    Bayelsa citizens don’t deserve Sylva, says Diri

    The People Democratic Party’s (PDP) candidate for governor, Douye Diri, claims that Timipre Sylva of the All Progressives Congress (APC) incites violence during election campaigns.

    The off-cycle governorship elections are currently held in Bayelsa, Imo, and Kogi states.

    After casting his ballot in his LG, Diri spoke with the media and expressed his satisfaction with the way the election was handled at his polling place.

    He said: “INEC has improved from the last election, voting was fast, smooth, and seamless.”

    The governor expressed his party’s worry that its representatives and observers were unable to enter Nembe LGA.

    He said PDP has written an official letter to the chairman of INEC on the matter.

    He said: “They have to take drastic measures to allow our people to go in there to monitor the voting process. What we call for is a free and fair electoral process. Let accreditation of voters in Nembe be done by the BVAS as I have done here today.”

    Speaking further, Diri accused Sylva of winning elections through violence, adding that the people of Bayelsa do not deserve a violent governor.

    Diri said: “Timipre Sylva has been a violent person in every election. If you recall, the leader of the Ijaw nation, elder Edwin Clark, wrote a letter to him on why he refused to drop his forceful and violent way of winning elections. However, God is on the throne and we’re standing against him in his violent way of winning elections.

    “Recall that his deputy in Brass LG threatened our party members that if any is sighted, they should be thrown into the Atlantic Ocean and that they’re not the first people to die and you’ll agree with me that pair is a violent pair and that’s not what the people of Bayelsa deserve.”

    The Court of Appeal in Abuja has dismissed an appeal seeking to prevent former Minister of State for Petroleum Resources, Timipre Sylva from participating in today’s  governorship election in Bayelsa State.

     In a judgement on Thursday evening, a three-member panel of the Court of Appeal held that the appeal brought by Hon Isikima Ogbomade Johnson was without merit.

    In the judgement read by Justice Binta Zubar, the court held that the subject matter of the case was non-justiceable, adding that the case was brought in bad faith.

    The court upheld Sylva’s argument that it cannot be said that he took the oath of office as a governor twice because his first election as governor of Bayelsa State was voided by courts which informed why another election was conducted,and he won.

     The Court of Appeal, in the judgment on the appeal marked CA/ABJ/CV/1052/2023, rejected the appellant’s claim that the primary election conducted by the All Progressives Congress (APC) on April 14 which produced Sylva as the party’s candidate, was held without compliance with relevant laws.

    The appellate court held that the overwhelming evidence presented by the Independent National Electoral Commission (INEC) and the APC showed that no legal provision was violated  in the conduct of the primary.

    It added that with the undisputed evidence coupled with the monitoring report produced by INEC, the allegations by the appellant that Sylva emerged from a flawed  primary election was unfounded.

    The court said: “From the uncontroverted independent report of INEC, it was clear beyond any doubt that a valid primary election was conducted by APC and monitored by the electoral umpire as required by law.”

    It also held that the case of the appellant was statute barred having been instituted outside the 14 days allowed by law as a pre- election matter.

    The Court of Appeal proceeded to uphold the judgment of a Federal High Court in Abuja delivered by Justice Inyang Ekwo which on September 26 dismissed  the suit by Mrs. Johnson for lacking in merit and substance.

    The Court of Appeal also imposed a cost of N1million against the appellant.

    Mrs. Johnson had, by an originating summons, sued the APC, INEC and Sylva before the Federal High Court, praying for an order to disqualify Sylva from today’s governorship election on the grounds that he had been elected into governorship office twice and took the oath of office and oath of allegiance twice.

    She also claimed that the April 14 primary election that produced Sylva was illegal and unlawful, having been allegedly done in contravention with APC’s guidelines.

    Vice President Kashim Shettima has called on the people of Bayelsa State to rally behind the candidate of All Progressives Congress (APC), Chief Timipre Sylva, in order to connect the state to the centre.

    Shettima who was in Yenagoa for the grand finale of the APC governorship campaign on Wednesday evening, said President Bola Tinubu was ready to work with Sylva to tackle youth unemployment.

    He urged the people to vote massively for Sylva to continue the good work he had started in the state.

    He reiterated President Tinubu’s commitment towards the overall development of the Niger Delta as well as other parts of the country.

    He noted that Bayelsa State, like every other state in Nigeria, remained dear to the vision and developmental focus of the Tinubu administration.

    The Vice President said: “My Principal, our President is a man filled with vision, will power and total commitment to the Nigerian project. He is unwavering and in a rush to ensure the speedy development of the Niger Delta and all other parts of the country.

    Ahead of  November 11 governorship election in Bayelsa State, the camp of Governor Douye Diri, the candidate of the Peoples Democratic Party (PDP) and All Progressives (APC)  standard bearer,  Chief Timipre Sylva have clashed over allegations of violence and thuggery.

    A group loyal to Governor Diri, the Concerned Bayelsa Elders and Stakeholders for Democracy (CESD) alleged that the immediate past Minister of State for Petroleum Resources had  sown fake police uniforms that would be worn by  militants and thugs to do his bidding.

    This is just as Sylva accused the Diri’s administration of buying guns for militants and importing gunmen from neighbouring states to cause mayhem.

    The CESD, after rising from an emergency meeting in Yenagoa, the state capital, claimed that it had come to their knowledge that Chief  Sylva,  is set to use violence as a tool to circumvent the electoral process in the forthcoming poll.

    The Public Relations Officer, CESD, Chief Timiebi Okiriyan, alleged that the APC candidate had already sown fake police uniforms that would be worn by the militants and thugs which he had flooded the state with to do his bidding.

    The CESD spokesman said it was against that backdrop and fearing a repeat of the 2015 mayhem in Southern Ijaw that the group is sending the alarm to security agencies and the general public about Sylva’s plans and the need for all, particularly the Police, to be on the alert to arrest the ‘’fake policemen wherever in the state they are identified on election day.’’

    However, Sylva, who spoke through his Media Adviser, Julius Bokoru, stated that the allegation is “dead on arrival” and that the APC candidate, being a law-abiding citizen would never be involved in anything that would tarnish the democratic image of the country or Bayelsa State for that matter.

    Sylva said: “Over the years, what we have come to understand about Governor Douye Diri and the PDP in Bayelsa State is that anything they are planning to do is what they project on us.

    The Bayelsa State Chapter of the All Progressives Congress (APC) has  described as big win for democracy,  the judgement which reversed the   disqualification of its candidate for the November 11, 2023 Bayelsa State governorship election Chief Timipre Sylva.

     The Court of Appeal had on Tuesday in Abuja  reversed the disqualification of Sylva for the November 11 polls.

     This followed the October 9 judgement of the Federal High Court, Abuja, presided by Justice Donatus Okorowo which nullified the candidature of Sylva in the November 11 governorship election on the excuse that he had taken the oath of office twice as Governor of Bayelsa State. This led to the Independent National Electoral Commission (INEC) de-listing  Sylva’s name from the list of candidates.

      A statement by the APC  Publicity Secretary in the state,  Mr. Doifie Buokoribo, said justice has been served and it is victory for the state.

       “The Appeal Court by its ruling has given the people of Bayelsa State a choice on November 11. A choice between light and darkness. A choice between moving to the mountain top and descending to the valley below. A choice between moving forward and backward. Democracy is about choices. And the Peoples Democratic Party (PDP) in sponsoring this frivolous case has demonstrated its mortal fear of our party, APC, and candidate, Chief Timipre Sylva.

     “The PDP is desperate. They do not want us on the ballot. We thank God that this distraction is now over. justice has been served.”

     “The Appeal Court, in a unanimous decision by a three-member panel, ruled that the first respondent (Mr. Demesuoyefa Kolomo) is not an aspirant in the elections and therefore lacks the locus standi to file the case; that the upper court cannot exercise jurisdiction where  the lower court lacks it; and that the appeal is meritorious and allowed. A cost of N1 million was  awarded to the appellant.

     “Provision of adequate and affordable housing in both urban and rural areas in secure, healthy and decent environment for all Nigerians is the primary mandate of this Ministry and equally one of the cardinal focuses of the present administration’s Renewed Hope Agenda. Therefore, the issues of Housing and Urban Development are being given the deserved attention. The Ministry intends to actualize the aforementioned mandate, through a multi-stakeholders and institutional engagements and collaborations.”

     Managing Director/Chief Executive Officer, Federal Housing Authority (FHA), Sen. Gbenga Ashafa said the government has to make concerted and deliberate effort at urban development, through building of new cities and regenerating of the old ones.

     He said through this, not only will we provide houses to our people, we will also deliver more liveable and secure environment to them.

     He added, “More importantly, the value chain of the housing industry remains the surest bet of creating jobs, both directly and indirectly, employing both professionals and non-professionals. This will enable us to reinforce growth and recovery in our Urban Economies.”

    The Court of Appeal in Abuja has set aside the October 9 judgment given by Justice Donatus Okorowo of the Federal High Court, Abuja nullifying the nomination of Timipre Sylva as the candidate of the All Progressives Congress (APC) in the Bayelsa State governorship election scheduled for November 11.

    A three-member panel of the appellate court held, in a judgment on Tuesday, that the Federal High Court, Abuja lacked the jurisdiction to have heard and determined the case filed by

    Demesuoyefa Kolomo described himself as a registered voter and a member of the APC.

    The court held that having not been an aspirant, who participated in APC’s governorship primary, Kolomo lacked the locus standi to approach the court to challenge the nomination of the party’s candidate.

    In the judgment read by Justice Binta Zubairu, the court held that since Kolomo was not an aspirant and did not participate in the primary from which Sylva emerged as APC’s candidate and cannot be clothed with the requisite locus standi as provided under sections 285(14) of the Constitution and 29(5) of the Electoral Act 2022.

    Speaking with reporters at the APC National Secretariat in Abuja, shortly after consulting with the Deputy National Chairman (North), Alhaji Ali Bukar Dalori on the outcome of the judgment, Sylva said: “I believe that the Judiciary has vindicated itself. Because I had suffered defeat because of this issue of locus. I took Governor Dickson as he then was to court. On this issue of locus, the Supreme Court decided then that since I didn’t participate in that primary, I didn’t have the locus standi to take the matter to court and I lost the battle.

    “But when the High Court now said, the guy who didn’t participate at all in the process had locus standi, I was a little bit confused. But the judiciary has vindicated itself. I am quite happy. We are ready.”

    While delivering the judgment, the court indicated that from the provision of the law, one must be an aspirant, who participated in a primary before he can challenge the conduct or outcome of the primary concerning the qualification of the candidate nominated for the selection process.

    It found that Kolomo failed to establish he was an aspirant in the APC primary and, as such, clothed with the requisite locus standi to institute the action on which the judgment disqualifying Sylva was given.

    “Having held that the first respondent is not an aspirant, he lacked the locus standi to have instituted the matter under whatever guise before the lower court.

    “Where a party lacked the locus standi to institute a case, the court has no jurisdiction to entertain and determine it, Justice Zubairu said and proceeded to hold that the Federal High Court in Abuja was without jurisdiction to have heard the case.

    She proceeded to set aside the Federal High Court judgment, allowed the appeal filed by Sylva and granted all the reliefs sought.

    The court also awarded N1million cost in favour of Sylva.

    In his October 9 judgment, Justice Okorowo held among others,  that Sylva, having been sworn in twice and served for five years as governor of Bayelsa, would breach the  Constitution should he be allowed to contest again.

    Justice Okorowo declared that Sylva was not qualified to contest the November election because if he won and is sworn in, he would spend more than eight years in office as governor of the state.

    Relying on the Supreme Court’s decision in the case of Marwa vs Nyako, the judge held that the drafters of the Constitution stated that nobody should be voted for as governor more than twice and that the parties to the suit agreed that Sylva was voted into office two times.

    While arguing the appeal on October 27,  lawyers to Sylva and the APC  – Akinlolu Kehinde (SAN) and K. O. Balogun faulted Justice Okorowo’s position on Sylva’s qualification.

    Balogun argued that it was wrong for the trial court to have entertained the suit by Kolomo because he lacked the locus to have approached the trial court.

    He faulted the decision of Justice Okorowo, to the effect that Sylva took the oath of office twice as Governor of Bayelsa State.

    Balogun said: “In 2007 he (Sylva)  was elected the Governor of Bayelsa State, but within eight months, the Court of Appeal (which was then the final court for governorship election petition) sacked him.

    He added: “He contested again in 2008 and won. The eight months that he earlier spent in office was nullified, so he could not have said to have spent that with months because it was voided by the court.

    “What he (Kolomo) is doing is fighting a proxy war. He cannot be a member of the APC and be fighting to destroy its candidate and chances at the election.

    “What the first respondent (Kolomo)  is asking this court to do is to deem the nullified eight  months as 4 years.”

    In another judgment on Tuesday, the same Court of Appeal allowed a similar appeal filed by the APC to challenge Sylva’s disqualification.

    The court granted all the reliefs sought in the appeal marked: CA/ABJ/CV/1060/2023 and equally awarded N1m cost in favour of the appellant.

    The deputy governorship candidate of the All Progressives Congress (APC) in the forthcoming Bayelsa governorship election, Joshua Maciver has come under attack for inciting violence ahead of the election.

    Maciver, during a political campaign of the party in Twon Brass, Bayelsa State, called on supporters of APC to chase anyone opposed to the emergence of the party into the sea and kill people, as long as victory was secured.

    In a statement, the Bayelsa Women Arise has condemned the comments. The statement by the Publicity Secretary, Ebibaratimi Atani, urged the Inspector General of (IGP) and the Director-General of the Department of State Services (DSS) to take immediate and decisive action to reassure voters of their safety.

    The group argued that it was the duty of law enforcement agencies to protect the lives and property of all citizens, adding: “we believe that failure to address this issue promptly would set a dangerous precedent for our state’s political climate.

    The statement said: “In light of the above, we urge the Inspector-General of Police to launch a thorough and swift investigation into the comments made by Mr Joshua Maciver, as a way of preventing bloodshed, which Mr Maciver and his co-travellers are determined to unleash on our people during the forthcoming election.

    “Recall that a few days ago, our organisation expressed our fears and sensitized the people of Bayelsa for a violence-free Governorship election on November 11, during a Peace Walk where thousands of Bayelsa people participated.

    “During his speech in Twon Brass, Mr Joshua Maciver shockingly advocated for the killing of supporters of opposition candidates, thereby inciting violence and creating an atmosphere of fear and intimidation in our beloved state.

    “Such statements are not only unbecoming of a political candidate but are also a direct threat to the democratic process, which is built on the principles of peaceful coexistence and respect for the rights and choices of the citizens.”

    The withdrawal of the names of its candidates from the November 11 Bayelsa State governorship election in the amended list was premature, the All Progressives Congress (APC) told the Independent National Electoral Commission (INEC) last night.

    On its website late Tuesday, the electoral body withdrew the APC flag bearers Timipre Sylva and his running mate, Joshua Maciver from the off-circle governorship poll in the state.

    INEC’s action was informed by an October 9, 2023, High Court order that disqualified Sylva as the APC candidate.

    But APC National Publicity Secretary, Felix Morka, insisted that delisting the party’s candidates, in the circumstances, as INEC has done, preempts the outcome of the valid appeal in the matter.

    In a statement, the APC noted that its candidate and party had promptly appealed the judgment and brought other processes seeking a stay of the judgment’s execution.

    Morka further stated that the Court of Appeal, recognising the extreme urgency of the matter,  granted an order of accelerated hearing of the matter now fixed for definite hearing tomorrow, stressing that INEC is a party in this matter and has been served with all relevant filings and orders in this matter.

    The APC spokesman complained that removing Sylva’s and running mate’s from the list of contestants would foist a situation of helplessness on the appellate court, the candidate and APC should the appeal succeed.

    He said: “The attention of the All Progressives Congress (APC) has been drawn to the updated list of gubernatorial candidates for the November 11 governorship election in Bayelsa State by the Independent National Electoral Commission (INEC), which excluded the All Progressives Congress (APC) candidate’s name, Chief Timipre Sylva.

    “Delisting our Candidate, in the circumstances, as INEC has done, is premature, and preempts the outcome of the valid appeal in the matter. This flies in the face of INEC’s established practice of awaiting the decisions of appellate courts before taking action that may be prejudicial to the interest of the appellants.

    “Furthermore, removing our candidate from the list of governorship contestants in Bayelsa would foist a situation of helplessness on the appellate court, the Candidate and our Party should the appeal succeed. We urge INEC to withdraw its amendment under reference in the interest of fairness.

    “In the meantime, we appeal to the good people of Bayelsa State, especially our teeming members and supporters, to remain calm while the judicial process runs its full course. We have confidence that our candidate will be victorious both at the Court of Appeal and at the polls.”

    The Independent National Electoral Commission (INEC) has delisted Chief Timipriye Sylva from the list of candidates for the November 11 governorship election in Bayelsa State.

    Sylva, who is the APC candidate for the off-cycle election in the State, was disqualified by a Federal High Court in Abuja from contesting the election on the ground that he has been been sworn in twice.

    The former Minister of State for Petroleum Resources has appealed the judgement of the lower court while the Appeal. court has fixed Friday for hearing in the appeal.

    In an ammended list of candidate published by the commission on its website on Tuesday night, the commission also removed the name of the Deputy Governorship, Joshua Maciver.

    The commission cited the court order as the reason for the development.

    The commission also included the name of the PRP candidate for the election Uchechukwu Ishiodu and his deputy, Ahumbe Chiazor on the list of candidates for the Imo Governorship election also citing court order.

    The amended list was signed by the Secretary to the commission, Rose Oriaran-Anthony.

    Chairman of the commission, Prof. Mahmood Yakubu, told political party leaders on Tuesday that court orders and judgements were creating problems for the commission in printing sensitive materials for the elections.

    Bayelsa Council of Chiefs endorses Sylva’s candidacy

    The governorship ambition of the Bayelsa  State  All Progressives Congress (APC) candidate, Chief Timipre Sylva, received a boost yesterday as the council of chiefs from Nembe and Brass local government areas endorsed his candidacy.

    The endorsement of the immediate former Minister of State for Petroleum Resources took place at a news conference in Yenagoa by the group.

    The chiefs that attended the conference were those of Brass Council of Chiefs, Okoroma Council of Chiefs, Egweama Chiefs Council, Okoroba Chiefs Council, Odioma Chiefs Council, Okpoama Kingdom Chiefs Council, Opu-Nembe Chiefs Council, Nembe City Chiefs Council, Akassa Council of Chiefs, among others.

    Addressing reporters after the meeting of the group, the Chairman of the Opu-Nembe Council of Chiefs, Chief Yousuo Donald Theo-Iruo, said they met to chart a course for the people of the two local governments.

    Theo-Iruo said their meeting was a fruitful and successful one among themselves and they had decided to make a political statement whereby they would all go back to their communities and councils to direct their people on the way to go.

    He added that in respect of the forthcoming governorship election on November 11, it had become imperative for the councils in the two local governments of Nembe-speaking ethnic nationality to make a statement and direct their people on whom to vote for.

    Theo-Iruo said: “We are about four hundred (400) chiefs of delegation basis that attended the conference and these are what we have decided to go back to our various councils to implement.

    “The entire Nembe and Brass local governments want to endorse and affirm that the chiefs councils in Nembe and Brass have decided to adopt, affirm and endorse Timpre Sylva as the candidate for these two councils.

    “We have made this affirmation that we will all go back to our communities where councils domicile to ensure that Timipre Sylva is elected. There is no alternative to Sylva as far as these councils are concerned. We believe that in Timipre Sylva, councils across these two local governments and the people of these areas will have a face in the governance of our state.

    “In Sylva, we also strongly believe that the dividends of democracy will go round to all the nooks and crannies of Bayelsa State, not only the Nembe-speaking people.

    “We also want to reaffirm our strong belief and conviction on Timipre Sylva because having known him in his first tenure when he was the governor, we strongly believe that for now he is more experienced, more exposed, more connected and believe that he would take us to Bayelsa of our dream where equity, fairness and justice will be the order of the day in the state.

    “We strongly believe that Sylva has the right connections, right exposure and he will be the man to beat in this forthcoming election.

    “So, today, the respected chiefs of this Nembe-speaking people have decided to speak in one voice. Apart from that, we will direct, coordinate and ensure that our people know the way to go by voting en masse for Sylva.”
