Taraba: Tribunal refuses INEC’s relocation request

•Insists on hearing petition against Ishaku in Abuja

The Taraba State governorship election tribunal has declined a request by the Independent National Electoral Commission (INEC) to relocate to the state.

The President of the Court of Appeal, Justice Zainab Bilkachuwa, empowered under the Constitution to constitute election tribunals in respect of disputed elections, set up the Taraba governorship tribunal in Abuja owing to security challenge in the state.

Tribunal Chairman, Justice Musa Abubakar, in a ruling yesterday, rejected INEC’s opposition to the tribunal’s sitting in Abuja.

He also dismissed INEC’s motion, challenging the tribunal’s jurisdiction to sit in Abuja and hear a petition filed by the All governorship candidate of the All Progressives Congress (APC) in the last election, Hajia Aisa Alhassan, and her party.

Justice Abubakar held that the tribunal was validly constituted by the Court of Appeal President in line with her constitutional powers.

INEC had, in its motion, challenged the decision of the Court of Appeal President to direct the tribunal’s sitting in Abuja.

It argued that the tribunal ought to sit in the state where the election was held.

It also noted that the state’s legislative election tribunal was currently sitting in Jalingo, the state capital.

INEC urged the tribunal to relocate to the state.

The tribunal chairman upheld the argument by lawyer to the petitioners, Mahmud Magaji (SAN) to the effect that since INEC was, by its motion, was challenging the Court of Appeal President’s exercise of her constitutional power, it should go before the Federal High Court, with powers to determine constitutional issues.

The petitioners are challenging the outcome of the last governorship election in Taraba State, won by Ishaku of the Peoples Democratic Party (PDP).

Alhassan and her party are of the view that the election was marred with irregularities. They want the election voided.

Magaji’s request for the tribunal to proceed with the hearing of his clients’ petition was opposed by lawyers to the respondents – Ishaku, PDP and INEC).

While Magaji was of the view that the tribunal could hear the petition along with motions, challenging the competence of the petition, respondents’ lawyers led by former Attorney General of the Federation (AGF), Kanu Agabi (SAN) urged the tribunal to act otherwise.

They contended that it was the tradition that a court or tribunal must first deal with motions challenging the competence of a petition or a suit before assuming jurisdiction over suit a suit or petition.

They argued that the tribunal must first determine whether or not the petition was competent for it to determine whether or not to exercise its jurisdiction to hear it.

Magaji, in a counter argument cited the provision of Paragraph 12(5) of the First Schedule to the Electoral Act which, he said, made it mandatory for an election tribunal to hear any objection to the competence of a petition along with the petition.

He argued that since election petition proceedings were peculiar, the regular rules of court do not apply. He noted that time was of the essence in electoral cases.

Magaji faulted the respondents’ reliance of the provision of Paragraph 18(7)(d) where it was provided that a tribunal may decide any objection before proceeding to consided the main petition.

He noted that the tribunal had, at its inaugural sitting, cautioned parties against delay and elected to take all preliminary motions with the petition.

Justice Abubakar has adjourned to August 3 for ruling on whether or not to hear pending preliminary motions with the petition.

  • I’ll not abandon Suntai, says Ishaku

I’ll not abandon Suntai, says Ishaku

Taraba State Governor, Darius Dickson Ishaku Monday, said he will not abandon his predecessor, Danbaba Danfulani Suntai, who has been recuperating from the multiple injuries he suffered in a plane crash in 2012.

Ishaku spoke in a release signed by former Commissioner of Information and Strategy, Emmanuel Bello, while reacting to social media reports that he (Ishaku) has “forsaken Suntai, leaving him to rot away in a desolate place.”

According to the said reports, which have gone viral on Facebook, Twitter and Instagram, Suntai is said to have even suffered a stroke recently, with no one around to help him out. And that Governor Bindow of neighbouring Adamawa State had to pick Suntai’s bill by flying him out of the country”

Ishaku said the story is not true but a mischief.

“That is a flat lie, because Suntai is in Jalingo and has not skipped town for months now. And he doesn’t have to, because his health is not bad. In fact, Suntai is stronger now.”

The picture painted by the contentious story is that of an ex-governor left by all and allowed to suffer the crisis of loneliness and neglect.

Many who read the report have continued to heap insults on Ishaku and an amorphous group called “cabal” who reportedly featured Ishaku in the election.

The report further accused Ishaku and the cabal of using Suntai and now deserting him.

The statement reads: “First, Governor Ishaku has not deserted Suntai. He has continued to pledge his loyalty to the ideals and legacy of the Suntai years.

“Even in his inaugural speech, Ishaku recommitted himself to all the five points agenda of the Suntai era which basically were good governance, democracy and propriety in public life. He went on to pay a glowing tribute to the Suntai years as the foundation of the making of a modern Taraba.

“Again, the funny news had said Suntai was not at the inauguration which they say is an evidence of their comic accusation. But we make haste to say that it is really a non-issue because the inauguration was a symbolic affair. But even then, Governor Ishaku ensured that the essence of Suntai was felt at the well-attended event. In any case, the Acting Governor of the state, Alhaji Sani Abubakar Danladi, who is one and the same thing with Suntai did the handing over ceremony. Where is the abandonment there?

“We want to inform all and sundry that governor Ishaku is footing the medical bills of Suntai. The former governor’s condition has improved tremendously and he is surrounded by many friends and family members.

“Therefore, Suntai is too big to be deserted by anyone. A man who has left sterling accomplishments in the Taraba firmament is not your day to day politician who can be forgotten so soon.

“Suntai continues to be the darling of all and sundry both in Taraba and elsewhere. His dreams, struggles and exemplary lifestyle have remained the template for which many would continue to take their bearings from.”

  • Taraba Ag. Governor’s ADC promoted

    Taraba Ag. Governor’s ADC promoted

Things are looking up for Mr Mahmood Mohammed Dahuwa, police aide to Taraba State acting Governor Abubakar Sani Danladi. Dahuwa is now an Assistant Superintendent of Police (ASP).

His steady rise through the ranks has been a product of discipline, punctuality, hard work, honesty, humility and dedication to service, but above all, his unconditional love for his job.

Thus, when the opportunity came on February 2, 2000, he promptly enrolled in the NPF as a recruit Constable. He was indeed a happy man.

But his happiest moment, he told The Nation, came when he was promoted to the rank of an Assistant Superintendent of Police (ASP) at the prestigious Police Staff College, Jos, Plateau State seven years after joining the police. He said he was highly elated to be decorated by the then Inspector General of Police (IGP) Sunday Ehindero, ably represented by the then DIA Administration Mr.  Ogbonna Onovo, who also was later appointed to the IG post.

To master his job, Dahuwa trained at the Police Training School Farfaru, Sokoto State. He obtained an HND/PGD in Public Administration from Abdu Gusau Polytechnic Talata Mafara, Zamfara State. He brought crime in the area down to the barest minimum by initiating new crime fighting strategies, and using a wide range of technology to identify, track down and punish perpetrators of crime to protect the masses. Witnesses said he succeeded because he made the police friends of the community.

However, while as DPO in Karimlamido, his saddest moment came amidst successes. “My saddest moment in the police was the day I was attacked by mobs in a police station in Karimlamido where I was the DPO. Two suspects under my custody were killed by the invading mobs,” he regrettably said.

From DPO, he became the State Traffic Officer of the Central Motor Traffic Division in Jalingo. From there, he was posted to Acting Governor Abubakar Sani Danladi as an aide de camps (ADC) on November 20, 2014, a post he has held sway till date.

DSP Dahuwa said he remains grateful to the Taraba Acting Governor Abubakar Sani Danladi. He spoke well of his boss, saying: “the Acting Governor is not only my official principal, he is an elder brother and father to me. Our union is beyond an ADC-Governor relationship. He is like an elder brother who is from the same mother and father with me.”

The acting governor on his part, has always said his ADC is one of the best, having “served well” -without a blemish record.

The new DSP was decorated by his boss -the acting governor and the Commissioner of Police Nyats Jatau. The event took place at the Executive Council Chambers of Government House, Jalingo.

Dahuwa’s advise to upcoming police personnel is for them to “shun all forms of indiscipline, be punctual and dedicated to duty.”

Death toll rises to 27 in military, Fulani clash in Taraba

    •Two soldiers’ bodies recovered

The death toll in Karimlamido Local Government Area of Taraba State, where the military carried out what some people called a reprisal attack, has risen to 27.

About 84 persons have been killed in communal clashes in Takum at the same time.

At least 25 persons were feared killed in Karimlamido at the weekend, following a retaliatory attack by soldiers who lost six of their colleagues in an attack by Fulani militia.

It was learnt that local militia, last Thursday, killed nine soldiers on a peace-keeping mission in Amar and Kambari villages of Karimlamido Local Government Area. Six bodies were recovered while the bodies of three others were missing.

It was expected that the military would retaliate as they searched for the missing soldiers.

When they started the search, they reportedly recovered two more bodies.

But 27 persons were feared dead.

It was also learnt that the militia opened fire when the soldiers were combing the area in search of their missing (dead) colleagues.

But, this time, they returned “fire for fire,” killing 27 of them at the spot. Two of the injured died yesterday.

Many residents were fleeing the area when soldiers said they might return to Karimlamido to “intensify the search” for other missing soldier.

Karimlamido Local Government Chairman Bobboi Bello Bendu confirmed the gun battle between the military and the Fulani militia.

He said two villages were razed during the battle.
