  • Suspected rapist remanded in Lagos prison

    A 50-year-old man, Suleman Buhari, who is charged with raping a 13-year-old girl in a Lagos Island market, is to remain behind bars indefinitely, a court has ruled.

    An Igbosere Magistrates’ Court which gave the ruling, denied the accused bail even after he pleaded not guilty to the charge.

    He was ordered to be remanded in Ikoyi Prisons.

    The Magistrate, Mrs O.A.Ogunbowale, asked the accused to approach a competent court of jurisdiction – High Court – for bail.

    She directed the prosecutor to duplicate the case file and forward a copy to the State Director of Public Prosecutions (DPP) for legal advice.

    The accused, who resides at Shop 50, Ojaoba Market (named after the traditional ruler) on the island, is being tried for unlawful carnal knowledge and sexual assault.

    Earlier, Police Prosecutor Ajaga Agboko said the accused committed the offence of rape on Oct. 5 in the market.

    “The accused unlawfully had a carnal knowledge of the girl in the market.’’

    The offences contravened Sections 137 and 261 of the Criminal Law of Lagos State 2011.

    The case has been adjourned to Nov. 9 for DPP’s advice

  • Nurse docked for drugging, raping patient

    For allegedly drugging and raping a 19-year-old girl, a 27-year-old male nurse, Olugbenga Isaac, was on Tuesday arraigned in an Ikeja Magistrates’ court in Lagos.

    Isaac, a resident of Ajah area of Lagos is being tried for rape.

    The prosecutor, Insp. Clifford Ogu, told the court that the accused committed the offence on Sept.15 at Onipanu, Lagos.

    He said that the accused unlawfully had sexual intercourse with the 19-year-old girl.

    “The accused had sexual intercourse with a woman without her consent,” he said.

    Ogu said that the complainant was sick and called the defendant, a nurse, to treat her.

    “The complainant had toothache, she called the nurse to administer drugs on her, instead the accused injected her with some substance suspected to be sleeping injection.

    “The complainant slept off and the accused raped her and left.

    “The complainant regained consciousness after several hours and was bleeding from her private part, it was dawned on her that she had been raped,” he said.

    The offence, Ogu said, contravened Section 258 of the Criminal Law of Lagos State, 2011.

    Section 258 provides that if convicted of the offence, the accused is liable to life imprisonment.

    The accused denied committing the offence, while the Magistrate, Mrs T. Akanni granted him bail in the sum of N200, 000 with two sureties in like sum and adjourned the case till Nov. 30 for mention.

    The Police in Lagos State, have arrested a man, who claimed to be a trader, for allegedly raping his 15 year-old daughter and administering drugs on her to prevent pregnancy.

    The spokesperson of the state Police Command, SP Dolapo Badmos, confirmed the arrest to the News Agency of Nigeria (NAN) on Saturday.

    Badmos said that the Gender Unit of the command was investigating the suspect, Uchena Elumadu for a case of defilement.

    She said that a neighbour, who resides at Martins Street, new Oko Oba, Agege Lagos, reported the case to the police.

    She said that preliminary investigation revealed that the suspect had on different occasions, raped the JSS 3 student who is his daughter.

    The police image maker said that Elumadu usually administer drugs to prevent his victim from getting pregnant after having intercourse with her.

    “The victim said that her father, on countless occasions wakes her up in the middle of the night to rape her, mostly when her mother is on night duty.

    “The mother is a casual worker in one of the outfits attached to airport.

    “On the night of Sept. 19, the mother discovered the suspect having intercourse with the victim and raised the alarm and one of their neighbours reported the case to the police,” Badmos said.

    She said the victim had been admitted at the Police Cottage Hospital, Ikeja Police College, where she is receiving treatment in partnership with Mirabel Centre LASUTH.

    The spokesperson said that medical examination was being carried out on the victim.

    Badmos said the Commissioner of Police, CP Fatai Owoseni, had directed that the father, who admitted raping his daughter on three occasions be charged to court.

    “The commissioner has vowed that the command will no longer tolerate cases relating to domestic and sexual abuse in the state,” she said.

    Ekiti court remands man for raping girl, 5

    An Ado Ekiti Chief Magistrate’s Court has remanded a 23-year-old man, Tobi Aremu, in prison custody for allegedly raping a 5-year-old girl (name withheld).
    Police prosecutor, Sgt. Bankole Olasunkanmi, informed the court that Aremu committed the offence on September 20 at Efon Alaaye, headquarters of Efon Local Government Area of the state.
    He explained that the accused, on the said date, unlawfully defiled the minor which led to her being hospitalized for the bruises sustained during the attack.
    The prosecutor said the offence contravened Section 218 of the Criminal Code Cap C16, Laws of Ekiti State 2012.
    According to him, the case file has been forwarded to the office of the Director of Public Prosecution (DPP) for legal advice.
    The plea of the accused was not taken as his counsel, Chris Omokhafe, sought for a short adjournment pending the legal advice from the office of the DPP.
    Presiding Chief Magistrate Idowu Ayenimo who expressed concern on the soaring rate of rape of minors across the country ordered the remand of the accused at the Federal Prisons, Ado Ekiti till the outcome of advice from the DPP.
    He subsequently adjourned the case to November 4 for further hearing.

    Rape in the house of God

    Often, they scream, cry and fight to free themselves from what they consider an absurdity from their religious leaders; at other times, they just lay at the receiving end, believing somehow that what they’re being put through may just be right. After all, these are men of God; they know it all and can do no wrong. Medinat Kanabe and Dorcas Egede appraise the rising cases of sexual abuse and rape being perpetrated by pastors and Muslim clerics against young people in the society.

    Although they teach the ‘proper’ human conduct and respect for God, and enjoy societal respect for their ‘piety;’ clergymen, whether of the Muslim faith or Christian – by the actions of a few – are increasingly casting doubts in the mind of their followers and diminishing their value in society.

    A recent report emanating from the Lagos State government revealed that over 700 rape, sexual abuse, assault and defilement cases are pending across courts in Lagos State. Of this figure, 80 per cent were abused in their infant stage. The report also revealed that the majority of these cases were perpetrated by people in trust positions, with families and religious leaders occupying polar positions.

    With cases and news assaulting the public sensibility almost on a daily basis, from newspaper headlines in recent times, this might not be an outlandish claim. Lagos Police PRO, Ms Dolapo Badmos may have put it succinctly, when she said, “The concern  the command is having at the moment is of people, who claim to be religious leaders. They hide under the fact that they are religious leaders to perpetrate domestic violence in the state.”

    To underline its concern, the Lagos State Government, led by no other person than the number one citizen of the state, Gov. Akinwunmi Ambode, recently led an ‘All Male Walk’ campaign to sensitise the public on the need to tackle the unwholesome trend in the society.

    But why religious leaders? Are the cases really on the increase?

    Reported cases involving pastors

    One example is of 31-year-old pastor Olabode Sunday, who allegedly raped a job seeker on a church altar during vigil, only to tell her that by the act, her prayers had been answered by God.

    The incident which happened in Ilorin, Kwara State, shocked residents of Tanke area, where the church is located. The victim, Funke (other names withheld), 25, who had just concluded her National youth’s service went to the pastor for prayers to pave the way for her to get a job, but midway into the vigil, the Christ Apostolic Church (CAC) pastor allegedly forced himself on the hapless girl and raped her.

     Sunday, who was remorseful afterwards, blamed the devil for his action. His outraged church members said the incident was unfortunate, saying by choosing the altar of all places to perpetrate his satanic act, he had dented the image of the church.

    In Edo State, another pastor, of the Pentecostal sect, allegedly raped a 12-year-old choir member of his church at Afuda-Uromi, Esan North East Local Government Area.

    The little girl (name withheld) had gone to church for choir rehearsals, but while awaiting other choir members, the pastor, who is also founder of the church, called her into his office and carried her on his laps. Thereafter, she said, he began to suck her breast and dip his finger into her private part before raping her. The incident caused her to bleed from her private part, as a result of injuries sustained. But when accosted, the pastor told her father that he was only carrying out deliverance on the victim.

    In Ibadan, Pastor Isaiah Ojo, founder Dayspring Family Chapel, Egbeda area, Ibadan, allegedly took a seven-year-old daughter of his friend and fellow pastor, Bidemi (not real name), laid her on the church altar, and proceeded to have carnal knowledge of her.

    According to the report published by a national newspaper (not The Nation), the incident took place on Monday, May 9, 2016, but the little girl bled for almost a week, as she was said to still be bleeding by the 13th day of that month.

    In a bizarre attempt to defend himself, the pastor said “On Monday May 9, I was in my church premises when she came with her brother. The girl went to lie on the rug on the altar and told her brother that her private part was itching, asking him to come and lay on her. They used to play on the rug before then.

    “I went near them to ask what was wrong with her. I had to use my hand to help her scratch her private part. After that, the girl said: “Daddy Dayspring, come and lay on me also. When I moved nearer, I could not do anything with her; I did not insert my penis in her vagina.

    “What happened next was that I brought my penis out but I could not penetrate her because her vagina was tight. My intention was to touch her, not to damage her. When I saw that her vagina was very tight, I withdrew my penis and left. There was no blood at that time. I don’t know how blood came out of her.”

    In Akwa Ibom State, a 60-year-old pastor, who doubled as a traditional healer, Udo Job was arrested for raping a 14-year-old daughter of one of his patients.

    The girl had gone to visit her sick father in Job’s care, when he lured her into his inner chamber and forcibly defiled her, after sending her mother to the market.

    In Awka, Anambra State, yet another pastor, of a Pentecostal church, Jesus Miracle Ministries, is on the run after he sexually assaulted a 13-year-old boy, allegedly.

    According to a source, the pastor, who is said to be gay, was told by a native doctor that he would be cured of his homosexuality, if he slept with a male teen.

    Narrating his ordeal, the victim (Abuchi) said the incident took place after a vigil service. The boy who hails from Ebonyi State said, “The pastor approached me after the vigil and asked me to stay back. I told the pastor that I wanted to go home since the church activities had ended but he said I must wait till dawn.

    “When I insisted, he rubbed a substance on my eyes which made me sleep. When I woke up, I noticed that my trousers were torn, and my anus was damp. I began to cry, as I was feeling pains in my anus. The pastor said I should stop crying, that he would give me money. I rejected the money offer and went home and told my people what happened,” he said.

    In Anambra State, another pastor was nabbed for raping a 13-year-old girl during the church’s night vigil.

    The pastor, with a new generation Pentecostal church, was identified as Nzube Ohuama. The young victim had gone with her parents to the church for the monthly vigil, when the pastor lured her into a private room attached to the church and raped her.

    It was also reported that Ohuama had earlier prophesied to the girl’s parents three days before the incident that she was being tormented by an evil spirit, hence the need for a special deliverance prayer.

    Muslim Clerics not left out

    40-year-old Islamic cleric, Abdullah Omobolaji reportedly took advantage of a teenager, Idowu (not real name), having sex with her several times between November 2014 and March 2015, when the act was discovered by the girl’s mother.

    The cleric, who has since been arrested, was said to have raped her in his consultation house on Bakare Lane, Agege.

    According to a newspaper report, the cleric lived in Abule Egba, but had a room apartment on Bakare Lane, where he received clients for spiritual help.

    Report said that Omobolaji also beat  the girl’s mother up, when  she confronted him.

    Speaking of her ordeal to the Punch, the victim said she could not muster the courage to tell anyone about her experience because Alfa had threatened that she would die if she did.

    According to the victim, “It started in November, 2014 when Alfa Abdullahi called me and said I should always come to meet him if I needed anything, since my dad was dead and my mum was unable to cater for all my needs.

    “Later, he told me that he had seen a vision, adding that a man had placed an evil mark on me. He asked me to rinse my hand with cold water, which he put on fire. When the water finally boiled and I brought it down, I saw two cowries and a ring in the water. Alfa said that was what the man put inside my body and he (Alfa) was the only man that could remove the evil mark from me. He said he must sleep with me three times; and that was how he slept with me.

    “He said I must never tell anyone what happened between us, and that if I did, I would die like my father did a few years back.”

    Idowu said a few days afterwards, the suspect called her and asked her to buy an egg. He was alleged to have instructed the victim to rub her body with the egg.

    “Then he said I should break it. I found seven needles in the egg. Alfa then said he would have to sleep with me seven times. I pleaded with him not to since he only recently slept with me three times, but he insisted,” she added.

    The teenage girl told newsmen that the Islamic cleric after sleeping with her seven more times, continued to pressure her for more sex.

    However, a relative of the suspect, who did not reveal his name, said there was no truth in the allegation, adding that Alfa and the victim were dating.

    In Ogun State, a 24-year-old Dubai returnee was rescued from the custody of an Islamic cleric five months after he allegedly abducted her from the Murtala Muhammed Airport, Lagos.

    The suspect, Olalekan Anifowoshe, aka Alfa, was said to have kept the victim, Simbiat (not real name), in his rented apartment in the Atan-Ota area of Ogun State and allegedly had repeated sex with her during the period.

    The suspect, who is said to be married with three children, resided in Surulere but kept Simbiat in Atan.

    The woman was said to have consulted him in 2013 for help over a spiritual attack before travelling to Dubai, United Arab Emirates. She explained that after receiving a call from Alfa on January 11, 2016, instructing her to come back to Nigeria, she lost her senses and returned to the country immediately.

    Simbiat told journalists that Alfa had slept with her for at least 10 times, adding that anytime she demanded to see her parents, he would beat her up and boast that she had reached her “final destination.”

    Explaining how she met ‘Alfa,’ She said, “Sometime in 2013, I had a dream that a man made love to me. A friend introduced me to him and he gave me a piece of white cloth with Arabic inscriptions to cover my body whenever I wanted to sleep, which I used. Some months later, I travelled to Dubai.

    “On January 11, he called me on the telephone to come home. It was like a spell. I packed my things and arrived in Lagos the following day without telling my parents. He picked me at the airport and took me to his apartment in the Aboru. After some time, he relocated me to Atan-Ota, where he was eventually arrested. He beat me anyhow and slept with me.”

    The suspect allegedly owned up to the allegations in his statement to the police, promising to refund the money. He said “It is true I cast a spell on her to come back to Nigeria. She was living with me and I slept with her occasionally….”

    Another case involving an Islamic cleric is that of a 42-year-old man, Wasiu Lawal, who raped a 38-year-old woman on the pretext of helping her spiritually.

    The accused, who claimed to be a pastor, native doctor and a Muslim cleric (alfa), forcefully had sexual intercourse with the woman under the guise of “praying” for her.

    On her part, the woman said she did not know how she ended up sleeping in the man’s house till the next day. She said the next day, she narrated the story to her husband, who reported the matter at Ikorodu police station, which led to Lawal’s arrest.

    It was discovered that the accused used one room for pastoral work, the second room to consult as an herbalist and the third one for Islamic consultations.

    Human Rights Activists speak

    Reacting to the trend, Itoro Eze-Anaba, founder, Mirabel Sexual Assault and Referral Centre, in a chat with The Nation, said “I think pastors, imams and all those religious persons are also part of the society, and they wield certain level of influence on these worshippers, so they tend to exploit them.”

    She noted that this exploitation is further fuelled by the peculiarity of our society, “where we are taught not to challenge authority. For instance, a clergy man tells you that God has ordained his sperm to make you pregnant, and you believe it? It’s crazy!”

    Eze-Anaba said “rape is rape, whether it is perpetrated by a gang of robbers, an older sibling, uncle, neighbour, street urchin, imam or pastor. Someone once shared with me how she was raped by a bishop. She did not even know how to go about the matter. How was she to say that this ‘respected man of God’ raped her?”

    Eze-Anaba said it is difficult for rape victims of spiritual leaders to report their violations, adding that the reason is not far-fetched. “She might even get victimised just for talking about it. Like I said, these are also a reflection of what goes on in the larger society. It is easier not to believe such stories, and much easier to keep quiet and not talk about it, especially when an adult is involved. But if it’s a child, there’s this outrage, and everybody is horrified.”

    Asked if the centre has handled any such case in recent times, Eze-Anaba’s response was an emphatic “Yes.”

    She continued, “We have had such cases where the choirmasters, pastors, those people in charge of the church building, like the Catholic Church, abused female members of the church. Actually, in a recent incident, it was the Catholic Church that took the step to report. We have a lot of them that are being abused.”

    But are the cases really of manipulations or consensus? Eze-Anaba said: “They know what they are doing. A rapist grooms his victims and knows the best time to carry out his evil deed. That’s why 90 percent of survivors know their rapists. They make the plan over time and look for the opportunity to do it. Rape doesn’t just happen overnight.”

    Speaking on the increased cases of rape in the media in recent times, she said it is now more in the news because more victims are now coming forward and reporters are doing their job. “For us, we’d rather say there is an increase in reporting rape cases. And then there’s also more awareness and more people are beginning to speak up. People are beginning to have confidence in the system, and are therefore talking more about it.”

    On how the tide can be stemmed, the rights activist said, “Rape flourishes in silence. A rapist would often threaten his victims. For instance, he can tell a child, ‘If you say anything to anybody, your mother or father will die.’ The child then keeps quiet because she’s afraid for her parents. But the minute that child speaks up, the abuse ends. So, we need to break the silence, we need to begin to talk about it, we need to shout at the top of our voices. If you shout, the rapist runs. You see, a rapist will go after a child that is quiet, vulnerable. He will hardly go after a child that talks because he is afraid she will tell it to the whole world. But he’s comfortable going after the one that is quiet, the bookworm, the nice girl, the one that is withdrawn and keeps to herself; the one that just does what she’s asked to do by an adult without asking questions. That kind of child is easily silenced.”

    Apart from breaking the silence, Eze-Anaba said “Parents need to teach their children, both boys and girls, about sexuality, sexual abuse and rape. They need to teach the girl child to know that there are people out there that can bring harm to them, including their brother or his friends. They also need to teach their male children to respect women, that they are human beings with rights, and this, beginning with his sister.

    The Mirabel Foundation works with the police in ensuring the prosecution of perpetrators; but Eze-Anaba laments the slow prosecution process. “Prosecution is slow actually because it takes some time for the police to complete their investigation, before sending it to the EPP for advice. The people will now respond, it will now go to court. But by and large, we also have clients whose cases have been successfully heard within six months.

    Speaking on the huge following of these pastors even after they have been convicted of sexual offences, the Mirabel founder said, “If a pastor that’s supposed to teach you about God now turns to a rapist, I don’t need to teach you what to do. It’s obvious that that man is a criminal, and I see no reason why you should listen to a criminal. If you know your pastor is raping members of the church, and you don’t report the matter to the appropriate authorities, then you become an accomplice to the man. A lot of worshippers are in denial. They are ready to defend their clergy men to the last. They accuse the rape victims of being the ones who manipulated or seduced those so called men of God.”

    Bose Ironsi of Women Rights and Health Project (WRAHP) on her part, believes that clergymen who take advantage of their followers, lack spirituality. She said if they are truly spiritual, they would not be involved in such crimes. She also believes that people place too much trust in fellow men.

    “In a sane world, we should trust our clergy men, but unfortunately happenings around us are dictating otherwise. People should not trust easily especially when it comes to issues of that nature. But it’s becoming so disheartening. If a mother can be raped, what happens to innocent children?”

    Speaking with so much disgust in her voice and expression, Ironsi said, “Unfortunately, we have so many people who wear the garb of religion, look pious on the outside, but are all rotten within.”

    To the parents, Ironsi said, “We need to raise our children to understand some of these things that are happening. Some mothers still feel very shy to discuss these things with their children, both male and female. Many parents know how to tell the girls not to have sex and get pregnant, but find it very difficult to tell the boy not to have sex or get the girls pregnant. And there’s something about a girl being a virgin, but the boy can be wayward.”

    Ironsi strongly believes that adults who sexually assault young people or even female adults do so because of what she termed, power control. “It’s also about power control. It is the desire to control people. It’s just like you see a policeman with a gun. He has power and wants to intimidate you. So also is this pastor or religious person, who has been given that power to preside over a particular number of people, so he wants to influence them. These are the issues.”

    Ironsi has a word for mothers; “I think mothers should be vigilant. Some of us are weak because of certain circumstances we find ourselves. Some of us are even coming from abuse, we were raped by our cousins, brothers, and so sometimes when some things are happening you just discover that you cannot really deal with it. But thank God people are now coming out to speak up. Pastors will tell you they will pray for you so that you can have a child. How can you pray for me? Is it by having sex with me?”

    Asked how clergymen who have not had their hands soiled can help the society, Ironsi said, “I think first of all, let the congregation be alert to what these bad clergy men are involved in; and let them not cover them up. Again, let those who are still responsible among them speak up against what the act. They shouldn’t keep quiet. They shouldn’t say because he’s an imam or a pastor, then they won’t speak against their fellow clergymen. That’s stupidity because it will rub off on all of them. Look at it, they’re talking about corruption now, and what they say is that Nigerians are corrupt. But is it every Nigerian that is corrupt? Is it not rubbing on every one?

    Should there be stiffer punishment? Ironsi sounded a little sceptical at first, but then said unequivocally that such ‘holy’ perpetrators of rape should be made to face the music. “People are doing all sorts in the name of God because they know that Nigerians are religious people. But when such cases are reported, the law should be allowed to take its course, no matter the calibre of the person involved, be he a pastor or an imam. If they are guilty, let them face the law.”

    Asked if the recent increase in sexual assaults on minors may not be a result of mental inbalance in the perpetrators, Ironsi responded rather irritated: “There’s no mental illness anything. Let anybody not try to hide under the cover of mental illness. It is not even the devil, because he’s sitting down quietly somewhere and they go and invite him. Like I told you earlier, it’s a show of power. They play on the vulnerability of these children because they know the children can’t resist them. If those children could resist them, then they won’t try it. You will discover that sometimes when they want to rape a child who can resist them, they are often more than one.”

    Ironsi finished off with a pointed message: “People should speak out against all that is wrong.”

  • Girl gets expectant after rape

    A teenager has been arraigned before an Ikeja Chief Magistrates’ Court for allegedly raping and putting in the family way a teenage girl.

    The 16-year-old-boy was granted bail with two sureties in the like sum.

    The 16-year-old, who lives at Olusesi Street in Agege, Lagos, had pleaded not guilty before Chief Magistrate Tajudeen Elias.

    He is facing a charge of rape.

    Prosecuting Sergeant Rafael Donny told the court that the offence was committed on June 20 at the apartment of the accused.

  • Pastor remanded in prison for ‘rape, robbery’

    An Ogudu Magistrates’ Court in Lagos yesterday ordered one Korede Olamide, 37, a pastor, to be remanded in prison custody for allegedly raping and robbing a woman.

    Korede is also accused of unlawfully detaining the victim and putting a hard substance, known as ‘Vilium 5’ in her drink, making her to sleep till the next day.

    He was arraigned before Mrs O. Sule-Amzat on a six-count of unlawful detention, maliciously administering poison, rape, causing a person to engage in sexual intercourse, provoking breach of peace and stealing.

    The Prosecutor, Sgt. Lucky Ihiehie, told the court that the accused committed the crime on Aug. 20 at Popoola Guest House, Alapere-Ketu, near Lagos.

    He explained that the victim met the accused some time ago and told her that he was a pastor, giving her some messages about herself.

    “The accused told her some of her problems and the barriers she was facing in life, saying that he would help solve her problems with prayers.

    “The accused, after their meeting the first time, followed her up with phone calls and asking her the kind of dreams she has been having of late.

    “He asked her to buy items like Bible, coconut, honey, salt and then told her to meet him for a spiritual bath at an undisclosed address.

    “The last incident was when the accused told her to buy a sponge, drink ginger and water before coming to meet him at Popoola Guest House, Alapere- Ketu in Lagos State, where the incident happened.

    “He gave her a liquid substance in a cup to drink and she passed out and found herself alone the next day with her money gone.”

    Ihiehie said that during police investigation, a video of the illicit act was found on the phone of the accused with other previous videos of similar treatment of victims.

    The accused, however, pleaded guilty to unlawful detention, maliciously administering poison, rape and stealing but denied causing a person to engage in sexual intercourse, provoking breach of peace.

    Sule-Amzat adjourned the case till Oct. 6 for sentencing and for bail of the accused on the fourth and sixth counts.

  • Catholic priest remanded for ‘rape’

    AGudu Upper Area Court in Abuja yesterday remanded the parish priest of the Church of Assumption, Asokoro, Rev. Anthony Ochigbo, in police custody for the alleged rape of a 10-year-old.

    Ochigbo was arraigned on a one-count charge of rape.

    The judge, Alhaji Umar Kagarko, adjourned the case till August 30 for ruling.

    Ochigbo’s counsel Godwin Chukwukere applied for his bail pursuant to sections 158, 162, 163 and 164 of the Administration of Criminal Justice Act (ACJA), urging the court to grant the defendant bail.

    He said although the offence was not bailable, Section 162 gives the court wide powers to grant bail in cases as this.

    Chukwukere urged the court to exercise its discretion in favour of his client, adding that the defendant was on administrative bail and would not jump, if granted.

    Prosecutor John Ijagbemi opposed the application, saying the defendant was not given administrative bail. He urged the court to discountenance the application and remand the defendant in custody.

    He told the court that Grace Ibong of Kuruduma village, Asokoro, reported the matter at the FCT police command on August 17.

    According to him, the defendant asked the complainant to leave her 10-year-old and eight-year-old daughters to spend the night with him after a church programme.

    When she went back to pick her children on August 15, she discovered her 10-year-old had a funny movement and when she asked why, the victim said the defendant forcefully had carnal knowledge of her during the night.

    He said the offence contravened Section 283 of the Penal Code.

    Ochigbo pleaded not guilty.

     

  • Why is there so much rape in Nigeria today?

    Rape is a conscious process of intimidation wherein perpetrators keep women and children especially, in a state of constant fear. Rape devalues the victim.  It is a crime which stigmatizes the emotions, a crime of insult, oppression and revenge that needs to be punished because a rapist is a criminal and all crimes and their beneficiaries must be punished. Rape and other forms of sexual harassment need the urgent and serious attention of family, institutions, civil society groups, government and international community if we really want to ensure a violence-free society for all.

    Cases of sexual violence have increased all over the world. The Stanford rape case involving a 20-year old former Stanford University student who was sent to jail for sexually assaulting an unconscious woman on the school campus is a case in point. The judgment generated a lot of negative responses on social media and from the public against the Judge mostly because the sentence – a mere 6months and 3 year probation – seemed like a slap on the wrist for the rapist.

    In Nigeria as well, there has been an increasing number of rape and sexual harassment cases on a keen keel. A total number of 150 reported cases of sexual and physical abuse were recorded in Lagos state for one year period as at April 27, 2016. Also the Lagos State commissioner for Women Affairs and Poverty Alleviation, Mrs. Lola Akande, said the Ministry in the last one year treated about 589 cases ranging from sexual abuse, physical abuse and child labour.

    There was the case of a 52-year-old builder who confessed to having carnal knowledge of a 12-year old girl in Suleja local government area of Niger state. As a matter of fact, another 33-year old teacher of Government Girls Secondary School, Minna, Abdullahi Shaba was remanded in prison Custody for allegedly raping a 16-year old senior secondary student. Two teenage girls were violently raped to death by a gang of young men in Bayelsa state. While this was going on, two other cases  of child abuse occurred in the state, and this included  the death of a 7-year old girl after being raped and infected with HIV/AIDS.  There was also a report of a 15-year old girl who was gang raped in Ebonyi state on her way from a wake-keep.

    If nobody is alarmed at the frequency of these occurrences, we are. They seem to have grown in frequency maybe because our institutions are not addressing these crimes by dealing with the perpetrators. There was a case of a 44-year old man from Ini local government area of Akwa Ibom state who was alleged to have defiled his daughter and actually confessed to have had sexual intercourse with her severally. What then can we make of the man in Enugu who raped three of his children aged five, seven and nine and another 10-year old girl who cried out after constant defilement by her father for a period of 18months in Lagos state? What can we say about that? Rape in Nigeria has also been festering in our universities. We are not likely to easily forget the Cross River state university rape matter between the Dean, faculty of Law, Prof. Cyril Ndifon and a 20-year old 400 level student; the part-time lecturer of the University of Lagos, Afeez Baruwa who allegedly raped an 18-year old girl seeking admission to the university of Lagos. Another case of rape involving a certain Dr. Mohammed Sani Idiagbon and it took place at the department of English in  University of Ilorin.

    Just recently, Kaduna State Governor, Nasir El-Rufai, revealed that the 19 governors in the northern states are set to review the Penal Code which will address the issue of rape and penalties. He also said a bill to that effect is currently before the State House of Assembly. We are gladdened by this but wish that the governor was not merely reacting to the case of one Haruna Tukur who allegedly raped a five-year old girl in Kaduna recently.

  • Rape victim’s ordeal and police

    Reports of the abduction of Dr.Ime Stephen, uncle to the 15-year old school girl, Mary Udo, allegedly raped at gunpoint by a police Inspector in Akwa Ibom State, represent the apogee of the travails of the family since the rape incident took place.

    It is at once a dangerous development that calls for the immediate intervention of the Inspector-General of Police as insinuations are very high that the incident has an uncanny link with the rape saga.

    Before his abduction, Citizen Stephen had reportedly escaped assassination attempt at his village house at Nyaodiong, in the MkpatEnin Local Government Area of the state. He had also petitioned the state Commissioner of Police, Murtala Mani, alleging threat to his life, that of his family members, attempted arson on his new house and malicious damage of property.

    He also had cause to visit the CP penultimate Friday to complain of frequent attacks on him and how to get justice for Udo. Before his latest fate, the victim was pressing hard for the matter not to be swept under the carpet after refusing to accede to entreaties from some clergymen and police officers sent to him by the Divisional Police Officer DPO to let the matter go.

    Those sent to him by the DPO of the MpatEnin local government were said to have persuaded him to pipe down on the grounds that the incident was not only a big shame to the offending Inspector but the police establishment he represents. But as things stood, Citizen Stephen would not allow the matter go apparently in deference to the rape victim who had said “it was a harrowing experience. There is nothing on earth that would make me forgive the inspector”.

    The little girl’s feelings are understandable given that the inspector not only allegedly raped her at gunpoint while returning from church but detained her for three harrowing days and made the family to cough out N10, 000 before setting her free. That is the height of criminality unexpected of those paid with taxpayers’ money to protect the society. It is a big scandal that by now ought to have attracted deserved attention from the police authorities.

    It is bad a thing that a police officer of that rank could degenerate to such a bestial and criminal level of raping a school girl returning from church at gunpoint. Worse still, he also had the temerity to detain her for three days and forced the family to pay N10, 000 for her safety. These are enough to ruffle public sensibility in saner societies.

    In an issue as serious as this, the minimum expectation is for the accused to be made to face the full weight of the law without delay. But all indications have not pointed to this direction. For, it is about a month now the incident happened without the public being availed the benefit of any serious action taken against him. Rather, what we find is an attempt by the police to paper the matter as vividly indicated by the emissaries they sent to the victims’ uncle.

    Unfortunately, Udo’s family would not have such things covered up because it could encourage policemen to take laws into their hands in anticipation that the system would have a way of protecting them. This column identifies with the Udo family in condemning this singular rape incident and the lawlessness that followed. It cannot and should not be swept under the table. It is a very heinous offence with prospects of further denting the image and credibility of the police force.

    It is trite that the course of the police force will be better served when it distances itself from the criminal activities of its men and officers by taking decisive steps to discourage the resort to criminality. Even if the police had need to apologize to the victim’s family for the bestial treatment meted to their daughter, that should not in any way detract from the fact that the accused must still be made to pay for his sins.

    The accused inspector whose name up till now, is being shielded by the police should immediately be made to face the music for the unmitigated disgrace he is to the institution. That way, we will be sending the right signals that those who abuse their positions of trust for self-serving reasons will not go scot free. That is the lesson that must be underscored most poignantly in the instant case.

    Curiously, the abduction of Stephen has added another dangerous dimension to the matter. This is especially so given that before his latest ordeal, he had escaped an assassination attempt to his life. He had also alleged threats to his life, that of his family, attempted arson on his new house and malicious damage of his property. All these were documented in a petition he sent to the state Commissioner of Police CP.

    Ironically, not much is known of the response of the CP to these allegations before the man was finally abducted from his house by masked gunmen who broke through the wall from the backyard. Neither is there any evidence of the provision of police protection to the man in the face of the serial threats to his life and that of his family.

    And until the CP speaks on the latest development, the impression we get is that the command did not take seriously the copious complaints of the human rights activist. But if the police did not take seriously the issues raised in the petition, the abduction has shown very vividly that either it underestimated the weight of the matter or turned a blind eye to it for inexplicable reasons.

    For whatever reason, it is sad that the fears of Stephen have come true. If the police had taken the matter seriously, they would have responded positively by building some form of security around the Udo family. Had that been done, we would have saved the police institution the embarrassment of having to contend with the reality of this abduction despite repeated complaints and allegations of threats to life and property.

    That is the burden the police has to shoulder given the latest development. It also suffers vicarious responsibility of having to demonstrate beyond reasonable doubt that this abduction is not in any way connected with the family’s insistence that justice must be done in the case of the inspector that raped, abused and extorted money from the innocent school girl.

    There is no better way to demonstrated this than a quick apprehension of the marauding gang that abducted Stephen. With the smashing of the gang and freeing of the rights activist, we will be demonstrating to the world very unambiguously that the cries of the witch at night had nothing to do with the death of the child in the morning. That is the uncanny reality that has been elevated to the fore by the unfolding events surrounding that rape case.

    It is important that the police authorities get to the root of the matter to demonstrate very clearly that the current twist is not in any manner linked to the family’s insistence that the offending inspector must face the wrath of the law. A quick apprehension of those criminals will not only disabuse insinuations of complicity but further shore up the waning public confidence in the ability of the police to protect and treat information given to them with utmost confidentiality.

    We now run the risk of allowing the impression fester that those charged with the security of the citizens can trample on and serially abuse such privileges and get away with them. That is the point where the predicament of Stephen now leaves us. We must work to reverse this ruinous tendency by promptly apprehending the abductors and secure Stephen’s freedom. The IG must act now to extricate the police from it actions or inaction that led to the current pass. But nothing untoward should happen to Citizen Stephen.
