    N500m debt recovery: Committee suspends SAN

    The Chief Justice of Nigeria (CJN), Justice Maryam Aloma Mukhtar, yesterday led the Legal Practitioners and Privileges Committee to suspend a Senior Advocate of Nigeria, Chief Ajibola Aribisala, pending the final disposition of a petition against him in a N500million debt recovery for Fidelity Bank Plc.

    Aribisala will lose the privileges he has been enjoying in court as a SAN.

    The committee took the decision after a two-hour session in Abuja where the petition against Aribisala was considered.

    According to sources, the CJN and the committee wielded the big stick as part of the ongoing reform of the nation’s Judiciary.

    It was learnt that Justice Mukhtar has vowed not to condone any act of misbehaviour from the bench and the bar.

    Fidelity Bank Plc said it engaged Aribisala to recover a N500million debt, but he allegedly unilaterally deducted N163million as his fee without the knowledge of the bank.

    The bank also alleged that the debt was recovered in two tranches of N300million and N200million.

    The petition also claimed that when the first tranche of N300million was recovered, Aribisala allegedly kept the bank “in the dark” until it got to know of it from another source.

    A source said: “Despite that a counsel is entitled to his fee, there must be full disclosure, which Aribisala was alleged to have violated.

    “When the issue came up, the suspended SAN went to court to stop any attempt to look into the complaints against him.

    “The Privileges Committee established a prima facie basis to conduct an investigation into the conduct of Aribisala. It is on this premise that he has been suspended. The suspension is indefinite until the case is disposed of.

    “If it involves engaging anti-graft agencies, the Privileges Committee will do so to get to the root of the matter.

    “At the session, the CJN said she would not compromise on the ongoing reforms in the Judiciary. She said all SANs must be prepared to live above board or else they would face disciplinary action.

    “She told members of the committee that ‘the era of impunity is gone.”’

    It was also learnt that the committee is awaiting an application from a former Minister of Justice, Mr. Mike Aondoakaa, for a reprieve and restoration of his rank as a SAN.

    The source added: “Although by now Aondoakaa ought to have finished serving his suspension, he still needs to write the committee to restore his SANship.

    “We are awaiting his application. But he has comported himself well throughout the suspension.”

    Others at the session were the Deputy Chairman of the National Judicial Council (NJC), Justice Mahmud Mohammed; the Acting President of the Court of Appeal, Justice Zainab Bulkachuwa; the Attorney-General of the Federation, Mr. Mohammed Bello Adoke (SAN); six chief judges representing each of the nation’s geopolitical zones and representatives of the Nigerian Bar Association.

    NBC suspends licence of Kano Wazobia FM

    The National Broadcasting Commission has suspended the Kano Operating Licence of Globe Broadcasting and Communications Limited, owners of Wazobia FM in Kano, Kano State.

    The suspension is contained in a statement issued in Abuja on Friday by the commission’s Head of Public Affairs, Malam Awwalu Salihu.

    The statement explained that the suspension was in continuation of the steps taken by the commission following the broadcast of an episode of the programme – Sandar Girma.

    It said the programme was found to have breached Section 3.9.1 of the Nigerian Broadcasting Code which prohibits the use of language encouraging crime or disorder.

    “Section 3.9.1, for instance, stipulates that: language or scene likely to encourage or incite crime, or lead to disorder, shall not be broadcast.”

    It said that the commission has formed the opinion that the station had been used in a manner that was detrimental to national interest.

    The statement ordered the station to go off air with ‘immediate’ effect until further notice.

    “The commission has, therefore, decided to suspend the licence of the station in accordance with sections 10 (d) and 14 of the Third Schedule of the National Broadcasting Act, CAP N11, Laws of the Federation, 2004, until further notice,” it said.

    NJC suspends Justices Naron, Archibong

    The National Judicial Council (NJC) has recommended the compulsory retirement of Hon. Justice C. E. Archibong of the Federal High Court Lagos and Hon. Justice T.D. Naron of the Plateau State High Court.

    The NJC, chaired by the Chief Justice of Nigeria (CJN), Justice Aloma Mariam Mukhtar, took the decision at its emergency meeting held on Wednesday in Abuja.

    The two judges have been placed on suspension, the council said in a statement issued in Abuja yesterday by its Acting Director (Information), Mr. Soji Oye.

    This is in line with its disciplinary powers under the 1999 Constitution, as amended.

    The council has also “set up a ‘Fact Finding’ Committee to investigate the allegations levelled against Hon. Justice Abubakar Talba of the FCT High Court in the Police Pension case of EFCC vs Mr. John Yusuf & Ors.”, the statement said.

    Justice Talba sentenced Yusufu to a two-year jail term after he (Yusuf) had pleaded guilty to a three-count charge in the N32.8 billion police pension fraud. The jail term is to run concurrently.

    The Judge, however, gave the convict an option of N250,000 fine for each of the three counts. The sentence sparked negative criticisms of the judge.

    Justice Naron chaired the first Osun State Elelction Petition Tribunal, which affirmed the victory of former Osun Governor Olagunsoye Oyinlola in the petition of the Action Congress of Nigeria (ACN) and its candidate, Governor Rauf Aregbesola.

    The Court of Appeal, Ibadan, later sacked Oyinlola and declared Aregbesola winner of the May 2007 election.

    Following a petition by a counsel to Aregbesola’s counsel, Mr. Ajibola Basiru, that the tribunal headed by Justice T.D. Naron was embroiled in call logs controversy with the lead counsel to Oyinlola, Kunle Kalejaiye (SAN), the NJC raised a team to investigate the allegation.

    Despite Basiru’s request for the tribunal members to disqualify themselves from the trial, the judges went ahead to deliver judgment on the case on July 15, 2008.

    The Council also received another petition against the judges on February 4, 2011 from Basiru.

    The NJC said “Justice T. D. Naron of High Court of Justice, Plateau State was recommended for compulsory retirement to Governor David Jonah Jang sequel to the ‘Findings’ by the Council that there were constant and regular voice calls and exchange of mms and sms(text) messages between Hon. Justice Naron and one of the lead counsel for one of the parties to the suit in the Osun State Gubernatorial Election Tribunal, contrary to the Code of Conduct for Judicial Officers of the Federal Republic of Nigeria vide Section 292(1((b) of the 1999 Constitution of the Federal Republic of Nigeria as amended.

    The statement added: “Hon. Justice Archibong was recommended for compulsory retirement to President Goodluck Ebele Jonathan, GCFR pursuant to the ‘Findings” by the Council on the following Complaints levelled against him:-

    *That the Judge dismissed the grievous charges against an accused without taking his plea;

    *That he refused to release the Certified True Copy of his ruling to the lawyers;

    *That the Judge issued a bench warrant on some officials of Peoples Democratic Party for contempt even when the counsel who was directed by the Court to serve them filed an affidavit that he had not been able to serve the contempt application;

    *That he made unfounded and caustic remarks on professional competence of some Senior Advocates of Nigeria;

    *That there were glaring procedural irregularities which showed that Hon. Justice Archibong did not have a full grasp of the Law and procedure of the Court; and

    *That he granted the leave sought for in the originating summons that had no written address of the parties and without hearing both parties in the originating summons after he had earlier on overruled the preliminary objection.”

    The News magazine broke the story of the strange call logs, which it supported with call logs of one of the GSM service providers, MTN.

    In its edition dated July 14, 2008, The News reported that Oyinlola’s lead counsel at the Osun First Election Petitions Tribunal, Otunba Kunle Kalejaiye, had several telephone conversations with two of the judges on the tribunal, including the chairman, Justice Naron.

    According to the report, telephone call records of judges at the Osun tribunal and Kalejaiye pointed to a plot to subvert justice.

    The report showed that Kalejaiye and Justice Naron were exchanging text messages even when the panel was sitting and this, said the magazine, took place at times when Justice Naron wanted to hint Kalejaiye about issues to object to.

    After the report came out, the Osun State Government was the first to respond, defending Kalejaiye.

    In one of the petitions to the NJC, two members of the tribunal, Justices Naron and Ekanem, were specifically mentioned.

    The affected SMS and MMS of the judges were from mobile number 08037035105 and 08073160534 (belonging to Justice Naron); 08034105705 (belonging to Justice Ekanem); 08034062075 (belonging to Kunle Kalejaiye, SAN); 08034037521(belonging to Niyi Owolade-ex-Attorney-General of Osun State); and 08066572719(belonging to Sade Alaba Adewunmi—the Interpreter to the tribunal).

    In a statement, Oyinlola’s Special Adviser on Media, Mr. Lasisi Olagunju, said that the governor did not enter into any kind of deal with the judges.

    Olagunju described as false, claims that Kalejaiye was the linksman between the judges and the governor.

    The statement said: “These characters exposed themselves further by forgetting to edit out the MMS entries in the logs which they displayed under a headline claiming they were calls from one of the judges. Every literate person knows that MMS means Multi Media Service, which is used to send pictures. Now, the question is: was the poor judge also sending pictures to lawyer Kalejaiye?

    “They even claimed that the judges, who were recording verbatim the proceedings of the tribunal with long hands, were sending text messages to Barrister Kalejaiye while the court was sitting. One would want to ask if the judges have more than two hands?”

    Kalejaiye later caused to be published a statement from MTN stating that it was not the source of the call logs.

    In the statement, which accompanied the MTN letter, Kalejaiye said he was going to sue the magazine. He also attempted to cast the magazine in the mould of an agent of falsehood.

    He made reference to an instance where the magazine’s management had to apologise to him over a case settled out of court. He also said that the call logs showed that the magazine alleged that he was making calls to himself.

    The SAN threatened to sue the magazine and that he would not settle out of court this time around.

    The management of The News responded to issues raised by Kalejaiye. One, the magazine said that it never claimed MTN gave it the call logs. It also explained that Kalejaiye’s claim that the call logs showed that he was calling himself was a mere error, which had been corrected on the magazine’s website as at the time he made his statement.

    The magazine also explained that the case Kalejaiye referred to, which was settled out of court, involved Senator Iyiola Omisore, former deputy governor of Osun State.

    According to the magazine, it agreed to settle out of court because its key witness chickened out at the last minute and that it had nothing to do with being an agent of falsehood. It went on to challenge Kalejaiye to go to court if he was sure of himself.

    The leadership of the Action Congress of Nigeria (ACN) in Alimoso sub-zone, Lagos State, has suspended a chieftain of the party, Alhaji Fatai Sodimu, for anti-party activities.

    Sodimu was accused of fraternising with the Peoples Democratic Party (PDP).

    The Alimoso Federal Constituency Leadership Forum announced Sodimu’s indefinite suspension after an emergency meeting attended by the Commissioner for Information and Strategy, Mr. Lateef Ibirogba; House of Assembly member Mr. Bisi Yusuf; former Special Adviser to the Governor on Establishment Mr. Femi Adebanjo; six council chairmen and party chairmen from the sub-zone, women and youth leaders. The suspension has been communicated to the State ACN Chairman, Otunba Oladele Ajomale.

    Sodimu denied the allegations, saying he did not in any way undermine the party.

    He accused Alimoso ACN leaders of gross insubordination, indiscipline and incitement of members against the party’s leadership.

    Sodimu is a former chairman of Alimoso Local Government Council. He defected from the PDP to ACN in 2007. ACN leaders in Ward E, Egbe Idimu Local Council Development Area (LCDA), alleged that he was hobnobbing with PDP chieftains. He was invited to defend himself but he shunned the invitation.

    ACN Chairman in Egbe-Idimu Chief Solomon Ogundola said Sodimu’s suspension was in good faith, adding that members should learn to conform with the party’s rules.

    Ogundola said Sodimu’s suspension by the ward leadership was only ratified by the constituency leaders.

    Catholic Church suspends relationship with CAN

    The Catholic Church, in Nigeria has suspended relations with the Christian Association of Nigeria (CAN).

    The church said its decision to temporarily “pull out “of CAN, was informed by the national Christian body’s alleged undue romance with the Federal Government.

    The Catholic Church added that it was suspending its relations with CAN because the body, under its present leadership, headed by Pastor Ayo Oritsejafor was moving in a different direction from CAN’s laid down objectives.

    CAN expressed indifference to the news. It said the Catholic Church was at liberty to leave the national Christian body. It blamed the Catholic Church’s action on the loss of CAN’s presidency to Pastor Ayo Oritsejafor.

    Also, a member of the Senate Committee on Culture and Tourism, Senator Babafemi Ojudu hailed the Catholic Church for its decision to pull out of CAN.

    He urged others not comfortable with the leadership pattern in CAN to emulate the Catholic Church.

    The Catholic Church’s Director of Communication, Reverend Father Ralph Madu and the Administrator of the Catholic Diocese of Abeokuta, Monsignor Christopher Ajala confirmed their church’s severance of relations with CAN.

    Madu said the Catholic Church in the country is still part of CAN, but the temporal withdrawal was just to settle their differences.

    Ajala, at a conference in Abeokuta said the decision was taken as a result of what the church termed as the undue closeness of the Christian umbrella body to government, especially at the national level.

    Ajala alleged that CAN under Pastor Ayo Oritsejafor was moving in a different direction from its laid down objectives. He said Catholic is still part of CAN at the state level.

    The Public Relations Officer of the 19 Northern States of CAN and Abuja, Sunny Oibe also accused Catholics of arrogance. He spoke with reporters last night in Abuja.

    “There is no division in CAN and we are all speaking one language.

    “There is no need for anybody to lose sleep over the threat by Catholics to pull out of CAN because without them CAN will still continue. The constitution of CAN makes provision that membership can be terminated by any group that is misbehaving or any group can also terminate their membership.

    “Why is it that when Catholics were in the leadership of CAN, every bloc supported them but now because power has changed hands, they are threatening to pull out and causing confusion?”

    “They have been agitating that the Presidency of CAN must come from the South. They are an appendage of PDP and PDP itself. They are known for double standards. A man of God should not be double speaking,” he said.

    Oibe, who is also the spokesperson of the President of “Tarayar Ekklisiyar Kristi A Nijeriya (TEKAN )”, a conglomeration of 13 church groups in CAN, said Catholics should not mislead the public even if they want to pull out.

    “The Catholics are claiming that the current CAN leadership has deviated from the vision of the founding fathers when they don’t even know how CAN came about. What did the Catholics know about the vision of the founding fathers?

    “CAN was formed because of the neglect of Christians in the North. The Christians in the North, particularly those from the TEKAN extraction came together and formed Northern Christian Association. It was that body that metamorphosed into CAN,” he said.

    He alleged that during Olusegun Obasanjo’s administration, when CAN was to be registered, “the leadership was given to them because Catholics were in leadership; I want to correct that impression because they have been telling the world that they are the founding fathers of CAN.”

    Oibe said: “Catholics have accused the present CAN leadership, led by Pastor Ayo Oritsejafor of being pro-government. But if you look at the whole scenario, you will be able to find out who between Oritsejafor and Onaiyekan is closer to government.

    “The problem of Catholics is that they always display arrogance in knowledge. They don’t want to be under anybody but they want everybody to be under them. It doesn’t work like that because there is no seniority in CAN, “Oibe said.

    Ojudu said the church ought to serve as a corrective body to those in power and not as their buddy. He said the Christian body in the country had not done enough in condemning the wrongs allegedly being perpetrated by political leaders in the country.

    He said Nigerian pastors should emulate Reverend Martin Luther King Jnr, who brought about change in the United States through non-violent means.

    Ojudu, representing Ekiti Central, urged other churches who believe that their leadership is dragging them into the mud to do the same if several appeals to them to turn over a new leaf fail.

  • Ondo PDP suspends Bada

    The State Working Committee (SWC) of the Peoples Democratic Party (PDP) in Ondo State has suspended a chieftain of the party, Dr. Oluwadare Bada.

    It said the former Director-General of the Olusola Oke Campaign Organisation (OOCO) was suspended for ignoring the party’s directive to explain certain issues concerning his position as OOCO Director-General.

    In a statement, PDP Publicity Secretary Wale Ozogoro said: “The party invited the director several times to answer questions on the campaign expenditure of the October 20, 2012, governorship election to no avail.

    “The party frowns at Bada’s anti-party activities and vituperations in the print and electronic media. The working committee has set up a disciplinary committee in line with the party’s constitution to look into these allegations and submit its report within two weeks.”

    Bada’s suspension letter was signed by the party’s Secretary Chief Oyedele Ibini and delivered personally to him.

    The Peoples Democratic Party (PDP) in Ogun State yesterday suspended four of its members in Ogun West Senatorial District for alleged anti-party activities”.

    They are former member of the House of Representatives Kazeem Salako; former Commissioner for Forestry Resources Alhaji Alli Ajibode; former Special Adviser to former Governor Gbenga Daniel, Chief Wale Egunleti and former Chairman of Yewa North Local Government Olusoji Eweje.

    In a statement yesterday, the party’s Publicity Secretary, Mr. Waliu Oladipupo, accused the estranged party members of flirting with the opposition.

    He said: “The suspended persons have been fraternising with opposition parties while pretending to be with us. The suspension will last 30 days, within which they are expected to appear before the party’s disciplinary committee.”

    Amosun suspends council chair, others

    Ogun State Governor Ibikunle Amosun yesterday suspended the Chairman of Ijebu East Local Government, Mr. Patrick Ogunde, the vice-chairman and councillors.

    A statement by the Secretary to the State Government, Mr. Taiwo Adeoluwa, gave no reason for their suspension.

    The government said it was in line with Sections 39 and 43 of the Ogun State Local Government Law, which approve the suspension of the Executive and Legislative arms of the councils for 90 days by the governor.

    The government has constituted a Panel of Enquiry to look into issues that led to the suspension. It will submit its report within 14 days.

    The panel members are Chief Wole Adesiji (Chairman), Mrs. Ayoola Afolabi, Mr. Bayo Adeyemi and Mr. James Omotosho of the Ministry of Justice (Secretary).

    The Head of the Local Government Administration (HOLGA) has been directed to manage the council’s affairs.

     

  • Ogun suspends 1,024 fake teachers

    The Ogun State Government has suspended 1,024 teachers for forged certificates and other irregularities.

    According to the report of CITC Consulting, the firm employed by the government to audit the teacher’s certificates, 475 teachers were suspended for possessing forged certificates, 274 for not appearing for the screening, 236 for being unqualified, 12 for exceeding the statutory length of service and 11 for age discrepancies.

    Two of those suspended were considered to be impostors and 14 were found to be dead.

    Chairman of the State Universal Basic Education Board (SUBEB) Chief Mufutau Ajibola said the suspension takes immediate effect, pending the formal determination of the cases by the panel raised in the Office of the Head of Service.

    He said the names of the offenders and the documents they presented to the government are being compiled for presentation to the police.

    Ajibola restated the government’s determination to flush out persons “polluting the noble and respected profession”.

    Commissioner for Education, Science and Technology, Segun Odubela said: “The exercise is about quality assurance of our human capital. All our investments to provide affordable quality education will only yield result if we have well qualified and motivated teachers in our classrooms.”

  • Ogun PDP suspends Olurin, four others

    THE Chief Adebayo Dayo-led Executive Committee of the Peoples Democratic Party (PDP) in Ogun State yesterday suspended the parallel Executive Committee Chairman, Senator Dipo Odujinrin and four others backing his “illegal office”.

    Others are the party’s candidate in the 2011 governorship election, Gen. Adetunji Olurin (rtd.); PDP National Auditor Bode Mustapaha; Mr. Dapo Adeyemi and Mr. Yahaya Ahmed.

    In a statement by its Secretary, Mr. Semiu Sodipo, the Dayo-led executive said the suspension was in accordance with Article 21.1 a, b, f, h, j and Article 21.4 of the party’s constitution.

    It accused the suspended members of indulging in “excessive, illegal and provocative actions”.

    The statement reads: “All legal pronouncements by the Federal and State High courts have clearly stated that the Dayo-led executive remains the only PDP executive in Ogun State until March, 2016.

    “It is public knowledge that the impostor Odujinrin group invaded the state’s party secretariat with armed thugs to intimidate officers and staff of the party. All efforts to get the police and the State Security Service (SSS) to redress this anomaly to date have proved abortive.

    “The Odujirin group has been undermining the legitimate function of the Dayo-led executive by taking illegal actions in violation of the reconciliation efforts by the hitherto separate groups belonging to the former Minister for Commerce and Industry, Senator Jubril Martins-Kuye, former Governor Gbenga Daniel and Prince Buruji Kashamu.

    “It is hoped that this disciplinary action would rein in other divisive tendencies in the party and enhance the ongoing reconciliation and integration of the major groups.”

    The Publicity Secretary of the Odujinrin faction, Mr. Bidemi Osunbiyi, said his faction has in turn suspended Kashamu, Dayo, Chief Pegba Otemolu, Sodipo and Mr. Segun Sowunmi.

    Osunbiyi said: “The suspension is for 30 days, during which they will face the State Disciplinary Committee to answer to the charges against them.”
