    Social medicine: Sexual violence,rape and Hiv: Matters Arising

    This discussion began  two weekends ago  .There was a break that was occasioned by circumstances and commitments beyond my control.

    Sex related violence in Nigeria has  indeed assumed very dangerous dimensions. Usually  what is reported is very little compared with the cases that are brushed aside, kept secret or  which  got reported to law enforcement agencies but  were simply allowed to fizzle out . Commonly , the victim continues to suffer the multiple jeopardizes of contracting infections including HIV, Hepatitis B, Stigma, divorce, separation  and pregnancy if a woman of reproductive age

    Those of  us who write are glad to do so purely as a form of service to humanity, hoping that somehow, someone somewhere will read, digest , and understand  that when you indulge in some certain acts which are considered dangerous or  inimical  to  other people, you  are likely to be consumed by  the consequences of your action, one way or the other. Even if your victim appears and looks very healthy ,make no mistake about it , by reason of the  unyielding biology of the  human  body  under conditions  of  sexual violence, you might just be preparing yourself  not only for an unnecessary, avoidable and life long  battle with HIV/AIDS, but also with equally dangerous and incurable infection ,Hepatitis B. And for women  who rape  men and other women , the  risk of disease transmission is only marginally  lower  when there is passage of sperm  cells ,which is  more likely to occur when a young woman is the rapist. The many  ills of society that are man made inflict pain and suffering too deep to imagine . Humans come in different forms and indeed our present understanding  of medicine began with the study of forms (morphology).

    From the general appearance to the cells and tissues and the blood elements that flow in us ,we are made differently. Interestingly, we share sameness of genes (basic units of heredity) with animals including wild animals, hence it remains an uphill task to change patterns of behavior in man that are difficult to differentiate from those found in wild animals . The inner spirit battles to restrain man from destructive tendencies and from given vent to primitive instincts . It is from this understanding that best friends often turn out to be worst  enemies, unhealthy rivalries can develop between blood brothers and the family friend you seem to trust religiously may turn out to be the one caught in an inappropriate relationship with a loved one . Differences in the Anatomy of our brain tissues and mind also explain why certain persons, men and women will find pleasure  in inflicting unimaginable injuries on others for reasons no other person except they can provide.  If I might add, these genetic and acquired differences in us  partially also explains why  those who are entrusted with care and protection of other human beings  do little or nothing to help victims of rape and sexual violence, even when death is involved. The interest of victims seem to matter very little to these individuals . For those who survive attacks of rape(non spousal), no one other than the victim can adequately  describe the resultant effects.  Perhaps as a result  of issues bothering on  the circumstances prevailing when  the incident occurred, marriages have been broken , intending couples separated and  promising young people cut down in a few hours of insane inability to postpone , delay or avoid abnormal  the urge for  immediate sexual gratification.

    In all these, early recognition of  unusual  sexual behavior patterns is very essential. These could be seen or observed in verbal or non-verbal communication, and at times in written messages, done quietly but with  sufficient  scrutiny on people around us .

    Young people keeping multiple partners  often fail to understand that  it is risky business and any one person in the group is only a  link in a big network of  sex enthusiasts , some of them with  unmatchable desire to explore what belongs to others.

    For reasons of clarifications, let us look at the language commonly used to discuss these issues

    Sexual assault.

    This  means any sexual  action, involving the genitals, anus or other body parts performed by one person, on another, without that person’s consent associated with the use of force, threat of force, or inability to give consent

    Rape

    This the  act of forced anal or  vulval intromission  by a  male or female  genital organ , object, or body part, without  established consent, and with or without ejaculation .

    Spousal rape can occur between a husband and wife .This may be defined as forced coitus or sexual acts in a marital relationship without the consent of a partner. This is quite uncommon in African societies.  People have asked whether house wives should not be asked to explain why husbands now turn away from them  preferring house helps and under aged. In societies where polygamy and polyandry is customary, spousal rape is unheard of .

    Date rape

    Quite common among young people, occurs when rape involves  individual adults  out on a date.  May be prompted by indecent exposure . Often occurs in association with  the use of hard drugs and alcohol; May begin with true intention   hidden, until the intended victim is provided with an offer she is unable to reject or finds herself unable to prevent being abused.

    Statutory rape

    Refers to intercourse with a female or male below a specified age or mental status established to be impaired regardless of whether or not consent was given.  This seems to occur very frequently in some parts of the  underdeveloped world  and the reasons go from arrant bestiality , through fetish obsession to others more sinister

  • Man rapes man in Lagos

    A terrifying ordeal occurred in Lagos last month when a man held down another man and raped him, a police prosecutor told an Abule Egba Magistrates’ Court on Tuesday.

    The prosecutor, Insp. Racheal Williams alleged that the accused had drugged his victim before raping him.

    “When the complainant woke up, his anus was paining him and there was some left-over semen in it,’’ she said.

    The News Agency of Nigeria (NAN) reports that the accused, 38-year-old Sali Malu, a gatekeeper, lives at 31, Peace Estate, Ipaja, a suburb of Lagos.

    He is facing a two-count charge of sexual assault and causing a breach of peace.

    The accused pleaded not guilty to the charge of raping a fellow gatekeeper (names withheld) and breach of peace.

    Williams said the offences were committed on March 23 in the house of the accused.

    “The complainant (names withheld), who is also a gatekeeper in the estate, went to the room of the accused to charge his phone.

    “The accused gave him food to eat. The man did not know that the food had been laced with drug.

    “After eating the food, he slept off only to wake up to the reality that he had been raped,’’ she told the court.

    The offences, according to the prosecutor, contravene Section 166 (d) and 259 of the Criminal Law of Lagos State, 2011.

    Ruling on the bail application of the accused, the Magistrate, Tajudeen Elias, granted the accused a bail of N500, 000 with two sureties in like sum.

    The case has been adjourned to May 5 for mention.

  • Man arraigned for rape

    The police yesterday arraigned a 20-year-old man at a senior magistrate’s court for the alleged rape of a six-year-old girl.

    The police said Sadi Ahmed, a resident of mile Tara in Kadawa village within Ungogo Local Government Area, allegedly committed the crime on March 19.

    The accused denied the allegation.

    Police prosecutor Ibrahim Abdulrazak told the court that the offence was capital in nature, adding that the case file was ready for the DPP advice.

    The Magistrate, Ummi Sani Kurawa, adjourned the case till April 29. He ruled that Ahmed be remanded in prison custody.

  • Teacher docked for defiling pupil

    A primary school teacher, Abdukadiri Olaitan, on Tuesday appeared before a Yaba Chief Magistrates’ Court, Lagos, charged with defilement of an eight-year-old girl.

    Olaitan, 23, who resides at No. 1 Ajisegiri St, Ilupeju, Lagos, is standing trial on a charge of having unlawful carnal knowledge of a minor.

    The Prosecutor, ASP Godwin Anyanwu, told the court that the accused committed the offence on Dec. 19, 2013, at his residence.

    He said that the accused, who teaches at the New Horizon Islamic School, Okearin, Ilupeju, Lagos, took advantage of his eight-year-old pupil and had sexual intercourse with her.

    “He capitalised on her lack of good guardianship and exploited her,” the prosecutor said.

    Anyanwu said that  the offence contravened Section 137 of the Criminal Law of Lagos State, 2011.

    However, the accused denied the charge.

    The Chief Magistrate, Mrs Yewande Aje-Afunwa, said that though the offence attracted life imprisonment, the accused would be admitted to bail.

    She said: “The offence is a serious one and attracts life imprisonment; it is, however, bailable, but the conditions will be stringent.

    “The defendant is hereby admitted to a bail of N500,000 with two sureties in like sum.

    “The sureties must own residential property in Lagos State and one must be a recognised community or religious leader while the other must be a blood relation of the defendant.’’

    The chief magistrate added that the sureties must both show evidence of tax payment and gainful employment.

    Aje-Afunwa adjourned the case to May 12 for further hearing. (NAN)

  • Cleric docked over alleged defilement of 12-yr-old

    A 32-year-old Islamic cleric, Kazeem Jimoh, on Monday appeared before an Ota Magistrates’ Court in Ogun, charged with the alleged defilement of a 12-year-old girl.

    Jimoh, whose address was not given, is facing a one-count charge of rape.

    The prosecutor, Insp. Peter Molokwu, told the court that the cleric committed the offence on March 18 at 8.00 p.m. in an uncompleted building opposite Community Primary School, Iloye in Ota.

    Molokwu said that the accused lured the girl into the building and had unlawful carnal knowledge of her.

    He said that police investigation revealed that the cleric had previously engaged in the act with the girl.

    The prosecutor said that the offence committed contravened Section 218 of the Criminal Code Vol. 1 of the Revised Laws of Ogun, 2006.

    The Magistrate, Mrs. Titi Bello, admitted Jimoh to bail in the sum of N200, 000 with two sureties in like sum.

    She said that the sureties must be resident within the court’s jurisdiction and show evidence of tax payment to the Ogun Government.

    Bello said that one of the sureties must also be an owner of a developed land, while the other should be a civil servant not below Level 14 in the employment of the Ogun government.

    The case was adjourned till May 23, for mention.

     

  • Mumbai gang rape: 4 men found guilty

    A court in Mumbai on Thursday found four men guilty of the gang rape of a photo journalist and another woman in 2013.

    Vijay Jadhav, Kasim Bengali, Salim Ansari and Siraj Rehman ,convicted in both cases, attacked the 23-year-old photo journalist while on assignment at a deserted textile mill in August 2013.

    Days after the assault, another victim, a telephone operator, alleged the same group of men had raped her a month earlier.

    Arguments on sentencing are to be held on Friday and the convicted men face a maximum punishment of life imprisonment.

    The fifth accused, a minor, was being tried in a juvenile court.

    The Mumbai attacks sparked renewed anger over rape in India, where the death of a student who was gang-raped in a bus in New Delhi in December 2012, led to weeks of protests.

    Laws against sexual violence were amended to make them stricter and the government promised swifter prosecution

  • Defilement: Lagos court slams stringent bail conditions on rapist

    Godspower Eva, a 52-year-old security guard, who allegedly raped three minors and a teenager, was on Wednesday in Lagos granted bail on stringent conditions.

    A Yaba Magistrates’ Court admitted the suspected serial rapist to a bail of N500, 000 with two sureties in like sum.

    The Chief Magistrate, Mrs. Yewande Aje-Afunwa, who noted that the offences attracted life imprisonment, ruled that the bail condition would be stringent even though the offences were bailable.

    Other bail conditions slammed on him include sureties, who must own a landed property in Lagos.

    She said the one of the sureties should be a recognised community or religious leader, while the other must be a blood relation of the accused.

    “The accused is hereby admitted to a bail of N500, 000 with two sureties in like sum.

    “The sureties must show evidence of tax payment and gainful employment,” Aje-Afunwa said.

    She ordered that the case file should be duplicated and forwarded to the Director of Public Prosecutions for advice.

    She also referred the defiled minors to the Clinical Psychologist at the Lagos State University Teaching Hospital for counseling.

    The News Agency of Nigeria (NAN) reports that the accused, who resides at 23A, Adebayo Doherty Road, Lekki Phase 1, is standing trial on a four-count charge bordering on conspiracy and child defilement.

    Eva, however, denied the charges.

    Counsel to the accused, Mr Gabriel Agedo, informed the court that he had filed an application for his bail.

    He pleaded with the court to grant Eva bail on liberal terms.

    Earlier, the prosecutor, ASP Godwin Anyanwu, told the court that Eva committed the offences on Feb. 17 at his residence.

    He said the accused took advantage of the four girls of ages 9, 10, 12 and 14 by assaulting them sexually.

    “On Feb. 17, Eva had sexual intercourse with three minors – aged 9, 10 and 12 — in his room after promising to give them N100 each.

    “He conspired with their 14-year-old classmate, whom he had earlier defiled, to bring to his house the minors. He also gave them N100 each,” the prosecutor alleged.

    Anyanwu said Eva was apprehended after one of the parents of the defiled minors reported the matter to the police.

    He said the offences contravened Sections 137 and 409 of the Criminal Law of Lagos State, 2011.

  • Businessman docked over alleged rape of girl, 18

    A businessman, Ejike Ukaonu, on Wednesday appeared before a Yaba Magistrates’ Court in Lagos for alleged rape of his neighbour’s 18-year-old daughter.

    Ukaonu, who resides at No. 7, Moshalashi St., Sari Iganmu, is facing a one count charge of rape.

    The prosecutor, ASP Godwin Anyanwu, told the court that the accused forcefully had canal knowledge of the girl at No. 9 Amosun St. on March 4.

    He said that Ukaonu took advantage of the absence of the victim’s mother to rape her at her mother’s place of work.

    “Ukaonu dropped by at the complainant’s mother’s shop under the pretext of paying a casual visit.

    “The defendant apparently aware of the absence of the 18-year-old girl’s mother, forcefully had canal knowledge of her,” he said.

    Anyanwu said the matter was reported to the police and the accused was arrested.

    He said that the offence contravened Sections 285, 258 and 409 of the Criminal Laws of Lagos State, 2011.

    Section 258 provides that anyone who commits rape is liable to between 15 years jail term to life imprisonment.

    Ukaonu, however, pleaded not guilty to the charges.

    In her ruling, the magistrate, Mrs Adekorede Ajibade, granted the accused bail in the sum of N200, 000 with two sureties in like sum and adjourned the case to April 14 for trial.

  • Pakistani gang-rape victim dies

    A teenage Pakistani gang-rape victim, Amina Bibi, died on Friday after setting herself ablaze to protest the release of one of her alleged rapists from police custody, officials said.

    Bibi, 18, was raped by five men on Jan. 5 as she walked home from her college in central Muzaffargarh district.

    Police arrested four men but released the main accused person on Thursday.

    A police officer who said he would not want to be identified said Bibi alleged that intentionally misleading work by the police resulted in the release of the major culprit.

    The police officer said “Amina Bibi set herself ablaze in front of the police station on Friday and was taken to a local hospital.

    “She was also taken to another medical facility in neighbouring Multan city where she died.’’

    Meanwhile, a report said the Pakistani Chief Justice, Tassaduq Hussain-Jillani, had asked the police to submit a report on the matter on Monday.

  • Why rape cases are increasing—Police

    Mrs. Sybil Akinfenwa, the Divisional Police Officer (DPO) of Sango, Ibadan, on Tuesday said rape cases had been on the increase because victims’ families fail to report the incidents to law enforcement agents.

    Akinfenwa told the News Agency of Nigeria (NAN) that the Force was   ready to deal with any case of rape reported.

    “It is so sad that cases of rape and child defilement have continued to be on the increase because relations of victims do not report such incidents to the police,’’ she said.

    Akinfenwa said that in some instances when such cases were reported to the police, relations of victims would not want the law enforcement agents to continue with the trial of suspects.

    “The relations of rape victims will come to the police and say they are discontinuing with the case because they are feeling shy or afraid of public ridicule,’’ she said.

    Akinfenwa said the police authorities were ready to apply the relevant laws of the land in dealing with rape suspects and urged members of the public to report any culprit.

    She also called on parents to deploy moral measures to address the problems of rape and child defilement.

    Akinfenwa further urged parents not to send female children to the streets to hawk, saying that this could expose them to danger.
