    Edo: Court plans hearing on Shuaibu’s contempt claim against Obaseki’s deputy

    A Federal High Court in Abuja has scheduled a hearing for October 24 in a contempt proceeding initiated by the reinstated Deputy Governor of Edo State, Phillip Shuaibu against Marvellous Godwins Omobayo, claiming to be the state’s deputy governor.

    Justice James Omotosho chose the date on Tuesday, September 24, after Shuaibu’s lawyer, Reuben Eguaba drew his attention to a motion by his client seeking Omobayo’s committal to prison for allegedly failing to comply with a subsisting order of the court.

    Justice Omotosho directed that Omobayo be served with all the documents filed so far, including Form 49, filed on September 19 by Shuaibu.

    The judge said the service was necessary to allow the alleged contemnor to purge himself of the alleged contemptuous act.

    Justice Omotosho said: “This matter is hereby adjourned to 24th day of October for hearing of the motion on notice dated 13th September and filed on 19th September, seeking for committal of Engr Marvellous Godwins Omobayo, and to give him the opportunity to defend himself.

    “I hereby make an order that the motion (for committal) be served on Marvelous Godwins Omobayo to enable him to file a necessary defence.”

    Earlier, Eguaba urged the court to grant a short adjournment in the case since the tenure of the current administration in the state will expire on November 12.

    Eguaba told the court that its judgment, delivered on July 17 voiding Shuaibu’s impeachment and ordering his reinstatement, was duly served on Omobayo and that several letters were also written to the state’s House of Assembly, which they allegedly ignored.

    Earlier in the proceedings, Justice Omotosho gave a ruling striking out the two motions filed by the Edo State Government and the House of Assembly, seeking to stay the execution of the judgment reinstating Shaibu as Deputy Governor of Edo State.

    The judge equally awarded N200,000 each, as a cost, against the state government and the House of Assembly.

    The ruling resulted from applications by lawyers to the state’s Attorney General and the House of Assembly – Marvin Omorogbe and Sonia Egbunia – for the withdrawal of both motions.

    They said the decision to withdraw the motions was informed by the fact that the records of appeal had been transmitted to the Court of Appeal and the appeal entered.

    Eguaba did not object to the withdrawal but prayed the court award N50 million in cost against them.

    Edo: Shuaibu loses bid to void Ighodalo’s candidacy

    A Federal High Court in Abuja has dismissed a suit filed by the impeached deputy governor of Edo State, Phillip Shuaibu, seeking the nullification of the February 22 governorship primary of the Peoples Democratic Party (PDP).

    Asue Ighodalo won the party’s primary.

    In a judgment delivered yesterday, Justice James Omotosho held that Shuaibu lacked the locus standi to have challenged the outcome of primary because he did not fully participate in it and was not present at the venue of the primary the day it was held.

    The judgment was on a suit in which Shuaibu had sought the conduct of a fresh primary.

    Justice Omotosho held that although it was not in doubt that Shuaibu was a governorship aspirant who purchased the Expression of Interest and the Nomination forms, there was no evidence that he participated in the actual primary.

    The judge also held that Shuaibu failed to effectively counter the claim by the defendants that he only participated in a parallel primary held in his house.

    He averred that where a person bought the Expression of Interest and Nomination forms, got screened and cleared but failed to physically participate in the primary, he/she has lost the right to challenge the outcome of the primary.

    Justice Omotosho also held that Shuaibu’s suit was premature because he failed to exhaust the internal dispute resolution mechanism of his party before heading to the court.

    The judge held that as a member of the PDP, Shuaibu was bound by the rules and regulations of the party, which require an aggrieved aspirant in a primary to first approach the party’s Appeal Committee before filing a suit in the court.

    He held that having failed to exhaust the internal dispute resolution mechanism put in place by his party, the suit he filed was premature and the court could not exercise jurisdiction to hear it.

    Justice Omotosho found that Shuaibu failed to lead credible evidence to support his claim that the primary was manipulated and the 393 delegates were disenfranchised.

    The judge held that the plaintiff’s allegation of irregularities in the conduct of the primary was not supported by any credible evidence.

    He also held that there was sufficient evidence to show that Ighodalo actually won the primary.

    In a separate rulings in another suit that Shuaibu filed, Justice Omotosho granted him leave to amend his originating process from originating summons to writ of summons in view of that fact that contentious issues were raised in the suit to warrant the calling of oral evidence.

    Shuaibu is, by the second suit, challenging his impeachment as Edo State deputy governor.

  • Pipeline vandalism: Navy arrest notorious kingpin

    The Nigerian Navy on Tuesday said it had arrested Mr Shaibu Ogunmola, an alleged notorious pipeline vandal kingpin under its Operation Awase in Lagos.

    Operation Awase was set up by the Nigerian Army in collaboration with the Nigerian Navy in 2014 to tackle the vandalism of the NNPC pipelines in Majidun, Ikorodu and other parts of the state and to crave the maximum cooperation of host communities.

    Rear Admiral Obed Ngalabak, Leader of the operation, told newsmen that Shuaibu and his boys were known for vandalising oil pipelines under the Altas Cove covering about 70 kilometers.

    The Atlas Cove Depot in Lagos was designed to receive imported petroleum products and through the line products are distributed to various part of the country.

    The News Agency of Nigeria reports that at the Ilashe Community where Shuaibu operates, drums were buried by the sides of each pipeline to syphon products when being released from the Atlas cove to other depots.

    “Two weeks back, we got information about the operation of some people in Ilashe, part of Atlas cove.

    “Following that information, we came and realised that the oil pipelines have been divided into fields by three people, Shuaibu, Barshiru and Dele.

    “The arrest of Shuaibu which we did last week on Jan. 17 was in line with the operation Awase which is about the protection of oil pipelines.

    “He is the ring leader and has been in this business for over 30 years,’’ he said

    He said that Shuaibu had groomed some boys in the business adding that his arrest was significant in ensuring the end of vandalism in Nigeria.

    Ngalabak said Shuaibu would soon be handed over to relevant agency for immediate and proper prosecution to serve as a deterrent to his boys and others in the line of business.

    “We hope that Shuaibu’s arrest will yield result and that proper people in position will do all that is required to punish him,’’ he added

    He assured that the operation would not rest until all those involved in oil pipeline vandalism were arrested and brought to book.

    “We still have about three Shuaibu’s, we have Dele, we have Bashiru, and one other person and we are after them.

    “We are not going to rest until we get them, except if they leave Nigeria but we will make sure that we get them.

    “And we know that they will not leave because this is where they make their money; but if they leave here, that is good for us because that is our aim but if they come back, we will get them,’’ he said.

    He called for support on logistics for the operations to work effectively and urged Nigerian to support every effort that would help to curb pipeline vandalism for economic growth and development in the country.

    Also, the General Manager, Security, Nigerian National Petroleum Corporation (NNPC), Mr Sam Otoboeze, said that the arrest of Shuaibu meant celebration for the corporation.

    “The arrest means celebration for us because of the deterrent impact, not only the prosecution of the key character, but the message that will go out.

    “We do hope that the way it is handled will determine to what extent the success will be sustained.

    We celebrate that arrest and we thank the Nigerian Navy for picking him up and want to hope that this continues until so many other Shuaibus’ are arrested because certainly, they are more than 10,’’ he said

    Otoboeze noted that Shuaibu and others in the business of pipeline vandalism remained the major enemies of Nigeria.

    “You can imagine the wastages, not the one stolen but the one wasted for it to drip into their well, underground tank; you can imagine what that is.

    “So, the economic sabotage is massive and a fight to bring it down is something to be celebrated. It is also celebration of reliving the country from the shackles of poverty.

    He assured that the NNPC would continue to strengthen its partnership with all the agencies to ensure effective protection of the nation’s oil pipelines for economic growth and development in the country.

    “We have a kind of robust intelligence network, outside our own system, which we can also support the government.

    “Also, to be the voice of the agency when they require support, like logistic to make them succeed, that we will do,’’ he added.

    This, he noted would continue to strengthen the relationship and ensure that we keep the fire burning.

    Commenting on the economic values of the Atlas Cove pipeline, he said: “the economic benefit is huge, one is that the history of fuel scarcity will be gone, the origin, the foundation, the tap root of fuel scarcity was from the attack of this place.

    “The moment this place is tampered with, there will be fuel scarcity; just imagine the quantity of fuel that goes into the soil wasted.

    “Then imagine the more that is scooped and sent across to Cotonou, because there is their major artery of their supply.

    “So, if this battle is won, we will be able to think and it might even help to crash fuel price, because when you have it in surplus, then of cause, in demand and supply argument of typical economics, it could come down.

    “So, we need it, it is a war for the nation not a war for one person, it is not for security agencies alone or NNPC alone.

    “It is for all and sundry because down the line it affect those that are yet unborn, including the children in the school and the aged who are waiting for their pension.’’

    Meanwhile, in an interview with Shuaibu, he denied being a vandalism kingpin adding that he had no idea of the reason he was arrested by the Navy.

    “I don’t know why they arrested me, I was in my house, I was going to pray when this people came and arrested me.

    “I am a businessman, I am a hotelier,’’ he said

    AFTER keenly contested elections, 33 more candidates emerged as members of the new National Working Committee( NWC) of the All Progressives Congress( APC).

    The new officers yesterday joined the new APC National Chairman, Adams Oshiomhole and 25 others, who were elected unopposed on Saturday –  the first day of the party’s National Convention.

    With the conclusion of the election, 59 members of the NWC have been duly elected.

    Of the 59 slots, 26 candidates were elected unopposed.

    But the election led to the return of some former NWC members, including the National Secretary, Mallam Mai Mala Buni; Senator Lawal Shuaibu (Deputy National Chairman, North); the National Publicity Secretary, Bolaji Abdullahi; the National Auditor, Chief George Moghalu and the National Vice Chairman (North-West), Alh. Inuwa Abdulkadir.

    Some former NWC members and APC leaders, rated as bigwigs, were however voted out by delegates including former National Organising Secretary Senator Osita Izunaso, ex-National Women Leader Hajiya Ramatu Tijjani and Farouk Adamu Aliyu.

    The outcome of the convention indicated that the consensus option adopted by APC governors and endorsed by President Muhammadu Buhari and other party leaders was strictly adhered to by all groups in the party.

    A governor said: “We had a consensus list based on fault lines in the party and we thank God that all governors and party leaders kept faith with our agreement.

    “We accommodated those who have grievances and we dropped some candidates like Izunaso and Ramatu Tijjani as sacrifices for the unity of the party.

    “We will use this benchmark henceforth in reuniting APC and charting a new course for this great party. We want to reconcile as fast as possible because presidential and other primaries for 2019 poll are around the corner.

    “We hope to revisit our coalition and make it to work better for all caucuses in APC.”

    But’ a former Kano State Governor Rabiu Kwankwaso yesterday said he boycotted the convention of APC to avoid causing embarrassment to the party.

    He said his group was unhappy that all the congresses it conducted were not recognised by the dissolved National Working Committee (NWC), which was headed by ex-National Chairman, Chief John Odigie-Oyegun.

    Kwankwaso, who made the clarifications in a statement in Abuja, said his presence and that of his loyalists will not be in the interest of the convention.

    He said: “The All Progressives Congress (APC) group in Kano, which I am opportune to lead will like to congratulate and felicitate with the newly elected Chairman Comrade Adams Oshiomhole and his newly elected members of the Executive Council.

    “I wish to inform the leadership of the party and the public that we had wanted to be part of the National Convention but regrettably all the congresses that we conducted at the wards, local government councils and at the state level were not recognised by the outgoing National Executive Council of the party.

    “Therefore, I felt that presenting ourselves at such an important event will not be in the overall interest of the entire convention, that is assuming we are allowed access into the convention ground.”

    Edo State Deputy Governor Philip Shaibu has said he earned the nickname, ‘Mr Constituency Projects,’ because of projects he executed in his constituency when he was a member of the House of Assembly.

    Shaibu, who represented Estako West Constituency II between 2007 and 2015, urged the people to elect good representatives.

    He said the secret behind the electoral victories of the All Progressives Congress (APC) in Edo was due to its developmental projects.

    Shaibu disclosed that N36m constituency project fund is provided for lawmakers in the State House Assembly to execute projects in their various constituencies.

    He reflected on his tenure in the House when he distributed empowerment materials to members of Estako Federal Constituency.

    Items presented by Shaibu included sewing machines, tricycles, generators, motor-cycles and grinding machines.

    The deputy governor said the empowerment materials were part of what he attracted to the constituency when he was in the House of Representatives between 2015 and 2016 before he became Deputy Governor to Governor Godwin Obaseki.

    Shaibu said he ensured that projects were executed from the N36m constituency funds, unlike some lawmakers that connived with contractors to share the money.

    He said some constituencies, including Estako West Constituency 1, have not enjoyed constituency projects because of their elected representatives who opted to fight former Governor Adams Oshiomhole.

    His words: “The money for Constituency projects is equal in the budget. We met N20m when I was first elected to the Assembly. I did four schools from the fund available. The money was later increased to N30 and it is now N36m.

    “Constituency one in Estako West did not benefit because their representatives was never in line with the State government. While I was building schools, the lawmaker was fighting the governor. Those of you in constituency have to blame your legislator for not aligning with the government.

    “The money is there in the budget for the constituencies. The lawmaker choose the project to execute or can decide to go with the contractor to share the money.”

    Shaibu, however, urged political leaders in the state to play politics of development and not of division.

    According to him, “If you want to play politics play it the right way, I play politics of development and project, I don’t play politics of division. Those that want to play politics of division, this is a warning for you, play politics of development because our people wants projects and when you play politics of development, you can win and win and win.

    “This empowerment was the one that I got from my first year in the House of Representatives before you people voted me in to become the Deputy Governor of Edo state. In another 30 days we will commissioning blocks of class rooms which I did while I was in the House of Representatives.

    Shuaibu ready for shift to Europe

    Former Giwa FC striker, Ibrahim Shuaibu is set for a move to Europe. The pacy forward informed supersport.com that he will soon be departing Nigeria for a club abroad to sign a deal in a matter of days.

    A product of the famed GBS Academy, Shuaibu was sent to Giwa FC in 2013 as a rookie after showing a lot of promise at a very tender age.

    He soon became a force to reckon with after scoring several important goals for the club. In August 2013 he won promotion with the club to the Nigeria Professional Football League (NPFL) from the second tier and has since developed into a clinical goal machine.

    Shuaibu said his time at Giwa FC was full of good memories and is now ready and waiting to travel abroad to join a new club after obtaining his clearance from the Jos-based football club.

    “I have now finished my contract with Giwa FC and I wish to thank my coaches and everybody at the club for supporting me during my stay at the club. I also want to thank our  club chairman, Chris Giwa for giving me the opportunity to develop my game at his club.

    “My manager informed me that I will be travelling soon so I’m now awaiting further instructions,” said Shuaibu to supersport.com.

    Shuaibu scored 23 goals in the past two seasons in the Nigerian top-flight while with Giwa FC. He has now returned to GBS academy where he is training and keeping fit before embarking on his trip to Europe.

    Giwa FC top scorer, Ibrahim Shuaibu, has said more than the three maximum points are at stake in the clash against Heartland.

    The Tin City side will host the Owerri outfit in the Nigeria Professional Football League (NPFL) match day 16 clash on Sunday at their adopted home, Ahmadu Bello Stadium in Kaduna.

    Shuaibu said the quest to upstage NPFL leading top scorer and Heartland marksman, Bright Ejike, will be uppermost in his mind in the clash.

    “Beyond the three points to win in the clash there is the personal agenda to upstage Heartland’s Bright Ejike as NPFL top scorer.

    “Ejike leads the goal scorer’s chart on eight goals while I come close second on seven goals so I’m targeting at least, two goals to help me climb to the top chart.

    “I know the race for the top scorer’s gong has just started but I strongly believe that my name will not be missing at the top when a roll call will be made.

    “However, key for us in the match is three points to further improve our position on the league log. I quite understand that Heartland are a good side with some quality players that can ruffle feathers in a match so certain to come out tough.

    “We equally have good players that can match them in any department, we have trained very hard as well as perfected our homework to withstand whatever tricks they may come up with. We are damn prepared and ready to turn them back empty-handed,” said the former Wikki Tourists goal poacher to supersport.com.

    The Jos-based side have amassed a total of 25 points from possible 45 in the 15-week old Nigerian top flight.

    Shuaibu: Power must shift in 2015

    Senator Lawal Shuaibu is the Deputy National Chairman (North) of the All Progressives Congress (APC). He represented Zamfara North in the National Assembly between 1999 and 2007. In this interview, the former National Secretary of the defunct Action Congress of Nigeria (ACN) speaks about the chances of the Apc in next year’s election. He spoke with Tony Akowe.

    The APC is less than two years old as a party, but it has gained a wide acceptability across the country. What is responsible for this?

    What is responsible is the desire by Nigerians to see a change. The Nigerian people have always been looking forward to the opposition to effect a change in the status quo. People are fed up with the situation of things in the country because nothing works, corruption is growing and impunity has become the norm in official quarters. You’ll find out that there is impunity everywhere, including the legislature, the judiciary and the executive. In fact, in the executive arm of government everybody is doing whatever they want without any caring what will happen. The Nigerian people have been pushed to the wall. Nigerians are desirous of good governance. Indeed, the APC was formed to push for good governance. For your information, the APC is a conglomeration of all major opposition parties in this country. They made sacrifices to come together because they know that Nigerians are yearning for change.

    Why has the party settled for Gen. Mohammadu Buhari as its presidential candidate?

    That is the people’s choice. The primary that threw him up was very transparent; votes were cast and he emerged. He emerged because people want to give him the opportunity to realize his ambition of effecting a change in the country.

    The argument is that globally many countries are going for younger people…

    But, in Tunisia, an 82 year old man just won an election; in Sierra Leone, somebody much older has also won election. You cannot question people’s choice. People wanted a change and they made their choice as to the person they feel can effect such a change.

    The North, which is your constituency, appears divided between Buhari and Jonathan. For instance, the ACF came out recently to say that they have not endorsed Buhari. What is your take on this, given the fact that the region is very critical to your success?

    The North is solid as far as the choice of Buhari is concerned. When you talk about the Arewa Consultative Forum (ACF), you should know that it is not a political grouping, but a cultural organisation. When you say ACF or Ohaneze, they are not political organisations and, so, what anybody from the organisation says does not necessarily reflect the views of the generality of the people in the North. Let me tell you that the leaders of the PDP from the North have resolved to back Gen. Buhari and will mobilize for his success come February. Quote me on this and go and write it down. Forget all the rhetoric flying around. Of course, man must eat. But, when it comes to that day, you will see what is going to happen.

    Do you think it would be easy to defeat an incumbent? Secondly, don’t you think the insurgency in the Northeast will affect your chances in the election?

    There are several countries in Africa where the opposition took over power and Nigeria cannot be an exception. I told you from the beginning that when the wind of change comes, it will not be about money or power, but the will and wish of the people. Once they are resolved, they will go the whole hug to realise their wish. As for the issue of insurgency, elections were successfully held in Afghanistan, Egypt and Syria, which are experiencing insurgency. The same applies to Iraq. So, what are you talking about? Insurgency is not an impediment. In fact, the people in the Northeast where the insurgency is more pronounced are very eager to use their votes to express their opinion about the incumbent government and the way things are going in the country. They feel highly disenchanted and they are going to show it.

    Some people believe that the change the APC is preaching has only happened in the state capitals in places like Lagos and Edo and that if given the chance, the party may not be able to replicate this at the federal level…

    We are talking about the APC as a party that is a little over one year old. It has just ratified its manifesto at the recent National Convention. The party intends, as a matter of policy, to enforce the implementation ifs policies by government at all levels. Our policies are cry clear and we are going to implement it and it is left for Nigerians to judge the implementation of the party’s programmes. You cannot use the standard of the legacy parties to judge what is going to happen to an APC government henceforth.

    We are talking about change in the APC when a good number of the chieftains of the party are from the same PDP we are accusing of running down the system. So, what is that change we are talking about?

    The good thing is that it is not everybody in the PDP that came to join the APC. Besides, those who defected to the APC probably found themselves in the midst of strange bedfellows and that is why they left the fold. I want to assure you that in the APC we are going to strictly adhere to the constitution of the party. There will be the principle of party supremacy. The party is supreme and dictates what happens; the governors or the President cannot hold the party to ransom.

    The leader of the party is Chief John Odigie-Oyegun, in his capacity as the National Chairman. But, of course, we have national leaders such as Atiku Abubakar, Asiwaju Bola Tinubu, Chief Bisi Akande, Dr. Ogbonnaya Onu and many others. Tinubu is always in the news, but he is not the only national leader. The issue of national leader is not an issue that has to do with the constitution of the party. As far as the party is concerned, the leader of the party is the National Chairman of the party. During the NPN days, they observed the principle of party supremacy. If you watched General Buhari on Channels TV before the convention, they asked him what he intends to do or the action he will take on certain issues and he said he will rely on the party to tell him what to do. He has read the constitution and gone through the manifesto and understood how the APC should operate. The party is just starting and we are going to show Nigerians for the first time that the issue of party supremacy is back in Nigeria’s democratic norms.

    In other climes, when you defect from one party to other, you resign your position. But, in Nigeria under the present political dispensation, this has not been the case. What will the APC do about this?

    We will follow strictly the constitutional provision and ensure that the judiciary, when confronted with matters like this, will do justice to it.

    Recently, Prof. Akinyemi wrote a letter predicting that there will violence during and after the 2015 election. What is your take on this?

    When you talk about violence, you are shouting fire even before you strike the match. It means that you have a motive. We don’t foresee any violence. What we foresee is when the will of the people is spelt out, the generality of Nigerians will stand up in jubilation because for the first time, we have all resolved to accept the will of the people. But where you are talking about violence, it means there is an intention to rig election. If there is no intention to rig election, why do you have to talk about violence. Why do you start shouting fire when there is no smoke?

    But one of your governors Chibuike Amaechi said if the election is rigged, you will not go to court, but will form a parallel government and make Nigeria ungovernable. How would you react to this?

    People are entitled to their opinions and their audience is entitled to their own interpretation of such statements. Only Amaechi could interpret what he said and what he meant. But, we are saying is that we don’t intend to embark on any violence. But, let me tell you that if you strike somebody and he reacts, then you turn round and say he wants to perpetuate violence. We don’t propagate violence and we don’t advice people to embark on violence. But, sometimes, you don’t have control over the reaction of people who feel they are on their right. You may even be in your house when commotion will erupt and somebody will say that you caused it. You didn’t cause it. Once the will of the people is allowed to prevail, there is not going be violence in any party of the country. When you talk of the Niger Delta, I want you to go and write it down, the APC will win Bayelsa, the home state of the President. We have made our assessment; we know what is going on there and we I’ll cashed in on that.

    There is the belief that the Southwest is the base of the APC. Don’t you have this fear that there may be a repeat of what happened in 2011 when they voted for Jonathan when Nigerians were expecting them to vote for the ACN?

    When you talk about 2011, the circumstances are not the same. The political atmosphere is no longer the same. The year 2011 was a time when an opportunity was opened for the political class to introduce religious politics and the PDP has continued to encourage it. The President visited Lagos nine times within a period of one month. He was visiting churches and that has never happened in the history of this country where you take your political campaign to the church or the mosque. But, he was doing it openly in the full glare of cameras.

    The PDP has just raised N21 billion for the campaign. How would you match this? Are you going to do the same thing?

    We would not attempt to replicate the fraud perpetrated by the PDP. If the Independent National Electoral  Commission (INEC) is serious about enforcing the provisions of the electoral act, it ought to ensure that every member of the PDP who pledged a donation at the fund raising show the source of the money. This is the law and the electoral act is very clear about this. When a governor says he has donated N1 billion, it must not be from government coffers. INEC knows that the governor has no right to take the peoples’ money and donate. The PDP National Chairman Adamu Muazu said part of that money will be used to complete the National Secretariat and the rest will be used for campaign at all levels. There is no provision in the law that says you can use government money meant for developmental projects for political campaign. So, the party should show us the receipt issued to each donor by the party and let us see the accounts of the PDP because such money cannot come in bags and sacks, but through some instruments. We must know the source of that money. If it comes from government account, then the PDP or the person who stole government money for political campaigns is liable. In our own case, we intend to raise funds, through transparent means. Whoever donates money, we will publish it, so that the whole world will see. We will not accept any anonymous donations.

    Whoever brings in money, it will be for the world to know where the money comes from. So, we don’t have any fear about the money raised by the PDP, as long as they are as transparent as the law stipulates and as far as INEC will be neutral and be prepared to enforce the provisions of the Electoral Act.
