  • Buhari’s 2nd term inauguration will be low-key, says Lai Mohammed

The 2nd Term inauguration of President Muhammadu Buhari will be low-key, the Minister of Information and Culture, Alhaji Lau Mohammed has said.

President Buhari’s inauguration is scheduled for May 29th 2019.

The President who was the All Progressives Congress (APC) candidate in the last February 2019 general polls won his re-election bid beating his closest rival, Atiku Abubakar of the People’s Democratic Party (PDP) with over two million votes.

The minister of Information and Culture who disclosed that the 29th May inauguration will be low key, explained that since June 12 has been adopted as Democracy Day, hence all the a activities lined up for the inauguration have therefore been shifted to 12th June.

Mohammed said: “President Muhammadu Buhari’s inauguration for a second term on May 29, 2019, will be a low-key affair, as a number of the events slated for the inauguration will now be held during the first observance of June 12 as the National Democracy Day.”

The decision to have a low-key inauguration for the President, he said was taken at the meeting of the Federal Executive Council (FEC) on Wednesday, 8 May 2019.

He said this would not stop the invitation to world leaders to attend the ceremonies.

“However, invitations have been sent to all world leaders to attend the ceremonies marking the observance of the Democracy Day on June 12.

“Since the first observance of June 12 as Democracy Day falls into an election year, and as a measure to sustain June 12 as Democracy Day, the celebration of the inauguration and the advancement of democracy in the country will now take place on June 12. The country can ill-afford two major celebrations within a two-week interval.”

Details of the events slated for the two ceremonies, the Minister said will be unveiled at a world press conference slated for May 20th in Abuja.

The Economic and Financial Crimes Commission (EFCC) Friday said it arrested and quizzed two fast-rising Nigerian musicians – Afeez Fashola (aka Naira Marley), Omoniyi Temidayo Raphael (aka Zlatan) and three others over alleged Internet fraud.

It said the suspects have allegedly volunteered useful information.

The commission however said it has secured a six-month jail term for Uchenna Samuel Nwosu (a.ka. Jackson Mendez) for defrauding an American.

The EFCC made the clarifications in a statement by its Head of Media and Publicity, Mr. Tony Orilade against the backdrop of the arrest of the five suspects.

The statement said: “The Economic and Financial Crimes Commission, EFCC, Lagos Zonal office, arrested two fast-rising Nigerian musicians – Afeez Fashola (aka Naira Marley) and Omoniyi Temidayo Raphael (aka Zlatan), in connection with alleged case of internet fraud and money laundering. Intelligence report had also linked them to cybercrime offences.

“They were arrested along with: Tiamiyu Abdulrahman Kayode, Adewunmi Adeyanju Moses and Abubakar Musa.

“Their arrest followed an early morning raid on Friday, May 10, 2019 at 9, Gbangbola Street, Ikate, Lekki, Lagos.

“At the point of arrest, the commission found and recovered a number of items, including laptops, from the suspects.

“They have so far volunteered useful information about their involvement in the alleged criminal activities, even as investigations continue.”

Meanwhile, the EFCC said it has secured a six-month jail term for Uchenna Samuel Nwosu (a.ka. Jackson Mendez) for defrauding an American.

A separate statement said: “Justice I. M Sani of the Federal High Court sitting in Port Harcourt, Rivers State has convicted and sentenced Uchenna Samuel Nwosu (a.ka. Jackson Mendez) to six months imprisonment for internet fraud, impersonation and obtaining the sum of $500 (Five Hundred American Dollars) from an American, Carmen Alvarez, under false pretence.

Nwosu was arraigned by the Economic And Financial Crimes Commission, EFCC, Port Harcourt’s Zonal Office on April 11, 2019 on three-count charges bordering on internet fraud, impersonation and obtaining under false pretences contrary to Section 6 of the Advance Fee Fraud and Other Related Offences Act, 2006 and punishable under section 1(3) of the same Act.

One of the counts was: “That you UCHENMNA SAMUEL NWOSU (alias Jackson Mendez) on or about February 2019, in Port Harcourt, Rivers State within the jurisdiction of this Honourable Court had in your possession (your email address: jacksonmendez180@gmail.com) documents containing false pretence which you knew or ought to know contains false pretence and thereby committed an offence or an attempt to commit an offence contrary to section 6 of the Advance Fee Fraud and Other Related Offences Act 2006 and punishable under section 1 (3) of the same Act”.

“Nwosu originally pleaded “not guilty” to the charges but later changed his plea to “guilty”.

“Based on his changed plea, Prosecuting counsel, Barrister Samuel Chime prayed the court to convict him accordingly.

“Justice Sani convicted and sentenced him to six months imprisonment on each of the three – count charges. The sentence however runs concurrently.

“The court also ordered Nwosu to restitute the $500 he collected from his victim. Also, the court ruled that a laptop, Lenovo T410, recovered from him should be forfeited to the Federal Government.

“Nwosu’s journey to prison began when he was arrested along Liberty Drive, Woji, Port Harcourt, for his involvement in online dating scam. Specifically, he impersonated an American soldier in Syria to defraud Carmen Alvarez, an American lady of $500, being a part-payment of $2,350 he requested from her in an online chat.”

  • Alleged N650m fraud: EFCC to re-arraign ex-minister Akinjide

The Economic and Financial Crimes Commission (EFCC) will re-arraign former Minister of the Federal Capital Territory Mrs Jumoke Akinjide for alleged money laundering on June 11.

The anti-graft agency charged her along with a People’s Democratic Party (PDP) leader in Oyo State Chief Olarenwaju Otiti and a former Senator representing Oyo Central Senatorial District Ayo Adeseun.

Former Minister of Petroleum Resources Mrs. Diezani Alison-Madueke, said to be at large, is also named in the charge.

They will be re-arraigned before Justice Chukwujekwu Aneke of the Federal High Court in Lagos.

The defendants were arraigned on January 16 last year before Justice Muslim Hassan on an amended 24-count charge.

Trial had begun before Hassan before the case was transferred to Justice Aneke.

Otiti and Adeseun had on February 6 prayed Justice Hassan to recuse himself from the case.

They accused him of bias, claiming that as a former head of EFCC’s legal unit before he was appointed a judge, they did not believe they would get justice in his court.

Although the judge had refused to recuse himself, the Chief Judge eventually reassigned the case to Justice Aneke.

Defence counsel Messrs Bolaji Ayorinde (SAN), O.F.A Adeosun and Akinola Oladeji prayed the court for another date for the re-arraignment.

Ayorinde said he and prosecuting counsel Rotimi Oyedepo were to appear in another trial before another judge.

He told the court that Oyedepo would want to be present during the re-arraignment.

EFCC accused the defendants of conspiring to directly take possession of N650million from Mrs Alison-Madueke, which they reasonably ought to have known was part of proceeds of an unlawful act, and without going through a financial institution.

The alleged offence, EFCC said, contravenes the Money Laundering Act.

    The defendants pleaded not guilty.

  • Updated: Appeal Court voids judgment sacking Osun Gov’nor Oyetola

The Court of Appeal in Abuja on Thursday set aside the March 22, 2019 majority judgment given by the Osun State Governorship Election Tribunal, sacking Governor Adegboyega Oyetola of Osun State.

The appellate court held, in three judgements delivered on three appeals filed by Oyetola, the All Progressives Congress (APC) and the Independent National Electoral Commission (INEC), that the trial tribunal erred in its majority judgment.

Although one member of the court’s five-man panel dissented on the judgments in the three appeals by Oyetola, APC and INEC, the panel was, however, unanimous in dismissing the cross-appeal by Peoples Democratic Party (PDP) and its candidate in the election held on September 22 and 27, 2018, Senator Ademola Adeleke.

The panel led by Justice Jummai Sankey decided the three appeals (which were substantially similar) mainly on issues raised and argued by lawyer to Oyetola, Wole Olanipekun (SAN) in the appeal he filed for the Governor.

As it was the case at the Court of Appeal on Thursday, the three-man panel of trial tribunal was also divided in two-to-one in its judgment of March 22, 2019, with the majority judgment upholding the petition by the PDP and Adeleke.

It was a harvest of losses for the PDP and Adeleke at the conclusion of proceedings as they lost in the four judgments delivered on Thursday.

Justice Sankey read the lead judgments in the appeals by Oyetola and INEC, with which Justices Abubakar Yahaya, Isaiah Akeju and Bitrus Sanga agreed, while Justice Ita Mbaba dissented.

Justice Yahaya read the lead judgment in the appeal by the APC, with which other members of the panel agreed, except Justice Mbaba, who also dissented.

The last judgment was on the cross-appeal by the PDP and Adeleke, which was read by Justice Akeju, with other members agreeing that the cross-appeal was unmeritorious and deserved to be dismissed.

In upholding the appeal by Oyetola, Justice Sankey, in the lead judgment, resolved 10 of the 12 issues raised for determination, in favour of the Governor.

Justice Sankey, in resolving the first issue, upheld Olanipekun’s argument that the absence of Justice Peter Obiorah (who authored and read the lead majority judgment at the trial tribunal) at the tribunal’s sitting on February 6, 2019, rendered the proceedings of the tribunal and its majority decision a nullity.
She held that Obiorah’s absence on that day implied that the tribunal was not properly constituted to conduct proceedings, which, the judge analysed and relied on in the majority judgment he authored and read.
“I find and resolve the first issue in favour of the appellant and against the 1st and 2nd respondents (PDP and Adeleke)

“I declare the entire proceedings and the judgment of the Osun State Governorship Election Tribunal a nullity. I hereby set aside the entire proceedings including the judgment,” Justice Sankey said.

She noted that having nullified that proceedings of the tribunal and set its judgment aside, the court would have ordered that the petition be re-heard, but for the fact that the 180 days provided in the Constitution, for the hearing of election petition, has lapsed.

Justice Saankey said a re-hearing could not be ordered, because Section 285(c) of the Constitution which provides that an election petition must be heard and determined within 180days from the day of its filing.
She noted that the petition, having been filed before the tribunal on October 16, 2018, the 180 days had lapsed on April 15, 2019.

Justice Sankey also upheld the submission of the appellant to the effect that the petition was incompetent as per the reliefs sought therein, which the appellant had argued, were contradictory and ungrantable.

She faulted the trial tribunal for declaring the rerun election held on September 27, 2018 illegal.

Justice Sankey equally faulted the trial tribunal for holding that the petitioners established substantial non-compliance in 17 polling units in which the tribunal voided election results.

She noted that, having found that the petitioners did not prove over-voting, it ought not to have voided the results from the 17 polling units on the grounds that some portions of the results sheets were not recorded.
Justice Sankey said: “The absence of proper ballot accounting in the Forms EC8A in the 17 polling units is not a substantial non-compliance and did not substantially affect the results of the election.

“The only appropriate other is for a rerun election as provided under section 140(2) of the Electoral Act but not to recompute the results of the election and proceed to declare the 1st respondent or any other person the winner of the election.

“The tribunal was in patent error when it set aside the rerun election especially when it found that the conduct of the rerun was not marred by malpractices and non-compliance with the Electoral Act, leading to the unwarranted disenfranchisement of the voters in the seven polling units.”

In his dissenting decision, Mbaba dismissed the appeal by Oyetola with N200,000 cost in favour of the PDP and Adeleke.

He disagreed with the majority position that the appellant justified its claim that Obiorah was absent from the tribunal’s proceedings of February 6.

  • Africa honours Ghanaian table tennis legend Ethel Jacks

When Ethel Jacks walked into the venue of the 2019 ITTF Africa Junior and Cadet Championships – Sports Trust Emporium in Accra, Ghana, not many of the players knew who she was.  But some of the older coaches quickly recognised her and exchanged pleasantries with the former African champion.

Her call at the venue on Thursday, was elicited by a special award bestowed on her by the African Table Tennis Federation (ATTF), in appreciation for her contributions to table tennis.

Although she is now 76 years old, you could not miss the athleticism in Jacks’ steps and strides. When her profile was read before the presentation, an excited Jacks was welcomed to the stage by ATTF President, Khaled El-Salhy, who was assisted by President, Ghana Table Tennis Association (GTTA), Mawuko Afadzinu.

In her remarks, the beaming septuagenarian said: “I am so happy that this long-awaited recognition finally came to me in my lifetime. I am grateful to the ATTF for this special award and I believe this will also motivate the present players, showing them that their labour will not be in vain.”

The occasion unlocked the flood bank of pleasant memories for Jacks. It certainly brought back a recall of her great exploits with her late doubles’ partner, Ernestina Akuetteh.  In 1964 and 1968, Jacks partnered Akuetteh to win the women’s doubles gold medals at the African Championships. Fittingly, Jacks called for a one-minute silence for the great Akuetteh of blessed memory.

For the ATTF helmsman, the award was in recognition of Jacks’ immense contributions to the sport. “Ethel Jacks put Ghana on the African map with her performance in the 1960s and 1970s. She is one of the three players in Africa to have won the African Championship thrice in the history of the tournament. So ATTF believes honouring her would inspire upcoming players in Ghana to aim high and exceed Ethel Jacks’ feat,” the ATTF chief said.
