Abiodun’s Supreme Court victory and Ogun’s Renewed Hope

    • By Lekan Adeniran

On Friday January 19, the Supreme Court affirmed the victory of Governor Dapo Abiodun as the Ogun State governor. A five-member panel of the court led by Justice John Okoro held that the Peoples Democratic Party (PDP) governorship candidate, Ladi Adebutu, failed to prove allegations of non-compliance with the Electoral Act during the conduct of the 18 March 2023 elections.

“This appeal is unmeritorious and ought to be dismissed and it is hereby dismissed. The judgement of the Appeal Court is hereby affirmed,” said Tijjani Abubakar who read the lead judgement.

Incidentally, Adebutu’s arrival at a New Year service organised by a former governor of the State was heralded with loud cheers on Sunday, January 17. Videos of the service which flooded the social media presented the false hope that his matter at the Supreme Court would result in him being declared the Ogun State governor. But Governor Abiodun is a man of destiny. The highest court in the land upheld the election that produced him.

It is crystal clear that Prince Abiodun is the Lord’s project and no mortal can stop the march of destiny.

A mandate confirmed is a mandate fully renewed. With a renewed mandate till 2027, Mr. Adebutu and his party, PDP, have no choice but to support the governor in the quest to transform Ogun State. After the judicial rigmarole, Adebutu owes his conscience the moral duty of supporting Governor Abiodun in the quest to turn the Gateway State around. Significantly, the Supreme Court judgment has solidified the legitimacy of Governor Abiodun’s mandate, reinforcing his authority to govern effectively. This ruling has also strengthened the people’s trust and confidence in his leadership, as it demonstrates the judicial system’s endorsement of the election results and affirms the democratic process.

The end to the legal tussle, hopefully, should also bring the much-needed political stability to Ogun State. The prolonged court proceedings have not only been a drain on resources but have also created uncertainty and distractions in governance. This much was attested to by the governor during a Thanksgiving Service to mark his victory at the St. James’ Anglican Church, Iperu on Sunday. He said: “Although this period has brought a lot of distractions, I am relieved that is now behind us, allowing us to fully focus on our unwavering commitment to lead Ogun State to new heights and make it a shining example amongst not just Nigerian states, but other states in Africa.”

One can say unequivocally that the state has never had it so good. Now, the governor can proceed with the implementation of his policies and programmes and push forward with his agenda, with emphasis on good governance, accountability, transparency, and responsiveness to the needs of the citizens. It was fitting enough that the governor’s plane from Abuja after the judgement landed at the Ogun State International Agro Cargo Airport. Ensuring its total completion has been a major plan of the administration. The airport is a legacy project that should be the pride of any administration. The governor has strategically positioned Ogun State to reap the maximum benefits of its contiguity to Lagos. This has no doubt further boosted the state’s economy and ensured its exponential growth. This confirms what a report said last year, namely that Ogun State outperformed Rivers State, a major oil-producing state, on the list of economically viable states for 2022.

Ogun State has consistently ranked among the three topmost revenue generating states in Nigeria since GovernorAbiodun came to office. Continuously positioning the state among the economically viable states is a mission that this administration will pursue to a logical conclusion. The Governor Abiodun-led administration has done well in providing infrastructure across the nooks and crannies of the state. It is heart-warming that currently, there is no local government in the state that has not been touched by the government in terms of road construction, but according to the governor, there’s still room for improvement. With improvement in revenue collection, the governor is poised to continue his infrastructural revolution in the Gateway State. The Agbara-Lusada road and the Sango-Ota-Abeokuta Expressway are some of the projects that the governor has promised to complete during his second term in office. Also in the pipeline is the development of the Olokola Seaport and the Kajola Dry Port. The completion of these projects and many more will further enhance the industrialisation of the state.

To the credit of the Abiodun administration, the ease-of-doing-business index has been consistently high under its watch. This surely will continue as the state maximises its closeness to Lagos. With manufacturing concerns continuously choked in the city of Lagos, Ogun State offers a viable alternative for investors seeking to reap maximum benefits from their investment. The state is now poised to make more progress in various sectors. Governor Abiodun can now work on attracting local and foreign investments, improving infrastructure, promoting agriculture, enhancing healthcare and education, and creating job opportunities, all of which are crucial for the growth and prosperity of Ogun State. Indeed, he has been the state’s “salesman”, as he has been taking advantage of every opportunity to market the potential available in the state to local and foreign investors.

The governor has promised that before the end of his tenure, the electricity outlay he is initiating will give stable power supply across the state. The completion of The Light Up Ogun State project will make the state one of the first set of states to take advantage of the constitutional reform in electricity generation and distribution. This, no doubt, is a great incentive to industries considering relocating or setting up in Ogun State.

Increasingly, more and more Lagos residents are taking the advantage of the closeness to Ogun State to register and renew their vehicles documents. This is a testament to the efficient way Ogun State conducts its affairs. It is also a plus to the growing ease of doing business in the state. Governor Abiodun has done well in the last four years and seven months. The Prince from Iperu will write his name in gold between now and 2027.

He has earned the peoples’ mandate and from observations, he intends to exercise it judiciously. The governor has always promised not to leave any part of the state out in his developmental strides. Citizens are right in having high expectations of his government: the last four years have led them to such expectations. The governor must therefore outperform himself between now and 2027.

Supreme Court affirms Fubara, Kefas, Aliyu victories

The Supreme Court yesterday affirmed the elections of Siminalayi Fubara, Agbu Kefas and Ahmad Aliyu as governors of Rivers, Taraba and Sokoto states.

In three judgments, a five-member panel held that the appellants failed to prove their cases.

The first judgment was on the appeal by Tonye Cole, candidate of the All Progressives Congress (APC) in Rivers.

He prayed to void Fubara’s victory because the election was marred by corrupt practices.

Cole contended that the poll was not conducted in substantial compliance with the Electoral Act 2022.

He also claimed that Fubara did not validly resign his from previous position before the election was held.

Cole alleged that Fubara continued to sign documents as the Accountant-General even after he was nominated as the PDP candidate.

Justice Ibrahim Saulawa, who read the lead judgment, resolved all four issues identified for determination against the appellant.

He held that the appeal was devoid of merit.

The Justice dismissed it and affirmed the judgment of the Court of Appeal, which upheld Fubara’s election.

The second judgment was on the appeal by Muhammad Sani Yahaya of the New Nigeria Peoples Party (NNPP), who sought the nullification of Kefas’ election.

Justice Mohammed Lawal Garba, who read the lead judgment, found that the appeal lacked merit.

According to him, the Court of Appeal was right to have dismissed the appeal on grounds of incomplete record of appeal.

He noted that the part of the record of appeal that was omitted was essential for the determination of the case.

The Justice said the omitted part of the record contained the testimonies of polling unit agents called by the appellants at the trial tribunal in support of their claims relating to invalid votes.

Justice Garba held that there was no way the Court of Appeal could have determined issues raised without the missing records.

He adjudged the appeal unmeritorious, dismissed it and affirmed the judgment of the Court of Appeal which upheld Kefas’ election.

The third judgment was on the appeal by Sa’idu Umar, candidate of the Peoples Democratic Party (PDP) in the Sokoto poll.

Umar and his party had sought to void Aliyu’s election, claiming he and the APC were wrongly declared winners because they did not secure a majority of valid votes cast.

They alleged other malpractices, including that Aliyu submitted forged academic credentials, that he was not qualified and that he did not accompany his Form EC9 with an affidavit as required by law.

In the lead judgment, Justice Tijjani Abubakar resolved all the issues distilled for determination against the appellants.

The Justice held that the appellants failed to prove their claims and dismissed the appeal.

He affirmed the November 27, 2023 judgment of the Court of Appeal, which upheld Aliyu’s election.

Fubara to opposition: join in building Rivers

Fubara expressed gratitude to God, President Bola Ahmed Tinubu and the Minister of Federal Capital Territory (FCT), Nyesom Wike, for his triumph at the Supreme Court.

The governor declared his resolve to remain committed to the purpose for which he was elected, saying nothing would distract his governance.

In a statement by his Special Assistant on Media, Boniface Onyedi, he said: “The Supreme Court revalidation of our mandate is a victory for the entire state.”

“It is important for us to note that we need this victory to consolidate the purpose of governance. We have had a few distractions here and there.

“The good news is a refreshing strength that will encourage us to continue the good works in governance.

“We have a dream of making it a highly competitive state that will measure, if not up to Lagos but close to becoming like Lagos. We can only achieve this in an atmosphere of peace.”

Rivers PDP chapter congratulated Fubara, saying the victory was a reflection of the massive support the governor enjoyed from the people at the poll.

The party, in a statement by its Publicity Secretary, Tambari Sydney Gbara, said: “It is also our conviction that with this judgment and victory, Rivers people will continue to enjoy the dividends of good governance.”

Also, the Rivers State Council of the Nigeria Union of Journalists (NUJ) congratulated Fubara.

In a statement jointly by its Chairman, Stanley Job Stanley and the Secretary, Ike Wigodo, the NUJ described the verdict as confirmation of the people’s trust and mandate freely given to the governor.

“We urge the people of Rivers State, especially the political class, to put all that happened during and after the elections in the state behind them and support the Siminilayi Fubara-led government to succeed and make Rivers a better place for all,” the union said.

Supreme Court victory: UPU urges opposition on unity

Urhobo Progress Union (UPU), Worldwide has implored candidates of parties in Delta State, who challenged the victory of Governor Sheriff Oborevwori up to the Supreme Court, to support him to take the state to greater heights.

Speaking yesterday at a news conference at the Urhobo Cultural Centre in Warri, the President-General of the apex Urhobo body, Chief Ese Gams Esq., congratulated Governor Oborevwori on his victory at the Supreme Court, noting that “the storm is over.”

Also acongratulating the other political parties, which include the All Progressive Congress (APC), Social Democratic Party (SDP) and Labour Party (LP), for contesting the March 18, 2023 election, he urged their candidates to “reason under the UPU body” to be better equipped to assist the governor.

Noting that since the election, Urhobo nation has been “tense and very disturbed,” considering the fact that all candidates were sons of the soil, he said, “it was more or less an in-house fight.”

“As a matter of fact, so many things we had in mind were put on hold after consultation with some stakeholders, particularly the traditional rulers.

“Now, I can say confidently that the storm is over. If the storm is over, we can say too that this news conference is geared towards letting the Urhobo nation know that the cacophony of voices has been collapsed at this particular time.

“We now have a governor on record for four years, God willing, for eight years. If we cannot as an Urhobo body come together, get united in order to move Delta State forward, history will not forgive us.

“Why I said this is because the incumbent governor from the report sheet we are receiving started by hitting the ground running. All these stories about Julius Berger coming to Delta State are stories we never heard before.

“Only about two days ago, somebody said on Facebook that the current governor has not borrowed money to do anything. These are the things we have never seen.

“Having said this, I congratulate the governor. I congratulate all those who contested in the election, PDP, APC, Labour Party, SDP and all because they’re all our sons. We congratulate them,” Gams said.

Stressing the need for unity, he advised Governor Oborevwori to “wholeheartedly” accept anyone who resolves to work with his government.

    • Asks Umbugadu to wait for his turn as age still on his side
    • Massive crowd welcomes triumphant gov to Nasarawa

Nasarawa State Governor, Abdullahi Sule has disclosed that he is done with political contest in his life as he was only interested in becoming Governor of Nasarawa State and not any other political office, not even the President of Nigeria.

Governor Sule advised his opponent, the candidate of the People’s Democratic Party (PDP) David Umbugadu to wait for his turn, since age is still on his side.

The governor stated this Friday while speaking on his victory at the Supreme Court during an interview on Channels Television’s Politics Today.

The Supreme Court had affirmed the re-election of Governor Abdullahi Sule on Friday, dismissing the petition filed by David Umbugadu of the PDP for lacking in merit, though the Governorship Election Petition Tribunal had on 2nd of October, 2023 declared Umbugadu the rightful winner of the 2023 Governorship Election.

According to him “I came in only to be a Governor; I did not come in to be a chairman, a senator or a member of the House of Representatives. I don’t have any dreams for those offices.

“I have no dream of becoming even President; I have no dreams for that. I can tell you categorically that Abdullahi Sule would not go for Senate after leaving office. By the time I finish my eight years, I can do whatever I want to do.”

He explained that, he knew he was going to win his case at the Supreme Court: “I was expecting to win, the reason being that, first at the tribunal, we have three judges; they disagreed with themselves, they couldn’t agree; two of them voted against us, therefore we lost.

“One of them had a very comprehensive report, he voted for us and said we won; so we pick it up from there, went to the Appeal Court, where there were more experienced senior judges and all the three of them unanimously said we won.”

Following the Supreme Court pronouncement, a massive crowd yesterday joyfully welcomed the back to the state.

The massive crowd of supporters, spanning several kilometres, thronged Gudi, the home town of the governor in Akwanga local government to celebrate the victory of their son.

Expressing gratitude at his home town, Governor Sule thanked Nasarawa citizens and supporters for their unwavering support during the litigation which ran up to 10 months.

Governor Sule commended the justices for upholding justice and restoring hope to the people, emphasising his commitment to addressing key issues such as insecurity, poverty, illiteracy, healthcare, and education.

The Governor expressed appreciation to President Bola Ahmed Tinubu for respecting the independence of the political and judicial processes, acknowledging him as a strong leader on the global stage.

Describing Friday, 19th January as a historic day where the Supreme court of Nigeria confirmed and affirmed him as the Governor of Nasarawa State, Governor Sule said: “Today brings to conclusion the long run 10 months exercise of our election, the tribunal, the Appeal Court and finally the Supreme Court. I want to use this opportunity to show great appreciation to the judiciary for confirming us, just like we were declared by the INEC.

Edo 2024: I will get APC’s ticket, win gov election – Ize-Iyamu declares

“I also want to take special opportunity to thank the opposition and appreciate them for testing the principles of democracy.

“I want to specifically thank the good people of Nasarawa State for the tolerance, the patience that they have gone through; it was a very trying moment for most people in order for us to get there. Let me take the opportunity to appreciate our members, the APC for their patience; so today both the victors and those who did not win at the Supreme Court have become one.”

In a related development, the Special Adviser on Politics to Governor Abdullahi Sule of Nasarawa State, Dr. Kassim Mohammed, has warned against distorting information targeted at portraying the image of Nasarawa State in bad light.

According to Mohammed, the era of politics and court cases are over and individuals who have previously recruited and used by opposition parties to carry out campaign of calumny against the person of Governor Sule should stop forthwith.

He described as false the alarm being raised by some sections of the media that portrayed the state as being engulfed in a crisis, following the Supreme Court judgement.

“The yesterday protest by desperate Peoples Democratic Party (PDP) supporters in front of their secretariat, where they burned some tires, should not be misconstrued for state-wide crisis over the court judgment.

“Reporters are warned against spreading fake news that could tarnish the state’s image and incite unjust violence.

“Reporters must verify information before distorting reality, as the new face of government will not tolerate such actions,” he warned.

Following the Supreme Court judgment, the All Progressives Congress (APC) in Kano state has decided to reassess its strategy for the party’s future in the state.

This resolution was reached during a meeting on Friday night in Abuja, where selected stakeholders convened to review the apex court’s decision on the 2023 governorship election dispute between the party’s flag bearer, Dr. Nasir Gawuna, and Governor Abbas Yusuf of the Bew Nigeria Peoples Party (NNPP).

Hopes by the Peoples Democratic Party (PDP) of regaining gubernatorial power in Ogun, Kaduna, Nasarawa, Kebbi and Gombe states ended up in tatters yesterday after the  Supreme Court dismissed claims by the party’s candidates of winning last March’s election in those states.

A similar appeal by the All Progressives Congress (APC) in respect of Delta State was also thrown out by the apex court.

It upheld the election of Governors Dapo Abiodun (Ogun), Uba Sani (Kaduna), Abdullahi Sule (Nasarawa), Muhammad Inuwa Yahaya (Gombe), Nasir Idris (Kebbi) and Sheriff Oborevwori (Delta)

But the decision of the court did not go down well with some PDP supporters  in Nasarawa State, who took to the streets in the capital, Lafia, burning tyres.

The Supreme Court, in deciding the 14 appeals filed in relation to the governorship election disputes in the six states, held that the appellants failed to establish their claims.

Two appeals were filed in relation to Ogun State. The first, marked  SC/CV/1221/2023 instituted  by the candidate of the PDP, Oladipupo Adebutu and the second, a cross appeal, marked  SC/CV/1222/2023 filed by Governor Abiodun

Three appeals were filed  against Oborevwori. The first was by the candidate of the APC, Ovie Omo-Agege marked: SC/CV/1203/2023; second by Kenneth Gbagi of the Social Democratic Party (SDP), marked: SC/CV/1202/2023, third by Kennedy Pela of the Labour Party (LP), marked: SC/CV/ 1204/2023.

Four appeals were filed in respect of Nasarawa by the candidate of the Peoples Democratic Party (PDP), Emmanuel David Ombugadu.

    The appeals were marked: SC/CV/1213/2023; SC/CV/1214/2023; SC/CV/1215/2023, and SC/CV/1216/2023.

For Gombe, one appeal, marked: SC/CV/1226/2023 was filed by the candidate of the PDP, Jibrin Mahammed Barde.

In relation to Kebbi State, three appeals were filed. The first, marked SC/CV/1228/2023 by the candidate of the PDP, Bande Aminu, the second, marked SC/CV/1228A/2023 by Governor Idris and the third, marked   SC/CV/1228B/2023 filed by the Deputy Governor, Abubakar Umar Argungu.

For Kaduna, one was filed by the candidate of the PDP, Mohammed Ashiru Isa, marked  SC/CV/1240/2023.

Justice Tijjani Abubakar authored and read the lead judgment on the appeal by Adebutu.

Justice Abubakar first upheld the notice of preliminary objection filed by INEC and struck out issue four formulated by the appellants – Adebutu and the PDP – on the grounds that it was incompetent.

The judge said, having analysed the other issues raised by the appellants, their supporting arguments, he found that there was nothing substantial to sustain the appeal.

Justice Abubakar held that Adebutu and his party failed to prove their case.

He resolved all the issues raised for determination against the appellants, held that the appeal was unmeritorious and proceeded to dismiss it.

Justice Abubakar affirmed  the majority decision of the Court of Appeal, delivered on November 24, 2023, which upheld Abiodun’s election.

He said, as agreed by lawyers to parties, the judgment in the appeal by Adebutu shall apply to the cross appeal by Abiodun.

Justice John Okoro, who  read the lead judgment on the appeal by Omo-Agege and his party, held that the appellants were unable to prove that the election was invalid by non-compliance.

Justice Okoro found that even if the over 300 ballots disputed by the appellants were deducted from the majority votes scored by Oborevwori, the margin of deference would not be substantially affected.

Justice Okoro held that the appellants failed to discharge the burden of proof placed on them by the law.

He proceeded to dismiss the appeal and upheld the concurrent judgments of the election tribunal and the Court of Appeal.

On the appeal by Gbagi, Justice Mohammed Lawal Garba held that the SDP flag bearer and his party failed to prove their claim that the election was conducted without substantial compliance with the relevant laws and that Oborevwori was not qualified to contest the last governorship election in Delta State.

Justice Garba resolved all the issues raised for determination against the appellants and held that the appeal was without merit.

On the appeal by Pela, Justice Uwani Abba-Aji wondered why the appellants who scored  only 48,047 votes wanted the court to disqualify all the other candidates in the election for them to be declared the winner.

Justice Abba-Aji  resolved all the six issues identified for determination against the appellants and declared the appeal as unmeritorious.

She held that the appellants failed to prove their case as required and proceeded to dismiss it for lacking in merit

On the appeals by Ombugadu and the PDP, Justice Kudirat Kekere-Ekun, who read the lead judgment found that the appellants failed to establish their claims with credible evidence.

Justice Kekere-Ekun said the decision of the Court of Appeal, affirming Sule’s election, was unassailable and could  not be faulted.

She held that the appeals lacked merit and proceeded to dismiss them.

It was only one of the appeals that the court heard. It said its ruling on that one applied to the ones not heard.

In upholding the Gombe Governor’s election, Justice Kekere-Ekun, in the lead judgment, declared  that the appellants failed to show that the concurrent findings of the election tribunal and the Court of Appeal were perverse.

She further held  that there was no merit in the appeal by Barde and dismissed it.

Justice Abba-Aji, in her lead judgment on the Kebbi case, dismissed the appeal by Bande Aminu, who was the candidate of the PDP in the last governorship election in the state.

She found the appellants failed to prove their case and proceeded to hold that the appeal was without merit.

Justice Abubakar, who authored and read the lead judgment in the Kaduna PDP appeal, held that the appeal by the party and its candidate was without merit.

The judge found that the appellants, as petitioners before the election tribunal,  failed to comply with the provision of Paragraph 18(1) and (3) of the First Schedule to the Electoral Act 2022 in relation to the filing of pre-hearing notice at the tribunal.

This, the court said, made the tribunal to hold that their petition was abandoned.

Taking to his X account @ubasanius,the governor said: “The Supreme Court in a unanimous decision today put a final seal on the mandate freely given to me by the good people of Kaduna State.

PDP supporters protest in Nasarawa; Respect Supreme Court’s decision, Sule tells them

Moments after the court ruling, some PDP supporters took to the streets of Lafia to register their displeasure with the development.

They burned tires and blocked the  Lafia -Jos highway, forcing motorists to use alternative roads.

Shops and business centres including schools within the Lafia metropolis shut down abruptly on account of the protest.

However, Governor Sule  told the protesters and other residents of the state to respect the judgement of the Supreme Court

Speaking to State House correspondents after a meeting with President Bola Tinubu ,Sule acknowledged the dissenting views of those unhappy with the verdict.

He said: “Nasarawa is a state where we had over 600,000 votes and we won with over 340,000 votes, so you will know that over 200,000 people did not vote for us. So if out of these 200,000 people that did not vote for us and other set of 1,000 people are protesting somewhere, then you will know because it’s a day that not everybody will be happy.

“In every state where the Supreme Court actually passed judgment, in every one of these states you will find some people are happy and some other people not happy. But I think people who understand what democracy is all about will understand that the Supreme Court is the ultimate and is the final and those who appreciate or respect democracy should actually leave it right there because protests or no protests will not change anything. The Supreme Court has already passed its judgment.

“In our own case, when we lost at the tribunal, we told everybody, nobody should protest and that’s why nobody protested, but that is the level of maturity that you will see from one political party or the other. We are a very mature political party, we’re the ruling party in the country, we’re the ruling party in the state and we’re showing a good example, so that’s why we will not protest.”

Sule who was accompanied on the visit by his two predecessors – Umar Tanko Al-Makura, and Abdullahi Adamu- said: “in line with all the judgments that have been going on in the country, I think first and foremost, we must continue to thank Almighty God for giving us the good health and the opportunity to see the kind of democracy we are seeing. We must thank Mr. President, and that’s what brought us here to the Villa.

“We thank him for the kind of role he continues to play in all of these, by ensuring that fairness is done without undue interference, allowing the justice system to work the way it’s supposed to. So we must express our appreciation to him for doing all that to the good people of Nigeria.

“As far as we are concerned in Nasarawa State, we have won at the court of appeals, unanimously. We also won today with the five justices being led by a panel of the highly respected Justice Kudirat Kekere-Ekun (JSC). So we have to thank Almighty Allah that we also had all the five justices in support of us and that’s why we came.

“All the issues, as far as elections are concerned, are over today. We call on our opponents, without any grudge whatsoever, to come and join with us so we can build our state. Nasarawa State is next to Abuja. Nasarawa State is, today in the North-Central, the only state that has commercial quantity discovery of oil.

“It is the only state, so far, that is building minerals processing plants. We already have one of the lithium factories almost concluded and as you know, it is also a state that we are very lucky where we have agriculture that is flourishing. In fact, on my right hand, is the biggest local farmer that we have in the state and he’s rushing to go back for his harvest because he’s started harvesting.”
