    Faleke fails to unseat Bello

    The Kogi State Governorship Election Petition Tribunal sitting in Abuja Monday dismissed the petition James Faleke the running mate to the late governorship candidate of the All Progressives Congress (APC), Abubakar Audu in the last governorship election in the state.

    Faleke had challenged the emergence of Yahaya Bello as the governor of the state and sought to be declared winner of the election on among other grounds, that his joint ticket with the late Audu won the election.

    Delivering the judgment of the three-man tribunal Monday, Justice Halima Mohammed held that Faleke’s petition lacked merit, the petitioner having failed to participate in the election to the end.

    The tribunal was of the view that the initial part of the election, in which Faleke participated as the running mate of the late Prince Audu Abubakar, was inconclusive and did not produce a winner.

    The tribunal held that the APC, as a political party, was legally empowered to nominate and sponsor a candidate for an election because the Constitution did not recognise an independent candidate.

    It further held that Faleke was without the requisite locus standi (the right to institute a suit in court) to challenge Bello’s victory because “he was never a governorship candidate in the election.”

    The tribunal further held that APC duly nominated and sponsored Bello as its candidate for the election and having originally nominating the late Prince Audu, the party was entitled to inherit the votes cast in the initial part of the election held on November 21, which INEC declared inconclusive.

    Before determining the main petition, the tribunal ruled on the preliminary objection by Bello. It upheld the objection and held that Faleke lacked legal capacity to file the petition, holding that the November 21 election which he claimed to have won was inconclusive as declared by INEC.

    The tribunal held that contrary to Faleke’s contention, the November 21 election was not conclusive and therefore, the right had not accrued to petitioner to step into the late Audu’s shoes going by the provision of section 181(1) and (2) of the Constitution.

    It noted that the Independent National Electoral Commission is the only body charged with the responsibility of declaring an election conclusive or inconclusive.

    “The provisions of Section 181 of the Constitution contemplate only situation where declaration has been made and the governor-elect and deputy-governor-elect have been returned.

    “It is hereby observed that the situation where the petitioner can step into the late Abubakar Audu’s shoes has not arisen in the instant case.

    “And there is no evidence before the tribunal that the petitioner had been declared deputy governor-elect.

    “Section 181 of the Constitution does not contemplate a situation when none of the candidates who participated in the election has been returned,” the tribunal said.

    While considering the main petition, the tribunal held that Faleke was never a governorship candidate of the APC at any stage of the election and did not participate in the primary leading to APC’s choice of its governorship candidate for the November 21 governorship.

    It added that the petitioner was never nominated by the APC as its governorship candidate for the December 6 supplementary poll.

    The tribunal further held that since Faleke was never a governorship candidate, he lacked the competence to present the petition before the tribunal by virtue of section 137(1) (a) of the Electoral Act.

    It also held that the issues contended by Faleke bordered on the power of a political party to nominate its candidate, a decision which Justice Mohammed ruled that the tribunal lacked jurisdiction to interfere with.

    The tribunal added that Faleke having not participated in the said primary, he lacked the locus standi to challenge Bello’s nomination by the party.

    It added that going by Supreme Court’s decision on supplementary election in the case of Peoples Democratic Party vs Rochas Okorocha, the votes polled on November 21 belonged to the various political parties thus, the APC had the right to replace its flag bearer upon Audu’s death.

    It also held that there was evidence that Bello participated in and emerged as the first runner-up in the primary from which the original governorship candidate of the party, the late Abubakar Audu, emerged as the party’s flag bearer.

    “It is a fact that the second respondent participated in the primary and came second in the primary.

    “It is equally a fact that the second respondent participated in the December 5, 2015 supplementary election.”

    The tribunal also dismissed Faleke’s contention that Bello was not qualified to run for the office of the Governor of Kogi State.

    It held that contrary to the petitioner’s argument, (Bello) fulfilled the conditions for qualification as contained in Section 177 of the Constitution, requiring that a candidate must be a member of a party, sponsored for the election by the party, a citizen of Nigeria, more than 35 years of age and educated up to the level of secondary school certificate or its equivalent.

    The tribunal faulted Faleke’s argument that Bello’s election was invalid as he contested the December 6 poll without a running mate.

    It held that contrary to Faleke’s argument, remained the deputy governorship candidate of the APC in the December 6 supplementary poll having failed to withdraw his candidacy as the running mate in the manner stipulated by law.

    It noted that rather than send his withdrawal letter to his party, Faleke erroneously send the letter through his lawyer to INEC.

    The tribunal will Tuesday deliver judgment in the petition by the candidate of the Peoples Democratic Party(PDP) in the election, Idris Wada, who is also seeking to unseat Bello.

    The Kogi State governorship election petition tribunal sitting in Abuja on Monday dismissed the petition filed the deputy governorship candidate of the All Progressives Congress (APC) in last November governorship election in the state, James Falake, challenging the emergence and subsequent election of Yahaya Bello as governor of the state.

    A three-man panel led by Justice Halima Mohammed held that Faleke lacks locus standi to challenge Bello’s election having never been sponsored by his party as governorship candidate in the November 21, 2015 election and the December 6, 2015 supplementary poll respectively.

    The tribunal dismissed the petition for lacking in merit.

  • Bello appoints administrators for Kogi LGs

    Kogi State Governor, Alhaji Yahaya Bello, on Friday appointed administrators for local councils in the state.

    The governor during a ceremony at the Government House in Lokoja swore in administrators for 20 out of the 21 local government areas in the state, leaving out Lokoja local government, which he said will be announced later

    The new administrators are to inaugurate four other members for their respective councils on Monday.

    Addresing the administrators in government, the governor said their every step will be watched at the new positions.

    He added: “You are going to be monitored by this state and even your opponents. You are owing a lot of salaries. As Mr. President has graciously released part of our bailout funds, ensure they are cleared.

    “For any security issue from your local government areas, I will hold you responsible. Flush out criminals from amongst you. It is why security chiefs are here.

    “Every kobo of LGA funds must be accounted for. I, Yahaya Bello, will not send anyone to get money from you. Disregard any request for money from anyone however highly placed in my government.”

    The governor added, “No one can boast they were instrumental to your being appointed. Your allegiance should be to this state and to your people at the grass root. Our people have suffered enough.

    “I hereby inaugurate you and give you the authority to inaugurate other four members of the committee by Monday. The list shall be given to you, signed by me.”

    The ex- Governor of Kogi State, Capt. Idris Wada, has faulted reports credited to his successor, Alhaji Yahaya Bello, on the status of the N20 billion bailout fund approved by the Central Bank of Nigeria (CBN), saying there was no truth in the assertion that the new administration applied newly for the money from the Federal Government.

    Wada in a statement issued by his Chief Communications Manager, Mr. Phrank Shaibu, said it was part of the bailout approved for the state during his tenure that ‎the CBN released, adding that Governor Bello could not have fulfilled the conditions precedent for a state to benefit from such fund.

    He said, “It is curious that Governor Bello announced that the CBN has approved N20 billion as part of N50 billion bailout fund applied for. It was the same N50 billion we requested for out of which N20 billion was to have been released before the All Progressives Congress-led Federal Government created bottlenecks to frustrate us from getting the bailout. But the coincidence in the figures leaves a very sour taste in the mouth.

    “We wonder how the new administration could have applied for a bailout when there is no state executive council in place to approve, neither has the state assembly ‎met to deliberate on the application, nor the staff audit embarked on by Bello to determine exact overhead cost completed.

    “Since the advent of the new administration, commissioners have not been appointed. So, could the state executive council have met to approve the application? The state house of assembly has been in turmoil since January this year. Could some ghost lawmakers have been employed to approve the application? And has the current staff audit ended as to have determined the monthly workers’ pay? How was the so called fresh application done without meeting these conditions?”

    KOGI APC PASSES VOTE OF NO CONFIDENCE ON GOV YAHAYA BELLO

    The Kogi State chapter of the All Progressives Congress (APC) is on the war path with Governor Yahaya Bello after passing  a vote of no confidence in him.

    The party has also reported the governor officially to the APC National Secretariat in Abuja.

    Bello is accused of  sidelining members of the state executive council and other organs of the party in the affairs of the state, and patronizing members of the Peoples Democratic Party (PDP).

    Rising from a meeting in Lokoja, the State Executive Council of the APC said that of the 45 appointments so far made by the governor since his inauguration, he has not deemed a single member of the party fit enough for the positions.

    “All the 45 appointments made so far by Gov. Yahaya Bello are given to the PDP,” they said, and vowed to have nothing to do with him  “from now henceforth.”

    They accused him of supporting the PDP in the last re-run election “making us to lose two senators, one House of Reps and two House of Assembly members.”

    They labilled him “an APC governor who has not deemed it fit to appoint a single APC member in his cabinet and board, an APC Governor who openly relates with PDP Local Government Chairmen and leaders and abandon his party men is not our best dream project.”

    Besides, they accused the governor of masterminding the leadership crisis now rocking the State House of Assembly which led to a resolution by the House of Representatives to take over the affairs of the state legislature.

    They asked the national leadership of the party to ensure that Bello has no input whatsoever in who will be replacing the late Minister of State for Labour, Mr. James Ocholi.

    However, the governor’s spokesman, Kingsley Fanwo, dismissed the allegations against his principal as untrue.

    “It is absolutely untrue, ignominious and unintelligent to insinuate that members of the State Executive Committee of APC are working at variance with the landmark progress of the APC government in the state.”

    He called for the co-operation of all APC members with the governor for him to succeed for the glory of the party.

  • Staff included 300 ‘ghost workers’ in Kogi salary payroll

    Kogi State Govermor, Alhaji Yahaya Bello has decried the role of some officials of the state civil service who he said are constituting a cog in the wheel of the development of the state.

    The governor said that the committee handling the ongoing workers screening at both state and local government levels discovered mind-boggling acts perpetrated by civil servants.

    Addressing a crowd in Okene, headquarters of the central senatorial district of Kogi State on Saturday during a reception organized for him, he decried the ghost workers’ syndrome.
    He said the screening committee uncovered how a single person included “as many as 300 ghost workers in the payroll of a local government” at the detriment of development of the council area.

    He said his administration will not spare the perpetrators after the ongoing screening exercise.

    According to him: “It is ridicule to discover that a single person without an iota of fear of God placed as much as 300 ghost workers on the payroll of a local government”.

    He added that after the screening exercise, it is only the actual workers that will receive salaries from the state and local governments.

    “This one person is just one of many in the business of siphoning public funds into their private pockets. We will ensure that the law take its course with those suspected of putting ghosts into the system so that it will serve as a deterrent to others,”said the governor.

    He stated that workers’ welfare was his priority, noting that the state government has paid two salaries in less than two months of the present administration.

    He said, “The temptation to use the money available for other things was great, but we have chosen to prioritise the welfare of our workers. In that regard, we have paid two salaries in less than two months.

    “We paid the first batch of salaries across board and without asking too many questions even though we knew the nominal rolls were compromised. This was to help actual workers who needed money to handle their responsibilities.

    “The second batch we paid with the personal guarantee of the Head of each Ministry Department and Agency (MDA) because we reasoned that change begins with each of us, and a leader should know those working under his immediate supervision”.

    The Ohinoyi of Ebiraland, Dr. Ado Ibrahim solicited cooperation and support for the governor to enable him deliver the dividend of democracy.

    He emphasised the need for peaceful co-existance irrespective of tribe or religion.

    “I am appealing to my people and indeed the entire people of the state to let peace prevail among ourselves. It is only in the atmosphere of peace that we can see and enjoy more dividend of democracy,” he said.

    No crisis in Kogi State – Governor

    The Governor of Kogi State, Yahaya Bello on Wednesday said that there is no crisis in the House of Assembly and the state in general.

    He made the remark while speaking to State House correspondents after meeting with the Chief of Staff to the President, Abba Kyari, at the Presidential Villa, Abuja.

    According to him, the House of Assembly is sitting and all legislative works are ongoing.

    Ruling out crisis in the state, he said: “My house is sitting and we have absolute peace in Kogi state, I am not aware of that.  The National Assembly was supposed to have taken over, the state is absolutely in peace and the legislative activities are ongoing.

    “I am the executive and the executive is functioning and we are doing the best we can, so legislature is their own business and they are on it.

    “I have a speaker that is sitting right now. So I don’t know if there is any problem there.” He added

    On the application for bail-out funds for his state, he said: “We applied for it and its under processing right now I have not gotten any bail-out yet.

    “Well I think to the best of my knowledge, the last administration either did not go on with the process properly, we are now to trying to correct whatever was not done properly, so that we can access it for our people.”

    He urged the people of his state to remain calm, noting that the state has suffered for a long time.

    “This is not the time for political crisis. This is the time to work and I am here to work. I am not here to have any political fuss with anybody; whoever is ready should join me and let’s fix Kogi state,” he stated.

  • Kogi: Hearing begins Monday in Faleke’s petition

    The Kogi State Governorship Election Petition Tribunal will commence hearing in the petitions challenging the election of Yahaya Bello of the All Progressives Congress (APC) as governor of the state.

    Six petitions were filed before the tribunal now sitting in Abuja following fear of insecurity in Lokoja, the Kogi State capital.

    On Tuesday, tribunal Chairman, Justice Halima Muhammed announced that parties would adopt reports of their pre-hearing sessions beginning from Monday (March 14), following which trial will commence.

    The chairman said the tribunal will take the objections to the petition along with the substantive petition.

    Parties in the petitions told the Tribunal that they will be calling two witnesses each to prove their cases in the petition challenging Governor Bello’s election.

    On February 23, 2016, the Tribunal fixed dates for pre-hearing sessions in the six petitions filed by different parties challenging the outcome of the last governorship election held in the state.

    Upon agreements by lawyers in the petitions, including Chief Wole Olanipekun (SAN), (Alex Iziyon –SAN), (for the Independent National Electoral Commission), Mahmud Magaji (SAN), (for Yahaya Bello), Chris Uche  (SAN), (Idris Wada and Peoples Democratic Party), among others agreed to ensure that all the necessary processes were filed before the next dates.

    The first petition mentioned was the one by James Faleke against INEC and Bello. Faleke who ran as running mate to the late governorship candidate of the All Progressives Congress (APC), Abubakar Audu, is seeking to be declared winner of the election on among other grounds, that his joint ticket with the late Audu won the election.

    The second petition was the one filed by Idris Wada (immediate past governor of the state), his deputy, Yomi Awoniyi and their party, the PDP against Bello, APC and INEC.

    Pre-hearing session will be held on Wednesday in the third and fourth by Progressive Peoples Alliance (PPA) and Labour Party (LP), while those by Usman Zainab and her party, the African Development Party (ADP), and Akwu Umar Goodman of the All Progressives Grand Alliance (APGA) have been fixed for March 11, 2016.

    Bello sacks Accountant General, Perm Secs

    Kogi State Governor, Alhaji Yahaya Bello, on Monday directed all the permanent secretaries and heads of parastatals in the state civil service to immediately proceed on compulsory leave.

    A statement issued by the governor’s Chief Press Secretary, Kingsley Fanwo, said  the state Accountant General has been relieved  of his position, while his second in command will proceed on 30 days compulsory leave.

    The statement reads: “I wish to confirm that His Excellency, Alhaji Yahaya Bello has directed that all permanent secretaries, heads of administration are to go on compulsory leave with immediate effect. The only exemptions to this category are people on acting capacity and the permanent secretary, government house.

    “Also, the Accountant General has been relieved of his position, while the second in command will proceed on 30 days compulsory leave.

    “At the local government level, the Directors of Local Government (DLGs), treasurers, education secretaries and cashiers are also to proceed on compulsory leave.”

    Bello orders reinstatement of Kogi LG chairmen

    Governor of Kogi State, Alhaji Yahaya Bello on Friday ordered the immediate reinstatement of all council chairmen that were relieved of their positions on political grounds.

    In a directive through his Chief of Staff, Mr. Edward Onoja, the governor stated that he is committed to his contract with the people of Kogi State to promote the rule of law and ensure that no one is oppressed based on political beliefs or any other reason whatsoever.

    The Governor directed that in situations where the council vice chairmen are acting in the capacity of the affected chairmen, the former are to revert to their original positions.

    The normalization, said the governor is to be carried out “without rancour, regardless of political differences.”

    According to the directive, LG chairmen who were removed via impeachment are considered to have been legally removed.

    The governor directed the Ministry of Local Government and Chieftaincy Affairs and the Local Government Service Commission to comply immediately and accordingly.
