  • Senate lacks capacity to probe CCT boss, says Unity Forum

Senate lacks capacity to probe CCT boss, says Unity Forum

Senators on the platform of the Senate Unity Forum yesterday said the upper chamber lacked the capacity to investigate the Chairman, Code of Conduct Tribunal (CCT), Danladi Umaru, for alleged corruption.

The forum added that it has identified a procedural error in the petition submitted to the Senate, which levelled corruption allegations against Umaru.

The Senate last week received a petition against the Cc1hairman of the CCT.

A group, Anti-Corruption Network, submitted the petition through Senator Obinna Ogba representing Ebonyi Central.

The forum’s spokesperson, Senator Kabiru Marafa, attempted to pick a hole in the petition yesterday, but the Senate President, Abubakar Bukola Saraki, ruled him out of order.

Marafa, who felt slighted, told reporters that “impunity and tyranny have become the order of the day in the Senate”.

He explained that the petitions submitted against the Office of Attorney General of the Federation (OAGF) and CCT chairman were not properly presented.

The senator noted that the presenter of the petitions did not indicate his name in accordance with Section 41(5) of the Senate standing rules.

He further claimed that the presentation of the petitions was unethical.

Marafa added that it was public knowledge that Saraki was an interested party since he is standing trial before the CCT Chairman the Senate planned to investigate.

The Zamfara Central lawmaker said they have found out that the Executive Secretary of Anti-Corruption Network is a senator.

He noted that the senator was also a member of the Senate Committee on Ethics, Privileges and Public Petitions charged to probe Umar.

The forum’s spokesman insisted that it would be difficult for the CCT chairman to get fair hearing during the Senate investigation.

Marafa described the decision of Saraki to rule him out of order as “open tyranny and impunity”, saying Nigerians should stop the Senate President from continuing with the attitude.

He noted that the Senate Rule is specific that when a senator is standing on Point of Order, he/she must be allowed to make his point.

He said: “Today, I rose to speak on something that is fundamental. But to my surprise, the Senate President is becoming more desperate. This is open tyranny and impunity of the highest standard. The consequences of this will only make the Senate ungovernable in future.”

In the petitions, the group alleged that the OAGF failed in its duty in arraigning Justice Umaru for corruption.

The petitions alleged that the Chairman of the Economic and Financial  Crimes Commission (EFCC) wrote an “investigation report” to the Attorney-General of the Federation about evidence of criminal allegations against two suspects from CCT, namely  Justice Umaru and Ali Gambo Abdulahi.

It claimed that only the second suspect, Ali Gambo, was prosecuted and that “Danladi has been left unprosecuted” after the OAGF ordered their trial.

“This is a breach of the order of AGF. Since then, the office of the Attorney General has been silent on this failure to prosecute as directed,” the petition said.

  • Unity Forum’s case against Saraki to go on

Unity Forum’s case against Saraki to go on

The Senate Unity Forum (SUF) yesterday vowed to forge  ahead with its legal battle against Senate President  Bukola Saraki and his deputy, Ike Ekweremadu.

Other defendants in the alleged Standing Order forgery suit are the Clerk of the National Assembly, the Clerk of the Senate, the Senate and the National Assembly.

Senators Suleiman Hunkuyi, Kabir Garba Marafa, Abu Ibrahim, Robert Ajayi Boroffice and Gbenga Ashafa insisted that their case before the Federal High Court, Abuja should go on.

The Forum, in a statement by its counsel, Mamman Mike Osuman (SAN), against the backdrop of reports that the SUF withdrew its suit on the alleged forgery of the Senate Standing Orders 2015, made its position public.

There were reports on Tuesday that Justice Ademola Adeniyi of the Federal High Court struck out the suit by the five Senators on behalf of the Senate Unity Forum (SUF).

The counsel to the SUF, Mamman Mike Osuman (SAN), said it was “erroneous and mischievous” to claim that the suit by the five senators had been withdrawn.

He added that it was the first suit filed by Senator Anthony Adeniyi, who was in the 7th Senate, that was withdrawn to avoid abuse of court process.

He said: “Despite the legal possibility that the suit discontinued by Sen. Anthony Adeniyi could be re-filed, the media should have been more specific about the case withdrawn.

“Contrary to the misinformation put out there, we hereby confirm that the originating summons in suit no: FHC/ABJ/CS/651/2015 filed at the instance of the above-named senators against Saraki, Ekweremadu and the National Assembly.

“The above particularised suit differs in contents from that of Sen. Adeniyi as can be distilled from their respective grounds, reliefs sought, affidavit evidence, parties and declarations sought.”

Osuman insisted that the prayers sought by the five senators in the originating summons were still subsisting.

He said the plaintiffs maintained their position that  the election of Saraki and Ekweremadu was “illegal, irregular and non-sustainable because the Senate Standing Orders (2011) was not amended in the manner stipulated by Rules 110 of the 2011 Senate Standing Orders to produce the purported document titled: Senate Standing Orders 2015 (as amended).”

The senators urged the court to prevent Saraki and Ekweremadu from “proceeding with the constitution of committees and appointment of chairmen and deputy chairmen of committees respectively”.

He said the demands of the Senate Unity Forum are as follows:

    • The Senate Standing Orders 2011(as amended) was not amended in manner stipulated by Rules 110 of the 2011 Senate Standing Orders to produce the purported document titled “Senate Standing Orders 2015(as amended);
    • The purported election which produced Saraki and Ekweremadu as President and Deputy President of the Senate respectively are illegal, irregular, and non-sustainable;
    • That Saraki, Ekweremadu, the Clerk of the National Assembly and the Clerk of the Senate wrongfully relied on the Senate Standing Orders 2015 (Exhibit “B”) in electing the President and Deputy President of the 5th Defendant (Senate);
    • That Saraki and Ekweremadu still seek to abide by these contrived Rules which are at variance with the valid, regular and subsisting Senate Standing Orders 2011(as amended); and
    • The instant suit seeks not only the reversal of the illegal elections and appointments but also to restrain Saraki, Ekweremadu and the Senate from proceeding with the constitution of committees and appointment of chairmen and deputy chairmen of committees.
  • Senate hails withdrawal of suit by Unity Forum

The Senate praised yesterday its members who operate under the aegis of ‘The Unity Forum’ for withdrawing the suit they filed before the Federal High Court, Abuja, in which they sought to remove the Senate President, Dr. Abubakar Bukola Saraki and his Deputy, Senator Ike Ekweremadu, over allegation of forgery of the Senate Standing Orders 2015 used for the inauguration of the eighth Senate.

Justice Ademola Adeniyi, of the Federal High Court, Abuja on Monday struck  out the case and terminated hearing on the matter after the plaintiffs withdrew their suit.

The five members of the Unity Forum who instituted the suit are Senators Abu Ibrahim, Kabiru Marafa, Ajayi Borofice, Olugbenga Ashafa and Suleiman Hunkuyi.

Chairman, Senate Adhoc Committee on Media and Publicity, Senator Dino Melaye, in a statement in Abuja, hailed members of both the Unity Forum loyal to Senator Ahmad Lawan and the Like Minds Senators loyal to Saraki for their maturity and sagacity.

Melaye said that with the discontinuation of the suit, the plaintiffs and their supporters have demonstrated that national interest is superior to individual and group interest. He added that the development has put to shame divisive elements who wanted to ridicule the eighth Senate.

Melaye said: “On behalf of the Senate, we want to commend the maturity of the Unity Forum Group and Like Minds Group. We appreciate that by withdrawing the suit, national interest has overcome individual and group interest.

“I salute the sagacity of the Unity Forum for withdrawing the matter from the court. This is as a result of series of underground reconciliatory moves. I salute the sense of purpose of both groups.  By this very positive development, the divisive elements who wanted to bring the eighth Senate to ridicule have been completely shamed.”

He stated that the eighth Senate will henceforth remain focused on issues that border only on the security and welfare of the people.

“Our primary objectives shall continue to remain about the people, the people and the people. The Senate President has promised to carry all parties along and he  shall at all times place national interest above primordial sentiments”, Melaye said.

  • Funds’ diversion: EFCC’s probe is illegal – Unity Forum

Funds’ diversion: EFCC’s probe is illegal – Unity Forum

The Senate Unity Forum on Wednesday faulted the invitation of the Chairman of the Economic and Financial Crimes Commission (EFCC), Mr. Ibrahim Lamorde, by the Senate Committee on Ethics, Privileges and Public Petitions.

The Forum said the invitation was illegal and a breach of the Senate Standing Rules.

It said there is no record indicating that the petition by Mr. George Uboh, was presented to the Senate in plenary.

It asked the Senate leadership to halt the ongoing probe of the EFCC by the committee.

The Forum made its position known in a statement signed by Senator Ahmed Lawan, Senator George Akume, Senator Abu Ibrahim and Senator Barnabas Gemade.

The statement said: “The Senate Unity Forum hereby declares that the Senate Committee on Ethics, Privileges and Public Petitions probe of the Chairman of the Economic and Financial Crimes Commission, Mr. Ibrahim Lamorde is illegal and a breach of the Senate Standing Rules.

“In standard parliamentary practice, a petition is routed through either a Senator or a member of the House of Representatives. Upon receipt of such petition, the representative will inform the presiding officer of the chamber and, thereafter, present the petition in plenary.

“Upon presentation in plenary, the presiding officer will invite the Senator/Representative to lay the same petition on the table in the chamber, which automatically becomes a public document.

“Thereafter, the presiding officer will refer the petition to the appropriate committee for consideration upon which it would be returned to the Senate in plenary.

“In this regard, nothing of the sort happened. Senate proceeded on recess on August 13 and it is not on record that the petition of Mr. George Uboh, accusing Lamorde of diverting over N1 trillion recovered from some corrupt Nigerians, including the former Bayelsa State Governor, Diepreye Alamieyeseigha, and the former Inspector General of Police, Tafa Balogun was presented to Senate in plenary.”

The Senate Unity Forum urged the Senate leadership to halt the probe of the EFCC.
