  • Melaye safe in custody – Police

    The spokesman of the Nigeria Police Force, Assistant Commissioner of Police (ACP) Jimoh Moshood has said that Senator Dino Melaye is safe in police custody.

    The police image maker made this known when contacted to confirm the re-arrest of the senator after being arraigned at a magistrate court in Abuja on Wednesday.

    He explained that Melaye was arraigned on charges bordering on escape from lawful custody and attempted suicide, for which he was granted bail.

    He however said that the senator is still in police custody over allegations of conspiracy, gun-running, armed robbery and kidnapping, which is before a High Court in Lokoja, Kogi state.

    He added that suggestions that the senator’s life is in danger was untrue, because he is in lawful custody.

    This, he said is known to the public, that and all lawful procedures would be adhered to while he remains in lawful custody.

  • Melaye recall process to begin Saturday in 560 polling units

    More trouble appears to be in the offing for the embattled member representing Kogi West at the National Assembly, Senator Dino Melaye, as the Independent National Electoral Commission (INEC), Wednesday in Lokoja, announced that it will conduct the signature verification exercise for his recall in seven local councils on Saturday.

    Addressing media in Lokoja, during the “Stakeholders Meeting on the Process of the Recall (Verification) of the Senator Representing Kogi West Senatorial District, Kogi State”, the INEC National Commissioner Supervising Kogi, Kwara and Nassarawa states, Mohammed Haruna, assured that the electoral body has no interest in the process, other than to ensure that the process is followed through as spelt out by the law.

    “INEC has absolutely no interest in who wins or loses”, he explained.

    He urged all concerned to adhere strictly with the laid down process as spelt out by the laws guiding the process.

    Highlighting the process so far undertaken, the Kogi State Resident Electoral Commissioner (REC), Prof. James Apam, explained that more than 50 percent of the constituents of the senatorial district, “plus at least one person”, must affirm that their signature or thumbprint must be verified by INEC national n the 560 polling units in the Kogi West Senatorial district.

    According to him, the process will be undertaken across the 560 wards of Kogi West, between 8am and 2pm on Saturday.

    He said that the Card Reader Machine will be employed for the exercise, adding that those who did not append the recall petition in the first instance, cannot partake, while polling units where malfunction is experienced, will be cancelled and/or redone, if the number involved will substantially affect the outcome.

    “All I want to tell you is that we are ready to commence on April 28, from 8am-2pm, in the seven LGAs of the senatorial district. What we are doing is in compliance with what the law says”, he explained.

    He added that applications from local observers will be entertained in Lokoja, the state capital, till Friday, April 27, 2018.

    Outcome of the signature verification exercise is expected to be made public on the following day (Sunday, April 29, 2018).

  • Melaye: Senate summons IGP

    The Senate on Wednesday summoned the Inspector General of Police (IGP) Ibrahim Idris over what transpired Tuesday with Senator Dino Melaye.

    The Senate also suspend sitting on Wednesday to visit Melaye who is presently in the hospital.

    Senators were furious over what they described as alleged inhuman treatment meted on Melaye.

  • Melaye set to surrender to Police

    Senator Dino Melaye has announced his resolve to surrender to the Police Tuesday.

    Melaye who represents Kogi West senatorial district in the National Assembly made the announcement via his Twitter handle around 7:11am on Tuesday.

    The post reads: “I will make myself available to the police today. My resolve to speak the truth and defend the poor masses of NIGERIA is Total. We shall overcome!!!

    It is however unclear whether the Senator would surrender himself to the Kogi State Police Command in Lokoja or the Force Headquarters in Abuja.

    The police had laid siege to his residence in Abuja on Monday after he was stopped from travelling to Morroco by personnel of the Nigeria Immigration Service.

    His tweet was later followed by another one which was posted around 8:04am.

    It reads: “A man without arm, no security yet you mobilise 150 policemen to invite him. And those who committed Treason are free. We shall not be intimidated or cowed. Struggle continue.”

  • Over 30 armed policemen stormed my residence – Melaye

    Over 30 armed mobile police men are reported to have stormed the Abuja resident of Senator Dino Melaye on Monday.

    The Senator who revealed this via his twitter handle@dino_melaye also said that all roads leading to his house in Maitama has been condoned off by the policemen. “Over 30 heavily armed fierce looking mobile police men have just stormed my residence in Maitama, Abuja. All roads leading to the house has been condoned off, as heavy mobile police men blocked entry and exit of the road. They currently laid siege on in and around the house,” he said.

    It would be recalled that Senator Melaye was on Monday morning arrested at the Abuja International Airport on his way out of the country.

  • Recall process: Dino Melaye heads for Supreme Court

    …Seeks voiding of Appeal Court’s judgment affirming INEC’s power on recall

     

     

    Senator Dino Melaye (All Progressives Congress – Kogi West) has lodged an appeal at the Supreme Court against the March 16, 2018 judgment of the Court of Appeal, Abuja, which affirmed the power of the Independent National Electoral Commission (INEC) to conduct a referendum for the purpose of recalling a legislator unhindered.

    Melaye, in a notice of appeal dated April 3, 2018, filed by his lawyer, Mike Ozekhome (SAN), urged the Supreme Court to among others, set aside the Court of Appeal judgment, which upheld an earlier judgment by Justice Nnamdi Dimgba of the Federal High Court, Abuja.

    INEC had in July last year, on receiving a petition from some registered voters from Melaye’s constituency, requesting his recall on grounds of non-performance, wrote to notify him about the petition and further steps it intended to take.

    On learning about the petition, Melaye filed fundamental rights enforcement suit before the Federal High Court, Abuja, accusing INEC of not affording him fair hearing by not serving him with a copy of the petition to enable him respond.

    Before the suit could be heard, Justice John Tsoho (also of the Federal High Court, Abuja) entertained an ex-parte application from Melaye, and granted it, restraining INEC from taking any further steps in relation to the petition.

    Justice Dimgba, who later heard the substantive suit, dismissed it for being unmeritorious. The judge, in his judgment, held that Melaye’s suit was “hasty, premature and presumptuous.”

    Melaye appealed to the Court of Appeal, which, in a unanimous judgment of a three-man panel on March 16, 2018, dismissed the appeal for lacking in merit.

    Justice Tunde Awotoye, who read the Court of Appeal’s lead judgment, upheld the decision of the Federal High Court and said the trial court ought not to have wasted time hearing Melaye’s suit, but should have struck it out for not disclosing any cause of action.

    Justice Awotoye said: “Such statutory bodies like the INEC should be allowed to exercise their statutory powers without interference by the court. The appellant cannot claim that his right of fair hearing was infringed upon. His right to fair hearing has not been violated since INEC, as a statutory body, is not a tribunal neither is it a court of law.

    “The appellant has not disclosed any cause of action and the suit ought to have been struck out by the trial court for not disclosing any cause of action. I agree with the decision of the trial court.

    “Ordinary, it ought to have struck out the suit for non-disclosure of cause of action. This is because where there is no cause of action, the court has no jurisdiction to hear the suit.  Having resolved all the issues in the appeal against the appellant, I hereby struck out the suit and dismiss the appeal,” Justice Awotoye said,

    It is this decision of the Court of Appeal that Melaye now seeks to challenge at the Supreme Court with his notice of appeal of seven grounds.

    As against the finding by the Court of Appeal that INEC was still within time to conduct Melaye’s recall process, the Senator wants the Supreme Court to hold otherwise.

    Melaye wants the Supreme Court to, among others, declare that the statutory 90-day period for INEC to conduct a recall process, provide in Section 69(b) of the Constitution, having elapsed by effluxion of time on September 23, 2017, INEC can no longer validly proceed on the basis of the petition for his recall, presented on June 23, 2017.

    He equally wants an order of perpetual injunction, restraining INEC from commencing or further proceeding with the process of acting on the petition presented to it by his supposed ‎constituents.

    Addressing newsmen Wednesday in Lokoja, the Commissioner of Police, Mr.  Ali Janga confirmed that Melaye have been declared wanted.

    Kogi State Governor, Yahaya Bello on Thursday reacted to a video of Senator Dino Melaye, representing Kogi West, saying he has been roundly defeated and cannot do anything.

    Dino Melaye. in the recently released video on Instagram was seen singing, dancing and mocking the governor.

    Speaking with State House correspondents on the sidelines of the expended National Economic Council meeting at the Presidential Villa, Abuja, Bello claimed that he had not seen the video as he was too busy to listen to a noise maker.

    Bello said, “I don’t know there is any such video from anybody, I am not aware. Maybe, you may tell me what the video is all about, I am not aware if there is any such video.

    “You see Kogi state is a very complex state and I took it over when things were really bad and I am doing my best to ensure that we give quality service to the good people of Kogi state.

    “So any noise maker out there is just disturbing himself. So I just focused on the job as the executive governor of Kogi state, and I am doing my best and the people of Kogi state really appreciate my services to them.” he stated

    On the recent attack in Kogi, he said, “It was a very pathetic situation where about 12 people were killed and I visited that place. It is a place that was neglected by their own people and it was unfortunate that that incident happened and we have constituted Judicial Panel of Inquiry to look into the immediate and remote cause of that attack because this is not the first time that an attack is happening in that particular area.

    “In 2014 it happened where lives and property were destroyed but thank God with the support of the military, police and other security agencies were able to quickly move into action and then that particular incident had been stopped.

    “As we speak arrests are being made and investigations are on and by the time the Judicial Panel of Inquiry comes up with its own findings and recommendations, l am sure there will be a lasting solution to that crisis.

    On People’s Democratic Party (PDP) allegation that the rescued Dapchi girls is an arrangement, Bello said, “I think Nigerians are happy with Mr.President for the good job that he is doing for being proactive and for the quick response by the military and other security agencies in rescuing our Dapchi girls, I think it is a good job that they have done and I really congratulate Mr. President, I congratulate the APC, I congratulate the government and good people of Yobe State, I congratulate the girls and their parents and I congratulate Nigerians.

    “By the grace of God such effort is being made to ensure that the remaining Chibok girls are brought back. You will recall that when Mr. President came, probably the APC might have arranged the kidnap of Chibok girls then. So I think those that are accusing APC or our government of arranging such a kidnap are insensitive to the parents, to the children and to Nigerians. We shouldn’t push politics to certain level. So we should congratulate ourselves and I am sure such incident will not repeat itself in the country.”

  • Melaye: Police allegations laughable, preposterous

    Senator Dino Melaye has described as preposterous and laughable, the allegations by the police that he hired two political thugs and armed them to cause mayhem in Kogi State.

    The police in Lokoja today said they have charged the senator with illegal possession of firearms in a case filed in a Lokoja court on 16 March.

    Charged along with the senator were another politician, Muhammed Audu , said to be on the run and two other ‘deadly’ persons linked with a spate of kidnapping and robbery.

    One of the two suspects was identified as a 31 year-old Kabiru Saidu, a.k.a Osama. T
    The other was Nuhu Salisu, who is 25 years-old.

    The duo were arrested in January. Police claimed they had confessed that they were also working as thugs for Senator Melaye.

    “Fabricated lies by Kogi State Govt and the police will fail. It’s utterly laughable and preposterous. It’s a sign of desperation”, the embattled Senator tweeted today.

    “No amount of lies and blackmail will detract my attention from speaking the truth and defending it”, he said.

    Melaye also claimed that the withdrawal of police from VIPs, announced by the Inspector General of Police, Ibrahim Idris, was targeted at him.

    “I am the target. IG wants to expose me so I can be killed. Having survived assassination attempt twice, I deserve police protection in a country where I’m a tax payer”, he wrote.

    At a press conference in Lokoja today, the police spokesman Jimoh Moshood, said the police seized from the thugs and their gang members , two AK47 rifles, five pump action guns, two locally made pistols and heaps of charms.

    According to the police, the men not only confessed to have been involved in several kidnappings in the state and environs, they also claimed to be hired thugs for politicians.

    “According to the gang leader, Osama, he has been working as a political thug for one Alhaji Mohammed Audu a Politician in the State.

    ” He said Alhaji Mohammed Audu invited him to Abuja and introduced him to Senator Dino Melaye and they met on Airport road, Abuja inside the Senator Dino Melaye’s Car in the month of December, 2017.

    “The suspect further confessed that Sen. Dino Melaye told him that they should start working for the Senator as his political thugs and they should recruit and train more other(sic) thugs to work for him in preparation toward 2019 General election to enable him ( Sen. Dino Melaye ) challenge his political opponents and disorganised Kogi State.

    The police said Osama further confessed that Melaye handed over a bag containing one AK47 rifle, two Pump Action guns and the N430,000.00 to share with his boys.

    “Consequent on the indictments and criminal confessions against Senator Dino Melaye by the principal suspect KABIRU SAIDU a.k.a OSAMA “31 YRS”, Nigeria Police Force, wrote a letter dated 2nd of March, 2018 addressed to the Senate President, Federal Republic of Nigeria informing and requesting him to release Senator Dino Melaye to report to Commissioner of Police, Kogi State Command on the 7th March, 2018 to answer to criminal offences levelled against him, to enable the Police carry out a discreet investigation into the confessions of the principal suspect against Senator Dino Melaye. But Senator Dino Melaye have refused to honour the Police invitation till date.

    “A case of Criminal Conspiracy and unlawful possession of prohibited firearms have therefore been filed by the Nigeria Police Force at Federal High Court Lokoja on 16th March, 2018 against the two suspects mentioned above, Senator Dino Melaye and Alh. Mohammed Audu who is also a suspect in the matter and is now on the run.

  • Melaye, three others charged with illegal possession of firearms

    Senator Dino Melaye who is challenging moves to recall him by his constituency is in fresh trouble: the Police said they have filed a case in a Lokoja court accusing him and three other persons of illegal possession of firearms.

    Police spokesman Jimoh Moshood, announced the move today in a statement.

    The police took the action, following the confession of two ‘dreaded’ thugs who claimed they were working for Melaye, who represents Kogi West in the Senate.

    The men were arrested on 19 January at Ogojueje in Dekina Local Government Area of Kogi State, after a shootout with the police and have confessed being hired by Melaye, to cause mayhem in the state, Moshood said.

    One of the persons arrested was identified as 31 years-old Kabiru Saidu, a.k.a Osama. The other was Nuhu Salisu, who is 25 years-old. The third person charged to court was identified as Alhaji Muhammed Audu, a politician, who is now said to be at large.

    The police said they seized from the thugs and their gang members, two AK47 rifles, five pump action guns, two locally made pistols and heaps of charms.
