  • Collapsed building: Synagogue loses appeal to stop trial

    The Synagogue Church of All Nations (SCOAN) has lost in its bid to stop its trial by an Igbosere High Court, Lagos

    This is because the Court of Appeal, Lagos Division, has dismissed the appeal filed by the church and it’s engineers for lacking in merit.

    This was disclosed in a statement signed by Deputy Director Public Affairs, Ministry of Justice, Mr Kayode Oyekanmi.

    The statement said the appellate court  affirmed the decision of the lower court judge, Justice Lateef Lawal-Akapo delivered on March 9, 2018.

    Justice Lawal-Akapo, of a Lagos State High Court had on March 9, 2018  dismissed the no case submission filed by the defendant’s/appellants.

    The  trial Judge, held in his ruling that the state had established a prima facie case against the defendants/appellants to warrant them being called upon to put up a defence.

    But dissatisfied with the ruling of the lower court, the defendants appellants, Messrs  Oladele Ogundeji and Akinbela Fatiregun charged alongside their companies, Hardrock Construction and Engineering Company and Jandy Trust Limited , approached the appellate court urging the appellate court to upturn the ruling.

    Having considered the arguments of the appellants and the submission of the DPP, Ms. Titi Shitta-Bey, the Court of Appeal dismissed the appeal for lacking in merit.

  • Revisiting the Synagogue tragedy

    As Synagogue Church Of All Nations (SCOAN) is about to open its defence in the criminal charges brought against it over the collapse of its six storey guest house in September 2014 in which scores of people died, the world is waiting eagerly for this historic legal battle.

    Clearly it is not only the SCOAN alone that is on trial but also the entire Nigeria and of course humanity!

    What is it exactly that is peculiar in this case? Was this the first time a structure would collapse with even greater tragedy in the world? Definitely not. What is astonishing and remains astounding till today about this case is the seeming extraordinary and intriguing interest this incident has attracted.

    It is obviously not going to be an easy case. The peculiarity and unusual nature of the collapse which seems to have defied all known logic of foundational and structural ingredients of collapsed structures in the world of building industry.

    Former Lagos State Governor, Mr Babatunde Fashola clearly foresaw this when he pointed out during an interaction with the media after visiting the collapsed site that: “the issue of Synagogue is highly technical and it requires experts to determine what actually happened to the building because it is not a thing that can be rushed into.”

    Yes it is highly technical as can be seen from the Coroner’s inquest. Today the event of collapsed structure in Synagogue has become a case study for academic research because of its peculiarity for the advancement of knowledge.

    Dr Stephen Ntoga, an international expert in civil, structural and material engineering and Dean Faculty of Engineering in Tanzanian University was at the site for thorough investigation with his team. His verdict was incontrovertible: “The collapse of the Synagogue building was completely strange. It goes beyond the issue of foundation or structural elements. The construction and the materials used were excellent.” Ntoga, a renowned scholar who had handled and partaken in collapsed structures across Europe and America and boasting of the British and American codes said he clinically examined the foundation where he found no element of crack, the aggregates of materials used from the sand, steels, cement, columns, beams, loading among others that the job he found done in the collapsed Synagogue building also took a preemptive sensitivity of resistance of building construction in an environment prone to natural disasters such as earthquakes  and therefore confidently declared that the job done on the collapsed structure was  perfect.

    He stated further that the types of steels used was the highest in the world and as  such with what he found, without any palpitation the foundation of the collapse six storey structure would carry conveniently twelve floors by the strength of what he saw.

    Another expert from South Africa, Engr. Alfeus Mamafa who also carried out an independent and private investigation at the instance of his country also admitted at the end that: “I found nothing wrong in the design and work done here. Structural failure will always happen from the foundation and in this case everything remained solid, no cracks of any kind and with the structural elements intact nothing can affect or shake the building. It can never be a case of foundational or structural failure.”

    In the same vein, Engr. Thabo Pheeha also an expert concluded after his team’s investigation that “the structure must have been affected by something else other than structural or foundational failure. It is not the case here because everything remained intact despite the collapse.”

    Dr Folayan, a Geophysical expert with over 45 years of experience practising across the world including USA declared after his examination of the collapsed building that he was ready to sacrifice his career if anybody could disprove his findings that the foundation of the building was in any way faulty. He described it as “adequate, perfect and superb.”

    What then was responsible for the collapse?  Prophet T.B. Joshua, The General Overseer of SCOAN has a reputation for excellence all over the world for whatever he lays his hands on to do. Everything around him clearly shows the mark of super standard and higher wisdom.

    He is the only preacher who would hold Crusades abroad without collecting offerings or donations there. He would foot his bill all through and even do charity in the country.

    In him you find love and unequalled integrity.

    T.B. Joshua had rushed down from a crusade in Cali Columbia and suddenly appeared in the Sunday service. He declared: “I could see a dark cloud gathering here and that is why I have to rush down.” He enjoined church members to be praying for this to pass over.

    But like Jesus at the critical moment of His trial when he called God to take away the cup of sorrow from him if it was His Father’s will,  similarly the cup of sorrow of the collapse building could not be removed from Prophet T.B. Joshua.

    Invariably from a superb intuition and higher spiritual intimation Prophet T.B. Joshua in a jiffy mounted surveillance CCTV cameras on the building with nobody able to decode what was in the offing besides the Man of Synagogue himself.

    Today the world had seen clearly the perfidy and conspiracy of the collapse through the CCTV recordings. Within four seconds, a six storey building came down flat. It had never happened in the whole world.

    Jericho Weapons in its website added more egregious dimension to the charade of the synagogue building collapse. It was a case of one Super power country accusing another as the mastermind of the collapse. What did he call TB JOSHUA offence? For having the effrontery to be boldly assisting and curing Ebola victims, a terrible affliction. programmed to pauperise Africa and to continue to keep Africa on her knees  before the super power country and its allies.

    This perhaps may have informed the wisdom of TB Joshua  in the use of words such as: ,” Spirit of man, Spirit of woman” for those people with the demonic spirit of gay and lesbianism as euphemism while undergoing spiritual deliverance.

    Clearly the case of Synagogue is a battle between the light and darkness. It is also like that of a child with an unfathomable  fractured waist. The wisdom of Solomon beyond legalism may be required because SCOAN is a blessing to the world.

    Synagogue has case to answer over guest house collapse, says court

    An Igbosere High Court in Lagos has dismissed the no-case submission filed by the Registered Trustees of the Synagogue Church of All Nations (SCOAN) and the two engineers involved in the six-storey guesthouse that collapsed and killed 116 people, including 85 South Africans on 12 September, 2014.

    The Lagos State Government had sued the church over the building.

    The engineers – Ms Oladele Ogundeji and Akinbela Fatiregun – were charged alongside their companies — Hardrock Construction and Engineering Company and Jandy Trust Ltd.

    They are facing 110-count charge of involuntary manslaughter while the registered trustees of SCOAN were charged with one count of building without approval.

    The Lagos State Directorate of Public Prosecutions accused the defendants of violating Section 75 of the Urban and Regional Planning Law of Lagos State 2010 as well as Section 222 of the Criminal Law of Lagos State 2011.

    They were arraigned on April 19, 2016, but they pleaded ‘not guilty’.

    NAN reports that the prosecution subsequently opened its case, called witnesses and tendered documents to prove the allegations against the defendants.

    However, upon the close of the prosecution’s case in October 2017, the defendants, rather than enter their defence, filed a ‘no-case’ submission, contending that the prosecution failed to establish a prima facie case against them.

    The defence insisted there was nothing in the evidence by the prosecution to warrant their client to proceed into any defence.

    They, therefore, urged the court to discharge the defendants.

    However, the prosecution opposed the no-case submission and argued that the defendants had a case to answer based on the evidence of all the prosecution witnesses.

    The prosecution maintained that a prima facie case had been established which the defendants must defend.

    At the resumed hearing on Thursday, Justice Lateef Lawal-Akapo, dismissed the no-case submission filed by the defendants.

    He adjourned the case until April 27 for the defence to open its case.

    A Lagos High Court sitting in ikeja heard yesterday that there was no truth in the report that the collapsed guest house of the Synagogue Church of All Nations (SCOAN) was caused by radiation from a plane that flew over it.

    A former Commissioner for Physical Planning and Urban Development‎ in Lagos state, Mr Olutoyin Ayinde, made this assertion yesterday during the continuation of his evidence in the matter.

    Ayinde told the court presided by Justice Lateef Lawal-Akapo that contrary to  claims of the church, evidences at his diaposal suggested otherwise.

    The ‎ former Commissioner who was being led in evidence by the Director, Directorate of Public Prosecution (DPP),Mrs. Idowu Alakija stated that he visited the site of the collapsed building with former Governor Babatunde Fashola alongside two General Managers of the agencies under his ministry.

    He said that during their visit to the site of the building collapse, the General Overseer of the church gave them a CCTV  recording of an aircraft hovering over the building shortly before it’s collapse.

    He added: “My office wrote to the Nigerian Civil Aviation Authority  (NCAA) seeking advice on the CCTV recording we received.

    “ We got the flight corridor and coordinates as well as a report from the NCAA which showed that the distance between the aircraft and the top of the building is between  137 and 288 meters.

    “We found that the aircraft were not flying directly over the building, Ayinde said.”

    The former Commissioner explained that the least distance from the top of the building to the nearest aircraft was 137 meters which he said is the equivalent of four  buildings, like NITEL building,  placed on top of each other.

    He also explained that evidence was collected from the site during his visit with Fashola.

    “We took pictures of the site as well as did a video recording of the visit of the delegation to the site, he said.”

    At this stage, the DPP, Mrs. Alakija, sought to tender the documents mentioned by Ayinde as evidence to the court.

    “My Lord, we seek to tender the application for building approval for the Synagogue Church auditorium, letter from the NCAA, flight path coordinates, the survey of the collapsed building as well as pictures as evidence, the prosecutor said.”

    The defence led by Mr Lateef Fagbemi (SAN) who is also representing the trustees of the church objected to the tendering of the documents.

    Fagbemi said they oppose the admission of the documents because they were just being served as additional proof of evidence by the prosecution.

    ”We need to have previous knowledge of what is in those documents to enable us confer with our clients”, he said.

    Justice Lateef Lawal-Akapo, told the  counsel to come up with dates for adjournment to enable them examine the documents.

    The lawyers, however, could not agree on a date for adjournment and the judge had to impose a date on them.

    After waiting for some time, the trial judge ruled on the counsels and fix fresh dated for hearing.

    “I waited patiently for counsel to come up with a date but they couldn’t, I have no choice but to impose these dates on counsel.

    “This case is adjourned to June 27, 28 and 29 for continuation of trial, Akapo said.”

    ‎The trustees of the church, two engineers,Messrs Oladele Ogundeji and Akinbela Fatiregun and their companies, Hardrock Construction and Engineering Company and Jandy Trust Limited are facing trial for the September 12, 2014 collapsed guest house.

    The state government has filed 111 charges bordering on criminal negligence, manslaughter and failure to obtain building permit were brought against the defendants.

    Synagogue: Lagos court remands engineers in prison

    The two engineers, who constructed the collapsed seven-storey guest house of the Synagogue Church of All Nations — Akinbela Fatiregun and Oladele Ogundeji — are to remain in Kirikiri Maximum Prisons till May 3, a court ruled on Tuesday.

    Justice Lateef Lawal-Akapo of an Ikeja High Court gave the order in a ruling on their bail applications.

    “Ruling is preserved for Tuesday, May 3, 2016,” Lawal-Akapo told a crowded courtroom.

    The News Agency of Nigeria (NAN) reports that the engineers were on April 26 ordered to be remanded in Kirikiri Prisons by Lawal-Akapo following their `not guilty’ plea to a 111-count charge bordering on gross negligence and criminal manslaughter.

    Earlier during Tuesday’s proceedings, counsel to Fatiregun, Mrs Titi Akinlawon (SAN), in her submission before the court, promised that the defendants would not jump bail.

    “The fifth defendant has been charged before at the Magistrates’ Court and he did not jump bail; he presented himself at all times.

    “Prior to when he was granted bail by the magistrates’ court, he was granted police bail and he always presented himself.

    “Since the entire essence of remand is for the defendant not to jump bail, the defendant going by his antecedents, has proven himself to be honourable by not jumping bail on previous occasions,” Akinlawon said.

    Mr Olalekan Ojo, counsel to Ogundeji in his application before the court, said Ogundeji needed to be on bail in order to build his defence.

    He said:“The case of the prosecution is founded on gross negligence, it will collapse or succeed on the strength of experts’ opinion and it is not pertinent for anyone to state the evidence is overwhelming on technical issues.

    “Because of the technical nature of the evidence, there is need for the fourth defendant to be on bail to liaise with experts to build his defence.

    “He cannot do this while on remand at the Kirikiri Maximum Prisons.”

    However, the prosecution led by Mrs Idowu Alakija, the State Director of Public Prosecutions, noted that the court was not obliged to grant bail to the engineers.

    She said:“The granting of bail is not mandatory, this court has the discretion to grant bail; but in so doing, it has to look at the facts before it.

    “My Lord, both the Supreme Court and the Court of Appeal had in an avalanche of cases held that a court needs not restrict itself to matters in the affidavit, but the proofs presented in court.

    “We have emphasised that Oladele Ogundeji has no address within the jurisdiction of the court.

    “If this court is to grant bail, I urge the court to grant accelerated hearing without delay because we have had too many delays caused by applications presented by the defence in this case.’’

    NAN also reports that the collapse of the guest house on Sept. 12, 2014 led to the deaths of 116 persons, 85 of who were South Africans.

    The Coroner’s Inquest instituted by the Lagos State Government had in its verdict on July 8, 2015, said the building collapse was caused by structural failure due to a combination of designs and detailing errors.

    The coroner ordered that Synagogue church should be investigated and proceeded against by the relevant authorities for not possessing necessary building permits while the two engineers involved in the construction of the building should be tried for criminal negligence.

    On Saturday, October 15, 2014 South Africa executed a clinical military/civilian operation to repatriate 74 of her citizens who perished when a six-storey guesthouse at the Synagogue Church of All Nations on September 12. In all it is suspected that close to 80 persons from that country may have lost their lives in that disaster.

    In the intervening two months while DNA tests were being carried out the South Africans piled unrelenting pressure in the media and through diplomatic channels seeking a proper accounting for, and the repatriation of their dead. President Jacob Zuma even appointed one of his ministers, Jeff Radebe, as Special Envoy to Nigeria for the sole purpose of bringing the Synagogue dead back home.

    Mind you some of the remains had badly deteriorated because of the delay in allowing emergency services access to the site of the tragedy. In the end because of very high humidity in these parts, putrefaction set in quickly. Still, the South Africans desperately pushed to recover their dead – the good, bad and ugly. What a lesson in human dignity and concern for your people.

    The number of her citizens that died at Synagogue is nowhere near the body count from some Boko Haram attacks. The Nyanya Motor Park, Abuja, attack alone produced a gory harvest of at least 88 bodies. After a quick photo-op at the hospital, President Goodluck Jonathan sped off to Kano to dance at a rally for a defecting politician.

    The day after a suicide bomber eviscerated 47 school kids in Potiskum, and with images of their broken limbs making many sick online, our humble, caring president was dancing again at Eagle Square – listening to sycophants telling him all was well in the land.

    Ever week hundreds are slaughtered in our killing fields. The response from those charged with protecting lives and property is to issue another canned press statement threatening to deal decisively with the perpetrators. We don’t treat our people – living or dead – with dignity. Is it any surprise that other countries find it convenient to trample all over us?
