  • Dantong’s family in legal battle over N25m hospital

    The family of late Sen Gyang Dantong has dragged a medical doctor, Dalyopp Nyango, to court over the ownership of a N25 million hospital situated in Jos, Plateau State.

    Nyango, who is standing trial before Justice David Mann of the State High III, is accused of “criminally cornering the hospital for himself after the demise of the late senator in July, 2012”.

    Details of the matter indicated that Dantong and Nyango had, on May 4, 2009, entered into an agreement to purchase New Crescent Hospital Limited, along Zaria Road, Jos.

    Further details indicated that under the agreement, Datong and Nyango had agreed to source for N25 million to purchase the facility and jointly run it.

    Proceeds from running the outfit was to go into offsetting the loan with 25 per cent interest, on 50 – 50 basis between the duo, even though he (Dantong) provided the amount as loan.

    A Jos-based legal firm, P.D. Dyek & Co, prepared the partnership agreement.

    Trouble, however, started after the death of Datong, when his family members accused Nyango of claiming sole ownership of the hospital, especially after he allegedly changed its name to New Star Health Specialist Hospital, without their consent.

    They became even more anxious after Nyango allegedly claimed that late Datong only gave him the N25 million as loan to purchase the said hospital, and explained that the two of them only agreed to run the hospital together.

    It was at that stage that the matter was reported to the police, who after several failed attempts to settle the two families, charged the matter to court and accused Nyango of attempting to cheat Dantong’s family.

    When the widow of Dantong, Hanatu, was docked, on Dec. 7, 2016, she denied Nyango’s claims and declared that she was in the know of how the doctor pestered her late husband for the joint business and purchase of the hospital.

    The family members were also surprised to see that lawyers from the firm that prepared the partnership agreement for the duo were standing as the accused person’s counsel.

    When the case came up for hearing on Wednesday, the prosecution counsel, Mrs. Muleng Alex, raised an objection on the competence of the firm to represent the accused.

    Alex argued that the lead counsel, Mr Niri Daring, had stood in for Nyango as a witness in the drafted partnership agreement, and opined that it would amount to “double standard” for him to represent Nyango in court on the current controversy.

    She argued that going by rule 17 (5) (c) of the rule of practice, no lawyer from P.D. Dyek & Co. could be qualified to stand in as counsel to the accused, not to talk of the very person that stood in as a witness during the partnership agreement.

    “My Lord, it has come to my notice that Mr Niri Isaac Darong, the lead counsel to the accused in this case, is the very person that stood in for the accused as witness and appended his signature; so he is not qualified to appear in this matter.

    “His position as counsel in this case will amount to interference with the matter.

    “I hereby object to his representation and all other lawyers from that firm and asked the court to disqualify them from the entire case as well as disregard his earlier cross examination of PW 1 (Hanatu) in our last sitting, ’’ she prayed.

    But Darong objected to her observations, arguing that being a witness to Nyango in the partnership should not disqualify him from representing him (accused) in court of law.

    “My Lord, I only signed for Dr. Nyango and not Dr. Dantong, who had his own witness in one Mr Amos M. Jabba.

    “I don’t see anything wrong with me or any of my colleagues’ representation in this matter as we have not contravened the rule of legal practice as my learned counsel claimed.

    “I have never met late Datong nor had any knowledge of him for her to accuse me of standing for the living and forgetting the dead; I only signed as witness to the accused and not for both of them because he (Dantong), had his own witness too, ’’ he argued.

    Darong prayed the court to disregard Alex’s submissions and allow him to continue the matter “especially since we have no interest in the case or any interior motive as painted by the prosecution counsel.’’

    The Judge, in his ruling, said that it would be unethical for anybody from that Law Firm, having been involved in the drafting of the agreement between the two partners, to stand as counsel to the accused in the matter before him.

    “In the eyes of the law, anyone from P.D. Dyek & Co. that acted for the accused during the drafting of the partnership agreement, knows something about the matter and it won’t be proper for the same counsel to now act for the accused as representative in matter in court, ’’ the judge said.

    Mann said that with respect to the right of the accused to counsel of his choice, his choice should not have been someone connected to the issue in one way or the other.

    “I therefore hold that it is not ethical for Mr Darong, or anyone within the firm, to stand for, or be involved in this matter, ’’ the Judge declared.

    He then adjourned the case to March 8, 2017 for continuation of hearing.

    Darong expressed dissatisfaction with the court’s ruling and promised to challenge it at the appellate court.’’

    “The rule of practice, which the prosecution counsel quoted, is applicable only when we have an interest in the case; as it is, none of us has any interest in it.

    “We are going to appeal and see whether the rule of professional conduct can take away the right of an accused as provided by section 36 (6)(C) of the 1999 Constitution as amended, ’’ Darong said.

    Lalong loses appeal against sacked Councillors

    The Court of Appeal in Jos, on Wednesday threw out an appeal filed by Gov. Simon Lalong of Plateau state, against 271 elected councillors he sacked in July 2015.

    The sacked councillors, through their counsel, Mr Gyang Zi, had sued Lalong, the Plateau Attorney General and the State House of Assembly, over their removal from office.

    The officials, whose three-year tenure was truncated in its first year, described their removal as “illegal and unconstitutional’’.

    Collectively, they filed a case against the trio before Justice David Mann of State High Court III, in Jos.

    But the governor challenged the jurisdiction of the court to entertain the matter and its decision to take the preliminary objection along with the substantive case.

    Lalong failed in that suit and quickly appealed against the ruling.

    The governor, through his counsel, Mr Victor Paul, prayed the appellate court to set aside the decision of the lower court.

    He also sought an order that the preliminary objection of his clients should be heard first, before the substantive suit.

    But the appellate court, presided by Justices A.G. Mshelia (lead Judge), A.H. Abiru and E.O. Williams, rejected Lalong’s objection to the decision of the lower court.

    While upholding the decision of the lower court, the appellate court declared that there was nothing wrong with the lower court hearing both the substantive and the preliminary objection simultaneously.

    The judges declared that the appeal lacked merit and dismissed it.

    The councillors’ counsel, Zi, in his reaction to the judgement, described the stance of the appeal court justices as “very satisfactory and a further testimony to the fact that there was hope for the common man”.

    “We are happy that the appellate court saw reasons with the decision of the lower court and upheld it by dismissing the appeal of Gov. Lalong,’’ he told the News Agency of Nigeria (NAN).

    “My clients will go back to the High Court to pursue their rights, having been wrongfully sacked by the state government,” he said.

    10 killed in Plateau illegal miners clash

    At least 10 people have been killed in a clash between two groups of illegal miners at Gero village in Gyel District of Jos South local government area of Plateau State.

    According to the Plateau Command of the Nigeria Security and Civil Defense Corps (NSCDC), miners from Gero arrived at a lucrative mining spot around their village, but met miners from Bassa already at the site.

    “When they met at the site, a fight ensued and six people were killed instantly,” NSCDC spokesperson, Naomi Cishak, told the News Agency of Nigeria (NAN) on Tuesday.

    She said four more corpses were later discovered at the scene of the clash.

    The NSCDC, official, however confirmed that normalcy had been restored to the area.

    “The clash has ended; we have been trying to bring the two groups together to discuss the path to peace so as to forestall a recurrence,” she said.

    Meanwhile, the state government has described the incident as “very sad” and advised illegal miners to stay away from the fields.

    “The security agencies have been given the nod to arrest anyone found; no one caught will be spared,” Director of Press Affairs, Emmanuel Nanle, told NAN.

    “It is sad that people engaged in illegal mining are committing another illegality – killing. Nobody should take our simplicity for granted and try to disrupt the peace we are enjoying.”

    Date fixed for Mrs Dalung’s burial

    The Minister of Youths and Sports, Solomon Dalung, has confirmed that his late wife will be buried on Feb. 4 at Sabongida, Langtang South Local Government Area of Plateau.

    Dalung confirmed this in a statement signed in Abuja on Wednesday by Tolu Makinde, the Director of Information in the Ministry.

    According to the statement, Dalung is still pained by the demise of his wife.

    It said the minister had expressed gratitude to Nigerians from all works of life for the outpouring of love, sympathy and condolences over the tragic loss of his wife.

    He thanked President Muhammadu Buhari who personally called him last night to condole with him and his family at this period of grief.

    Mrs Briskila Dalung passed on in Jos on Jan. 29 after a protracted illness.

    Jos communities reject polio vaccine, want food instead

    Some communities in Jos North Local Government of Plateau state, have refused to participate in the on-going immunisation exercise against polio, citing hunger as their reason.

    “The communities have shunned entreaties by the immunisation officers; they say the vaccine should be replaced with food,” Mrs Hannatu Davat, the Local Immunisation Officer, told newsmen in Jos on Monday.

    The immunisation exercise, which began on Jan. 28, is co-sponsored by the local government in collaboration with the World Health Organisation, UNICEF and the Nigerian Rotary Club.

    The four-day exercise, targeted at children below five years, vaccinates the group against polio and other killer diseases including hepatitis, measles, yellow fever and tetanus.

    Davat explained that the parents, who rejected the vaccine, asked the government to rather work toward slashing the prices of food items.

    She said that other residents, who refused to participate, claimed that they had collected too many rounds of the vaccination, while others described the vaccines as “’western medicine”.

    The officer further said that even doctors rejected the vaccines on the grounds that government was paying too much attention to polio while neglecting other serious diseases.

    “The local government has reported the development to the Plateau chapter of the Nigeria Medical Association (NMA), who have promised to ensure that no doctor rejects any polio vaccines meant for children.

    “One of the doctors mentioned Mumps as one of the diseases being neglected, and described it as a serious disease which government hardly worry about.”

    Davat said that the local government had set up a social mobilisation team that was moving through affected communities to sensitise them on the importance of taking the vaccines.

    “Based on such efforts, some of the communities have changed their initial stance and are ready to bring their children, but others have remained adamant,” she said.

    The officer, who refused to name the specific communities, however, revealed that three wards were involved.

    “We have seven rounds of immunisation this year and this is just the first round; if we are not able to resolve the lingering issues, we shall forward them to the state office for further action,” Davat said.

    Tourism: Plateau to lease out hospitality outfits

    The Plateau government is to lease out its hospitality outfits to boost activities in the tourism sector, improve service delivery and boost revenue generation, an official has disclosed.

    Mr Peter Mwankon, the Commissioner for Tourism, told the News Agency of Nigeria (NAN), in Jos on Thursday that the step was part of the state government’s efforts to restore the pride of tourism.

    “We want to ensure that the facilities are not left to rot; we also hope to invest what we will gather from the transaction back into the facilities to lift their standard,” he said.

    He listed facilities to be leased out to include Plateau Hotel, Jos Hotel and the Solomon Lar Amusement Park.

    The commissioner described the state as the most attractive arena for tourists, saying that the sector had witnessed a massive boost following the improvement of the security situation.

    “ A lot of organisations held their conferences and seminars in Plateau last year. This is a testimony to the fact that people feel secure and are ready to do business with us,” he said.

    Ex-Plateau commissioner killed by robbers buried

    The remains of a former Commissioner for Agriculture in Plateau, Mr Sargwah Wazhi , who was killed by armed robbers on Dec.  22, was laid to rest on Friday amidst tears.

    Wazhi,  who was also a former Plateau House of Assembly member,  was shot dead by robbers at Deika,  Mangu Local Government Area while returning from an APC stakeholders meeting in Shendam Local Government Area.

    The robbers had blocked the road and were robbing travellers when Wazhi, who was in company with the Chairman of Langtang South Local Government Council, Mr Nicholas Vongsing,  ran into them.

    Gov. Simon Lalong of  Plateau, in his tribute,  described the death of Wazhi as shocking.

    “His death is one of the mysteries of life you cannot explain because it looks like a fairytale.

    “We were together at the APC stakeholders meeting;  we had a fruitful meeting and he told us to work hard to promote peaceful coexistence in the state only for me to be told in the morning that he was killed on his way back to Jos,” he said.

    The governor stated that the deceased had put in much efforts in the service of the state and was still serving before death came calling.

    The governor described  Wazhi as his close friend having served  together as members of  PLHA before he became a commissioner.

    Lalong pledged that he would ensure that the family of  the deceased was catered for in spite of his demise.

    He appealed to the family to take solace in God in the belief  that he was resting with the Lord.

    Chief  Letep Daban, the APC Chairman in the state, described the deceased as an industrious member of the party.

    Daban expressed sadness that Wazhi,  who was his classmate,  did not live to enjoy the change he fought to bring in Plateau.

    The News Agency of Nigeria (NAN) reports that Wazhi was buried in his country home in Zangzat, Langtang North Local Government Area.

    The trial of former governor of Plateau state, Chief Joshua Dariye, was once again stalled in an FCT High Court, Gudu,Abuja, due to the absence of defence witness.

    Dariye, who was present in court on Tuesday, is facing a 23-count charge of money laundering and diversion of Plateau State ecological fund to the tune of N1.162 billion.

    The defence counsel, Mr. Garba Pwul (SAN), told the court that one of the witnesses had travelled  out of the country and could not be served with summons.

    He said the court bailiff could not reach the witness because there had been no working day in between the last adjourned date and Tuesday.

    The trial judge, Justice Adebukola Banjoko, who expressed dissatisfaction at the development, adjourned the case to January 18 and 19 next year for the continuation of defence.

    Dariye: Absence of defence witness stalls trial

    The trial of former governor of Plateau, Chief Joshua Dariye, was on Friday stalled in an FCT High Court Gudu, due to the absence of defence witness.

    Dariye, who is facing a 23-count charge bordering on money laundering and diversion of an ecological fund to the tune of N1.162billion, was present in court.

    The defence counsel, Mr Fidelis Kaatpo, holding the brief of Mr Garba Pwul (SAN), told the court that two of the witnesses were yet to be served summons.

    “The court bailiff was unable to serve them because they were not reachable,’’ he said.

    He also said that the witnesses reside in Jos.

    In his response, the EFCC lead prosecuting counsel, Mr Rotimi Jacobs (SAN), expressed concern that unnecessary adjournments may delay the conclusion of the matter.

    The trial judge, Justice Abebukola Banjoko, ordered that a fresh court summons is served on the witnesses.

    She adjourned the case till Tuesday, Dec.13 for the continuation of defence.

    Lalong to Fayose: Remain in PDP till 2018

    Governor Simon Lalong of Plateau state Thursday told his Ekiti state counterpart, Ayodele Fayose to forget the idea of leaving his party, the People’s Democratic Party (PDP) and joining another party to contest the 2018 elections in the state.

    Even though he did not say where he intends to pitch his tent, the Ekiti state governor was quoted by media reports as saying that he was considering leaving the PDP and seeking an alternative party to contest the election.

    However, the Plateau state governor said Governor Fayose will not be welcome in the All Progressives Congress (APC) now until after the party would have taken over his state from the PDP in 2018.

    Lalong told newsmen at the mini convention of party in Abuja to elect a National Publicity Secretary for the party that he was eagerly waiting for the elections to come up in the state, promising that the APC will replicate the successes the party recorded in Edo and Ondo States when the Ekiti election is conducted.

    Lalong said: “the one I am waiting for is Ekiti. I understand that after Ondo, the man has been saying he wants to come to APC, we are saying he should remain in PDP till after the election.

    “We just came back from Ondo and we were again recruited Thursday to go to Rivers again and conduct another election. Our own is to ask for your usual and continued support.

    “Before now, some people were looking down on APC, but now people with ambitions for 2019 are withdrawing from the PDP and coming to the APC. We are going to Rivers and we will win the elections there. After there, we are moving to Anambra and that one is a done deal.”

    He however assured that the party was well positioned to win the forth coming legislative rerun election in Rivers stage scheduled for December 10.
