  • Breaking: Osinbajo, Fayemi, Yari meet in Aso Rock

    Vice President Yemi Osinbajo on Thursday evening met behind closed doors with two All Progressives Congress (APC) governors at the Presidential Villa, Abuja.

    The governors were Kayode Fayemi of Ekiti State and Abdulaziz Yari of Zamfara State.

    They met for about thirty minutes behind closed doors.

    When approached after the meeting, they simply told State House correspondents that it was a private meeting.

    But it was gathered that the Court of Appeal in Abuja would on Thursday night deliver judgment in the Ekiti governor dispute case.

    The Ekiti State Election Tribunal had in January delivered judgment affirming the victory of Kayode Fayemi of APC in the election.

    Appeal Court had also nullified APC primaries in Zamfara State.

  • Court remands man for Taxify driver’s death

    An Igbosere Magistrates’ Court in Lagos Thursday remanded in prison custody, Ikechukwu Ozurumba, charged with killing a Taxify taxi driver.

    Magistrate O. O. Oshin made the order following Ozurumba’s arraignment by the Federal Special Anti-Robbery Squad (FSARS), Adeniji-Adele, Lagos.

    Ozurumba, 29, was charged alongside Chima Chukwuemeka, 34, on a five-count charge of murder, theft and accessory after the fact.

    They were also accused of stealing the taxi driver’s Toyota Camry car valued at N1.5 million.

    Prosecuting counsel, Mr. A. O. Fadipe, alleged that the duo committed the offences on December 26, 2018, at about 6:15pm at Festac and Okokomaiko areas of Lagos.

    He said first defendant Ozurumba conspired with one Kelechi (a.k.a Sunshine) still at large, and killed Taxify driver, Olufemi Ebenezer.

    They allegedly hit Ebenezer, who hailed from Akoko in Ondo State, with some tools, resulting in his death.

    Fadipe said after killing Ebenezer, Ozurumba dumped his body on Jimoh Street, Okokomaiko, Lagos.

    According to the prosecutor, the defendant also made away with the victim’s car marked SMK-980 FM.

    He said second defendant, Chukwuemeka, “with the knowledge that the first defendant committed an offence, gave him shelter to prevent his arrest by the police.”

    The court heard that the offences contravened Sections 1(2) (b) and 6(b) of the Robbery and Firearms (Special Provisions) Act, Laws of the Federation, 2004.

    They also offended Section 233 of the Criminal Law of Lagos State, 2015.

    Ozurumba’s plea was not taken, because the court had no jurisdiction to entertain the charge.

    But Chukwuemeka pleaded not guilty to the charge of accessory after the fact.

    The defendants’ counsel, Mr. Francis Agaoro prayed the court to admit Chukwuemeka to bail, because the charge “is a bail able offence.”

    But Fadipe opposed him and prayed the court to remand both defendants.

    He said Chukwuemeka was charged under the Robbery and Firearms Act which falls under the jurisdiction of the high court.

    In a bench ruling, Magistrate Oshin granted both applications in part.

    She remanded Ozurumba, pending the Director of Public Prosecution (DPP’s) advice and granted Chukwuemeka N250, 000 bail.

    The case continues on May 28.

  • Bayelsa election tribunal begins sitting in Yenagoa

    The 2019 election petition tribunal began sitting in Yenagoa, Bayelsa State, to begin considerations of various petitions arising from the conduct of the 2019 national and state legislative elections.

    Already, the candidates of the Advanced People’s Democratic Alliance (APDA), Azibataman Johnbull, filed a petition challenging the declaration of the People’s Democratic Party (PDP) candidate, Mieteme Obodor, as the winner of the House of Assembly election in Ogbia Constituency 1.

    Johnbull earlier applied to the Independent National Electoral Commission (INEC) for the certified true copies of results from the entire Ward 13, where he alleged that irregularities took place during the election.

    He alleged that army personnel attached to former President Goodluck Jonathan were involved in the malpractices.

    The tribunal also received from the APC candidate for Bayelsa Central senatorial district, Mr. Festus Dumeibi, against the PDP candidate, Douye Diri.

    Petitions were further received from the APC candidate for state House of Assembly candidates, Dr. Selekaye Victor-Ben (Constituency 4, Southern Ijaw), Leskey Ikengs (Southern Ijaw Constituency 4), Nathan Aggro (Yenagoa constituency 1) and Mrs. Caroline Jack (Yenagoa 3).

    The Speaker of the State House of Assembly and candidate of the People’s Democratic Party (PDP) in Southern Ijaw Federal Constituency also filed a petition against the electoral victory of Preye Oseke of the APC.

    Petition came from Mrs. Marie Ebikake of the PDP against the victory of Israel Sunny-Goli of the APC who was declared winner of the Nembe/Brass federal constituency.

    In a related development, the Independent National Electoral Commission (INEC), has issued certificates of return to 23 members-elect of the Bayelsa State House of Assembly.

    The State Resident Electoral Commissioner of INEC, Pastor Monday Udoh-Tom, while presenting the certificates return urged them to be better representatives to their constituency.

  • Health workers to Buhari: Don’t appoint only doctors as health ministers

    The Medical and Health Workers Union of Nigeria (MHWUN) has advised President Muhammadu Buhari on the need to avoid past mistakes in his appointment of ministers, especially as it concerns the ministry of Health.

    MHWUN urged the president not to appoint only Medical Doctors as Ministers of Health.

    In the current dispensation, the two ministers of Health, Prof. Isaac Adewole and Dr. Osagie Ehinare are both medical doctors and not until recently, the permanent secretary of the ministry was also a medical doctor.

    Nigerians are looking forward towards appointment of new ministers as the president sets to commence his second term in office on 29th May 2019.

    The first term of the Buhari administration is expected to wind down on 29th May, 2019 and he is expected to dissolve his cabinet latest 24 hours before the end of the current administration.

    The union argued that appointing two ministers from the same segment of the medical profession to head the ministry does not promote healthy working environment.

    MHWUN National President, Com. Biobelemoye Josiah said because of the existence of other professionals, appointment of ministers should be a mix.

    He noted that one can be a medical doctor while the other can be from any of the other professions within the medical sector.

    Besides, Josiah called for the return of the management of health institutions to hospital administrators who have the capacity to manage the institutions.

    He spoke Thursday in Abuja at the 10th National Quadrennial delegates’ conference of the Union.

    Josiah noted that the last four years is the worst for health delivery in the country, saying many factors conspired to cast a very gloomy and dark cloud on the horizon in the Nigerian health care delivery system.

    He therefore warned that as long as the appointment of ministers of health, and other key positions are held by only one profession to the exclusion of other health professionals, there will continue to be disruptions in healthcare delivery.

    He said, “As long as the appointment of ministers of Health, Directors in the ministry of health and the Chief Executives of health institutions remain the birthright of one profession, to the exclusion of other health professionals in the team, turbulence and inefficiency shall continue to thrive as they are not trained for such duties, their discriminatory approach would continue to invite protestations from other members of the health team who are in the majority. As long as government does not make conscious efforts to break this monopoly by the medical doctors, a monopoly that is self-serving, Nigerians would continue to suffer for it.”

    He posited that “As an immediate action to put confidence into Nigerians, the appointment of Ministers in the ministry must not necessarily be to only health professionals in order to halt politics of exclusion that has taken tap roots in the ministry.

    “We believe the appointments of both doctors and other health professionals as ministers, or the mixing of appointments of both doctors and other health professionals as ministers in the Ministry of Health would go a long way in boosting the confidence of the operators/ stakeholders in the ministry.

    MHWUN president also opposed the school of thought that is pushing for privatization of the health care industry.

    While stressing that privatization is not an option, Josiah said that it is the business of the government to provide for security and welfare and wellbeing of its citizenry.

  • Why we’re withholding Okorocha’s certificate of return – INEC

    The Independent National Electoral Commission ( INEC ) on Thursday cleared air on its decision to withhold certificates of return of Gov. Rochas Okorocha of Imo and three others.

    Mr Festus Okoye, INEC National Electoral Commissioner, Information and Voter Education, said the decision “does not amount to shifting goal post at the middle of a match.“

    He told the News Agency of Nigeria (NAN) on Thursday in Awka that INEC only issue certificate to people who genuinely won elections.

    “Issuance of certificates of return is a statutory function of INEC, it is only issued to those who won election and must be done through free will of a returning officer.

    “In the case of Imo West Senatorial zone where Okorocha contested, the Otu-Opi Federal Constituency in Benue, Agayi State Constituency and another in Akwa Ibom.

    “What INEC is saying is that you can’t engage in bad electoral behaviour and expect INEC to reward you with a certificate.

    “Our certificate is only for those who won freely,” he said.

    Okoye said the commission has the right not to issue certificate to such persons as it would amount to abnormality.

    He said INEC action is not targeted at the voters who voted people of their choice but to address excesses of those who wanted to use unconventional means to win elections.

    “Once we have such case, INEC will not issue certificate, but ensure that the right thing is done,” he said.

    He said at the moment that contenders of the positions in all the four affected areas are in court adding that INEC is awaiting for the outcome of the pending matters.

    Okoye said if the court orders INEC to issue certificates of return to the people involved, it would do same.

    He said if a consequential order is made directing INEC to conduct fresh election in the areas, the commission would do same.

  • Buhari meets Security Chiefs in Aso Rock

    President Muhammadu Buhari on Thursday met behind closed doors with Service Chiefs and security heads at the Presidential Villa, Abuja.

    The meeting was expected to deliberate on the security situation in the country.

    The security heads are also expected to present regular briefing to the President, who is the Commander-in-Chief of the Nigeria Armed Forces.

    The Service Chiefs at the meeting were Chief of Defence Staff General Gabriel Olonisakin; Chief of Naval Staff Ibok-Ete IIbas and Chief of Air Staff, Air Marshal Sadiq Abubakar.

    The Chief of Army Staff, Lt. Gen. Yusuf Buratai and the Director of National Intelligence Agency, NIA, Ahmed Abubakar were represented at the meeting.

    Also present were the National Security Adviser Major Gen. Babagana Monguno; Director General, Department of Security Service DSS Yusuf Bichi; the Acting Inspector General of Police IGP Mohammed Adamu; Chief of Defence Intelligence and the Minister of Defence, Brigadier Gen. Mansur Dan-Ali.

  • FG working hard to sanitize pension system, says Buhari

    President Muhammadu Buhari on Thursday assured that his administration was working hard to sanitize the rot it met in the pension system in 2015.

    He gave the assurance during the launch of the Micro Pension Plan floated by the Nigeria Pension Commission at the Old Banquet Hall, Presidential villa, Abuja.

    The President also promised to resolve all pending issues on pension payment.

    The dignity of public servants, who worked tirelessly and sacrificed for the greatness of Nigeria, he said, will be restored.

    Buhari also observed that retired public servants deserved better treatment and effective service that meets their needs to carry on after retirement.

    He said “We are also working tirelessly to sanitize some of the rot within the pension system we inherited.

    “I want to assure all Nigerians that this government remains committed to resolving all pending issues on pension payment in the federal public sector despite the lean resources of Government.

    “The dignity of retired public servants who sacrificed their lives for this country will be restored. We will ensure all hard working Nigerians in the private sector, both formal and informal, can retire without fear,” he said.

    The President also said that the Federal Government will continue to support the National Pension Commission to ensure a successful roll-out of the Micro Pension Plan, which will capture citizens that are not fully captured in the formal corporate sector.

    He urged trade associations, unions, non-governmental organizations and other stakeholders in the informal sector to join hands with the government and pensions industry to enlighten their members and general public on the benefits of Micro Pension Plan.

    He said, “Today, millions of traders, farmers and other entrepreneurs in various cottage industries are completely excluded from the different pension programs in existence.

    “The Micro Pension Plan is the natural next step. The program guarantees that when these hard working citizens retire, they can still live in dignity and comfort.”

    Towards efforts to diversify the economy and create a more inclusive and enabling environment for all Nigerians, President Buhari said the government has provided grants, concessionary loans and technical support through Small and Medium Enterprises clinics to farmers, traders and SMEs.

    Also speaking at the event, Secretary to the Government of the Federation, SGF, Boss Mustapha, said the new scheme will provide more security for Nigerians in the informal sector, and expand the country’s pension coverage as well as boost the economy.

    “This scheme also benefits the government because it has the potential to generate a pool for investible long term funds that can drive economic development,’’ he said.

    In her remarks, the Acting Director General of National Pensions Commission, Hajiya Aisha Dahir–Umar, said the Contributory Pension Scheme had recorded huge success since it was launched in 2004, with the formation of long term domestic capital, represented by N8.7 trillion worth of pension assets as at January 2019.

    The funds she explained belong to 8.46million formal sector participants.

    “The Micro Pension Plan is remarkable because it unveils a unique financial product, which democratizes the saving culture in Nigeria in a systematic and efficient manner,’’ she said.

    Dahir–Umar said the plan was designed after wide consultations with stakeholders, noting that the product is flexible with contribution amount and channel of remittance of contributions to respective pension accounts.

    She said N6.51trillion representing 73 percent of the total pension asserts have been invested in Federal Government securities issued to finance various activities.

    The acting PenCom DG said N95.31billion of the funds have also been invested in infrastructure while N7.19billion have been invested in the N10.67billion Green Bond issued by the federal government.

    She said the Micro Pension Plan launched by the President targets significant majority of Nigerian working population who operate in the informal sector.

    Micro Pension Plan is designed to fit the peculiarities of these informal sector groups. The National Pension Commission has issued a robust guideline on micro pension plan to the provision of section 2(3) of the pension reform act 2014.

    ”The product is flexible with respect to contribution amount and the channel of remittance of contributions to the respective pension accounts. Access to accumulated contributions is also flexible, seamless and facilitated by technology through varied payments system platform,” Aisha said

  • UPDATED Osun gov, Oyetola asks Appeal Court to reverse tribunal’s decision

    Osun State Governor, Adegboyega Oyetola, who contested the last governorship election on the platform of the All Progressives Congress (APC), has asked the Court of Appeal in Abuja to reverse the majority judgment given on March 22 by the Osun State election tribunal.

    The tribunal had, by a majority judgment given by two of its three members, voided the election of Oyetola, pronounced Ademola Adeleke of the People’s Democratic Party (PDP) winner.

    It then asked the Independent National Electoral Commission (INEC to issue him a certificate of return.

    In a 39-ground notice of appeal filed on March 26, 2019 by his team of lawyers, led by Wole Olanipekun (SAN), Oyetola faulted the majority judgment, given by Justices Peter Obiora and Anyinla Gbolagunte, on the grounds that it was perverse, replete with contradictions and not supported by evidence led by the petitioners.

    Oyetola wants the Court of Appeal to uphold his appeal, set aside the majority judgment and dismiss the October 16, 2018 petition by PDP and Adeleke.

    The governor said his complaint, in the appeal, was against the entire majority judgment, except where the tribunal held that it lacked jurisdiction to set aside INEC Guidelines; that the allegation of over voting was not proved; that the petitioners did not prove voided votes and other parts of the judgment where the tribunal agreed with their arguments.

    Oyetola is contending, in his first ground of appeal, that the entire of the majority judgment is a nullity because it was written and delivered by Justice Obiora “who did not participate in all the proceedings of the tribunal and who was not present when all the witnesses gave evidence.”

    He noted that Justice Obiora was absent on February 6 when the respondents witnesses (RWs) 12 and 13 – Ayoola Soji and Oladejo Kazeem – testified and tendered exhibits, which the tribunal admitted in evidence.

    The appellant argued that, having not attended the tribunal’s siting on February 6, 2019, Justice Obiora could not see the two witnesses and was unable to examine their demeanour, as required, and therefore, unlawful for the judge to have authored a judgment in which he reviewed the evidence given by the witnesses.

    He said: “The writing of and or the participation of the Honourable Justice P. C. Obiora in the writing of the judgment of the lower tribunal of 22nd March 2019 and delivery of same, vitiates the entire judgment.”

    Oyetola also argued the tribunal, in its majority judgment, erred in law and acted without jurisdiction when it accepted the petitioners’ complained of non-compliance with the provisions of Electoral Act in relation to the September 22, 2018 governorship election in Osun State and on that basis proceeded to nullify the victory of Oyetola and APC.

    It was equally the appellant’s contention the tribunal acted without jurisdiction by basing its decision to uphold the petition and set aside the return of the appellants on the basis of allegation of non-compliance with the Electoral Act, in relation to the September 22 governorship election.

    The appellant noted that, nowhere in the entire petition, did Adeleke and the PDP complained about non-compliance with the provisions of the Electoral Act in relation to the September 22, 2018 election.

    He added that the only ground, in the petition, alleging non-compliance with the provision of the Electoral Act was in relation to the rerun election held on September 27, 2018.

    Oyetola noted the tribunal contradicted itself in its conclusion, in page 191 of the majority judgment, to the effect that the information omitted by the election officers in the Forms EC8A in the 17 polling units, where the tribunal voided results, were essential to proving over-voting.

    He argued that, having earlier found that accreditation is not done on Form EC8A and that same (accreditation) cannot be proved without voters’ register, the tribunal was without jurisdiction to overrule itself.

    The appellant further argued that the tribunal erred in law when it cancelled elections in 17 polling units on the mere allegation of improper ballot accounting and accreditation details.

    He argued that since all the witnesses called by Adeleke and the PDP admitted that the voting process was regular; that votes scored by each party were publicly announced after counting and that the announced scores of parties were truly reflected on Forms EC8A tendered by petitioners, the tribunal was wrong to have proceeded to cancel results.

    Oyetola said: “All petitioners’ witnesses testified and admitted that petitioners were not short-changed regarding the scores recorded for them in each Form EC8A tendered, and that no addition of votes was reflected in favour of the appellants.

    “The lower tribunal had rightly found that there was no over-voting; there was no voiding of valid votes; that accreditation can only be done through voters’ register; that no single ballot paper was tended before it.

    “By cancelling of elections in 17 poling units the lower tribunal acted without jurisdiction. By deciding as aforesaid, the lower tribunal discountenanced Section 139(1) of the Electoral Act.”

  • Why inconclusive elections are rampant, by INEC

    As it presented certificates of return to Kaduna state Governor Nasir El-Rufai and 34 elected house of assembly members in Kaduna on Thursday, The Independent National Electoral Commission (INEC) has explained why inconclusive elections have become the order of the day in Nigeria.

    The election management body noted that though, inconclusive elections did not start with the present commission, it became rampant because elections have become highly competitive.

    National Commissioner supervising Plateau, Niger, Kaduna States and FCT, Professor Antonia Okoosi-Simbine stated while presenting certificate of return to the Governor and the lawmakers.

    According to Professor Okoosi-Simbine, “Our democracy is deepening incrementally having conducted the sixth successive election without an interregnum; there is improved integrity in the electoral system; the elections are becoming more and more competitive and the margin between winners and runners-up are decreasing to the extent that in many instances elections into the Executive and Legislatures are increasingly becoming inconclusive.

    “This explains why the phenomenon of inconclusive elections appears to have
    increased. To be sure, it existed prior to the existence of the present commission. We cannot expect less when a few big parties are contesting for power at every level.” He said.

    She also noted that the election was marred by violence through, “a new trend in which some parties and candidates engaged in violent behaviour, including manhandling election duty officials and intimidation of voters, collation and Returning Officers.

    “The Commission views this trend with grave concerns and will continue to work on greater voter enlightenment for mandate protection as well as with the security agencies to curtail this ugly trend.”

    She, however, advised politicians who felt aggrieved in the just concluded general elections to seek judicial remedy in law court.

    “The commission advises disgruntled persons and parties to feel free to seek judicial remedy where they believe they have genuine case(s) to pursue.

    “Indeed, seeking judicial remedy is not only a part and parcel of the electoral process in Nigeria, it is consistent with the culture of democracy as opposed to resorting to self-help.

    However, the INEC boss called on governor El-Rufai to ensure the people of the state enjoy dividends of democracy.

    “I encourage you to deliver more materials benefits to the diversity of people in Kaduna in order to meet their governance expectations”. She told El-Rufai.

    Shortly after receiving the certificate, El-rufai said in a remark that he would carry everybody along in governance irrespective of political differences.

    He assured of security of lives and property, just as he expressed gratitude to the people for re-electing him to serve them for the second term.

  • Adamawa Election: Security beefed up at polling units

    Security has been beefed up at polling units as people in Adamawa trickle out to vote in Thursday’s supplementary governorship election.

    The News Agency of Nigeria (NAN) reports that the election is going on in 44 units across 29 wards of 14 local government areas of the state.

    Vehicular movement has, however, not been restricted, but armed policemen were seen on roads leading to polling units conducting stop and search on motorists.

    Plain clothes security and unarmed policemen are seen around the polling units observing the exercise.

    Speaking on the security situation, the Adamawa Resident Electoral commissioner, Mr Kassim Gaidam, said that only those with Permanent Voter Cards in the affected units would be allowed access to the polling units.

    Gaidam added that only one agent from each of the political parties was allowed at polling units; but political parties’ monitoring teams would not allowed access to the election venue.

    According to him, the Assistant Inspector General (AIG) Zone 3 and the Commissioner of Police in the state are leading other security agencies in monitoring the exercise.

    He said that the National Commissioner in charge of Adamawa, Taraba and Gombe states would be joined by some neigbouring states electoral commissioners to monitor the election.
