  • Umeadi is visiting Professor of law

    Chief Judge Emeritus of Anambra State Justice Peter Umeadi has been appointed visiting Professor of law at the University of Nigeria (UNN), Enugu campus.

    His appointment letter, signed by the Registrar of the University, Dr. Chris Igbokwe, reads: “The Vice Chancellor has approved that you be offered appointment as a Visiting Professor in the Faculty of Law, University of Nigeria, Enugu Campus, for one year. With effect from the day you assume duty, the appointment is hereby so offered.

    “The appointment is subject to the provisions of the University of Nigeria Act and any Statutes made thereunto, and to the Regulations Governing Conditions of Service of Senior Staff (CONUASS 1-7) as approved by the Governing Council from time to time.

    “The appointment lapses if you fail to assume duty within three months from the date of acceptance of offer.”

    Justice Umeadi, who voluntarily retired from the Judicial Service of Anambra State on February 28, was appointed and sworn in as a Judge of the High Court of Anambra State on January 17, 1997, and later elevated as the Acting Chief Judge of Anambra State.

    He retired from the service of Anambra State Judiciary on February 28, 2019 as the Chief Judge of the State.

    He, however, retains his position on the Global Council of World Jurists Association (WJA) as President for another term of two years (2019-2021).

     

  • Why we review Anambra Civil Procedure Rules, by Umeadi

    Chief Judge of Anambra State, Justice Peter N.C Umeadi, has said the state Rules of Court have become obsolete, hence the urgent need for their review.

    Justice Umeadi, who stated this while speaking at the just concluded two-day summit, organised by the state Judiciary for the review of the court rules, said: “The rules of courts have become obsolete, which necessitated the setting up of various review committees to look into them and come up with draft documents that would be subjected to public  scrutiny before being adopted as rules of procedure for all courts in the state.”

    The Chief Judge listed the rules to be reviewed to include the High Court Rules (2006), Anambra State Magistrate Court Rules (1991) and the Rules Establishing the Anambra State Multi-Door Court House.

    He said the review followed  the recommendations of the various committees set up to review these laws. “The dynamism of the law does not allow its rules of practice to be latent,” Umeadi said.

    He explained that participants at the summit had the opportunity to make comments and suggestions in areas they do not agree with the recommendations of the committees “all of which will be reflected in the final draft that would ultimately become the rules of procedure for courts in Anambra State”.

    Anambra State governor, Chief Willie Obiano said the synergy between the Executive and Judicial arm of government in the state has led to many landmark changes in the system of justice administration as well as the working condition of judicial officers in the state.

    The Governor, who was represented by the Secretary to the State Government, Prof. Solo Chukwulobelu, appreciated the Chief Judge, for kick-starting the process that has led to a total overhaul of the rules governing civil procedure of various cadres of courts in the area.

    The  two-day public summit urged stakeholders in the justice sector to evolve acceptable rules of proceedings that would ensure the efficient and effective functioning of courts in the area.

    Participants, cutting across all public strata, from the bar, academia, stakeholders and other groups in the state justice system engaged in robust debate on what seemed like a clause-by-clause consideration of the proposed new set rules of courts.

    Some of the key areas that engaged their attention were issues of enhanced court fees, summary trials, granting of adjournments, probate matters, preliminary objections, pre-trial conferences, Alternative Dispute Resolution (ADR) mechanisms, enforcement of  ADR awards, use of modern technology  in litigation process etc.

    One of the resource persons, who is a Senior Advocate of Nigeria, Chief Arthur Obi-Okafor, made a strong case for synergy between the regular courts and the multi-door courts, to ensure that judicial officers at various levels are bound to enforce the ADR decisions reached at the Multi-Door Court House.

    Chief Obi-Okafor advocated for the inclusion of a clause in the new high court rules that will “empower judges to enforce the outcome of proceedings of multi-door court house, insofar as the multi-door court proceedings conform to the acceptable rules of conduct”.

    Addressing newsmen at the end of the summit, Planning Committee Chairman, Justice Ngozi Oyeka, assured that all the views expressed by members of the public would be collated and put into a working document that would form part of the new rules for civil proceedings in the state.

  • Umeadi: allow retired judges to practise law

    ANAMBRA State Chief Judge (CJ), Justice Peter Umeadi, has backed the call for retired judges to return to practice.

    He faulted the barring of former judges from returning to the Bar.

    The CJ spoke during a special court session to mark the beginning of the 2018 legal year.

    He pointed out that other countries had since lifted the restrictions on former judges practising as lawyers after leaving the Bench.

    Justice Umeadi backed a former Nigerian Institute of Advanced Legal Studies (NIALS) Director-General Prof Epiphany Azinge (SAN) who earlier made the call.

    He said: “The Judiciary is inseparable from the Bar. I express my sincere appreciation to the Bar for coming to the rescue of the Bench whenever there is need.  Such has been the practice.

    “On a personal note, let me paraphrase and say that from the Bar I come and unto the Bar I shall return. And that would not be too long from now.

    “It does not matter that Judicial Officers are not allowed to return to the Bar in full steam.

    “The erudite Prof. Epiphany Azinge (SAN) harped on this exclusion at his rousing speech during the Sixtth Chief Judge Dinner in March, 2017 at Awka.”

    Justice Umeadi quoted Azinge as saying: “Many jurisdictions abroad have long waived this Rule. A judge will certainly be more relaxed, bolder and more resolute, if he or she is aware that regardless of any untoward occurrence he or she can still dust the wig and gown and return to legal practice.”

    He called on lawyers to join the advocacy.

    “I urge the Bar to put their heart to this fight. After all a returning Judicial Officer to the Bar world not change the law,” Justice Umeadi said.

    The Committee of Chairmen of Nigerian Bar Association (NBA) branches in Anambra praised Umeadi for transforming the judiciary.

    It said the CJ was able to raise the bar in terms of infrastructural development and reforms, which has improved the economic fortunes of lawyers.

    The committee’s chairman, Mr. G.U. Moneke, who is NBA Awka branch chairman, said in a statement: “I congratulate the chief shepherd of the Anambra State Judiciary, Justice P.N.C. Umeadi on his giant strides in the upliftment of the judiciary in the previous legal year particularly the 2017/2018 legal year.

    “The Chief Judge was able to weather the storm in the previous years and despite the harsh economic realities, he has miraculously raised the bar in terms of infrastructural development of the judiciary.

    “My Lord has also been able to enhance the scope of operations of lawyers of the judiciary despite the  economic realities and by extension improved the income of legal practitioners.

    “This he achieved by the creation of three new judicial divisions in Aniocha, Orumba and Ogbaru judicial divisions.

    “Above all, my lord has maintained the cordiality in the relationship between the Bar and the Bench.  My lord has shown a remarkable respect for the bar.

    “This he has always demonstrated any time the bar goes to have a meeting with him or pays him a visit.”

    The committee pledged to continue to work harmoniously with the Bench.

    “I have also been asked to felicitate with all the members of the bench in Anambra State for their unalloyed support to the Chief Judge; for their rare display of diligence, strength, wisdom and fairness in the administration of justice, and above all, their show of understanding of and good relationship with the Bar in the preceding year,” he said.

    Governor Willie Obiano and Chief Judge of Anambra State, Justice Peter Umeadi, are among dignitaries expected at the Second Biennial  Law Week and Bar  Dinner of the Nigerian Bar Association (NBA) Anaocha branch holding between October 26 and 29.

    The theme of the law week  to be chaired by Justice Peter Umeadi is: “Law as an instrument of sustainable change in the 21st Century”.

    Bayelsa State Attorney-General and Commissioner for Justice, Mr. KemasuodeWodu will be the keynote speaker at the lecture that will hold at White Castle Hotel, Neni in Anaocha.

    Other expected dignitaries, according to NBA Chairman, Mr. Basil Aguigwo, include: Speaker, Anambra State House of Assembly, Rt. Hon. Rita Maduagwu; President of the NBA, Mr. A. B.   • Obiano, Umeadi, Alegeh for Anaocha Bar Week

    Anambra State Governor Willie Obiano, the Chief   Judge Justice Peter Umeadi and Nigerian Bar Association (NBA) president Augustine Alegeh (SAN) will be special guests at the maiden edition of the NBA Anaocha branch law week.

    The event, to be held on October 2, will be chaired by Justice Umeadi,  while Chief Obiano. A former Supreme Court Justice Anthony Iguh and Vice-President (West Africa) Pan African Lawyers Union (PALU) Emeka Obegolu are also expected.

    The event with theme: Nigeria’s self inflicted judicial wounds: the calamitous consequences of legal practice, will hold at White Castle Hotel Neni, Anambra State.

    A statement from the branch Chairman, Chief Chris Ogom Adimorah reads in part: “ This will be followed by a Dinner and Awards  party on Saturday, October 3 at the same venue under the chairmanship of Alegeh.”
