  • South Africa: What you need to know about ‘xenophobic attacks’

The xenophobic attack on Nigerians and other foreigners in South Africa is the major topic of discourse on the lips of everyone due to the recent spate of violent and deadly attacks.

This episode of violence has prompted a flurry of high-level condemnations and criticisms from international bodies and government officials across various countries.

The violence echoes sporadic outbreaks of attacks mainly targeting migrants from other African countries in some of South Africa’s poorest areas.

It should be recalled that in 2008 and 2015, the world was horrified by the savage scenes of xenophobic violence towards African immigrants in South Africa despite the unprecedented support provided by African countries during South Africa’s struggle to end ‘apartheid’.

Prior to 1994, immigrants from different countries faced discrimination and even violence in South Africa.

After majority rule in 1994, contrary to expectations, the incidence of xenophobia increased. Between 2000 and March 2008, at least 67 people died as a result of the incessant xenophobic attacks.

    What is ‘xenophobic violence’

Xenophobic violence refers to any act/acts of violence, perpetrated by local communities or groups against an individual or group of individuals, based on the perception that the victim/victims of this violence do not belong to the perpetrators’ community, society or nationality.

The attacks towards foreign nationals or perceived outsiders are often expressed in the forms of murder, assaults, intimidation and harassment.

Such attacks can include arson attacks on non-nationals and/or their property or the looting and robbery of non-nationals’ shops.

These xenophobic attacks occur across all nine provinces of South Africa, while the Western Cape, Gauteng, KwaZulu-Natal, Free State, Limpopo, Mpumalanga and the Eastern Cape are mostly affected.

    Reason for ‘xenophobic violence’

One of the many reasons advanced by some South Africans for their anger towards black Africans since the xenophobic violence of 2008 and 2015 is that ‘foreigners are taking jobs from indigenes in the country’.

A Pew Research poll conducted in 2018 showed that 62% of South Africans viewed immigrants as a burden on society by taking jobs and social benefits and that 61% of South Africans thought that immigrants were more responsible for crime than other groups.

South Africa’s Legal Obligation to Protect Foreign Nationals

South Africa has ratified numerous international instruments that place an onus on the country to ensure that it provides protection against all forms of discrimination, including xenophobia and xenophobic violence.

In accordance with this legislation, refugees and asylum seekers in South Africa are legally entitled to the same rights as South African citizens, except for the right to vote.

However, with the ongoing situation, the South African Government must send out a ‘strong message’ to its citizens that ‘hostility towards non-nationals should not acceptable under any circumstances’.

  • Tiv/Jukun crisis: Slain Taraba Priest buried amidst tears

The Catholic Community in Taraba state was on Tuesday laid to rest the remains of Rev. Fr. David Tanko, a Catholic priest who was killed in Takum last Wednesday.

Tanko was gruesomely gunned down and set ablaze with his white Toyota Corolla car. He burnt beyond recognition. He was 42 years.

He was reportedly in charge of St. Peter’s Catholic Parish in Amadu, a Tiv settlement in Takum local government area of Taraba state.

He had gone to Takum to see his fellow clergymen and was killed on his way back to Amadu, between Kasuwan Haske and Tor Tser.

His death came as a result of the raging crisis between Jukun and Tiv in southern Taraba.

The crisis is an offshoot of a lingering feud based on a claim by the Jukun that the Tiv are “settlers,” in Taraba State and have no ownership right to the land they occupy and should leave.

Tanko was buried at the Our Lady Queen of Peace Cathedral, Jalingo.

    His co-parishioners were all tears.

The Bishop of Catholic Diocese, Jalingo, Most Rev. Charles Hammawa, who presided over the mass for Tanko’s interment, described the deceased as a lover of peace who paid the supreme price with his life in the most inhuman way.

Hammawa said: “We are only strengthened and comforted by our Christian faith of surrendering all things to God and faith in the resurrection of the dead and life everlasting.

“Fr Tanko was part of the peace efforts initiated by me to help in bringing an end to the crisis between the Tiv and Jukun.

“He was a good man, a good priest, diligent, hard-working, amiable and peaceful.

‘’He had never set out to offend anyone. He was also a prayerful person.

“He is the kind of person Nigeria needs, to be able to come out of the quagmire and mess we are in today.

‘’A person who will serve selflessly without bias, he was.

“I am convinced that Tanko is with God in heaven and interceding for us and for the end of hostilities and unwanted killings in the country.

“May his death end all the ugly and despicable human acts.”

Hammawa charged government at all levels to protect lives and properties in the country.

“Government has the resources, constitutional powers, the institutions and the machinery to stop crises.

“There should be an end to lip service and deceit especially when it concerns security of lives and property,” the bishop said.

Taraba state Chairman of Christian Association of Nigeria, Isaiah Jirapye said the death of the young priest was a great loss to the church.

It was gathered that Tanko’s death sparked a blame-game between Jukun and Tiv on who really killed the peace broker.

His assassination also caused anxiety in the state and sapped hopes for reconciliation between Tiv and Jukun and raised more fears about the deteriorating security in Taraba state.

His death is also a puzzle to the Taraba State Police commissioner, Alkassam Sanusi, who has been given marching orders by the Inspector-General of Police (IGP), Mohammed Adamu, to fish out his killers.

Adamu has directed the DIG in charge of the Force Criminal Investigation Department (FCID) to provide “additional forensic and other investigative assets” to the Taraba State Police Command to aid investigations into the incident.

President Muhammadu Buhari called on the government and people of Benue and Taraba States to “exercise restraint and stop escalation of the feud.”

The President directed Governor Darius Ishaku of Taraba State and Samuel Ortom of Benue, the Tor Tiv and the Aku Uka, religious and community leaders in the two closely tied states and top security operatives, put together by the Secretary to the Government of the Federation (SGF), to meet today, examine and bring to end all issues underlying persistent violent clashes between Jukun and Tiv ethnic groups.”

The meeting of the opinion stakeholders holds at the Yar’Adua Centre, Abuja.

Governor Darius Ishaku, host of the meeting, said the meeting will find a lasting solution to the Tiv/Jukun crisis.

Governor Samuel Ortom of Benue State is among the key stakeholders at the meeting, Ishaku said in a statement.

“Federal and state legislators, speakers of the state houses of assembly (Benue and Taraba) security chiefs, other prominent sons and daughters and representatives of youth groups of Tiv and Jukun in Taraba State will be in attendant,” Ishaku said.

  • Duke to pay N537m debt in 12 hours

A former Cross River State Governor Donald Duke on Monday told a Federal High Court in Lagos that he will pay his N537,334,360.77 debt to Asset Management Corporation of Nigeria (AMCON) in less than 12 hours.

Duke, through his counsel, Mr Edoigiawerie Omoruyi, told Justice Nicholas Oweibo that he had approached AMCON with a promise to liquidate the debt before the end of yesterday (September 2).

He prayed for an adjournment to enable him settle the case out of court. AMCON, on August 8, through its lawyer Juliet Reeds, obtained the court’s order to take interim possession of Duke’s Ikoyi home.

The court also authorised corporation and United Bank for Africa (UBA) to, in the interim, take possession of funds in the accounts of the ex-governor and others in any bank.

The judge gave the order pursuant to AMCON’s and UBA’s August 8 ex parte application.

The applicants listed Stonehedge Investment Limited, Duke and his wife, Owanari Bob-Manuel Duke, as first to third defendants in the suit.

When proceedings resumed yesterday around 2 p.m, Omoruyi said Duke was willing to liquidate the debt before yesterday’s midnight deadline for repayment of the loan.

AMCON’s lawyer Austin Erhabor of Benson Reeds Legal Practitioners, confirmed that Duke approached the corporation with a pledge to pay the debt before midnight.

Erhabor added: “In the spirit of trust and fairness, we will concede to an adjournment to enable us finalise the possible settlement.”

Justice Oweibo upheld Duke’s prayer and adjourned till September 11 for a report of the settlement.

AMCON and UBA, on August 8, prayed the court for “an order of interim attachment, possession and custody of the property being 3, Temple Road, Ikoyi, Lagos”.

They averred that the property was mortgaged by Duke “as collateral in securing the first respondent’s indebtedness to the applicants”.

  • Election tribunal voids Osun PDP Rep Salami’s victory

The Election Petition Tribunal, sitting in Osogbo, the Osun State capital, has nullified the victory of the People’s Democratic Party (PDP) candidate for Ede North, Ede South, Egbedore and Ejigbo Federal Constituency,  Bamidele Salam.

The tribunal, headed by Justice Eyo Ita, ordered a re-run in the seven units of the federal constituency.

The other two members of the tribunal are Justice Kadi Yakub and Justice Ibrahim Mashi.

The candidate of the All Progressives Congress, Adejare Bello, had challenged the victory of Salam in the February 23 National Assembly election.

The tribunal cancelled election results in seven units across four local government areas in the constituency for over-voting.

Reacting to the judgment, Salam said he was not “moved” over the judgment, adding that the mandate that was freely given to him by the people and stamped by God, could not be stolen by any man.

“Our victory at the February 23 House of Representatives poll is sacrosanct and this minor setback will only sweeten the taste of victory in our mouths.

“My legal team will study the details of this judgment and decide the necessary course of action on it,” he said.

Also, the tribunal declared the State Assembly Election for Obokun State Constituency inconclusive.

The panel said the petitioner, Olatunbosun Oyintiloye of the All Progressives Congress (APC), established over-voting in four units. The court, therefore, cancelled elections in those units.

The tribunal declared the results of the poll inconclusive and ordered rerun in the units.

Oyintiloye had challenged the victory of the PDP candidate, Adewumi Adeyemi.

The tribunal on Monday upheld the election of a member of the state House of Assembly, representing Ifelodun State Constituency, Mulikat Abiola, of APC.

The tribunal said the petitioner, Hazzim Abioye of the PDP, failed to prove that the respondent did not resign her appointment in Michael Opara University, Umudike, before contesting for the February poll.

Oyintiloye, in a statement, said the judgment was a confirmation that the election was manipulated to favour the PDP candidate against the popular wish of the people.

According to him, the PDP and its candidate have been exposed and the judiciary has restored their hope through the judgment.

Hailing the tribunal judges for their fearlessness and commitment to the rule of law, he said, again the judiciary has proven its impartiality.

Oyintiloye also lauded his lawyer for being committed to the case and put before the tribunal every legal machinery that eventually led to the victory at the tribunal.

He thanked Governor Gboyega Oyetola and his predecessor, Ogbeni Rauf Aregbesola, for their support to ensure that the stolen mandate of the people of Obokun is restored.

He also lauded leaders of the APC, starting from its Chairman, Prince Gboyega Famodun, and members of party in the state and Obokun constituency for their support and steadfastness during the tribunal proceedings.
