Alleged N3.4b theft: Prosecution opens case in ex-NIMASA D-G’s trial

The Economic and Financial Crimes Commission (EFCC) yesterday called its first witness in the trial of a former Director-General of the Nigeria Maritime Administration and Safety Agency (NIMASA), Patrick Akpobolokemi.

He was arraigned with nine others, including two companies, before Justice Saliu Saidu of the Federal High Court in Lagos.

The charge is different from the one before Justice Ibrahim Buba, in which five witnesses have testified for the EFCC.

In the case before Justice Saidu, Akpobolokemi and others were accused of conspiring to convert N3.4 billion belonging to NIMASA, which the commission said “was derived from stealing”.

The others are Captain Ezekiel Agaba, Ekene Nwakuche, Felix Bob-Nabena, Captain Warredi Enisuoh, Governor Juan, Ugo Fredrick, Timi Alari and two companies – Al-Kenzo Limited and Peniel Engineering Services Limited.

The first prosecution witness, a Compliance Officer at Zenith Bank Plc, Mr. Teslim Adekunle, said he was responsible for enquiries from regulatory agencies, such as EFCC.

Led in evidence by EFCC’s lawyer Festus Keyamo, the witness said Zenith, between last August and December, received several enquiries from EFCC.

He said the bank was asked to produce statements of account as well as account opening packages of three companies, namely: Interwind Limited, Margai Integrated Limited and Grandpact Limited. The documents were tendered in evidence.

An argument between the prosecution and defence counsel ensued when Keyamo sought to tender a document on Thlumba Enterprise Limited.

Akpobolokemi’s lawyer Dr Joseph Nwobike (SAN) objected on the basis that the document was a photocopy.

Keyamo applied to withdraw the document, but the defence counsel urged the judge to admit the document and mark it as “rejected”.

If marked as rejected, tendering of the original document may be foreclosed.

The EFCC witness earlier informed the court that the original copy was in the bank’s archive.

Justice Saidu adjourned for ruling and continuation of trial today.

•Ex-minister urges severe sanctions against looters

Former Judge of the International Court of Justice (ICJ) at The Hague Prince Bola Ajibola has described the alleged theft of N1.34 trillion by 55 privileged Nigerians as “obscene, horrendous and saddening”.

He said the government should be hailed for having the courage to speak-out and explain the extent of the theft.

The former attorney-general and minister of Justice, who spoke with The Nation in an interview yesterday in Abeokuta, the Ogun State capital, said the government should be supported in the onslaught against endemic corruption.

He warned that Nigeria might be “doomed”, if the mind-boggling looting was not tackled and punished.

The octogenarian said some of the people entrusted with public offices were emboldened to embark upon “stinking and primitive” theft of such funds because the nation’s sanction mechanism has become a huge “ruse”.

He queried: “What has become of our country? Is it descending into nothingness or abyss, that about 55 people would steal N1.34 trillion within seven years?

“This is a serious situation in need of saviour and once we are not saved from it, we shall all be doomed. The people are doing it with impunity and recklessness, knowing full well that everything that has to do with sanction is just a ruse.

“They know that the system will charge them to court, the court would grant them bail and that is the end of it. This is a mockery on the legal and judicial system; it is a mockery to the country and everything we have.

“Unless we come together to give support to who that is helping us to deal with this situation of endemic corruption, cheating and other crimes, we shall be branded as criminals and be destroyed as a nation.”

Ajibola added: “This is our moment of trials and tribulations. The country will dip into lawlessness if people keep stealing with impunity. The message being communicated by the alleged stealing is that the people called to govern us are cheating us.

“Nigerians must do something in order not to allow corruption become an eclipse on the nation. The amount of money involved is staggering and detrimental to the health of the nation. That is why we are backward in many fronts – infrastructure, education and industrialisation.”

He noted that the revelations coming out from the alleged $2.1 billion arms scandal also involved some elderly Nigerians, wondering the type of country his generation would leave behind for the younger ones.

Ajibola said: “The young ones should accept my sympathy because of what is happening. We who are about to leave will sympathise with you the young ones. The billions and trillions being stolen are not needed to live in this world. You don’t need it.”

  • Sabotage, theft undermining power supply – Buhari

Sabotage, theft undermining power supply – Buhari

President Muhammadu Buhari has disclosed that sabotage and theft of gas were undermining the efforts of the government to increase power supply in the country.

He made the remark during question and answer interaction with the Nigerian community in Tehran, the Islamic Republic of Iran.

To check the trend, he said that existing Military Task-Forces will be reorganized to ensure successful protection of the network of gas pipelines in the country.

Buhari, in a statement by his Senior Special Assistant on Media and Publicity, Garba Shehu, noted that sabotage of pipeline installations continues to be a problem despite improvement in power in the recent period.

According to him, Nigeria has everything it takes to generate enough power.

“Power is a running battle because the saboteurs are still there. We have the potential. We have gas, we have qualified people but we are contending with a lot of saboteurs who go and blow up installations. When gas is pumped to Egbin and such other power stations, thieves and saboteurs such as the militants cut those supplies,” he said.

He also cited another factor as the reduced role of the government in the sector due to the privatization of the institutions under the Power Handling Company of Nigeria (PHCN) in the process of which, he said, the facilities “have been sold to a number of interest groups.”

He assured that the Military task-forces with representation from the Army, Navy, Air Force, the Police and the secret services will be reconstituted to secure the pipelines.

“Supplies will become steady; there will be less sabotage as we secure the pipelines.”

The President also updated the Nigerians in Tehran on the efforts of his administration towards ending the Boko Haram terrorism in the country, explaining that a lot had been achieved following the reorganization of the military top command, followed by increased equipment supply and training.

In response to a question on the need to improve healthcare delivery, President Buhari said that efforts had been intensified towards ridding the country of fake drugs and fake doctors, and also what he called “the disgraceful aspects” manifested by ” baby factories.”

He listed several steps being taken towards the revival of education from primary school level to university.

On creation of jobs, he placed the prevailing joblessness in the country at the door-step of the last administration which he blamed for giving “a devastating blow to the economy through corruption and incompetence.”

The President said that something urgent will be done about the bad condition of roads, citing the Lagos-Ibadan Expressway as one to be addressed from next week by the Minister, Works, Power and Housing Babatunde Fashola who sat next to him at the meeting.

Speaking on the issue of corruption, one of the three issues he identified as the priorities of his administration, President Buhari said that the necessity for compliance with due process of the law was responsible for the delay in the prosecution of the looters of the country’s economy but that the “the day of reckoning is gradually coming.”

He also revealed that a number of past officials had begun the voluntary return of stolen funds but expressed the view that his government was not satisfied with tokens.

“We want to have everything back-all that they took by force in 16 years,” the President concluded.

  • ‘Nigeria loses $7.2m daily to oil theft’

‘Nigeria loses $7.2m daily to oil theft’

Nigeria is losing 150,000 barrels of oil per day (bpd) to theft, translating to $7.2milliion, an economist/consultant to  American Petroleum Institute (API), Ikenna Ifeobi, has said.

He said aside theft, pipeline vandalism is also responsible for the loss.

According to him, when one considers the fact  that 150,000 barrels of crude is stolen per day at the current price of $48 per barrel, Nigeria is losing $50.4million per week and and $2.6billion yearly.

Citing a report titled: Appraisal of Activities in the Global Oil Market: Implications for the Oil  Producing Nations, Ifeobi said Nigeria has lost greatly to the menace called oil theft.

He said pipeline vandalism is inhibiting the flow of gas to thermal plants, as well as causing 81 per cent of  the problems besetting the power sector.

He said the epileptic power supply in the country, is as a result of the twin problem of pipeline vandalism and crude oil theft, urging  the Federal Government to tackle the problem for growth.

He said power is critical to the growth of the economy, stressing that the problem in the sector is having ripple effects on other sectors of the economy.

He said tankers are made to carry petroleum products, which ordinarily should have  been transported to  end users through pipelines, adding that the issue, among others, has resulted in outbreak of fire in some parts of the country.

“Modern economies depend on a complex network of pipes, mostly underground to transport products within, to and from refineries without which these process plants would not function.

“Crucial upstream and downstream activities like drilling, refining, production, storage, tank farms and marine transportation of petroleum based products would perform at an inefficient rate or even grind to a total halt without the functionality and protection of pipelines,” he added.

The former Minister of Power, Prof Chinedu Nebo alluded to this fact in Lagos when he said the country’s ability to improve its power supply is hampered by incessant vandalism of oil pipelines.

He said the introduction of  local vigilante group  by the government of former President Goodluck Jonathan  to curb pipeline vandalism did not yield positive results.

President Muhammad Buhari has however opted for the use of aerial drones to check pipeline vandalism, and also serve as a replacement for the local vigilante group introduced by the former president to curb the menace of pipeline vandalism and its attendant problems.
