    Court adjourns Dasuki ‘s case till March 22

    An FCT High Court, on Wednesday adjourned until March 22, continuation of hearing in the case involving former National Security Adviser, retired Col Sambo Dasuki, pending outcome of judgment of the Supreme Court on his appeal.

    The judge, Justice Hussein Baba-Yusuf, adjourned the case after Dasuki’s counsel Mr Adeola Adedipe, holding the brief of Mr Joesph Daudu (SAN) applied for adjournment.

    Adedipe informed the court that Dasuki’s  matter is pending at the apex court and the outcome of the judgment on March 2, may affect the case pending in the trial court.

    He also expressed surprise that Dasuki was not in court.

    Responding, Mr Henry Ajiga, holding the brief of Mr Rotimi Jacobs (SAN), who did not oppose the application, prayed the court to adjourn it to the same day with a sister case.

    He also expressed surprise on Dasuki ‘s absence, adding that the date for hearing was transmitted to the agency holding him.

    Dasuki is standing trial on a 19-count charge bordering on alleged diversion of N13.6 billion.

    On trial along with Dasuki were Shuaibu Salisu, a former Director of Finance, Office of the National Security Adviser, and Aminu Baba-Kusa, a former NNPC Executive Director, and two others.

    Dasuki: Absence of judge stalls commencement of trial

    The absence of Justice Hussein Baba-Yusuf on Thursday stalled the trial of former National Security Adviser(NSA),retired Col. Sambo Dasuki in an FCT High Court Maitama .

    Dasuki, NSA to former President Goodluck Jonathan, was arraigned on a 22- count charge, bordering on diversion, conspiracy, bribery, abuse of office and criminal breach of trust involving N19.4 billion.

    Others in the trial are: Amb. BashirYuguda, Shuaibu Salisu, a former Director of Finance, Office of the National Security Adviser, Dalhatu Investment Ltd, Sagir Attahiru and Attahiru Bafaarawa, former governor of Sokoto State.

    The judge was unavoidably absent to hear the case adjourned until Thursday.

    The News Agency of Nigeria (NAN) reports that the court did not sit but the defendants and their counsel were present in court except Dasuki.

    The trial was adjourned until Sept. 27 with the consent of all the counsel in the matter.

    NAN also reports that Dasuki was also arraigned on another 19-count charge bordering on diversion of funds pending in the same court.

    He is being tried alongside Shuaibu Salisu, a former Director of Finance, Office of the National Security Adviser, and Aminu Baba-Kusa ,a former NNPC Executive Director.
    Also being tried were two firms, Acacia Holding Limited and Reliance Referral Hospital Limited.

    The Economic and Financial Crimes Commission (EFCC) preferred the charges against the defendants since 2015.

    Parties agree to re-assign Dasuki, others’ cases

    Parties in the criminal cases involving former a National Security Adviser, Sambo Dasuki and others have agreed that the two charges against them be brought before a single judge for determination.

    They resolved on Wednesday to approach the Chief Judge of the High Court of the Federal Capital Territory (FCT), before which the cases are pending, to seek his approval for re-assignment of both cases to Justice Husein Baba-Yusuf.

    The first case involves Dasuki, a former Director of Finance, Office of the NSA, Shuaibu Salisu; a former Executive Director of the Nigerian National Petroleum Corporation (NNPC), Aminu Baba-Kusa and his two companies – Acacia Holding Limited, and Reliance Referral Hospital Limited.

    They are accused of diverting about N13.6 billion belonging to ONSA.

    The case is being handled by Justice Baba-Yusuf.

    The second case, now before Justice Peter Affen (also of the High Court of the FCT), involves Dasuki, ex-Minister of State for Finance, Bashir Yuguda; a former Director of Finance at ONSA, Shuaibu Salisu, a former governor of Sokoto State, Attahiru Bafarawa, his son, Sagir Bafarawa and their company, Dalhatu Investment Limited.

    They are accused of diverting about N9.2billion from ONSA.

    At the resumption of proceedings on Wednesday, lead prosecution lawyer, Rotimi Jacobs (SAN), suggested that the court shelved the scheduled hearing of a motion by Dasuki, challenging the simultaneous existence of both cases.

    The scheduled commencement of trial in one of the cases involving the former National Security Adviser (NSA), Sambo Dasuki before the High Court of the Federal Capital Territory (FCT) was stalled on Tuesday due to Dasuki’s absence in court.

    Dasuki is named in three charges pending before Justices Husseini Baba-Yusuf and Peter Affen of the High Court of the FCT in Maitama and Justice Adeniyi Ademola of the Federal High Court, Abuja.

    ‎He was arraigned alongside four others before Justice Baba-Yusuf in December last year on a 19-count charge in which they were, among others, accused of diverting about‎ N32bn arms procurement fund.

    Also named in the charge are former Director of Finance and Administration in the office of the NSA, Shuaibu Salisu‎ and  a former director in the Nigerian National Petroleum Corporation (NNPC), Aminu Baba Kusa and two of his companies – Acacia Holdings Limited and Reliance Referral Hospital Limited.

    It had been impossible for the prosecution to commence trial in the case since the defendants were arraigned due to a motion filed by Dasuki, seeking to stop his trial because of Federal Government’s purported violation of an order admitting him to bail.

    The court had on February 8 dismissed Dasuki’s motion and fixed March 23 for commencement of trial.

    Court clears FG of disobedience on Dasuki

    A High Court in the Federal Capital Territory (FCT) on Monday cleared the Federal Government and the Economic and Financial Crimes Commission (EFCC) of disobedience of any court order in the ongoing trial of ex-National Security Adviser (NSA), Sambo Dasuki.

    The court held that it was wrong for Dasuki to accuse the federal government and the EFCC of violating the order granting him bail when there was evidence that he was only arrested after he had been released from prison for fulfilling his bail conditions.

    Justice Husseini Baba Yusuf gave the ruling on Dasuki’s application in which he had sought among others, an order restraining the EFCC from proceeding with his prosecution and an order quashing the charge against him.

    The ex-NSA’s lawyers, Joseph Daudu (SAN) and Ahmed Raji (SAN), urged the court not to indulge either the government or the EFCC by proceeding with the trial on the ground that its agency had rearrested Dasuki after granting him bail.

    Dasuki is being tried with a former Director of Finance and Administration, Office of the National Security Adviser, Shuaibu Salisu, a former General Manager, Nigerian National Petroleum Corporation (NNPC), Aminu Babakusa and two companies – Acacia Holdings Limited and Reliance Referral Hospital Limited – on a 19-count charge of money laundering and criminal breach of trust.

    Dasuki, Salisu, ex-NNPC director arraigned for alleged fraud

    Former National Security Adviser (NSA), Sambo Dasuki, ex-Director of Finance and Administration in the office of the NSA, Shuaibu Salisu were on Monday arraigned with three others over alleged diversion of public funds estimated at about N32 billion.

    Also arraigned before Justice Baba Yusuf of the High Court of the Federal Capital Territory, Maitama, Abuja, on a 19-count charge were the ex-Director of the Nigerian National Petroleum Corporation (NNPC), Aminu Baba-Kusa and two companies – Acacia Holdings Limited and Reliance Referral Hospital Limited.

    They were charged with conspiracy and criminal breach of trust under the Penal Code Act and the Economic and Financial Crimes Commission (Establishment) Act.

    Dasuki and Salisu were accused of distributing funds held in the NSA account with the Central bank of Nigeria (CBN) to politicians, media practitioners and businessmen purportedly for political campaigns and organizing of prayer sessions.

    The duo were in counts 5, 6, 7 and 8 accused of paying N2.2billion to Baba-Kusa  through  the bank accounts of Acacia Holdings Limited and Reliance Referral Hospital Limited in Zenith Bank Plc.
