Ahead of the December 10 legislative rerun across three senatorial districts in Rivers State, the state Chairman of the Peoples Democratic Party (PDP), Chief Felix Obuah, and his counterpart of the All Progressives Congress (APC), Chief Davies Ikanya, are presently at loggerheads over the kick-off of construction of roads in the state. Obuah, yesterday in Port Harcourt, lauded Governor Nyesom Wike on the commencement of another phase of construction of roads and other developmental projects, and called on the people of the state to support PDP’s candidates with their votes on December 10. Ikanya, however, urged all right-thinking people of the state to ignore Wike’s deceptive and politically-motivated road projects’ kick-offs. According to the Rivers APC chairman, “Wike’s road construction kick-off, barely two weeks to December 10 rerun, is the height of grand deception. “The first test of the dishonesty of Wike’s road projects’ kick-off is that the Rivers governor never announced important elements of a road project, such as length or distance, costs and phases of the projects.

    The consequence is that no one will be able to hold him to account if the kick-off packs up a day after or ends after a kilometre. “The other bigger issue is that not even the Rivers Commissioner for Works, Mr. Bathuel Iheanyichukwu, knows the actual costs of the road projects and when they are expected to be completed. “The solemn truth is that the Rivers governor simply embarks on his kick-off journey to nowhere, just to deceive the people, especially as rerun elections draw near.” Ikanya also admonished members of the main opposition party and the teeming supporters of the APC to continue to mobilise members of their families and people of Rivers communities, while expressing optimism that the better candidates of the party would emerge victorious during the December 10 rerun.

    But the PDP chairman expressed satisfaction on Wike’s commitment to delivering dividends of democracy to the people of Rivers state, while lauding his administration’s various development initiatives, which he claimed had entered another phase, aimed at putting the state on the fast lane of development. He noted that since inception, the Wike-led government had not ceased on its drive to put smiles on the faces of all the people of the state, which he said had given new look to Rivers infrastructure, starting with total revamping of moribund public facilities.

    Obuah said: “The initial development projects of the Wike led-government touched all sectors of the economy and public life in the state, including education, sports, security, electricity, water supply, tourism, housing, health, payment of salaries of public servants as and when due, youths empowerment, restoration of the dignity of the judiciary, as well as respect for the rule of law, harmonious relationship between all arms of government and return of peace to the state, resulting in the influx of investors and international business entrepreneurs into the state. “The phase two of Wike’s development projects is focusing more on giving new lease of life to the people in the rural communities.

    It is a step taken in line with the philosophy of the PDP, which believes in giving back to the people what belongs to them. “The kick-off of the construction of many gigantic projects in most LGAs of Rivers State and rural communities outside Port Harcourt, the capital city, including the completion of the abandoned Ogoni–Andoni– Opobo/Nkoro Unity road, construction of Olakwor- Afara-Nihi road, rehabilitation of Okrika internal road in Okochiri, Okrika LGA, reconstruction of the Igbo- Etche road and construction of Chokocho- Umuechem-Ozuzu road are steps in the right direction.”

  • Rivers PDP, APC leaders disagree on December 10 rerun

    The leaders of the Peoples Democratic Party (PDP) and the All Progressives Congress (APC) in Rivers State have disagreed on the December 10 fixed by the Independent National Electoral Commission (INEC) to conclude the legislative rerun.

    The state governor, Nyesom Wike, of the PDP, was not convinced that INEC would conduct the elections on December 10, stressing that insecurity would again be cited as reason to further postpone the rerun, despite the Senate’s directive to the electoral commission that the polls must be held on or before December 10 or plenary would be suspended indefinitely.

    Wike, while speaking yesterday in Port Harcourt, noted that the fact that the new date was announced less than 24 hours after the Senate’s ultimatum was an indication that INEC had been lying to the people that insecurity was behind the repeated postponement of the elections.

     He alleged that INEC and its anti-democratic elements would adduce reasons why the election might not be conducted, on the same premise of security consideration.

     The rerun will hold in eight of Rivers 23 local government areas, spread across the three senatorial districts of the state, where elections were suspended by INEC on March 19, 2016. The polls could not be held on July 30 and in October, earlier fixed by the electoral commission, in view of insecurity and the July 22 burning of INEC office in Bori-Ogoni, the headquarters of Khana LGA of the state.

    The governorship candidate of the APC in the 2015 general election in Rivers state, Dr. Dakuku Peterside, however, welcomed the directive of the Senate to INEC to conduct the legislative rerun in the state not later than December 10.

    Peterside noted that the APC in Rivers was ready for the elections and would use the opportunity to prove that the party would win any election in a free and fair atmosphere, devoid of threats, killing and intimidation.

    He called on INEC to ensure that it made necessary arrangements for the rerun and to put in place measures that would make it difficult for electoral thugs to cause violence and intimidate the voters.

    Peterside, the Director-General of the Nigerian Maritime Administration and Safety Agency (NIMASA), also tasked Wike to stop intimidating INEC officials and ad hoc staff with death threats, but to rather cooperate with the commission and its officials to ensure successful poll.

    He said: “Threats to the electorate by a governor is demeaning of the office and smacks of the height of uncouthness and you can be sure that the people will resist him.”

    The APC chieftain also gave an assurance that his party would win all outstanding elections in the state, insisting that APC was on the ground in Rivers state and had credible candidates that had been tested and proven.

    Peterside, a former member of the House of Representatives, also called on the Senate to look into issues in the Rivers House of Assembly, where two members of the APC: Victoria Nyeche and Andrew Miller, had been refused inauguration into the state’s House of Assembly, despite winning their respective elections and issued certificates of return by INEC, while urging the members of the National Assembly to call Wike to order.

    The director-general of NIMASA pleaded with the Senate to compel the Rivers House of Assembly to inaugurate the members of APC, without further delay.

    The Rivers Chairman of the PDP, Chief Felix Obuah, also toed the line of the state’s governor, by not having confidence in INEC and its officials to conduct free, fair and credible rerun on December 10.

    APC Chairman in Rivers, Chief Davies Ikanya, however, expressed optimism that the good and more acceptable candidates of the party would emerge victorious during the elections, stressing that PDP members only knew how to win at the polls through rigging and violence.

    Gunmen kill 18 in Rivers PDP chairman’s home town

    A supremacy battle between rival cult groups has left no fewer than 18 persons killed in Omoku, headquarters of Ogba/Egbema/Ndoni local government area of Rivers state.

    It was gathered that the incident took place on Friday night in the densely-populated town, which hosts the Federal College of Education (Technical).

    Omoku is also the hometown of Rivers Chairman of the Peoples Democratic Party (PDP), Chief Felix Obuah.

    Sources said a cult group known as the Icelanders invaded the community around 11pm to carry out the killing and injure many others.

    Among those killed, according to eyewitnesses, were a couple and two brothers of the same parents.

    It was learnt that many of the deceased were beheaded with the killers allegedly making away with their corpses.

    Elder John Awo, who hails from the community, told one of our correspondents that the killers operated freely despite security presence and checking points mounted on major junctions in the area.

    He alleged cultists have taken some villages in the area in the last six months the past six months, pointing out four of his cousins were among the victims.

    Omoku town, which plays host to some multinational oil companies, has become desolate as residents have fled their homes for safety.

    The Rivers State Police Command confirmed the incident.

    It said six corpses of the suspected cultists have been recovered.

    The Rivers Police Public Relations Officer (PPRO), Muhammad Ahmad, a Deputy Superintendent of Police (DSP), stated that the situation was under control.

    Ahmad said: “The incident is reasonably believed to be battle of supremacy between rival cult groups in the town (Omoku).

    “As it is now, the situation is under control, as more anti-riot policemen have been drafted to reinforce the existing security in the town.

    “As for the casualties, six dead bodies of the suspected cultists were recovered.”

    The situation has further heightened violence in Rivers State.

    Last Thursday, a former member of the Rivers House of Assembly, Monday Eleanya, who represented Ogba/Egbema/Ndoni constituency on the platform of the PDP, was shot dead as he was driving out of his residence on Ada-George road in Port-Harcourt.

    Eleanya just recently defected to the All Progressives Congress (APC).

    Rivers Publicity Secretary of the APC, Chris Finebone, while reacting to the assassination of Eleanya, popularly called World Bank, insisted that it was part of the threats by PDP leaders to eliminate most leaders of the party ahead of the March 19 legislative reruns.

    3 Senatorial, 12 of 13 House of Representatives and 22 of 32 state’s House of Assembly seats are open for contest at the ordered reruns.

    Finebone said APC leaders and members in Rivers would never be cowed or intimidated.

    He urged security agencies to be alive to their responsibility of protecting lives and property.

    The Rivers State Peoples Democratic Party (PDP) and All Progressives Congress (APC) are trading words over Dr. Dakuku Peterside’s comments on the Supreme Court judgment affirming Governor Nyesom Wike’s election.

    PDP Chairman Felix Obuah said Peterside’s claim  that Wike had foreknowledge of the Supreme Court judgment affirming his election was “absolutely false and misleading”. He berated Peterside for his comment on former Governor Peter Odili and his wife, Justice Mary Odili.

    APC’s Publicity Secretary Chris Finebone said Obuah lacked the moral fibre to raise his voice against Dr. Peterside.

    Obuah, who spoke yesterday in Port Harcourt, the Rivers State capital, said Sir Peter Odili and his wife, a Justice of the Supreme Court, had nothing to do with Wike’s victory.

    He said: “Dr. Peter Odili and his wife, Justice Odili are worthy citizens of Rivers State, who deserve the respect and regard of Rivers people, having worked tirelessly to etch their names on the marble.  The generality of Rivers people owed the couple a duty to protect and guide their name jealously.

    “The people of the state remain eternally grateful to the Supreme Court for foreclosing Dakuku’s ambition to continue to cause crisis in Rivers State. The judgment of the apex court was indeed an act of God.”

    Finebone said Peterside and Rivers people would only take notice of Obuah and what he had to say after he addressed the allegations against him.

    The Rivers APC chairman, through his Senior Special Assistant (SSA) on Media and Public Affairs, Chief Eze Chukwuemeka Eze, said Peterside never insulted the Odilis.

    Ikanya said: “Rivers PDP chairman is totally wrong. Dr. Dakuku Adol Peterside never insulted the Odilis. Obuah could not interpret correctly the statement by a credible doctoral degree holder and respected gentleman from Rivers State, who has proved himself as a better leader.

    “Dr Peterside only reacted to the insinuation by Wike that the Odilis were the forces behind his Supreme Court victory. Obuah, who is also the helmsman of the Rivers State Waste Management Agency, should try and busy himself with how to clean the dirty environment Wike’s administration has bestowed on Rivers State as a legacy.”

    The APC yesterday said the PDP was planning to scuttle the March 19 rerun, with a faceless group to be used to file a case in court.

    Finebone, in a statement, said: “We have confirmed that the intention of Governor Nyesom Wike is to employ an unknown group to scuttle the elections, to further create chaos in the polity.

    “The unnamed faceless group being activated by Governor Wike to embark on the exercise is expected to file a suit asking the court to declare as illegal, the March 19 elections, claiming that the date was outside the mandatory 60 days pronounced by the Courts of Appeal.

    “The APC condemns this wanton act of political misbehaviour by the governor. The party believes that the ripple effects of his planned action may become his waterloo, despite the gains he may be envisaging.”

    The state PDP’s Publicity Secretary, Samuel Nwanosike, could not be reached, while the Special Assistant to Wike on  Electronic Media, Simeon Nwakaudu, did not respond to calls or messages.

    The election petitions tribunals and Courts of Appeal ordered rerun in the three Senatorial, 12 of 13 House of Representatives and 22 of 32 House of Assembly seats.

    The elections, initially fixed for February 6,  were shifted to March 19.

    A chieftain of the All Progressives Congress (APC) in Rivers State, Emma Chindah, has dismissed the “planned reception” for the party’s defectors by the state Chairman of the Peoples Democratic Party (PDP), Chief Felix Obuah, as propaganda and deceit.

    He noted that despite the unfavourable January 27 judgment of the Supreme Court, no Rivers APC member had defected to the PDP.

    The party stalwart insisted that many PDP members were instead eager to join the APC.

    Chindah, who is also a former Commissioner for Agriculture, spoke yesterday in Port Harcourt, the state capital.

    The APC chieftain urged the peace-loving residents to discountenance Obuah’s claim and wait for God’s judgment on the governorship election in which he said over 100 innocent persons were killed and several others were injured or maimed.

    Chindah assured that APC leaders and members were prepared for the February 6 rerun polls involving three senatorial, 12 of 13 House of Representatives and 22 of 32 House of Assembly seats.

    The APC chieftain expressed optimism that the party’s candidates would win the rerun.

    Obuah, through his Special Adviser on Media and Publicity, Jerry Needam, claimed that he planned to receive some prominent leaders and members of the APC from the 23 local government areas of the state.

    He claimed that the defectors were reacting to Governor Nyesom Wike’s olive branch to all politicians to join his administration, following his victory at the Supreme Court.

    Obuah said PDP’s umbrella was large enough to accommodate everyone, including defectors from the party on the eve of the apex court’s verdict.

    But Chindah said PDP’s promises to APC’s supposed defectors were mere propaganda that should be discountenanced.

    Rivers PDP, APC prepare for fresh battle

    Following the nullification of the April 11 governorship election in Rivers State, the candidates have returned to the drawing board. BISI OLANIYI writes on the battle ahead between the All Progressives Congress (APC) and the Peoples Democratic Party (PDP) in the Southsouth state.

    The prelude to the governorship battle in Rivers State was the frosty relationship between the former Governor Rotimi Amaechi of the All progressives Congress (APC) and his former Chief of Staff, Nyesom Wike, a chieftain of the Peoples Democratic Party (PDP).

    Amaechi and Wike are Ikwerre. The people spread across (Obio/Akpor, Port Harcourt City, Ikwerre and Emohua) local government areas.

    The former Rivers governor hails from Ubima, while Wike is an indigene of Rumueprikom. Both are the Rivers East Senatorial District..

    Ahead of the general elections, Amaechi declared that, to ensure justice, equity and fairness in the multi-ethnic state, his successor should come from outside Ikwerreland or another senatorial district, having been governor for eight years and Speaker of the House of Assembly for eight years (1999-2007).

    Wike, a former Minister of State for Education, however, insisted that it was his constitutional right to contest in the PDP, thereby drawing the battle line.

    Former member of the House of Representatives, Dr. Dakuku Peterside, emerged as the standard bearer of the APC. During the campaigns members of the APC were either killed or injured.

    The governorship election on April 11, 2015 was like a war, making the international observers, who monitored the poll, to describe it as a sham, in view of the massive rigging, violence, intimidation of voters and multiple thumb-printing.

    The candidate of the PDP was declared the winner by the Independent National Electoral Commission (INEC), in spite of the fact that many eligible voters could not exercise their franchise.

    Wike and the Chairman of the PDP, Chief Felix Obuah, maintained that the election was free, fair, credible and peaceful..

    The Rivers APC and Peterside decided to file petition at the tribunal against the PDP, its governorship candidate and the INEC.

    To ensure the safety of the judges, lawyers, litigants and others, the venue was moved from Port Harcourt, the Rivers state capital, to Abuja.

    After some months of fireworks by counsel to the petitioners and respondents, written addresses were adopted  on October 22, with the date to deliver judgment not indicated, in view of the indefinite adjournment, with a promise to later get across to various counsel.

    The tribunal eventually delivered judgment on October 24, nullifying the election over irregularities and non-compliance with the Electoral Act, thereby ordering fresh election within 90 days.

    It was celebration galore for APC members and Peterside’s supporters in Abuja, Port Harcourt and other parts of Rivers state.

    Wike, however, declared that he would appeal the judgment and pursue the matter to the Supreme Court, describing the judgment as a gang-up against Rivers people.

    He said: “I am still the governor of Rivers State. Our lawyers are going on appeal. We are all going on appeal. There is also the Supreme Court.

    “They can say anything, but Rivers people’s interest must be protected. Nobody will intimidate me to abandon this state. If they like, let them summon the justices as they have been doing. But one day, God’s own pronouncement will come.”

    Amaechi attributed the verdict to the God’s wish.

    Amaechi revealed that with the sack of his successor (Wike) by the tribunal, he suddenly realised that there is God, stressing that he (Amaechi) was always reluctant to come to Port Harcourt, because he had no house to sleep.

    As the Rivers governor and his supporters were praising God on Stadium Road, Wike mobilised people from the state’s 23 LGAs to the Dr. Obi Wali International Convention Centre in Port Harcourt to pray.

    The ex-NGF chairman said: “If you thought we won (at tribunal) by our own strength, then you are not godly. You are not a Christian. Imagine the kind of money they (Wike and allies) were willing to pay. You can pay all the money you want to pay, if Christ says it is not your turn, it will not be your turn.

    “It is not yet time for celebration. Even if you win at the Supreme Court, it is not yet time for celebration. We did not even know that they fixed Saturday for judgment. Before, the other group (Wike’s) were not used to God, they were not going to church. Suddenly, they have realised that there is God. Our God is a merciful God.

    “If we ask God to show us His mercy, they can take billions of naira to anywhere they want to go, God will answer our prayers. When we were fighting to be governor in 2007, we did not have money. They had money and they were carrying it around and we won. This is not a new path. We had passed it before. As you praise God, you must also be practical. Go home and organise your wards, Continue to focus on APC’s activities.

    “It is those projects that I have done that they (Wike and allies) are driving on. This Stadium Road was dualised by my government. The drainage is underground. I never built gutter, until I left office. They are now building gutter and covering it. Check the difference.”

    Amaechi also noted that he borrowed N300 billon, and paid N245 billion. He said Wike’s government was not borrowing to pay contractors, but borrowing for personal expenses.

    The former NGF chairman stated that Wike’s administration borrowed N45 billion, but not seen, noting that pumping N45 billion into the economy, Port Harcourt would be dancing, contractors would be working, more workers would be employed, schools would open and people would pay fees.

    The Chairman of the APC, Chief Davies Ikanya, described the tribunal’s judgment as a victory for democracy, the rule of law and a vindication of the party’s stance that there was no election in Rivers. He said that no magic could sustain Wike’s appeal.

    Ikanya said party decided not to resort to self help, in view of their confidence in the judiciary as the last hope of the common man.

    Ikanya said: “We welcome the judgment of the tribunal. We have been vindicated in our persistent position that the election in Rivers State was a sham and that INEC erred in declaring Wike governor.

    “There is no way that Wike can beat our candidate, Dr. Dakuku Adol Peterside, in a free and fair election. Despite the malfeasance of a few, the Nigerian judiciary is still made up men and women of impeccable character, who cherish their good name, character and hallowed profession.

    “Wike prides in his ability and capacity to compromise any living member of the judiciary in Nigeria. He claims that everyone has a price, but we have also taken notice of his failed attempts to reach out to the incorruptible Chief Justice of Nigeria (CJN), which was a disaster, because the CJN is beyond Wike’s compromising influence.

    “For us in the APC, we will continue to believe and trust in the transparency and forthrightness of the members of the Nigerian judiciary. We believe that the antics and machinations of a few persons, such as Nyesom Wike, are not enough to tarnish the impeccable records of our distinguished men and women of the bench in Nigeria.”

    Peterside described the tribunal’s verdict as victory, not just for democracy, but also for justice and the rule of law.

    He said: “This judgment is resounding, because at last, we are vindicated. The journey, no doubt was tortuous, but the suffering was worthwhile. It also shows that perseverance pays. This judgment no doubt also shows that we must continue to have faith in our judiciary as the last hope of the common man.

    “Under the last administration, our people suffered all forms of indignities, because of their political leaning. Democracy is essentially about freedom and we must never, under any circumstance, lose our freedom again.

    “This verdict has put a nail on the coffin of electoral rascality, electoral violence, election fraud and impunity. It has restored the faith of the resilient people of Rivers State in the electoral process as a fair means of choosing leaders. I particularly thank the people of Rivers State for their resilience throughout this period.

    “Let us all join hands with the Muhammadu Buhari-led government as it tackles impunity, incompetence, unemployment and all the vices that remind us of the sorry story of our recent history. Surely, Rivers State is on the march again and we must all lend our support”

    Peterside also congratulated the people for standing up to impunity, executive rascality and intimidation of the highest order.

    He said while Rivers people would be looking forward to a fair contest, they should be calm and to continue to pray for the state.

    The Director-General of Peterside’s Greater Together Campaign Organisation, Chief Victor Tombari Giadom, declared that the rascality of the members of the PDP would no longer be condoned.

    Giadom said the judgment confirmed that God is supreme. He thanked the judges for the fearless judgment and lauded Rivers people for their continuous support, assuring that Peterside, upon becoming governor, would deliver real dividends of democracy to them.

    The Rivers governorship candidate of the Labour Party (LP), during the April 11, 2015 election, Prince Tonye Princewill, declared that there was no need to appeal the tribunal’s judgment.

    Princewill said: “Even as it (tribunal’s judgment) might have come as a surprise to many neutral observers, it was no surprise to me, my supporters and many Rivers people, who came out on that fateful day to try and cast their votes.

    “Even PDP supporters, I am sure in their hearts, knew that the day would come. Like I said to my supporters on that election day that justice would prevail and the truth would come out. If the APC legal team could not prove that there was no election in Rivers State (on April 11, 2015), nobody could. It was that obvious.

    “I will like to thank all the judges (of the tribunal) for upholding the law, the parties for conducting their briefs with civility and the people of Rivers State for surviving this period. If I was the PDP, I would not even bother to appeal this judgment. I would rather head for the court of public opinion. Ultimately that is where this matter will end. Why delay?”

    The LP’s governorship candidate also expressed optimism that the electorate’s votes would count during the fresh election, adding: “Do unto others, as you wish they do unto you. What goes around does come around,” while admonishing his supporters not to take the law into their own hands, but to remain calm and be peaceful..

    The Rivers chairman of the PDP, however, condemned the tribunal’s judgment, claiming that it was “compromised,” describing it as a travesty of justice and a rape on democracy.

    Obuah said: “No matter the degree of conspiracy by the APC-led Federal Government, the falsehood and gang-up against Rivers people will amount to a nullity, at the end.

    “I urge Rivers people not to panic over the pre-empted judgment, which had been decided long before the written addresses by the parties were adopted Thursday, October 22, 2015. Section 143, Sub-Section 1 of the Electoral Act 2010 guarantees an elected governor to stay in office and continue to execute his duties, as long as a notice of appeal is given against the judgment within 21 days, from the date of the judgment.

    “This is one tribunal judgment that will never stand. PDP will get to any legal height possible to fight the injustice. There is no other reason why the tribunal hurriedly delivered the contraption it called judgment, in less than 24 hours after adopting the written addresses on a matter that lasted over four months, than to pre-empt the judgment of the Supreme Court against the tribunal by the PDP, which comes up on October 27..

    “The good thing is that by the hurried judgment, the tribunal chairman has exposed his partiality and shot himself in the leg by defying all legal procedures and going ahead to deliver judgment on the APC’s petition, when there is an impending matter hinging on the appeal at the Supreme Court, just as he refused to vacate his seat as chairman of the election petitions tribunal for the state governorship election petitions, despite PDP’s resentment on questions of integrity and impartiality. In the end, we shall have the last laugh.”

    Obuah also insisted that the tribunal’s judgment was compromised, but urged the PDP members to remain calm.

    APC’s candidate for the Rivers Southeast Senatorial District, Magnus Ngei Abe, however, described the nullification of the Rivers governorship election at the tribunal as a justification for the struggle of the members of the party in the state and vindication for justice.

    Abe said: “We have always maintained our confidence that there are judges in Nigeria, who will deliver justice to Rivers people.

    “All well-meaning Rivers people, especially the supporters of the APC, must be steadfast that victory is sure. They will have the opportunity to exercise their franchise, which was earlier denied them.”

    The former Secretary to the Rivers State Government (Abe) also stated that the truth had come to limelight that indeed no election took place in Rivers State, with Nigerians now in a better position to tell the world the whole truth.

    The senator lauded the leader of the APC in Rivers state (Amaechi) and Peterside on the success, stressing that change had come to stay in the state.

    The Rivers Commissioner of Police, Musa Kimo, also warned troublemakers who might want to capitalise on the nullification of the Rivers governorship election, to stay away from the state, with security already beefed up and policemen on alert.

    The police chief also maintained that he would not condone lawlessness and breakdown of law and order..

    Kimo said: “You are all aware of the situation in Rivers State, following the tribunal’s nullification of the April 11, 2015 governorship election in Rivers State. The police under my watch are not resting on our oars. We are poised. We are out on show of force, to ensure that lives and property of Rivers people are protected.

    “I have warned that everybody should be law abiding, to ensure that we have peace. So far, I want to commend the good people of Rivers State for being civil, calm, law abiding and for being peaceful.

    “For now, there is no reported case of any uncivilised and anti-social and unscrupulous behaviour, as a result of this nullification. So, I want to applaud, I want to commend the good people of Rivers State, for the good conduct. I urge them to continue to be law abiding, even as we are out on show of force.

     

     

     

     

    “I’ve directed all the Area Commanders, the Divisional Police Officers (DPOs) and the Squadron Commanders to be vigilant, on alert and ensure we checkmate any nauseating or excruciating activity by miscreant, but for now, everywhere is calm. We pray and hope that it continues. We are out. We are synergising with other security agencies to ensure there is peace and tranquillity now and beyond.”

     

    The tribunal judgment’s implications for Rivers state are numerous, including the fact that if the police and other security agencies do not regularly get involved in show of force, militants, cultists and thugs might let loose and unleash mayhem.

     

    Members of the two dominant political parties – APC and PDP – and their supporters, during the eventual fresh election will have the opportunity of exercising their franchise, but must now be preparing for campaigns and sensitising the electorate..

     

    There can only be development in an atmosphere of peace. Politicians and their supporters should not heat up the polity. The electorate must be allowed to vote and their votes must count, in order to sustain democracy and move the nation forward.

    The Rivers State Chapter of the Peoples Democratic Party (PDP) yesterday sought to calm its disillusioned supporters after the tribunal’s judgement that annulled the April election of Mr. Nyesom Wike as governor.

    It said that Mr. Wike remains governor for now.

    Reacting to what he called a travesty of justice and rape on democracy, the State PDP Chairman, Mr. Felix Obuah, said: “no matter the degree of conspiracy by the All Progressives Congress, APC-led federal government, the falsehood and gang-up against Rivers people will amount to a nullity in the end.”

    He urged the people of the state “not to panic over the pre-empted judgment which had been decided long before the written addresses by the parties were adopted Thursday, October 22, 2015.”

    He cited section 143, subsection 1 of the Electoral Act 2010 which guarantees an elected governor to stay in office and continue to execute his duties as the State Chief Executive as long as a notice of appeal is given against the judgment within 21 days from the date of the judgment notwithstanding the decision of the election tribunal.

    He said:  “this is one tribunal judgment that will never stand,” stressing that the PDP will go to any length to “fight the injustice.”

    “There is no other reason why the tribunal hurriedly delivered the contraption it called judgment in less than 24 hours after adopting the written addresses on a matter that lasted over four months than to pre-empt the judgment of the Supreme Court against the tribunal by the PDP which comes up next week Tuesday.”

    “Notwithstanding all this, in the end we shall have the last laugh.”

    Rivers State Governor Nyesom Wike and his party, the Peoples Democratic Party (PDP) failed yesterday to stall proceedings at the governorship election petition tribunal in Abuja.

    The tribunal, in two rulings, refused the proposal by Wike and his party that it stayed  proceedings in the petition by the All Progressives Congress (APC) and its candidate  Dakuku Peterside.

    Tribunal Chairman Justice Mohammed Ambrosa observed that against the request by Wike and PDP that the tribunal must first rule on their pending applications, the Court of Appeal,  last week, did not order a stay of proceedings, but ask the tribunal to accelerate hearing in the petition.

    Wike and the PDP had appealed three earlier decisions of the tribunal made on July 9, 29 and 31 that it would, while deciding the petition, resolve issues relating to the petition raised by the respondents.

    On Monday, the petitioners were expected call their witnesses, when respondents’ lawyers informed the tribunal that the Court of Appeal in Abuja delivered judgments last Saturday directing that the tribunal should deliver its rulings on the respondents’ motions pending before it before resuming the trial.

    But, when the respondents were unable to produce certified true copies of the judgments and enrolled orders of the judgments, the tribunal adjourned to yesterday and requested that the CTC of the appellate court’s judgments be filed before the tribunal on Tuesday to enable it determine what next step to take.

    Yesterday, although petitioners’ lawyer, Akin Olujinmi (SAN) said he was yet to obtain copies of the judgments and enrolled orders, the tribunal confirmed that it was in receipt of the enrolled orders, which Justice Ambrosa later read,

    The appeal against the tribunal’s ruling of July 9 partially succeeded, following which the Court of Appeal set aside the ruling and ordered the tribunal to hear the application leading to this appeal. It also ordered the tribunal to accord the case accelerated hearing.

    The appeal against the ruling of succeeds in part, to the effect that the tribunal was ordered “to resolve the issue of the locus standi of the petitioners and the issue of service of the originating processes raised by the appellants, but which were not decided.”

    On the appeal against the tribunal’s ruling of July 31, the Court of Appeal  set aside the ruling to the effect that “the decision of the tribunal that the motion filed by the appellant on July 1st and argued, will be heard along with the petition is hereby set aside.

    “The tribunal is hereby ordered to consider the arguments already proffered for and against and deliver a ruling.”

    After reading the ruling, Justice Ambrosa said “it is our view that the orders (of the Court of Appeal) are clear and unambiguous. We shall comply with them promptly. With respect to the last order, we shall accord the matter accelerated hearing. That being the position of things, we hereby call on the petitioners to continue with their case.”

    Olujinmi was about to call his witness as ordered by the tribunal when lawyer to the PDP, Adedayo Adedipe (SAN) sprang up and demanded that the tribunal first comply with the ruling of the Court of Appeal before proceeding with the trial.

    “The tribunal ought to determine the applications that the Court of Appeal ordered it to determine first before continuing with the trial,” Adedipe said.

    He argued that the non-resolution of the pending issues will amount to reinstating the status quo of the order granted, which resulted in the appeal. He said proceeding with trial will render the order of the Court of Appeal nugatory.

    Wike’s lawyer, Emmanuel Ukala  (SAN) argued in similar vein, arguing that with the orders of the Court of Appeal, proceeding with the calling of witnesses will not amount to complying with the appellate court’s orders.

    “I am equally wondering that orders relating to the hearing of the motion on the determination of the issue of locus standi and the competence of the originating processes, is also being put at serious risk of being breached,” Ukala said.

    Responding, Olujinmi urged the court to ignore Adedipe and Ukala and proceed with the trial, He said should any of them feel uncomfortable with the tribunal’s decision,  he has the option of appealing.

    Ruling, Justice Ambrosa said the tribunal, having elected to proceed with trial, will not reverse itself. He noted that the case, being an election matter, time was of the essence and the tribunal could not afford to waste time.

    The petitioners later called some witnesses, among whom, was Clinton Ochonma, who acted as Ward Collation agent for the APC during the election. All the witnesses were unanimous that the election was marred by irregularities.

    Trial in the case resumes today.

    The All Progressives Congress (APC) has described as deceitful the petition to President Muhammadu Buhari by the 16 Peoples Democratic Party (PDP) lawmakers from Rivers State on the Governorship Election Petition Tribunal, saying those obstructing  justice are trying to play the victim.

    In a statement in Abuja yesterday by its National Publicity Secretary, Alhaji Lai Mohammed, the party said despite the tribunal’s order, the Rivers PDP and the  INEC colluded to ensure that the Rivers APC neither gets the certified true copies of requested documents nor inspect materials used for the election.

    ‘’Because we are a law-abiding party, unlike the PDP and their INEC collaborators, we reported this to the tribunal, which said it was not up to it to enforce its earlier order. This was why we reported to the security agencies, especially the Police and the Department of State Services (DSS).

    ‘’Although the inspector general of Police intervened to ensure the tribunal’s order  was carried out, the Rivers INEC still refused. This was why the DSS, seeking to prevent a breakdown of law and order resulting from the intransigence of the Rivers INEC, prevailed upon them to carry out the tribunal’s order. Despite these efforts, the order has still not been complied with,’’ it said.

    APC also denied that the military was being used to intimidate anyone, saying the party only subpoenaed the soldiers, who played a major role in the elections not only in Rivers but in the Niger Delta, in view of the violence unleashed by the PDP on APC supporters before, during and after the elections.

    ‘’Nigerians can now see there is no truth in the petition by the Rivers PDP federal lawmakers that the DSS and the military were being used to obstruct justice. What the petitioners are seeking to do is to pull the wool over the eyes of Nigerians,’’ the party said.

    It said it was not a secret that the PDP allegedly rigged the elections not only in Rivers but also in Akwa Ibom, where the party and the state INEC had also refused to allow the APC access to electoral materials, and where indeed vital documents were allegedly destroyed.

    ‘’Knowing full well that they allegedly cooked up the figures, and that their figures cannot stand serious scrutiny, the Rivers PDP has resorted to using all tricks in the books to delay the proceedings at the tribunal, hoping that by so doing, the statutory 180 days we have to prove our case will expire.

    ‘’It was for the same reason that they (Rivers PDP and INEC) tried to goad us to file contempt charges against them for refusing to obey the tribunal’s order. They had hoped that by filing such charges, valuable time would have been wasted,’’ APC said.

    The party urged the 16 PDP lawmakers to tell their people to stop obstructing justice by allowing the Rivers APC access to election materials, instead of writing frivolous petitions and blaming the victims for their lawlessness.

    ‘’The PDP has always been a lawless party. This is why they think others are like them. In pursuing our petition at the tribunal, we do not seek any favour beyond what the law prescribes. But we will not fold our arms and allow anyone to bury us under the ruble of injustice. We will use all constitutional and legal means to ensure that justice prevails,’’ it warned.

    The Southsouth Screening Committee for Peoples Democratic Party (PDP) governorship aspirants in Rivers State may have disqualified 13 of them, it was learnt yesterday.

    Though no reason has been given for the action, but the aspirants were declared ineligible on the allegation that they are not members of the party.

    It was also observed that all the aspirants who attended the screening are from the Kalabari, Andoni and  Ogoni axis.

    The Ambassador Obed Wadzani-led screening committee sat for three days at the party’s zonal headquarters, on Circular Road, Port Harcourt. Those that were asked to go home are Chief Bekinbo Dagogo-Jack; Nimi Walson Jack; Prince Tonye Princewill and Chief Dumo Lulu-Briggs.

    Others are Prof. Dom Baridom; Major Lancelot Ayanya; Gabriel Pidomsom; Oseleye Dennis- Ojuka; Tamunosisi  Gogo-Jaja; Sampson Ngerebara and Mrs. Abietedogho Bob-Hart including Henry Odien Ajumogobia, a Senior Advocate of Nigeria and former Minister of State for Foreign Affairs.

    Pawariso Samuel Horsfall; Capt. Sunday Nwankwo; Nyesom Wike; Bernard Mikko and Ibinabo Michael-West were said to have been given the nod to contest.

    Horsfall, Sunday and Mikko were among the 16 aspirants who pushed vigorously that the party should adopt the principle of zoning as enshrined in Section 7 3 (c) of the PDP constitution.

    It was gathered that those disqualified flew to Abuja yesterday morning to submit their petitions to the party’s national headquarters.

    The Spokesman for the Rivers Mainstream Coalition, Prof. Israel Owate, condemned the disqualification, saying that it is strange that the screening committee could describe such prominent members of the PDP as not being recognised by the party, after being cleared to purchase the expression of intent forms and nominations worth millions of naira.

    Princewill, said: “This is sheer madness. I am not a PDP member after I raised hundreds of millions for the party, donated a multi-million media centre to the national headquarters and participated in all affairs of the party I was invited to?

    “I am not a member but you collected millions for a PDP form. If this decision is true, this marks a new low in our state’s politics. This is a sad day for internal democracy”.

    “My options now are to: appeal, quit politics altogether; stay in PDP even though they say I am not one of them, or to go to another party, not the All Progressives Congress (APC), and run?”

    Most of the disqualified aspirants were said to have submitted their appeals.

    Meanwhile, 87 of the 92 governorship aspirants in four of the Southsouth states, have been screened, it was revealed yesterday.

    The Admiministrative Secretary of the PDP in the zone, Usen Edemeka said many of the aspirants, with a large number from Rivers State, were disqualified for not being active or card-carrying members.

    Edemeka, told reporters in an interactive session at the zonal secretariat of the PDP, off the Port Harcourt-Aba Expressway, stated that the disqualified aspirants still had the opportunity of appealing the decision before the members of the National Appeal Panel in Abuja today (Wednesday), as loyal members.

    He said the aspirants, who were screened, came from Delta, Rivers, Akwa Ibom and Cross River states, excluding Edo and Bayelsa states, where elections would not hold in 2015, in view of court judgments.

    Edemeka said: “Many of the governorship aspirants from Rivers, Delta, Akwa Ibom and Cross River states have been disqualified by the screening panel, for either not being active or not being card-carrying members of the PDP. A large number of the disqualified  governorship aspirants are from Rivers State, but all of them still have the opportunity tomorrow (today) to appear in Abuja, before the members of the National Appeal Panel.”

    Edemeka admonished the disqualified aspirants not to resort to self help, but to re-present their cases before the appeal panel, thereby showing total loyalty to the PDP, stressing that doing otherwise might attract sanctions.
