    Ondo poll: How far can Jegede go?

    Ondo State Attorney-General and Commissioner for Justice Eyitayo Jedege (SAN) has resigned his appointment to pursue his governorship ambition. Correspondent DAMISI OJO examines his chances at the proposed Peoples Democratic Party (PDP) primary.

    Before his appointment as the Attorney-General and Commissioner for Justice in Ondo State over seven years ago, Eyitayo Jegede (SAN)was a dark horse in politics in the Sunshine state.

    He hails from a noble family in Akure, the state capital. His name rings a bell at the bar.

    His sojourn in Adamawa State where he runs a thriving Law Chambers has brought him fame to the extent. There, he consummated his friendship with  former Vice President Atiku Abubakar,a strong voice in the politics of the state.

    Jegede’s rise to political stardom, however, followed his appointment as a commissioner by Governor Olusegun Mimiko. He is loyal and committed to the governor. The eminent has defended Mimiko, the state government and  the ruling Peoples Democratic Party(PDP)in court.

    For over a year, observers have been speculating that Mimiko is grooming Jegede to succeed him in office. He has been receiving tutelage from the his principal, ahead of the November 26 poll.

    His adoption by the governor has generated controversy. Other aspirants-Saka Lawal, Remi Okunrinboye, Adedayo Omolafe, Bakitta Bello, Bamiduro Dada,Nekan Olateru-Olagbegi, Dare Emiola, Gbenga Elegbeleye, Dayo Fadahunsi, Yekinni Olanipekun, Sola Ebiseni and Dare Bada-have kicked against the endorsement.

    The PDP primary is scheduled for August 22. It may be a sort of coronation for Jegede as the PDP flag bearer.

    Mimiko was said to have dared the aggrieved aspirants, who are not comfortable with Jegede to quit the ruling party and seek the ticket on the platform of any other party.

    Jegede is from Akure. Mimiko, whose two-term tenure will expire in February next year, is from Ondo. Both towns are in the Central District.

    Agitations for the slot by Akure people have been more pronounced, shortly after the Deji, Oba Ogunlade Aladelusi Aladetoyinbo, ascended the throne. He is at the forefront of the struggle for power shift on the platform of the ‘Akure Agenda.’

    The monarch hinged his clamour on the fact that, since 1976 when the Old Ondo State was created with Akure as the capital, no indigene of the community has ruled the state under any civilian government. Hence, Jegede’s endorsement by Mimiko was greeted with jubilation.

    The development has created a crack in the PDP. No fewer than 10 aspirants have rejected his candidacy. Women and youth wings are also protesting.

    Sources said there are powerful forces behind the adoption of Jegede. It was even speculated that the choice was even beyond the governor.

    The leader of the Peoples Democratic Movement(PDM), Atiku Abubakar, some notable lawyers and other conservative politicians have indicated interest in bankrolling Jegede’s campaign.

    There are hues and cries, following the controversial endorsement. Aspirants from the North District are bitter. In their view, the governor had taken a wrong step by picking his successor from his district of birth.

    Mimiko had earlier intimated some political leaders and aspirants about his intention. But, they advised him to have a rethink. The stakeholders urged Mimiko and other leaders promoting the Akure Agenda to align with the rotational/zoning principle of the party. According to the aspirants, there was a Memorandum of Understanding(MoU)on zoning. The agreement was to rotate the ticket among the three districts. Thus, they believe it is the turn of the North to enjoy the slot. It was signed by late Governor Olusegun Agagu, the late Chief Olaiya Oni, Saka Lawal, Otunba Fasawe(now in the All Progressives Congress (APC), Olusola Oke(now in the APC),Dr Gbakinro, Hon.Victor Olabimtan(now in the APC)and Kayode Pelemo.

    Ondo North stakeholders have vowed to resist the imposition of Jegede on the party. They chided the governor for  what they described as “a miscalculation that will further put Ondo North District at a serious political disadvantage, putting the state PDP at a loss and laying bad precedence in the state.”

    The communique of the forum reads: “The signatories to the agreement align their position with the rotation/zoning principle of the party in accordance with the MoU reached by the party leadership towards the October 20,2012 poll that the governorship of the state should be rotated amongst the three senatorial districts.

    “Eventually, that election was won by Mimiko for a second term from the Central,following a six year governorship of late Agagu from the South District.

    “We stand by the MoU signed by the PDP leadership in 2012 that Ondo North should produce the next governor after the expiration of Mimiko’s tenure”

    Aspirants from the North have vowed to shun the primary.

    Another group, thePDP Elders Forum, in a communique signed by its Chairman, Senator Omololu Meroyi, Secretary, Hon. Ebenezer Alabi and Public Relations Officer, Hon. Yemi Mahmoud rejected Jegede’s endorsement. They vowed to resist the imposition by the governor.

    According to the communique: “The next governorship slot should not be retained in the Central after an unprecedented eight years of Governor Olusegun Mimiko, who hails from the central senatorial district.

    “Aspirant from both the North and the South will not participate in any primary election where central senatorial district will be involved.”

    However, Jegede is unperturbed. He resigned his position as commissioner last Friday to focus on his ambition. He said he hoped to serve in a higher office with his energy, time and sacrifice.

    The former commissioner listed his achievements while in office. These include the review and publication of Laws of Ondo state and the signing into law the administration of criminal justice law 2015 by Mimiko.

    In a carnival-like procession, the former AG was led to the Governor’s Gffice, Alagbaka, by the crowd, who were mainly Akure indigenes. He was later led to the Deji’s palace to pay homage to the monarch.

    The members of the Deji-in-Council, including the kingmakers, palace and quarter, and honorary chiefs, congratulated the lawyer and promised to support his bid.

    A Governorship aspirant on the platform of Ondo State All Progressives Congress (APC) Mr. Oluwarotimi Akeredolu has said his drive to contest the governorship seat is borne out of his passion to serve his people.

    Akeredolu noted that he has always wanted to serve the masses and bring succour to the state.

    The legal icon spoke with reporters, at weekend, at his 60th birthday celebration in Owo, his home town.

    The event was well-attended by the party’s leaders,  delegates, members of the bench and other dignitaries.

    They include Governor Olusegun Mimiko, Chief Judge of Ondo State Sehinde Kumuyi, Chief Pius Akinyelure, Minister of State for Niger Delta Prof. Claudius Daramola, Ondo APC Chairman Isaac Kekemeke, Dipo Opeseyi SAN, Senator Ajayi Boroffice, Olusola Oke, Rotimi Ibidapo and Senator Titus Olupitan.

    Others were Chief Akinolu Olujimi, SAN; Oyo State Attorney General Seun Akinbola; Adebayo Ojo, SAN; Folakemi Solanke, SAN; Yemi Adaramodu, Engr. Adetimehin; Yemi Olowolabi; Gboyega Adefarati; Wale Akinterinwa; Ifedayo Abegunde; Femi Adekanmbi Bola Ilori and others.

    Akeredolu said the state needed a man, who can render a selfless service to turn around its economy.

    According to him, “only someone who is prepared for governance and determines to take the Sunshine State to a glorious height is needed at this time.”

    He said: “Having reached the pinnacle of every situation in my life, I have been President of the Bar and I have been many things. So, it is not the position that is attractive.

    “But it is a personal push for me to want to serve the people of Ondo State and I want to deliver on good governance  and leave a legacy that the people of Ondo State will be proud of, “ Akeredolu said .

    He urged the people of the state to keep hope alive, promising that a better government will be enthroned in February, 2017.

    APC releases time-table for Ondo governorship poll

    The All Progressives Congress (APC) has released the time-table and schedule of activities for its governorship primary election in Ondo State.

    National Organising Secretary Senator Osita Izunaso said this yesterday in a statement.

    Izunaso said the announcement was in line with provisions of the Electoral Act 2010 (as amended), Independent National Electoral Commission (INEC) guidelines and party guidelines.

    According to the time-table and schedule of activities, sale of forms will begin at the party’s National Secretariat, from tomorrow to August 5.

    Governorship nomination forms will be sold at N5 million, and intending aspirants will pay N500,000 to pick expression of interest form. The forms are free for female aspirants.

    The statement added that the last day for submission of completed forms is Monday, August 8 at the party’s National Secretariat.

    The screening of aspirants will be in Abuja from August 9 to August 12.

    The primary election will hold on August 27 and election appeal is scheduled between August 29 and September 1.

    All Progressives Congress (APC) leaders in Akokoland have called for unity in the sub-zone in its bid to produce the next governor of Ondo State.

    The elders under the aegis of the ‘Akoko APC Elders’ Assembly said it will endorse a consensus candidate, who will be supported by the people at the primary.

    The group said, following extensive consultations, it will back a candidate from the Akoko North Federal Constituency in the spirit of unity, fair play and justice.

    Rising from a meeting yesterday in Arigidi-Akoko, the Chairman of the group, Chief Felix Aiyegbusi, explained that slot was zoned to the area because it has never had the opportunity to produce the governor, unlike other constituencies in Akokoland.

    He said: “We, the APC Akoko Elders Forum, have reached a decision at this stage of the campaign towards the gubernatorial election in Ondo State to zone the slot to Akoko North Federal constituency. This decision was made to maintain peace, unity, progress and statesmanship in Akokoland, as there is no reason to create confusion within ourselves”.

    Aiyegbusi added: “This decision is unanimous and we have thrown the challenge back to the Akoko North people and the gubernatorial aspirants that hail from there to further consult within themselves and present one uniform viable candidate of their own to us. That candidate should be assure of our backing”.

    The elders advised the chieftains of the APC to put their house in order in their bid to sack the Peoples Democratic Party (PDP) from power.

    Many indigenes have hailed the resolve of the forum, describing it as a right step in the right direction.

    According to them, the unity of Akoko is paramount, if the sub-zone is to make a headway during the contest.

    However, the elders are silent on who among the aspirants should step down to achieve the consensus agenda.

    There are indications that the APC may zone the slot to Ondo North Senatorial District. The governor, Olusegun Mimiko, is from Ondo Central. His predecessor, the late Dr. Olusegun Agagu, hailed from Ondo South.

    Aspirants of Akoko origin include Dr. Tunji Abayomi, Dr. Olusegun Abraham, Gani Dauda, Senator Ajayi Boroffice, and Hon. Victor Olabimtan. A source said the elders have their eyes on three of them.

    Akoko has two federal constituencies-Akoko South and Akoko North. The senator representing Ondo North is from the Akoko South. The late Governor Adebayo Adefarati was also from Akoko South.

    Akoko North aspirants are Olusegun Abraham from Ikare, Tunji Abayomi from Oke-Agbe and Gani Dauda from Irun-Akoko.

    The Anambra State chapter of the All Progressives Congress (APC) has criticised Governor Willie Obiano for using caretaker committees in the state’s 21 local government areas, instead of conducting a fresh poll to elect their chairmen.

    Also, the party faulted the N20 million the governor promised each of the 177 communities in the state for what it called developmental projects.

    It described the governor’s action as a ploy to wet the ground ahead of 2017 governorship election.

    Addressing reporters yesterday in Awka, the state capital, APC State Secretary, Chukwuma Agufugo, wondered why Anambra was drifting to a broke and debtor state.

    He noted that the government’s move was parochial as it was allegedly caused by lack of vision.

    Agufugo bemoaned the level of development the state government was expecting to derive from its move.

    The party’s spokesman said instead of development, it would cause a crisis between and among the individuals, leaders and communities.

    He condemned the move, urging the government to look beyond what he called petty policies aimed at advancing a second term bid of the APGA administration.

    Agufugo advised the APGA government to implement policies that would engender the socio-economic growth of the state and avoid going back to the mannerism of the previous administration of sharing tax payers’ money to suspected cronies.

    He said: “You will recall that the state government recently borrowed some money and just sent a bill, which was approved by the House of Assembly, to apply for a bailout loan of billions of naira from the Federal Government”

    The APC spokesman advised the APGA-led administration to return the development burden of the rural areas to the local government areas, as enshrined in the Constitution, by first conducting a free, fair, credible local government election.

    Opinion poll shows I’ll win, says Ize-Iyamu

    Edo State Peoples Democratic Party (PDP) factional candidate in the September 10 governorship election, Pastor Osagie Ize-Iyamu, has said an opinion poll showed that he will win the election.

    But he was however silent on the organisation that conducted the poll.

    Ize-Iyamu addressed reporters in Benin, the state capital, where he declared his intention to begin his campaigns today.

    The PDP factional candidate said over 20,000 seats would be moved to the venue of the event since the state government had allegedly denied him the use of the Dr. Samuel Ogbemudia Stadium.

    State Chairman of the Ahmed Makarfi’s PDP faction, Chief Dan Orbih, said the members were surprised to receive words that the approval for the use of the stadium had been cancelled.

    The chairman said a new venue had been secured, adding that “a hundred Oshiomholes cannot stop the flagging off on Monday”.

    He described the election of a factional candidate of the PDP as “a gathering of APC members, who voted for a suspended PDP member”.

    Orbih insisted that various judgments on the party’s leadership tussle showed that Senator Ahmed Makarfi is the recognised caretaker chairman of the PDP.

    But Edo State Commissioner for Sports, Priestley Ediagbonya, said he only received PDP’s letter, dated June 28, to use the stadium last Friday.

    Ediagbonya, who said the letter got to the registry of the Ministry of Sports on June 28, added that he could not look into the requests made to the ministry on Thursday because he spent a good part of the day attending a party’s function.

    He said his ministry had never declined PDP’s approval to use the stadium but did not say if the PDP’s request would be granted.

    The Southsouth National Vice Chairman of the All Progressives Congress (APC), Prince Hilliard Eta, has said the party will not manipulate the Edo State governorship election.

    In a statement in Calabar, the Cross River State capital, by his media aide, Bassey Ita, the APC chieftain said the party had the capacity to match the Peoples Democratic Party (PDP).

    He said the party would rather leverage on the performance of its current administration in the state to win the election.

    Governorship aspirants for the poll were urged to avoid campaign of calumny and bigotry.

    Eta said: “Let me urge all the aspirants that are contesting the party’s primary to play by the rules. There should be no campaign of calumny, no infighting and no bigotry.”

    The party’s Southsouth zone met last Friday in Benin, resolving to win the September 10 governorship election without manipulations.

    Eta said the meeting was necessary to boost the morale of the Edo chapter towards winning the election.

    The APC chieftain added that the performance of the Adams Oshiomhole-led administration would be leveraged upon to woo the electorate.

    $20b ‘missing’ oil cash diverted to poll

    The Economic and Financial Crimes Commission( EFCC) has traced the diversion of the substantial part of the missing $20billion oil cash  to the 2015 electioneering campaign of the Peoples Democratic Party (PDP).

    The anti-graft agency discovered how the cash was transferred and wired into secret accounts for political purposes.

    It was learnt that the EFCC has made “ appreciable progress” in recovering a huge chunk of the cash.

    Former Central Bank of Nigeria (CBN) Governor Sanusi Lamido Sanusi (now Emir of Kano Muhammadu Sanusi II) raised the alarm that there was an estimated $20bn shortfall in oil revenues due to the treasury from the state oil company which might have been spent illegally.

    The EFCC latest discovery is said to be part of the ongoing “comprehensive” probe of a former Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke.

    A source close to the investigator, said: “We have tracked a substantial part of the missing $20billion about which the former CBN Governor raised the alarm.

    “From our findings, the oil money was diverted. We will soon make the details available.

    “As for those being invited for interrogation on campaign funds, we have been able to establish that the amounts in question were strictly government funds.

    “Whatever noise anyone is making is baseless. We are determined to recover these funds from all the beneficiaries.

    “Some of the suspects have refunded the cash credited to them and some still have outstanding funds to pay.”

    The highly-placed source said the EFCC was not targeting PDP leaders at all.

    He said if there is any evidence of government funds spent on the campaign of other political parties, we will “investigate too”.

    In 2014, Sanusi told members of the Senate Committee on Finance at the National Assembly in Abuja that $20billion was missing.

    He said: “It is established that of the $67 billion crude shipped by the Nigeria National Petroleum Corporation (NNPC), between January 2012 and July 2013, $47 billion was remitted to the Federation Account.”

    “It is now up to NNPC, given all the issues raised, to produce the proof that the $20billion unremitted either did not belong to the Federation or was legally and constitutionally spent.”

    Mrs Alison-Madueke denied that $20billion was missing.

    She said: “When the former CBN Governor came up with the allegation that about $49.8bn of crude oil sales proceeds were not remitted by NNPC, we swung into action with all the relevant agencies to reconcile the figures.

    “When we reconciled the figures down to $10.8bn and some agencies were having a different figure of $12bn, we insisted that the reconciliation must continue because there was still an anomaly; we said we must get down to the bottom of the matter to find out what is really amiss.

    “We appeared before the Senator Makarfi Commttee to defend ourselves over the fresh allegation of unremitted $20bn. We put our papers forward. The Makarfi Committee then went through all the evidence supplied by all the relevant agencies and found that there was no missing $20billion.

    “Despite the fact that the Makarfi Committee declared that no money was missing, the opposition kept insisting that $20bn was missing and they were calling us names.”

    While receiving APC chieftains from Adamawa in April 2015, President Muhammadu Buhari promised to probe the whereabouts of the $20billion.

    He said: “Going by the huge sum of money involved, there was no way an APC-led administration that has the fight against corrupt practices as a cardinal objective would sit by and watch some highly placed Nigerians loot the treasury.”

    •Form 48, other court papers to be served on commission’s chief

    A Federal High Court in Abuja has given Ejike Oguebego and Chuks Okoye, the Chairman and Legal Adviser of Anambra State chapter of the Peoples Democratic Party (PDP), the green light to begin contempt proceedings against the Chairman of the Independent National Electoral Commission (INEC), Prof Mahmood Yakubu.

    Oguebego and Okoye, who are suing for themselves and on behalf of other members of the Executive Committee of the PDP in Anambra State, are accusing Prof Yakubu of refusing to obey the December 5, 2015 judgment of the Federal High Court in Abuja, delivered by Justice Evoh Chukwu.

    Justice Chukwu, in the fifth order contained in the judgement, restrained INEC, its agents, among others, “from accepting or receiving any delegates’ list or nominated candidates that may emerge from the congresses or primaries conducted by the caretaker committee set up by the first defendant (PDP) for the Anambra PDP, except those that emanate from the plaintiffs”.

    Bothered by INEC’s alleged refusal to comply with the judgment, particularly the Fifth order, Oguebego and Okoye initiated contempt proceedings against the INEC chairman before the Federal High Court, Abuja.

    Last Friday (May 20), Justice John Tsoho (also of the Federal High Court, Abuja) granted an order ex-parte for substituted service of processes in relation to the contempt proceedings, including Form 48, on Prof Yakubu.

    For service on the INEC chairman, Justice Tsoho directed the plaintiffs to serve the court processes, including Form 48 on “an adult person, staff or official at the Legal Department of INEC at 436 Zambezi Crescent, Maitama, Abuja, being the usual place of business of the second respondent (Yakubu)”.

    On INEC, the judge ordered the services of all processes, including Form 46, “by delivering or leaving same at the Legal Department of INEC, the commission, having refused to accept service of same from the bailiffs of this honourable court”.

    The Form 48 issued by the court’s Registrar on March 31 is a notice of consequences of disobedience to order of court.

    It states: “Take notice that unless you obey the directions contained in the order of the honourable court, attached to this Form (in particular, the Fifth order, restraining you from acting on any list of nominated candidates for the PDP in Anambra State in respect of Legislative seats for the 2015 general election, except those that emanated from the plaintiffs), you will be guilty of contempt of court, and you will be liable to be committed to prison.

    “Take further notice that if the INEC continues to disobey this order, you, Prof Yakubu, the Chairman of INEC, will be held liable for contempt of court and liable to imprisonment.”

    Justice Tsoho adjourned further proceedings till May 27.

    Ekiti poll: Aluko floors Fayose as court quashes arrest warrant

    An Ado Ekiti High Court has quashed a warrant of arrest issued against a former Secretary of the Peoples Democratic Party (PDP) in Ekiti State, Dr. Temitope Aluko.

    The state government through the Office of the Attorney General on February 3,2016, secured the bench warrant seeking Aluko’s arrest at an Ado Ekiti Chief Magistrate’s Court presided over by Mr. Adesoji Adegboye.

    The state government had approached the Magistrate’s Court to compel the police to arrest Aluko for alleged perjury after claiming that the election which brought Governor Ayo Fayose to power was rigged.

    The Fayose administration averred that Aluko had committed perjury having earlier testified before the governorship election Tribunal that the election was free and fair.

    But the state High Court presided over by Justice John Adeyeye set aside the bench warrant issued by the Magistrate’s Court following the hearing of a motion ex-parte filed and sworn to by Fayose’s aide, Lere Olayinka.

    The case with Suit Number HAD/191M/2016 has Attorney General of Ekiti State as applicant while the Commissioner of Police is the respondent.

    The application was seeking an order of the court granting leave for the applicant to apply for the issuance of prerogative writ of mandamus to compel the respondent to discharge its statutory duty to arrest and investigate Aluko for alleged perjury and be made to face trial as a result of the investigation.

    But Justice Adeyeye, according to an Enrolment of Order obtained by our reporter on Friday nullified the bench warrant issued by the Chief Magistrate’s Court on ground that motion was not filed within three amounts allowed by law after Aluko had given evidence before the Tribunal.

    The certified copy of the Enrolment of Order was issued at the High Court Registry, Ado Ekiti bythe presiding Judge on Thursday, 5th of May, 2016.

    Justice Adeyeye ruled: “This application was brought pursuant to Order 40 of the High Court of Ekiti State Civil Procedure Rules.

    “Order 40 Rules (4) provides as follows: an application for judicial review shall be brought within three months of the date of occurrence of the subject of application.

    “Since Dr. Temitope Aluko was alleged to have committed the offence of perjury when he testified before the Election Petition Tribunal on 12/11/2014, the subject matter of the application is clearly a period of more than three months stipulated by Order 40 Rule (4).

    “The application having been brought outside the period stipulated by the Rules of this Court, in my humble view, is incompetent. It should be dismissed. I hereby dismiss it.”
