  • Unpaid salaries killed Kogi’s judicial officer, say colleagues

The death of Mr. Zekery Aguye, a Magistrate and Deputy Chief Registrar (Litigation) with the Kogi State judiciary, has led to unease in the service with colleagues attributing his demise to backlog of unpaid salaries.

Aguye reportedly died last Tuesday at the National Hospital Abuja after a protracted battle with prostate cancer.

He eventually died at the National Hospital, where he was initially being treated, before discontinuing treatment due to alleged inability to offset his medical bills.

The Chief Registrar of the State High Court, Mr. Yahaya Adamu, who confirmed the sad development, described Aguye’s death as pathetic.

He described the deceased as one of the best hands in the state judiciary.

“I am very sorry to say that even as we subscribe to the will of almighty Allah, who gives and takes life, you and I know certainly that sometimes there are deaths that are evitable.

“In this particular one, we feel it may have been further delayed if we had continued to manage his ailment as we were doing in the past before the judiciary was financially grounded,” he said.

According to him, Aguye’s illness surfaced two years when he was diagnosed of the disease.

He pointed out with quick response and the concerted attention of the family and judiciary, the deceased received the proper medical treatment.

He added: “He was taken to the National Hospital where he was treated, to the extent that he even started driving his car by himself, having survived the critical period of the illness also affected his spine.

“When it all started, we thought it was one of those usual ailments. But when it became obvious that he needed to be handled by specialists, we headed for the National Hospital.

“You will agree with me that treatment there is highly capital intensive. So, in conjunction with the family and other wells wishers, he was revived.

“He was subsequently placed on drugs and periodic examinations by the hospital, which we consistently complied with.

“This processes costs between N400, 000 and N500, 000 monthly, depending on the result of the tests.

“By the grace of God and with the cooperation of the family and others we were coping with the management of the illness.

“However, we started having problems with his treatment as from the middle of last year when the Kogi State Judiciary started facing funding crises.

“At this point, his salary, allowances and even the little assistance the judiciary was giving him ceased to come anymore.

“His care suddenly became the exclusive responsibility of the wife and the family alone.

“You’ll surely agree with me that, coupled with the children’s demands, it will be difficult for the wife to bear this enormous burden.

“As a matter of fact, before he finally gave up the ghost, he was withdrawn from the National Hospital for lack of fund.

“It is at the critical point of his death that he was rushed back to the hospital by which time it was already too late.”

He appealed to Governor Yahaya Bello to find solution to the impasse between the judiciary and the state government to avert further loss of lives.

  • Alleged forgery: You have case to answer, judge tells Obasanjo’s in-law

Justice Mojisola Dada of an Ikeja Special Offences Court, on Tuesday, told John Abebe, brother to late former First Lady, Mrs Stella Obasanjo, that he had a case to answer over an alleged forgery of some portions of an oil contract document.

The News Agency of Nigeria (NAN) reports that Abebe had made a no-case submission after the Economic and Financial Crimes Commission’s (EFCC) closed its case against him.

In the submission dated Jan. 19, Abebe said that the anti-graft commission had no case against him.

However, in a ruling on Tuesday, Dada held that evidence by the EFCC established a prima-facie case against Abebe.

“The no-case submission is hereby dismissed, and the defendant is hereby called upon to open his case,” the judge ruled.

NAN reports that, in the no-case submission, which relied on Section 239(1) of the Administration of Criminal Justice Law, 2011, Abebe’s counsel, Mr Uche Nwokedi (SAN), had urged the court to dismiss the EFCC’s case against him.

He said that evidence relied on by the commission had no grounds in law, and that the testimony of the prosecution witnesses had been discredited under cross-examination.

The defence counsel also said that no original copy of the allegedly forged document was produced in court, arguing that evidence of prosecution witnesses amounted to hearsay.

In his response, Mr Rotimi Oyedepo, the lead counsel to the EFCC, had said that evidence adduced by the prosecution had not been discredited, adding that evidence of prosecution witnesses was not hearsay.

Oyedepo urged the court to dismiss the no-case submission.

NAN reports that Abebe had on July 26, 2018 pleaded not guilty to a four-count charge of forgery, fabricating evidence, using fabricated evidence and attempt to pervert the course of justice.

According to the EFCC, the defendant committed the offences on June 22, 2010, in Lagos.

“Abebe knowingly forged BP Exploration Nig. Ltd.’s letter, dated Nov. 30, 1995, to Inducon (Nig.) Ltd.

“He committed the forgery by inserting in page two of the said letter, the following words: ‘Also note that the ‘Buy-Out Option’ only applies to the pre-production stage of the NPIA. The $4 million buy-out is, thus, irrelevant from production of oil in any of our fields.’

“He purported same to have been issued by BP Exploration Nig. Ltd.,” Oyedepo said.

The prosecution claimed that the defendant used the allegedly forged letter as evidence in suit No. FHC/L/CS/224/2010 between Abebe, Inducon Nig. Ltd. and Statoil Nig. Ltd., before a Federal High Court.

The evidence was admitted and marked exhibit BB in the suit, according to the EFCC, which added that the defendant, through his actions, attempted to pervert the course of justice, in violation of Sections 120(1), 120(2), 126(2) of the Criminal Code Law of Lagos State, 2003.

The judge adjourned the case until June 11 for defence.

  • You have no moral right to claim Omo-Agege’s seat, ex-Milad tells Emerhor

A former military administrator of Abia State, and National Caucus Member of the All Progressives Congress, AVM Frank Ajobena (rtd) has taken a swipe at Olorogun O’tega Emerhor over his claim that he is now the Senator-elect for Delta central as a result of the ruling of the Federal High Court in Asaba, saying Emerhor has no moral right to claim the electoral victory of Senator Ovie Omo-Agege who emerged winner of the March 23 Delta Central senatorial election.

AVM Ajobena also accused Emerhor of pretending to be in support of a candidate from Delta North senatorial district of the state as the APC governorship candidate during the build-up to the 2019 gubernatorial election.

Following a ruling by a Federal High Court, Asaba that Chief Cyril Ogodo led-Exco was the legitimate executive of the All Progressives Congress, APC in Delta State, Emerhor had described himself as the “senate-elect” for the district, but Ajobena said that Emerhor has no moral right to make that claim.

The former governor said Emerhor worked against Omo-Agege’s emergence for the Senate and didn’t contribute anything but God helped the party, and Omo-Agege was popular enough to attract votes that earned him victory, the margin would have been wider if he had the support of O’tega. So, on what moral grounds would Emerhor be spoiling to take the trophy from that contest?”

Speaking on the status of State Executive of Delta APC, AVM Ajobena said “There are two sides to the court judgement. One side of the story is on the legitimacy of the Ogodo executive. I believe there was justice in that direction. The other side of the story is on whether Emerhor should claim that seat, I don’t think he should take that seat if there is any way the law could interpret it.

Ajobena said Emerhor created confusion among that group (Delta North) to the extent that they could not even come up with a candidate.

“He didn’t want any of them to emerge. Yet, the Ogodo-led executive was to be the platform to present a Delta North candidate for the party with all the northern candidates including Chief Okotie Osiobe except Chief Great Ogboru being on the Mainstream Delta APC platform which was being championed by Emerhor.

“But Emerhor made sure he created confusion among these people and ensured that none of them emerges. At the surface, you will think he is supporting a Delta North candidate but in reality, he wasn’t interested in any of them neither was he supporting Ogboru but was working for himself and calculating for 2023.

“He wants to be governor of Delta State in 2023 and wasn’t supporting any APC governorship aspirant for 2019.

He saw it that if Ogboru emerges, Ogboru will want to do 8 years, so how will that help his cause in 2023. So, to justify what he is doing, he claims to support a northern candidate, but in same way, what is the guarantee that if a northern candidate emerges, he will serve for a one term hence he wasn’t comfortable with that.

Unlike in 2015 when the leadership was hijacked by senators, who didn’t get the blessings of the ruling party, the APC is determined to ensure that the next leadership of the National Assembly are in line with the wishes of the ruling party.

The dinner, which started around 8pm, was still in progress at the time of filing this report.

Senators already aspiring for the 9th National Assembly Senate Presidency included Senators Ahmed Lawan, Ali Ndume and Danjuma Goje.

  • N1.3trn stolen in four years by 32 entities—Magu

The Acting Chairman of the Economic and Financial Crimes Commission, EFCC, Ibrahim Magu on Monday said public funds stolen by 32 entities (human and corporate) between 2011 and 2015 was well over N1.3 trillion.

Magu disclosed this in his keynote address at the opening ceremony of the 2019 First Batch Conversion Training Programme to Procurement Cadre for Federal Parastatal and Agencies, organised by the Bureau of Public Procurement (BPP) in Lagos on Monday, March 25, 2019.

In the paper delivered on his behalf by the Commission’s Secretary, Ola Olukoyede, Magu decried this huge financial loss on the country.

He said: “One third of this money, using world bank rates and cost, could have comfortably been used to construct well over 500km of roads; build close to 200 schools; educate about 4000 children from primary to tertiary levels at N25million per child; build 20,000 units of two-bedroom houses across the country and do even more.

“The cost of this grand theft, therefore, is that these roads, schools and houses will never be built and these children will never have access to quality education because a few rapacious individuals had cornered for themselves what would have helped secure the lives of the future generations, thereby depriving them of quality education and healthcare, among others.”

He said the poor state of procurement process in Nigeria was one of the major reasons why corruption has continued to thrive in government agencies and parastatal.

He identified some of the fraudulent practices in procurement process in Nigeria to include: kickbacks, conflict of interests, fraud in the bidding process, bid suppression, collusive bidding, bid rotation and market division.

Others, according to him, are: co-mingling of contracts, change order abuse, cost mischarging, defective pricing, false statement and claim, phantom vendors, product substitution, unnecessary purchases and purchases for personal use or resale.

Magu expressed confidence that Nigeria still has patriotic and credible individuals who would do all within their abilities to uphold the credibility and honesty required for leadership in public offices.

  • Our father raped us serially for years, two sisters tell court

An Ikeja Domestic Violence and Special Offences Court, Monday heard the sordid details of how a driver, Gabriel Ogbar, allegedly raped his three daughters multiple times for several years.

Two of the daughters (names withheld) told Justice Abiola Soladoye that the incidents occurred from when they were 10 and 12 years old, at their home at Oke-Ogbe, Atura area of Badagry, Lagos State.

They testified against Ogbar at the continuation of his trial for the offences.

Sister A, now 23, told the court that she endured sexual abuse from her father for five-years from the age of 12 until she was 18-years-old.

She said: “When I was 12-years-old, I was living with my mum and dad, my mum is not always around because she is a businesswoman and my father was a driver at the time.

“Whenever my mother was not around, he would come to me at night with a knife or screwdriver or something harmful to threaten me to open up to sleep with me, because I was scared at the time, I gave in to his requests to sleep with me.

“It continued for a very long time, I could not tell anyone about it because I was scared. When I got to the age of 18-years, there was a night he came to me but I ran to my mum’s pastor who is Mrs Ochiegbu and I reported the event to her.

“I hid in her church and my dad came and was saying that I should start coming home but unknown to him, I had explained everything to them at church, I waited at the church till my mother returned and I went home with her.

“The next day, the pastor called my mother and told her everything I told her, she was upset and did not know what to do.”

Sister A said that her father continued to ask her for sex and she had to run away from home for a year.

She said she thought the abuse at home had stopped until her older sister (Sister B) caught their father defiling their 13-year-old sister.

“I and my older sister (Sister B) went for a vigil. My father did not allow our younger sister to go for the vigil. My older sister said she had a funny feeling and needed to go home to check on our younger sister.

“When she got home everywhere was quiet and, being suspicious, she went to the window to peep and she saw my dad trying to rape our younger sister. He had just finished fingering her.

“My older sister shouted and ran back to the church to report what happened, I and my older sister went back to the house to get our younger sister out of the house.
“He started attacking us and we started fighting him too. Our younger sister ran out and we told her to go to the church until my mum returned, because she comes late.

“We reported to our mum and asked our younger sister how long it had been going on and she explained that it had been a very long time he had been doing it to her and that she told her uncle at school,” Sister A said.

She added that the abuse was reported to Andrew Ogbar, the defendant’s brother, who threatened them that they should not testify against their father.

Sister B, who is 25-years-old, testified that the sexual abuse from their father started when she was 10-years-old.

She said nobody believed her when she reported the abuse to the police.

“When it started, he threatened that he will kill me if I told anyone, because he used to scare me. I used to run away from home to stay with my friends and my mum never knew about it.

“One day he was beating and threatening me, I could not take it anymore and I again ran away from home. He was pursuing me and I ran to the police station at Iba.

“The police asked me what happened and I told them what happened, the police thought I was lying because my father was pursuing me.

“The police caught him; he denied my allegations and said that it is because I ran away from home that is why I made up the allegations. The police believed him,” Sister B said.

She said the family moved to Atura in Badagry and the sexual abuse continued. Sister B also gave insight into the night she caught her father defiling her 13-year-old sister.

“I looked through the window and saw my father sleeping with my little sister. I went into the house and caught my father coming out of the room he shares with my mum.

“I saw my little sister shaking and crying and my father ran out immediately he saw me, asking me why I was back home from the vigil, and I thought to myself that ‘this man thinks I don’t know what is going on.”

“I asked my younger sister what happened and she said that daddy just finished sleeping with her. I was angry and provoked. I shouted because I wanted the whole street to know what was going on,” Sister B said.

Sister B said following the revelation that their father was also defiling their youngest sister, their father became aggressive, threatening the sisters and their mother.

“The threats were too much. My father hit my mother with a stick and wanted to burn her alive with fuel.

“We reported him to the Marogbo Police Station but he kept evading arrest until the police caught him.
“When the police saw the injuries on my mum’s hand from my father, they believed us and that is when we were taken from one court to another,” she said.

Under cross-examination by defence counsel, Mr Peter Odoeme, Sister B noted that she caught her father defiling their 13-year-old sister in July 2015.

Last February 25, the youngest sister (name withheld) gave evidence in private about the alleged defilement.

The press and members of the public were asked to leave the courtroom during the third sister’s testimony because she was a minor.

Following the sisters’ testimonies, Justice Soladoye adjourned till May 23 for continuation of trial.
