judge, having found that the allegation was spurious and baseless.

    To underline his ignorance, Bamaiyi, in trying to pooh-pooh the NJC’s investigation, claimed in his book that the judge “refused to enter the dock” during the investigation. If the retired General had availed knowledgeable people, versed in law the privilege of going through his poorly written manuscript, they would have told him that NJC administrative panel is not a criminal court where a defendant facing criminal charges enters the dock. They would also have advised him against the defamatory statements he made in the book concerning the judge and Osinbajo.

    According to Bamaiyi, “Specifically, that prof. Osinbajo brought what he said was the panel report during one of the motions. Unfortunately, pages one through to twenty-nine of the report were not produced”. He went on to allege that the NJC protected the judge, while he similarly alleged that Osinbajo and the presiding judge were invited to Abuja and directed to convict the defendants within six months. He went on with his cocktail of lies of how the judge allegedly demanded a bribe of N10 million.

    As someone who was a witness during the trial and conversant with the facts, l say without any equivocation that nothing could have been farther from the truth.

    Bamaiyi should have known the additional steps taken by his lawyer, Mike Okoye during the trial, in repeating this allegation of bribery and how he recanted and apologised to the judge.

    Mike Okoye had addressed a press conference, where he repeated the allegation of Bamaiyi but in his own case, he alleged it was $10million and not N10 million as stated by Bamaiyi. These spurious allegations were published by the press and Mr Okoye was subsequently charged to court for criminal contempt.

    He was charged before Justice Bode Rhodes-Vivour (now Justice of the Supreme court).

    In court, Okoye recanted and apologised to the judge.

    Mr. Mike Okoye, a legal practitioner was charged on an information with the following offences:-

    Count 1

    Statement of Offence

    Contempt of Court Contrary to section 133 (4) of the

    Particulars of Offence

    Mike Okoye (M) on or about the first day of January 2002 at Lagos in the Lagos Judicial Division did cause the scandalizing of the court with utterances and statements spoken and made in news item  of “THISDAY” Newpaper of 7/1/2002 and concerning the Honourable Mr Justice A. Ade Alabi in the public capacity, to wit, qua the presiding trial judge seized  of the conduct of charge No. LCD/108/99: The State vs. Lt. Gen. R. Ishaya  Bamaiyi and 4 others.

    Statement of offence

    Contempt of court contrary to section133 (4) of the Criminal Code Cap 32 Vol. 2 Laws of Lagos State 1994.             Particular of Offence:

    Mike Okoye (M) on or about the 4th  day of     January 2002 at Lagos state in the Lagos Judicial Division, did cause the scandalizing of the court with utterances and statements spoken, published and made in a news item on the back page of  Daily Times newspaper of 7/1/2002 and concerning the Honorable Mr. Justice A. Alabi  in his public capacity to wit, qua the presiding trial Judge seized of the conduct of the charge number LCD/108/99: The State vs Lt. Gen R. Ishaya Bamaiyi and 4 others.

    He pleaded not guilty to both counts , and immediately proceeded to read out a prepared text to the court. The operative part reads thus:

    “I apologize to the Bench and the Hon. Justice Ade Alabi for any injury he may have suffered from his unwarranted and unnecessary publications. I am aware that the publication has the effect of bringing to disrepute, office, integrity and position of Hon. Justice Alabi but l would want to disabuse the minds of the public of this impression and state that these allegations of corruption leveled against Hon. Justice Ade Alabi are not true to the best of my knowledge”.

    Thereafter, the Lagos State Solicitor General applied to withdraw the charge on behalf of the Hon. Attorney General and the Commissioner of Justice. This is what he had to say:”I wish the  court understands the attitude of Office of the Attorney-General to prosecute or otherwise. Because Mr. Okoye has apologized and because more fundamentally, he has admitted that the allegations are not true, it is our view that the mischief/damage which this proceedings were filed to correct, to wit: maintenance of the institution and it’s officers,  I would, considering the plea of the accused person, be willing on behalf of the Attorney-General to withdraw the charge.”

    It is about time that when a reporter is not clear as to what a judge said, he would do well to seek an explanation from  the registrar  of court, rather than credit the judge with what was never said.

    The Honorable Justice Ade Alabi is the trial judge in suit  No.LCD/108/99.  The accused persons are Lt. General Bamaiyi, the former Chief of Army Staff, Major H. Al- Mustapha, Chief Security Officer to the former military

    Head of state,  Rabo lawal, a Chief Superintendent of police, Mr  James Danbaba,  a one time Lagos  Commissioner of police and Col. T. Baba Yakubu, ex-administrator  of Zamfara State. They are charged with attempting to kill the Guardian Publisher, Mr. Alex Ibru.

    During the trial, which is still in progress, Major Al-Mustapha accused the trial judge of demanding bribes from him. Mr. Mike Okoye who at the time represented one of the accused persons, held a press conference and told newsmen that he could prove the trial judge demanded for $10 million from the accused person. The Daily Times and THISDAY Newspapers of Monday 7th day of January 2002, gave wide coverage to Mr. Okoye’s wild, unguarded and unfounded statements which to me, amount to the most despicable assault on the Bench. Mr. Mike Okoye’s conduct constitutes an intolerable attack on the Bench and the well being of society. A crime of monumental proportions. Such dare devilry must be checked, otherwise the foundations of the judiciary may very well crumble.

    The Honourable Attorney-General quickly rose to the occasion, filing this information.

    One can imagine the days, weeks of grinding hell, an awful strain these unguarded and untrue accusations caused his Lordship , a judge  no doubt with transparent integrity and manifest probity, whose tireless energy and unquenchable enthusiasm are too clear for all to see.

    Okoye said openly in court that his statement with the press are not true. The need to proceed with a trial with be pointless since the statement fundamentally addresses the issue and the trial will not do the same.

    It is not the practice of courts to question the Attorney-General when he decides to withdraw a charge . He can not be questioned by anyone and owes no one an explanation for prosecuting or deciding against prosecution.It is clear that the offensive publications were given very wide coverage by the press and other electronic devices.

    Petitions were addressed to the Executive, Legislative, and Judiciary, accusing the highly respected Jurist of taking bribes. It becomes imperative that a retraction is given similar wide publication.

    Based on this ruling, it would amount to sheer mischief for General Bamaiyi to make such defamatory statements against Hon. Justice Ade Alabi and Prof. Osinbajo on the so-called bribery.

    Instead of belching out despicable lies against innocent people, Bamaiyi should rather use this time of respite for sober reflection on the controversial roles he played during the General Sani Abacha junta.

    More importantly, it would also be interesting for the former Chief of Army Staff to explain how he came about the $4.8million dollars that was swindled off him while in Kirikiri prison, Lagos, for which Fred Ajudua is currently standing trial.

    Ajudua, has been charged to an Ikeja High court by the Economic and Financial Crimes Commission (EFCC) for allegedly defrauding Bamaiyi of $4.8 million, having approached the former Army Chief while at Kirikiri prison that he could help him secure his freedom.

    Already, a court registrar, Ronke Rosulu, an alleged accomplice of Ajudua in the fraud saga, is currently serving a 10 – year imprisonment, having been convicted by Justice Lateef Lawal -Akapo over her role in the fraud saga.

    It may be necessary for the EFCC to ask Bamaiyi to come and explain how he came about such amount of money, even during his incarceration.

    Vice President Yemi Osinbajo on Wednesday presided over the Federal Executive Council (FEC) meeting at the State House, Abuja

    It was the first time the vice president was presiding over the meeting since President Muhammadu Buhari returned from medical vacation in United Kingdom on March 10.

    The meeting started at 11:00 a.m. with the rendition of the National Anthem.

    Osinbajo thereafter asked the Minister of Defense, Dan Ali Mansur, to say the Muslim opening prayer, while the Minister of Trade and Investment, Okechukwu Enelamah, offered the Christian prayer.

    The meeting was still in progress at the time of filing this report.

    • FG seeks water-tight prosecution of corrupt elements

    The Federal Government has gone back to the drawing board to re-strategize on its prosecution of corruption-related cases.

    This followed its recent losses, one after the other, of four high profile corruption-related cases in court.

    First was the unfreezing, on the order of a Federal High Court, Lagos, of the account of Lagos lawyer Mike Ozekhome (SAN),  which is said to hold a sum of N75million professional fee paid to him by Governor Ayo Fayose of Ekiti State.

    The Economic and Financial Crimes Commission (EFCC) had alleged that the money was proceeds of corruption.

    Next was the discharge and acquittal of Justice Adeniyi Ademola and his wife of charges of corruption and possession of firearms filed against them.

    The initial forfeiture of a sum of $5m found in an account of former First Lady, Dame Patience Jonathan was similarly reversed on the order of another court, while the Minister of Niger Delta in the Jonathan administration, Elder Godsday Orubebe was also discharged and acquitted after Abubakar Malami, the Attorney General of the federation, told the   Independent Corrupt Practices and Other Related Offences Commission (ICPC) that the case filed against the former minister did not exist.

    The ICPC had accused him of diverting N1.97 billion meant for the compensation of owners of property on the Eket Urban section of the East-West road in Eket, Akwa Ibom State.

    It was gathered that government was shocked by the development which it perceived as a terrible blow to its anti-corruption crusade.

    Vice President Yemi Osinbajo at the weekend met with the Attorney-General of the Federation, Mallam Abubakar Malami and heads of other prosecuting agencies on the situation.

    These are the Director-General of the Department of State Security Service (DSS), Mr. Lawan Daura, Acting Chairman of EFCC, Mr. Ibrahim Magu, Chairman, Code of Conduct Bureau (CCB), Mr. Sam Saba.

    Although the Chairman of the Independent Corrupt Practices and Other Related Offences Commission (ICPC), Mr. Ekpo Nta was away on official assignment, the agency was represented.

    Osinbajo directed the agencies to henceforth ensure a water-tight prosecution of corruption suspects.

    He also asked the heads of the agencies to cooperate with the bench in handling all such matters.

    Government, sources said, was disturbed that vital cases were lost on technical grounds to some suspects.

    A highly-placed source said: “Losing four or five high profile cases in quick succession was seen as a setback for the anti-graft war.

    “As a Professor of Law of Evidence, Osinbajo had a review session with all the heads of prosecuting agencies on what technically went wrong on some of these cases.

    “Although the government has filed appeal on the rulings of the affected courts, the VP stepped in to arrest the slide.

    “The heads of the agencies have been directed to ensure diligent investigation, water-tight prosecution and place sufficient evidence before the court.

    “All constraints affecting the legal team will be addressed accordingly.”

    Responding to a question, the source added: “The VP asked the agencies to collaborate among themselves instead of petty rivalry.

    “He also told them to cooperate with the bench on all matters before the court.”

    A top source said: “The presidency will now take more than a passing interest in all anti-graft cases. There will be effective monitoring and constant review.

    “Save the case of former Minister of Niger Delta Affairs, Mr. Godsday Orubebe, the government will file appeal against most of the rulings of the court on the lost cases.”

    Abuja Airport runway repair on course – Osinbajo

    Vice President Yemi Osinbajo on Friday expressed confidence that the Nnamdi Azikiwe International Airport, Abuja, would be reopened on April 19.

    He made the remark during an inspection tour of the airport.

    Osinbajo, according to a statement issued by his Senior Special Assistant on Media and Publicity, Laolu Akande, said “I have looked round and I think that from what I have seen and also from the information from the contractors and consultants, things are going very well.

    “We are told that we are nearing completion and we are clearly on schedule. We expect to see that this will be completed well on schedule. I don’t think we should expect any delays whatsoever.

    “We have assurances from the consultants that we are clearly on schedule, so by the 19th of this month, a new runway should be settled.

    “I have no reservations. I think that by just looking at all of this myself, inspecting it and listening to the consultants, contractors,  personnel from FAAN and the Ministry of Transport, I think that a lot of work has gone in here.

    “The contractors are doing 24 hour shifts, working round the clock. I think they have taken the job very seriously and we expect to see that this will be done and completed by the 19th as they have promised.”

    On move to upgrade the terminal building to standard, the vice president added “FAAN has said it is ready starting to do something. They say they have started to do some work. “

  • Abia to be included in FG amnesty programme – Osinbajo

    Vice President Yemi Osinbajo on Friday said the Federal Government would take urgent measures to include Abia State in the amnesty programme designed for oil-producing areas.

    Osinbajo stated this in Umuahia during a town hall meeting with representatives of groups from oil-producing communities in the state, comprising traditional rulers, women and youth groups.

    He said the federal government and the Ministry of Niger Delta Affairs would work hand-in-hand with the state government to ensure that beneficiaries of the amnesty programme hailed from Asa, the oil-producing area of Ukwa West local government area of the state.

    Osinbajo was reacting to protest by people of the area over non-inclusion of Abia in the amnesty programme.

    The people publicly disowned the purported list of 237 indigenes from the oil-producing communities alleged to have benefitted from the programme.
