Supreme Court judgment: Time to jettison politics, rebuild Nigeria, says Omo-Agege

Former deputy Senate president, Ovie Omo-Agege, has charged all Nigerians, especially politicians, to get down to the business of rebuilding Nigeria with the final seal on the Supreme Court judgment affirming President Bola Tinubu’s win at the February polls.

Reacting to the judgement that validated and upheld the earlier ruling of the Court of Appeal, the All Progressive Congress (APC) governorship candidate in Delta state said the judgment has effectively ended all jostling on politics and leadership.

In a statement issued by his Media Adviser, Sunny Areh, Omo-Agege stated, “What the Supreme Court did is not just to affirm the validity of President Bola Tinubu’s mandate, but a call to duty. The learned Justices saved Nigeria from unnecessary and prolonged distractions by promptly giving their verdict so that we could get down to the task of rebuilding our country.

He said: “Whatever each of the protagonists may feel, this is not a victory for President Tinubu alone or any political party. This is an admonition for us to collectively work towards fixing Nigeria again.”

He commended the Supreme Court and the entire judiciary for putting Nigeria first and upholding the rule of law.

Omo-Agege noted: “One remarkable feature of our judiciary is that despite all challenges facing the country, despite all seeming uncertainties, our Supreme Court has always displayed an independent and calming disposition on the country. This is one such instance. Our justices must be commended for their service to the country.

“Now is the time to jettison politics and work with President Tinubu to get Nigeria working again. It is now a matter of duty to our people. Alhaji Atiku Abubakar and Mr. Peter Obi, their political parties, and followers should think of Nigeria first, not just because the Supreme Court is the final arbiter but the higher interest of the people whom we are all aspiring to serve, to support, and collaborate with the President to get Nigeria back on track.”

He further thanked Abubakar and Obi for enriching Nigeria’s jurisprudence through their democratic litigations to challenge the election, noting that the electoral process gets better as a result.

Supreme Court judgement affirmation of people’s voice, says Oyebanji

Ekiti state governor, Biodun Oyebanji, has congratulated President Bola Tinubu, on the affirmation of his Presidential election victory by the Supreme Court, in Abuja on Thursday, October 26.

Governor Oyebanji described the triumph of the president at the apex court as “the ultimate judicial stamp on the landslide victory of the All Progressives Congress (APC) flag bearer at the 2023 presidential poll held on February 25, 2023.”

He described the decision of the Supreme Court validating President Tinubu’s win as a victory for democracy, the rule of law, and a landmark judgement in the nation’s electoral jurisprudence that has become a reference point for generations to come.”

In a statement on Thursday by his special adviser on media, Yinka Oyebode, Governor Oyebanji, described the latest judicial victory of President Tinubu as the confirmation of the electoral wishes of the majority of Nigerians who massively voted for the APC as the party of their choice.

Governor Oyebanji said the affirmation of President Tinubu’s victory by both the Presidential Election Petition Court and the Supreme Court has laid to rest all doubts and controversies raised by the opposition about the presidential election.

The Ekiti helmsman advised the People’s Democratic Party (PDP) flag bearer, Atiku Abubakar, his Labour Party (LP) counterpart, Peter Obi, and the presidential candidates of other political parties to join hands with President Tinubu to move the country forward politically, economically and socially in the interest of Nigerians.

He also advised the candidates and parties whose petitions and appeals were not successful at the courts to accept the hand of fellowship earlier extended to them by President Tinubu since there must be an end to litigation after the electorate had spoken with their votes.

Describing election petitions as part of democracy and a better way to ventilate grievances arising from the conduct of polls, Governor Oyebanji said the aggrieved candidates have legitimately explored avenues to seek redress rather than resorting to self-help.

The governor also charged leaders and supporters of the ruling party to be magnanimous in victory while their counterparts in the opposition should accept the outcome of the court verdict in good faith and explore ways to work together with their principals for a united and prosperous Nigeria.

He enjoined Nigerians irrespective of their political, ethnic, and religious leanings to support President Tinubu’s vision to positively turn around the fortunes of Nigeria through his Renewed Hope agenda now that his election has been confirmed as legitimate by the apex court.

The governor stated: “This is a victory for democracy and the rule of law. On behalf of the Government and good people of Ekiti State, I congratulate President Bola Ahmed Tinubu, the leadership of our party, APC and Nigerians as a whole on this victory. • Supreme Court: Tinubu scored highest votes in 2023 election, says Justice Inyang Okoro

Supreme Court: Tinubu scored highest votes in 2023 election, says Justice Inyang Okoro

The Supreme Court of Nigeria on Thursday, October 26, said that President Tinubu had the highest votes in the 2023 presidential elections, adding that Atiku Abubakar and Peter Obi were unable to prove that they secured a higher number of votes than President Bola Tinubu in the 2023 presidential election.

This was stated by the Supreme Court when ruling in favour of President Tinubu in an appeal filed by the appellants contesting the verdict of the Presidential Election case Court, which had dismissed his case challenging Tinubu’s election.

In his decision on Atiku’s appeal, the panel’s presiding justice, John Okoro, stated that nowhere in the appeal did the appellant identify a specific number of votes he received in the election to counter Tinubu’s score and establish that his score was not entirely allotted to him.

The Supreme Court upheld the election petition court’s judgment where it stated that “the table referred to by the petitioners is the table of results declared by the first respondent. There is no other set of results placed before this court by the petitioners to form the basis of our finding or the fact as to whether the declared results are wrong or not.”

It said: “Success or failure in an election depends on figures which is in turn depending on votes garnered by each candidate.

“So, where the complaint in an election petition is that the candidate returned did not poll the majority of the highest votes in the election, as contended here by the petitioners, not only must the figure disputed be pleaded, the figures or votes the petitioner perceives as correct figures of the election ought to and must be pleaded.”

The Supreme Court also affirmed the ruling of the election petition court, which noted that “Section 134(2) of the 1999 Constitution talks of the highest number of votes cast at the election if the contest was among more than two candidates as in the instance case, not majority of votes cast as propounded by the petitioners.

He said: “The first respondent was therefore right from the results declared by her in the absence of any rival or alternative results placed before this court by the petitioners; that the second respondent who scored 8,794,726 votes as against 6,984,225 votes scored by the petitioners in the election, scored the highest number of lawful votes cast in the election.”

Justice Okoro therefore said that the ruling of the election petition court “represents the correct position of the law and I wholly endorse the same.”

The Independent National Electoral Commission (INEC) on March 1 declared Tinubu of the ruling All Progressives Congress (APC) as the president-elect, according to the commission, Tinubu, a former Lagos State governor, polled a total of 8,794,726 votes to defeat his closest challengers, Atiku who scored a total of 6,984,520 votes and Peter Obi of the Labour Party (LP) who scored a total of 6,101,533 votes.

Justice Inyang concluded saying, “Nowhere, definitely, not from the evidence on the record and that is why this issue is resolved against the appellants.”

BREAKING: Supreme Court judgement disappointing, says PDP

The Peoples Democratic Party (PDP) has reacted to the Supreme Court verdict affirming President Bola Tinubu’s victory in February 2023.

Atiku Abubakar of the PDP and Labour Party (LP)’s Peter Obi had appealed the verdict of the Presidential Election Petitions Court (PEPC) which upheld Tinubu’s win.

But the apex court on Thursday dismissed their appeals, saying they lacked merit.

A statement signed by the National Publicity Secretary, Hon. Debo Ologunagba described it as disappointing and “thrashed” the expectations of Nigerians.

It said: “The Peoples Democratic Party (PDP) is appalled by the judgment of the Supreme Court in the petition filed by the PDP and Presidential Candidate, Atiku Abubakar against the declaration of the All Progressives Congress (APC) @OfficialAPCNg and Bola Ahmed Tinubu @officialABAT as winners of the February 25, 2023 Presidential election by the Independent National Electoral Commission (INEC).

It accused the Supreme Court of condoning “serious issues of forgery, falsehood and perjury on the altar of technicalities.

“The PDP and indeed majority of Nigerians are alarmed, disappointed and gravely concerned with the reasoning of the Supreme Court which the PDP believes is against the express provisions of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the Electoral Act, 2022, the Guideline and Regulation issued by INEC under which the election was conducted.

“The PDP asserts that it is indeed a sad commentary for our democracy that the Supreme Court failed to uphold the provisions of the law. Instead, it trashed the expectation of majority of Nigerians who looked up to it as a Temple of Impartiality to deliver substantial justice in the matter having regards to the laws and facts of the case.

“Nigerians earnestly expected the Supreme Court to uphold and defend the clear provisions of the 1999 Constitution in terms of qualification and minimum requirement for a winner to be declared in a Presidential election in Nigeria especially with regards to the required statutory 25% of votes in the FCT as well as issues of violation of electoral Rules and Guidelines, brazen manipulations and alterations of election results by the APC.

“Nigerians are still at a loss as to how the Supreme Court condoned the serious issues of forgery, falsehood and perjury on the altar of technicalities.

“The general gloom, melancholy and sense of despondency across the country upon the delivery of the judgment is an ominous sign of eerie situation which portend grave consequences because of the disappointment embedded in the judgment.

“This judgment by the Supreme Court has evidently shaken the confidence of Nigerians in the judiciary, especially the Supreme Court as the last hope of the common man.

“The PDP remains undeterred and charges Nigerians not to be discouraged or allow the judgment to detract from their collective quest for the entrenchment of a credible electoral system that can guarantee a government that truly derive its legitimacy from the people.”
