ABU Professor guilty for enticing married woman- Supreme Court

The Supreme Court on Friday affirmed the conviction and sentencing to two months in prison of Professor Festus Kolo, a lecturer at the Ahmadu Bello University, Zaria for enticing a married woman.

The News Agency of Nigeria (NAN) reports that the pronouncement was without an option of fine.

Delivering the judgment, Justice Clara Ogunbiyi held that the appellant had failed to dispel the prosecution evidence that linked him to the offence.

“It is ironical and intriguing that a Counsel for the appellant, who described the act of his client as condemnable and detestable, could in another tone dismiss the same act simply as mere allegation.

“It was stated that the appellant had been warned severally by the husband of the woman both face to face and on phone to stay away from her.

“He had refused to heed until he was caught red handed with the woman in a hotel room.

“The appellant according to the evidence before the court had left his place and travelled for up to four hundred kilometres from Zaria to Dutse to pursue his illicit sexual act,’’ she said.

Ogunbiyi said: “it was alleged further that the appellant was arrested by the Police in the hotel room and later charged to court for enticing the married woman.

“This alleged offence is contrary to Section 389 of the Penal Code’’.

The judge said: “ for purpose of recapitulation, a critical analysis of the behaviour pattern exhibited by the appellant will give a reasonable assessment of his character and intention.

“This is well depicted in his persistent refusal to stay away from another man’s wife despite several warnings by her husband.

“In addition to the foregoing, the open confession made by the appellant to the commission of the offence during police investigation is a further reason to discountenance the submission put forward by the appellant.

“I have stated the position of this court earlier in the course of this judgment wherein it holds that the confession is the best form of evidence.

“And an accused person can be convicted on his confessional statement alone’’.

Ogunbiyi held that: “consequently, the lower court could not be faulted when it went ahead to affirm the conviction and sentence of the appellant.

“This was done according to strict compliance with summary trial procedure by the successive lower courts’’.

The judge, therefore, held that the appeal at hand was devoid of any merit.

“The concurrent judgments of the lower courts are endorsed while the conviction and sentence of the appellant by the lower court is also affirmed by me.

“The appeal is dismissed and the judgment of the lower court is affirmed by this court,’’ she said.

NAN reports that it was an appeal against the decision of the appellate session of Jigawa State High Court delivered on Sept.17, 2013 in appeal No. JDU/14/CA/2013.

The court had affirmed the judgment of the trial Magistrate Court, Kiyawa, Jigawa state wherein the appellant was convicted summarily for the offence.

Upon this conviction and sentence by the Magistrate, the appellant was dissatisfied and lodged an appeal before the appellate division of the Jigawa state High Court.

Kolo had asked the court to decide whether or not the lower trial Magistrate, “Senior Magistrate’’ had the jurisdiction to try and determine the offence under Section 389 of the penal code laws of the state.

After hearing argument from both sides, the High Court in its judgment delivered on Sept. 17, 2013 dismissed the appeal and upheld the decision of the trial court.

NAN reports that the statement of facts indicated that Kolo was a professor and lecturer at the Ahmadu Bello University, Zaria while the victim was his student at the University.

It was stated in the face of the First Information Report (FIR) that the appellant had been sending love messages via his phone number to the married woman through her phone number.

The FIR also said that the convict had defied all warnings, adding that he was thereafter caught in the near sexual act with the victim in a hotel by the police.

The convict had described the entire incident and trial as a set up. (NAN)

  • Woman steals lover’s car after drugging him

Woman steals lover’s car after drugging him

Rapid Response Squad (RRS) operatives have arrested a woman who allegedly drugged her lover in a hotel and stole his Volkswagen Passat Wagon 2001 model.

The suspect was apprehended in Agbor, Delta State last Tuesday, where she was traced to with the help of a dealer she engaged to process import papers for the stolen vehicle.

She was also said to have stolen her victim’s laptop and mobile phones from the hotel in Ojodu, Berger, where they lodged on January 19.

Also arrested was a generator repairer, Adesanya Gbenga, who drove the vehicle out of the hotel for her.

According to RRS, the victim, a doctor, said he met the woman on a social media site, Badoo, last year.

The suspect was said to have told her brother, Mukoro Okpako, of her intention to sell the vehicle but was arrested before she could perfect the papers.

The police also recovered the stolen vehicle from a shop in Warri, but its number plate was removed.

It was gathered that the suspect who gave the victim a false name, drugged the malt and yoghurt she got from the bar, while he was taking his bath.

He claimed that after taking the drink around 6pm, he slept off and woke up around 2pm the following day.

He said: “I went in to take my bath and when I returned, she had gone to buy some drinks. I took the malt drink and yoghurt and I slept off. I slept at 6pm and woke up around 2pm.

“When I woke up, my personal effects such as phone and laptop had gone. Unfortunately for me, I do not know any of her relatives. We only met on a social media dating site, Badoo about a year ago. As I woke up, I rushed straight to meet with the receptionist and gateman to ask for her whereabouts, that was when I realised my car had been taken away too.

“They told me someone came to pick the car for her. And, she said she was going to get food. Immediately, I reported the incident at Omole Police Station.

“I was getting to know her for real. She told me her name was Aisha and gave me these numbers- 08067188213, 07081240038. I never knew her name is Mitchel. Since the incident, I have been trying to call her to no avail. One of the numbers was switched off, she wasn’t picking the other.”

Gbenga, according to RRS, said he had driven about three cars to Sapele for the suspect.

RRS quoted him as saying: “I was surprised to see her opening the gate of the hotel herself for me to drive out instead of the gateman. That wasn’t the first time I would be helping her take a vehicle out of Lagos to Sapele. It was about the third time. First, it was a Toyota Camry “Big for Nothing.” I helped her move it from Ajah to Sapele. The second one was an “End of Discussion” Honda Accord and thirdly, Volkswagen Passat, 2001 model. I moved that too all night to Sapele.

“I was introduced to her last year by her elder brother, who works as a clearing and forwarding agent. I was told she needed the assistance of a good driver to take her to Warri. I later met her in Ajah where I helped her to carry a Toyota Camry to Sapele.

“About four months later, she summoned me to GRA Ikeja. She gave me a Honda Accord (End of Discussion) to help her collect fuel from her brother at Wawa, Ogun State. I took the fuel and returned the car. She then told me that she has gotten another driver to take her. She gave me N5000 and I left.

“The last vehicle is the one that has created crisis for me. Although, I have been wondering where she has been getting these cars but she told me that she hired them from Delta whenever she comes to Lagos, and that a driver brought her to Lagos and returned to Delta. I didn’t know she steals cars.”

A source said she tried to conceal the victim’s phone when she was apprehended, adding that investigations were ongoing to know the whereabouts of the other stolen cars.

Police spokesperson, Dolapo Badmos, a Superintendent (SP), said the case had been transferred to the State Criminal Investigation and Intelligence Department (SCIID).

  • THE REASON WHY MY WOMAN SCREAM FOR MORE

THE REASON WHY MY WOMAN SCREAM FOR MORE

    SPONSORED POST

Majority of us living are carriers of various diseases; infections and worst of all burdens. We fail to share our problems with people around us because of the general ego we (humans) exhibit. Sometimes, it might not be the ego but the fear of been stigmatized. Share on Facebook Share on Twitter One thing I have come to realize is that humans irrespective of our race or sex have one problem or the other but never get solution because we conceal these pains to ourselves alone.

I have suffered a lot in the past because of my ignorance and shy personality but I have taken this bold step to share my experience with you all readers so as to save some millions of souls out there who is suffering from this condition I was battled with even though I was presented with a saving grace (http://aloehealthsolution.com.ng/arji1.html) but I was by then still blind to the truth. I am 36 years old married with a year old daughter.

I know many would say not bad now nor too old an age for an African man, but truth be told it was an underachievement in terms of child rising for me considering the standard I had set for myself initially. I came from a well to do home and was very lucky to gain admission into university at the age of seventeen were I studied history and international studies.

While I was in 200 level, few months to my 19th birthday I was still a virgin but felt ashamed of my status because of what older boys would say about having fun with their lovers on campus. Since I had no girl friend of my own I picked up some shameful practice which was masturbation. I soon got addicted and never felt the urge for having a girl-friend anymore, hence I was a very shy person who cannot confidently walk up to a lady and ask her out. As an addict, I would seek for any opportunity to induce ejaculation which would mean making use of any available opportunity either in the room alone, toilet, bathrooms, and sometimes in the sitting room while watching adult movies. The exercise was never a total success in many occasions as I soon got nervous whenever I hear voices or footsteps approaching I tend to hasting up the ejaculation so I can gain the needed pleasure before the intrusion of the third party. Often times the duration of these practice is 2 minutes and few seconds at max. Gradually, it became a habit an even without any interference I could no longer hold up for more than two minutes before ejaculating.

http://aloehealthsolution.com.ng/arji1.html. It got me so worried because I could have my peers bragging of lasting for more than 20 – 30 minutes during sexual intercourse I knew quite well that some might be exaggerating but not withstanding I could not help that feeling of been weak or inferior among them so I never told anyone about my condition. I had my very first girl friend at the dinner party organized for us the final year students. I was 20 years plus then while she was 22.

My mature look and lanky stature helped me overcome the age gap between us. She told me that she was a virgin, so, we never needed to have sex which was very ok by me. We had our marriage immediately after our service year since my parents agreed to sponsor it. The marriage exposed my deficiency I did not have an enjoyable honeymoon. I tried hard but could never get my spouse to orgasm. She agreed to endure with me and we began to seek for solution. I tried so many local herbs but it never worked all I achieved was quick erection but not lasting sex life. I was shy to open up to my family doctors. I stayed long on the internet but never came across this life changer

(http://aloehealthsolution.com.ng/arji1.html) Share on Facebook Share on Twitter So I began to try other means I could remember then how some would say they use drugs to enhance this so I self medicated on clomipramine, dapoxetine and sildenafil. These drugs were not so easy to get without doctor’s prescription so I would buy a handful doze of ‘’TM’’. I soon abused these “SSRIs”. I must be honest this almost ruined my life completely as it made me hyper active. On most occasions my wife got tired of my condition and deserted me. I eventually had a diminished libido as an effect of over reliant on the drugs. Share on Facebook Share on Twitter I had no choice now but to open up since my condition has worsen, I did not tell our family doctor since I don’t want my parent to know but it wasn’t easy at the same time. The doctor warned me to stop completely the intake of cigarette or alcohol and began a therapy with me. I could feel a change in my system but it was rather too slow and most times I feel I still suffer from low sex drive despite my replacement therapy with various testosterous. I lost my confidence as a man I decide not to re marry. THE TESTIMONY On October 21, 2015 I was home in my parent house to mark my 35th birthday with them all when I overheard my younger brother friend telling him how is elder brother got saved from similar issue of quick ejaculation and that I have suffered from for many years at this point I was no longer shy I quickly cut in and met with my brother in person. He gave me this website and guaranteed me full recovery which I never believed was possible. I eventually visited the link http://aloehealthsolution.com.ng/arji1.html I visited the site and was well accepted. I opened up completely and was placed on some supplements which did not take me more than three (3) weeks to gain my natural but boosted active self. Today I am happily married with a beautiful daughter. I feel so indebted to Sanmi my brother’s friend for showing me the way out.
