  • Court discharges retiree after five months in prison over food debt

    An Osogbo Magistrates’ Court on Friday discharged one Moses Olatunde, 55, who had been in prison custody since October 2018 for allegedly accumulating debt incurred from buying food on credit.

    Olatunde, who retired from Osun State Ministry of Education as an Administrative Officer in 2017, collected food worth N269, 940 on credit from one Mrs Kudirat Yusuff, but failed to pay.

    The police prosecutor, Insp. Jafani Muslim, told the court that the defendant committed the offence between June 2017 and September, 2018 at Ola-Iya Area of Osogbo metropolis.

    When the case came up on Friday, the representative of the Ministry of Justice, Mr Iyiola Olajubu, told the court that the case was a simple contract matter.

    Olajubu said that there was no established evidence of crime that could have warranted any approach other than a civil procedure.

    “Having gone through the case file, it is evident that a simple contract was entered into by the parties.

    “All the elements of a simple contract have been fulfilled, and consequently, the defendant breached the terms of the simple contract.

    “There are no evidences of any crime that has been perpetrated against the complainant by the defendant other than the breach of a simple contract which should be a civil matter.

    “I am of the opinion that this is a civil case and not criminal in nature.

    “However, steps should be taken to ensure the defendant pays his debt.

    “The defendant is, therefore, not liable for any criminal offence whatsoever,” Olajubu said.

    The Magistrate O.T. Badmus, struck out the case after counsel to the defendant , Mrs Julie Olorunfemi, assured the court that the debt would be paid. (NAN)

  • Men in court over theft of Fish worth N4.3m

    The Police in Osun on Thursday arraigned three men in an Osogbo Magistrates’ Court over alleged theft of cat fish worth N4.3 million.

    The defendants are Ojo Michael, 33, Ojo Dayo, 23, and Matthew Emmanuel, 22 ,whose addresses was unknown.

    The Prosecutor, Insp. Olaiwola Rasaki, told the court that the defendants committed the offence on Jan. 14, at Power line Area, Osogbo.

    He said the trio conspired and entered a fish pond belonging to one Owolabi Tajudeen and stole cat fish worth N4, 281,200.

    The prosecutor said the offence contravened sections 516 and punishable under section 390(9) of the criminal code cap 34 vol.11 laws of Osun, 2003.

    The defendants pleaded not guilty to a two- count charge bothering on conspiracy and theft.

    The Defence Counsel, Mr Oyegbemi Adediran, prayed the court to grant his client bail in the most liberal terms.

    The Magistrate, Mrs Aishat Ajanaku, granted the defendants bail in the sum of N500, 000 and two sureties each in the like sum.

    Ajanaku said the sureties must reside within the court jurisdiction, produce evidence of tax payments and three passports sized photographs, attached with an affidavit of means.

    The case was adjourned until July 12 for hearing.

  • Man docked over breach of peace

    A 72-year-oldman,  Fatai  Yusuf , was on Friday charged before an Osogbo Magistrates’ Court in Osun over alleged breach of public peace.

    Yusuf, whose address was not given, is facing a charge of breach of peace.

    The Prosecutor, Insp. Taiwo Adegoke, told court that the accused committed the offence on April 3 at Owotoyan area of Osogbo.

    Adegoke said that the accused had conducted himself in a manner that could breach public peace.

    “The accused forcefully stopped bricklayers working on the complainant’s land and scuffle began which drew the attention of passersby.

    “He could not give reasons why he had to stop the workers,’’ the prosecutor stated.

    The offence contravened Sections 249 (d) and 517 of the Criminal Law of Osun State, 2003.

    The accused pleaded not guilty to the charge.

    Counsel to the accused, Mr Sanusi Sanusi pleaded with court to grant his client bail on liberal terms.

    The Magistrate, Mr Olusola Aluko, granted the accused bail in the sum of N100, 000 with two sureties in like sum.

    Aluko said the sureties must reside within the court’s jurisdiction and should show evidence of tax payment to the Osun Government

    The case was adjourned until June 13 for mention.

  • Eight in court over 1,000 stolen chickens

    Eight in court over 1,000 stolen chickens

    Eight persons on Tuesday appeared before an Osogbo Magistrates’ Court in Osun over the theft of 1,000 chickens from a poultry farm.

    The accused include Odebiyi Yinka, 20, Ayoola Samson, 20, Cecilia Ochilla, 35, and Elizabeth Akira, 30.

    Others are: Oyelami Tajudeen, 30, Regina Philip, 40, Grace Odelia, 35, and Akira Hanna, 24.

    The accused and others at large are facing charges bordering on stealing.

    The Prosecutor, Insp. Taiwo Adegoke told the court that the accused committed the offence between the months of May, June and July at Erin-Osun, Osogbo.

    Adegoke said the accused conspired with others now at large to steal 1, 000 chickens owned by one Mrs Titilayo Akulo.

    He said that Odebiyi and Ayoola, who are co-workers at Aluko Poultry Farm, conspired to steal 1, 000 chickens valued at about N1.5 million.

    The prosecutor said the accused sold the chickens to the six other persons at the total sum of N1.2 million.

    He said the offences contravened Sections 516, 390(9), 383(9) and 427 of the Criminal Code cap 34 Vol.11, Laws of Osun, 2003.

    The accused, however, pleaded not guilty.

    Counsel to the accused, Mrs Bose Dada, prayed the court to grant her clients bail in the most liberal terms.

    The Magistrate, Mr Olusola Aluko, granted the accused bail in the sum of N 100,000, with two sureties each in like sum.

    Aluko said the sureties must reside within the court’s jurisdiction.

    He adjourned the case to Nov. 25, for hearing.

  • Court orders remand of 26-year-old murder suspect

    An Osogbo Magistrates’ Court on Tuesday remanded one Afeez Alabi in prison custody, over alleged robbery and murder.

    Alabi, 26, was brought to the court by the police for allegedly shooting to death a security guard in Osogbo.

    The prosecutor, Mireti Wilson told the court that the accused committed the offence on July 27, at about 2:00am on Television Street in Awosuru area of Osogbo.

    Wilson said that the accused shot and killed the security guard, Adejumo Abimbola, and also stole a plasma television and two wrist watches belonging to one Akinwusi Abidemi.

    The prosecutor said the offences contravened Sections 1 and 6 of the Robbery and Firearms (Special Provisions) Laws of the Federation and the Criminal Code Cap 34 Vol. 11 Laws of Osun, 2002.

    The plea of the accused was not taken as he had no legal representation.

    The Magistrate, Mr Olusola Aluko, however, ordered that the accused be remanded at Ilesha Prisons, and adjourned the case till Nov.11, for mention.

    Man docked over alleged impersonation of Vice President

    A 44-year-old man, Eseosasere Gift Osifo, on Thursday appeared before an Osogbo Magistrates’ Court over alleged impersonation and fraud.

    Osifo was in court for creating a Facebook account using details of Prof Yemi Osunbajo, Vice President of Nigeria, to defraud unsuspected victims.

    The Prosecutor, Mr Onoche Ekwom, Principal Legal Officer, Department of State Services (DSS), told the court that the accused committed the offence between January and August before he was arrested and brought to the court.

    Ekwon said the accused used the account to extort money from unsuspected victims on several occasions before he fell prey to the last victim which led to his arrest.

    He said the offence contravened Sections 484 and 422 of the Criminal Code, Cap 34, Vol. 11, Laws of Osun, 2002.

    The accused pleaded not guilty to the two-count charge of impersonation and fraud.

    Counsel to the accused, Mr Peter Ofoyeju, prayed the Magistrate to grant his client bail in the most liberal terms.

    The Magistrate, Mrs Sodamade Fatimoh, granted the accused person bail in the sum N500,000 and two sureties in the like sum.

    Fatimoh said the sureties must reside within the court jurisdiction and must have evidence of tax payment and two passport sized photographs attached with an affidavit of means.

    She said one of the sureties must be a civil servant on Grade level 12 and the other a closed relations to the accused.

    The case was adjourned the case to Nov.21 for hearing.

    Two docked over alleged N1.9m fraud

    Two men, Egbebi Gbenga, 36, and Kolawole Lukeman, 45, on Monday appeared before an Osogbo Magistrates’ Court over an alleged fraud of N1.9 million.

    The Prosecutor, Sup. Mireti Wilson told the court that the accused committed the offense in 2012 at Gbongan area of Osun.

    Wilson said the accused conspired with others still at large to steal the money from one Aderemi Tumade.

    He said the accused promised to help the complainant to buy a Toyota bus in Togo, but they failed to deliver.

    The prosecutor said the accused committed a three-count charge of conspiracy, fraud and theft.

    He said the offense committed contravened sections 516 and 419 of the criminal code cap 34 vol.11 laws of Osun, 2003.

    Counsel to the accused, Bose Adeyinka, prayed the court to grant her clients bail in the most liberal terms.

    The Magistrate, Mr Olusola Aluko, granted the accused persons bail in the sum of N500, 000 and two sureties in like sum each.

    Aluko said the sureties must reside within the court’s jurisdiction, with evidence of tax payment and two passport photographs attached to an affidavit of means.

    The magistrate said one of the sureties must be a civil servant on Grade Level 10, with a landed property; while the other must be a close relation.

    The case was adjourned to Nov.11 for hearing.
