  • Court acquits Tejuosho market director of forgery

A Lagos High Court has quashed the forgery charge brought against Mr Olaide Omotola, a director of Stormberg Engineering Company Limited, the developer of Tejuosho Ultramodern Market.

Justice Oluwatoyin Taiwo held that the prosecution could not establish a prima facie case against the accused.

According to the judge, Omotola was not served with the charge or notified of the trial.

The judge said there were discrepancies in the legal advice as the petitioner’s statement was written on March 2, 2012; the petition was written on March 5 and approved on March 7, 2012.

Justice Taiwo said the petitioner had finished writing his statement “before his petition was approved,” noting that it smacks of meditated prosecution.

Omotola, a partner in the development of Tejuosho Ultramodern Market and leading equity contributor, was accused of forging the signature to become a director.

He said he was accused of forgery after he discovered some discrepancies in the market’s redevelopment following which he petitioned the Economic and Financial Crimes Commission (EFCC).

Omotola said while EFCC was investigating his allegation, a petition was sent to the police Special Fraud Unit (SFU), accusing him of forgery.

On March 22, 2012, SFU operatives came to his house and took him to its office on the charge of forgery and stealing N20 million.

“After they investigated, they could not establish any prima facie case against me in the matter. My passport was seized and later returned to me.

“In the course, we petitioned the Inspector-General of Police (IGP) that SFU was taking a biased position and the matter was transferred from SFU.

“But unknown to us, they had hurriedly gone to court on the matter. When Mr. Dolapo Atimo died, as it was obvious that I had the controlling share of the company, they also wrote another petition to the Corporate Affairs Commission (CAC).

“The CAC called my attention to the request. I told them to write a letter so that we can see the petition and what the issues are. This was when we now knew that there was a secret trial going on at a Lagos High Court, Igbosere without our attention being called to it,” he said.

Tejuosho Market: Charge against bank struck out

The Federal High Court in Lagos yesterday struck out contempt proceedings initiated by Access Bank Plc against First Bank of Nigeria Plc.

Justice Okon Abang held that the Form 48 and Form 49 (notices of disobedience of a court order) were not properly served on First Bank.

According to the judge, the court’s leave was not obtained before the processes were served on the alleged contemnors.

“For the plaintiff to commence a valid contempt proceedings, it requires the leave of court. The plaintiff did not obtain leave of court before serving the alleged contemnors. These processes are, therefore, incompetent,” Justice Abang held.

Stomberg Engineering Company Limited (the defendant) and its owner Mr Dolapo Atinmo, allegedly entered into separate funding agreements with Access Bank and First Bank over the Tejuosho Ultra-modern market.

In their bid to recover their money, both banks filed separate suits against Stomberg Engineering and Atinmo.

Access Bank’s lawyer Mr Kunle Ogunba (SAN), who was appointed as the the market’s Receiver/Manager, initiated contempt proceedings against First Bank officials, alleging that they flouted the court’s order by obstructing the performance of his functions.

The court had empowered Ogunba to take over the assets of Stomberg in respect of the market, and restrained the defendant from interfering with the Receiver/Manager removing its funds in the Alausa Branch of First Bank.

Justice Abang added that Access bank did not specify which First Bank officials disobeyed the court’s order.

First Bank’s lawyer, Mr Kemi Balogun filed an application seeking to be joined as a defendant in the suit by Access Bank against Stomberg before Justice Abang.

First Bank accused Access Bank of misleading the court  with half truth.

Justice Abang adjourned till June 16 for hearing of First Bank’s application to be joined in the suit, and Access Bank’s motion for interlocutory injunction against the defendant.

  • Ruling on Tejuosho market for May 27

Ruling on Tejuosho market for May 27

The Federal High Court in Lagos yesterday refused an application by a firm, Stomberg Engineering Limited, seeking to halt proceedings in the hearing of a suit over the ownership of Tejuosho Ultramodern Market Phase 1, Yaba on Lagos Mainland.

The firm had urged the court, presided over by Justice Okon Abang, to stay proceedings pending the determination of its appeal at the Court of Appeal, Lagos.

Stomberg had earlier brought an application seeking to dismiss the suit filed by Access Bank Plc, claiming it is an abuse of court process, but Justice Abang had refused it.

The firm said it filed an appeal against the ruling, and therefore applied for a stay of further proceedings before Justice Abang.

The judge ruled on the application yesterday that there was no evidence before him that an appeal had been filed.

He said what was before him was a motion filed by Stomberg, urging the appellate court to extend the time to enable it compile records of appeal.

Besides, the judge said he had earlier dismissed a similar application by the defendant, who is the market’s developer.

“The court had expected counsel for the defendant/applicant to withdraw this motion since a similar one had been dismissed, but he argued it as it it was totally fresh. The application dated December 12, 2013 is a nullity and ought not to have been filed. The application is a sheer waste of judicial time,” he said.

Dismissing the application, Justice Abang said there is no valid appeal against his decision made on May 10, last year.

“The application is very strange. There is no valid appeal against the decision of this court dated 10th of May 2013,” he said, describing his decision as “an avoidable ruling”.

Stomberg Engineering and its owner, Mr Dolapo Atinmo, allegedly entered into separate funding agreements with Access Bank and First Bank of Nigeria Plc over the market.

In their bid to recover their money, both banks filed separate suits against Stomberg Engineering and Atinmo.

Access Bank’s lawyer, Mr Kunle Ogunba (SAN), who was appointed as the market’s Receiver/Manager, initiated contempt proceedings against First Bank officials, alleging that it flouted the court’s order by obstructing the performance of his functions.

Meanwhile, First Bank, through its lawyer, Mr Kemi Balogun, has filed an application seeking to be joined as a defendant in the suit.

Responding to the contempt charge, First Bank accused Access Bank of misleading the court and feeding it with half truth.

“The facts deposed to in the affidavit in support of FORM 49 are half-truths and same was intentionally averred and initiated by the plaintiff (Access Bank) to mislead the honourable court and embarrass the Managing Director of the said bank,” one of First Bank’s affidavits opposing the contempt charge reads in part.

Yesterday, there was an argument on which of the pending applications – one for contempt and the one for joinder – should be heard first.

Justice Abang adjourned till May 27 for ruling.
