    ‘You have no power to declare our seats vacant’

    The Rivers State Assembly members  loyal to Governor Siminialayi Fubara yesterday hit back at the Martin Amaewhule-led House, saying it lacked the powers to declare their seats vacant.

    The pro-Fubara lawmakers  insisted that the seats  of  Amaewhule and 24 others remain vacant following their alleged defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

    The lawmakers said the legislators’ seats must be filled through a bye-election conducted by the Independent National Electoral Commission (INEC) .

    The lawmakers, in a statement  by their Speaker,  Victor Oko-Jumbo, in Port Harcourt, explained that the 25 legislative seats were declared vacant on December 13, 2023, by  Edison Ehie, and regretted that the commission had been foot-dragging on the conduct of bye-election to fill the vacant seats.

    Oko-Jumbo said: “Today, the 15th day of October, 2024, Martin Chike Amaewhule & 24 Ors who ceased to be members of the Rivers State House of Assembly, on December 11, 2023, purportedly declared vacant the legislative seats of  Victor Oko-Jumbo and others as members of the Rivers State House of Assembly. They have no such powers. This is an exercise in futility. It is a joke taken too far”.

    Oko-Jumbo said that the inability of INEC to do the needful since December 13, 2023, had created room for unnecessary distractions from Amaewhule and called on the commission to discharge its constitutional responsibilities to the people of the state.

    Oko-Jumbo said:  “Please, recall that on the 11th day of December, 2023, Martin Chike Amaewhule and 24 others defected from the Peoples Democratic Party that sponsored their election into the Rivers State House of Assembly, to the All Progressives Congress.  Their defection was headline news and widely reported in print and electronic media.

    “On the 13th day of December, 2023, the defection by Martin Chike Amaewhule and 26 others was further cemented in an affidavit deposed to by Martin Chike Amaewhule, when in Suit No. FHC/ABJ/CS/1681/2023, Martin Chike Amaewhule & 26 Ors v. INEC & 5 Ors. in paragraphs 15 thereof, he deposed as follows: ‘That faced with the state of uncertainty and confusion in the 2nd defendant (Peoples Democratic Party) caused by division in the political party, the Plaintiffs were forced by the state of affairs within the 2nd defendant to defect and join the All Progressives Congress (APC).”

    “On the 13th day of December, 2023, Rt. Honourable Edison Ogerenye Ehie, as then Speaker, declared the seats of Martin Chike Amaewhule and 24 others in the Rivers State House of Assembly vacant, and called on the Independent National Electoral Commission (INEC) to conduct bye-election to fill their vacant legislative seats. This has not been challenged and set aside by any court of law.

    “Subsequently, I was elected as the Speaker of the Rivers State House of Assembly.  Myself and the members of the Rivers State House of Assembly have been piloting the affairs of the Rivers State House of Assembly, including passing resolutions and screening various eminent persons as commissioner-nominees and recommending them to  His Excellency, the Governor of Rivers State to be appointed and sworn-in as Commissioners, among others.

    “Truth and facts are constant, sacrosanct and indelible.  The fact of the defection by Martin Chike Amaewhule and 24 Ors cannot be erased by pretenders like Martin Chike Amaewhule and his committee of friends.

    “As the Rt. Honourable Speaker of the Rivers State House of Assembly, I call on INEC to immediately conduct bye-election to fill the legislative seats declared vacant on December 13, 2023. I also call on Nigerians and the good people of Rivers State in particular, to ignore the vituperations and ranting of Martin Chike Amaewhule and his committee of friends.

    “They are not members of the Rivers State House of Assembly not to talk of having the powers to declare vacant the legislative seats of legitimate Assembly members, who have remained steadfast and did not defect like them”.

    Rivers judgement: Oko-Jumbo heads for Supreme Court

    The Victor Oko-Jumbo-led lawmakers have confirmed the filing of an appeal at the Supreme Court challenging the judgement of the Appeal Court delivered on Wednesday in Port Harcourt. 

    Oko-Jumbo insisted that he remained the Speaker  despite the Appeal Court judgement.

    He said they “strongly believes that the Court of Appeal was in error when it held that the Rivers State High Court lacked the Jurisdiction to hear and determine Suit no. PHC/1512/CS/2024”.

    He spoke while addressing his camp during a plenary at the temporary facility used for Legislative businesses in Port Harcourt on Friday.

    Oko-Jumbo declared that he remained the authentic Speaker because there could not be two Houses of Assembly in Rivers State.

    Oko-Jumbo in a statement by Dr. Gillis West said that the seats of Martin Amaewhule and 24 other former lawmakers remained vacant as declared by the then factional  speaker, Edison Ehie, on 13th December, 2023, following their defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) on the 11th day of December, 2023.

    He said: “There cannot be two Houses of Assembly in Rivers State or indeed any State in Nigeria. This House of Assembly, with me as the Speaker, is the only House of Assembly in Rivers State.

    “As the whole world knows, on the 11th day of December, 2023, Martin Amaewhule and his 24 friends defected from the Peoples Democratic Party to the All Progressive Congress.

    “On the 13th Day of December, 2023, Rt. Hon. Edison Ehie, as the Speaker of the Rivers State House of Assembly, declared the seats of Martin Amaewhule and 24 others in the RSHA vacant. That declaration by Rt. Hon. Edison Ehie has not been set aside by any court in Nigeria.”

    Oko-Jumbo explained that the legitimate members of the Rivers State House of Assembly secured restraining order against Martin Ameawhule and the 24 others when they continued to parade as members of the RSHA despite their defection from the Peoples Democratic Party to the APC and their seats declared vacant.

    He said that because they felt dissatisfied with the rulings of the Rivers State High Court in Suit No. PHC/1512/CS/2024, Martin Amaewhule & 24 ORS had filed an Appeal No. CA/PH/198/2024 at the Court of Appeal, Port Harcourt Division.

    Oko-Jumbo said: “Yesterday, the 4th of July, 2024, the Court of Appeal, in its lead Judgement, allowed the Appeal by Martin Ameawhule & 24 ORS on the ground that the Rivers State High Court lacked the jurisdiction to hear and determine the case. 

    “Accordingly, the Court of Appeal struck out Suit No. PHC/1512/CS/2024 and NOTHING MORE. The Court of Appeal did not make any declaration that Martin Amaewhule & 24 ORS did not defect from the PDP to APC. 

    “The Court of Appeal also did not make any declaration that Martin Amaewhule and 24 ORS are still members of the RSHA.”

    Oko-Jumbo added: “We strongly believe that the Court of Appeal was in error when it held that the Rivers State High Court lacked the jurisdiction to hear and determine SUIT NO PHC/1512/CS/2024. 

    “Accordingly, we have instructed our lawyers and they have filed an appeal to the Supreme Court of Nigeria challenging the judgement of the Court of Appeal delivered on the 4th Day of July, 2024.

    “Martin Amaewhule & 24 ORS, in spite of all their pretences, are no longer members of the Rivers State House of Assembly, and they remain so until a court of competent jurisdiction says otherwise.

    “Once again, we the legitimate members of the RSHA HEREBY call on the Independent National Electoral Commission (INEC) to promptly conduct a bye-election to fill the vacant seats in the RSHA.

    “We strongly urge the general public to ignore Martin Amaewhule & 24 ORS in their pretence that they are members of the RSHA,” he added.

    During the plenary, the Oko-Jumbo-led considered two bills, opened debate, and moved them through first reading.

    Rivers Assembly screens, confirms eight commissioner designates

    The Victor Oko-Jumbo-led faction of the Rivers State House of Assembly, on Tuesday screened and confirmed eight nominees for possible appointment as commissioners in the state.

    The News Agency of Nigeria (NAN) reports that the screening took place at the temporary legislative chambers located within the state Government House.

    The Oko-Jumbo-led three-member legislature is loyal to the state Governor, Siminalayi Fubara.

    The commissioner designates are to fill some of the vacancies created by the recent resignation of nine commissioners loyal to the Federal Capital Territory Minister, Chief Nyesom Wike.

    During the sitting, Oko-Jumbo read the correspondence from the governor, requesting the screening and confirmation of the nominees.

    He expressed the assembly’s commitment towards supporting the governor to provide democracy dividends to Rivers people.

    The factional speaker said that the screening was part of the assembly’s responsibility in the governance of the state

    Responding, the House Leader, Mr Sokari Good-boy and Deputy Speaker, Adolphus Timothy, unanimously adopted the request.

    They said that most of the nominees had previously served the state at various capacities without blemish.

    The commissioner designates include, Mr Charles Bakee, Mr Collins Onunwo, Dr Peter Medee and Mr Elloka Amadi,

    Others are, Mr Basoene Benibo, Mr Sydney Gbara, Dr Ovy Chukwuma and Mr Solomon Eke.
