    PDP to appeal Edo Election Petitions Tribunal judgment

    Peoples Democratic Party (PDP) says it will appeal the Edo Governorship Election Petitions Tribunal judgment affirming the election of Gov. Monday Okpebholo of All Progressives Congress (APC).

    The party, in a statement by its National Publicity Secretary, Debo Ologunagba on Thursday in Abuja, described the tribunal’s judgment as a miscarriage of justice.

    Ologunagba said that the PDP national leadership, after a thorough review of the judgment, concluded that the verdict was a betrayal of the trust which Nigerians, particularly the people of Edo, had invested in the tribunal.

    He said that with the avalanche of evidence presented to the tribunal, it was clear that PDP’s candidate, Dr Asue Ighodalo, won the Sept. 21, 2024 governorship election, having scored the highest number of valid votes cast in the election.

    The PDP spokesman said it was disturbing that in spite of the overwhelming evidence and findings by the tribunal, it contradicted itself by coming to a conclusion that was at variance with its own findings.

    He further stated that democracy could only thrive in an atmosphere of adherence to the rule of law and adjudication of issues.

    This, Ologunagba said, could only be accepted by people when a tribunal of such nature impartially applied the law, the facts and the body of evidence made available to it during proceedings

    “However, consistent with PDP’s avowed belief in the capacity of the judiciary to, in appropriate cases, ensure that justice is done, our party and candidate, Ighodalo, are proceeding to the Court of Appeal.

    “We believe that there will be a conscientious judicial review of the matter to give justice to the people of Edo State,” he said.

    Ologunagba called on the people of the state to remain resolute and not allow the tribunal’s verdict to dampen their confidence in the judiciary and democracy in Nigeria, as they await the restoration of Ighodalo’s mandate.

    The Peoples Democratic Party Governors’ Forum (PDP-GF) has called on Nigerians to continue to live together in peace and harmony.

    The forum Chairman, Governor Bala Mohammed of Bauchi State, made the call in his Sallah message, by the forum’s Director-General, Emmanuel Agbo, yesterday in Abuja.

    Mohammed urged Nigerians not to relent in their prayers and support for the leaders.

    Enugu LP suffers major blow with Edeoga’s return to PDP

    A major political realignment has taken place in Enugu State.

    Labour Party (LP) strongman Chijioke Edeoga had dumped the party and returned to Peoples Democratic Party (PDP).

    Edeoga, the LP governorship candidate in the 2023, who lost narrowly to Governor Peter Mbah of the PDP, has now teamed up with the governor in a move seen by observers as the likely end of LP in the state.

    Edeoga was a commissioner in the immediate past government in Enugu led by Governor Ifeanyi Ugwuanyi.

    He lost out the race for the PDP ticket, following which he defected to the LP.

    Preparatory to his defection Edeoga met with the leadership of Enugu State PDP on January 31.

    Yesterday, Edeoga, accompanied by his supporters, drove into the PDP State secretariat in a convoy and was received by the state party leadership and stakeholders led by the Chairman, Dr. Martins Chukwunweike.

    Addressing party faithful, Edeoga thanked Governor Mbah and his Eha-Amufu Ward III, Isi-Uzo LGA, and state party leaderships for making his return possible and smooth.

    Rededicating himself to the PDP, he said it was time for all to join hands with Governor Mbah in the great works he is doing in Enugu State.

    “I want to say that I’m happy to be here. I want to start by thanking in a very special way, the governor of Enugu State.  I appreciate that what has happened today cannot begun to be conceived without his political involvement.

    “By this gesture, he has demonstrated a mental state that is worthy of appreciation and that is worthy of being supported or rewarded to the extent that is humanly possible.

    “A thing like this has never happened in the annals of Enugu State politics. It might look small, but it will cause a paradigm shift in the way politics is played in Enugu State. It is no longer something where you warehouse bitterness. It is no longer winner takes all. All those things that people have been trying to preach in Nigeria like accommodating everybody, are being demonstrated in Enugu State.

    “So, I rededicate myself again to the PDP to make sure that the PDP remains a winning machine in Enugu State as it has always been. I am happy to be here. I appreciate all those who made it possible,” he stated.

    Dr. Chukwunweike described Edeoga’s return as strategic for Enugu PDP, and also had the full blessing of Governor Mbah.

    “Our number one term of reference upon our election as the state’s party leadership is to reunite the party. His Excellency said that we must work to bring everybody together. So, today is a major step in that direction.

    Council Chairman of Isi-Uzo, Edeoga’s home LGA, Obiora Obeagu, described his return as a very welcome development and a milestone for Isi-Uzo and Enugu PDP, an affirmation of Mbah’s leadership, and vindication of those of them who worked for the governor’s victory in the 2023 election.

    The 2023 Labour Party (LP) governorship candidate Chief Chijioke Edeoga has returned to the Peoples Democratic Party (PDP).

    Edeoga, who left the PDP for LP after failing to secure its governorship ticket, finished second in the election behind Governor Peter Mbah.

    He was received at the PDP Secretariat in Enugu where he formally announced his return to the party.

    Addressing the party members, Edeoga rededicated himself to the PDP. 

    He expressed gratitude to Governor Peter Mbah and Enugu PDP chairman, Dr. Martin Chukwunweike, for making the event possible.

    According to him, Mbah had demonstrated an elevated mental strength that is worthy of appreciation; worthy of being supported and rewarded to the extent that is humanly possible.

    Edeoga, who said his return to the party, would cause a paradigm shift in the way politics is played in the state, argued: “It’s no longer politics of bitterness or winner takes all. All those things that people have been trying to preach in Nigeria, about justice and accommodations and all that. All those things have been demonstrated by the Governor.”I thank everyone who is witnessing this historic and very memorable occasion. I want to state that I’m happy to be here .

    PDP must apologise for overheating polity – APC chieftain Okechukwu 

    A founding member of the All Progressives Congress (APC), Osita Okechukwu, has accused the opposition Peoples Democratic Party (PDP) of destabilising Nigeria’s democracy and contributing to the country’s political tensions.

    Speaking to journalists in Abuja on Sunday, the former Director-General of the Voice of Nigeria (VON) blamed the PDP for the ongoing political crisis in Rivers State and the alleged slide toward a one-party state. 

    He insisted that the PDP owes Nigerians an apology for what he described as the unintended consequences of its past actions.

    “It’s high time the PDP came down from their high horse and apologized profusely to Nigerians for the impunity that led to the current challenges in Rivers State instead of playing blame games,” Okechukwu said.

    Addressing accusations that President Bola Ahmed Tinubu and his minister, Nyesom Wike, were responsible for the crisis, Okechukwu countered by accusing the PDP of sowing discord during its 2023 presidential primary. 

    He claimed that the party violated the north-south power rotation convention, which he described as a crucial “ligament holding the nation together.”

    “The day we tame the culture of impunity is the day we progress. If the PDP had respected their constitution and our democratic norms, there wouldn’t have been a ‘Wike Masquerade’ today,” he added.

    When asked whether the APC is leveraging the PDP’s internal discord to create a one-party state, Okechukwu responded, “Those who discarded the rotation convention are the real drivers of the one-party state narrative.”

    “Otherwise Nigeria operates multiparty system by law, it is only the fire stoked by PDP, that is raging. They erroneously misunderstood the sophisticated northern electorates, assumed they were in dormitory to be hauled to polling stations on election day to vote for northern candidate.

    “These are illiberal elements fast eroding our multiparty system. They’re at it again to stop rotation convention with an awkward presidency arithmetic of 17 years south and 11 years north by 2027, as if Nigeria got independence in 1999.” Okechukwu submitted. 

    He insisted that if PDP had adhered to rule of law and subsisting rotation convention, maybe Atiku, Obi and Kwankwaso votes could have been theirs in 2023 presidential election.

    Wike working for Nigerians, not APC –PDP chieftain

    National Vice-Chairman of Peoples Democratic Party (PDP), Chief Dan Orbih, says the FCT Minister, Nyesom Wike, is working for Nigerians and not for All Progressives Congress (APC).

    Orbih in an interview with the News Agency of Nigeria (NAN) Abuja on Saturday said having sought permission through the relevant organs of the party, PDP permitted Wike to serve in the President Bola Tinubu administration.

    He said that in view of this, there should not be any issue with Wike working with the APC-led Federal Government.

    “And I can tell you there is no record that the current acting national chairman and the members of the national working committee, or any of the organ wrote him in reply to his letter that he should not participate in this government.

    “He wrote to the South-South Zonal executive. We had a meeting in Port Harcourt and unanimously we said it was a call to national service, and we gave him our nod.

    “He wrote to the state chapter of his party and the response was positive; that he should take the appointment as a national call for service.

    “He wrote to his ward and Local Government chapters of the party. There is no organ of the party that came out to say no, don’t accept this appointment.

    “He wrote to the Governors Forum and I can tell you, that at the end of the first meeting held by the forum, a delegation of that body went to congratulate him in Abuja,” he said.

    He noted that political parties must be careful how they treat their members.

    “Now I have told you that his participation in this government is not an issue, except for those who are mischievous.

    “When he was given an invitation to serve in this government, he wrote to every critical organ of the party, informing them that Mr President has invited him to be part of his government.

    “I am also aware, that not too long ago, the members of the Board of Trustees met him in his official residence, and throughout that meeting, none of them raised this issue.”

    “So, Wike, the Minister of the Federal Capital Territory, is not working for APC; he is working for the government of the Federal Republic of Nigeria,” he said.

    The PDP National Vice-Chairman also said that his relationship with the FCT minister and his friends in other political parties could not be defined by his politics.

    “Let me make it abundantly clear here that my membership of PDP cannot determine those who are my friends and those who should be my enemies.

    “If at my age, I now belong to a political party and the party tells me, this man cannot be your friend, then it is wrong.

    “I have friends across board. I have friends in Labour Party, APC, and in many other parties, but that doesn’t affect my membership and commitment to the PDP.

    “I want to say it very clearly, PDP cannot determine my friendship with Nyesom Wike, a very dependable, hard-working friend of mine, he added. (NAN)

    Land revocation: Wike’s aide knocks PDP over non-payment of Ground Rent for 28 years

    Peoples Democratic Party (PDP) elders like Chief Bode George should be blamed for the party’s failure to pay Ground Rent for 28 years. 

    Senior Special Assistant to the Federal Capital Territory (FCT) Minister on Public Communication and New Media, Lere Olayinka, said this in a statement in Abuja on Saturday. 

    Olayinka advised George not to blame the FCT Minister,  Nyesom Wike.

    He said it was funny George, who was in the party’s National Working Committee (NWC) that failed to conclude purchase of the Wadata Plaza National Secretariat of the PDP,  could come to national television to say; “Wike has crossed the red line by revoking the PDP’s national secretariat in Abuja”.

    George had said during an interview on a television station on Friday hat Wike’s action was an open declaration of war against the PDP.

    Responding, Olayinka said it was painful that elders like George, could chose to play the ostrich on a matter so glaring as the revocation of 4,794 land titles for not paying Ground Rent for as much as 43 years.

    He asked: “Why didn’t the PDP pay Ground Rent for 20 years on its Plot No. 243 national secretariat (under construction), which is the only property belonging to the party among the 4,794 revoked titles? 

    “How’s government’s enforcement of the consequences of land title owners’ refusal to pay Ground Rent declaration of war? Should the FCTA under Wike have treated PDP differently from the 4,794 owners of land titles that were revoked over failure to pay Ground Rent?”

    While clarifying that the Wadata Plaza property being used as Secretariat by the PDP was not owned by the party, Olayinka said the property belonged to Senator Samaila Mamman Kurfi, who bought it from Wadata Enterprises Nigeria Limited. 

    He said: “The PDP offered to buy the Wadata Plaza property in 2005 and when the Minister’s Consent was sought, the party was asked to pay N26.9 million.  The money was never paid. 

    “The party wrote a letter to Malam Nasir El-Rufai, the FCT Minister then, to waive the payment, claiming that it lacked the financial capacity to pay, but he (El-Rufai) insisted the party must pay. 

    “El-Rufai, who insisted PDP must do the right thing by paying the necessary fees to the government was a member of the party then, and Chief Bode George, who was in the PDP NWC, did not go to national television to accuse him (El-Rufai) of declaring war against the party. And if the owner of did not pay ordinary N2.8 million as 28 years Ground Rent, who is to blame?

    “On the PDP national secretariat at Central Area, is it the fault of Wike that a mere N7.6 million, was owed as 20 years Ground Rent despite that over N21 billion was raised in 2014 for the completion of the building?”

    While counseling George to start functioning like an objective elder that he should be, the FCT Minister’s spokesperson said: “what should have been done was to seek information, rather than going on television to advertise hatred against a Minister who is simply doing his jobs without looking at people’s faces.  

    “If Chief Bode George had sought necessary information and refrained himself from acting out of hatred for Wike, it would have been known to him that also affected by the revocation were government owned institutions like Central Bank of Nigeria (CBN), Independent National Electoral Commission (INEC), Nigerian National Petroleum Company Limited (NNPC), Borno State Government, Nigerian Television Authority (NTA), Niger Delta Development Commission (NDDC), National Universities Commission (NUC), Kaduna State Government, Nigerian Port Authority (NPA), News Agency of Nigeria (NAN), Federal Ministry of Environment, Nigerian Security Printing and Minting Company, University of Calabar and Nigerian Postal Service and Power Holding Company of Nigeria (PHCN).

    “And like I asked earlier, if Chief Bode George were to be the FCT Minister, would he have treated PDP differently from the other 4,793 land title owners?”

    On loyalty and commitment to the PDP,  Olayinka said the results in Wike’s Rivers and George’s Lagos State from 1998 till date are clear for everyone to see and used as yardstick.

    2026: APC faces uphill task dislodging PDP in Osun

    The All Progressives Congress (APC) is confronted with some challenges ahead of next year’s off-cycle governorship election in Osun State, particularly the internal crisis within its fold. To boost its chances of winning, the party must choose a candidate that would resonate with the electorate, writes Deputy Political Editor RAYMOND MORDI

    Leaders of the Osun State chapter of All Progressives Congress (APC) are facing a race against time to put the party in order ahead of next year’s off-cycle governorship election. Since it was dislodged from power two years ago, stakeholders have made frantic efforts to woo some key opposition figures and shore up the party’s popularity and influence. 

    The APC appears determined to unseat the occupant of the Bola Ige Governor’s House. However, the party faces a challenging environment as it prepares for the upcoming election. Addressing the challenges, which include internal divisions within the fold, improving its public perception and effectively engaging with the electorate, will be crucial for the party’s success.

    The process of selecting candidates for the 2026 race is crucial. If the APC fails to choose a candidate that resonates with the electorate and can effectively address the people’s concerns, it may struggle to regain support. The party is yet to recover from the defeat it suffered in the last governorship election at the hands of the People’s Democratic Party (PDP).

    The recent political tension in the state, marked by clashes between the APC and the PDP is nothing but a dress rehearsal for next year’s election. Since the APC lost power to the opposition in 2022, its influence has waned because the party’s performance in that election has punctured the myth of its perceived strength and invisibility in the state and the Southwest geopolitical zone in general.

    However, members of the APC are not leaving anything to chance to bring the party back to winning ways. In a bid to satisfy public sentiment, the party’s reinstated local government chairmen and their ex-counterpart from 2017 to 2022 appealed to its leadership to cede the 2026 governorship ticket to the Chief Executive Officer of the National Inland Waterways Authority (NIWA), Bola Oyebamiji. The chairmen reached that consensus after their meeting on Monday in Osogbo, the state capital.

    The former Chairman of Boluwaduro Council, Akeem Tokede, who spoke on behalf of his colleagues, said a campaign group called Grassroots for AMBO has been launched to champion Oyebamiji’s aspiration. He said they still respect the immediate past governor and the Minister of Marine and Blue Economy, Adegboyega Oyetola as the chapter’s preferred candidate “but if he chooses not to contest, the NIWA boss should be given the ticket”.

    He added: “If the minister decided not to recontest, he should cede the ticket to Oyebamiji because he has the charisma to deliver victory for our party when we work for him. We believe that as local government chairmen, we are at the grassroots and can mobilise and campaign for the NIWA boss to emerge victorious in the election.”

    While responding to questions from reporters, Tokede said the APC National Secretary, Senator Ajibola Basiru is eminently qualified to contest. Nevertheless, he added that he would have to abide by the party’s decision if Oyetola anoints Oyebamiji.

    Oyebamiji who hails from the Osun West Senatorial District served as the Commissioner for Finance under Aregbesola and Oyetola. He was initially anointed to succeed Aregbesola because of the agitation for a power shift to Osun West. His campaign had gained popularity throughout the state with his nickname, ‘Dodo Ikire’, on many people’s lips before Oyetola got the party’s ticket in 2018. He was a banker before he ventured into politics.

    He was one of the eggheads under the administration of Oyetola who managed the state finance and was instrumental in repayment of about N100bn debt of Osun State within four years. He is believed to be generous as that made his popularity cut across party lines. However, he has never been on the ballot before and has never contested for any position before.

    The recriminations that followed the 2022 defeat have further polarized the party. Today, the APC is experiencing internal divisions and conflicts among its members, which have weakened its cohesion and effectiveness. The internal division or conflict within the party has resulted in a lack of unified strategy or sense of oneness and belonging for some aggrieved members, making it difficult to carry everyone along.

    The primary issue the Osun chapter grappled with before the last governorship election was the clamour for the party’s ticket to be zoned to the Osun West Senatorial District. Its inability or unwillingness to tackle it for equity and fairness divided it. As a result, a faction led by former Governor Rauf Aregbesola connived with the PDP, particularly in the Osun West Senatorial District, where members were determined to dislodge the former ruling party from power.

    The clamour for a governor of Osun West extraction worked against Oyetola’s re-election bid because he is from Osun Central, while his opponent, Ademola Adeleke, now the governor, is from Osun West. Indications are that the APC has not learnt lessons from the last governorship election because it has yet to take a stand on zoning, which was its undoing in the 2022 election.

    It appears in a quandary and has yet to take a position. However, the uncertainty over the APC’s position on zoning is one factor that is still unsettling some stakeholders, particularly those who have ambitions to contest. It is uncertain whether Oyetola would contest. There are insinuations in some quarters that he may not contest because of the national assignment that President Bola Tinubu has entrusted in his hands.

    The decision of whether to zone the ticket for the election to a particular senatorial district or throw it open to all comers is causing ripples within the fold. While some groups within the Osun APC, like the Osun Progressives Independent Forum (OPIF), are urging its leadership to throw its governorship ticket open to all candidates, several others are calling for it to be zoned to Osun West if former Governor Oyetola decides not to run. The OPIF believes the APC would stand a better chance of winning next year’s election if it chooses a candidate based on merit, not sentiments. Speaking at a press conference recently, the coordinator of the group, Satiregun Olayiwola, said the party’s process of selecting its candidate should be all-inclusive, transparent, and without favour or pressure from any quarter.

    Olayiwola’s words: “The future of APC and Osun State depends on selecting a candidate based on merit, not sentiments. Our party must evaluate potential candidates against clear criteria, including antecedents, experience, electoral viability, courage, and demographic appeal.

    “Advocating for a particular zone, region, or senatorial district should be discarded to avoid repeating what befell our party in 2018/2022. This division resulted in some loyalists leaving the party, leading to a rerun in an election we could have easily won. The consequences of this were felt in the 2022 governorship election.

    “What APC needed to win in 2026 is a candidate with proven track records in leadership, vast experience in governance, and the ability to connect with a wide array of voter groups. The will to bell the cat on critical Osun issues and the vision to lead the state toward sustainable development are also paramount. This process should be all-inclusive, transparent, and without favour or pressure from any quarter.

    “Therefore, we are appealing to the leadership of our party, APC, to carefully consider the aspirants who possess the qualities of soundness, vibrancy, competence, and integrity. We need someone who is marketable and ready to serve, not anyone who will act as a pawn for a few individuals at the expense of the people of Osun.”

    However, another group in the party, the Coalition of Osun APC Interest Groups (COAIG), vehemently kicked against the stand of the OPIF and insisted on zoning the ticket to Osun West. The group argued that zoning the ticket to Osun West would bring fresh perspectives and address the unique developmental challenges of the district. A statement by Its Director of Public Engagement and Operations, Iwolode Samuel, COAIG, acknowledged OPIF’s contributions to the party but rejected their perspective on zoning. Samuel added: “A leader emerging from Osun West could bring innovative solutions and align district-wide developmental goals with our broader state objectives.”

    The coalition emphasized the need to focus on district representation rather than individual aspirations. It noted that this approach would allow multiple qualified candidates from Osun West to compete, fostering healthy internal democracy. The statement added: “By concentrating on a district rather than an individual, we ensure internal democracy where candidates are chosen based on their capabilities to lead and transform the state.”

    COAIG further described zoning as a tool for equitable representation and to correct historical imbalances. “Zoning to Osun West is a bold step towards ensuring that democracy works for everyone, not just a select few. We invite dialogue and continued discussions on how zoning can be effectively implemented to serve the best interests of Osun as a whole. Together, we can prioritize unity and collective advancement over division.

    “Our vision is to chart a course for sustained development that transcends political divides and captures the aspirations of every Osun citizen. The coalition’s stance on zoning the APC governorship ticket for the Osun 2026 election is not for personal interest. This position is rooted in fairness, equity, and balanced representation across Osun’s senatorial districts. It is different from the stance of those condemning the zoning to pursue the interest of an individual instead of the party’s interest.

    “Our agitation doesn’t revolve around a personality like the agenda of our brothers in OPIF. We are projecting an aspiration that considers the benefit of the majority over the comfort of an individual.”

    The APC’s influence in Osun State politics began to wane in 2017 when it lost the Osun West by-election to the then-PDP candidate, Ademola Adeleke. The seat became vacant following the death of the lawmaker who hitherto represented the constituency, Senator Isiaka Adeleke, the elder brother of Governor Adeleke. The PDP, which fielded the incumbent governor as its flag bearer for the Osun West senatorial race, defeated the APC by winning nine local government areas against the APC’s one.

    The party’s unpopularity then was attributed to the anti-people policies of the APC government led by Aregbesola. Such policies include the half salary syndrome, single uniform, school reclassification, and the state’s high indebtedness. People were determined to protest against the party with their votes during any election. This protest vote resulted in APC nearly losing the 2018 governorship election to Adeleke.

    Though Oyetola corrected most of the anti-people policies when he emerged as governor, following Aregbesola’s exit, he could not convince Osun residents that the party meant well because his government equally faced different challenges, ranging from #EndSAR protest and COVID-19 to zero allocation, among others.

    To boost its chances of winning the forthcoming election, the APC must have a good campaign strategy, which will be critical, in engaging with the electorate, addressing their concerns, and presenting a clear vision for the future.

    This is particularly true since the PDP appears united in its resolve to back Governor Adeleke for a second term. The lawmaker representing Osun East, Senatorial District at the National Assembly, Francis Adenigba Fadahunsi, and his Osun West and Osun Central counterparts, Olalere Oyewumi and Olubiyi Fadeyi respectively were all elected on the platform of the PDP. Observers say Fadahunsi and other leaders from Osun East are behind the incumbent governor for his numerous developmental projects delivery in Ijeshaland. In Osun West, the governor has a solid home base in Ede and Iwo, alongside Ejigbo, Ikire, Gbongan and Odeomu. For Osun Central, the Osogbo people are believed to be behind the governor for transforming the state capital.

    The broader political landscape in the country, including the performance of the APC at the national level, could also impact the party’s fortunes in Osun. Public perceptions about national issues, such as security, economic challenges, and governance, could influence voter sentiment.

    PDP rejects emergency rule in Rivers

    The Peoples Democratic Party (PDP) has rejected the declaration of State of emergency in Rivers, stating that the president has no power to suspend democratically elected governor.

    The party stated this in a statement by its National Publicity Secretary, Debo Ologunagba on Tuesday in Abuja.

    President Bola Tinubu had on Tuesday in a national broadcast declared a state of emergency in Rivers suspending both the legislative and executive arms of the state for six months, as part of efforts to restore peace in the state

    Ologunagba, however, described Mr president action as “utter violation” of the 1999 Constitution.

    “The PDP outrightly rejects this attempt by the President to override the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and undermine the votes and will of the people of Rivers by seeking to depose a democratic government and foist an undemocratic rule in the State.

    “The unconstitutional declaration by President Tinubu of the suspension of the democratically elected Governor of Rivers, Siminalayi Fubara and appointment of an unelected individual, Vice Admiral Ibokette Ibas (rtd) to govern the State is a clear attack on our nation’s democracy.

    “It is an abrogation of the votes and democratic right of the people of Rivers State to choose their leader under the Constitution,” he said.

    Ologunagba also described it as clear attempt at state capture and a well-oiled plot to forcefully take over Rivers for the All Progressives Congress (APC).

    He said that the reasons adduced by the President could not justify the declaration of a state of emergency in the state under the 1999 Constitution, rendering the declaration completely incompetent.

    Ologunagba said that the unwarranted imposition of emergency rule in Rivers State was part of plot to foist a siege mentality across Nigeria, decimate opposition and impose a one-party State

    “In any case, nothing in Section 305 of the 1999 Constitution relied upon by the President in the declaration grants him the exclusive powers to declare or execute the declaration of a state of emergency without recourse to the statutory approval of the National Assembly.

    “For the avoidance of doubt, Section 305 (2) provides that ‘The President shall immediately after the publication, transmit copies of the Official Gazette of the Government of the Federation containing the proclamation including the details of the emergency to the President of the Senate and the Speaker of the House of Representatives;

    “Each of whom shall forthwith convene or arrange for a meeting of the House of which he is President or Speaker, as the case may be, to consider the situation and decide whether or not to pass a resolution approving the proclamation’.

    “Mr President should recognize that his order to an unelected individual to forthwith take over government of Rivers State is illegal and a clear recipe for crisis, threat to the peace and stability of not only Rivers State but the entire nation,” he said.

    Ologunagba said that Gov. Fubara was democratically elected for a tenure of four years which tenure could not be unconstitutionally abridged.

    “The PDP therefore cautions Vice Admiral Ibokette Ibas (rtd) to respect the Constitution and ensure that he does not take any action or step which is capable of derailing smooth democratic Governance in Rivers State.

    “Nigeria is not under a military rule where the Governance of a State is by appointment by a junta,” Ologunagba said.

    PDP loses two Reps from Kaduna, Niger to APC

    Main opposition Peoples Democratic Party (PDP) yesterday lost two more members in the House of Representatives to the ruling All Progressives Congress (APC).

    The two members – Husseini Mohammed Jallo representing Igabi Federal Constituency of Kaduna State and Adamu Tanko representing Suleja/Tara/Gurara federal constituency of Niger State – hinged their defection on the lingering crisis in the PDP.

    In his letter of defection read at plenary by Speaker Tajudeen Abbas, Jallo said PDP’s crisis has made it difficult for him to deliver on his mandate and serve his people effectively.

    The lawmaker also said he was influenced by the leadership style of the Speaker and his belief in the principle of national unity, adding that he found the APC the appropriate platform to better serve his constituents.

    Jallo, who is the second PDP lawmaker from Kaduna State to defect to the APC, said the current challenges in the PDP have made it difficult for him to continue his membership of the PDP.

    Also in his letter, Tanko said he had consulted widely with his constituents before resolving to dump the PDP and embrace APC.

    But raising a constitutional Point of Order, Minority Leader Kingsley Chinda said the opposition members in the House would not stop their calls for the right things to be done right.

    The lawmaker drew attention to the judgment of the Supreme Court, which established that the defection of any member must be complete.

    He said there was no evidence before the House to suggest that the defectors toed the right constitutional path in their actions.

    Deputy Minority Leader Ali Isa said the issue of defection must be taken seriously, adding that the two defecting lawmakers should withdraw their letters of defection or face litigation.

    According to him, the PDP remains a strong party and opposition as there is no crisis within the party.

    Isa urged the defecting members to resign their positions and return to their constituents to face a fresh election.
