    Group to Soun: Oyo Chieftaincy law does not subordinate religious leaders to traditional rulers

    Muslims in Ogbomoso, under the auspices of the Ogbomoso Muslim Youth Forum, have asserted that the chieftaincy law in Oyo state does not place religious leaders under traditional rulers in the state.

    The group made the statement in response to a recent query issued by the Soun of Ogbomoso, Oba Afolabi Ghandi Olaoye, to the Chief Imam of Ogbomoso, Sheik Teliat Yunus Ayilara, for travelling to Saudi Arabia for Hajj without informing him.

    The traditional ruler’s query, dated June 10, 2024, and signed by palace secretary, Toyin Ajamu, was challenged by the forum.

    In a statement signed by its chairman, Alhaji Ishaq AbdurRaheem, the group clarified that the chieftaincy law does not categorize the Chief Imam or other religious leaders as minor chiefs under the authority of kings.

    AbdurRaheem emphasised that the Chief Imam was appointed under Islamic law by a Shura committee that interviewed and screened all candidates.

    He added that the Muslim community is the custodian of the Central Mosque, not Soun or the palace, adding that ownership of any mosque in Islamic jurisprudence is the Muslim community.

    He then advised the traditional ruler to maintain the status quo as ordered by the court pending the determination of the substantive suits.

    “As a rejoinder to the press conference titled “Imbroglio in Ogbomosoland: Need to Avoid Instigating Violence and Insubordination against Constituted Authorities” held on Saturday 29 June 2024 by a coalition of few members of the Ogbomoso Special Committee on Islamic Affairs, alongside absconded members of Imam in Council, dissenting members of the League of Imams and Alfas and aggrieved members of Ayilara Family, Ogbomoso Muslim Youth Forum under the chairmanship of Alhaji Ishaq AndurRaheem wish to accentuate the facts of the matter as follows:

    “The conveners of the conference tactically sought to exonerate His Imperial Majesty – Oba Ghandi Afolabi Olaoye Orumogege III from the saga. The Kabiyesi was cajoled into believing that this set of propagandists were the real leaders of Islam in Ogbomoso when none of them possessed the required Islamic education to lead Muslims. And on the occasion when the Ogbomoso Muslim Youth Forum sought dialogue with the king long before the issue escalated, they were unceremoniously sent out of the palace.

    “The late Soun, Oba Jimoh Oladunni Oyewumi Ajagungbade III formed this Special Committee on Islamic Affairs (led by Aare Musulumi ofMuslim’s Ogbomosoland) in his capacity as a Muslim stakeholder to enable the community to benefit from their resources and influence towards advancing Islam. The modifications in the old system of mosque administration to incorporate people of sound Islamic knowledge and creed initiated by the Chief Imam constituted their falling apart. Noteworthy is that the reform was also intended for better accountability.

    “The erroneous accusation of insubordination on all and sundry against the King’s position is reprehensible. The Muslim Community is one global community with an ultra-high sense of brotherhood. It is therefore natural that the unprecedented actions of the king, Oba Ghandi Olaoye Orumogege III provoke reactions from all Muslims. Nobody invited or sponsored all the mediators visiting the city for peace as speculated in the press conference. This exposed the conveners’ bad intentions.

    “They mischievously justified their claim with unreferenced history on the building of the Central Mosque and appointment of all the past Chief Imams. History affirms that Obas in Yorubaland accorded Islamic scholars/clerics special status, housed them in close quarters, and assisted them in building mosques in exchange for their spiritual services. In some cases, those kings donated pieces of land for mosques, and ditto for churches, and traditional shrines.

    “Ogbomoso is not an exemption in this regard. Although an admission was made unwittingly that none of the past Souns unilaterally built Ogbomoso Central Mosque, they stopped short of admitting that constituted committees among the Muslim Ummah did the job. This shows that the Muslim Community is the custodian of the Central Mosque, not Soun or the palace. Besides, ownership of any mosque in Islamic jurisprudence is the Muslim Community, hence why it is not treated as an estate.

    “Past records as stated also show that all the past Chief Imams were appointed by Soun based on the age-long custom occasioned by the mutually beneficial relationship between Kings, Imams and Muslim Communities; a relationship defined by mutual respect for their boundaries. The game was changed before the demise of the last Soun (Oba Jimoh Oyewumi Ajagungbade III) when the Muslim Community prevailed on the late monarch to allow them to take over the selection, screening, interview and final appointment of the Grand Chief Imam.

    “The late monarch bowed to the argument that the initial arrangement does not have a place in constitutional democracy. This paved the way for the appointment of the Grand Chief Imam through the provisions of Islamic law by a Shura committee that interviewed and screened all prospective candidates.

    “The press conference conveners were among the principal committee members who oversaw the constitution of the Shura committee that oversaw the screening process. The committee led by Parakoyi of Ogbomosoland presented the present Grand Chief Imam to the late Soun as the chosen one for turbanning and conference royal blessings. 

    “However, it was wrongly asserted in the press conference that Soun delegated the selection and screening of the Imam to three duchies due to old age and ill health although they agreed that Imam Teliat Yunus Ayilara was presented/appointed as the successful candidate and accepted by Soun.

    “That some people prevented the aggrieved and Ayilaras who lost out in the process from presenting their protest members’ letter to the late monarch was a blatant lie. It is on record that all the Ayilara family members led by their mogaji and chairman graced the turbanning of the Grand Chief Imam with fanfare and even adorned beautiful aso ebi. Seed of rancour was eventually sown by those who could not stomach their defeat gracefully and till today, they remain a tiny minority within the Ayilara family.

    “It is our belief that the Chief and Customary Laws of Oyo State (as amended) does not place the Chief Imam and by extension all religious leaders as Minor Chiefs under the Prescribed Authority of Kings as revealed in the controversial query letters issued by the king on 10th and 14th June 2024 hence why we approached the Oyo State High Court for clarity with the Imam having done so earlier. We expected our dear monarch to maintain the status quo as ordered by the court pending the determination of the substantive suits so as not to be held in contempt of court.

    “Lastly, the Soun of Ogbomosoland and the entire populace should know the real identity of the Press Conference conveners. They are not the leaders of the Ogbomoso Muslim Community (OMC) as wrongly claimed. Lagos-based businessmen – Aare, Basorun & Asoju all of Ogbomosoland are but three of twenty-one members of the Ogbomoso Special Committee on Islamic Affairs. Parakoyi, Mufassir & Balogun all of Ogbomosoland are just the dissidents among a bulky Imam-in-Council.

    “Ogbomoso Muslim Community (otherwise called Muslim Community of Oyo State, Ogbomoso zone) is the umbrella association of all Muslim organisations; NACOMYO, MSSN, Alasalatus, Ahalu Sunnah, the League of Imams and Alfa, League of Imam Ratibis, all Suffi Orders, Ogbomoso Muslim Youth Forum and others. It is currently under the leadership of Alhaji Chief Akintoye Abdul Salam Olla. 

    “Pseudo-organizations under names like Ogbomoso Muslim Community (North/South), Ogbomoso Muslim Ummah, and Ogbomoso Muslim Justice Forum surfaced less than a year ago in rebellion to the da’wah and authority of the Grand Chief Imam. The security agencies and the palace should therefore take note.”

    Justice K.B. Olawoyin of an Oyo State High Court sitting in Ogbomoso has barred the Soun of Ogbomoso, Oba Afolabi Ghandi Olaoye and kingmakers in Ogbomoso land led by Chief Sobalaje Otolorin from removing the Chief Imam of Ogbomoso, Sheik Teliat Yunus Ayilara.

    Soun and the Chief Imam have been in supremacy battle in the last few months.

    The Nation learnt that Muslims in the town under the auspices of “Registered Trustees of Ogbomoso Muslim Youths Forum” dragged the traditional ruler and the kingmakers who are members of Soun-In-Council to court over planned removal of the cleric.

    The case with the suit number HOG/31/2024, filed at Oyo State High Court Ogbomoso Division, has Registered Trustees of Ogbomoso Muslim Youths Forum as plaintiff, while the Soun and the Soun-In-Council are the defendants.

    The court, presided over by Justice Olawoyin,  barred the traditional ruler and the Soun-In-Council from removing the Chief Imam.

    It barred the “defendants/respondents whether by themselves, their agents, privies, officers under their control, or any persons acting on the instruction of the defendants/respondents from suspending or removing the holder of office of Grand Chief Imam of Ogbomoso land (in person of Alhaji Yunus Olusina Ayilara) or in anyway disturbing or tampering with the office of Grand Chief Imam of Ogbomoso land pending the hearing and determination of the Motion on Notice.

    “The defendants/respondents and their agents, servants and/or privies and/or any persons acting under their control or on their instructions are also restrained in the interim from doing anything under any guise whatsoever to interfere with or impede the Grand Chief Imam of Ogbomoso land from carrying out the functions and duties of his office as Grand Chief Imam of Ogbomoso land pending the hearing and determination of the Motion On Notice filed herein.

    “I put on record that I have taken judicial notice of the full names of the Grand Chief Imam of Ogbomoso land as Alhaji Taliat Yunus Olusina Ayilara and that of the 1 defendant/respondent as His Imperial Majesty Oba Ghandi Afolabi Olaoye (Orumogege III), the Soun of Ogbomoso land.

    “The hearing of the Motion on notice dated and filed 26/6/2024 is adjourned to 1/7/2024”.

    Soun queries Chief Imam for Hajj trip without notification

    The Soun of Ogbomoso, Oba Afolabi Ghandi Olaoye, has queried to embattled Chief Imam of Ogbomoso, Shiek Taliat Ayilara, for going to Saudi Arabia to perform Hajj exercise without informing him (Soun).

    The traditional ruler in the letter dated 10th June, 2024, said what the Chief Imam did was in contrast with the undertaking he signed before he became the Chief Imam.

    The query was signed by the palace Secretary, Toyin Ajamu, on behalf of the traditional ruler.

    The letter reads: “I refer to the earlier query issued to you with regards to your unbecoming and reprehensible conducts as Chief Imam Agba of Ogbomosoland and the need to desist from such conducts.

    “You will recall that on your appointment as Chief Imam Agba of Ogbomosoland you signed an undertaking and agreement which you agreed will be binding on you.

    “In the said undertaking, you unequivocally undertook to inform the Soun of Ogbomoso before traveling outside Ogbomoso.

    “However, we have been informed that you are currently in Mecca on a Holy pilgrimage without notifying the Soun. This is a clear violation of your undertaking.

    “Secondly, you agreed not to appoint any surrogate during your tenure without the approval of His Royal Majesty, Soun of Ogbomoso.

    “Nevertheless, we have received information that you have appointed a surrogate namely Sheik Abdulrahman Alim Areo as the acting Chief Imam Agba of Ogbomosoland, who led the Jumat Prayer of Friday, 7th June, 2024 of the Central Mosques.

    “This action is a direct breach of your undertakings. As the Soun of Ogbomosoland, I hereby demand that you immediately return to Ogbomoso and rectify these violations and desist from any further actions that violate the the undertakings you signed on the approval of your appointment as Chief Imam Agba of Ogbomosoland.”

    When contacted, The Chief Imam confirmed the development, saying this was not the first time the Soun will issue him a query.

    He said: “Yes. That is what I am confirming for you. He has issued some queries to me in the past. I will send you the documents.

    “This time, he issued the query to me that I didn’t inform him before going to Saudi Arabia.”

    Ayilara Descendants Family, Ogbomoso, has disowned the Chief Imam of Ogbomosoland, Imam Teliat Olushina Ayilara over alleged attacks on the Soun of Ogbomoso, Oba Ghandi Afolabi Olaoye.

    The family described the Chief Imam as an impostor, using social media to allegedly blackmail the Soun of Ogbomoso.

    Speaking with newsmen in Ibadan on behalf of the family, Prince Hassan Ayilara claimed that Imam Olushina has brought disrepute to Imam Ayilara’s family, the prestigious throne of Soun and the image of the entire Muslim Community in Ogbomosoland.

    Ayilara in a reaction to a recent interview granted by the Chief Imam to a newspaper noted that Imam Ayilara’s family of Ogbomoso doesn’t know Imam Teliat Olushina in the family neither he was from Ogbomosoland.

    According to him, there are six recognised Chief Imam families in Ogbomosoland which are Bango, Alawiye, Abogunde, Aduinin, Ile Imam and Ayilara.

    He said Ayilara’s family is not in support of threat calls to Soun of Ogbomosoland and the Chiefs by the Chief Personal Assistant to Alfa Teliat Olushina as reported in an online news platform.

    He said: “We condemned the attacks and molestation by hoodlums in which various properties were destroyed and many seriously injured.

    “Teliat has been sent away from Imam Ayilara’s family quarters of Ogbomoso a long time ago since it was detected that he was an imposter and not the original son of the Ayilara family of Ogbomoso.

    “We state that Imam Ayilara’s family of Ogbomosoland frowns at insults on Soun by Imam Teliat Olushina and against Muslim organisations, individuals, sons and daughters of Ogbomosoland.

    “We dissociate ourselves from his effrontery, we can never be part of that as we hold the Soun of Ogbomosoland in high esteem whose dynasty made our forefathers Chief Imam of Ogbomosoland.

    “It’s unfair on his part to have sued Soun and the Soun-in-Council to court that they had no power to remove him even though they installed him.”

    The effort to reach Imam Olushina for a reaction proved abortive as calls out to his phone did not go through.

    Soun visits Olubadan, says Ibadan very strategic in Yorubaland

    Soun of Ogbomosoland, Oba Afolabi Ghandi Olaoye on Friday, December 22, described Ibadan as very strategic in the affairs of Yorubaland and Nigeria in general, saying the ancient city cannot be ignored for any reason. 

    Oba Ghandi, who was on Tuesday, December 18, installed as the 21st Soun of Ogbomoso, made the remark during his visit to the Olubadan of Ibadanland, Oba Lekan Balogun, at his Alarere, Ibadan residence.

    Accompanied by some of the principal Chieftaincy title holders of the ancient town, including: Are Ago, Iyalode and Abese, the new Soun, who described Ibadan as a home to him, noting that he was born in Catholic Hospital, Oluyoro, Oke-Ofa in the ancient metropolis and lived in Ibadan for 27 years. 

    He noted that the important and strategic position Ibadan occupies in the affairs of Yorubaland made it compelling for him to visit his brother Oba, the Olubadan of Ibadanland. 

    The visit which coincided with the visit by the members of the Karim Adeyemi Foundation to the palace, afforded Oba Ghandi to recall his relationship with the Republic of Germany where the young Karim Adeyemi plays professional soccer with Borusa Dortmund Club and how he had facilitated more than 20 young Nigerians through an MTN programme to play soccer in the country.

    Soun commended Oba Balogun for the peace being enjoyed in Ibadan under his reign, promising to collaborate with him and other brother Obas in the state, especially the three Imperial Majesties, Olubadan, himself and the Alaafin of Oyo to advance the cause of the state in all ramifications. 

    Speaking, Oba Balogun, who expressed delight at the visit said Ibadan belongs to all as recalled by Oba Ghandi and assured him of his readiness to work together with him and their colleagues in the state, stressing that the relationship between Ogbomoso and Ibadan has been for agelong and can only continue to wax stronger. 

    The visit by the Karim Adeyemi Foundation which comprised the young player, Karim, his parents, family members and some of his friends in his football team in Germany, according to Mr. Adeyemi was to ensure that the young Nigerian relates with his roots. 

    He disclosed that the Foundation was set up as a means of the player giving back to the society, Nigeria in particular, noting that the current visit was marked with a football match at the Olubadan Stadium, the previous day where some young Nigerians were empowered. 

    It was also disclosed that through the instrumentality of the Foundation, some Nigerians had been facilitated to soccer playing in Germany just as there was a promise to do more in the years ahead.

    Ecstatic indigenes and residents of Ogbomoso trooped out in large number to participate and witness the commencement of the coronation of Oba Ghandi Afolabi Olaoye as the 21st Soun of Ogbomoso on Thursday, December 14.

    The week-long ceremony kicked off with an empowerment programme for the less-privileged at the town’s palace with a total of 102 indigenes as benefit from N150m empowerment items

    The co-chairman of the Central Coronation Planning Committee, Air Vice Marshal Bolaji Adigun (rtd) commended indigenes for coming out in large number, saying their attendance corroborated Olaoye’s approval by Governor Seyi Makinde.

    Judging by the monarch’s vision for Ogbomoso, he said the people should expect rapid development, urging them to support the new king.

    He advised beneficiaries to utilize the equipment well, warning them against selling the items.

    The empowerment programme was undertaken by the Ogbomoso First Community Initiative (O 1st Group) in conjunction with the Special Project Unit of the Federal Ministry of Works and Housing.

    Items distributed include industrial sewing machines, deep freezers, electric generators, motorcycles and hair dryers.

    The Federal Controller of Housing (Oyo State Field Office) Engr. Gbolahan Adesola said the equipment was a palliative for the less-privileged in Ogbomoso.

    He explained that government’s intention was to assist people by equipping them with tools they need to create wealth. He disclosed that a monitoring team would be deployed to ensure that the tools are well used. If well utilized, he said more would be provided.

    The President, O First Group, Olusegun Adekunle, explained that the group is proactive with the aim of elevating socio-economic development of Ogbomoso. He stressed that the group always makes Ogbomoso’s interest first in everything and works hard to empower indigenes.

    He expressed the group’s gladness in being part of the coronation programme, assuring the monarch of the its support.

    He, however, highlighted the destructive impact of drug abuse among youths in the town as being witnessed in other communities. To address this, he revealed that the group has established a rehabilitation centre in Ogbomoso as a positive move in addressing the challenge.

    He also revealed that the beneficiaries had been trained on the best way to manage and utilize the items. The beneficiaries were drawn from across the five local governments in the town.

    Speaking at the occasion, Oba Olaoye said since his confirmation and installation as the Soun, he has emphasized the comprehensive development of Ogbomoso as his vision. He stressed that his reign would bring just that, stressing that he would collaborate with NGOs and other stakeholders in Nigeria.

    “We commenced this ceremony with today’s empowerment to help people economically. This is just the beginning.” The monarch declared.

    Oba Olaoye expressed satisfaction with the spirit of unity in Ogbomoso, pointing out that the initiative was a testament of the love and commitment of the group. 

    “I call on other groups to emulate their initiative.”

    The monarch also thanked the Federal Government for supporting the project, promising that Ogbomoso people will continue to work with the government to bring development.

    He warned the beneficiaries not to sell the items, promising that anyone found to have sold them would be prosecuted as a thief. He explained that the empowerment was aimed at provoking wealth and job creation as beneficiaries put the items to maximal use in ways that will be multiplied and create employment for others.

    “As the Soun and father of All, I pledge my unwavering support to you and all aspiring entrepreneurs in Ogbomosoland. My doors will always be open to your concerns, aspirations and suggestions. Together, we shall build a thriving community where everyone has the opportunity to achieve their dreams and contribute to the collective good.

    Chiefs, some notable indigenes, academics, market women, drummers and government representatives attended the programme.

    Indigenes of Ogbomoso under community associations are to mark the coronation of the 21st Soun of Ogbomoso, Oba Ghandi Afolabi Olaoye, with a N150 million empowerment project.

    The plan was unveiled yesterday by the Central Coronation Planning Committee while briefing reporters on the coronation schedule in Ogbomoso.

    The ceremony will begin with the empowerment of the poor, needy and vulnerable at the palace on December 14 and end with the actual coronation on December 19 at Ogbomoso Township Stadium.

    Addressing reporters, the committee Chairman, Prof. Adesola Adepoju, said the coronation would hold, following the granting of stay of execution of the High Court judgment, which earlier nullified Olaoye’s selection.

    He said: “I am happy to inform you that the little hitches occasioned by the court proceedings are relatively settled and we are optimistic that all forms of dispute on the ascension to the throne will soon be a thing of the past.”

    The week-long ceremony will also feature an interdenominational service where the General Overseer of the Redeemed Christian Church of God (RCCG), Pastor Enoch Adeboye, will minister.

    Others include a Jumat service, golf tournament, praise and worship concert.

    Adepoju said dignitaries expected include members of the diplomatic corps, traditional rulers, representatives of the government, private sector leaders, as well as notable Ogbomoso indigenes.

    • Alaafin: Court adjourns nine Atiba royal families’ suit against Oyo Govt, Oyomesi

    Activities for the official coronation of the Soun of Ogbomoso, Oba Ghandi Afolabi Olaoye Orumogege III, are scheduled to hold between December 14 and 19.

    This followed approval of motion of stay of execution by the Oyo State High Court against the nullification of the selection process, which enthroned Oba Olaoye.

    A statement by the Chairman of the Central Planning Committee of the Coronation, Prof. Adesola Adepoju, faulted the date published by some media outfits, saying the correct date is December 14-19.

    He appreciated media partners for their support and urged them to seek clarification from the appropriate authority before going to press.

    He said a breakdown of the main event would be made public in few days at a World Press Conference holding soon.

    An Oyo State High Court sitting in Awe, Afijio Local Government, has adjourned hearing of a case filed by the nine Atiba royal families against Oyo State Government and kingmakers in Oyo (Oyomesi), over the vacant stool of Alaafin of Oyo.

    Justice Ladiran Akintola yesterday adjourned hearing till February 27, 2024.

    Justice Akintola said the adjournment was due to the absence of the state counsel.

    Speaking after the adjournment, counsel for the 1st, 2nd and 3rd defendants, Benjamin Ogunleye, said the matter was actually slated for mentioning.

    He said the notice of preliminary objection was filed by the 3rd defendant and the (plaintiffs) would respond to it before the next adjournment day.

    Nine of the 11 royal families had sued Oyo State Government and Oyomesi over alleged marginalisation.

    There is confusion over two seemingly conflicting judgments by Justice K. A. Adedokun of the Oyo State High Court in Ogbomosho.

    It is on the selection and approval of Prince Afolabi Olaoye as the Soun of Ogbomoso land.

    Justice Adedokun, in a judgment delivered on October 3 in a suit numbered HOG/20/2022 between Alhaji Adeyemi Taofiq Akorede Olaoye and Pastor Afolabi Ghandy Olaoye and others, held that the appointment of the first defendant as Soun-elect by the Soun Ogbomoso Kingmakers is valid, legal and binding. 

    He held that the kingmakers are statutorily empowered to carry out the selection/appointment of Soun of Ogbomoso land.

    The judge held: “The selection and appointment of the first defendant by the kingmakers as the Soun-elect in line with the Soun Chieftaincy Declaration conducted on the 22th March 2022 …is the only valid, legal and subsisting selection and nomination as Soun of Ogbomoso land…”

    Less than a month later, Justice Adedokun, in a sister suit marked HOG/27/2022, between Prince Muhammed Kabir Olaoye and Pastor Afolabi Ghandy Olaoye, set aside his earlier judgment and restrained the monarch from parading himself as Soun of Ogbomoso.

    He ordered the monarch to stop holding himself out for any ceremony of installation and /or coronation or wear any regalia portraying him as the occupant of the stool of Soun of Ogbomoso.

    The judge explained: “The decision of this Honourable Court delivered on the 3rd day of October 2023 in Suit No: HOG/20/2022 Between Alh. Adeyemi Taofiq Akorede Olaoye vs. Pastor Afolabi Ghandy Olaoye was made per incuriam (through lack of due regard to the law or the facts) without having the benefit of the Supreme Court decision in Prince Ademolu Odeneye V. Prince David Olu Efunuga(Supra) and Court of Appeal decision in Prince Adeyeye Oyerinde & ORS V. Oba Jimoh Oyewumi.”

    There was, however, some confusion in the interpretation of the two judgments, which sources said will be appealed.

    Some were of the view that the verdicts should be challenged at the Court of Appeal for a clearer understanding.

    It was learnt that the Oyo State Government Secretariat had welcomed the first judgment and plans had begun to hand the Staff of Office to Oba Olaoye Ghandi.

    Some legal experts expressed surprise that the judge overruled himself within a month, claiming the court could no longer deal with issues raised in the second judgment.

    They argued that the judge, being functus officio (lacking the power to re-examine a decision), was no longer in a position to adjudicate on the matter.

    To them, only another court could have applied the rule when faced with two conflicting authorities.

    They fear that while the appellate courts may eventually settle the matter, the State Government may rely on the first judgment and conclude the installation rites.

    It was, however, learnt that the judgment will be appealed.

    A legal team has been assembled to study the two judgments, with a mandate to file a Notice of Appeal, it was learnt.

    The Oyo government had announced Olaoye as the new Soun and made him king on September 8.

    Olaoye was a pastor of the Redeemed Christian Church of God (RCCG).

    Oyo State Government has filed an appeal challenging the court ruling that invalidated the selection and installation of Oba Ghandi Afolabi Olaoye as the Soun of Ogbomosoland.

    It also filed an application for stay of execution pending the hearing and determination of the Appeal Defendants/Applicants against the judgment at the Court of Appeal, Ibadan Judicial Division at the High court.

    The application is also seeking for an order from the Court restraining the Claimant/Respondent by himself or through his servants, agents, privies or otherwise howsoever from taking any step or further step in recognition or in pursuance of

    the Judgment of this Honourable Court, Coram: Honourable Justice K. A. Adedokun delivered on the 25th day of October, 2023 in Suit No: HOG/27/2022 BETWEEN: PRINCE MUHAMMED KABIR OLAOYE V. EXECUTIVE GOVERNOR OF OYO STATE & 11 ORS. in executing the ruling.

    Justice K.A Adedokun on October 25 in his judgment on suit no HOG/27/2023 between Prince Muhammed Kabir Olaoye Vs The Governor of Oyo State and 11 others said that the procedure for the nomination of the Soun of Ogbomoso the 12th Defendant was “ irregular, null and void.’’ for not strictly complying with the provisions of the Soun Chieftaincy declaration of 1958.

    The same judge in a suit no HOG/20/2023 instituted by Prince Taofeeq Akorede Olaoye also challenging Oba Olaoye in which judgment was delivered on October 3, Justice Kareem Adeyimika Adedokun ruled that the procedure was “right, valid and proper.”

    Dissatisfied with the judgment, the appeal filed by Akin Onigbinde SAN and Co in Ibadan on behalf of  Oyo Governor Seyi Makinde,  Attorney General and Commissioner of Justice, Oyo State and Hon. Commissioner  Ministry of Local Government and Chieftaincy matter.

    The notice of appeal dated October 27 is seeking for an order setting aside the Judgment of the Trial Court of 25th October or an order of re-trial before another judge of the Oyo State High Court.

    The six ground of appeal pointed out how the Trial Judge erred in his submission and how the judgment of 25th October, 2023 is against the weight of evidence before the Honourable Court.
