  • US Envoy hails INEC decision on Osun election

The Deputy Chief of Mission of the United States Embassy in Nigeria, Mr David Young, yesterday commended the Independent National Electoral Commission (INEC) for the decision to conduct a supplementary election in Osun State, saying it would enhance democracy.

Young made the remarks at an interactive session with reporters after he inaugurated Magvoile Vocational Centre in Kaduna.

The deputy chief said the re-run would ensure that voters at the remaining seven polling units who were not able to vote on Saturday cast their votes.

He said: “Certainly the decision of INEC to go ahead and have a supplementary election in seven polling unit is one that we respect, given the fact that there was only 353 vote margin between the two leading candidates.

“Certainly this is a decision that make sense; we want to say that its important for democracy that every person vote is secret and counted as we go forward with the vote tomorrow.”

Young who commended the people of Osun over last Saturday’s peaceful election, urged them to ensure same in the upcoming supplementary election.

He also urged contestants to accept the outcome of the election without rancour, in accordance with democratic norms.

“We want to urge the victor to be magnanimous in victory and whoever loses to be gracious in defeat, this is part of democracy.”

  • Osun rerun: INEC describes CUPP allegation as baseless

The Independent National Electoral Commission (INEC) has described as irresponsible and baseless, the allegation that uncollected Permanent Voter Cards were being released ahead of the Osun State Governorship rerun election.

Mr. Rotimi Oyekanmi, Chief Press Secretary to INEC Chairman dismissed the allegation in an interview with the News Agency of Nigeria (NAN) on Monday in Abuja.

Oyekanmi asked the Coalition of United Political Parties (CUPP), which made the allegation, to provide the proof.

“It is highly irresponsible of the CUPP to make a wild, unsubstantiated allegation such as this at this time.

“What exactly is their motive? The media should ask the CUPP to provide concrete proof about this allegation.

“INEC has conducted 191 different types of elections, including six governorship elections since 2015.

“If the Commission did not manipulate any of these elections, why will it do so now with the Osun Governorship election?

“The CUPP is advised to engage in patriotic actions rather than sowing discord at a time like this.”

The CUPP in a statement issued by its spokesman, Ikenga Ugochinyere alleged that credible intelligence revealed that
some INEC officers were releasing uncollected PVC to the desperate politicians in Osun to use imported voters to vote at the rerun.

Ugochinyere also alleged that a senior INEC staff had refused to release the official list of people who have collected PVC’s at the seven polling units where rerun election would be held.

“We have it on good authority that less than 1000 registered voters have collected PVC’s out of the 3,498.

“This means that less than 1000 persons are to participate in the actual voting. We demand that INEC immediately release this list.”

He added that the plot was part of a move to use incidence form to vote knowing that the finger prints of those with the hijacked uncollected PVC can’t be read by the Smart Card Reader.(NAN)

  • PDP goes to court over Osun election

The Peoples Democratic Party (PDP) yesterday said it had concluded arrangements to challenge the inconclusive verdict passed on last Saturday’s governorship election in Osun State in the court.

The Independent National Electoral Commission (INEC) declared the election inconclusive, following the cancellation of the result in seven units across four local government areas.

But in a statement yesterday by its spokesman, Kola Ologbondiyan, the PDP insisted that the election was concluded and results announced in all polling and the collation centres.

According the PDP, that signified the lawful conclusion of the election, thus removing INEC’s powers to declare the election inconclusive.

The statement reads: “Our electoral law is clear that once an election result is declared, INEC is bound to return a winner. INEC, in trying to play the card of the defeated All Progressives Congress (APC), contravened the law by refusing to announce a return, even when the declared results have thrown up a winner.

“Section 69 of the Electoral Act 2010 (as amended) states that inter-alia “in an election to the office of the President or governor whether or not contested and in any contested election to any other elective office, the result shall be ascertained by counting the votes cast for each candidate and subject to the provisions of sections 133, 134 and 179 of the constitution, the candidate that receives the highest number of votes shall be declared elected by the appropriate Returning Officer.

“Concurrently, Section 179 (2), (a) (b) of the constitution directly prescribes that “a candidate for an election to the office of Governor of a State shall be deemed to have been duly elected where, there being two or more candidates – (a) he has the highest number of votes cast at the election; and (b) he has not less than one-quarter of all the votes cast in each of at least two-thirds of all the local government areas in the state.

“INEC’s action in declaring a concluded election as inconclusive is therefore an annulment, totally duplicitous, constitutionally illegal, ultra-vires and as such null and void.”

The PDP called for the immediate arrest and prosecution of the Osun State Governorship Election Returning Officer, Prof. Joseph Fuwape, for “succumbing to the pressure of the APC” and declaring a decided election as inconclusive.

“We demand that INEC Chairman, Prof. Mahmood Yakubu immediately summon the courage to do the needful by declaring our candidate, Senator Ademola Adeleke, as winner.

“It is completely ludicrous, that INEC and the APC are now attempting to divert the narrative from the substance of the election by making outlandish allegations against the PDP and lobbying Civil Society Organisations and Electoral Observers to validate their illegality.

“Moreover, even if the Osun governorship election is conducted over and over again, the PDP will still win as the people of the state have chosen the PDP and its candidate, Senator Ademola Adeleke.

“Nevertheless, we insist that the September 22, 2018 election, under our laws, is conclusive and our candidate must be declared winner.”

  • Osun election: Party accuses INEC of excluding its candidate

    *Threatens court action

One of the political parties seeking to field candidate for the September 22 governorship election in Osun State, the National Rescue Movement (NRM) has accused the Independent National Electoral Commission (INEC) of excluding its candidate from the commission’s list.

NRM argued that despite supervising its primary as required under the Electoral Act, INEC has unlawfully excluded its candidate, Mrs. Jumoke Lawoyin, from the list of candidates for the gubernatorial election slated for next Saturday

In a complaint, authored by its lawyer, Kayode Ajulo, to INEC Chairman, NRM argued that the commission’s “act of omitting, refusing and or neglecting to add our Client’s candidate’s name to your approved candidates list for the 2018 Osun State gubernatorial election is unlawful, illegal, unconstitutional and ought to be urgently rectified.”

NRM, in the complaint, dated September 17, 2018 with reference No. KACCL/LET/RO/381/18, stated “that considering the peculiarity of this case and the urgency attached thereof, our Client requires that you should within 24-Hours of receipt of this letter, cause an amendment to be effected to the approved Osun State gubernatorial candidates list to include our Client’s candidate, otherwise, we may be constrained to perfect the brief of our client by employing all available legal mechanism at our disposal to ensure that our client is not dispossessed of their right to participate in the Osun State gubernatorial Election by this colossal omission.”

It informed the INEC boss that NRM is a recognized and duly registered political party under the relevant laws in Nigeria with a mandate to attain political power through democratic and constitutional means for the purpose of creating socio-economic well-being of the citizens.

The complaint reads in part: “Our client briefed us that by a notice dated 12th July, 2018, your office was informed of the conduct of our client’s primaries, sequel to which your representatives led by Mr. Asaolu Adeniyi Ishola were sent to observe and monitor the said primary election which held at Brymor Hotel, Agunbelewo, Oshogbo and in which Mrs Jumoke Lawoyin was confirmed and affirmed as our client’s candidate for the Osun State gubernatorial election scheduled to hold on the 22nd of September 2018.

“However, it is our brief that despite the service of the requisite notice of the primaries on your commission as required by law and your subsequent participation wherein your staff observed the emergence of our client’s candidate for the impending Osun State gubernatorial election, your commission has negligently, unlawfully, illegally omitted, left out and excluded the name of our client’s candidate from the INEC approved list.

“Our client further informed us that they have exhausted all available mechanisms of communication with your commission in other to rectify the anomaly which as explained to them was due to some administrative oversight which unfortunately has been left unattended, hence, the briefing our firm to formally take up their complaint with your commission.

“It is trite law that every duly registered political party and candidate enjoys the constitutional right to vote and be voted for, we therefore implore you to within the specified period, accede to our client’s demands.”

  • IGP: 30 police commissioners to supervise Osun election

The Inspector General of Police (IGP), Mr Ibrahim Idris, yesterday said 30 police commissioners will supervise the September 22 governorship election.

He said each commissioner will oversee a local government. There are 30 local governments in Osun State.

Idris spoke at a seminar on security with stakeholders in the election in Osogbo, the Osun State capital.

He said the idea was mooted as a way of strengthening security for the election.

The police boss also told The Nation that deployment of a huge number of policemen for the election is unlikely because he has confirmed that Osun State is peaceful and that residents are orderly.

He said: “Obviously I think we are going to do normal deployment here. I have seen and confirmed here that this is a very peaceful environment. This place is peaceful. In some other places, you see people causing problems and formenting trouble. But this is a very peaceful and orderly environment. No, we won’t have unusual deployment for this election.”

About 30,000 policemen were deployed to Ekiti State for the July 12 governorship election.

Idris said security seminars with stakeholders in elections became pertinent because it is crucial to a peaceful, free and fair election. He said the seminar would be a continuous programme.

The IGP reiterated the commitment of the police to ensuring that the exercise is not disrupted in any way, stressing that it was the reason behind deployment of 30 commissioners to the state for the election.

The Resident Electoral Commissioner, Mr Segun Agbaje, hailed the police. He said INEC was working hard on every aspect of the election.

He said the commission was ready and well-prepared for the election and that politicians and other stakeholders only need to play the game according to the rule, so that the efforts of the commission would not be thwarted.

The Ooni of Ife, Oba Adeyeye Ogunwusi, also called on politicians, INEC, security agencies and other stakeholders in the election to place the interest of the nation above any other. He advised them to ensure that all voters are able to cast their votes in an atmosphere of peace, stressing that peace is needed for development to happen.

At the seminar were representatives of other security agencies, traditional rulers, civil society groups, market women and political parties, among others.

  • INEC to arrest, prosecute vote buyers in Osun election

The Independent National Electoral Commission (INEC) has warned that it will arrest and prosecution anyone found inducing voters with money or material things during the September 22 governorship election in Osun State.

The commission’s Deputy Director, Voter Education and Publicity,  Stephen Ojewande, made this known yesterday in an interview with The Nation.

Ojewande said the Electoral Act frowns at voters inducement in any way, as Section 12 of the document stipulates a maximum fine of N500,000 or 12-month jail term or both for anyone convicted of inducement.

He said the popularity which the crime has gained in recent times is a source of worry for the commission.

The INEC official explained that sensitization against vote buying is already integrated in its voter education programme, as its officers have been explaining to voters that they cannot own a government that emerges through vote buying.

He added that the electoral umpire is also out to fish out any of its staff that may be involved in such, adding that the law will be applied appropriately. He said the commission will continue to discourage voters not to sell their votes.

Ojewande said: “Any act of lawlessness is anti-societal development. We will ensure the arrest of anyone caught with voter inducement this time, because it is against the law. They will be prosecuted. In fact, INEC is looking for scape goats in this area.”

Vote-buying allegedly reigned in the last governorship elections in Ondo and Ekiti states.

On the level of preparation, particularly with card readers, Ojewande said the machines are being tested from time to time and that there are enough back-ups for them.

He disclosed that some of the machines were used in the last governorship election Ekiti State and in the House of Assembly by-election held in Oyo State recently.

  • Osun election: INEC to arrest, prosecute vote buyers

The Independent National Electoral Commission ( INEC ) has expressed its willingness to ensure arrest and prosecution of anyone found inducing voters with money or material things in the September 22 governorship election.

Ojewande said the Electoral Act frowns at voters inducement in any way as Section 12 of the documents stipulates a maximum fine of N500,000 or 12-month jail term or both for anyone convicted of inducement. According to him, the machines performed creditably well. He pointed out that the little problem in the Ekiti election was human error, assuring that such errors would not occur in the Osun election.

A total of 48 parties are participating in the September 22 election.

  • Osun election: IGP to hold security seminar

In a bid to have smooth and violent-free elections in Osun State next month and the country generally next year, the Inspector General of Police (IGP), Mr Ibrahim Idris, has invited major stakeholders to a one-day seminar on August 30, at the state capital, Osogbo.

The IGP’s Principal Staff Officer in Lagos, ACP Bode Ojajuni, said the theme of the seminar which will be declared open by Governor Rauf Aregbesola is: “The Imperativeness of Police Collaboration with Essential Stakeholders: Towards Secured, Free and Credible Elections in Nigeria”.

Ojajuni said: “It is meant to kick-start numerous security enlightenment programmes lined up to sensitise and enlist the support of stakeholders towards securing 2019 General elections.”

The Vice Chancellor, Obafemi Awolowo University (OAU), Ile-Ife, Prof. Eyitope Ogunbodede, is expected to chair the event. The Ooni of Ife, Oba Adeyeye Enitan Ogunwusi, would be the Royal Father of the Day. Other guests include the INEC Chairman, Prof. Mahmood Yakubu, representatives of political parties, other security agencies, interest groups and opinion leaders.

Foreign missions, including the United States, Britain, the African Union, the European Union and   aas local and foreign election observers are also expected to participate.

  • Osun election tribunal: No backdoor victory

Osun election tribunal: No backdoor victory

“EVEN now there were many good men who aspired to nothing beyond a seat in Congress, a gubernatorial or a presidential chair, such belong to the family of the lion, or the tribe of the eagle. Such honours were not enough for men of ambition and talents. These routine offices would not satisfy an Alexander, a Ceasar, or a Napoleon, from whom the greatest danger to popular government must be expected..” These statements were made by Abraham Lincoln, one of the Presidents and a man that ended slavery in America, while discussing his ambition with the people.

In the next few days, legal fire works at the Osun Election Tribunal would begin and it is expected that both the All Progressives Congress (APC) and Peoples Democratic Party (PDP) would give account of the governorship election held on August 9, 2014. So far, the Independent National Electoral Commission (INEC) has made available all necessary electoral materials to the parties in dispute over the result of the election. However, the PDP, in a bid to win by crook or hook, has been feeding the public with tissues of lies about the ballot papers and other related materials, with the sole intention to bias the minds of the general public against the victory of APC governor-elect, Ogbeni Rauf Adesoji Aregbesola.

The first kite from the opposition was the false press statement ditched out on the suspension of two electoral officers by the INEC; while it was true that the two officers were suspended, the PDP blackmail against the APC was the alleged conspiracy between the officers and the victorious party. The desperate PDP was indeed the guilty party over the voting materials that were impounded at Ibokun, headquarters of Obokun Local Government Council Area of the state, on the eve of the election, when members of the public raised alarm over the diversion of electoral materials by INEC staff. The people themselves raised an alarm before security men arrested and impounded both the vehicle and the suspects. Almost all the newspapers reported the ugly incident. Only for the PDP to turn around after the election, accusing the APC for the offence which it committed.

Just few days ago, the desperate PDP was at its faslehood game again, calling wolves, where there is none, over the inspection and photocopying of electoral materials used for the said election. The parties at the Tribunal were earlier granted an order to inspect the materials as a pre-trial procedure; a legitimate exercise. Apart from the initial exchange of blows by some of the agents of the parties at the INEC office over the said materials; as the PDP alledgedly declined the video recording of the proceedings, peace eventually prevailed after the eletoral umpire had stepped in.

Napoleon, the Emperor of France was notoriously noted for being ambitiously power hungry, but the kind of power that he sought was not for the benefit of the people, but simply for selfaggrandizement. Napoleon eventually ruined himself over power without genuine responsibility. The PDP and its flagbearer are desperately seeking for power, but the fact remains that the people have spoken and they have spoken well. They have given their mandate to the incumbent governor, because of his superlative performance in his first four years of administration. For almost eight years that PDP was in the saddle of governance in the State of Osun, there was little or nothing to refer to as achievement. But on the other hand, the same cannot be said of the current regime, as the state has been turned around in almost every facet, and works are still in progress despite the limited resources available for the government. The Federal government under President Goodluck Jonathan has not been encouraging enough. Instead of giving a helping hand by allocating more funds for the state, the state allocation has now been reduced from N4.6 billion monthly to N2.5 billion as at August when we went for the election. The opposition in the state takes delight in the reduction in the monthly allocation by boasting to the public that they were the ones behind the reduction, a statement of lies, as the reduction in the monthly allocation is more of a general malady due to the flimsy excuse that the crude oil theft activities were negatively affecting the revenue acruing to the Federal Government. This lame excuse is untenable as the Federal Government has been paying ex-militia leaders millions of dollars for oil pipeline safety, despite the presence of Nigerian security outfits at the same oil fields.

The claim by Iyiola Omisore and his party that they discovered fake ballot papers and unmarked materials among the APC used ballot papers was another white lie. While their first accusation that electoral officers were suspended for conspiring with the APC was debunked by the electoral umpire, the PDP failed to apologise to the nation that it had misinformed the public till date. This second lies has also blown up in the face of the losers, who want to secure victory through the back door, yet they are claiming that their mandate was stolen.

Stolen mandate! By who? The people of Osun have rejected the impostors, who had earlier relied on the Federal Government and its coercive forces to rob the state of good governance. The people stood against over 100,000 security personnel, masked men and snifing dogs all over. The people voted with gun pointing at their backs, further resisting, when a Major General in the Nigerian Army was in the state to ensure victory for the PDP and its candidate at all cost. The people stood their ground against money for votes. Some colllected and voted for the incumbent, others collected and ran away from the state and those who kept their own shares within the PDP are currently at logger heads, as the centre could no longer hold for the desperate party.

In an ideal state, the Police should have by now been busy prosecuting those that were involved in buying voters’ cards and other related electoral offences, in accordance with the Electoral Act. But the men and women, who are being paid from our taxes, pretended as if nothing happened. That explained why we remain infantile as a nation after 54 years of independence. That is why a man who knew that not until ten years after his impeachment, he could not re-contest, would ignore the provision of the law, only to turn thugs to dese crate the temple of justice. The PDP must conduct itself in a modest way as the Tribunal resumes hearing of its petition in the name of peace and progress. The parties before the Tribunal must allow the law to take its course. We must not transfer the hooliganism that Fayose and his electoral thugs displayed in Ado Ekiti to Osun. Just as we said before the election in Osun that Osun is different from Ekiti, we must keep it in our minds as the Tribunal continue its duties.
